PATENT LAW NO.64/19911
CHAPTER I - GENERAL PROVISIONS
Art. 1 - (1) The rights in inventions shall be recognized and protected on the territory of Romania by the grant of a patent by the State Office for Inventions and Trademarks under the conditions specified by the law.
(2) The rights arising from the European patent shall also be recognized and protected, according to the law.
Art.2 - For the purposes of this Law, the terms and phrases below shall be defined as follows:
a) European patent - the patent granted under the European Patent Convention; b) international application - the application for the protection of an invention, filed
under the Patent Cooperation Treaty; c) industrial property attorney - the person specialized in rendering assistance in
the industrial property field (inventions, trademarks, designs etc.) which legally carries out said activity.
d) European Patent Convention - the Convention on the Grant of European Patents concluded in Munich on 5 October 1973, as amended by the act revising Article 63 EPC of 17 December 1991 and by the decisions of the Administrative Council of EPO of 21 December 1978, 13 December 1994, 20 October 1995, 5 December 1996 and 10 December 1998, as well as by the Revision Act adopted in Munich on 20 November 2000;

e) Paris Convention - Paris Convention for the Protection of Industrial Property of 20 March1883, as revised and amended;
f) description - the presentation of the invention in writing; g) inventor - the person who created the invention; h) professional representative - industrial property attorney who may also
undertake representation in proceedings before the State Office for Inventions and Trademarks;
i) OSIM - the State Office for Inventions and Trademarks; j) predecessor - natural or legal person entitled to the patent before the filing of
the patent application; k) publication - dissemination of information in a manner accessible to the public; l) applicant - the natural or legal person applying for the grant of a patent; m) successor in title - any natural or legal person to whom either the right to the
grant of the patent, or the rights arising from a granted patent, was transferred; n) claim - the part of the patent comprising the subject-matter of the requested
protection and whose contents determine the scope of protection; o) patent owner - the natural or legal person to whom the right conferred by the
patent belongs; p) employer - legal person functioning legally; q) person exploiting the invention - natural or legal person who legally applies the
invention. The person exploiting the invention may be the same person as the patent owner.
Art. 3 - The right to the patent shall belong to the inventor or his successor in title.
Art. 4 - (1) Where the invention has been created jointly by several inventors, each of them shall have the status of joint inventor and the right shall belong to them jointly.
(2) If two or more persons have created the same invention independently of one another, the right to the patent shall belong to the person who filed the patent application having the earliest filing date.
Art. 5 - Foreign natural or legal persons having their domicile or registered office outside the territory of Romania shall benefit by the provisions of this law, according to the international treaties and conventions on inventions to which Romania is a party.
CHAPTER II - PATENTABLE INVENTIONS
Art. 6 - (1) A patent shall be granted for any invention having as a subject-matter a product or a process, in all technological fields, provided that it is new, involves an inventive step and is susceptible of industrial application.
(2) Inventions in the field of biotechnology shall be patentable if they relate to: a) biological material which is isolated from its natural environment or produced
by any technical process, even if it previously occurred in nature; b) plants or animals, if the technical feasibility of the invention is not limited to a
particular plant variety or animal breed; c) a microbiological process or other technical process or a product, other than a
plant variety or animal breed, obtained by means of said process; d) an element isolated from the human body or otherwise produced by a
technical process, including the sequence or partial sequence of a gene, even if the structure of that element is identical to that of a natural element.
Art. 7 - (1) The following in particular shall not be considered as inventions, within the meaning of Art. 6:
a) discoveries, scientific theories and mathematic methods; b) aesthetic creations; c) schemes, rules and methods for performing mental acts, playing games or
doing business, as well as computer programs; d) presentations of information. (2) The provisions of paragraph (1) shall exclude the patentability of the subject-
matters or activities referred to therein, only to the extent to which the patent application or patent relates to such subject-matter or activities as such.
Art. 8 - (1) Patents shall not be granted under this Law in respect of: a) inventions the exploitation of which would be contrary to public order or
morality, including inventions harmful to the health or life of persons, animals or plants, and which are likely to seriously harm the environment, provided that such exception from patentability shall not depend merely on the fact that exploitation is prohibited by a legal provision;
b) plant varieties and animal breeds, as well as the essentially biological processes for the production of plants or animals. This provision shall not apply to microbiological processes or products obtained thereby;
c) the inventions having as a subject-matter the human body in its various stages of formation and development, as well as the mere discovery of one of its elements, including the sequence or partial sequence of a gene;
d) methods of treatment concerning the human or animal body, by surgery or therapy and methods of diagnosis applied to human or animal body.
(2) The provisions of paragraph (1) d) shall not apply to products, in particular substances or compositions to be used in any such method.
Art.9 - (1) An invention shall be considered to be new if it does not form part of the state of the art.
(2) The state of the art shall be held to comprise all knowledge that has been made available to the public by means of a written or oral description, by use, or in any other way, before the date of filing of the patent application.
(3) The state of the art shall be also held to comprise the content of the patent applications filed with OSIM and international applications that have been entered the national phase in Romania or European patent applications designating Romania, as filed, provided that their filing date is prior to the date referred to in paragraph (2) and they were published on or after that date, according to the Law.
(4) The provisions of paragraphs (2) and (3) shall not exclude the patentability of any substance or composition comprised in the state of the art, to be used in a method referred to in Art. 8, paragraph (1) d), provided that its use in any such method is not
comprised in the state of the art. (5) The provisions of paragraphs (2) and (3) shall not exclude the patentability of
any substance or composition referred to in paragraph (4), for any other specific use, in any method referred to in Art. 8, paragraph (1) d), provided that its use in any such method is not comprised in the state of the art.
Art. 10 - (1) For the application of Art. 9, the disclosure of the invention shall not be taken into consideration if it occurred within the six months preceding the filing of the patent application, and if was due to or in consequence of:
a) an evident abuse in relation to the applicant or his legal predecessor; b) the fact that the applicant or his legal predecessor has displayed the invention
at an official or officially recognized international exhibition falling within the terms of the Convention on international exhibitions signed at Paris on 22 November 1928 with the subsequent revisions.
(2) The provisions of paragraph (1) b) shall be applicable only if the applicant states, when filing the patent application, that the invention has been actually displayed and if he files a document supporting his statement within the time limit and under the conditions provided for by the implementing regulations concerning this Law2.
Art. 11 - (1) An invention shall be considered as involving an inventive step if, having regard to the state of the art, it is not obvious to a person skilled in the art.
(2) Patent applications referred to in Art. 9, paragraph (3), although included in the state of the art, are not to be considered in deciding whether there has been an inventive step.
Art. 12 - (1) An invention shall be considered as susceptible of industrial application if it can be made or used in any industry, including agriculture.
(2) The industrial application of a sequence or partial sequence of a gene must be disclosed in the patent application.
CHAPTER III - REGISTRATION, PUBLICATION, AND EXAMINATION OF PATENT APPLICATION, GRANT OF THE PATENT
Art.13 - (1) The patent application drawn up in Romanian must contain: a) the request for the grant of a patent; b) applicant’s identification data; c) a description of the invention; d) one or more claims; e) drawings referred to in the description or the claims. (2) If the applicant is not the inventor, the patent application shall also contain
particulars serving to identify the inventor and shall be accompanied by a document indicating the origin of the right to the grant of the patent.

(3) The document referred to in paragraph (2) shall be filed before a decision is taken in respect of the patent application.
(4) The patent application shall be filed by the person entitled to the grant of the patent, either in person, or in any manner specified by the regulations for implementing this Law3.
(5) In all the proceedings before OSIM, the applicant shall be regarded as the person entitled to the grant of the patent.
(6) The patent application shall be filed with OSIM, at the applicant’s choice, on paper or in any other form and means of transmittal agreed by OSIM and provided in the regulations for implementing this Law.
(7) The patent application shall be accompanied by an abstract which may not be filed later than 2 months before the patent application publication date.
(8) The abstract shall exclusively serve for use as technical information; it may not be taken into account for other purposes, in particular not for the purpose of interpreting the scope of protection nor for the purpose of applying the provisions of Art. 9, paragraph (3).
Art. 14 - (1) The date of filing of the patent application shall be the date on which the following are filed with OSIM:
a) an explicit or implicit indication that the grant of a patent is requested; b) indications serving to identify the applicant or to make possible for OSIM to
contact him; c) a part which should, at first sight, seem to be a description of the invention. (2) Where a part of the description is missing, for the purposes of according the
filing date, said part can be subsequently filed, the filing date being the date on which said part is filed and on which the fee for the registration of that part is paid.
(3) If the missing and subsequently filed part of the description specified under paragraph (1) c) is withdrawn, the filing date shall be the date on which the requirements referred to in paragraph (1) are fulfilled.
(4) The conditions for the subsequent filing and those for the withdrawal of the missing and subsequently filed part pursuant to the paragraph (2) shall be laid down by the implementing regulations in respect of this Law.
(5) Where the patent application does not comprise a part which, at first sight, seems to be a description, for the purpose of according a filing date, reference may be made in the patent application, in the Romanian language, to a prior application filed with any office, which replace the description, while observing the provisions of the regulations for implementing this Law. Otherwise, the application shall not be treated as a patent application.
(6) The patent application shall be registered in the National Register of Patent Applications. The data contained in the Register shall not be available to the public, until their publication in the Official Industrial Property Bulletin, according to the special law.
(7) The claims and drawings relating to the invention may be filed within two months from the date of filing the patent application, provided that the legal fee is paid.

application, the filing date shall be the date resulting from the international treaties and conventions to which Romania is party and that date shall be entered in the National Register of Patent Applications.
Art. 15 - (1) Natural or legal persons may, on justified reasons, file the description, claims and drawings in a foreign language, provided that a certified translation of said documents in the Romanian language is filed with OSIM within two months from the registration of the patent application or from the date of entering the national phase, as the case may be, and the legal fee is paid.
(2) The following shall be considered as complying with the requirements concerning the form and the content of an application under this Law:
a) international applications complying with the requirements concerning the form and the content prescribed by the Patent Cooperation Treaty adopted by the Diplomatic Conference in Washington on 19th of June 1970, ratified by the Decree no. 81 of 2nd of March 1979 of the Council of State with its subsequent modifications;
b) international applications complying with the requirements concerning the form and the content prescribed by the Patent Cooperation Treaty and required by OSIM or EPO, when acting on behalf of OSIM, after their processing or examination has begun.
(3) Any other requirements regarding the form and the content of the application, provided by the regulations for implementing this Law shall be observed.
(4) The filing of the patent application shall produce the effects of a regular national filing provided that the provisions of Art. 13, paragraph (1) or Art. 15, paragraph (1) are fulfilled.
(5) Regular national filing means any filing that is sufficient for establishing the date on which the application was filed, whatever may be the outcome of the application.
Art. 16 - Any person who has duly filed a patent application with OSIM in compliance with Art. 13, paragraph (1) and Art. 15, paragraph (1), or his successor in title, shall, from the date of filing the application, enjoy a right of priority relative to any other subsequent filing in respect of the same invention.
Art. 17 - (1) The invention shall be disclosed in the patent application in a manner sufficiently clear and complete for it to be carried out by a person skilled in the art.
(2) If the invention relates to a biological material or to the use of a biological material which is not available to the public and which cannot be described in the patent application in such a manner as to enable the invention to be carried out by a person skilled in the art, the requirements prescribed in paragraph (1) shall only be considered fulfilled if the applicant produces a document attesting that, prior to the date of filing of the patent application, the biological material was deposited with an international depositary institution.
(3) The claims shall define the matter for which protection is sought and they shall be clear and concise and be supported by the description of the invention.
Art. 18 - (1) A patent application shall relate to one invention only or to a group of
inventions so linked as to form a single inventive concept. (2) Patent applications that fail to meet the condition specified in the first
paragraph may be divided by the applicant, either on his own initiative or at the request of OSIM, until such time as a decision has been made on the said patent applications.
(3) An application resulting from the division shall only claim the elements that do not go beyond the content disclosed in the original application. Applications resulting from the division complying with that requirement shall be considered to have been filed on the filing date of the original application, and each of them shall enjoy the right of priority claimed thereby.
Art. 19 - (1) Any person who has duly filed, in any State party to the Paris Convention for the Protection of Industrial Property or Member State of the World Trade Organization, an application for a patent, utility model or utility certificate, or his successor in title, shall enjoy, for the purpose of filing a subsequent patent application in Romania in respect of the same invention, a right of priority during a period of twelve months of the date of filing of the earlier application.
(2) Every filing that is equivalent to a regular national filing under the national law of any State party to the Paris Convention for the Protection of Industrial Property or Member State of the World Trade Organization where it was made, shall be recognized as giving rise to a right of priority.
(3) A European patent application having Romania as a designated State and for which a filing date was accorded, is equivalent in Romania to a regular national filing, the priority claimed for the European patent application being taken into consideration, where appropriate.
(4) The applicant for a patent application may take advantage of the priority of a previous application for the same invention if he files with the patent application a declaration claiming the priority of the earlier application, justified by priority documents, under the provisions laid down by the regulations for implementing this Law.
(5) Multiple priorities may be claimed and recognized in respect of a patent application, while observing the provisions of paragraph (1), only for those elements of the patent application comprised in the application(s) whose priority is claimed; multiple priorities may also be claimed, where appropriate, for the same claim.
(6) Priority may be recognized only for those elements which are clearly disclosed in the patent application as a whole.
(7) Priority may also be recognized for an application which claims or may have claimed the priority of an earlier application, on a filing date subsequent to the expiry of the priority time limit, but no later than two months from the expiry of said time limit, against payment of the prescribed fee, provided that:
a) an express request to that effect is drawn up under the conditions laid down by the regulations for implementing this Law;
b) the request is drawn up within the prescribed time-limit; c) the request presents the reasons why the priority time limit was not observed; d) OSIM finds that the subsequent patent application was not filed within the
priority time limit, although concerned diligence was exercised, or non-observance of time limit was unintentional.
(8) Where the applicant claims a right of priority belonging to another person, an
authorization shall be filed with OSIM by the assignor, attesting the fact that the applicant is entitled to claim the priority of the earlier application.
(9) The authorization shall be filed within three months, at the most, from the date on which priority was claimed.
Art. 20 - (1) If a subsequent patent application is filed by the applicant of the earlier application or by his successor in title, within a time limit of 12 months from the filing date of a patent application accorded by OSIM, a priority right named internal priority right may be claimed in the subsequent application for the same invention. Where an internal priority right is claimed in a subsequent application, the earlier application whose priority is claimed shall be deemed to be withdrawn, if a decision has not been made thereon.
(2) Internal priority may be claimed on the date of filing the subsequent application or within two months of that date.
(3) The internal priority of an earlier application claimed in a subsequent application shall not be recognized if:
a) at least one of the patent applications enjoyed a priority right under Art. 16 above;
b) internal priorities were claimed in the earlier application, the date of one such priority being earlier than the 12-month time-limit calculated from the filing date of the subsequent application;
c) the internal priority document was not filed within the time limit prescribed by the regulations for implementing this Law.
Art. 21 - (1) Where the applicant has failed to claim priority at the time of filing the patent application, he may claim it, pursuant to the provisions of the regulations for implementing this Law, up to two months following that date, against payment of the prescribed fee.
(2) Priority documents shall be filed within a time limit of 16 months from the date of the earliest priority or 4 months from the date of opening the national phase, as the case may be.
(3) Where the translation of an earlier patent application used as a basis for priority claim is deemed by OSIM to be necessary in the examination procedure, OSIM shall invite the applicant to file a certified translation into Romanian of the earlier application, while observing the provisions of the regulations for implementing this Law.
(4) Non-recognition of priority for failure to comply with the provisions of paragraph (2) or Art. 19 shall be decided by OSIM within 6 months of the filing date or of the date of entering the national phase.
Art. 22 - (1) Patent applications filed by national route, in respect of which the regular national filing has been effected, shall be published as soon as possible after the expire of a period of 18 months from the date of filing or, if priority has been recognized, as from the date of priority, except in the case provided for in Art. 38, paragraph (2).
(2) Patent applications filed under the Patent Cooperation Treaty shall be published as soon as possible after the expiry of a period of 6 months from the opening
of the national phase. (3) At the request of an entitled natural or legal person, publication may be
effected within a shorter time than that prescribed in paragraphs (1) and (2), under the provisions of the regulations for implementing this Law.
(4) Where the decision to grant the patent has been made before the expiry of the time limit prescribed in paragraph (1), the patent application shall be published simultaneously with the publication of the notice mentioning the decision to grant the patent.
(5) Patent applications referred to in Art. 38, paragraph (2), shall be published within 3 months from the date on which the classified status of the information comprised therein has been lifted.
(6) Where, before the expiry of the 18-month period, a decision to refuse has been made or the patent application has been withdrawn or declared as deemed to be withdrawn, the patent application shall not be published.
(7) The publication of the application shall be mentioned in the Official Industrial Property Bulletin and shall be effected under the provisions of the regulations for implementing this Law.
Art. 23 - (1) At the request of the applicant, OSIM shall draw up a search report which may be accompanied, where appropriate, by a written opinion on patentability, and shall publish the search report under the provisions of the regulations for implementing this Law.
(2) If the search report is not published at the same time as the patent application, it shall be published subsequently.
Art. 24 - (1) Examination of the patent application may be requested on the filing date of the patent application or, as the case may be, upon the opening of the national phase or within 30 months from one of these dates.
(2) For the patent applications containing information classified as secret of State, examination may be requested on the filing date of the patent application or within 3 months from the date on which such secrecy has been lifted, but no later than 30 months before the expiry of the patent duration prescribed under Art. 30.
Art. 25 - OSIM shall examine whether: A. the patent application satisfies: a) the provisions of Art. 5; b) the requirements concerning filing, prescribed under Art. 13 - 15; c) the requirements for recognizing the priority, prescribed under Art. 19, 20 and
21; d) the requirement of unity of invention, prescribed under Art. 18, paragraph (1); B. the invention which is the object of the application: a) is disclosed in accordance with Art. 17; b) is not excluded from patentability under Art. 7, paragraph (1), or does not fall
under the provisions of Art. 8; c) satisfies the patentability conditions under Art. 6 and Art. 9 - 12.
Art. 26 - (1) OSIM is authorized to request the applicant to provide explanations and documents considered necessary in connection with the identity of the applicant or the inventor, with the regular national filing effected or in order to meet the conditions of patentability.
(2) In all the procedures related to the patent application or the patent, OSIM may send notifications to the applicant, the patent owner or the interested person, and they may send communications to OSIM, observing the time limits prescribed by the regulations for implementing this Law, time-limits that may be extended by OSIM upon request, against payment of the prescribed fee.
(3) The absence of notifications shall not absolve the applicant, patent owner or interested person from the obligation to meet the requirements of this Law.
(4) The applicant shall file with OSIM all public documents connected to his invention, including copies of patents granted in other States.
(5) At the request of OSIM or on his own initiative, the applicant or his successor in title may, until such time as a decision is made, modify the patent application, provided that the disclosure of the invention does not extend beyond the content of the patent application on the filing date.
Art. 27 - (1) On the basis of the patent application examination report, OSIM shall decide through the specialized Examination Board, to grant a patent or to refuse the patent application.
(2) OSIM shall decide to refuse the patent application in the following cases: a) the patent application does not meet the requirements laid down in Art. 5, Art.
15 paragraphs (1) and (4) and Art. 37 paragraph (2); b) the invention to which the application relates is not patentable within the
meaning of Art. 7 or is covered by the provisions of Art. 8 or does not meet the patentability conditions laid down in Art. 6, 9, 11 and 12;
c) the invention to which the application relates does not meet the requirements of Art. 17;
d) the time-limit for opening the national phase for internationally registered applications has expired;
e) the 12-month time-limit from the date on which applications under the paragraph (4), b) were deemed to be withdrawn has elapsed;
f) refusal of the patent application in accordance with Art. 63, paragraph (2), c) has been requested;
g) the applicant, other than the inventor, has not proved, within the time-limit prescribed in Art. 28, paragraph (2), that he is entitled to the grant of the patent;
h) examination of the patent application in view of the grant of a patent has not been requested within the time-limits prescribed in Art. 24.
(3) OSIM shall take note of the withdrawal of the patent application provided that the applicant expressely requests the withdrawal, in writing.
(4) Patent applications shall be declared as deemed to be withdrawn in the following cases:
a) the inventors were not declared within 18 months from the date on which substantive examination was requested;
b) the applicant did not respond, within the established time-limit, to the
notifications of OSIM to make the form of the description and drawings correspond to the content of admitted claims;
c) the application served as the basis of the priority claim in a subsequent application, filed either by national route or by international route, which has been entered the national phase in Romania;
d) the patent application is in the circumstance provided for in Art. 63, paragraph (2), b).
e) the applicant did not submit the claims within the time-limit prescribed in Art. 14, paragraph (7);
f) one of the legal fees, namely filing fee, fee for the subsequent filing of claims, fee for opening the national phase, publication fee or examination fee, has not been paid in the amount and within the time-limits prescribed by the law and by the regulations for implementing this Law;
g) patent application in respect of which a decision to grant the patent has been taken but the publication fee, printing fee and patent issuance fee have not been paid within the time-limit provided by the law.
(5) All decisions issued by OSIM in respect of patent applications shall be substantiated, registered in the National Register of Patent Applications and shall be communicated to the applicant within 1 month from the date on which a decision was taken. In the same register there shall be also entered the mentions concerning withdrawn patent applications or the mentions concerning the declarations pursuant to which the patent applications are deemed to be withdrawn, which shall be also communicated.
(6) The mention of the decision to grant a patent or to refuse the patent application shall be published in the Official Industrial Property Bulletin within 1 month from the date on which the legal time-limit for appeal has elapsed and under the conditions laid down by the regulations for implementing this Law.
(7) OSIM shall publish the mention of the decision to grant the patent and, simultaneously with the publication, it shall make the patent description and drawings available to the public, provided that publication fee, printing fee and patent issuance fee are paid.
(8) If publication fee, printing fee and patent issuance fee are not paid within the time limits laid down by the law, the patent application shall be deemed to be withdrawn and the patent shall not be deemed to have been granted.
(9) The decision to grant the patent shall only take effect from the date on which the mention thereof is published in the Official Industrial Property Bulletin.
(10) In case of decisions to grant a patent for an invention containing classified information, after such secrecy has been lifted, the provisions of paragraphs (7) and (9) and Art. 22, paragraph (4) shall be applied.
(11) In case of death of the applicant - natural person, or in case of dissolution of the legal person, the examination procedure shall be discontinued until OSIM is notified of the successor in title, under the conditions laid down by the regulations for implementing this Law.
(12) Where judicial procedures have commenced regarding the right to the patent or the right to the grant of the patent, the patenting procedure shall be suspended until the court decision becomes final and irrevocable.
(13) The interested party shall communicate to OSIM the decision provided under paragraph (12).
Art. 28 - (1) OSIM may revoke its decisions ex officio, for failure to comply with the conditions laid down by this Law, until notification.
(2) Where OSIM, on the basis of solid proofs, finds that the applicant, other than the inventor, is not entitled to the grant of the patent, it may proceed to postpone the communication of the decision made, not exceeding a 6-month period since its date; if, within that period of time, the applicant cannot prove that he is entitled to the grant of the patent, the decision to grant the patent shall be revoked according to paragraph (1) and the patent application shall be refused.
Art. 29 - (1) Patents shall be issued by the Director General of OSIM, based on the decision to grant the patent. For European patents, OSIM shall certify the validity of the patents in Romania, according to the law.
(2) The date of issuance of the patent shall be the date on which the mention of the issuance is published in the Official Industrial Property Bulletin.
(3) Patents shall be entered in the National Register of Patents. (4) Where the conditions laid down by the law are met, the European patent shall
be entered in the National Register of Patents.
Art. 30 - (1) Patent duration shall be 20 years as from the date of filing the application.
(2) For European patents, the duration under paragraph (1) shall run from the date on which the regular national filing of the patent application was effected, pursuant to the European Patent Convention.
(3) For patented medicaments or plant protection products, supplementary protection certificate may be granted under the Council Regulation (EEC) no. 1768/92 of 18 June 1992 concerning the creation of a supplementary protection certificate for medicaments and the Regulation (EC) no. 1610/96 of the European Parliament and of the Council of 23 July 1996 concerning the creation of a supplementary protection certificate for plant protection products.
CHAPTER IV - RIGHTS AND OBLIGATIONS
Art. 31 - (1) The patent shall confer on its owner an exclusive right of exploitation throughout its entire duration.
(2) It is prohibited to perform, without the owner’s consent, the following acts: a) manufacturing, using, offering for sale, selling or importing for the purpose of
using, offering for sale or selling, where the subject-matter of the patent is a product; b) using the process and using, offering for sale, selling or importing for those
purposes the product directly obtained by the patented process, where the subject- matter of the patent is a process.
(3) The extent of the protection conferred by the patent or the patent application shall be determined by the content of the claims. At the same time, the invention description and drawings shall be used to interpret the claims.
(4) Throughout the period of time up to grant, the extent of the protection conferred by the patent application shall be determined by the claims published under Art. 22.
(5) The patent, as granted or as amended during the revocation or cancellation in part, shall retroactively determine the protection conferred by the patent application, in so far as such protection is not thereby extended.
(6) To determine the extent of the protection conferred by the patent, due account shall be taken of any element equivalent to an element specified in the claims. Where the subject-matter of the patent is a process, the protection conferred by the patent shall be extended to the product obtained directly by the patented process.
(7) The protection conferred by a patent relating to a biological material having specific characteristics shall be extended to any material derived by reproduction or multiplication from the patented material, in an identical form or differentiated, and having the same characteristics.
(8) The protection conferred by a patent relating to a process allowing the production of a biological material having specific characteristics shall extend to the biological material obtained directly by that process or to any other biological material derived from the biological material directly obtained by that process and to any other material obtained starting from the biological material directly obtained by reproduction or multiplication, in an identical form or differentiated, and having the same characteristics.
(9) The protection conferred by a patent to a product containing genetic information or consisting of genetic information shall be extended to any other material incorporating the product and wherein the genetic information is contained and exercises its function, except for the human body in the various stages of its formation or development.
(10) The protection referred to in paragraphs (7) - (9) shall not extend to the biological material derived by reproduction or multiplication from a biological material sold or offered for sale on the territory of Romania by the patent owner or with his consent, where the reproduction or multiplication necessarily results from the utilization for which the biological material was put on the market, provided that the obtained material has not been used subsequently for other reproductions and multiplications.
Art. 32 - Starting from the date of its publication under Art. 22, paragraphs (1)- (3), the patent application shall provisionally confer on the applicant the protection laid down in Art. 31.
Art. 33 - (1) The following acts shall not constitute infringements of the rights provided in Art. 31 and Art. 32:
a) exploitation of inventions in the construction and the operation of land vehicles or aircrafts and aboard vessels, or in devices used in the operation thereof, that belong to States party to international treaties and conventions concerning inventions to which Romania is also a party, when the vehicles, crafts or vessels enter the territory of Romania, either temporarily or accidentally, provided that such exploitation is exclusively for the needs of the vehicles, crafts or vessels;
b) performing any of the acts referred to in Art. 31, paragraph (2) by a person
who has applied the subject-matter of the patent or that of the patent application, as published, or has taken real and effective steps towards producing or exploiting said subject-matter in good faith on the territory of Romania, independently of the owner of the patent, and before the regular national filing concerning the invention has been effected or before the date on which the recognized priority period starts running; in that case the invention may continue to be exploited by that person to the same extent as on the date of the regular national filing or recognized priority, but the right of use may not be transferred otherwise than with the assets of that person or the part of the said assets assigned to the exploitation of the invention;
c) performing any of the acts referred to in Art. 31, paragraph (2) exclusively privately and for non-commercial purposes; production or use of the invention, as the case may be, exclusively privately and for non-commercial purposes;
d) marketing or offering for sale, within the territory of the European Union, of specimens of the product constituting the subject-matter of the invention that have been previously sold by the patent owner or with his express consent;
e) use of the subject-matter of the patented invention for exclusively non- commercial experimental purposes;
f) exploitation in good faith or taking of real and effective steps towards exploiting the invention by third parties in the interval between the patent owner’s loss of rights and the reinstatement of the patent. In that case, the invention may continue to be exploited by that person to the same extent as on the date of publication of the mention of reestablishment of rights, but the right of use may not be transferred otherwise than with the assets of the person exploiting the invention or the part of said assets assigned to the exploitation of the invention;
g) exploitation by third parties of the invention or part of the invention in respect of which protection has been renounced.
(2) Any person who, in good faith, exploits the invention or has taken real and effective steps to exploit the invention, in so far as the rights conferred by a patent application, or a European patent in its original translation, are not thereby infringed upon, may continue to exploit the invention after the correct translation becomes effective, within his enterprise or for its necessities, without payment and not exceeding the extent existing on the date on which the original translation became effective.
Art. 34 - (1) The inventor shall have the right to the mention of his full name and status in the patent granted, in his employment record4 and in any other documents or publications concerning his invention.
(2) Where the patent owner is not the same person as the inventor, a duplicate patent shall be issued to the latter.
(3) Upon his express request, the inventor’s full name shall not be published; such request shall be subject to payment of the prescribed fee.
Art. 35 - In the event of loss of rights under Art. 40, paragraph (3), the patent

owner may apply, for justified grounds, with OSIM, for reinstatement of the patent, within 6 moths of the date of publication of said loss. Within 60 days from the registration, OSIM shall decide upon the request for reinstatement, subject to payment of the prescribed fee. Mention of the reinstatement of the patent shall be published in the Official Industrial Property Bulletin within 30 days from the date on which the decision becomes final and irrevocable.
Art. 36 - (1) The patent owner may renounce the patent, either wholly or in part, by virtue of a written statement filed with OSIM.
(2) In the case of employees’ inventions, the patent owner shall notify the inventor of his intention to renounce the patent; the patent owner shall transfer the patent rights to the inventor, at the latter’s request, as well as any records relating the patent, provided that the employee grants the employer a non-exclusive licence in respect of the patented invention. The conditions for the grant of the non-exclusive licence shall be set by specific provisions in the employer’s internal regulations. In the absence of these specific provisions, the conditions for the grant of the licence shall be set through the consent of the parties.
(3) Where the patent is the subject of a license agreement, renunciation shall be possible only with the agreement of the licensee.
(4) The invention or part of the invention in respect of which protection has been renounced may be freely exploited by third parties.
(5) The patent owner may renounce a patent granted for inventions containing information classified under Art. 38, paragraph (2), only after such secrecy has been lifted and the mention of the decision to grant the patent and the description, claims and drawings of the patented invention have been published pursuant to Art. 27, paragraph (6).
(6) Renunciation shall be entered by OSIM in the National Register of Patents and shall come into effect on the date of its publication in the Official Industrial Property Bulletin.
Art. 37 - (1) In proceedings before OSIM, the applicant, assignor or owner or any other interested person may be represented by a representative, on the basis of a power of attorney filed with OSIM, under the conditions and within the time limits prescribed by the regulations for implementing this Law.
(2) For the persons mentioned above, not having their domicile or registered office on the territory of Romania, representation by representative shall be compulsory, with the following exceptions, in which one may act in his own name:
a) filing of a patent application for the purpose of being accorded a filing date; b) payment of a fee; c) submitting a copy of a previous application; d) issuance of a notification by OSIM concerning any procedure under a), b) and
c) above. (3) Maintenance fees may be paid by any person. (4) In case of revocation of power of attorney, the representative’s signature does
not have the effect of the signature of the applicant, owner or interested persons who appointed the representative.
Art. 38 - (1) An invention in respect of which a patent application has been filed with OSIM shall not be disclosed without the applicant’s consent, until the publication thereof, and shall have, until publication, the character established by the special law.
(2) Information in the field of national defense and State security included in an invention created on the territory of Romania and being the object of a patent application may be classified as secret of State by the competent authorities; in such case, the applicant shall be informed accordingly by the authority that has classified the information and may, on a contract basis, benefit by a compensation granted by said authority under the conditions prescribed by the regulations for implementing this Law.
(3) The secrecy of information classified as secret of State may be lifted at the discretion of the authority that has classified them.
Art. 39 - (1) Inventions made by Romanian natural persons on the territory of Romania may not be patented abroad until a patent application has been filed with OSIM.
(2) In the case of inventions containing information classified as secret of State, patenting abroad shall be possible only after such secrecy has been lifted, according to Art. 38, paragraph (3).
(3) For the patenting abroad of the inventions referred to in paragraph (1) above, Romanian applicants or patent owners may avail themselves of financial support, pursuant to the law.
(4) With regard to the inventions referred to in paragraph (1), the patenting abroad shall be communicated to OSIM by the Romanian natural persons who have created them or their successors in title.
(5) For the registration of international applications with a view to patenting inventions in other States, OSIM shall act as a receiving Office, pursuant to the Patent Cooperation Treaty.
Art. 40 - (1) The proceedings carried out by OSIM regarding the patent applications and patents referred to in this Law and its implementing regulations shall be subject to the payment of fees, in the amounts and within the time limits laid down by the law.
(2) Throughout the term of validity of the patent, the patent owner shall annually pay patent maintenance fees.
(3) Failure to pay such fees shall cause the patent owner’s loss of his rights arising from the patent. The loss of said rights by the owner shall be entered in the National Register of Patents and published in the Official Industrial Property Bulletin. Maintenance fees may also be paid in advance, under the conditions laid down by the regulations for implementing this Law, for a period not exceeding 4 years.
(4) Fees due to be paid by foreign natural or legal persons shall be paid in convertible currency, into the account of OSIM.
(5) Appeals exclusively relating to the correction of errors or omissions shall not be subject to payment of fees.
Art. 41 - (1) The applicant or the patent owner who, for legitimate grounds, was unable to observe a time limit in the proceedings before OSIM, shall have his rights
reestablished, provided that he submits a substantiated request within two months from the removal of the cause that prevented him from acting, but no later than one year since the expiry of the non-observed time-limit.
(2) The provisions of paragraph (1) shall not apply where the non-compliance with the time limit occurred in the following cases:
a) claiming of priority, in accordance with Art. 19, paragraphs (5) or (6) and Art. 21, paragraph (1);
b) filing of the translation of the description, claims or drawings, according to Art. 15, paragraph (1);
c) payment of the filing fees and the documentary search report fees, according to Art. 40, paragraph (1);
d) filing of an application for revocation, in accordance with Art. 49; e) expiry of the time limit for dividing a patent application, laid down in Art. 18,
paragraph (2); f) expiry of the time limit for filing a new patent application, according to Art. 63,
paragraph (2) b); g) payment of patent maintenance fees. (3) The provisions of paragraph (1) shall neither apply in the cases provided for
in Art. 27, paragraph (2) e) and f), paragraph (4) d) and e) and Art. 48. (4) The request for the reestablishment of rights shall be subject to the payment
of a fee, in the amount laid down by the law for lodging an appeal, except for the case provided in Art. 27, paragraph (4) b), for which no fees are payable.
CHAPTER V - TRANSFER OF RIGHTS
Art. 42 - (1) The right to the patent, the right to the grant of a patent and the rights deriving from a patent shall be transferable, either wholly or in part.
(2) Transfers may be effected by assignment, by the grant of exclusive or non- exclusive licenses or by legal or testamentary succession.
(3) Transfers shall produce effects in respect of third parties only as from the date of publication in the Official Industrial Property Bulletin of the mention of the transfer registered with OSIM.
Art. 43 - (1) Upon request by any interested person, the Court of Bucharest may grant a compulsory license after 4 years have elapsed from the patent application filing date or after 3 years have elapsed from the grant of the patent, whichever period expires later.
(2) The provisions of paragraph (1) shall only apply where the invention has not been exploited or has been insufficiently exploited on the territory of Romania, and the patent owner cannot justify his inaction, and where no agreement has been reached with him regarding the conditions and commercial methods for applying the invention.
(3) The Court of Bucharest shall authorize the compulsory license, if it considers, based on given circumstances, that, in spite of all efforts made by the interested person, no agreement could be reached within a reasonable time period.
(4) Besides the cases referred to in paragraph (2), a compulsory license may be authorized by the Court of Bucharest:
a) in national emergency cases; b) in other cases of extreme emergency; c) in cases of public use for non-commercial purposes. (5) The grant of the compulsory license, for one of the reasons provided under
paragraph (4), shall not require the fulfilment of the conditions mentioned under paragraph (2). Nevertheless, the licensee shall inform the applicant or patent owner about the authorization given by the Court, within the shortest delay.
(6) In cases of public use for non-commercial purposes, the Government or third parties authorized by the Government, if they know or have demonstrable reasons to know that a valid patent is or will be used by the Government or the third parties, shall inform the patent owner accordingly, within a reasonable time.
(7) In cases where a patent cannot be exploited without infringing the rights conferred by other patent granted for an application having a prior regular national filing date, a compulsory license for exploiting the subsequent patent may only be authorized if the following additional conditions are cumulatively fulfilled:
a) the invention claimed in the subsequent patent involves an important technical advance of considerable economic significance as compared with the invention in the earlier patent;
b) the owner of the earlier patent is entitled to a cross-license on reasonable terms for using the invention claimed in the subsequent patent;
c) the use authorized in respect of the earlier patent shall be non-transferable, except for the transfer with the subsequent patent.
Art. 44 - (1) Compulsory licenses shall be non-exclusive and shall be granted by the Court of Bucharest, under specific conditions regarding their extent and duration, as well as the amount of royalties to which the right holder is entitled, established in accordance with the commercial value of the licenses granted.
(2) Beneficiaries of the compulsory license can also be the Government or third parties authorized by the Government.
(3) Compulsory licenses shall be authorized mainly for supplying the market. (4) The extent and duration of compulsory licenses shall be limited to the
purposes for which they have been authorized. In case of the inventions in the semiconductor technology field, the license shall be granted only for public non- commercial purposes or to remedy a practice declared as anti-competitive, as a result of a judiciary or administrative procedure.
(5) When the owner of a plant variety patent cannot exploit the patent without infringing a prior patent, he may request a compulsory license for the invention protected by said patent.
(6) When the owner of a patent relating to a biotechnological invention cannot exploit the patent without infringing a prior plant variety patent, he may request a compulsory license for the exploitation of the plant variety protected by said patent.
(7) Where a compulsory license is authorized for remedying an anti-competitive practice, the provisions of Art. 43, paragraphs (3) and (4) and Art. 44, paragraph (3) shall not be applicable.
Art. 45 - The compulsory license shall not be transferred otherwise than with the
part of the enterprise or the stock of goods benefitting by said use.
Art. 46 - (1) Upon the justified request presented by the interested person, the Court of Bucharest may withdraw the compulsory license, when the circumstances leading to the grant of the license ceased to exist, provided that the legitimate interests of the licensee should be protected adequately. The license shall not be withdrawn if the circumstances which determined the grant of the license are likely to occur again.
(2) The decisions of the Court of Bucharest concerning the authorization for using a compulsory license, as well as those concerning the remuneration prescribed as against the use of the license, may be appealed against only with the Court of Appeal of Bucharest.
Art. 47 - The final and irrevocable Court decisions concerning the grant or the withdrawal of the compulsory license, as the case may be, shall be communicated by the interested person to OSIM, which shall enter said decisions in the National Register of Patent Applications or in the National Register of Patents, as the case may be, and shall publish the mention of such decisions in the Official Industrial Property Bulletin within one month from communication.
CHAPTER VI - DEFENSE OF RIGHTS IN INVENTIONS
Art. 48 - (1) Any decision made by the Examination Board may be appealed against with OSIM within 3 months from communication.
(2) The object of the appeal may be a limitation of the patent, under the conditions laid down by the regulations for implementing this Law.
Art. 49 - (1) Any interested person is entitled to apply with OSIM, in writing, on valid grounds, for the revocation of the patent, within 6 months of the publication of the mention of granting the patent, provided that:
a) the subject-matter of the patent is not patentable, under Art. 6 - 9, 11 and 12; b) the subject-matter of the patent does not disclose the invention in a manner
sufficiently clear and complete for it to be carried out by a person skilled in the art; c) the subject-matter of the patent exceeds the content of the patent application,
as filed. (2) Where the grounds for revocation only relate to a part of the patent, the
patent shall be revoked in part.
Art. 50 - (1) The appeal or the request for revocation, as the case may be, shall be settled within 3 months of registration thereof with OSIM, by a Board of Appeal within the Appeal Department of OSIM5.
(2) The attributions of the Board of Appeal, as well as the procedure for settling

the appeals and requests for revocation shall be laid down in the regulations for implementing this Law.
Art. 51 - (1) Patents granted by OSIM, as well as European patents with effects in Romania, may be cancelled upon request, provided that it is ascertained that:
a) the subject-matter of the patent is not patentable, under Art. 6 - 9, 11 and 12; b) the subject-matter of the patent does not disclose the invention in a manner
sufficiently clear and complete for it to be carried out by a person skilled in the art; c) the subject-matter of the patent exceeds the content of the patent application,
as filed; d) the protection conferred by the patent has been extended; e) the patent owner is not the person entitled to the grant of the patent. (2) Where the grounds for cancellation only relate to a part of the patent, the
patent shall be cancelled in part. (3) The cancellation of the patent shall have retroactive effects, starting from the
filing date.
Art. 52 - (1) The cancellation of the patent may be requested after the time limit provided under Art. 49 for the request for revocation has elapsed, except for the cases provided under Art. 51, paragraph (1), d) and e) and throughout the entire duration of the patent, and the requests shall be ruled upon by the Court of Bucharest. The decisions of the Court of Bucharest may be appealed against before the Court of Appeal of Bucharest within 30 days from communication.
(2) The decisions of the Court of Appeal of Bucharest may be appealed against before the High Court of Cassation and Justice within 30 days from communication.
(3) The final and irrevocable decisions to cancel the patent shall be registered with OSIM by the interested person.
(4) Mention of the decision to cancel the patent shall be published in the Official Industrial Property Bulletin within 60 days of the registration of the decision with OSIM.
Art. 53 - (1) Failure to meet one or more of the formal requirements concerning the patent application shall only constitute grounds for revocation or cancellation of the patent, either wholly or in part, where said failure resulted from fraudulent intentions.
(2) A patent shall not be revoked or cancelled, either wholly or in part, without giving the owner the possibility to present observations concerning the revocation or cancellation and to make, in a reasonable period of time, amendments or corrections allowed by the Law and the corresponding implementing regulations.
Art. 54 - (1) The substantiated decision of the Board of Appeal shall be communicated to the parties within 30 days from pronouncement and may be appealed against before the Court of Bucharest within 30 days from communication.
(2) The decisions of the Court of Bucharest may only be appealed against before the Court of Appeal of Bucharest.
(3) The enacting terms of the decision to grant the patent made by the Board of Appeal, as well as those of the final and irrevocable decision made by a judicial authority, shall be entered into the National Registers and shall be published in the
Official Industrial Property Bulletin within 60 days from the date of their registration with OSIM by the interested person.
(4) OSIM shall enter the modifications pursuant to final and irrevocable Court decisions into the National Registers and shall publish them in the Official Industrial Property Bulletin within 60 days from the date of their registration with OSIM by the interested person.
Art. 55 - (1) The unlawfull assumption, in any way, of the status of inventor shall constitute offence and shall be punished with imprisonment from 3 months to 2 years or fine.
(2) Reconciliation of parties shall remove criminal liability.
Art. 56 - (1) Violation of Art. 31, paragraph (2) shall constitute infringement and shall be punished with imprisonment from 3 months to 2 years or fine.
(2) Reconciliation of parties shall remove criminal liability. (3) For prejudice caused to him, the patent owner or licensee shall be entitled to
damages, as provided for by civil law, and may request to the competent law court to order the infringing products to be confiscated or destroyed, as the case may be. The same provisions shall be applied to materials and equipments that directly served to the perpetration of the infringement offence.
(4) Infringement of the rights referred to in Art. 31, paragraph (1), by third parties, after the publication of the patent application, shall make the infringers liable for damages under civil law, and the entitlement to the payment of damages shall be enforceable after the grant of the patent.
(5) Notwithstanding the provisions of Art. 31, paragraph (1), the acts referred to in Art 31, paragraph (2) performed by third parties before the date of publication of the patent application or before the date of the summons made by the applicant and accompanied by a certified copy of the patent application, shall not be deemed to infringe the rights conferred by the patent.
Art. 57 - Where the acts referred to in Art. 31, paragraph (2) continue to be done after summoning, the law court may, upon request, order such acts be discontinued until OSIM makes a decision on the patent application. Said measure may be ordered subject to payment by the applicant of a security fixed by the law court.
Art. 58 - (1) In case of infringement of the right of a process patent owner, referred to in Art. 31, paragraph (2) b), the burden of proof in establishing the fact that the process used to obtain an identical product is different from the patented process shall be incumbent upon the alleged infringer of said right.
(2) In applying the provisions of paragraph (1), any identical product made without the consent of the patent owner shall, in the absence of the proof to the contrary, be deemed to have been obtained by the patented process in at least one of the following circumstances:
a) if the product obtained by the patented process is new; b) if there is a substantial likelihood that the identical product was made by that
process and the patent owner has been unable, through reasonable efforts, to
determine the process actually used. (3) Upon presentation of the proof to the contrary by the patent owner, the
legitimate interests related to the manufacturing and trade secrets of the alleged infringer shall be taken into account.
Art. 59 - (1) Disclosure, by the staff of OSIM, as well as by persons doing work in connection with inventions, of the information contained in patent applications, prior to the publication thereof, shall constitute an offence and shall be punished with imprisonment from 3 months to 3 years or fine.
(2) OSIM shall be answerable to the inventor for prejudice caused as a result of the offence referred to in paragraph (1) above.
Art. 60 - (1) Litigations concerning the status of inventor, patent owner or other rights arising from the patent, including the economic rights of the inventor under assignment or license contracts shall fall within the jurisdiction of the law courts.
(2) The interested person shall communicate the court decision to OSIM within 30 days from the date on which the decision became final and irrevocable, in order to be entered in the National Register of Patent Applications or in the National Register of Patents and published in the Official Industrial Property Bulletin. In the absence of the publication in the Official Industrial Property Bulletin, the decision shall not be opposable to third parties.
Art. 61 - (1) If the patent owner or the owners of an industrial property right protected by a patent granted by the Romanian State, owned within the period 6 March 1945 - 22 December 1989, and their successors in title, whose patrimonial rights conferred by the patent have been infringed by the abusive exploitation of the invention in the absence of the owner’s consent or by any other right-infringing acts, or any other person exerting the industrial property right with the owner’s consent provides credible evidence that his industrial property right protected by a patent is subject to a current or imminent illegal act that is likely to cause him irreparable prejudice, may request the law court to order provisional measures.
(2) The law court may order, in particular: a) the infringement to be prohibited or provisionally ceased; b) the appropriate measures to be taken for preserving the evidence. Provisions
of the Government Emergency Ordinance no 100/2005 on the enforcement of industrial property rights, approved with amendments through the Law 280/2005, with the subsequent amendments and completions shall be applicable.
(3) Applicable procedural provisions are comprised in the Civil Procedure Code relating to provisional measures in the field of intellectual property rights.
(4) Provisional measures may also be ordered against an intermediary whose services are used by a third party to infringe a right protected by virtue of this Law.
Art. 62 – (1) Customs authority may order, either ex officio or upon request by the patent owner, customs clearance operations to be suspended for the import or
export of goods provided under Art. 56, paragraph (1), or to place such goods under a suspensive customs status.
(2) Customs competence concerning the enforcement of patent rights at the borders shall belong to the National Agency for Fiscal Administration6, according to Law no. 344/2005 concerning certain measures for ensuring the enforcement of intellectual property rights within customs operations.
Art. 63 – (1) Where a court decision has established that a person, other than the one mentioned in the patent, is entitled to the grant of the patent, OSIM shall issue the patent to the entitled person and shall publish the change of ownership.
(2) If, before the grant of the patent by OSIM, a court decision has established that the right to the patent belongs to a person, other than the applicant, within a time limit of 3 months from the date on which the court decision became final and irrevocable and under the conditions laid down by the regulations for implementing this law, the person entitled to said right may:
a) continue, instead of the applicant, the procedure concerning the filed patent application as if it were his own application;
b) file a new patent application for the same invention. For the elements which do not extend the content of the original application filed in accordance with Art. 18, the original application shall be declared by OSIM as deemed to be withdrawn starting on the date of filing the new application;
c) request the application to be refused.
Art. 64 – (1) Upon request by the law court, OSIM shall submit the acts, documents and information necessary for judging the cause entrusted to the law court, those documents being finally returned to it. Summoning to the court shall only be made for this purpose.
(2) Petitions to the law court in the industrial property field shall be exempt from judicial fees.
CHAPTER VII – DUTIES OF THE STATE OFFICE FOR INVENTIONS AND TRADEMARKS
Art. 65 – OSIM is a specialized body of the central public administration subordinated to the Government7, with sole authority on the territory of Romania in the

Art. 66 – In the field of inventions, OSIM shall have the following duties: a) to coordinate the industrial property policy in Romania; b) to register, publish and examine patent applications with a view to granting
and issuing patents; c) to be the depositary of the National Register of Patent Applications and the
National Register of Patents in which all particulars of patent applications and patents are recorded;
d) to act as a receiving office for patent applications internationally filed by Romanian applicants, according to the provisions of the Patent Cooperation Treaty;
e) to administer, maintain and develop, by international exchange, the national collection of descriptions of inventions and to create the computerized data base in the field of inventions, on any kind of information support;
f) to provide, upon request, mediation and technical information services based on descriptions of Romanian and foreign inventions and official industrial property publications, as well as services of storing, under non-public status, documents containing non-patentable solutions like those referred to under Art. 7, paragraph (1);
g) to attest and authorize industrial property attorneys, while keeping records thereof in the national register it maintains and periodically publishing data from said register;
h) to conduct relations with similar governmental and intergovernmental organizations and with specialized international organizations to which the Romanian State is party;
i) to organize training and professional improvement courses for specialists in the field;
j) to edit and periodically publish in the Official Industrial Property Bulletin data concerning patent applications and patents.
CHAPTER VIII – TRANSITIONAL AND FINAL PROVISIONS
the organization and functioning of the Ministry of Economy, published in the Official Gazette of Romania, Part I, no 102 of 20 February 2013 as rectified, with the subsequent amendments and completions, the State Office for Inventions and Trademarks passes from the Government subordination and coordination of the Prime Minister to the Ministry of Economy subordination.
Art. 67 - Patent applications filed with OSIM under Law no. 62/19748 in respect of which no decision to grant the patent or to refuse the patent application has been taken, shall be ruled according to the provisions of this Law.
Art. 68 – (1) Patents and improvement patents as well, granted prior to the entry into force of this Law and valid on the territory of Romania, shall have the duration provided for in Art. 30.
(2) Throughout the entire duration of the improvement patents, exploitation of the invention shall be made in accordance with the provisions of Art. 43, paragraph (7).
(3) Economic rights accruing to inventors for patented inventions that have been exploited and which rights have been partially settled or not settled prior to the entry into force of this Law shall be negotiated between the inventor and the entity that has exploited said invention. In such cases the negotiation shall begin at the highest amount of compensation that the inventor could claim under the law applicable on the date of filing the patent application. In the absence of agreement between the parties, the economic rights shall be determined according to the provisions of Art. 60.
(4) The right in the patent shall be transferred to the inventor by operation of the law where, on the date of entry into force of this law, the enterprise that has become the owner of the invention by legal assignment, as provided in Art. 14 of the Law no. 62/19749, has not exploited the invention or has not taken the necessary steps for its exploitation.
Art. 69 – Patents in force represent intangible assets and shall be registered in the patent owner’s patrimony, where the owner is a legal person.

Chapitre premier Dispositions générales
1. Les droits sur les inventions sont reconnus et protégés sur le territoire de la Roumanie par la délivrance de titres de protection par l’Office d’Etat pour les inventions et les marques, dans les conditions prévues par la présente loi.
2. Le titre de protection d’une invention est le brevet, qui confère à son titulaire un droit exclusif d’exploitation pour la durée de sa validité.
3. Le droit au brevet appartient à l’inventeur ou à son ayant cause.
4. Si plusieurs personnes ont créé ensemble une invention, chacune d’entre elles a la qualité d’inventeur et le droit au brevet leur appartient en commun. Si plusieurs personnes ont créé la même invention indépendamment les unes des autres, le droit au brevet appartient à celle d’entre elles qui a la première déposé la demande de brevet auprès de l’Office d’Etat pour les inventions et les marques ou, si une priorité a été reconnue, à celle d’entre elles dont la demande de brevet a la date de priorité la plus ancienne, à condition que cette demande n’ait pas été rejetée, retirée ou abandonnée.
5. Si l’inventeur est un salarié, le droit au brevet appartient, en l’absence de stipulation contractuelle plus favorable au salarié:
a) à l’employeur, pour les inventions faites par le salarié dans l’exécution d’un contrat de travail lui confiant explicitement une mission inventive qui correspond à ses fonctions effectives; l’inventeur peut recevoir une rémunération supplémentaire déterminée par contrat;
b) au salarié, pour les inventions qu’il a faites soit dans le cours de l’exécution de ses fonctions, soit dans le domaine d’activité de l’entreprise, grâce à la connaissance ou l’utilisation de techniques ou moyens

spécifiques à l’entreprise ou de données disponibles dans l’entreprise, soit encore avec l’aide matérielle de l’employeur, en l’absence de stipulations contractuelles contraires.
Lorsque l’invention résulte d’un contrat de recherche, le droit au brevet appartient, en l’absence de clause contraire, à l’employeur qui a commandé la recherche, l’inventeur ayant droit à une rémunération supplémentaire, déterminée par acte additionnel au contrat.
Dans les cas prévus aux sous-alinéas a) et b) du premier alinéa et au deuxième alinéa, l’inventeur et l’employeur doivent s’informer mutuellement, par écrit, de la création et du stade de réalisation de l’invention et s’abstenir de toute divulgation.
La violation de l’obligation d’informer engage la responsabilité de son auteur. Si, dans le cas prévu au sous-alinéa a) du premier alinéa et au deuxième alinéa, la demande de brevet
n’a pas été déposée auprès de l’Office d’Etat pour les inventions et les marques dans un délai de 60 jours à compter de la date à laquelle le salarié a communiqué par écrit à l’employeur le libellé de la description de l’invention, le droit de déposer la demande de brevet et le droit au brevet appartiennent, sauf convention contraire entre les parties, au salarié dans les conditions prévues au sous-alinéa b) du premier alinéa.
Dans le cas prévu au sous-alinéa b) du premier alinéa, l’employeur a, pour conclure un contrat concernant l’invention de son salarié, un droit de préférence qu’il doit exercer dans un délai de trois mois à compter de la date de l’offre expresse du salarié; à défaut d’accord sur le prix du contrat, ce prix est fixé par le tribunal.
6. Les personnes physiques ou morales étrangères ayant leur domicile ou leur siège en dehors du territoire de la Roumanie bénéficient aussi des dispositions de la présente loi dans les conditions prévues par les conventions internationales relatives aux inventions auxquelles la Roumanie est partie ou sur la base de la réciprocité.
Chapitre II Inventions brevetables
7. Une invention est brevetable si elle est nouvelle, si elle résulte d’une activité inventive et si elle est susceptible d’application industrielle.
L’invention brevetable peut avoir pour objet un produit, un procédé ou une méthode. L’invention ayant pour objet une nouvelle variété végétale, un hybride ou une nouvelle race animale
est considérée comme brevetable si la variété, l’hybride ou la race est nouveau, distinct, homogène et stable.
8. Une invention est nouvelle si elle n’est pas comprise dans l’état de la technique. L’état de la technique comprend toutes les connaissances devenues accessibles au public avant la date de l’enregistrement de la demande de brevet d’invention ou de la priorité reconnue.
Une divulgation de l’invention n’est pas prise en considération si elle est le fait de l’inventeur ou de son ayant cause et si elle a eu lieu dans les 12 mois précédant la date d’enregistrement de la demande de brevet d’invention ou la date de la priorité reconnue.
9. Une invention est considérée comme impliquant une activité inventive si, pour un homme du métier, elle ne découle pas d’une manière évidente de l’état de la technique.
10. Une invention est considérée comme susceptible d’application industrielle si son objet peut être utilisé au moins dans un domaine d’activité de l’industrie, dans l’agriculture ou dans tout autre domaine et peut être reproduit en conservant les mêmes caractéristiques autant de fois que nécessaire.
11. Les variétés végétales, les hybrides ou les races animales constituant l’objet d’une invention doivent maintenir l’homogénéité et la stabilité de leurs caractères après des reproductions répétées ou à la fin de chaque cycle de reproduction, et ils ne doivent pas avoir été auparavant commercialisés ou offerts à la vente.
12. Les inventions contraires à l’ordre public et aux bonnes mœurs ne sont pas brevetables.
13. Ne sont pas considérées comme des inventions brevetables au sens de l’article 7: les idées, les découvertes, les théories scientifiques, les méthodes mathématiques, les programmes d’ordinateur en tant que tels, les solutions de caractère économique ou d’organisation, les diagrammes, les méthodes d’enseignement et d’instruction, les règles de jeu, les plans d’urbanisation, les plans et méthodes de systématisation, les phénomènes physiques en tant que tels, les recettes de cuisine, les créations de caractère esthétique.
Chapitre III Enregistrement, publication et examen
de la demande de brevet; délivrance du brevet
14. Le dépôt, auprès de l’Office d’Etat pour les inventions et les marques, de la demande de brevet comportant l’indication de l’identité du déposant, accompagnée de la description de l’invention, des revendications et, le cas échéant, de dessins explicatifs, tous rédigés en roumain, constitue le dépôt national régulier.
La demande de brevet doit comporter des indications permettant d’identifier l’inventeur; à défaut, le brevet demandé n’est pas délivré.
La demande de brevet doit être déposée par la personne qui a droit au brevet conformément à l’article 3, au premier alinéa de l’article 4 et à l’article 5, personnellement ou par l’intermédiaire d’un mandataire autorisé ayant son domicile ou son siège en Roumanie.
15. L’Office d’Etat pour les inventions et les marques enregistre la demande de brevet si au moins les documents suivants ont été déposés:
a) une demande contenant une requête explicite en délivrance d’un brevet et les indications relatives à l’identité du déposant;
b) la description de l’invention. Les revendications et les dessins explicatifs de l’invention peuvent être déposés dans un délai de deux
mois à compter de la date d’enregistrement de la demande de brevet. La demande de brevet est inscrite au Registre national des demandes de brevet, qui a un caractère
confidentiel.
16. La date du dépôt national régulier est celle à laquelle ont été déposés tous les documents prévus au premier alinéa de l’article 14, ou la date découlant de traités ou conventions auxquels la Roumanie est partie.
Cette date est reconnue aussi comme date du dépôt national régulier lorsque, pour de justes motifs, des personnes physiques ou morales étrangères ont déposé la description, les revendications et les dessins dans une langue étrangère, à condition que, dans un délai de deux mois à compter de la date d’enregistrement de la demande, elles déposent auprès de l’Office d’Etat pour les inventions et les marques une traduction exacte de ces documents en roumain.
17. Le dépôt national régulier assure à l’inventeur un droit de priorité à compter de la date de ce dépôt ou de la date de priorité revendiquée et reconnue par rapport à tout autre dépôt concernant la même invention effectué à une date ultérieure ou dont la date de priorité reconnue est ultérieure.
18. L’invention doit être exposée dans la description, les revendications et les dessins d’une manière suffisamment claire, complète et exacte du point de vue scientifique et technique pour permettre à un homme du métier de l’exécuter sans déployer d’activité inventive.
Si l’invention concerne du matériel biologique reproductible qui ne peut pas être décrit de telle sorte que l’invention puisse être reproduite par un homme du métier et auquel le public n’a pas accès, la description de l’invention doit être complétée par un document attestant le dépôt du matériel auprès d’une institution de dépôt désignée par le gouvernement ou ayant la qualité d’autorité de dépôt internationale. Ce dépôt doit être effectué au plus tard à la date d’enregistrement de la demande de brevet.
19. La demande de brevet ne peut concerner qu’une invention ou une pluralité d’inventions liées entre elles de telle sorte qu’elles ne forment qu’un seul concept inventif général.
Toute demande de brevet qui ne remplit pas la condition prévue au premier alinéa peut être divisée par l’inventeur ou son ayant cause de sa propre initiative, ou sur l’invitation de l’Office d’Etat pour les inventions et les marques, tant qu’une décision n’a pas été rendue sur la demande de brevet.
20. La demande de brevet peut contenir une ou plusieurs revendications de priorité fondées sur une ou plusieurs demandes antérieures ayant valeur de dépôt national régulier, conformément aux conventions auxquelles la Roumanie est partie.
Les personnes physiques ou morales étrangères d’Etats parties aux conventions auxquelles la Roumanie est aussi partie, ainsi que les ressortissants de ces Etats ou leurs ayants cause, bénéficient d’un droit de priorité à compter de la date du premier dépôt s’ils déposent une demande de brevet pour la même invention dans un délai de 12 mois à compter de cette date.
Des priorités multiples peuvent être revendiquées dans une demande de brevet à condition que le critère de l’unité de l’invention prévu à l’article 19 et le délai de priorité prévu au deuxième alinéa soient observés.
21. La demande de brevet peut aussi revendiquer la priorité d’une invention sur la base d’un dépôt effectué à la suite de la présentation d’un produit incorporant l’invention dans une exposition internationale organisée sur le territoire de la Roumanie ou d’un Etat partie aux conventions auxquelles la Roumanie est aussi partie, si la demande de brevet est déposée dans un délai de six mois à compter de la date de présentation du produit dans l’exposition. Ce délai de six mois ne prolonge pas le délai de priorité prévu au deuxième alinéa de l’article 20.
22. Les priorités visées aux articles 20 et 21 doivent être revendiquées lors du dépôt de la demande de brevet et attestées par des documents de priorité.
Le déposant qui a omis de revendiquer le droit de priorité dans la demande de brevet peut le faire dans un délai de deux mois à compter de la date d’enregistrement de la demande de brevet.
Les documents de priorité doivent être déposés dans un délai de trois mois à compter de la date du dépôt national régulier.
Lorsque les délais prévus aux deuxième et troisième alinéas n’ont pas été observés, la priorité revendiquée n’est pas reconnue.
23. Les demandes de brevet qui remplissent les conditions prévues aux articles 14, 15 et 16 sont publiées immédiatement après l’expiration d’un délai de 18 mois à compter de la date du dépôt national régulier ou de la date de priorité revendiquée et reconnue, à l’exception des demandes mentionnées aux deuxième et troisième alinéas de l’article 44 et de celles qui, au cours de ce délai, ont fait l’objet d’une décision de délivrance ou de rejet, ou qui ont été retirées, en vertu des articles 7 à 11 ou des articles 12 ou 13.
24. Si une personne physique ou morale qualifiée le demande, la publication peut être effectuée dans un délai plus bref que celui prévu à l’article 23.
25. La publication des demandes de brevet peut être accompagnée de la publication d’un rapport de recherche.
Si le rapport de recherche n’a pas été publié en même temps que la demande, il l’est ultérieurement.
26. L’examen en vue de la délivrance du brevet peut être demandé à la date du dépôt de la demande de brevet ou dans un délai de 30 mois à compter de cette date.
Les demandes de brevet pour lesquelles un examen en vue de la délivrance du brevet n’a pas été demandé dans le délai prévu au premier alinéa sont considérées comme abandonnées et sont rejetées.
27. L’examen des demandes de brevet porte sur: a) l’observation des conditions prévues aux articles 14, 15, 16 et 18; b) les conditions prévues aux articles 12 et 13; c) la priorité revendiquée conformément aux articles 20, 21 et 22; d) l’unité de l’invention prévue à l’article 19; e) les critères prévus aux articles 7 à 11.
28. L’Office d’Etat pour les inventions et les marques peut inviter le déposant ou son ayant cause à fournir les explications et les documents qu’il estime nécessaires au sujet du dépôt régulier effectué, ou au sujet de l’observation des conditions de brevetabilité.
Le déposant doit présenter à l’Office d’Etat pour les inventions et les marques tous documents publics se rapportant à son invention, y compris les copies des brevets délivrés à l’étranger.
Sur l’invitation de l’Office d’Etat pour les inventions et les marques ou de sa propre initiative, le déposant ou son ayant cause peut modifier les revendications, les dessins ou la description tant qu’une décision n’a pas été rendue, sans toutefois aller audelà de la divulgation de l’invention faite à la date du dépôt de la demande de brevet.
29. La décision de délivrer le brevet ou de rejeter la demande de brevet est rendue par une commission d’examen de l’Office d’Etat pour les inventions et les marques conformément aux articles 7 à 11 et 12 et 13 de la présente loi, sur la base du rapport d’examen de la demande de brevet, dans un délai de 18 mois à compter de la date à laquelle l’examen a été demandé.
Les décisions de délivrer des brevets rendues par l’Office d’Etat pour les inventions et les marques sont publiées dans un délai de 30 jours et les descriptions, revendications et dessins des inventions brevetées sont publiés dans un délai de trois mois.
L’Office d’Etat pour les inventions et les marques rend une décision de rejet de la demande de brevet à l’expiration des délais prévus aux articles 26 et 47 en cas d’abandon ou de défaut de paiement des taxes d’enregistrement, de publication ou d’examen, et il prend acte du retrait de la demande de brevet si celui-ci a été communiqué par écrit par la personne habilitée à le faire.
Toutes les décisions rendues par l’Office d’Etat pour les inventions et les marques doivent être motivées et sont inscrites au Registre national des demandes de brevet.
30. L’Office d’Etat pour les inventions et les marques peut révoquer d’office une décision pour inobservation des conditions prévues par la présente loi jusqu’à la communication de cette décision.
31. Le brevet est délivré par le directeur général de l’Office d’Etat pour les inventions et les marques, conformément à la décision de délivrance.
Les brevets sont inscrits au Registre national des brevets.
32. La durée de validité du brevet est de 20 ans à compter de la date du dépôt national régulier.
33. Si l’invention consiste dans le perfectionnement d’une autre invention brevetée et ne peut pas être appliquée sans l’invention brevetée antérieurement, sa durée de validité est limitée à la durée de validité du brevet délivré pour l’invention qui a fait l’objet du perfectionnement, mais ne peut être inférieure à 10 ans.
Chapitre IV Droits et obligations
34. Le brevet confère à son titulaire le droit d’interdire aux tiers d’accomplir les actes suivants sans l’autorisation de celui-ci:
a) pour les produits: la fabrication, la commercialisation, l’offre à la vente, l’utilisation, l’importation ou le stockage en vue de la commercialisation, de l’offre à la vente ou de l’utilisation;
b) pour les procédés ou les méthodes: leur utilisation. L’étendue de la protection conférée par le brevet est déterminée par la teneur des revendications, qui
doivent être interprétées à l’aide de la description et des dessins de l’invention.
35. Lorsqu’une demande de brevet est publiée conformément à l’article 23, la personne physique ou morale qui a droit à la délivrance du brevet bénéficie provisoirement des mêmes droits que ceux conférés au titulaire d’un brevet en vertu des dispositions de l’article 2 et des sous-alinéas a) et b) du premier alinéa de l’article 34 à compter de la date du dépôt régulier de la demande de brevet et jusqu’à la délivrance du brevet.
Lorsque la demande de brevet a été rejetée, le déposant ne bénéficie pas des dispositions du premier alinéa.
36. Le titulaire d’un brevet portant sur le perfectionnement d’une autre invention ne peut exploiter son invention qu’avec le consentement du titulaire de l’invention à laquelle se rapporte le perfectionnement.
37. Ne constituent pas une violation des droits prévus à l’article 2, aux sous-alinéas a) et b) du premier alinéa de l’article 34 et à l’article 35:
a) l’utilisation d’une invention dans la construction et le fonctionnement des véhicules terrestres et des aéronefs ainsi qu’à bord des navires ou dans des dispositifs destinés à leur fonctionnement, qui appartiennent aux Etats parties aux conventions internationales relatives aux inventions auxquelles la Roumanie est aussi partie, lorsque ces véhicules, aéronefs ou navires pénètrent temporairement ou accidentellement sur le territoire de la Roumanie, à condition qu’il soit procédé à cette utilisation exclusivement pour les besoins de ces véhicules, aéronefs ou navires;
b) l’utilisation ou la prise de mesures effectives et sérieuses en vue de l’utilisation d’une invention sur le territoire de la Roumanie par une personne de bonne foi, indépendamment du titulaire du brevet, avant la date du dépôt national régulier de cette invention ou avant la date de priorité reconnue; dans ce cas, l’invention peut continuer d’être utilisée par cette personne dans la même mesure qu’à la date du dépôt national régulier ou à la date de priorité reconnue, mais le droit d’utilisation ne peut être transmis qu’avec le patrimoine de la personne ou la part de ce patrimoine affectée à l’exploitation de l’invention;
c) la production ou l’utilisation de l’invention dans un but exclusivement expérimental; d) la commercialisation ou l’offre à la vente, sur le territoire de la Roumanie, avec ou sans le
consentement exprès du titulaire, d’exemplaires du produit objet de l’invention qui ont été vendus antérieurement par le titulaire du brevet.
38. L’inventeur a droit à la mention complète de ses nom, prénoms et qualité dans le brevet délivré, dans son carnet de travail, ainsi que dans tous autres documents ou publications concernant son invention. Lorsque le titulaire du brevet n’est pas l’inventeur, celui-ci a le droit d’obtenir une copie du brevet.
39. Les droits pécuniaires de l’inventeur sont établis par contrat.
40. Le titulaire d’un brevet qui a été déchu de ses droits en vertu du deuxième alinéa de l’article 47 peut demander à l’Office d’Etat pour les inventions et les marques le rétablissement du brevet, s’il justifie d’une excuse légitime, dans un délai de six mois à compter de la date de publication de la déchéance. Le rétablissement du brevet est publié par l’Office d’Etat pour les inventions et les marques.
Ne constitue pas une violation des droits prévus aux articles 2, 34 et 35 l’utilisation ou la prise de mesures effectives et sérieuses en vue de l’utilisation de l’invention par des tiers pendant la période comprise entre la déchéance des droits du titulaire du brevet et le rétablissement du brevet.
Dans les cas prévus aux premier et deuxième alinéas, l’invention peut continuer d’être utilisée par ces tiers dans la même mesure, mais elle ne peut être transmise qu’avec le patrimoine ou une part du patrimoine de la personne qui l’utilise.
41. Le titulaire peut renoncer au brevet en tout ou en partie par une déclaration écrite enregistrée auprès de l’Office d’Etat pour les inventions et les marques.
Dans le cas des inventions visées au sous-alinéa a) du premier alinéa et au deuxième alinéa de l’article 5 et des inventions ayant fait l’objet d’une cession conformément au sous-alinéa b) du premier alinéa de l’article 5, le titulaire du brevet doit communiquer à l’inventeur son intention de renoncer au brevet; sur requête de l’inventeur, le titulaire du brevet est tenu de lui transmettre les droits sur le brevet.
Si le brevet a fait l’objet d’un contrat de licence, la renonciation n’est possible qu’avec le consentement du preneur de licence.
L’invention ou la partie de l’invention ayant fait l’objet d’une renonciation peut être librement exploitée par des tiers.
La renonciation à une invention visée au deuxième alinéa de l’article 44 ne peut se faire qu’avec l’accord des autorités qui lui ont conféré le caractère secret.
La renonciation produit ses effets à compter de la date de son enregistrement auprès de l’Office d’Etat pour les inventions et les marques.
42. Le brevet délivré par l’Office d’Etat pour les inventions et les marques peut être annulé, en tout ou en partie, sur la demande d’une personne intéressée, lorsqu’il est constaté que les conditions de brevetabilité de l’invention n’étaient pas remplies à la date d’enregistrement de la demande de brevet d’invention. La demande en nullité peut être présentée pendant toute la durée de validité du brevet au tribunal municipal de Bucarest.
La décision d’annulation est enregistrée auprès de l’Office d’Etat pour les inventions et les marques et publiée dans le délai prévu au deuxième alinéa de l’article 29.
43. Dans les procédures devant l’Office d’Etat pour les inventions et les marques, les personnes physiques ou morales ayant droit à la délivrance d’un brevet peuvent bénéficier de l’assistance d’un conseil en propriété industrielle agréé.
44. L’invention faisant l’objet d’une demande de brevet ne peut être divulguée sans le consentement de l’inventeur ou de son ayant cause avant la publication de sa description par l’Office d’Etat pour les inventions et les marques.
Les inventions relevant de la défense et de la sécurité nationales faites sur le territoire de la Roumanie sont considérées comme secrètes; le caractère secret leur est conféré par les autorités compétentes, qui en informent l’inventeur ou son ayant cause et lui accordent une indemnité pécuniaire. Ce régime prend fin par décision des mêmes autorités.
Concernant les autres inventions, si la personne physique ou morale qui a déposé une demande de brevet en fait la demande, l’Office d’Etat pour les inventions et les marques ne rend pas l’invention publique avant la date indiquée par cette personne.
45. Les inventions faites sur le territoire de la Roumanie par des personnes physiques roumaines ne peuvent être brevetées à l’étranger qu’après l’enregistrement de la demande de brevet auprès de l’Office d’Etat pour les inventions et les marques.
Pour les inventions visées au deuxième alinéa de l’article 44, un brevet ne peut être obtenu à l’étranger qu’avec l’accord des autorités qui leur ont conféré le caractère secret.
Pour obtenir un brevet à l’étranger, les personnes physiques ayant droit au brevet peuvent bénéficier de crédits en devises pour le paiement des taxes.
En ce qui concerne les inventions visées au premier alinéa, le déposant doit informer l’Office d’Etat pour les inventions et les marques de son intention de demander un brevet à l’étranger.
46. S’il s’agit d’une invention pour laquelle le droit au brevet appartient à l’employeur, celui-ci doit informer l’inventeur du stade auquel se trouve l’examen de la demande de brevet à l’Office d’Etat pour les inventions et les marques ainsi que de l’avancement et des résultats de l’application de l’invention.
Sur la demande du titulaire, l’inventeur doit prêter son assistance technique pour la mise en œuvre de l’invention sur une base contractuelle.
47. L’enregistrement, la publication et l’examen de la demande de brevet, la revendication de priorité, la délivrance du brevet et son maintien en vigueur sont soumis au paiement de taxes dans les délais et aux montants établis par la loi.
Pendant toute la durée de validité du brevet, le titulaire doit payer une taxe annuelle. Le défaut de paiement de cette taxe entraîne pour le titulaire la déchéance des droits conférés par le brevet. La déchéance de ces droits fait l’objet d’une publication.
Le montant des taxes dues par des personnes physiques ou morales étrangères doit être versé en devises sur le compte de l’Office d’Etat pour les inventions et les marques.
Chapitre V Transmission des droits
48. Le droit à la délivrance d’un brevet, le droit sur le brevet, les droits découlant de l’enregistrement d’une demande de brevet ainsi que les droits découlant d’un brevet peuvent être transmis en totalité ou en partie.
La transmission des droits peut être faite par cession ou par concession d’une licence exclusive ou non exclusive, ainsi que par succession légale ou testamentaire.
La transmission produit ses effets envers les tiers à compter de la date de son enregistrement auprès de l’Office d’Etat pour les inventions et les marques.
49. Sur requête de toute personne intéressée, le tribunal municipal de Bucarest peut accorder une licence obligatoire à l’expiration d’un délai de quatre ans à compter de la date d’enregistrement de la demande de brevet ou de trois ans à compter de la date de délivrance du brevet, la date la plus tardive étant applicable.
Les dispositions du premier alinéa ne sont applicables que si l’invention n’a pas été exploitée, ou l’a été insuffisamment, sur le territoire de la Roumanie, si le titulaire du brevet ne peut justifier son inaction et s’il n’a pas été possible de parvenir à un accord avec ce dernier au sujet de la transmission des droits.
La licence obligatoire n’est pas exclusive et est accordée à des conditions déterminées en ce qui concerne la durée, le montant des redevances et les droits pécuniaires dus à l’inventeur.
La licence obligatoire est enregistrée auprès de l’Office d’Etat pour les inventions et les marques et produit ses effets à compter de la date de son enregistrement.
Lorsqu’il est constaté que le preneur de licence n’a pas rempli son obligation d’exploiter l’invention aux conditions fixées, la licence obligatoire peut être révoquée par le tribunal sur requête du titulaire du brevet.
50. Si les intérêts de la santé publique l’exigent, les brevets délivrés ayant pour objet des inventions du domaine de la santé qui ne sont pas exploitées ou le sont insuffisamment et pour lesquelles le titulaire ne peut pas justifier son inaction peuvent être soumis au régime de la licence d’office par le tribunal municipal de Bucarest, sur requête expresse du Ministère de la santé.
Après publication de la décision du tribunal soumettant l’invention au régime de la licence d’office, toute personne intéressée peut demander au Ministère de la santé une licence d’exploitation non exclusive.
51. Le ministère compétent peut mettre les titulaires de brevets d’invention autres que ceux visés à l’article 50 en demeure d’exploiter l’invention de manière à satisfaire aux besoins de l’économie nationale.
Si la mise en demeure n’a pas été suivie d’effet dans un délai d’un an et si l’absence d’exploitation, ou l’insuffisance en qualité ou en quantité de l’exploitation entreprise, porte gravement préjudice à l’économie nationale et à l’intérêt public, le brevet ayant fait l’objet de la mise en demeure peut, sur requête du ministère compétent, être soumis au régime de la licence d’office par arrêté du gouvernement.
Le délai d’un an prévu au deuxième alinéa peut être prorogé par le ministère compétent lorsque le titulaire justifie d’excuses légitimes et compatibles avec les exigences de l’économie nationale.
Après la publication de l’arrêté visé au deuxième alinéa, toute personne intéressée peut demander au ministère compétent une licence d’exploitation non exclusive de l’invention.
52. Dans l’intérêt de la défense ou de la sécurité nationales, le gouvernement peut accorder, à la demande du ministère compétent, une licence d’office pour l’exploitation d’une invention faisant l’objet d’une demande de brevet ou d’un brevet.
Cette licence est accordée directement au ministère compétent ou aux entreprises en mesure d’exploiter l’invention pour le compte de ce ministère.
La licence accordée conformément aux dispositions du premier alinéa produit ses effets à compter de la date de l’arrêté du gouvernement et elle est enregistrée auprès de l’Office d’Etat pour les inventions et les marques.
53. Les arrêtés qui soumettent un brevet au régime de la licence d’office prévu aux articles 50 et 51 sont communiqués à l’Office d’Etat pour les inventions et les marques, qui les publie dans un délai de trois mois à compter de la communication.
54. Les licences d’exploitation prévues aux articles 50, 51 et 52 ne sont pas transmissibles, et les redevances auxquelles les inventeurs ont droit sont fixées sur la base d’un contrat conclu entre les parties ou, en cas de divergences, par le tribunal municipal de Bucarest.
Chapitre VI Défense des droits relatifs aux inventions
55. Les décisions de l’Office d’Etat pour les inventions et les marques peuvent être contestées auprès de l’office par les personnes intéressées dans un délai de trois mois à compter de leur communication.
56. Toute personne intéressée a le droit de demander à l’Office d’Etat pour les inventions et les marques, par une requête écrite et motivée, la révocation totale ou partielle d’une décision de délivrance d’un brevet dans un délai de six mois à compter de la publication prévue au deuxième alinéa de l’article 29 si l’une des conditions prévues aux articles 7 à 11 n’est pas remplie.
La contestation ou, le cas échéant, la demande de révocation est examinée dans un délai de trois mois à compter de son enregistrement par une commission de réexamen de l’Office d’Etat pour les inventions et les marques, dont la composition est différente de celle de la commission qui a rendu la décision originale.
57. La décision de la commission de réexamen est communiquée aux parties dans un délai de 15 jours à compter de la date du prononcé et peut faire l’objet d’un recours formé auprès du tribunal municipal de Bucarest dans un délai de trois mois à compter de la communication.
La décision de délivrance du brevet rendue par la commission de réexamen ou les décisions rendues par les instances judiciaires et devenues définitives sont publiées dans un délai de 30 jours.
58. L’usurpation, par n’importe quel moyen, de la qualité d’inventeur constitue une infraction dont l’auteur est passible d’un emprisonnement de six mois à deux ans ou d’une amende de 50.000 à 100.000 lei.
59. La fabrication, l’utilisation ou la mise en circulation non autorisées de l’objet d’un brevet ou toute autre violation des droits découlant d’un brevet pendant la durée de validité de celui-ci constituent une contrefaçon dont l’auteur est passible d’un emprisonnement de trois mois à deux ans ou d’une amende de 50.000 à 100.000 lei.
L’action pénale est engagée sur plainte de la partie lésée. Le titulaire a droit, pour les préjudices qu’il a subis, à des dommages-intérêts conformément au droit
commun, et les produits contrefaits peuvent être confisqués conformément à la loi pénale. La violation par des tiers des droits prévus au premier alinéa de l’article 35 entraîne pour ceux-ci
l’obligation de verser des dommages-intérêts conformément au droit commun; le titre ouvrant droit au paiement des dommages-intérêts est exécutoire après la délivrance du brevet.
60. La divulgation, par le personnel de l’Office d’Etat pour les inventions et les marques ou par des personnes exerçant des activités relatives aux inventions, des informations contenues dans des demandes de brevet avant la publication de ces demandes constitue une infraction dont les auteurs sont passibles d’un emprisonnement de trois mois à deux ans ou d’une amende de 50.000 à 100.000 lei.
L’Office d’Etat pour les inventions et les marques répond envers l’inventeur des préjudices résultant de l’infraction visée au premier alinéa.
61. Les litiges relatifs à la qualité d’inventeur ou de titulaire d’un brevet ou aux autres droits découlant d’un brevet, y compris les droits pécuniaires de l’inventeur résultant d’un contrat de cession ou de concession sous licence, ainsi que les litiges relatifs à l’inobservation des dispositions des articles 39 et 46 relèvent de la compétence des instances judiciaires et sont exonérés des taxes fiscales.
62. Lorsqu’il est constaté, par une décision judiciaire, qu’une personne autre que celle dont le nom est inscrit sur le brevet d’invention a droit à la délivrance du brevet, l’Office d’Etat pour les inventions et les marques délivre le brevet à cette personne et publie le changement de titulaire.
Chapitre VII Attributions de l’Office d’Etat
pour les inventions et les marques
63. L’Office d’Etat pour les inventions et les marques est l’organe gouvernemental spécialisé ayant seul compétence sur le territoire de la Roumanie en ce qui concerne la protection dans le domaine de la propriété industrielle, conformément à la loi et aux dispositions des conventions internationales auxquelles l’Etat roumain est partie.
64. Dans le domaine des inventions, l’Office d’Etat pour les inventions et les marques a les attributions suivantes:
a) enregistrer, publier et examiner les demandes de brevet et accorder la protection par la délivrance de brevets;
b) tenir le Registre national des demandes de brevet et le Registre national des brevets et y faire inscrire toutes les données relatives aux demandes de brevet et aux brevets délivrés;
c) administrer, tenir à jour et développer par des échanges internationaux la collection nationale des descriptions d’inventions et créer une base de données informatisée dans le domaine des inventions;
d) fournir, sur demande, des services d’information technique sur la base des descriptions d’inventions roumaines et étrangères et des publications officielles de propriété industrielle;
e) entretenir des relations avec les organisations gouvernementales similaires et avec les organisations internationales spécialisées dont l’Etat roumain est membre;
f) fournir, sur demande, une assistance dans le domaine de la propriété industrielle et organiser des cours de formation pour les spécialistes de ce domaine;
g) éditer et publier périodiquement, dans le Bulletin officiel de la propriété industrielle de Roumanie, les données relatives aux demandes de brevet et aux brevets.
Chapitre VIII Dispositions transitoires et finales
65. Les demandes de brevet enregistrées auprès de l’Office d’Etat pour les inventions et les marques conformément à la loi N° 62 de 1974 qui n’ont pas fait l’objet d’une décision d’acceptation ou de rejet feront l’objet d’une décision conformément aux dispositions de la présente loi.
Les inventeurs, les déposants et, le cas échéant, les titulaires désignés devront, d’un commun accord, indiquer la personne habilitée à obtenir le brevet et déterminer les droits pécuniaires de l’inventeur dans les cas où le brevet doit être délivré à une personne autre que l’inventeur, et communiquer ces renseignements à l’Office d’Etat pour les inventions et les marques.
Cet accord doit être authentifié et déposé auprès de l’Office d’Etat pour les inventions et les marques dans un délai de six mois à compter de l’entrée en vigueur de la présente loi. Après l’expiration de ce délai, si l’accord n’a pas été déposé auprès de l’Office d’Etat pour les inventions et les marques, le droit au brevet appartiendra à l’inventeur, conformément à l’article 3 ou, le cas échéant, au sousalinéa b) du premier alinéa de l’article 5 de la présente loi.
66. Les brevets délivrés avant l’entrée en vigueur de la présente loi ont la durée de validité prévue par la loi applicable à la date de leur délivrance.
Les droits pécuniaires revenant aux inventeurs pour les inventions brevetées exploitées pour lesquelles la rémunération correspondante n’a pas été versée, ou l’a été partiellement, à la date d’entrée en vigueur de la présente loi, devront faire l’objet de négociations entre l’inventeur et l’employeur qui a exploité l’invention. Dans ces cas, les négociations doivent se faire sur la base du montant maximum des droits pécuniaires auxquels l’inventeur pouvait prétendre en vertu de la loi applicable à la date d’enregistrement de la demande de brevet. A défaut d’accord entre les parties, ces droits seront établis conformément aux dispositions de l’article 61 de la présente loi.
Le droit sur le brevet d’invention est transmis à l’inventeur par l’effet de la loi dans les cas où l’employeur devenu titulaire du brevet par l’effet de la cession légale prévue à l’article 14 de la loi N° 62 de 1974 n’a pas exploité l’invention ou pris les mesures nécessaires en vue de son exploitation à la date d’entrée en vigueur de la présente loi.
67. Les droits pécuniaires de l’auteur d’une création technique qui est nouvelle dans l’entreprise de l’employeur et lui est utile sont fixés par contrat conclu entre l’auteur et l’employeur.
L’employeur qui applique cette création technique doit attester la qualité de l’auteur. La violation des dispositions des premier et deuxième alinéas entraîne pour l’employeur l’obligation
de verser des dommages-intérêts conformément au droit commun. Les dommages-intérêts sont fixés compte tenu des résultats économiques obtenus par l’employeur.
68. Les bénéfices résultant de l’exploitation d’une invention sont exemptés d’impôt pendant les cinq premières années de l’exploitation, calculées à compter de la date à laquelle le brevet a pris effet, et restent, dans ce cas, intégralement à la disposition de l’entreprise qui exploite l’invention.
69. Avant l’entrée en vigueur des dispositions de la présente loi, le gouvernement approuvera un règlement d’application de celle-ci, établissant la procédure d’enregistrement et d’examen des demandes de brevet, les relations entre les inventeurs-salariés et les employeurs, conformément à l’article 5, ainsi que les conditions de délivrance de brevets pour les nouvelles variétés végétales et races animales.
70. La présente loi entrera en vigueur trois mois après la date de sa publication au Journal officiel de Roumanie.
A la même date, la Loi N° 62 de 1974 sur les inventions et les innovations, le Décret N° 93 de 1976 sur les normes pour le calcul des rémunérations auxquelles ont droit les auteurs d’inventions exploitées dans l’économie nationale, le Décret N° 363 de 1976 sur les taxes applicables aux demandes de brevet et aux brevets, ainsi que toutes autres dispositions contraires à la présente loi, seront abrogés.
