Year of Version 2002 Dates Enacted: March 12, 1964 Type of Text IP-related Laws Subject Matter Plant Variety Protection, Other Notes The Plant Varieties and Seeds Act 1964 has been most recently amended by the Beet Seed (Scotland) (No. 2) Regulations 2010. However, this amended version of the Act has not yet incorporated all the amendments made to it from 2004 (see the end of the amended version of the Act for further details).
The Act is divided into 4 parts (Parts I to IV) and 7 schedules (Schedules 1 to 7). Among others, Part I (the “Plant Breeder’s Rights”), and Schedules 1 to 4 established under sections 1, 2 and 10 the said Part I are repealed by the Schedule 4 of the Patent Varieties Act 1997; and Schedule 5 established under section 20 of the said Part I is repealed by Schedule 4 of the European Communities Act 1972.
Section 41(2) of the Act states that:“Parts II and III of this Act shall come into force on such day as the Minister of Agriculture, Fisheries and Food and the Secretary of the State may by order contained in a statutory instrument appoint, and orders under this subsection may appoint different dates for different provisions or different purposes”.
