WIPO Mediation for AGICOA Rightsholders
AGICOA-WIPO Collaboration
The Association for the International Collective Management of Audiovisual Works (AGICOA) and the WIPO Arbitration and Mediation Center (WIPO AMC) collaborate to provide alternative dispute resolution (ADR) services for disputes between AGICOA rightsholders in the event of a double declaration (or more) in respect of the same work and with an overlapping cumulative percentage of declared rights of more than one hundred percent (100%).
WIPO Arbitration and Mediation Center
The WIPO AMC offers ADR options, including mediation and arbitration, to enable parties to efficiently settle their domestic or cross-border commercial disputes. The WIPO AMC is international and specialized in IP and technology disputes. It has a strong focus on controlling the time and cost of its proceedings. WIPO ADR procedures are organized to stimulate positive opportunities for party settlement. Typically, 70% of the mediation procedures administered by the WIPO Center are successfully settled.
External Dispute Resolution Stage
If, after failing to reach an agreement, at least one party informs AGICOA within one hundred and eighty (180) days of their intention to initiate legal proceedings, arbitration, or mediation, AGICOA shall proceed to Phase 4 of the AGICOA dispute resolution procedure and inform the parties accordingly.
What is Mediation?
Mediation is an informal process in which a neutral intermediary, the mediator, assists the parties in reaching a settlement of their dispute based on the parties' respective business interests. The mediator cannot impose a decision. The settlement agreement has the force of a contract.
How to Refer an AGICOA Dispute to WIPO Mediation?
Invitation to Mediation
The WIPO AMC provides an invitation-to-mediation service that can be sent to the other party through an online form.
- The invitation to mediation is free of administrative fees.
- Mediation is consensual; if the other party does not agree to participate, the procedure cannot proceed.
- If both parties agree, mediator fees will apply.
- Mediation can be conducted online.
How Much does WIPO Mediation Cost?
The cost of mediation is determined on a case-by-case basis. Upon receiving an application, a detailed cost schedule will be provided.
