Copyright (Extended Application) Order, 1991

(No. 101 of April 23, 1991)

1. This Order may be cited as the Copyright (Extended Application) Order, 1991.
2. In this Order-
"the Act of 1988" means the Radio and Television Act, 1988 (No. 20 of 1988);
"the Commission" means the Independent Radio and Television Commission;
"sound broadcasting contract", "sound broadcasting contractor", "television programme service contract" and "television programme service contractor" have the meanings assigned to them, respectively, by section 4(2) of the Act of 1988.
3. The provisions of the Copyright Act, 1963, in so far as they relate to television broadcasts and sound broadcasts made by Radio Telefís Eireann shall apply to such broadcasts and the distribution of audio-visual programme material of any description by the means specified in section 17 of the Act of 1988 when made, or distributed by:

(a) a sound broadcasting contractor who, pursuant to section 4(2)(a) of the Act of 1988, has entered into a sound broadcasting contract with the Commission, and

(b) a television programme service contractor who, pursuant to section 4(2)(b) of the Act of 1988 has entered into a contract with the Commission, whether or not he has also entered into a contract pursuant to section 6(1) of the Broadcasting Act, 1990 (No. 24 of 1990),

for the purposes of such contracts, and the said provisions in so far as they relate to the broadcasts and the distribution of audio-visual programme material shall be construed as though any reference to Radio Telefís Eireann therein contained were a reference to such a sound broadcasting contractor and television programme service contractor.
