Protection of Plant Varieties and Farmers' Rights (Third Amendment) Rules, 2009

NOTIFICATION

New Delhi, the 17th December, 2009

G.S.R. 901(E). In exercise of the powers conferred by Section 96 of the Protection of Plant Varieties and Farmers Rights Act, 200I (53 of 2001), the Central Government hereby makes the following rules to amend the Protection of Plant Varieties and Farmers' Rights Rules, 2003.namely:

1. (1) These rules may be called the Protection of Plant Varieties and Farmers Rights (Third Amendment) Rules. 2009.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Protection of Plant Varieties and Farmers Rights Rules, 2003;-

(a) in the Second Schedule, in column (3),-

(i) against serial number 4, for the entries, the following entries shall be substituted. namely,-

Individual - Rs. 5.000

Educational - Rs. 7,000

Commercial - Rs. 10.000;

(ii) against serial number 5, for the entries, the following entries shall be substituted. namely,-

Individual - Rs.5,000

Educational -Rs.7.000

Commercial - Rs. 10,000 per years;

(iii) against serial number 8, for entries, the following entries shall be substituted, namely,-

Individual - Rs. 3.000

Educational - Rs. 5,000

Commercial - Rs. 7.000;

(b) in the Fourth Schedule,-

(i) against serial number 2, relating to the post of Legal Adviser, in column (4), for the existing entry, the following entry shall be substituted namely - Under Secretary;

(ii) the entry at serial number 4, relating to the post of Accounts Officer shall be omitted;

(iii) against serial number 5, relating to the post of Technical Assistant, in column (3), for the existing entry, the following entry shall be substituted, namely,- 1;

(iv) against serial number 6, relating to the post of Computer Assistant in column (3), for the existing entry, the following entry shall be substituted, namely,- 6.
