ARTICLE 16 (ARTICLE 15 OF DIRECTIVE 2010/13)

 

 

TITLE: BROADCASTING OF SHORT NEWS REPORTS

 

 

1. TV broadcasters that exercise exclusive broadcasting rights of events of high interest to the public and their side events shall indiscriminately provide other TV broadcasters established in Greece or other EU Member States the right of use of short extracts solely for the purposes of general news programmes, on a fair, reasonable and non-discriminatory basis. Such terms shall be communicated in a timely manner before the event takes place to give others sufficient time to exercise such right.

 

2. Access to events of high interest to the public shall be sought by the TV broadcaster which is established in Greece and has acquired exclusive rights. Where such exclusive rights have not been acquired for Greece, the request is put to the overseas TV broadcaster that holds general rights.

 

3. TV broadcasters freely choose short extracts of the event or its side events from the transmitting broadcaster�s signal with, unless impossible for reasons of practicality, at least the identification of their source.

 

4. Short extracts shall not exceed 90 seconds of an hour for each individual event or individually transmitted part of the event. They may be used for EU-wide programmes by any TV broadcaster, even by dedicated sports TV broadcasters.

 

5. Where compensation for broadcasting short extracts is provided for, it shall not exceed the additional costs directly incurred in providing access.

 

6. Such short extracts may be used solely in on-demand audiovisual media services, only if the same programme is offered on a deferred basis by the same media service provider.
