Year of Version 1978 Dates Entry into force: January 1, 1978 Adopted: December 30, 1977 Type of Text Implementing Rules/Regulations Subject Matter Copyright and Related Rights (Neighboring Rights) Notes The consolidated text 1978 of the Legal Regime on Payments due for the Use of Works in the Public Domain, composed of nine Titles and one Annex, incorporates all the amendments made by the following Resolutions of the National Arts Fund: 16.096/78, 16.349/79, 16.451/79, 17.168/84, 17.248/85, 17.776/85, 21.457/91, 21.516/91, 3.546/97, 3.457/97 and 3.458/97.
Title I, Article 1 of the consolidated text details the use of public domain works that are subject to the payment of author’s royalties, as provided for in Article 6(c) of Decree-Law No. 1.224/58 of February 3, 1958, Creating the National Arts Fund and Article 6 of Decree No. 6255 of April 28, 1958, Regulating the Activities of the National Arts Fund.
Title II to Title VIII refer to the collection of royalties for different kinds of rights that are carried out by the General Society of Argentina Authors (ARGENTORES), the Argentine Society of Authors and Composers of Music (SADAIC), and the National Arts Fund (FNA).
Title IX provides for an Annex on the royalty rates of works fixed by the National Arts Fund, which entered into force on January 1, 1978.
Article 3 of the present Resolution empowers the National Fund Art to apply the penalties established by Law No. 11.683 on Tax Procedure and the updated provisions governing credits approved by Law Nº 21.282 on Net Assets Taxes.

This Resolution took effect on the date of entry into force of the Annex on the royalty rates of works fixed by the National Arts Fund, which is on January 1, 1978.
