This Act amends the Independent Broadcasting Authority Act, 1993 the Telecommunications Act, 1996 and the Broadcasting Act 1999.
The Independent Communications Authority of South Africa Act 2000 ('the ICASA Act') dissolved the Independent Broadcasting Authority (IBA) and the South African Telecommunications Regulatory Authority (SATRA), and established the Independent Communications Authority of South Africa (ICASA) as the new regulatory body, which inherited the powers and duties conferred to IBA and SATRA. According to Section 2 of the Act, the Independent Communications Authority of South Africa (ICASA) is responsible for regulating the telecommunication, broadcasting sectors, and postal services in the public interest.
Section 4 prescribes the functions of ICASA, which include, inter alia, the following:
-to issue licenses to telecommunications and broadcasting service providers;
-to enforce compliance with rules and regulations;
-to impose license conditions; and to grant, renew, amend, transfer and revoke licences;
-to manage the effective use of radio frequency spectrum in accordance with bilateral agreements or international treaties;
-to ensure the interoperability of networks;
-to consult with Ministry of Communications; and
-to hear and decide on disputes and complains brought against licensees.
Section 4 D(4), Chapter II contains provisions on the submission of confidential information to ICASA in connection with trade secrets, and financial, commercial, scientific or technical information.
Section 25 of this Act stipulates that it takes effect on a date determined by the President by proclamation in the Gazette, except section 18(2) which entered into effect on March 30, 2000.
