This consolidated version of the Criminal Code incorporates all the amendments up to “Act of October 30, 2017, on the New Regulation of Protection of Secrets in case of the Participation of Third Parties in the Exercise of Profession of Persons Subject to Duty of Secrecy”, which entered into force on November 9, 2017, three days after its publication in the Federal Law Gazette, in accordance with its Article 11.
For the amended provisions of the said Act of October 30, 2017, see the following provisions of this consolidated version:
- General Part, Chapter Three, Sixth Title, Section 68a, paragaph (8) (the words “§ 203 Abs. 1 Nr. 1, 2 und 5” (“Section 203 Para. 1 No. 1, 2 and 5”) are replaced by the words “§ 203 Absatz 1 Nummer 1, 2 und 6” (“Section 203 Paragraph 1 No. 1, 2 and 6”));
- Special Part, Chapter Fifteen, Section 203, paragraph (1), subparagraph 3 (amended by adding the words “Kammerrechtsbeistand” ('a person who has been admitted to a Bar Association pursuant to Section 206 of the Federal Regulations for Practising Lawyers or a non-attorney provider of legal services who has been admitted to a Bar Association') after the words “Rechtsanwalt” (“attorney”)), subparagraphs 4a, 5 , 6 (renumbered as 5 to 7), paragraph (2a) (repealed), paragraph (3) (replaced by paragraphs 3 and 4), paragraphs (4) and (5) (renumbered as 5 and 6); Section 204, paragraph (2) (the word “Abs. 4” (“Para. 4”) is replaced by “Absatz 5” (“Paragraph 5”));
- Special Part, Chapter Twenty Eight, Section 309, paragraph (6) (reworded).
