Decree of the Government of the Russian Federation, No. 178 dated April 7, 2004 Moscow Issues of the Federal Service for Intellectual Property, Patents and Trademarks Published April 13, 2004. Shall come into force April 21, 2004. In accordance with the Decree of the President of the Russian Federation, dated March 9, 2004, No. 314 “On the System and Structure of the Federal Executive Authorities”, the Government of the Russian Federation enacts:

1. The Federal Service for Intellectual Property, Patents and Trademarks shall be a Federal executive authority performing functions of control and supervision in the area of the legal protection and exploitation of intellectual property rights, including patents and trademarks.

2. The Federal Service for Intellectual Property, Patents and Trademarks shall be under the Ministry of Education and Science of the Russian Federation. 3. The main functions of the Federal Service for Intellectual Property, Patents and Trademarks shall be: a) the provision of the procedure for affording in the Russian Federation the legal protection to intellectual property rights and also the procedure for their exploitation, said procedures are established by the Constitution of the Russian Federation, the Federal constitutional laws, the Federal laws and other statutory legal acts; b) the performance of control and supervision of examination of applications for intellectual property rights and the issue of protective titles in the manner established by legislation of the Russian Federation; c) the registration of intellectual property rights and also license agreements and assignment agreements in the sphere of intellectual property and publication of data on the registered intellectual property rights; d) the performance of control and supervision of the observance of the procedure for paying patent fees and registration charges; e) the performance of certification and registration of patent attorneys of the Russian Federation and the performance of control of the fulfillment by them of requirements provided for by legislation of the Russian Federation. 4. Authorize the Federal Service for Intellectual Property, Patents and Trademarks to have up to 3 deputies of the Head and in the structure of the Government Staff up to 4 Departments according to the main directions of activities of the Service. 5. Fix the limiting number of the employees of the Government Staff of the Federal Service for Intellectual Property, Patents and Trademarks in amounts of 85 units (without considering the personnel engaged in the guarding and maintaining the buildings). 6. Agree with the proposal of the Ministry of Education and Science of the Russian Federation on the location of the Federal Service for Intellectual Property, Patents and Trademarks in Moscow, 24 Berezhkovskaya nab., buildings 1 and 3.
