Notes
Sections 51 and 52 deal with patent claims and infringement of patent in aircraft. Section 51 exempts certain aircraft from seizure, detention, or any interference on the ground that the construction, mechanism, parts, accessories of or operation of the aircraft infringes a patent, design or model. This exemption applies to civilian aircraft registered in a country or territory in respect of which there is in force a declaration by the Minister responsible for civil aviation, with a view to the fulfillment of the provisions of the Convention on International Civil Aviation, 1944, that the benefits of the exemption apply to that country or territory. The exemption also applies to such other aircraft as the Minister may by order specify.
Aircraft that are not exempted under section 51 may be detained in Nigeria for alleged infringement of patent (see section 52).
