The notification by Italy to the WTO under article 63.2 of TRIPS states:
'Without prejudice to the powers of the Commission of the European Union, internal authority to implement the anti-competition rules has been conferred upon the institution of the national competition authority (Autoritá Garante per il Mercato el la Concorrenza ('AGCM')), established by the Competition and Fair Trading Act (At No. 287 of October 10, 1990)'.
