Notifications

The Estonian Patent Office notified in accordance with paragraphs 10 and 12 of the Framework Provisions that it would commence operation as both a depositing Office and an accessing Office with effect from 01 January 2017.

The legal basis for recognition of priority documents made available through the service is §21 Section 4 of the Patents Act (version from 01.01.2015).

Following consultation with the International Bureau on 20.09.2016, the scope of the Office’s participating digital library which it makes available as a depositing Office is as follows:

  • All national patent and utility model applications filed at the Office on and after 01.01.2017 which the applicant specifically requests be made available to the service

As an accessing Office, the Office will recognize priority documents available to it through the service for the purposes of any application for which the time for furnishing the priority document has not expired by 01.01.2017.

Technical arrangements

  • All documents and information will be exchanged black and white and in PDF format over PCT-EDI as priority documents
  • As an Accessing Office, the Office will accept color documents in PDF format.

Practical information

  • A request to the Office to make an application available through the service may be made by using intended Request Form, available from the Office website or by sending a letter clearly stating the relevant application number and indicating that it should be made available to WIPO Digital Access Service;
  • To request the Office as accessing Office to retrieve the document from the service, the applicant should check the relevant box next to the priority claim on the application form or send a letter to the Office.
  • The Estonian national applications hosted in the library will have the number format as country code EE following the letters/numbers PYYYYNNNNN or UYYYYNNNNN for patent and utility model applications respectively.
