Notes:The Act does not specifically provide for intellectual property rights. The purpose of the Act is to provide standards for the sale of food and drugs. However, for purposes of identifying the manufacturer of a particular product, Section 44 of the Act establishes the presumption that a person whose registered mark is on an article is presumed to be the manufacturer of that article.
