TITLE: DETERMINATION OF FEES FOR: A) PHOTOGRAPHY FILMING VIDEO RECORDING IN MUSEUMS, MONUMENTS AND ARCHAEOLOGICAL SITES, B) PUBLISHING PHOTOGRAPHS OF ARCHAEOLOGICAL CONTENT FOR COMMERCIAL EXPLOITATION C) ELECTRONIC PUBLISHING, D) USE OF IMAGES OVER THE INTERNET E) EVENTS IN ANCIENT THEATERS AND OTHER ARCHAEOLOGICAL SITES. F) PROCEDURE FOR PAYING FEES FOR IMPRESSIONS, COPIES AND ILLUSTRATIONS OF IMMOVABLE AND MOVABLE MONUMENTS THAT BELONG TO THE STATE. G) PROCEDURE FOR PAYING FEES FOR THE USE OF IMMOVABLE AND MOVABLE MONUMENTS ON A LOGO.

ARTICLE 0

We hereby approve the determination of fees in favour of the Archaeological Receipts Fund for a) photography filming video recording in Museums, Monuments and Archaeological sites, b) publishing of photographs of archaeological content for commercial exploitation c) electronic publishing, d) the use of images over the Internet and e) fees from events in ancient theatres and other archaeological sites Also, we approve the observance of a specific procedure for paying fees for impressions, copies and illustrations of immovable and movable monuments that belong to the State, as well the observance of procedures for paying fees for the use of immovable and movable monuments on a logo. According to following, their implementation will be in force after the promulgation of this order. The order is as follows:

1.1. PHOTOGRAPHY

1.1.1. Photography with a simple portable amateur camera without flash in Museums, accessible Archaeological Collections and Archaeological Sites is permitted for free, provided that the photographs are not intended for professional use.

1.1.2. Photography with a simple portable amateur camera with flash or incorporated flash as well as holographic photography in Archaeological Sites, Monuments, Museums and Archaeological Collections without permission is prohibited.

1.1.3. For photography with a professional camera without the interference of persons,

photography fees are paid as follows:

I. Archaeological Sites: 300 Euros daily for every Archaeological site.

II.
Museums and Archaeological Collections.
a.
When no items are moved or no display cases are opened, the fee is 20 Euros per item with no power supply and 25 Euros per item with power supply.
b.
When items are moved or display cases are opened, the fee is 70 Euro per item with no power supply and 100 Euro per item with power supply.

III. General photographs of individual Monuments in Archaeological Sites as well as in the interior or the yard of Archaeological Museums and Archaeological Collections, without focusing individual items: 160 Euros daily.

1.1.4. For photography with a professional camera for commercial and advertising purposes with persons’ interference, in Archaeological Sites, Monuments and Museums, photography fees amounting to1000 Euros daily are paid for every Archaeological Site or Museum. Fees can be increased, as the case may be and as the Archaeological Councils deem proper, provided that the required license is granted.

1.1.5. For aerial photography of monuments and archaeological sites, the lowest fees paid are 600 Euros daily for every monument and 1,000 Euros for every archaeological site.

1.1.6. For submarine photography of antiquities, the lowest fees paid are 1,200 Euros daily. The aforementioned fees of par. 1.1.5 and 1.1.6 can be increased, as the case may be and the Archaeological Councils deem proper. The aforementioned photographs of par. 1.1.5 and

1.1.6 are carried out according to the terms and conditions determined by the competent Ephorates of Antiquities or the Archaeological Councils.

1.1.7. For photography concerning the publication of a scientific guide for Museums, Collections, Monuments and Archaeological Sites that are carried out by Universities and Archaeological Institutions, a lump sum is paid after the recommendation of the Council.

1.2. FILMING VIDEO RECORDING 1.2.1. Video recording in Museums and Archaeological Sites with ½ inch VHS amateur

cameras or with cameras is allowed for free, provided that the videotapes or the digital recordings shall not be used for professional purposes.

1.2.2. Holographic filmingvideo recording in Museums and Accessible Archaeological Collections, Monuments and Archaeological sites is prohibited.

1.2.3. For films of cultural and informational content (documentaries) and films, which are intended for educational programs with or without a narrator, the following fees are paid:

I. Archaeological Sites and Monuments: 150 Euros daily for every Site or Monument.

II. Museums and Archaeological Collections: 100 Euros daily for every Museum or Archaeological Collection. Especially for the Archaeological Sites of Acropolis in Athens, Olympia, Delphi, Epidavros, Delos, Corinth, Mystras, Mycenae, Knossos and Pheastos, a daily fee of 250 Euro is paid for every site. Especially for the Acropolis Museum of Athens, the National Archaeological Museum, the Byzantine and Christian Museum of Athens, the Museum of Ceramicos, the Museum Olympia (new), the Olympic Games Museum (Olympia), the Museum Delphi, the Museum Epidavros, the Museum Mycenae, the Archaeological Museum of Thessaloniki, the Museum of Byzantine Culture (Thessaloniki) and the Museums of Volos, Delos and Heraklion, a fee of 170 Euros is paid for every museum.

1.2.4. For films in which persons participate, even one (1) person, since the site is used as scenery and not as a part of the film’s theme, the following fees are paid:

Archaeological Sites and Monuments: 1,000 Euros daily for every Archaeological Site or Monument.
II.
Museums and Archaeological Collections: 1,000 Euros daily for every Museum or accessible Archaeological Collection. Especially for the Archaeological Sites of Acropolis in Athens, Olympia, Delphi, Epidavros, Delos, Corinth, Mystras, Mycenae, Knossos and Pheastos, a daily fee of 250 Euro is paid for every site. Especially for the Acropolis Museum of Athens, the National Archaeological Museum, the Byzantine and Christian Museum of Athens, the Museum of Ceramicos, the Museum Olympia (new), the Olympic Games Museum (Olympia), the Museum Delphi, the Museum Epidavros, the Museum Mycenae, the Archaeological Museum of Thessaloniki, the Museum of Byzantine Culture (Thessaloniki) and the Museums of Volos, Delos and Heraklion, a fee of 170 Euros is paid for every museum. In case none of the shootings carried out in a specific Site, Monument, Museum or Archaeological Collection includes persons, the fees paid are 25% less.
1.2.5. For filming / video recordings for advertising purposes with or without intervention of

persons in Archaeological Sites and Monuments, a fee of 400 Euros is paid daily for every Site or Monument.

1.2.6. For aerial filming video recording of Archaeological Sites and Monuments, the lowest daily fee paid is 1,000 Euros.

1.2.7. For submarine filming video recording of antiquities, the lowest daily fee paid is 1,200 Euros. The aforementioned filming video recordings of par. 1.2.6 and 1.2.7 are carried out according to the terms and conditions determined by the competent Ephorates of Antiquities or the Archaeological Councils, as the case may be. The narrated texts or the texts describing the direction that accompany the films of all of the above categories, are submitted for check and approval to the competent Ephorate of Antiquities or the Museum, before issuing the license. The license is granted from the competent Ephorate of Antiquities or the Museum or following the opinion of the Local or Central Archaeological Council, as the case may be. The fees for films of all the abovementioned categories may be increased, as the case may be and as the Central Archaeological Council deems proper, depending on the number of the Archaeological Sites and Monuments where the filming will be carried out or the duration of the shootings, the interference of persons and whether the films are made for wide commercial exploitation. An increase of the fees can also be imposed by the Central Archaeological Council for advertising films, provided that the relevant license has been granted.

1.3. EXEMPTION FROM THE PAYMENT OF FEES

1.3.1. The following are exempted from the payment of fees: a. Photography of excavations and their findings when they are carried out by the excavators and the funding institutions or by scientists, for studies and scientific publications (l. 1947/1939 article 13. par. 5 and 3028/02 article 46). B. Photography by Greek or foreign scientists serving clearly scientific and educational reasons such as the documentation of archaeological surveys.

1.3.2. The following are exempted from the payment of fees for filmingvideo recording:
a.
Cinematographic documentation of excavations, reconstructions and other archaeological works, when they are carried out from the excavators or by the funding institutions or by scientists, for studies and scientific publications (l. 1947/1939 article 13. par. 5 and 3028/02 article 46).
b.
Cinematographic productions of any kind by the Ministry of Culture.
c.
Films of paragraph 1.2.3. (documentaries) produced by the Hellenic State Television or by

any other public organization and the their producers with external association, provided there is assignment of the work by the organization, as well as films of paragraph 1.2.3. (documentaries) produced by any state Television of the Member States of the European Union.

d.
Filmingvideo recordings of paragraph 1.2.3. (documentaries) carried out by International Institutions and foreign public organizations, provided that the film advertises Greece in foreign countries.
e.
Films produced or coproduced by the Greek Film Center are exempted from the payment of fees by 50%.
    1. PROCEDURE FOR GRANTING A LICENSE FOR PHOTOGRAPHYFILMINGVIDEO RECORDING IN MUSEUMS, ARCHAEOLOGICAL COLLECTIONS, MONUMENTS AND ARCHAEOLOGICAL SITES
    2. Prior to the realization of professional photography, filming and video recordings in Museums, Archaeological Collections and Archaeological Sites, as well as for photographs, filming and video recordings by air or underwater, a relevant license is needed to be issued by the competent Ephorates of Antiquities, Museums or the Archaeological Councils as the case may be, as well as the payment of fees in favor of the ARF (Archaeological Receipts Fund). The aforementioned license is granted after the submission of the relevant application from the interested parties in the special documents of the Service and the submission of the textscript.
  1. DEFINITION OF PUBLICATION FEES, SLIDES, TRANSPARENCIES AND OTHER IMAGES’ REPRESENTATIONS OF ARCHAEOLOGICAL CONTENT FOR COMMERCIAL USE.
2.1. PRINTED EDITIONS AND OTHER USES APART FROM ELECTRONIC TITLES:
a.
Books and high circulation imprints, such as: encyclopedias, dictionaries, archaeologicaltourist guides, historical and archaeological books, art books, educationalarchaeological books and periodicals, etc., 100 euros per photograph or slide or transparency.
b.
Slide transparency of 35mm for projection, educational films, informative audiovisual

television programs etc., 70 euros per photograph, slide or transparency.

c.
Leaflets, posters, diaries, photo albums, book and disc covers, full page photographs incorporated in books etc., 200 euros per photograph or slide (transparency).
d.
Use for advertising reasons, such as: brands, labels, stamps on clothing, advertisements in the Mass Media, etc., 3200 euros per photograph or slide (transparency)

2.1.1. The above fees of par. a) to d) per photograph or slide (transparency) etc., cover the rights for the specific use described in the submitted application in the competent Ephorate of Antiquities or Museum for granting the relevant license. For every new use of the same photograph or slide or transparency, a new application for granting the relevant license is submitted and the proportional fees as the case may be are paid in favor of the ARF. More specifically, the digital processing of photographs or slides etc., in a data carrier containing images of archaeological content for any purpose without a license, is prohibited.

2.1.2. The fees prescribed in par. 2.1.a) cover one (1) period of publication and the distribution rights of the edition in one (1) language in the country of its publication. If the same edition circulates in the country of its publication in more than one (1) languages, the publishing fees per photograph or slide (transparency) are increased by 20% for every additional language. For the distribution of the edition in countries beyond the country of its publication, the fees per photograph or slide (transparency) are increased as follows:

in two (2) to ten (10) countries: a. in the same language an increase by 50% b. in more than one (1) languages an increase by 100%

in eleven (11) and more countries: a. in the same language an increase by 300% b. in more than one (1) languages an increase by 500%. For any republication of the same book, new publication fees are paid which are defined in the amount of 50% of the fees standing at the time of republication.

2.1.3. The fees prescribed in par. 2.1.b) to 2.1 d) per photograph or slide (transparency) cover the use rights for two (2) years. For renewing the same use, new fees are paid, which are defined at the amount of 50% of the respective fees standing at the time of the new use.

2.1.4. The above fees for publication of photographs, slides or transparencies etc., of a data carrier containing images of archaeological content of par. 2.1, are paid for the use of photographic material files inside and outside Greece, if they illustrate items of Greek Archaeological Museums and accessible Archaeological Collections, Monuments and

Archaeological Sites of Greece.

2.1.5. For publishing photographs, slides (transparencies) etc., of a data carrier containing

images of archaeological content (items of Greek Archaeological Museums and Archaeological Collections, Monuments and Archaeological Sites of Greece), a notification of the antiquities origination is needed, which is stated as follows:

by the title of the Museum or the Archaeological Collection (for the exhibits) or the competent Ephorate of Antiquities (for Monuments/ Archaeological Sites)

by the title MINISTRY OF CULTURE ARCHAEOLOGICAL RECEIPTS FUND stating the service that has the COPYRIGHT and collects publication fees.

2.1.6. As archaeological items subjected to publication fees are meant to be exhibits of Archaeological Museums and accessible Archaeological Collections under the Administration of Museums, Exhibitions and Educational Programs, Archaeological Sites Ancient and Byzantine Monuments under the Administrations of Prehistoric and Classical Antiquities and Byzantine / Posterior Byzantine Antiquities and in general movable and immovable monuments that are protected by the standing legislation on protection of antiquities and cultural heritage.

2.1.7. EXEMPTION FROM THE PAYMENT OF FEES

The following are exempted from the payment of fees according to par. 2.1, in favor of the ARF: a. Editions of Greek State organizations in all levels of Education and the relevant State organizations of the states of the European Union, serving exclusively teachingeducational purposes.

b.
Scientific works of Greek or foreign scientists and periodical editions of Greek or foreign nonscientific institutions that circulate in limited number of copies (up to 3,000 copies) with essential purpose their circulation in special scientists in order to facilitate scientific research.
c.
Transparencies that are used in educational programs advertising the Greek cultural heritage by the Greek State Television or the State Televisions of the European Union States, in order to support their production.
2.2. ELECTRONIC PUBLICATIONS (ELECTRONIC TITLES)

Pursuant to the provisions of the standing legislation about publishing photographs, slides, transparencies etc., of a data carrier containing images of archaeological content (visual content) in Electronic Publications of any kind, such as: CDROM, CDVIDEO, CDI, PHOTOCD, DVD etc..( �/span> with essential purpose the distribution of information with cultural content of broad archaeological knowledge (such as, indicatively: archaeologicalhistorical editions, art

editions, editions with educational features, archaeologicaltourist guides, tourist enterprises 

guides, encyclopedias, dictionaries, games, albums etc..( �/span> authorization of the Minister of Culture after a dictum by the Archaeological Council, is required.

2.2.1. Publication fees of images containing archaeological content in electronic titles (fees of electronic title) are defined per country/countries of publication, per country/countries of distribution, per number of copies and number of images, as follows: A Countries of Electronic Title’s Publication:

I. Publication in one (1) state of the European Union (apart from Greece)

a.
For a number of copies of 1 to 3,000 visual content: the first 1100 images: 70 Euros per image visual content: the next 101500 images: 60 Euros per image visual content: the next 5011000 images: 50 Euros per image visual content: the next 10012000 images: 40 Euros per image visual content: the next 20013000 images: 30 Euros per image
b.
For a number of copies of 3001 to 6000 visual content: the first 1100 images: 100 Euros per image visual content: the next 101500 images: 90 Euros per image visual content: the next 5011,000 images: 85 Euros per image visual content: the next 1,0012,000 images: 75 Euros per image visual content: the next 2,0013,000 images: 65 Euros per image
c.
For a number of copies more than 6,001: visual content: the first 1100 images: 160 Euros per image visual content: the next 101500 images: 150 Euros per image visual content: the next 5011,000 images: 140 Euros per image visual content: the next 1,0012,000 images: 130 Euros per image

visual content: the next 2,0013,000 images: 110 Euros per image

CLARIFICATIONS:

The above fees of Electronic title per image cover the individual illustration of one (1) item of a Museum or Collection or one (1) Monument or Site in static form.

For static illustrations of items groups of Museums, Collections, Monuments and Archaeological Sites (general shootings), the fees per image are tripled.

if the visual content of the Electronic title is coming from video recorded or filmed shootings in Museums, Collections, Monuments and Archaeological Sites in part or as a whole, fees are defined as follows:

a.
For a number of copies of 1 to 3,000 visual content of duration up to 15': 3,000 Euros visual content of duration up to 30': 4,000 Euros visual content of duration up to 45': 5,000 Euros visual content of duration up to 60': 6,000 Euros visual content of duration over 60': 12,000 Euros
b.
For a number of copies of 3001 to 6,000 visual content of duration up to 15': 4,000 Euros visual content of duration up to 30': 5,000 Euros visual content of duration up to 45': 6,000 Euros visual content of duration up to 60': 7,000 Euro visual content of duration over 60': 14,000 Euros
c.
For a number of copies more than 6,001: visual content of duration up to 15': 4,000 Euros visual content of duration up to 30': 5,000 Euros visual content of duration up to 45': 6,000 Euros 

visual content of duration up to 60': 7,500 Euros 

visual content of duration over 60': 14,500 Euros

II. For Greece and for the Greek productions only, the above standing prices are reduced by 30% in order to encourage the implementation and development of modern technology in the wide distribution of the Hellenic civilization, as well as the domestic production of electronic products with a wide content of archaeological knowledge.

III.
For all other countries (apart from the European Union states) is defined the double amount of the above fees. Coproductions:
a.
Electronic title publication in Greece with coproduction of Greeks and Europeans: The above standing prices are reduced by 20%.
b.
Electronic title publication in Greece with coproduction of Greeks and others apart from Europeans: The above standing prices are reduced by 10%.

B Publication Languages of an Electronic Title. The above fees cover the Publication of the Electronic title in one (1) language in the country of its publication. If the electronic title is published in one (1) country and in more than one (1) languages, the fees per image are increased by 20% for every additional language.

C Countries of distribution of the Electronic title. For distributing the Electronic title in countries apart from the country of publication, the fees per image are increased as follows: in two (2) to ten (10) countries a. in the same language: 50% increase b. in more than one

(1) language: an 100% increase in eleven (11) and more countries: a. in the same language: 300% increase b. in more than one (1) language: an 500% increase

2.2.2. Term of validity of fees. The abovedefined fees of Electronic Titles are valid for two

(2) years. After the abovementioned time period the fees are readjusted.

2.2.3. Period of publication. The fees of an Electronic title cover the first edition only and only the number of copies that is declared. Every republication is meant to be as a new edition. The fees that are defined are reduced by 50% from fees standing the date of republication.

2.2.4. Educational Web based Electronic Titles: Electronic title fee exemption. Exempted from the payment of fees are the Electronic titles published in Greece, of Greek State organizations in all levels of Education serving exclusively teachingeducational purposes and are distributed for free. The same stands for the relevant organizations of the Member States of the European Union for electronic titles published in the Sates of EU.

2.2.5. Research use. For the use of images in research programs carried out from supervised state institutions, an relevant authorization of the Central Archaeological Council for payment in favor of the ARF is required; this payment may be under exemption by an order issued by the Minister of Culture.

2.2.6. Issuing a license of publication and payment in favor of the ARF of an electronic title.

a.
For the circulation of an electronic title with archaeological visual content the following are required: 1) granting a license for publication of images containing antiquities by the Minister of Culture following the opinion by the Council, provided that the competent Antiquities Administrations of the Ministry of Culture check the texts of the title, as well as 2) payment of fees in favor of the ARF.
b.
The issuing of license of the publication is nominal and is valid only for the specific title, the number of copies and the distribution in the country/countries and in the languages that is declared.
c.
Coincidently with the publication of the electronic title and prior its circulation, the lodgment of one (1) copy in ARF, in the competent Ephorate/Ephorates of Antiquities, as well as in the Administration of Museums, Exhibitions and Educational programs, is mandatory, together with a copy of the relevant license of publication of the visual content that has been published from the competent Administration of Antiquities of the Ministry of Culture. In case of spotting the circulation of an electronic title without the application of this provision, the Ministry of Culture and the ARF can take legal actions for claiming their rights without prejudice .
d.
Lending (or the distribution) in third parties of the whole or part of the visual content of the Electronic title, for whom a relevant license of use has been issued for the specific electronic title, requires the prior approval by the Minister of Culture following the opinion of the Council, as well as the payment of the relevant fees in favor of ARF for the new use.

2.2.7. General Regulations

α. The abovedefined fees are applied for electronic titles of limited consuming availability only (apart from broad communication and networking), namely for publications of one source and Information services, except communicational networking.

b. For the distribution and use of a data carrier of any kind containing images of archaeological content in advanced technological platforms of development for teleworking and the for exchange of teleinformation or/and media of multiple users, such as:

Broadband telecommunications

Advanced Transport Channels

Digital Channels of Integrated Information and telecomputing

Broadband satellite and other transmission of advanced interfaces

Cable text and image processing

For other means of advanced technology that are not named above, a special approval of the Central Archaeological Council is required as well as the payment of fees in favor of the ARF that are determined as the case may be, provided that the relevant authorization has been granted.

c.
The distribution for commercial purposes, either as a whole or partially, of any visual content of an electronic title for which a fee exemption has been approved, is prohibited.
d.
The distribution/circulation for commercial exploitation of the derivatives of imprinted products (printing technology) of the electronic product and consequently its title, as a whole or partially, is prohibited.
e.
The reuse of the visual content of an electronic title as a whole or partially in other derivative matters, from which new titles will originate, is prohibited.
f.
The reproduction of archaeological content images (items of Greek Museums and Collections, Monuments and Archaeological Sites of the State) from books and printed editions of third parties for the creation of an electronic title with visual content, as a whole or partially, requires:
  1. The prior approval of the Minister of Culture following the opinion of the Council for granting a license the publication of images containing antiquities in the specific title, and
  2. the payment of fees in favor of the ARF.

g. The aforementioned terms are valid for the use of photographic material of third parties in an electronic title, namely: the use of photographic files inside and outside Greece, which comprise photographs, slides, transparencies etc., of items that are found the Greek Archaeological Museums and in accessible Archaeological Collections, Monuments and Archaeological Sites of the State.

2.2.8. Archaeological Receipts Fund Editions The digitizing and reproduction as well as any use of verbal content all of the editions of ARF, without discrimination, require the prior

relevant license of the Executive Board of ARF, which defines the payable fees of the

electronic title. The EB of ARF reviews the fee payment, as the case may be.

2.2.9. Origination Notification

The electronic title is mandatory to contain the origination notification of the antiquities that consist its visual content. This notification is declared:

a.
By the title of the Museum/Archaeological Collection (if it is an item) or the Ephorate of Antiquities (if this is a monument or site).
b.
By the title of the MINISTRY OF CULTURE ARCHAEOLOGICAL RECEIPTS FUND

The title of the Archaeological Antiquities Fund states the Ministry of Culture’s Service that collects the electronic title fee. As archaeological items subjected to publication fees of an electronic title are meant to be exhibits of Museums under the Administration of Museums, Exhibitions and Educational Programs, Archaeological Sites Ancient and Byzantine Monuments under the Administrations of Prehistoric and Classical Antiquities and Byzantine / Posterior Byzantine Antiquities and in general movable and immovable monuments that are protected by the standing legislation on protection of antiquities and cultural heritage.

  1. Notification of Copyright The electronic title is mandatory toy contain the notification of Copyright of the Ministry of Culture over the antiquities that consist its visual content and which can never be transferred. This notification is declared as follows: COPYRIGHT MINISTRY OF CULTURE
  2. USE OF IMAGES OF ARCHAEOLOGICAL CONTENT OVER THE INTERNET OR/AND INTRANET

Within the framework of the new technologies on the sector of the advertisement and propagation of the cultural heritage, the Ministry of Culture considers as necessary the determination of the procedure and the cost for granting a license for using images containing archaeological content over the Internet or over the intranet of organizations, since the Greek State (Ministry of Culture) is the exclusive rightholder of copyright on the content of these images. The interested organizations should care for reassuring any complementary licenses as the case may be, e.g. license of photography or filming movable or immovable antiquities, license for using images from pictures shooting that pertain the copyright for the specified shootings etc.

3.1. The fees for using images of archaeological content over the Internet or/and the Intranet are defined by the category of the users – feature of the request, by the number of the images, by the type and the duration of use, by the language/languages of publication and by their technical features.

3.1.1. For the use of images by non profit organizations and by private educational institutions of all levels or by institutions of research where the characteristic of the web page will be informative, educational, researching or cultural, the following fees are paid:

I. Images use over the Internet: For one (1) month: 20 Euros per image

For six (6) months: 60 Euros per image For one (1) year: 80 Euros per image For two (2) years: 100 Euros per image

II. Use of images over the Intranet: For 150 photographs: annual subscription 80 Euros For 51500 photographs: annual subscription 180 Euros For 5011,500 photographs: annual subscription 330 Euros For over than 1,501 photographs: annual subscription 350 Euros

3.1.2. For the use of images by publishing organizations or by other organizations with commercial publishing work (e.g. University publications), by the mass media and by individuals where the characteristic of the web page will be informative, commercial or experimental, the following fees are paid: Pricing of use over the Internet:

For one (1) month: 130 Euros per image
For six (6) months: 180 Euros per image
For one (1) year: 280 Euros per image

For two (2) years: 480 Euros per image

3.1.3. For the use of images by tourist offices or companies of tourist web pages and gates of tourist information, by image data banks and by advertising companies or by other

organizations (physical or legal entities) within the framework of their advertising program

where the character of the web page will be commercial or advertising, the following fees are paid: Pricing of use over the Internet: For one (1) month: 750 Euros per image For six (6) months: 1,150 Euros per image For one (1) year: 1,550 Euros per image For two (2) years: 2,150 Euros per image

CLARIFICATIONS:
The aforementioned fees for the use of images of archaeological over the internet content
cover their publication in one (1) language and only for images of low resolution (72 dpi) The
prices are increased by 50% for any additional language, per image.

For the use of nonstatic images (2D, 3D illustrations) as well as images pf higher resolution (higher than 72 dpi and lower than 300 dpi), a 60% increase is prescribed per image.

3.2. EXEMPTION FROM THE PAYMENT OF FEES

3.2.1. The State, the ARF and the Hellenic Culture Organization S.A are exempted from the payment of the licensing fees for the use of images with archaeological content over the Internet, pursuant to article 46 of Law 3028/2002, provided that the Ministry of Culture has granted a license to them.

3.3. PROCEDURE FOR GRANTING A LICENSE FOR THE USE OF IMAGES OF ARCHAEOLOGICAL CONTENT OVER THE INTERNET

3.3.1. The interested party submits an application filling the special document in the competent Administration of the Ministry of Culture (Administration of Museums, Exhibitions, Educational Programs, Department of nonpublic Archaeological museums and Collections, Antique Shops and Prosecution of illegal trade of antiquities) or in the competent as the case may be Regional Services of the Ministry of Culture (Ephorates of Prehistoric and Classical Antiquities and Ephorates of Byzantine Antiquities).

3.3.2. The Minister of Culture grants the license following the opinion of the Central

Archaeological Council (CAC). CAC will review cases that require special regulations that are not prescribed in the present order.

3.3.3. The applicants should submit the following:

Brief but comprehensive description of the organization or the individual that submits the
request.
Description of the program for which the use of image is requested (purpose, targets,

structure, content, character of the programs e.g. commercial, educational etc.)
Full list of the items of the museums, archaeological sites or/monuments for which the license

for the use of their photographs is requested, their index number (regarding items of
museums) as well as the texts or captions that accompany the images.
The type of images (e.g. static, 2D, moving, etc.).
The way of access in the web page (e.g. if the interested party will pay a fee for the access 

in the gate and the amount of fee).
The duration of the use of the relevant material in the page under construction.
In how many and in what languages the web page is about to be viewed.
Use of a watermark.
Any other element the applicant considers necessary for the complete presentation of the

application.

3.3.4. The payment of the use fees of images will be carried out prior to the presentation of the images over the Internet or/and the Intranet. The fees will be paid in favour of ARF in the bank account referred at the end of the present Decision.

3.3.5. The organization should be inform immediately to Ministry of Culture for the initiation and the termination of operation of the web page.

3.4. GENERAL TERMS AND CONDITIONS
the license is granted for specific use only and for a certain period of time.
The transfer of the use license from the applicant to a third party is prohibited.

The interested party is committed to lodge a document of the digitized data carrier of images in the Ministry of culture, for enriching its relevant database.

The managing organization is solely responsible for the quality of the content of the web page and not the Ministry of Culture in any case.

The granting of license does not consist any kind of cooperation with the Ministry of Culture, unless otherwise specified in the relevant license.

Images should be accompanied by short text (captions) which shall be approved by the Ministry of culture, with the following elements: a) For immovable monuments: Monument Name Location (an optionally Date and Use) b) For the immovable antiquities: Item name

Location (Museum, Collection) Index number (and optionally Date and use) Also, there should be an indication that the Copyright of images belongs to the Ministry of Culture. This notification is declared as follows: “Copyright of the illustrated antiquities belongs to the Greek Ministry of Culture (Law 3028/2002)”

The images, for which a license is granted, should not be presented in a way that spoils their content (composition, overlap, etc.,), without prior special license by the Ministry of Culture.

The non compliance with the aforesaid procedure incurs the sanctions under the law.

4. DEFINITION OF FEES FOR EVENTS IN ANCIENT THEATERS AND OTHER ARCHAEOLOGICAL SITES.

4.1. For carrying out events inside ancient theaters, Odeons, etc., fess in favor of ARF are prepaid in the range of 3,000 to 5,000 euros daily and 1,500 Euros for every rehearsal. The precise amount of fees for the aforementioned events is defined by the kind of the event and by the requested Monument and is defined under a Decision of the Minister of Culture following the opinion by the Central Archaeological Council. For effecting of social events inside archaeological sites and monuments, even if an artistic or cultural program accompanies them, the fees are defined under an order of the Minister of Culture following the opinion by the Central Archaeological Council. The assignment of ancient theaters, Odeons etc., of archaeological sites of major importance, as well as of archaeological sites and Monuments in general, is realized after o dictum by the Central Archaeological Council and under the order of the Minister of Culture.

4.2. The following organizations are exempted from the payment of the above fees: National theaters Municipal Regional Theaters National Opera National Orchestra Cyprus Theater Organization School events Organizations that effect events for proven charity purposes.

4.3. In all cases of assignment of the aforesaid monuments, either with the payment of fess or without fees, the observance of the following terms is mandatory by the organizations that the assignment is made.

The payment of the overtime remuneration of the necessary guarding personnel or in case of emergency, the remuneration of the additional supporting superintendents.

The care for cleaning the sites before and after the events.

The care for the proper operation of electronic and other devices, of the hygiene locations etc., and their maintenance in case of damages.

Other additional terms that are defined as the case may be by the Ephorates of Antiquities and Archaeological Councils that are competent for the protection of monuments.

  1. Photography, filming, video recording of the events inside the ancient monuments are subjected to payment in favour of ARF of the relevant photography, video recording of monuments and archaeological sites fees, as standing at the time of realization of the events.
  2. IMPRESSIONS LOGOS

5.1. The fees for impressions, copies and illustrations of immovable and movable monuments that belong to the State, are determined ad hoc following the opinion by the central Archaeological Council and an order by the Minister of Culture.

5.2.1 The use fees in 2D or 3D form of the immovable or movable monuments in a logo, shall be defined ad hoc following the opinion by the central Archaeological Council and an order by the Minister of Culture Al the aforementioned fess should be paid in the name of the Archaeological Receipts Fund in the Bank of Greece on the account 026786/4 prior the initiation of any authorized work. If the payment of fees is carried out through another bank, these shall be paid in the Account IBAN GR 2201000240000000000267864 of the Bank of Greece. This order shall be promulgated in the Official Gazette.
