Anti-Commercial Fraud Law “the Law” is promulgated by Royal Decree No. M/19 of 23/4/1429H (April 29, 2008).
It contains five Chapters and 30 Articles: chapter One (Article 1) on Definitions; Chapter Two (Articles 2-4) on Violations; Chapter Three (Articles 5-15) on Recording, Investigation and Trial; Chapter Four (Articles 16-27) on Penalties and Chapter Five (Articles 28-30) on Concluding Provisions.

The fraud is defined by the Law as any attempt to deceive by any means, among other things, the nature, type or characteristics, origin, size or quantity of a product, or to manufacture, sell or import fraudulent products (Article 2).
The complaints for a commercial fraud including trademark counterfeiting may be submitted to a Special Committee of Commercial Fraud appointed by the Minister of Commerce. The law states that any person who commits a commercial fraud shall pay a fine up to five hundred thousand riyals (SR 500.000) or shall be subject to imprisonment for a period not exceeding 2 years or both penalties (Article 16). The penalty may be increased to one million riyal (SR 1000.000) and the imprisonment to three years, if the fraud is combined, among other things, with false weights, measurements, stamps and if the product is harmful to humans and animals health (Article 18).

Article 29 indicates that this law shall supersede the Anti-Commercial fraud Law issued upon the Royal Decree no. (M/11), dated 29/5/1404H (corresponding to 2/3/1984).
