o ochraně topografií polovodičových výrobků

Federální shromáždění České a Slovenské Federativní Republiky se usneslo na tomto zákoně:

Předmět ochrany

§ 1

(1) Podle tohoto zákona jsou chráněny topografie polovodičových výrobků (dále jen "topografie"), které jsou výsledkem tvůrčí činnosti původce a které nejsou v průmyslu polovodičových výrobků běžné. Ochrana podle tohoto zákona se vztahuje rovněž na části topografie, které jsou využitelné samostatně, jakož i na zobrazení sloužící k výrobě topografie.

(2) Jestliže topografie je tvořena z prvků všeobecně známých, je chráněna pouze tehdy, splňuje-li kombinace těchto prvků podmínky uvedené v odstavci 1.

(3) Ochrana podle odstavce 1 se nevztahuje na technologii užitou při vytváření topografie nebo výrobě polovodičového výrobku, ani na informace uložené v tomto výrobku.

§ 2

(1) Topografií se pro účely tohoto zákona rozumí série jakkoli zafixovaných nebo zakódovaných vzájemně souvisejících zobrazení, znázorňující trojrozměrné trvalé uspořádání vrstev, z nichž se polovodičový výrobek skládá, přičemž každé zobrazení znázorňuje vzor jedné vrstvy polovodičového výrobku nebo jeho části, popřípadě povrchu polovodičového výrobku v jednotlivých stupních výroby nebo jeho částí.

(2) Polovodičovým výrobkem se pro účely tohoto zákona rozumí konečná nebo mezitímní forma mikroelektronického výrobku, který je určen k plnění elektronické funkce a který se skládá ze základního tělesa obsahujícího vrstvu polovodičového materiálu a opatřeného alespoň jednou vrstvou vodivého, izolačního nebo polovodičového materiálu v předem daném uspořádání.

(3) Obchodním využitím se pro účely tohoto zákona rozumí prodej, pronájem, nabídka nebo jiný způsob obchodní distribuce topografie nebo polovodičového výrobku obsahujícího topografii nebo výrobku obsahujícího polovodičový výrobek.

Právo na ochranu

§ 3

(1) Právo na ochranu topografie přísluší jejímu původci nebo jeho právnímu nástupci.

(2) Jestliže topografie byla vytvořena ke splnění úkolu z pracovního poměru nebo obdobného vztahu, přísluší právo na ochranu zaměstnavateli nebo tomu, pro koho byla na základě smlouvy vytvořena, pokud smlouva nestanoví jinak.

§ 4

Právo na ochranu topografie je převoditelné.

§ 5

Právo na ochranu topografie zanikne uplynutím 15 let ode dne jejího vytvoření, jestliže topografie nebyla obchodně využívána jinak než skrytě nebo nebyla přihlášena u Úřadu průmyslového vlastnictví (dále jen "Úřad").

§ 6

(1) Právo na ochranu mohou uplatnit občané České republiky, jakož i osoby, které mají bydliště nebo sídlo na území státu, který je členem Světové obchodní organizace; 1a) jestliže stát, v němž má přihlašovatel bydliště nebo sídlo, není členem Světové obchodní organizace, 1a) lze právo na ochranu přiznat jen za podmínky vzájemnosti.

(2) Jestliže právo na ochranu neuplatní osoby uvedené v § 3, mohou je uplatnit osoby, které na základě výlučného souhlasu osoby uvedené v § 3 jako první v České republice využily topografii, která dosud ve světě nebyla využívána.

§ 7

Přihláška topografie

(1) Každý, kdo chce uplatnit právo na ochranu topografie (dále jen "přihlašovatel"), musí podat písemnou přihlášku topografie (dále jen "přihláška") u Úřadu. Pro každou topografii musí být podána samostatná přihláška.

(2) Přihláška musí obsahovat: a) žádost o zápis do rejstříku topografií (dále jen "rejstřík"), s uvedením názvu topografie,

b) podklady umožňující identifikaci topografie, a případně i samotný polovodičový výrobek obsahující topografii,

c) datum prvního, nikoliv však skrytého obchodního využití topografie, je-li dřívější, než je datum podání přihlášky,

d) doklad o nabytí práva na ochranu topografie podle ustanovení § 4 a údaje svědčící o právu na ochranu topografie podle ustanovení § 6.

(3) Přihlašovatel je oprávněn některé z požadovaných podkladů umožňujících identifikaci topografie nebo jejich částí označit jako obchodní nebo výrobní tajemství; v tomto případě musí být tyto podklady předloženy v dalším vyhotovení, jehož příslušné části označené jako obchodní nebo výrobní tajemství jsou nečitelné. Jako obchodní nebo výrobní tajemství nemohou být označeny podklady jako celek.

(4) Úřad může stanovit bližší formální náležitosti přihlášky.

§ 8

Zápis topografie

(1) Splňuje-li přihláška podmínky stanovené v ustanovení § 7, zapíše Úřad topografii do rejstříku. Úřad vydá přihlašovateli, jehož topografie byla zapsána do rejstříku (dále jen "majitel topografie") osvědčení o zápisu topografie do rejstříku a zápis topografie do rejstříku oznámí ve Věstníku Úřadu průmyslového vlastnictví (dále jen "Věstník").

(2) Jestliže přihláška neodpovídá požadavkům uvedeným v ustanovení § 7, Úřad vyzve přihlašovatele, aby ve stanovené lhůtě nedostatky odstranil. Neodstraní-li přihlašovatel vytčené nedostatky ve stanovené lhůtě, Úřad řízení o přihlášce zastaví. Na tento důsledek musí být přihlašovatel při stanovení lhůty upozorněn. Týkají-li se nedostatky přihlášky náležitostí uvedených v ustanovení § 7 odst. 2 písm. a) až c), považuje se za datum podání přihlášky den, kdy tyto nedostatky byly odstraněny. Byla-li přihláška podána v rozporu s ustanovením § 6 a § 9 odst. 1 písm. a), Úřad přihlášku zamítne.

(3) Po zápisu topografie do rejstříku Úřad zpřístupní podklady uvedené v ustanovení § 7 odst. 2 třetím osobám k nahlédnutí. Pořizování výpisů z těchto podkladů není třetím osobám dovoleno. Podklady, které obsahují obchodní tajemství, 1b) je Úřad oprávněn zpřístupnit třetím osobám, jen jsou-li účastníky řízení o výmazu topografie z rejstříku podle § 13, nebo na základě příkazu soudu, jsou-li účastníky řízení o porušení práv podle § 10.

§ 9

Vznik a doba trvání ochrany

(1) Ochrana topografie vzniká a) ke dni prvního nikoli skrytého obchodního využití topografie, jestliže tato topografie byla předmětem řádné přihlášky podané u Úřadu ve lhůtě 2 let od tohoto využití, nebo

b) ke dni podání řádné přihlášky podle ustanovení § 7, jestliže topografie nebyla dříve obchodně využita (§ 11), popřípadě byla-li využita pouze skrytě.

(2) Doba trvání ochrany topografie skončí uplynutím 10 let od konce kalendářního roku, v němž tato ochrana vznikla.

(3) Zmeškání lhůty uvedené v odstavci 1 písm. a) nelze prominout.

Účinky ochrany

§ 10

(1) Bez souhlasu (licence) majitele topografie nikdo nesmí: a) reprodukovat topografii nebo její samostatně využitelné části a zhotovovat zobrazení topografie pro výrobní účely,

b) vyrábět polovodičový výrobek, ve kterém je chráněná topografie obsažena,

c) obchodně využívat topografii nebo polovodičový výrobek, který obsahuje chráněnou topografii nebo její samostatně využitelné části, jakož i zobrazení topografie sloužící k jeho výrobě, nebo je k tomuto účelu dovážet.

(2) Účinky ochrany lze vůči třetím osobám uplatnit až po zápisu topografie do rejstříku.

(3) Jestliže majitel topografie prokáže, že třetí osoba před datem uvedeným v § 9 odst. 1 topografii podvodně reprodukovala, obchodně využila, popřípadě ji za těmito účely dovezla, má právo se vůči této třetí osobě domáhat přiměřené náhrady.

§ 11

(1) Účinky ochrany topografie se nevztahují na a) činnosti prováděné k neobchodním účelům,

b) reprodukci topografie k účelům analýzy, výzkumu, vývoje nebo vzdělávání,

c) obchodní využití topografie, která byla vytvořena na základě analýzy, výzkumu nebo vývoje podle ustanovení písmene b), pokud tato další topografie odpovídá podmínkám stanoveným v § 1 odst. 1,

d) následné obchodní využívání topografie nebo polovodičového výrobku obsahujícího chráněnou topografii, uvedených do oběhu majitelem topografie nebo s jeho výslovným souhlasem.

(2) Účinky ochrany topografie se nevztahují na osobu, která v dobré víře získá polovodičový výrobek obsahující chráněnou topografii, uvedený do oběhu bez souhlasu majitele topografie. Od doby, kdy se tato osoba dozvěděla nebo lze důvodně předpokládat, že se dozvědět mohla, že tento výrobek obsahuje chráněnou topografii, je povinna zaplatit majiteli topografie na jeho žádost za další obchodní využívání tohoto výrobku přiměřenou náhradu, pro jejíž výši je rozhodný rozsah dalšího obchodního využívání.

Výmaz topografie

§ 13

(1) Úřad provede na návrh, který může podat každá osoba, výmaz topografie z rejstříku, a) není-li zapsaná topografie způsobilá k ochraně podle ustanovení § 1,

b) nebyla-li přihláška topografie podána ve lhůtě podle ustanovení § 9 odst. 1 písm. a) nebo právo na ochranu zaniklo podle ustanovení § 5,

c) byla-li přihlašovatelem nebo majitelem topografie osoba, která nemohla uplatnit právo na ochranu podle ustanovení § 6,

d) jestliže podklady podle ustanovení § 7 odst. 2 písm. b) neodpovídají polovodičovému výrobku přiloženému k přihlášce.

(2) Výmaz topografie z rejstříku má účinky, jako by topografie nebyla do rejstříku zapsána.

§ 14

(1) Návrh na výmaz topografie z rejstříku se podává u Úřadu písemně ve dvojím vyhotovení.

(2) Návrh na výmaz topografie z rejstříku musí být věcně odůvodněn a současně musí být předloženy důkazní prostředky, o které se návrh na výmaz opírá.

(3) Úřad vyzve majitele topografie, aby se k návrhu na výmaz topografie z rejstříku ve stanovené lhůtě vyjádřil. Majitel topografie předkládá své vyjádření k návrhu na výmaz písemně ve dvojím vyhotovení.

(4) Nevyjádří-li se majitel topografie ve stanovené lhůtě, Úřad provede výmaz topografie z rejstříku.

(5) Vyjádří-li se majitel topografie ve stanovené lhůtě proti návrhu na výmaz topografie z rejstříku, zašle Úřad jeho vyjádření navrhovateli výmazu a stanoví datum ústního projednávání návrhu.

(6) Neúčast účastníků řízení na stanoveném ústním projednávání návrhu na výmaz topografie z rejstříku není na překážku rozhodnutí Úřadu o návrhu.

(7) Vznikly-li Úřadu v řízení o výmaz topografie z rejstříku náklady na znalecký posudek, má Úřad právo na jejich náhradu vůči tomu účastníku řízení, který neměl ve věci úspěch.

§ 15

Odnětí ochrany a přepis

(1) Úřad na návrh odejme ochranu majiteli zapsané topografie, jestliže z rozhodnutí soudu zjistí, že mu právo na ochranu topografie ve smyslu ustanovení § 3 nepříslušelo.

(2) Návrh na odnětí ochrany podle odstavce 1 je oprávněna podat pouze osoba, které podle rozhodnutí soudu přísluší právo na ochranu topografie, nebo její právní nástupce.

(3) Na návrh osoby, které přísluší právo na ochranu topografie a která může uplatnit právo na ochranu podle ustanovení § 6, podaný do 1 měsíce od pravomocného rozhodnutí soudu, Úřad zapíše tuto osobu jako majitele topografie. Návrh na přepis majitele topografie je nutno doložit rozhodnutím soudu.

(4) Nebude-li podán návrh na přepis podle odstavce 3, Úřad provede výmaz topografie z rejstříku z moci úřední.

§ 16

Rejstřík a údaje o topografiích zveřejňované ve Věstníku

(1) Úřad vede rejstřík topografií, do něhož zaznamenává rozhodné údaje o přihláškách topografií a o zapsaných topografiích.

(2) Do rejstříku se u každé topografie zapisuje zejména: a) číslo zápisu (osvědčení);

b) datum zápisu;

c) datum zveřejnění zápisu topografie ve Věstníku;

d) název topografie;

e) datum podání přihlášky a její spisová značka, popřípadě datum prvního veřejného obchodního využití, je-li dřívější než datum podání přihlášky;

f) přihlašovatel topografie (jméno nebo název), jeho bydliště (sídlo), popřípadě jeho zástupce;

g) majitel topografie (jméno nebo název), sídlo (bydliště), popřípadě jeho zástupce;

h) převod topografie;

i) licence;

j) výmaz topografie;

k) odnětí ochrany, popřípadě její přepis;

l) zánik ochrany.

(3) Ve Věstníku zveřejňuje Úřad skutečnosti týkající se zapsaných topografií a další údaje týkající se ochrany topografií, jakož i úřední sdělení a rozhodnutí zásadní povahy.

§ 17

Úschova spisů

(1) Podklady umožňující identifikaci topografie podle ustanovení § 7 odst. 2 písm. b) Úřad uschovává po dobu 6 let od uplynutí doby ochrany.

(2) Jestliže přihláška nevedla k zápisu topografie do rejstříku, Úřad podklady podle ustanovení § 7 odst. 2 písm. b) uschovává 1 rok od data rozhodnutí o přihlášce.

(3) Po uplynutí lhůt uvedených v odstavcích 1 a 2 Úřad vyzve osobu zapsanou jako majitel topografie k převzetí podkladů; nepřevezme-li tato osoba podklady ve stanovené lhůtě, Úřad je zničí.

Ustanovení společná a závěrečná

§ 18

(1) Pro řízení před Úřadem platí správní řád s odchylkami uvedenými v tomto zákoně a s výjimkou ustanovení o ověřování plných mocí pro neurčitý počet řízení, 1) o možnosti volby několika společných zmocněnců, 1a) o prominutí zmeškání úkonu, 1b) o přerušení řízení, 1c) o lhůtách pro vydání rozhodnutí 1d) a o ochraně před nečinností, 1e) dále z ustanovení o zvláštnostech řízení o rozkladu ustanovení o složení rozkladové komise a o možném způsobu ukončení řízení o rozkladu1f) a dále ustanovení o účastnících řízení; 1g) ustanovení správního řádu o účastnících řízení podle zvláštního zákona1h) se však použijí.

(2) Pro práva spolumajitelů topografie, pro nucené licence a licenční smlouvy k využití topografie, pro převody topografií, pro zastupování v řízení před Úřadem, pro zápis topografií utajovaných podle zvláštních předpisů, pro opravné řízení se obdobně použije ustanovení zákona o vynálezech, průmyslových vzorech a zlepšovacích návrzích. 2)

(3) Proti pravomocnému rozhodnutí Úřadu je přípustná žaloba proti rozhodnutí podle zvláštního právního předpisu 3a).

(4) Za jednotlivé úkony podle tohoto zákona vybírá Úřad správní poplatky. 3)

§ 19

Podle tohoto zákona se poskytuje ochrana pouze topografiím, které byly vytvořeny po nabytí jeho účinnosti.

§ 20

Tento zákon nabývá účinnosti dnem 1. ledna 1992.

ACT

on the Protection of Topographies of Semiconductor Products

Subject of Protection

Section 1

(1) Protection under this Act shall apply to topographies of semiconductor products (hereinafter "topographies") that are the result of its creator’s own intellectual effort and which are not commonplace in the semiconductor industry. Protection under this Act shall also apply to the parts of topography that are independently usable and to representations used in manufacture of topographies.

(2) A topography consisting of commonplace elements shall be protected insofar as the combination of such elements meets the requirements of paragraph 1.

(3) Protection under paragraph 1 shall not apply to the technology used for producing the topography or for manufacturing the semiconductor product or to any information stored in the product.

Section 2

(1) For the purposes of this Act, a topography shall mean a series of interrelated images, fixed or coded in any manner, that represent a given three-dimensional arrangement of layers of which the product is made, where each image refers to a model of one layer of the semiconductor product or of a part thereof, or of a surface of the semiconductor product, or of a part thereof, at any individual manufacturing stage.

(2) For the purposes of this Act, a semiconductor product shall mean a final or intermediate form of a microelectronic product intended to fulfil an electronic function, consisting of a basic body containing a layer of a semiconducting material comprising at least one predetermined layer of conducting, insulating, or semiconducting material.

(3) For the purposes of this Act, the commercial exploitation shall mean the sale, rental, leasing, offer or any other method of commercial distribution of the topography or of the semiconductor product containing the topography or of the product containing the semiconductor product.

Right to Protection

Section 3

(1) The right to protection of the topography shall apply in favour of the creator or of his successor in title.

(2) If topography has been created in the course of employment or a similar relationship, the right to protection shall apply in favour of the employer or of the person by whom the topography has been commissioned, unless provided otherwise by contract.

Section 4

The right to protection of a topography shall be transferable.

Section 5

The right to protection of a topography shall expire after 15 years from the date of its creation, if the topography has not been commercially exploited, other than confidentially, or has not been filed with the Industrial Property Office (hereinafter "the Office").

Section 6

(1) The nationals of the Czech Republic, as well as persons having their residence or headquarters on the territory of a state being member of the World Trade Organisation, 1a can claim their right of protection; if the state, where the applicant has his residence or headquarters is not member of the World Trade Organisation, 1a the right of protection can only be awarded on condition of the reciprocity.

(2) If the persons referred to in Section 3 do not claim the right of protection, it can be claimed by persons, who with the exclusively authorisation by the person referred to in Section 3 have exploited as the first in the Czech Republic the topography, which has not yet been exploited anywhere in the world.

Application of Topography

Section 7

(1) Any person who wishes to apply for the right to topography protection (hereinafter "the applicant") shall file an application in writing in respect of the topography for which protection is sought (hereinafter "the application") with the Office. A separate application shall be filed for each topography.

(2) The application shall contain:

a) a request for registration in the Register of Topographies (hereinafter "the Register"), designating the title of the topography;

b) material identifying the topography, or the semiconductor product, which contains the topography;

c) statement of the date of the first public commercial exploitation of the topography, provided such date is earlier than the date on which the application has been filed;

d) documents establishing the right to topography protection under Section 4 and data giving evidence of the right to topography protection under Section 6.

(3) The applicant is entitled to declare some of the required material identifying the topography or its parts as trade or industrial secrets; in such case the file shall contain a separate copy of those documents, wherein the corresponding parts designated as trade or industrial secrets have been made illegible. The material may not be designated as a trade or industrial secret in its entirety.

(4) The Office shall be empowered to establish detailed requirements for the application.

Section 8

Topography Registration

(1) If the application complies with the requirements of Section 7, the Office shall record the application in the Register. The Office shall issue to the applicant whose topography has been recorded in the Register (hereinafter "the topography owner") a registration certificate and shall publish the registration of the topography in the Official Bulletin of the Industrial Property Office (hereinafter "the Bulletin").

(2) Where the application does not comply with the requirements of Section 7, the Office shall invite the applicant to remedy the defects within a prescribed time limit. If the applicant does not remedy the defects within the prescribed time limit, the Office shall terminate the procedure. The applicant shall already be notified thereof by the Office when the time limit for remedying the defect is set. If the defect concerns the requirements of Section 7 paragraph 2 letters a) to c), the date of receipt of the rectified application shall be deemed the date of the application. If the application has been filed contrary to the provisions of Section 6 and Section 9 paragraph 1 letter a), the Office shall refuse registration.

(3) When the topography has been recorded in the Register, the Office shall make the material referred to in Section 7 paragraph 2 available to third parties for direct inspection. Third parties shall not be permitted to copy or reproduce such materials or parts thereof. The Office can only make available documents containing a trade secret, 1b to third persons, if they are involved in the procedure on the cancellation of the topography from the Register according to Section 13, or based on the order of a court, if they are involved in the procedure on the infringement of rights under Section 10.

Section 9

Commencement and Duration of Protection

(1) Topography protection shall commence:

(a) on the date of the first commercial exploitation, other than confidential, of the topography, if the later has been duly filed with the Office within two years of such exploitation; or

(b) on the date of filing of regular application with the Office pursuant to the provisions of Section 7, provided the topography has not been previously exploited commercially (Section 11), other than confidentially.

(2) Protection of a topography shall expire 10 years from the end of the calendar year in which this protection came into existence.

(3) Failure to comply with the time limit stated in paragraph 1 letter a) may not be excused.

Effect of Protection

Section10

(1) Without the consent (license) of the topography owner, all persons shall be prohibited:

(a) from reproducing the topography or its independently usable parts, and from making representations of the topography for the purpose of manufacture;

(b) from producing the semiconductor product which contains the protected topography;

(c) from exploiting commercially the topography or the semiconductor product containing the protected topography or its independently usable parts or the representation of the topography, which serves for its manufacture or to import them for this purpose.

(2) The effects of protection can only be asserted with regard to third parties after the topography has been recorded in the Register.

3) If the owner of the topography proves that a third person, before the date referred to in Section 9 paragraph 1, fraudulently reproduced, commercially used, or imported the topography for these purposes, he is entitled to seek compensation against the third person.

Section 11

(1) The effect of topography protection shall not extend to:

a) activities carried out for non-commercial purposes;

b) reproduction of the topography for the purposes of analysis, research, development or teaching;

c) commercial exploitation of a topography that has been created as a result of analysis, research or development in accordance with letter b), above, if the new topography satisfies the requirements of Section 1 paragraph 1;

d) subsequent commercial exploitation of the topography or of a semiconductor product containing the protected topography, provided the topography or the product have been distributed by the topography owner or with his explicit consent.

(2) The effect of protection shall not extend to a person who acquires in good faith a semiconductor product containing a protected topography and distributed without the consent of the topography owner. From the date such person knows or there is a reasonable ground to believe that he can have known that the product contains the protected topography, the topography owner shall be entitled to claim reasonable compensation for continued commercial exploitation of the product; the extent of such exploitation shall determine the level of the compensation.

Cancellation of Topography

Section13

(1) The Office shall cancel a topography in the Register, at the request by any person:

a) if the registered topography does not qualify for protection under the provisions of Section 1;

b) if the application has not been filed within the time limit stated in Section 9 paragraph 1 letter a) or the right to protection has expired under Section 5;

c) if the applicant or the topography owner is not entitled to protection under Section 6;

d) if the material required according to the provisions of Section 7 paragraph 2 letter b) is at variance with the semiconductor product attached to the application.

(2) Cancellation of a topography in the Register shall have the same effect as if the topography had never been registered.

Section14

(1) A request for cancellation of the topography in the Register shall be filed in writing with the Office in duplicate.

(2) A request for cancellation of the topography shall contain material evidence and shall state the grounds on which it is based.

(3) The Office shall invite the topography owner to file observations concerning a request for cancellation of the topography within a time limit prescribed by the Office. The topography owner shall file observations in writing and in duplicate.

(4) If a topography owner does not file observations within the prescribed time limit, the Office shall cancel the topography in the Register.

(5) If a topography owner files observations concerning a request for cancellation of his topography within the prescribed time limit, the Office shall dispatch his observations to the person who requested the cancellation and shall set a date for oral proceedings.

(6) Non-attendance of participants at the oral proceedings concerning the requested cancellation of a topography in the Register shall not prevent the Office from reaching a decision in the matter.

(7) Should the Office incur some costs in connection with the proceedings concerning a request for cancellation of a topography, the Office shall be entitled to a reimbursement of such costs by the unsuccessful party.

Section15

Annulment of Protection and Transfer

(1) Upon request, the Office shall annul the protection extended to a topography if the Office establishes on the basis of a court ruling that the topography owner was not entitled to the right of protection under Section 3.

(2) The request under paragraph 1, above, may be filed only by a person who, according to the court ruling, is entitled to protection for the topography, or his successor in title.

(3) Upon request, filed within one month after the court ruling has become legally valid, by a person who is entitled to protection for the topography and who may claim a right to protection under Section 6, the Office shall register that person as the topography owner. A request for transfer of topography ownership must be supported by a court ruling.

(4) If no request for a change of topography ownership under paragraph 3, above, is filed, the Office shall cancel the topography in the Register ex officio.

Section 16

Register and Particulars of Topographies Published in the Bulletin

(1) The Office shall keep the Register of Topographies and enter therein the particulars of application and registered topographies.

(2) The following items shall be entered in the Register for each topography:

a) number of registration (certificate);

b) date of registration;

c) date of publication of registration of the topography in the Bulletin;

d) title of the topography;

e) filing date of the application, the identification reference or the first commercial exploitation of the topography, whichever is earlier;

f) applicant (name or company), residence (headquarters) and representative, where appropriate,

g) topography owner (name or company), headquarters (residence) and representative, where appropriate;

h) assignment of topography;

i) license;

j) cancellation of topography;

k) annulment of protection or transfer of ownership;

l)expiration of protection.

(3) The Office shall publish in the Bulletin all matters relevant to the registered topographies and additional data of importance for the protection of the topographies, as well as official statements and decisions of fundamental nature.

Section 17

Archiving of Documents

(1) The Office shall keep the documents that permit identification of topographies under Section 7 paragraph 2 letter b) for 6 years after expiration of protection.

(2) If a filed application does not result in recording of the topography in the Register, the Office shall keep the documents stated in Section 7 paragraph 2 letter b) for 1 year after the date on which the final decision on the application has been made.

(3) After the time limits stated in paragraphs 1 and 2, above, have elapsed, the Office shall invite the person registered as the topography owner to collect the documents; if that person does not comply, the Office shall destroy the documents.

Common and Final Provisions

Section 18

(1) The general statutory rules on administrative procedure shall apply to procedure before the Office, subject to the exceptions laid down by this Act and excluding the provisions on suspension of procedure, declarations of honour, time limits for decisions and measures in the event of failure to act. 1

(2) The provisions of the Act on Inventions, Industrial Design and Rationalisation Proposals 2 concerning the rights of co-owner(s) of a topography, compulsory licences and licensing agreements on exploitation of a topography, transfer of topographies, representation of persons in negotiations with and before the Office, termination of proceedings, registration of topographies kept secret according to special regulations, legal remedies, infringement of rights and right of information shall apply mutatis mutandis.

(3) The Office shall collect special fees for separate operations. 3

Section 19

Protection under this Act shall apply only to topographies created after entry into force of this Act.

Section 20

The Act shall enter into force on January 1, 1992.

Objet de la protection

1er. — 1) La présente loi confère une protection aux topographies de produits semi- conducteurs (ci-après dénommées “topographies”) qui sont le fruit de l’effort intellectuel de leurs créateurs et ne sont pas courantes dans le secteur des semi-conducteurs. Elle protège par ailleurs les parties d’une topographie qui peuvent être utilisées de manière indépendante ainsi que les représentations utiles à l’élaboration de topographies.

2) Une topographie constituée d’éléments courants n’est protégée que dans la mesure où la combinaison de ces éléments remplit les conditions énoncées à l’alinéa 1).

3) La protection conférée par l’alinéa 1) ne vise pas les techniques utilisées pour élaborer la topographie ou pour fabriquer le produit semi-conducteur ni les informations stockées dans le produit.

2. — 1) Aux fins de la présente loi, on entend par “topographie” une série d’images liées entre elles, fixées ou codées d’une manière quelconque, qui représente une configuration tridimensionnelle donnée des couches dont le produit semi-conducteur est composé, chaque image reproduisant le modèle d’une couche du produit, ou d’une partie de celle-ci, ou celui d’une surface du produit ou d’une partie de celle-ci, à n’importe quel stade de la fabrication.

2) Aux fins de la présente loi, on entend par “produit semi-conducteur” la forme finale ou intermédiaire d’un produit microélectronique destiné à remplir une fonction électronique, celui-ci étant composé d’un substrat de base comportant une couche de matériau semi- conducteur et d’au moins une autre couche de matière conductrice, isolante ou semi- conductrice disposée conformément à une configuration prédéterminée.

Droit à la protection

3. — 1) Le droit à la protection d’une topographie est accordé au créateur ou à son ayant cause.

2) Si une topographie a été créée dans le cadre d’un contrat de travail ou d’une relation similaire, le droit à la protection est accordé à l’employeur ou à la personne qui a commandé la topographie, sauf dispositions contraires du contrat.

4. Le droit à la protection d’une topographie est transmissible.

5. Le droit à la protection s’éteint à l’expiration d’un délai de 15 ans à compter de la date de création de la topographie, si celle-ci n’a pas été exploitée à des fins commerciales, autrement que de façon confidentielle, ou n’a pas été enregistrée auprès de l’Office fédéral pour les inventions (ci-après dénommé “l’office”).

6. — 1) Tout ressortissant tchécoslovaque et toute personne ayant sa résidence habituelle ou son siège sur le territoire de la République fédérale tchèque et slovaque peut faire valoir un droit à la protection de ses topographies.

2) Les personnes n’ayant pas leur résidence habituelle ou leur siège sur le territoire de la République fédérale tchèque et slovaque peuvent faire valoir un droit à la protection de leurs topographies uniquement sous réserve de réciprocité.

7. — 1) Toute personne désirant faire valoir un droit à la protection de ses topographies (ci-après dénommé le “demandeur”) dépose par écrit, auprès de l’office, une demande portant sur la topographie à protéger (ci-après dénommée la “demande”). Une demande distincte doit être déposée pour chaque topographie.

2) La demande doit contenir

a) une demande d’inscription au registre des topographies (ci-après dénommé le “registre”), indiquant le titre de la topographie,

b) les pièces permettant d’identifier la topographie, ou le produit semi-conducteur proprement dit contenant la topographie,

c) la date de la première exploitation commerciale, non confidentielle, de la topographie, à condition que cette date soit antérieure à la date du dépôt de la demande,

d) les documents établissant un droit à la protection de la topographie au titre de l’article 4 ainsi que les données prouvant l’existence d’un droit à la protection en vertu de l’article 6.

3) Le demandeur est autorisé à désigner certaines des pièces requises pour identifier la topographie, ou des parties de celles-ci, comme contenant des secrets commerciaux ou industriels; dans ce cas, le dossier contiendra une copie à part de ces documents, dans laquelle les parties désignées comme contenant des secrets commerciaux ou industriels auront été rendues illisibles. Lesdits documents ne peuvent pas être désignés dans leur ensemble comme relevant du secret commercial ou industriel.

4) L’office est habilité à énoncer les conditions précises à remplir pour déposer la demande.

Enregistrement

8. — 1) Si la demande satisfait aux conditions énoncées à l’article 7, l’office l’inscrit au registre. L’office délivre au demandeur dont la topographie a été inscrite au registre (ci-après dénommé le “propriétaire de la topographie”) un certificat d’enregistrement et publie l’enregistrement de la topographie dans le bulletin officiel de l’Office fédéral pour les inventions (ci-après dénommé le “bulletin”).

2) Lorsque la demande ne remplit pas les conditions énoncées à l’article 7, l’office invite le demandeur à remédier aux irrégularités de celle-ci dans un délai prescrit. Si le demandeur ne s’exécute pas dans le délai fixé, l’office met un terme à la procédure. L’office en avise déjà le demandeur au moment où le délai pour remédier aux irrégularités est fixé. Si ces irrégularités portent sur les conditions énoncées à l’article 7.2)a) à c), la date de réception de la demande rectifiée est réputée être la date de la demande. Si la demande a été déposée en violation des dispositions de l’article 6 et de l’article 9.1)a), l’office refuse de procéder à l’enregistrement.

3) Lorsque la topographie a été inscrite au registre, l’office met les pièces mentionnées à l’article 7.2) à la disposition des tiers pour que ceux-ci puissent les consulter directement. Les tiers ne sont pas autorisés à copier ni à reproduire des documents ou des parties de ceux- ci.

Point de départ et durée de la protection

9. — 1) La protection d’une topographie prend naissance

a) à la date de la première exploitation commerciale, non confidentielle, de la topographie, si cette dernière a fait l’objet d’une demande d’enregistrement dûment déposée auprès de l’office dans les deux ans qui suivent cette première exploitation, ou

b) à la date de dépôt d’une demande régulière auprès de l’office conformément aux dispositions de l’article 7, à condition que la topographie n’ait pas été exploitée auparavant à des fins commerciales (article 11), autrement que de façon confidentielle.

2) La protection d’une topographie s’éteint à l’expiration d’un délai de 10 ans à compter de la fin de l’année civile de la création de celle-ci.

3) Aucune excuse ne peut être invoquée pour justifier l’inobservation du délai fixé à l’alinéa 1)a).

Effets de la protection

10. — 1) Sauf si le propriétaire de la topographie a donné son consentement (ou concédé une licence), il est interdit à quiconque de

a) reproduire la topographie ou les parties de celle-ci qui peuvent être utilisées de manière indépendante, ainsi que faire des représentations de la topographie en vue de son élaboration,

b) fabriquer le produit semi-conducteur qui contient la topographie protégée,

c) exploiter à des fins commerciales la topographie ou le produit semi-conducteur contenant la topographie protégée ou les parties de celle-ci qui peuvent être utilisées de manière indépendante, ou encore la représentation de la topographie qui sert à son élaboration.

2) Les effets de la protection ne sont opposables aux tiers qu’après que la topographie a été inscrite au registre.

11. — 1) Les effets de la protection d’une topographie ne s’étendent pas

a) à des activités menées à des fins non commerciales,

b) à la reproduction d’une topographie à des fins d’analyse, de recherche, de développement ou d’enseignement,

c) à l’exploitation commerciale d’une topographie dont la création est l’aboutissement de travaux d’analyse, de recherche ou de développement au sens du sous-alinéa b), si la nouvelle topographie satisfait aux conditions énoncées à l’article 1.1),

d) à l’exploitation commerciale ultérieure de la topographie ou d’un produit semi- conducteur contenant la topographie protégée, à condition que la topographie ou le produit ait été distribué par le propriétaire de la topographie ou avec le consentement formel de ce dernier.

2) Les effets de la protection ne s’étendent pas à une personne qui a acquis de bonne foi un produit semi-conducteur contenant une topographie protégée, distribué sans le consentement du propriétaire de la topographie. À compter de la date à laquelle cette personne a connaissance du fait que le produit contient la topographie protégée, le propriétaire de celle- ci a le droit d’exiger un dédommagement équitable si la personne en question continue à exploiter le produit à des fins commerciales; l’étendue de cette exploitation détermine le montant de la compensation.

Licences obligatoires

12. — 1) Lorsqu’aucun accord de licence n’a pu être conclu pour l’exploitation d’une topographie protégée, l’office peut accorder une licence obligatoire, à condition qu’un intérêt public important soit menacé.

2) L’octroi d’une licence obligatoire n’a pas d’incidence sur le droit du propriétaire de la topographie d’obtenir un dédommagement en fonction de la valeur de la licence.

Radiation de l’enregistrement d’une topographie

13. — 1) L’office radie une topographie du registre à la demande de quiconque

a) si la topographie enregistrée ne remplit pas les conditions de protection prévues à l’article premier,

b) si la demande n’a pas été déposée dans le délai fixé à l’article 9.1)a) ou si le droit à la protection a expiré conformément aux dispositions de l’article 5,

c) si le demandeur ou le propriétaire de la topographie n’a pas droit à la protection en vertu de l’article 6,

d) si les pièces qui sont remises conformément aux dispositions de l’article 7.2)b) ne correspondent pas au produit semi-conducteur joint à la demande.

2) La radiation d’une topographie du registre a le même effet que si ladite topographie n’avait jamais été enregistrée.

14. — 1) Les requêtes en radiation de topographies du registre doivent être déposées auprès de l’office par écrit et en double exemplaire.

2) Les requêtes en radiation de topographies doivent contenir des éléments de preuve substantiels et indiquer les motifs sur lesquels elles sont fondées.

3) L’office invite les propriétaires de topographies à déposer des observations concernant les requêtes en radiation de topographies dans le délai qu’il prescrit. Les propriétaires de topographies doivent formuler leurs observations par écrit et en double exemplaire.

4) Si le propriétaire d’une topographie ne dépose pas ses observations dans le délai prescrit, l’office radie la topographie du registre.

5) Si le propriétaire d’une topographie dépose dans le délai prescrit des observations concernant une requête en radiation de sa topographie, l’office communique lesdites observations à la personne qui a demandé la radiation et fixe une date pour l’audition des parties.

6) L’absence des parties à l’audience portant sur la requête en radiation d’une topographie du registre n’empêche pas l’office de rendre une décision sur l’affaire.

7) Si l’office encourt des frais dans le cadre de la procédure relative à une requête en radiation d’une topographie, il a le droit d’exiger de la partie perdante le remboursement des frais en question.

8) L’office accorde à la partie qui obtient gain de cause le droit au remboursement de tous frais que celle-ci a engagés pour faire valoir ou défendre ses droits, à condition qu’elle dépose une demande à cet effet avant que la décision finale ne soit rendue sur l’affaire.

Annulation de la protection et changement de propriétaire

15. — 1) Sur demande, l’office annule la protection conférée à une topographie s’il constate sur la base d’une décision de justice que le propriétaire de la topographie n’avait pas droit à une protection au titre de l’article 3.

2) Une demande au titre de l’alinéa 1) ne peut être déposée que par une personne qui, conformément à la décision de justice, a droit à une protection pour la topographie, ou par l’ayant cause de cette personne.

3) Sur demande présentée dans un délai d’un mois à compter de l’entrée en vigueur de la décision de justice par une personne qui a droit à une protection pour la topographie et qui peut faire valoir un droit à la protection en vertu de l’article 6, l’office inscrit cette personne au registre en tant que propriétaire de la topographie. Une demande de changement du propriétaire d’une topographie doit être étayée par une décision de justice.

4) Si aucune demande de propriétaire n’est présentée en vertu de l’alinéa 3), l’office radie d’office la topographie du registre.

Registre des topographies et renseignements publiés dans le bulletin

16. — 1) L’office tient le registre des topographies et y inscrit les renseignements relatifs aux demandes et aux topographies enregistrées.

2) Les éléments ci-après doivent être inscrits au registre pour chaque topographie :

a) le numéro de l’enregistrement (certificat);

b) la date de l’enregistrement;

c) la date de publication de l’enregistrement dans le bulletin;

d) le titre de la topographie;

e) la date de dépôt de la demande, celle de la référence d’identification ou celle de la première exploitation commerciale de la topographie, la première de ces dates étant retenue;

f) le nom du demandeur (nom de la personne ou de la société), sa résidence (son siège) et son représentant, le cas échéant;

g) le nom du propriétaire de la topographie (nom de la personne ou de la société), sa résidence (son siège) et son représentant, le cas échéant;

h) la cession de la topographie;

i) les licences;

j) la radiation de l’enregistrement de la topographie;

k) l’annulation de la protection ou le changement de propriétaire;

l) l’expiration de la protection.

3) L’office publie dans le bulletin toutes les informations relatives aux topographies enregistrées et les données supplémentaires revêtant de l’importance pour la protection des topographies, ainsi que toutes communications et décisions officielles fondamentales.

Archivage des documents

17. — 1) L’office conserve les documents permettant d’identifier les topographies qui sont mentionnés à l’article 7.2)b) pendant une période de six ans après l’expiration de la protection.

2) Si le dépôt d’une demande n’aboutit pas à l’inscription de la topographie au registre, l’office conserve les documents mentionnés à l’article 7.2)b) pendant une période d’un an à compter de la date à laquelle la décision finale a été prise au sujet de la demande.

3) Une fois que les délais établis aux alinéas 1) et 2) se sont écoulés, l’office invite la personne inscrite en tant que propriétaire de la topographie à reprendre les documents; si l’intéressée ne donne pas suite à cette invitation, l’office détruit les pièces en question.

Dispositions communes et finales

18. — 1) La législation générale sur la procédure administrative est applicable à la procédure se déroulant devant l’office, sous réserve des exceptions prévues par la présente loi et à l’exclusion des dispositions relatives à l’ajournement de la procédure, aux déclarations sur l’honneur, aux délais impartis pour rendre des décisions et aux mesures en cas d’inaction1.

2) Les dispositions de la loi sur les brevets2 relatives aux droits des copropriétaires d’une topographie, à l’enregistrement des accords de licence concernant l’exploitation d’une topographie, à la cession de topographies, à la représentation de personnes dans des négociations engagées avec ou devant l’office, à l’abandon d’une procédure, à l’enregistrement de topographies tenues secrètes conformément à un règlement spécial, aux voies de recours et aux violations des droits sont applicables mutatis mutandis.

3) L’office perçoit des taxes particulières pour chaque opération3.
