This Act consolidates the provisions of the Food and Drugs Act 1955 to 1982, the Sugar Act 1956, the Food and Drugs (Milk) Act 1970, section 7(3) and (4) of the European Communities Act 1972, section n198 of the Local Government Act 1972 and Part IX of the Local Government (Miscellaneous Provisions) Act 1982.
The Law is structured into 7 Parts and 11 Schedules.
In particular, Section 6 “Food Falsely Described” of this Act provides provisions on food with a label that “falsely describes” the food or “is calculated to mislead as to its nature, or its quality”. Section 7 of this Law empowers Ministers to make regulations that impose requirements to the making, labeling and advertising food.
Section 119 “Community provisions” provides provisions that authorize Ministers to make regulations to ensure that the Community provisions are enforceable under this Law (See: The Spirit Drinks Regulations 1990).
