Year of Version 2005 Dates Entry into force: October 27, 2005 Issued: October 12, 2005 Type of Text Implementing Rules/Regulations Subject Matter Transfer of Technology, IP Regulatory Body Notes Resolution No. P-328/2005 issued by the National Institute of Industrial Property (“INPI”), among others, provides the new requirements for the registration of technology transfer agreements and narrows the scope of the agreements, which may be registered as transfer of technology agreements. According to Article 1 of the Annex I of the Resolution, the following shall not be considered as technology transfers: - Acquisition of products - Technical or consulting services, know-how licenses for preparatory purposes, as well as any other delivery or rendering of service that do not incorporate technical knowledge directly applied to the productive activity of the local contractor - Software or software updating licenses - Services relating to repairs, supervision of repairs, maintenance and setup of plant and equipment that do not include the local company’s personal training - Any activity relating to the regular business operations of the local party. Article 2 of the Civil Code stipulates: “Laws shall not be binding until after their publication, and as of the stated day. If not day is stated, they shall be binding eight days following their official publication.” This Resolution was published in the Official Gazette on October 19, 2005 (B.O. 19/10/05), with no specific date of entry into force; based on Article 2 of the Civil Code it entered into force eight days after its publication.
