The Civil Code of Turkmenistan consists of 5 parts: general provisions (Part I); property rights (Part II); obligations (Part III); intellectual property rights (Part IV); and succession rights (Part V).
The Part IV, entitled “Legislation on Intellectual Property” covers the all areas of intellectual property, including copyright and related rights, inventions, industrial designs, semiconductor topographies, selection achievements, trademarks and commercial names. It sets out rules for IP licensing and assignment agreements, including the rules on compulsory licensing and collective management of IP rights; provides legal remedies for infringement of IP rights, and especially indicates the types of claims that the IP rights owner can file before the court.
