Year of Version 2001 Dates Entry into force: September 1, 2001 Adopted: July 24, 2001 Type of Text IP-related Laws Subject Matter Enforcement of IP and Related Laws, IP Regulatory Body, Other Notes This Law establishes the Customs Services of the Macao SAR Government, and confers on it, inter alia, the enforcement powers in matters relating to intellectual property. Articles 2(4) and 3(2) provide that the Macao Customs Services is responsible for protecting intellectual property rights, imposing penalties for IP infringement according to legislation, and monitoring the manufacturing process of goods produced in Macao Administrative Region, industrial activities as well as industrial and commercial sites. Article 18 of this Law amends the following legislation: - Article 217 of Decree-Law No. 43/99/M of August 16, 1999, on the Regime of Copyright and Related Rights. - Decree-Law No. 51/99/M of September 27, 1999, regulating the Commercial and Industrial Activities on Computer Programs, Phonograms and Video Products. (The terms 'DSE' and 'Director of the DSE' shall be replaced by 'Customs Service' and 'Director-General of Customs Service'; and the phrase 'through the Department of Inspection of Economic Activities' shall be deleted in Article 25(1)). - Articles 285, 288, 309 and 310 of the Industrial Property Code (approved by Decree-Law No. 97/99/M of December 13, 1999). Article 20(1) of this Law states that it shall enter into force on the first day of the month following its publication. This Law was published on August 6, 2001, and therefore came into force on September 1, 2001. Article 20(2) further states that Article 18 shall take effect upon the entry into force of the Administrative Regulation No. 21/2001. This Administrative Regulation took effect on November 1, 2001, which brought Article 18 into force on the same date.
