These Regulations, issued pursuant to section 2(2) of the European Communities Act 1972, make amendments, among others, to the Medicines for Human Use (Marketing Authorizations Etc.) Regulations 1994 and the Patents Act 1977 in order to give effect to the Directive 2004/27/EC of the European Parliament and of the Council of 31 March 2004 amending Directive 2001/83/EC on the Community code relating to medicinal products for human use ('2001 Directive').
In particular, regulation 3 provides for the amendments of section 60 ('meaning of infringement') of the Patents Act 1977 in order to give effect to article 10(6) of the 2001 Directive.
