Year of Version 2013 Dates Entry into force: November 1, 2013 Adopted: July 17, 2013 Type of Text Implementing Rules/Regulations Subject Matter Copyright and Related Rights (Neighboring Rights) Notes These Regulations, issued pursuant to section 78 of the Enterprise and Regulatory Reform Act 2013, amend the Copyright, Designs and Patents Act 1988 to implement the provisions of Directive 2011/77/EU of the European Parliament and of the Council of 27 September 2011 amending Directive 2006/116/EC on the term of protection of copyright and certain related rights.
Regulation 4 provides for the amendments of the Copyright, Designs and Patents Act 1988 and inserts in section 10A of the Act a new definition of a work of co-authorship as a musical composition with words where the author of the music and the author of the lirics have collaborated together to produce the work.
Regulation 6 extends the period of copyright in a sound recording which is published or made available to the public from 50 years to 70 years in section 13A of the Copyright, Designs and Patents Act 1988.
Regulation 8 also amends section 191 of the Copyright, Designs and Patents Act 1988 and extends the duration of a performer`s rights in a sound recording which is released from 50 years to 70 years.
Regulation 9 of these Regulations inserts new sections 191HA and 191HB in the Copyright, Designs and Patents Act 1988 that deal with the termination of the assignment of of the reproduction , distribution and making available rights in a sound recording to the producer and the payment of the annual payment for the assignment.
Regulation 10 provides for amendments of section 192A and sets out that the rights confered on the performer under new sections 191HA and 191HB are transmissible on the death of the performer.
