ACT No. XVIII of 2005

AN ACT to amend the Patents and Designs Act, Cap. 417.

BE IT ENACTED by the President, by and with the advice and consent of the House of Representatives in this present Parliament assembled, and by the authority of the same, as follows>

1. (1) The short title of this Act is the Patents and Designs (Amendment) Act, 2005 and it shall be read and construed as one with the Patents and Designs Act, hereinafter referred to as “the principal Act”.

(2) The provisions of this Act shall be deemed to have come into force on the 1st January, 2005.

  1. In sub-article (2) of article 26 of the principal Act, for the words from “Such maintenance fee” to the words “prescribed due date.” there shall be substituted the words “Such maintenance fee shall be due in respect of the third year and each subsequent year thereafter calculated from the filing date of the application and shall be paid by not later than the last day of the month of the prescribed due date.”.
  2. In the Maltese text of sub-article (1) of article 98 of the principal Act, for the words “ti;i dikjarata valida” there shall be substituted the words “ti;i dikjarata invalida”.
