Year of Version 2015 Dates Amended up to: September 17, 2016 Entry into force: December 15, 2003 Issued: March 10, 2003 Type of Text Implementing Rules/Regulations   Subject Matter Patents (Inventions), Plant Variety Protection, Genetic Resources, Traditional Knowledge (TK) Subject Matter (secondary) IP Regulatory Body Notes This consolidated version of Executive Decree No. 31514-MINAE (Ministry of Environment and Energy) incorporates amendments introduced by the following: - Executive Decree No. 32066 of March 19, 2004, which entered into force on November 2, 2004. - Executive Decree No. 33697 of February 6, 2007, which entered into force on April 18, 2007. - Law: No. 9046 of June 25, 2012, on the Transfer of the Telecommunications Sector from the Ministry of Environment, Energy and Telecommunications to the Ministry of Science and Technology, which entered into force on January 31, 2013 - Executive Decree No. 39341 of August 4, 2015, which entered into force on September 17, 2016 (Article 38 repealed Article 27 of this consolidated Executive Decree No. 31514-MINAE). Chapter II, Section IV, Article 25 of the Executive Decree establishes that the Technical Bureau of CONAGEBIO (the Competent Authority) will oppose the register of patents, trade secrets, plant breeder's rights, copyright, community generis intellectual rights, farmer's rights or others, if the authorized institutions, who provides with these types of protection do not comply with the requirements of Article 80 of Law No. 7788 on Biodiversity.
