The Constitution of Italy of 1947 adopted by the Constituent Assembly on December 22, 1947 enshrines democratic values and establishes a national, sovereign, independent, unitary and indivisible state (Article 5). The Constitution has been amended many times, most recently in 2007.

The Constitution promotes the development of culture and of scientific and technical research (Article 9), the freedom of art and the science (Article 33) and the right of private property (Article 42), which can be extended to the intellectual property rights.
