Notes
The Industrial Property Code (approved by Decree-Law No. 97/99/M of December 13, 1999), and the Copyright Law (Decree-Law No. 43/99/M of August 16, 1999) refer to the provisions of the Criminal Procedure Code.
Section II (Miscellaneous Provisions) of Chapter II (Unlawful Acts) of Part V (Monitoring and Penalties) of the Industrial Property Code contains Article 297 stipulating the collaboration with assistants in investigating crimes as specified in Title V (Assistants) of Book I (Subjects of Proceedings) of the Criminal Procedure Code; and Article 298 stipulating that the provisions of the Criminal Procedure Code can be subsidiarily applicable to the criminal offences provided for in Chapter II of the IP Code.
Chapters 2 to 3 of Part V (Criminal and Administrative Infringements) of the Copyright Law provides for the application of the criminal proceedings for criminal copyright infringements referred to this Code.
