Year of Version 2003 Dates Entry into force: June 10, 2003 Adopted: May 8, 2003 Type of Text Implementing Rules/Regulations Subject Matter Patents (Inventions), Plant Variety Protection, Enforcement of IP and Related Laws, Alternative Dispute Resolution (ADR), Genetic Resources, IP Regulatory Body Notes This Order amends the Patents Act 1977 in its application to the Isle of Man. It replaces the Patents Act 1977 (Isle of Man) Order 1978, and makes additional modifications to correspond to the amendments made to the Act by the Supreme Court Act 1981, the Competition Act 1998; the Patents and Trade Marks (World Trade Organization) Regulations 1999; the Patents Regulations 2000, and the Patents Act 1977 (Electronic Communications) Order 2003.
Among others, the Schedule on 'Modifications of specified provisions of the Patents Act 1977 in their application to the Isle of Man', established under article 2(1) of this Order specifies the amendments to sections 48, 48A, 48B on compulsory licences; section 52 on opposition, appeal and arbitration; section 76A on biotechnological inventions; and section 124A on use of electronic communications; the insertion of a new Schedule A1 (under section 60(5)(g)), entitled 'Derogation from patent protection in respect of biotechnological inventions', referring, inter alia, to the Council Regulation (EC) No. 2100/94 of 27th July 1994 on Community plant variety rights; and a new Schedule A2 (under section 76A)), entitled 'Biotechnological Inventions'.
