ACT ON COPYRIGHT IN LITERARY AND ARTISTIC WORKS (Swedish Statute Book, SFS, 1960:729, as amended up to April 1, 2011)

CHAPTER 1. Subject Matter and Scope

Article 1. Anyone who has created a literary or artistic work shall have copyright in that work, regardless of whether it is 1. a fictional or descriptive representation in writing or speech, 2. a computer program, 3. a musical or dramatic work, 4. a cinematographic work, 5. a photographic work or another work of fine arts, 6. a work of architecture or applied art, 7. a work expressed in some other manner.

Maps and other works of a descriptive nature executed as drawings, engravings, or in a three-dimensional form, shall be considered as literary works.

What is prescribed in this Act concerning computer programs shall mutatis mutandis apply also to preparatory design material for computer programs. (Act 1994:190)

Article 2. Subject to the limitations prescribed hereinafter, copyright shall include the exclusive right to exploit the work by making copies of it and by making it available to the public, be it in the original or an altered manner, in translation or adaptation, in another literary or artistic form, or in another technical manner.

As the making of copies shall be considered any direct or indirect, temporary or permanent preparation of copies of the work, regardless of the form or through which method this is carried out and regardless of whether it concerns the work in whole or in part.

The work is being made available to the public in the following cases

1. When the work is being communicated to the public. This is deemed to include any making available of the work to the public by wire or by wireless means that occurs from a place other than that where the public may enjoy the work. Communication to the public includes also acts of communication that occur in such a way that members of the public may access the work from a place and at a time individually chosen by them.

2. When the work is publicly performed. Such public performance includes only such cases where the work is being made available to the public, with or without the use of a technical device, at the same place as the one where the public may

enjoy the work.

3. When copies of the work are publicly exhibited. Public exhibition includes only such cases where a copy of a work is being made available to the public, without the use of a technical device, at the same place as the one where the public can enjoy the copy. If a technical device is being used, the act is instead a public performance

4. When copies of the work are placed on sale, leased, lent, or otherwise distributed to the public.

As acts of communication to the public and of public performance shall be deemed also acts of communication and performance that, in the framework of commercial activities, occur to or for a comparatively large closed group of persons. (Act 2005:359).

Article 3. When copies are made of a work, or when it is made available to the public, the name of the author shall be stated to the extent and in the manner required by proper usage.

A work may not be changed in a manner which is prejudicial to the author's literary or artistic reputation or to his individuality, nor may it be made available to the public in such a form or in such as context as is prejudicial in the manner stated.

The author may, with binding effect, waive his right under this Article only in relation to uses which are limited as to their character and scope.

Article 4. A person who has made a translation or an adaptation of a work or converted it into another literary or artistic form, shall have copyright in the work in the new form, but his right to exploit it shall be subject to the copyright in the original work.

If a person, in free connection with another work, has created a new and independent work, his copyright shall not be subject to the right in the original work.

Article 5. A person who, by combining works or parts of works, creates a composite literary or artistic work shall have copyright therein, but his right shall be without prejudice to the rights in the individual works.

Article 6. If a work has two or more authors, whose contributions do not constitute independent works, the copyright shall belong to the authors jointly. However, each one of them is entitled to bring an action for infringement.

Article 7. A person whose name or generally known pseudonym or signature appears in the usual manner on copies of the work or when it is made available to the public, shall, in the absence of proof to the contrary, be deemed to be its author.

If a work is published without the name of the author being stated in the manner prescribed in the first Paragraph, the editor, if he is named, or otherwise the

publisher, shall represent the author until his name is stated in a new edition or in a notification to the Ministry of Justice.

Article 8. A work is deemed to have been made public when it has lawfully been made available to the public.

As work is deemed to have been published when copies thereof have, with the consent of the author, been placed on sale or otherwise been distributed to the public. (Act 1973:363)

Article 9. Copyright does not subsist in 1. laws and other regulations, 2. decisions by public authorities, 3. reports by Swedish public authorities, 4. official translations of texts mentioned under 1.–3.

However, copyright subsists in works of the following kinds when they form part of a document mentioned in the first Paragraph: 1. maps, 2. works of drawing, painting or engraving, 3. musical works, or 4. works of poetry. (Act 2000:92).

Article 10. Copyright subsists in a work even if it has been registered as a design.

Copyright does not subsist in layout designs in semiconductor products. Special provisions apply to the rights in such designs. (Act 1994:190).

CHAPTER 2. Limitations on Copyright

General Provisions on Limitations

Article 11. The provisions of this Chapter do not limit the author's right under Article 3, except as provided in Article 26 c.

When a work is used publicly on the basis of the provisions in this Chapter, the source shall be stated to the extent and in the manner required by proper usage, and the work may not be altered more than necessary for the use. (Act 1993:1007).

On the Making of Temporary Copies

Article 11 a. Temporary forms of copies of works may be made, if the making of the copies is an integral and essential part of a technological process and if the copies are transient or have only a secondary importance in that process. The copies must not have any independent economic importance.

The making of copies under the first Paragraph is permissible only if the sole purpose of that making is to enable 1. a transmission in a network between third parties by an intermediary, or

2. a lawful use, that is, a use that occurs with the consent of the author or his successor in title or another use that is not un-permissible under this Act.

The provisions under the first and second Paragraphs do not confer a right to make copies of literary works in the form of computer programs or compilations. (Act 2005:359)

On the Making of Copies for Private Purposes

Article 12. Anybody is entitled to make, for private purposes, one or a few copies of works that have been made public. As regards literary works in written form the making of copies may, however, concern only limited parts of works, or such works of limited scope. The copies must not be used for purposes other than private use.

The provisions in the first Paragraph do not confer a right to 1. construct works of architecture 2. make copies of computer programs, or 3.make copies in digital form of compilations in digital form.

Furthermore, the provisions in the first Paragraph do not confer a right to engage, for private purposes, another person to 1. make copies of musical works or cinematographic works 2. make utilitarian articles or sculptures, or 3. copy another person’s work of fine art by means of artistic reproduction.

This Article does not confer a right to make copies of a work when the copy that constitutes the real master copy has been prepared or has been made available to the public in violation of Article 2. (Act 2005:359).

Article 13. (Constitutes, in an amended form, Article 42 c.)

On the Making of Copies for Educational Purposes

Article 14. Teachers and pupils may for educational purposes make recordings of their own performances of works. Such recordings may not be used for other purposes. (Act 1993:1007).

On the Making and Distribution of Copies within Certain Archives and Libraries

Article 16. Archives and libraries referred to in the third and fourth Paragraphs are entitled to make copies of works, with the exception of computer programs, 1. for purposes of preservation, completion or research 2. in order to satisfy the desires of library borrowers, for single articles or short extracts of works, or for material which, for security reasons, must not be given away in original form, or

3. for use in reading devices.

Copies that have been made on paper pursuant to the first Paragraph, item 2, may be distributed to library borrowers. Provisions on extended effect of collective licenses for the purposes of distribution to the public of copies in other cases and of communication to the public of works are contained in Article 42 d.

Entitled to the making of copies, and to the distribution, pursuant to the provisions of this Article are 1. governmental and municipal archival authorities, 2. such scientific and research libraries that are operated by public authorities, and 3. public libraries.

The Government may in specific cases decide that also certain archives and libraries other than those mentioned in the third Paragraph shall have a right to make copies pursuant to this Article. (Act 2008:1416).

On the Making of Copies, etc. for Persons with a Disability

Article 17. Anyone is entitled to make, by means other than recording of sounds, such copies of literary and musical works which have been made public and of works of visual art which have been made public, which persons with a disability need in order to be able to enjoy the works. The copies may also be distributed to those persons.

Libraries and organizations as decided by the Government in specific cases may also 1. communicate copies of the works that are referred to in the first Paragraph to persons with a disability who need the copies in order to be able to enjoy the work, 2. by means of sound recording make such copies of literary works that have been made public which persons with a disability need in order to be able to enjoy the works, and to distribute and communicate such sound recordings to those persons, and 3. make such copies of works transmitted on sound radio or television, and of cinematographic works, that deaf or hearing-impaired persons need in order to be able to enjoy the works, and to distribute and communicate copies of the works to those persons.

The making of copies, the distribution and the communication to the public pursuant to this Article must not be carried out for commercial purposes, nor must the copies be used for purposes other than those mentioned in the Article.

When libraries and organisations distribute or communicate copies of works to persons with a disability in such a way that those persons may keep a copy of the work, the author has a right to remuneration. The same applies if anyone, pursuant to the first Paragraph, second sentence, transmits more than a few copies to persons with a disability. (Act 2005: 359).

On the Making of Composite Works for Use in Educational Activities

Article 18. Anyone who, for use in educational activities, prepares a composite work consisting of works by a comparative large number of authors may reproduce minor portions of literary or musical works and such works of a limited scope, provided that five years have elapsed from the year in which the works were published. Works of fine art may be reproduced in connection with the text, provided that five years have elapsed from the year when they were made public. The authors have a right to remuneration.

The provisions of the first Paragraph do not apply to works that have been created for use in educational activities and does not confer a right to prepare composite works for commercial purposes. (Act 2005:359).

On the Distribution of Copies

Article 19. When a copy of a work has been has been transferred, with the consent of its author, within the European Economic Area, that copy may be further distributed.

The provisions of the first Paragraph do not confer a right to make available to the public 1. copies of works, with the exception of buildings and works of applied art, through rental or similar legal acts 2. copies of computer programs in machine-readable form or of cinematographic works, through lending. (Act 2005:359).

On the Display of Copies

Article 20. When a work has been published, the copies thus published may be publicly displayed. The same applies in respect of copies of works of fine art that the author has transferred. (Act 2005:359).

On Works of Fine Art Included in a Film, a Television Program or a Picture

Article 20 a. Anyone is entitled to prepare, by means of a film or a television program, and distribute, copies of works of fine art, publicly perform works of fine art and communicate works of fine art to the public, if the exploitation made of the work is incidental in relation to the contents of the film or the television program. Corresponding acts of exploitation may also be carried out of works of fine art that appear in the background, or otherwise form an insignificant part, of a picture.

Exploitation as referred to in the first Paragraph may, however, take place only if the master copy for the copy made when the work of fine art is being included in the film, the television program or the picture is a copy that is covered by an act of publication or a copy that has been transferred by the author. If no making of a copy occurs, the same applies to the copy that is directly communicated to the public through the television program. (Act 2005:359).

On Public Performance

Article 21. Anyone is entitled to publicly perform works, with the exception of cinematographic works and works made for the stage, that have been made public 1. on occasions where the performance of such works is not the main feature of the event, no admission fee is charged and the event is not organised for commercial purposes 2. in the course of educational activities or divine services.

The Parliament and governmental and municipal authorities may, in cases referred to in the first Paragraph, item 1, publicly perform also cinematographic works and works made for the stage that have been made public. The works may be performed only through connection to an external network that is made available in order to satisfy a public information interest. The performance may occur only at the Parliament’s or the authorities’ own venues.

The provisions in the first Paragraph, item 2. do not confer a right to publicly perform, for commercial purposes, compilations in the course of educational activities. (Act 2005:359).

On Quotations

Article 22. Anyone may, in accordance with proper usage and to the extent necessary for the purpose, quote from works which have been made available to the public.

On the Use of Works of Fine Arts and of Buildings

Article 23. Works of fine art which have been made public may be reproduced 1. in connection with the text in a scientific presentation which has not been prepared for commercial purposes, 2. in connection with the text in a critical presentation, except if it is in digital form, 3. in a newspaper and a periodical in connection with a report on a current news event, except if the work has been created for reproduction in such a publication.

The provisions in the first Paragraph apply only if the use of the reproduction is carried out in conformity with proper usage and to the extent called for by the information purpose. (Act 2005:359).

Article 24. Works of fine art may be reproduced in pictorial form 1. if they are permanently located outdoors on, or at, a public place 2. if the purpose is to advertise an exhibition or a sale of the works of fine art but only to the extent necessary for the promotion of the exhibition or the sale or 3. if they form part of a collection, in catalogues, however not in digital form.

Buildings may be freely reproduced in pictorial form. (Act 2005:359).

On Information on Current Events through Sound Radio and Television, etc.

Article 25. Works which are seen or heard in the course of an event may be used in connection with information concerning the event through sound radio, television, direct transmission or film. The works may, however, be used only to the extent justified by the purpose of information. (Act 1993:1007).

Article 25 a. Works that are being seen or heard in a television broadcast may be used when a television organization transmits an extract from the broadcast pursuant to Article 48 a. (Act 2010:697).

On Public Debates, Public Documents, etc.

Article 26. Anyone is entitled to use oral or written statements 1. before public authorities, 2. in government or municipal representative bodies, 3. in public debates on public matters, 4. at public questionings on such matters.

The provisions of the first paragraph, items 1. and 2. do not however apply as regards information for which secrecy applies under Chapter 31, Article 23 of the Public Access to Information and Secrecy Act (2009:400).

In the application of the provisions in the first paragraph it shall, however, be observed, 1. that writings cited as evidence, reports and similar works may be used only in connection with a report concerning the legal proceedings or case in which they have appeared and only to the extent necessary for the purpose of such a report, 2. that the author has an exclusive right to publish compilations of his statements, and 3. that what is stated during questionings as mentioned in the first Paragraph, item 4. must not be used, on the basis of that provision, in sound radio or television broadcasts. (Act 2009:406).

Article 26 a. Anyone is entitled to use works which form part of the documents mentioned in Article 9, first paragraph, and which are of the kind mentioned in Article 9, second paragraph, items 2 to 4. The author is entitled to remuneration except when the use occurs in connection with 1. the activities of a public authority, 2. a report of a legal proceeding or a case in which the work appears and the work is used only to the extent necessary for the information purpose.

Anyone is entitled to use documents which are prepared by Swedish public authorities but which are not such as are mentioned in Article 9, first Paragraph.

The second Paragraph does not apply to 1. maps, 2. technical models, 3. computer programs, 4. works created for educational purposes, 5. works which are the result of scientific research,

6. works of drawing, painting or engraving, 7. musical works, 8. works of poetry, or 9. works copies of which are made available to the public through public authorities in connection with commercial activities. (Act 2000:92).

Article 26 b. Notwithstanding copyright therein, official documents shall be made available to the public as prescribed in Chapter 2 of the Freedom of the Press Act.

Copyright does not prevent the use of a work in the interest of the administration of justice or of public security. (Act 1997:790).

On Alterations of Buildings and of Useful Articles

Article 26 c. The owner of a building or a useful article is entitled to alter the property without the consent of the author. (Act 1993:790).

Special Provisions concerning Sound Radio and Television

Article 26 d. (constitutes now, in amended form, Article 42 e)

Article 26 e. A sound radio or television organisation which has the right to broadcast a work is also entitled to record the work on a material support from which it can be perceived, if this act is made 1. for use in its own broadcasts on a few occasions during a limited time, 2. to ensure evidence concerning the content of the broadcast, or 3. in order to make it possible for a governmental authority to exercise supervision over the broadcasting activities.

Recordings made in accordance with the provisions of the first Paragraph, items 2 and 3, may be used only for the purposes indicated there. Such recordings which have a documentary value may, however, be preserved in the Royal Library.

A Government authority which has as its task of supervising advertising in sound radio and television broadcasts is entitled to use broadcasts to the extent necessary for the purpose. (Act 2008:1416).

Article 26 f. (Constitutes now, in amended form, Article 42 f)

Special Provisions on Computer Programs, etc.

Article 26 g. Anyone who has acquired the right to use a computer program is entitled to make such copies of the program and to make such adaptations of the program which are necessary in order for him to use the program for its intended purpose. This also applies to corrections of errors.

Anyone who has the right to use a computer program is entitled to make back-up copies of the program, if this is necessary for the intended use of the program.

Copies which have been made on the basis of the provisions of the first and

second Paragraphs may not be used for other purposes and may, furthermore, not be used when the right to exploit the program has expired.

Anyone who has the right to use a computer program is entitled to observe, study or test the function of the program in order to ascertain the ideas and principles which lie behind the various details of the program. This applies provided that the act is performed in connection with such loading, display on a screen, processing, transmission or storing of the program that he is entitled to make.

Anyone who has a right to use a compilation is entitled to dispose of it in any way that is necessary in order for him to be able to use the compilation for its intended purpose.

Contractual stipulations which limit the right of the user under the second, fourth or fifth paragraphs are null and void. (Act 1997:790).

Article 26 h. The reproduction of the code of a computer program or translation of its code is permitted if those acts are required in order to obtain interoperability between the program and another program. This applies, however, provided that the following conditions are met 1. the acts are performed by a person who has the right to use the program or, on his behalf, by a person who is authorised to perform those acts, 2. the information necessary to achieve interoperability has not previously been readily available to the persons referred to in item 1, 3. the acts are confined to those parts of the original program which are necessary to achieve interoperability.

The provisions of the first Paragraph do not permit that the information is 1. used for purposes other than to achieve the intended interoperability, 2. given to other persons except when necessary for obtaining the intended interoperability, 3. used for the development, preparation or marketing of a computer program substantially similar in its expression to the protected program, or 4. used for other acts which imply an infringement of the copyright.

Contractual stipulations restricting the rights of the user according to this Article are null and void. (Act 1993: 1007).

CHAPTER 2 a. Right to Special Remuneration

Article 26 j. (repealed)

Remuneration Relating to the Manufacture and Importation of Material Supports for the Recording of Sounds or Images

Article 26 k. When a businessman, in the course of his professional activities, manufactures or imports into this country material supports on which sounds or moving images may be recorded and which are especially suitable for the making of copies of works for private purposes, the authors of such protected works, that have thereafter been broadcast by sound radio or television or have been published on material supports by means of which they can be reproduced, have a right to remuneration from the businessman.

The authors have, however, no right to remuneration, where the material supports manufactured or imported are intended for 1. use for purposes other than the making of copies of works for private purposes 2. export from the country, or 3. use for the making of copies of works for persons with a disability. (Act 2005:359).

Article 26 l. The remuneration pursuant to Article 26 k is: 1. In respect of material supports for analogue recording, two and a half “Öres” for each possible recording minute on the support. 2. In respect of material supports where digital recording can be made repeatedly, 0,4 “Öres” for each megabyte storage capacity. 3. In respect of other material supports for digital recording 0,25 “Öres” for each megabyte storage capacity.

The businessman is entitled to a reduction of the amounts of the remuneration pursuant to the first Paragraph, if 1. the authors have in some other form received compensation for the making of copies of such works as referred to in Article 26 k, or 2. the remuneration is unreasonably high, taking into account the circumstances relating to the material support or other conditions on the market. (Act 2005:359).

Article 26 m. Only an organization representing a substantial number of Swedish authors and holders of neighbouring rights in the field concerned is entitled to collect the remuneration and to conclude agreements on the reduction of the remuneration pursuant to Articles 26 k and 26 l. The organisation shall collect the remuneration and distribute it to those entitled to it after deduction of a reasonable compensation to the organization for its costs. Right-owners who are not represented by the organization shall, for the purposes of the distribution, be treated in the same way as those right- owners who are represented by the organization.

The businessman referred to in Article 26 k, first Paragraph, shall give notice of himself to an organization as referred to in the first Paragraph. The businessman shall, upon request by the organization, provide an account of the number of material supports to which the right to remuneration applies, the recording time or the storage capacity, whether the supports can be used repeatedly for digital recording and when the supports were manufactured or imported. The account shall indicate the number of material supports referred to in Article 26 k, second Paragraph. (Act 2005:359).

Remuneration for resale of original copies of works of art (Resale right)

Article 26 n. When a copy of an original work of art, that has been transferred, has been re-sold within the term of copyright protection, the author has a right to remuneration (resale right) if an art market professional is the seller, intermediary or buyer at the sale. An “original work of art” means 1. a work of art that has been created by the artist himself, 2. a copy of a work of art that has been created in a limited number of copies by the artist himself or with his or her consent.

The author has, however, no right to remuneration where 1. the sales price, with the exclusion of the value added tax, does not exceed one twentieth of the price basic amount under Chapter 2, Articles 6 and 7 of the Code for Social Security, 2. the sale concerns a copy of a work of architecture in the form of a building, or 3. the sale is undertaken by a private person to a museum that is open for the public and that carries out its activity without profit-making purposes, if no art market professional took part in the sale.

Where only one person who is an art market professional took part in the sale as a seller, an intermediary or a buyer, the remuneration shall be paid by that person. Where more than one such person took part in the sale, the remuneration shall be paid by the seller. Where the seller is not an art market professional, the remuneration shall instead be paid by the intermediary. (Act 2010:1206).

Article 26 o. The remuneration according to Article 26 n shall be calculated on the sales price, with the exclusion of the value added tax, and be charged as follows 1. five per cent of the part of the sales price that does not exceed 50 000 Euros, 2. three per cent of the part of the sales price that lies between 50 000,01 and 200 000 Euros, 3. one per cent of the part of the sales price that lies between 200 000,01 and 350 000 Euros, 4. one half per cent of the part of the sales price that lies between 350 000,01 and 500 000 Euros, 5. 0,25 per cent of the part of the sales price that exceeds 500 000 Euros.

A remuneration according to the first Paragraph may not be charged by more than 12 500 Euros.

For the purposes of calculating what shall be paid as a resale right remuneration, the calculation of the amounts indicated in the first and second Paragraphs shall be made according to the exchange rate that the European Central Bank has decided for the date when the sale takes place, or, where the sale does not take place on a day when the Swedish banks are open, the exchange rate that has been fixed for the immediately preceding date when the Swedish banks are open.

The right to remuneration is personal and must not be transferred or waived.

However, notwithstanding the provisions of Chapter 10, Article 3, first Paragraph, of the Marriage Code, the provisions governing the division of property between spouses, inheritance and will shall apply to the right after the death of the author. (Act 2007:521).

Article 26 p. Only an organization representing a substantial number of Swedish authors in the field concerned is entitled to claim the remuneration. The organization shall claim the remuneration in respect of, and pay the amount to, the person entitled to it after a deduction has been made for a reasonable compensation to the organization for its administrative costs. If the organization does not claim the remuneration from the person liable for its payment within three years from the expiry of the calendar year when the sale took place, the claim is statute-barred.

The person who is liable for the remuneration shall, at the request of the organization, provide information about the sales for which remuneration is due and which have taken place during the immediately preceding three calendar years.

The claim of the person entitled to the remuneration as against the organization shall be statute-barred ten years after its coming into being, however only where the organization has undertaken reasonable measures in order to find the person entitled to the remuneration. (Act 2007:521).

CHAPTER 3. Transfer of Copyright

General Provisions on Assignments

Article 27. Subject to the limitation which follows from Article 3, copyright may be transferred entirely or partially.

The transfer of a copy does not include a transfer of the copyright. In the case of a portrait executed on commission, the author may, however, not exercise his right without the consent of the person who commissioned it or, after the death of such a person, the surviving spouse and heirs.

Provisions governing the transfer of copyright in certain specific cases are included in Articles 30–40 a §. Those provisions apply, however, only in the absence of an agreement to the contrary. (Act 1992:1687).

Article 28. In the absence of an agreement to the contrary, the person to whom a copyright has been transferred may not alter the work or transfer the copyright to others. If the copyright forms part of a business activity, it may be transferred together with the business activity or of part thereof; the transferor remains liable for the fulfilment of the agreement.

Article 29. Where an author transfers to a producer of sound recordings or recordings of moving images his right to make a work available to the public through rental of such recordings, the author shall have a right to an equitable remuneration.

Contractual stipulations invalidating this right are null and void. (Act 1997:309).

On Contracts Relating to Public Performance, etc.

Article 30. Where the right to communicate a work to the public or to perform it publicly has been transferred, the transfer shall be valid for a period of three years and shall not confer exclusivity. Where a longer term than three years has been determined and exclusivity has been agreed on, the author may nevertheless himself communicate the work or perform it or transfer rights in these respects to another person, if the right has not been exercised within a period of three years.

The provisions of this Article do not apply to cinematographic works. (Act 2005:309).

On Publishing Contracts

Article 31. By means of a publishing contract the author transfers to the publisher the right to reproduce a literary or artistic work by printing or a similar process and the right to publish it.

The manuscript or other copy from which the work is being reproduced shall remain the property of the author.

Article 32. The publisher shall have the right to publish one edition, which may not exceed, in the case of a literary work, 2 000 copies, in the case of a musical work 1 000 copies, and in the case of a work of fine art 200 copies.

An edition shall be understood as what the publisher produces at one and the same time.

Article 33. The publisher has the duty to publish the work within a reasonable time, to ensure the distribution of it in the usual manner, and to follow up the publishing to the extent determined by marketing conditions and other circumstances. In the case of default, the author may rescind the contract and keep the remuneration received. If the author has suffered damage which is not covered by the remuneration, such damage shall also be compensated.

Article 34. If the work has not been published within two years or, if it is a musical work, four years, from the time when the author has delivered the manuscript or other copy for reproduction, the author may, even if there is no fault on the part of the publisher, rescind the contract and keep the remuneration received. The same applies when the copies of the work are exhausted and the publisher has the right to publish a new edition but he fails to do so within one year from the time of the request by the author to do so.

Article 35. The publisher shall provide the author with a certification from the printer or whoever else reproduces the work concerning the number of copies produced.

If during the fiscal year sales have taken place for which the author is entitled to remuneration, the publisher shall render account to him within nine months from the end of the year, stating the number of copies sold during the year and the number in stock at the end of the year. At his request, the author is also otherwise entitled to obtain a statement of the number in stock by the end of the year.

Article 36. If the production of a new edition is commenced more than a year from the publication of the previous edition, the author shall be entitled to make, before the production starts, such changes in the work which can be made without unreasonable costs and without altering the character of the work.

Article 37. The author is not entitled to publish the work again in the form or manner covered by the contract, before the edition or editions which the publisher is entitled to publish have been exhausted.

When fifteen years have elapsed from the commencement of the publication, the author is, however, entitled to include a literary work in an edition of his collected or selected works.

Article 38. The provisions concerning publishing contracts shall not apply to contributions to newspapers or periodicals. Articles 33 and 34 shall not apply to contributions to other composite works.

On Film Contracts

Article 39. A transfer of the right to record a literary or artistic work on a film shall include the right to make the work available to the public, through the film, in cinemas, on television or otherwise and to make spoken parts of the film available in textual form or to translate them into another language. This provision does not apply to musical works. (Act 1973:363).

Article 40. If the right to use a literary or musical work for a film intended for public showing is transferred, the transferee shall produce the film and make it available to the public within a reasonable time. If this is not done, the author may rescind the contract and keep the remuneration received. If the author has suffered damage which is not covered by the remuneration, also such damage shall be compensated.

If the cinematographic work has not been produced within five years from the time when the author fulfilled his obligations, the author may rescind the contract and keep the remuneration received, even if there is no fault on the part of the transferee.

On Computer Programs Created in Employment Relations

Article 40 a. The copyright in a computer program created by an employee as a part of his tasks or following instructions by the employer is transferred to the employer unless otherwise agreed in contract. (Act 1992:1687).

On Transfer of Copyright at the Death of the Author, etc.

Article 41. Notwithstanding the provisions in Chapter 10, Article 3, first Paragraph, of the Marriage Code the provisions governing the division of property between spouses, inheritance and will shall, after the death of the author, apply to copyright. An administrator of the estate may not, without the consent of the heirs, exploit the work in a manner other than that in which it has been previously exploited.

The author may, with binding effect for the surviving spouse and heirs of his body, give directions in his will concerning the exercise of copyright or authorise somebody else to give such directions. (Act 1987:800).

Article 42. Copyright shall not be subject to legal seizure as long as it remains with the author or with any other person who has acquired the copyright by virtue of division of property between spouses, inheritance or will. The same shall apply to manuscripts and to such works of art which have not been exhibited, placed on sale or otherwise authorised to be made available to the public. (Act 1987:800).

CHAPTER 3 a. On the Extended Effect of Collective Licenses

Common Provisions concerning Extended Effect of Collective Licenses

Article 42 a. An extended collective license as referred to in Articles 42 b–42 g applies to the exploitation of works in a specific manner, when an agreement has been concluded concerning such exploitation of works with an organization representing a substantial number of Swedish authors in the field concerned. The extended collective license confers to the user the right to exploit works of the kind referred to in the agreement despite the fact that the authors of those works are not represented by the organization.

In order for a work to be exploited pursuant to Article 42 c, the agreement must have been concluded with someone who carries out educational activities in organised forms.

When a work is being exploited pursuant to Article 42 e, the author has a right to remuneration.

When a work is being exploited pursuant to Articles 42 b, 42 c, 42 d, 42 f or 42 g, the following applies. The conditions concerning the exploitation of the work that follow from the agreement apply. In respect of the remuneration deriving from the agreement and in respect of other benefits from the organization that are essentially paid for out of the remuneration, the author shall be treated in the same way as those authors who are represented by the organization. Without prejudice to what has been said now, the author has, however, always a right to remuneration for the exploitation, provided he or she forwards his or her claims within three years from the year in which the work was exploited. Claims for remuneration may be directed only towards the organization.

As against the user exploiting a work pursuant to Article 42 f claims for remuneration may be forwarded only by the contracting organizations. All such claims shall be forwarded at the same time. (Act 2011:94).

On the Making of Copies within Public Authorities, Enterprises, and Organizations, etc.

Article 42 b. The Parliament, decision-making municipal assemblies, governmental and municipal authorities as well as enterprises and organizations may, in order to satisfy the need for information within their field of activities, make copies, by means of reprographic reproduction, of published literary works and works of fine art reproduced in connection with the text in such a work, where an extended collective license applies pursuant to Article 42 a.

The provisions of the first Paragraph do not apply if the author has filed a prohibition against the reproduction with any of the contracting parties. (Act 2005:359).

On the Making of Copies within Educational Activities

Article 42 c. Copies may be made for educational purposes of works which have been made public, where an extended collective license applies pursuant to Article 42 a. The copies may be used only in such educational activities that are covered by the agreement constituting the basis for the coming into being of the extended collective license.

The provisions of the first Paragraph do not apply if the author has filed a prohibition against the reproduction with any of the contracting parties. (Act 2005:359).

On the Possibilities for Archives and Libraries to Communicate Works to the Public, etc.

Article 42 d. The archives and libraries referred to in Article 16, third and fourth Paragraphs, are, where an extended collective license applies pursuant to Article 42 a, entitled to 1. communicate works, with the exception of computer programs, to library borrowers in so far as concerns single articles, short portions or material which, for security reasons, should not be delivered in its original form, and 2. distribute copies which have been prepared pursuant to Article 16, first Paragraph, item 2, to library borrowers in cases other than those referred to in Article 16, second Paragraph,

The provisions of the first Paragraph do not apply if the author has filed a prohibition against the communication or the distribution with any of the contracting parties. (Act 2005:359).

On Sound Radio or Televisions Broadcasts

Article 42 e. Sound radio and television organizations as decided in specific cases by the Government are entitled to broadcast published literary and musical works and works of fine art which have been made public, provided that an extended collective license applies pursuant to Article 42 a.

The provisions of the first Paragraph do not apply to works made for the stage, nor to other works if the author has filed a prohibition with the organization to broadcast the work or there are otherwise special reasons to assume that he would oppose the broadcast. The provisions of the first Paragraph do not apply to re-transmissions referred to in Article 42 f.

As regards transmissions via satellite, the extended collective license applies only if the broadcasting organization simultaneously carries out a broadcast through a terrestrial transmitter. (Act 2005:359).

On Re-transmissions of Works Contained in Sound Radio or Television Broadcasts

Article 42 f. Anyone is entitled to transmit to the public (re-transmit), simultaneously and in an unaltered form, by wireless means or by wire, works which form part of a wireless sound radio or television broadcast, provided that an extended collective license applies pursuant to Article 42 a.

The provisions of the first Paragraph do not apply to works where the re- transmission right belongs to the sound radio or television organization that carries out the original transmission. (Act 2005:359).

Re-use of works in Sound radio or Television

Article 42 g. A sound radio or television organisation may, if an extended collective license applies under Article 42 a, communicate to the public works that have been made public, if the works form part of the organisation’s own productions or of productions that have been commissioned by the organisation and which have been broadcast before July 1, 2005. The organisation may also make such copies of the works that are necessary for the communication.

The first Paragraph does not apply if the author has filed with any of the contracting parties a prohibition against the communication or the reproduction or if, for other reasons, there is special reason to assume that the author would oppose the exploitation. (Act 2011:94).

CHAPTER 4. Term of Copyright

Article 43. Copyright in a work shall subsist until the end of the seventieth year after the year in which the author deceased or, in the case of a work referred to in Article 6, after the year in which the last surviving author deceased. However, copyright in a cinematographic work subsists, instead, to the end of the seventieth year after the death of the last deceased of one of the following persons, namely the principal director, the author of the screenplay, the author of the dialogue or the composer of the music specifically created for the work. (Act 1995:1273).

Article 44. In the case of a work which has been made public without mention of the author's name or generally known pseudonym or signature, the copyright shall subsist until the end of the seventieth year after the year in which the work was made public. If the work consists of two or more interconnected parts, the term shall be calculated separately for each part.

If the author reveals his identity within the term mentioned in the first Paragraph, the provisions of Article 43 shall apply.

For works which have not been made public and whose author is not known, the copyright subsists until the end of the seventieth year after the year in which the work was created.

Article 44 a. Where a work has not been published within the term referred to in Articles 43 or 44, the person who thereafter for the first time publishes or makes public the work shall benefit from such a right in the work which corresponds to the economic rights of the copyright. The right subsists until the end of the twenty-fifth year after the year in which the work was published or made public. (Act 1995:1273).

CHAPTER 5. Certain Rights Neighbouring to Copyright

Performing Artists

Article 45. Subject to the limitations prescribed in this Act, a performing artist has the exclusive right to exploit his performance of a literary or artistic work or of an expression of folklore, by 1. fixing the performance on a gramophone record, a film or another material support from which it can be reproduced, 2. making copies of a fixation of the performance, and 3. making the performance or a fixation of it available to the public.

The rights referred to in the first Paragraph, 2 and 3, last until the expiry of the fiftieth year from the year when the performance took place or, if the fixation has been published or made public within fifty years from the performance, from the year when the fixation was first published or made public.

The provisions of Article 2, second–fourth Paragraphs, 3, 6–9, 11–12, 16, 17, 21, 22, 25–26 b, 26 e, 26 k–26 m, and 27–29, 39, first sentence, 41, 42, 42 a, 42 c, 42 d, 42 f and 42 g shall apply in respect of performances referred to in this Article.

When a copy of a fixation pursuant to this Article has been, with the consent of the performing artist, transferred within the European Economic Area, the copy may be distributed further.

The provisions of the fourth Paragraph do not confer a right to make available to the public 1. copies of a fixation, through rental or similar legal acts, or

2. copies of a film or another material support on which moving images have been recorded, through lending. (Act 2011:94).

Producers of Recordings of Sounds and Images

Article 46. Subject to the limitations prescribed in this Act, a producer of recordings of sounds or of moving images has an exclusive right to exploit his recording by 1. making copies of the recording, and 2. making the recording available to the public.

The rights referred to in the first Paragraph last until fifty years have elapsed after the year in which the recording was made. If a sound recording is being published within this period, the rights last, instead, until the expiry of the fiftieth year after the year in which the sound recording was first published. If the sound recording is not published during the said period but is made public during the same period, the rights last, instead, until the expiry of the fiftieth year after the year in which the sound recording was first made public. If a recording of moving images has been published or made public within fifty years after the recording was made, the rights last until fifty years have expired after the year in which the recording of moving images was first published or made public.

The provisions of Article 2, second–fourth Paragraphs, 6–9, 11, second Paragraph, 11 a, 12, 16, 17, 21, 22, 25 - 26 b, 26 e, 26 k–26 m, 42 a, 42 c, 42 d and 42 g shall apply to recordings referred to in this Article. In addition, Article 42 f shall apply to recordings other than such referred to in Article 47.

When a copy of a recording pursuant to this Article has been, with the consent of the producer, transferred within the European Economic Area, that copy may be distributed further.

The provisions in the fourth Paragraph do not confer a right to make available to the public 1. copies of a recording through rental or other similar legal acts, or 2. copies of a film or other material support on which moving images have been recorded, through lending. (Act 2011:94).

Use of Sound Recordings for Public Performance, etc.

Article 47. Notwithstanding the provisions in Article 45, first Paragraph, and Article 46, first Paragraph, sound recordings may be used

1. for a public performance, or 2. for a communication to the public, except in cases where the communication occurs in such a way that members of the public may access the sound recordings from a place and at a time individually chosen by them.

When exploitation occurs as referred to in the first Paragraph, the producer and the performing artists whose performances appear in the recording, have a right to remuneration. Where two or more performing artists have cooperated in the performance, their right may be claimed by them only jointly. As against the user

of the recording, the claims of the performers and those of the producer shall be forwarded at the same time.

If a sound recording is used for a communication in the form of a wireless sound radio or television broadcast which is re-transmitted to the public by wire or by wireless means simultaneously and without alteration (further transmission) the following applies. As against the person who carries out the retransmission, the claim for remuneration may be forwarded only through organisations representing a substantial number of Swedish performing artists or producers. The organizations shall forward their claims at the same time as the claims referred to in Article 42 a., fifth Paragraph.

The provisions in Article 11, second Paragraph, shall apply to the cases referred to in this Article

This Article does not apply to sound films. (Act 2005:359).

Sound Radio and Television Organizations

Article 48. Subject to the limitations prescribed in the third Paragraph, a sound radio or television organization has an exclusive right to exploit a sound radio or television broadcast by 1. fixing the broadcast on a material support from which it can be reproduced, 2. making copies of a fixation of the broadcast, 3. distributing copies of a fixation of the broadcast to the public, 4. permitting a re-broadcast or a communication to the public in places accessible to the public against the payment of an entrance fee, or 5. permit that a fixation of the broadcast is being communicated, by wire or wireless means, to the public in such a way that members of the public may access the fixation from a place and at a time individually chosen by them.

The rights referred to in the first Paragraph, 2, 3 and 5, last until the expiry of the fiftieth year from the year in which the broadcast took place.

The provisions in Article 2, second Paragraph, 6 - 9, 11, second Paragraph, 11 a, 12, 16, 17, 21, 22, 25 - 26 b, 26 e and 42 g shall apply to sound radio and television broadcasts referred to in the Article.

When a copy of a fixation pursuant to this Article has been transferred within the European Economic Area with the consent of the organization, the copy may be distributed further.

If a sound radio or television organization has a claim for remuneration for such a retransmission as referred to in Article 42 f and which has been carried out with the consent of the organization, the claim shall be forwarded at the same time as the claims referred to in Article 42 a, fifth Paragraph. (Act 2011:94).

Article 48 a. If a television organization has alone a right to broadcast an event that is of significant public interest, other television organizations that are established within a country member of the European Economic Area may, notwithstanding Article 48, make use of extracts from the television broadcast of

the event in such of its own television broadcasts that constitute general news programs. The television organization may also make use of the extract when a recording of the news program is later made available to the public in such a way that members of the public may access the recording from a place and at a time individually chosen by them.

The extract may not be longer than what is justified by the information purpose. Nor may any use be made of it for a longer time after the event than may be justified by the news interest.

The provisions in Article 11, second Paragraph, shall apply in the cases referred to in the first Paragraph. (Act 2010:697).

Producers of Catalogues, etc.

Article 49. Anyone who has produced a catalogue, a table or another similar product in which a large number of information items have been compiled or which is the result of a significant investment, has an exclusive right to make copies of the product and to make it available to the public.

The right under the first Paragraph lasts until fifteen years have elapsed from the year in which the product was completed. If the product has been made available to the public within fifteen years from the completion of the product, the right shall, however, last until fifteen years have elapsed from the year in which the product first was made available to the public.

The provisions of Article 2, second–fourth Paragraphs, 6–9, 11, second Paragraph, 12, first, second and fourth Paragraphs, 14, 16–22, 25 - 26 b, 26 e, 26 g, fifth and sixth Paragraphs, and Articles 42 a–42 g shall apply to products referred to in this Article. If a product of this kind, or a part of it, is the subject of copyright, also this right may be claimed.

Contractual stipulations that extend the rights of the producer pursuant to the first Paragraph, are null and void. (Act 2011:94).

Photographers

Article 49 a. Anyone who has prepared a photographic picture has an exclusive right to make copies of the picture and to make it available to the public. The right applies regardless of whether the picture is used in its original form or an altered form and regardless of the technique used.

A picture that has been prepared by a process analogous to photography is also considered to be a photographic picture.

The right under the first Paragraph lasts until fifty years have elapsed after the year in which the picture was prepared.

The provisions of Articles 2, second–fourth Paragraphs, 3, 7–9, 11 and 11 a, 12, first and fourth Paragraphs, 16–20 a, 23, 24, first Paragraph, 25–26 b, 26 e,

26 k–28, 31–38, 41, 42, 42 a–42 g and 50–52 shall apply to pictures referred to in this Article. If such a picture is the subject of copyright, also this right may be claimed. (Act 2011:94).

CHAPTER 6. Special Provisions

Article 50. A literary or artistic work may not be made available to the public under such a title, pseudonym or signature that the work or its author may be easily confused with a work which has previously been made available to the public or with its author.

Article 51. If a literary or artistic work is performed or reproduced in a manner which violates cultural interests, a court may, upon action by an authority appointed by the Government, issue an injunction prohibiting such use, under penalty of a fine. This provision shall not apply during the lifetime of the author. (Act 1978:488).

Article 52. In connection with the adjudication of a fine, the Court may prescribe reasonable measures in order to prevent misuse of copies which are the subject of a prohibition under Article 51 and devices which can be used only for the production of such copies. Such a measure may prescribe that the property shall be destroyed or altered in a specific manner.

The provisions of this Article do not apply in relation to a person who has acquired the property, or a right therein, in good faith.

The property referred to in the first Paragraph may be taken into custody awaiting the measures mentioned in that Article; the general provisions on custody in criminal actions shall apply.

Article 52 a. Anyone wanting to carry out a retransmission by wire of works forming part of a wireless sound radio or television broadcast and who requests an agreement with an organisation representing Swedish right-owners or with a sound radio or television organisation carrying out emissions within the European Economic Area but is denied such an agreement on the terms requested, is, upon request, entitled to negotiations with the organisation or the sound radio or television organisation, respectively.

A party which has a duty to participate in such negotiations shall personally or through a representative attend a meeting for such negotiations and, if so is deemed necessary, put forward a reasoned proposal for the solution of the question which the negotiation concerns. The parties may agree on another form for negotiations than a meeting.

Anyone not complying with the provisions of the second Paragraph shall pay a compensation for the damage incurred. In the considerations concerning if and to what extent a damage has been caused to someone, also his interest in that the provision is applied and to circumstances other than such of a purely economic character shall be taken into account. (Act 1995:447).

CHAPTER 6 a. On the Protection of Technological Measures, etc.

Introductory Provisions

Article 52 b. This Chapter contains provisions on the protection of technological measures and of electronic information on the management of rights.

The expression “Technological measure” as used in this Chapter, means any effective technology, device or component designed to prevent or restrict, in the normal course of its operation, the reproduction or the making available to the public of a copyright- protected work without the consent of the author or his successor in title.

The expression “Information on the management of rights” means any information, also in the form of numbers or codes, that is linked to a copy of a copyright-protected work or appears in connection with the communication to the public of such a work and which aims at identifying the work or the author or his successor in title or at informing about the conditions of use of the work. The information must have been provided by the author or his successor in title. (Act 2005:359).

Article 52 c. The provisions on protection of technological measures in this Chapter do not apply to computer programs. Nor do they apply to the making available of official documents pursuant to Chapter 2 of the Freedom of the Press Act, to such use of works in the interest of the administration of justice or of public security that is referred to in Article 26 b, second Paragraph, or to research into cryptography.

The Act (2000:171) on Prohibition of Certain Decoding Equipment contains provisions aiming at preventing unauthorised access to certain services. As regards technological measures or arrangements used in connection with such conditional access to services in the form of such sound radio or television broadcasts as referred to in Article 2, item1, in that Act, the provisions on technological measures in this Chapter do not apply. (Act 2005:359).

On the Protection of Technological Measures

Article 52 d. It is prohibited to circumvent, without the consent of the author or his successor in title, any digital or analogue lock which prevents or limits the making of copies of a work protected by copyright, to circumvent a technological process, such as encryption, that prevents or limits the making available to the public of a work protected by copyright, or to circumvent any other technological measure that prevents or limits such acts of making available.

The provisions of the first Paragraph do not apply when someone, who in a lawful way has access to a copy of a work protected by copyright, circumvents a technological measure in order to be able to watch or listen to the work. (Act 2005:359).

Article 52 e. It is prohibited to manufacture, import, transfer, distribute by, for

instance, sale or rental, or to possess for commercial purposes any devices, products or components, or to make available services, which 1. are promoted, advertised or marketed for the purpose of circumvention of a technological measure, 2. other than to circumvent a technological measure, have only a limited interest from a commercial point of view, or a limited scope of commercial use, or 3. are primarily designed, constructed, adapted or produced for the purpose of enabling or facilitating a circumvention of a technological measure. (Act 2005:359).

On the Right to Use, in Certain Cases, Works Protected by Technological Measures

Article 52 f. Anyone who, pursuant to the provisions in Articles 16, 17, 26, 26 a. or 26 e, is entitled to exploit a work protected by copyright shall be entitled to make use of a copy of a work that he lawfully has access to as referred to in the relevant provision, notwithstanding the fact that the copy is protected by a technological measure.

Where a technological measure prevents such a use, a Court may, at the request by a user entitled to that use, order, upon penalty of a fine, the author or his successor in title to make it possible for the user to exploit the work in the way prescribed in the provision referred to.

The provisions in the first and the second Paragraphs do not apply to works that have been made available to the public in accordance with agreed contractual stipulations in a way that makes it possible for members of the public to get access to the work by means of a communication from a place and a time that they themselves have chosen. (Act 2005:359).

On the Protection of Electronic Rights Management Information

Article 52 g. It is, without the consent by the author or his successor in title, prohibited to 1. remove or alter any electronic rights management information relating to a work protected by copyright, 2. exploit a work protected by copyright, or a copy of it, that has been altered in violation of item 1, by distributing it, importing it for the purpose of distribution or communicating it to the public.

The provisions of the first Paragraph apply only if the measure undertaken induces, enables, facilitates or conceals an infringement of a right protected under this Act. (Act 2005:359).

On the Application of the Provisions on Neighbouring Rights

Article 52 h. The provisions in this Chapter relating to works shall apply correspondingly to subject matter protected pursuant to Articles 45, 46 and 48 as well as to such compilations and photographs which are protected under Articles 49 and 49 a. (Act 2005:359).

CHAPTER 7. On Penal and Civil Liability

Article 53. Anyone who, in relation to a literary or artistic work, commits an act which infringes the copyright enjoyed in the work under the provisions of Chapters 1 and 2 or which violates directions given under Article 41, second paragraph, or Article 50, shall, where the act is committed wilfully or with gross negligence, be punished by fines or imprisonment for not more than two years.

Anyone who for his private use copies a computer program which is published or of which a copy has been transferred with the authorisation of the author shall not be subject to criminal liability, if the master copy for the copying is not used in commercial or public activities and he or she does not use the copies produced of the computer program for any purposes other than his private use. Anyone who for his private use has made a copy in digital form of a compilation in digital form which has been made the public shall, under the same conditions, not be subject to criminal liability for the act.

The provisions of the first Paragraph also apply if a person imports copies of a work into Sweden for distribution to the public, if such a copy has been produced abroad under such circumstances that a similar production here would have been punishable under that Paragraph.

Anyone who has violated an injunction issued under penalty of a fine pursuant to Article 53 b, may not be held liable under criminal law for the infringement covered by the injunction.

Attempts to commit acts implying violations referred to in the first and third Paragraphs, and preparations for such acts are punishable pursuant to Chapter 23 of the Criminal Code. (Act 2005:360).

Article 53 a. Property in relation to which a violation has occurred pursuant to this Act shall be declared forfeited, if that is not considered obviously unreasonable. Instead of the property itself, its value may be declared forfeited. Also profits from such a violation shall be declared forfeited, if it is not obviously unreasonable. The same applies to what someone has received in compensation for costs related to such a violation, or the value of what has been received, where the act of receiving constitutes a violation pursuant to this Act.

Property that has been used as a tool in connection with a violation under this Act may be declared forfeited, where this is needed in order to prevent violations or where there are otherwise special reasons. The same applies to property that has been intended to be used as a tool in connection with such a violation, where the violation has been carried out or has constituted a punishable attempt or a punishable preparation. Instead of the property itself, its value may be forfeited. (Act 2005:360)

Article 53 b. Upon a petition by the author or his or her successor in title or by a party that, on the basis of a license, has the right to exploit the work, the Court may issue an injunction prohibiting, on penalty of a fine, a party that commits, or

contributes to, an act constituting an infringement or a violation referred to in Article 53 to continue that act.

If the plaintiff shows a probable cause that an act constituting an infringement or a violation referred to in Article 53, or a contribution to that act, takes place and if it can reasonably be expected that the defendant, through the continuation of the act, or the contribution thereto, diminishes the value of the exclusive right that copyright confers, the Court may issue an injunction, on penalty of a fine, for the time until the case has been finally adjudicated or otherwise is decided. No injunction may be issued before the defendant has been given an opportunity to respond, unless a delay would entail a risk for damage.

The provisions in the first and second Paragraphs apply also to acts constituting attempts, and to preparatory acts, relating to infringements or violations referred to in Article 53.

An injunction mentioned in the second Paragraph may be issued only if the plaintiff deposits a security with the Court for the damage that may be caused to the defendant. If the plaintiff is not capable of depositing such a security, the Court may liberate him or her from it. As regards the type of security, the provisions of Chapter 2, Article 25, of the Enforcement Code shall apply. The security shall be examined by the Court unless the defendant has accepted it.

When the case is adjudicated, the Court shall decide whether a prohibition issued pursuant to the second Paragraph shall continue to apply.

As regards appeals against decisions under the second or fourth Paragraph and as regards the proceedings in higher Courts the provisions on appeal against decisions in Chapter 15 of the Code of Judicial Procedure apply.

An action for the imposition of a fine may be brought by the party that has requested the injunction and shall be processed in accordance with the provisions in the Code of Judicial Procedure relating to actions in cases where a higher penalty than fines is not prescribed.

In connection with such an imposition, an action may be brought for a new injunction to be issued on penalty of a fine. (Act 2009:109)

Article 53 c. If the applicant shows a probable cause that someone has committed an infringement or a violation referred to in Article 53, the Court may order, on penalty of a fine, one or several of the parties referred to in the second Paragraph to provide information to the applicant concerning the origin and distribution networks for the goods or services in respect of which the infringement or the violation has been committed (order to provide information). Such an order may be issued upon a petition by the author or the successor in title of the author or by a party that, on the basis of a license, has the right to exploit the work. It may be issued only if it can be assumed that the information would facilitate an inquiry into the infringement or the violation related to the goods or services.

The obligation to provide information relates to any party that 1. has committed, or contributed to, the infringement or committed, or contributed to, the violation, 2. has on a commercial scale been exploiting the goods that the infringement or the violation concerns, 3. has on a commercial scale been exploiting the service that the infringement or the violation concerns, 4. has on a commercial scale made available an electronic communication service or another service that has been used in connection with the infringement or the violation, or 5. has been indicated by a party referred to in items 2 to 4 as being involved in the production distribution of the goods, or the making available of the service, that the infringement or the violation concerns.

The information on the origin or distribution network of goods or services may, in particular, include 1. the names and addresses of producers, distributors, suppliers and others who have previously held the goods or made available the services, 2. the names and addresses of intended wholesalers and retailers, 3. information on how much has been produced, delivered, received or ordered and the price obtained for the goods or services.

The provisions in the first to third Paragraphs apply also to acts constituting attempts, and to preparatory acts, relating to infringements or violations referred to in Article 53. (Act 2009:109).

Article 53 d. An order to provide information may be issued only if the reasons speaking in favour of the measure outweigh the inconvenience or other harm that the measure would cause to the party against which it is directed or to any other opposite interest.

The obligation to provide information pursuant to Article 53 c does not include information the revelation of which would disclose that the provider of the information or any person closely related to him or she as referred to in Chapter 36, Article 3, of the Code of Judicial Procedure has committed a criminal offence.

The Act (1998:204) on Personal Data contains provisions that limit the use that can be made of personal data received. (Act 2009:109).

Article 53 e. A decision on an order to provide information may be rendered by the Court where a trial on the infringement or the violation is pending. In other respects, the issue of the competence of the Court is governed by Article 58 in respect of cases referred to there, and by the provisions for civil cases in the Code of Civil Procedure in respect of other cases related to infringements or violations. The provisions in the Code of Judicial Procedure relating to limitation of the competence of a Court in disputes that has to be initiated in a way other than before a Court shall, however, not apply.

If the application for an order to provide information is directed against the applicant´s opposing party in a case related to an infringement or a

violation, the provisions on court procedures for that case apply. Decisions on orders to provide information may be appealed separately.

If the petition for an order to provide information is directed against a party other than the one referred to in the second Paragraph, the provisions in the Act (1996:242) on Court Matters shall apply. For the purpose of the consideration of the issue, also an oral hearing may be held pursuant to Chapter 37 of the Code of Judicial Procedure. The Court may decide that each party shall bear its own litigation costs.

An action for the imposition of a fine may be brought by the party that has applied for the order and shall be processed in accordance with the provisions in the Code of Judicial Procedure on actions in criminal cases for which no higher penalty than a fine is prescribed. In connection with such an action, an action may be brought for a new order to provide information. (Act 2009:109).

Article 53 f. Anyone who pursuant to the provisions in Article 53 c, second Paragraph, items 2 to 5, has been ordered to provide information pursuant to the first Paragraph of the same Article, has a right to a reasonable compensation for the costs and inconvenience caused. The compensation shall be paid by the party that has applied for the order to provide information.

Anyone who makes available an electronic communication service and who has, pursuant to an order to provide information, delivered information referred to in Chapter 6, Article 20, of the Act (2003:389) on Electronic Communication, shall send a written notice on this to the person whom the information concerns not earlier than one month and not later than three months from the delivery of the information. Costs for the notice shall be compensated in accordance with the first Paragraph. (Act 2009:109).

Article 53 g. Notwithstanding the prohibition in Article 21 of the Act (1998:204) on Personal Data, personal data on violations of the law that constitute criminal offences pursuant to Article 53 may be processed if this is necessary in order for a legal claim to be established, asserted or defended (Act 2009:109).

Article 53 h. At the petition of the plaintiff, the Court may, in cases of infringements or violations referred to in Article 53, order the party that has committed, or contributed to, the infringement or committed, or contributed to, the violation to pay a pecuniary compensation for appropriate measures to disseminate information about the judgement in the case.

The provisions in the first Paragraph apply also to acts constituting attempts, and to preparatory acts, referred to in Article 53. (Act 2009:109).

Article 54. Anyone who exploits a work in violation of this Act or of directions pursuant to Article 41, second Paragraph, shall pay to the author or his or her successor in title a reasonable compensation for the exploitation.

Where it has been carried out wilfully or with negligence, compensation shall be paid also for the further damage that the infringement or the violation has caused. When the amount of the compensation is decided, particular consideration shall be given to 1. lost profit, 2. profit that has been made by the party that committed the infringement or the violation, 3. damage caused to the reputation of the work, 4. moral damage, and 5. the interest of the author or the right holder in that infringements are not committed.

The provisions of the second Paragraph apply also to anyone who otherwise wilfully or with negligence commits an act constituting an infringement or a violation pursuant to Article 53.

The obligation to pay compensation pursuant to the first or second Paragraph does not apply to the person who, in connection with the making of copies for private purposes, violates only Article 12, fourth Paragraph, unless this violation is carried out wilfully or with gross negligence. (Act 2009:109)

Article 55. Upon petition by the author or his or her successor in title, the Court may, in so far as is reasonable, decide that property in respect of which an infringement or a violation referred to in Article 53 exists shall be recalled from the channels of commerce, be altered or destroyed or that some other measure shall be taken in respect of it. The same applies to implements that have been, or have been intended to be, used in connection with the infringement or the violation.

The provisions of the first Paragraph apply also to acts constituting attempts, and to preparatory acts, relating to an infringement or a violation pursuant to Article 53.

The provisions of the first Paragraph do not apply if the illegal action has involved the construction of a work of architecture.

A decision on a measure pursuant to the first Paragraph must not imply that the author or his or her successor in title will be ordered to pay compensation to the party against which the measure is directed.

Any measures pursuant to the first Paragraph shall be paid for by the defendant where there are no specific reasons against it.

A decision referred to in this Article shall not be rendered, if forfeiture or a measure for the prevention of wrongful acts shall be decided pursuant to Article 53 a. or the Criminal Code. (Act 2009:109).

Article 56. Notwithstanding Article 55, the Court may, if this is reasonable in view of the artistic or economic value of a copy of a work or of other circumstances, upon a petition by a party that has acted in good faith permit, issue a permission to the effect that the copy may, against the payment of a specific compensation to the author or his or her successor in title, be made available to the public or used

for other intended purpose. (Act 2009:109).

Article 56 a. Where it can reasonably be assumed that someone has committed, or contributed to, an infringement or committed, or contributed to, a violation referred to in Article 53, the Court may, for the purpose of preserving evidence relating to the infringement or the violation, order that an investigation be undertaken in respect of that party in order to search for objects or documents that can be assumed to be of importance for the inquiry into the infringement or the violation (infringement investigation).

An order for an infringement investigation may be issued only if the reasons speaking in favour of the measure outweigh the inconvenience or other harm that the measure would cause to the party against which it is directed or any other opposite interest.

The provisions in the first and second Paragraphs apply also to acts constituting attempts, and to preparatory acts, relating to infringements of violations referred to in Article 53. (Act 2009:109).

Article 56 b. An order for an infringement investigation is issued by the Court where proceedings relating to the infringement are conducted. Where legal proceedings have not yet been initiated, the issue of the competence of the Courts is governed by the provisions in Article 58 in respect of cases referred to there, and by the provisions for civil cases in the Code of Judicial Procedure in respect of other cases related to infringements or violations. The provisions in the Code of Judicial Procedure relating to limitation of the competence of a Court in disputes that have to be initiated otherwise than before a Court shall, however, not apply.

Issues relating to infringement investigations may be taken up for consideration only upon a petition by the author or the author´s successor in title or by a party that, on the basis of a license, has a right to exploit the work. Where legal proceedings have not yet been initiated, the petition shall be submitted in writing.

The opposite party shall be given an opportunity to respond before an order for an investigation is issued. Where a delay would entail a risk that objects or documents of importance for the inquiry of the infringement would be removed, destroyed or distorted, the Court may, however, immediately issue an order to be valid until otherwise decided.

In other respects, any issue relating to an infringement investigation which arises before legal proceedings have been initiated shall be processed in the same way as if the issue had arisen in the course of legal proceedings. (Act 2009:109).

Article 56 c. An order for an infringement investigation may be issued only where the applicant posts a bond at the Court for the injury which may be caused to the opposite party. Where the applicant is not able to post a bond, the Court may liberate him from it. As regards the type of security, the provisions of Chapter 2, Article 25, of the Enforcement Code shall apply. The security shall be examined by the Court, unless the opposite party has accepted it.

As regards appeals against the decision by the Court relating to an infringement investigation and as regards the proceedings in higher Courts the provisions concerning appeal against decisions prescribed in Chapter 15 of the Code of Judicial Procedure apply. (Act 1998:1454).

Article 56 d. Any order for an infringement investigation shall contain information about 1. the purpose of the investigation, 2. the objects and document which may be searched for, and 3. which venues may be searched.

Where necessary, the Court shall set also other conditions for the execution of the order. (Act 1998:1454).

Article 56 e. An order for an infringement investigation is immediately enforceable. If an application for its execution has not been filed within one month from the order, the order becomes invalid.

Where the applicant does not, within a month from the conclusion of the execution, file an action or initiate in some other manner a proceeding relating to the issue, any measure which has been undertaken in the context of the execution of the infringement investigation shall be invalidated to the extent possible. The same applies where an order for an infringement investigation is invalidated after the execution has been concluded. (Act 1998:1454).

Article 56 f. An order for an infringement investigation is executed through the local Enforcement Authority in accordance with the conditions prescribed by the Court and in applying Chapters 1 to 3, Chapter 16, Article 10, Chapter 17, Articles 1 to 5, and Chapter 18 of the Enforcement Code. The applicant's opposite party shall be informed about the execution only if the order for an infringement investigation has been issued after hearing the opposite party. The Authority has the right to take photographs and to make video and sound recordings of such objects for which it is authorised to search. The Authority may also make copies of, and extracts from, such documents for which it is authorised to search.

An infringement investigation must not concern written documents referred to in Chapter 27, Article 2, of the Code of Judicial Procedure. (Act 2006:680).

Article 56 g. The opposite party has the right to summon an attorney when an order for an infringement investigation is to be executed. The execution must not begin before the attorney has arrived. This does, however, not apply if 1. the investigation is thereby unnecessarily delayed, or 2. there is otherwise a risk that the purpose of the measure will not be achieved.

In the course of the execution the Enforcement Authority is authorised to engage, as necessary, the services of an expert.

The Authority may permit the applicant or a representative of the applicant to attend the investigation in order to provide information. If such permission is granted, the Authority shall see to it that the applicant or the representative is

not being informed about the findings at the investigation more than can be justified by the execution. (Act 2006:680).

Article 56 h. Photographs and video and sound recordings of objects as well as copies of, and extracts from, documents shall be listed and shall be held available for the applicant and the opposite party. (Act 1998:1454).

Article 57. The provisions of Articles 53–56 h shall apply also to rights protected by the provisions in Chapter 5. (Act 1998:1454).

Article 57 a. Anyone who, in cases other than those referred to in Article 53, sells, leases or possesses for sale, lease or other commercial purposes a device intended solely for facilitating unauthorised removal or circumvention of a device placed in order to protect a computer program against unauthorised reproduction, shall be punished by fines or imprisonment for not more than six months. (Act 1992:1687).

Article 57 b. Anyone who, in cases other than those referred to in Article 53, wilfully or with gross negligence violates Articles 52 e or 52 g, shall be punished by fines or imprisonment for not more than six months.

Anyone who, in cases other than those referred to in Article 53, wilfully or with gross negligence violates Article 52 d, shall be punished by fines. (Act 2005:359)

Article 58. The District Court of Stockholm shall have jurisdiction in cases involving sound radio or television broadcasts in violation of this Act. The same shall apply in cases involving claims for compensation under Articles 17 and 18, 26 a, first Paragraph, 42 a, third Paragraph, or 47, and in cases where a corresponding compensation is claimed on the basis of a reference in Articles 45, 46, 48, 49 or 49 a, and in cases concerning compensation for retransmissions referred to in Article 42 f. (Act 2005:359).

Article 59. Violations referred to in Article 57 b, second Paragraph may be the subject of a criminal action by a public prosecutor only if this is called for in the public interest. Criminal actions for other violations of this Act may be initiated by a public prosecutor if there is a complaint from an injured party or if such an action is called for in the public interest.

An action relating to a violation of the provisions in Article 3 or of directions given under Article 41, second Paragraph, may always be initiated by the surviving spouse of the author, by his relatives in the direct ascending or descending line or by his brothers or sisters.

If there is reason to believe that a criminal violation under this Act has occurred, property referred to in Article 55 may be taken into custody. In such cases the rules governing custody in criminal cases in general apply. (Act 2005:359).

CHAPTER 8. Applicability of the Act

Article 60. The provisions on copyright apply to:

1. works of Swedish nationals or of persons who have their habitual residence in Sweden, 2. works first published in Sweden or simultaneously in Sweden and outside the country, 3. cinematographic works whose producer has his headquarters or habitual residence in Sweden, 4. works of architecture constructed here, 5. works of fine art incorporated in a building situated here or in some other way permanently fixed to the ground.

For the purposes of the application of the first Paragraph, item 2, a simultaneous publication shall be considered to have taken place if the work has been published in Sweden within thirty days from its publication abroad. For the purposes of the application of the first Paragraph, item 3, the person whose name appears on copies of a cinematographic work in the usual manner shall, in the absence of a proof to the contrary, be deemed to be the producer of the said work.

The provisions of Articles 26 k to 26 p apply to works by persons who are Swedish nationals or who have their habitual residence in Sweden.

The provisions of Article 44 a. apply to acts of publication or of making public by persons who are Swedish nationals or who have their habitual residence in Sweden. The provisions apply also to acts of publication or of making public by legal entities having their headquarters in Sweden.

The provisions of Articles 50 and 51 apply to all literary or artistic works regardless of their origin. (Act 2007:521).

Article 61. The provisions of Articles 45, 47 and 48 apply to performances, sound recordings and sound radio and television broadcasts which take place in Sweden. In addition, the provisions of Article 45 apply to performances of persons who are Swedish nationals or have their habitual residence in Sweden, the provisions of Article 47 to sound recordings whose producer is a Swedish national or a Swedish legal entity or a person who has his habitual residence here, and the provisions in Article 48 to broadcasts by sound radio and television organisations having their headquarters in this country. The provisions of Article 46 apply to sound recordings and to recordings of moving images whose producer is a Swedish national or a Swedish legal entity or has his habitual residence in Sweden as well as to such recordings of moving images which take place in Sweden. However, the provision of Article 46 applies, as regards reproduction, to all sound recordings.

The provisions of Article 49. apply to productions whose producer is a Swedish citizen or has his habitual residence in Sweden. The provisions also apply to productions whose producer is a Swedish legal entity and have its registered office, its main headquarters or its principal place of business in Sweden. If the legal entity has its registered office in Sweden but does not have its main headquarters or its principal place of business here, the provisions apply, however, only where the production forms part of an economic activity established in Sweden.

Of the provisions in Article 49 a, the reference to Articles 50 and 51 applies to all photographic pictures and the other provisions to photographic pictures, 1. whose producer is a Swedish national or has his habitual residence in Sweden, 2. that have been first published in Sweden or simultaneously in Sweden and abroad, 3. that have been incorporated in a building or another construction which is permanently fixed to the ground, if the building or the construction is located in Sweden.

For the purposes of the application of the third Paragraph, item 2, the publication shall be considered to have taken place simultaneously if the picture has been published in Sweden within thirty days from its publication abroad.

Of the provisions in Article 45, the reference to Articles 26 k to 26 m applies only to performances by someone who is a Swedish national or has his habitual residence in Sweden. Of the provisions in Article 46, the reference to Articles 26 k to 26 m applies only to recordings whose producer is a Swedish national or a Swedish legal entity or has his habitual residence in Sweden. Of the provisions in Article 49 a, the references to Articles 26 k to 26 p apply only to photographic pictures whose maker is a Swedish national or has his habitual residence in Sweden. (Act 2007:521).

Article 61 a. When a work or another subject matter protected under this Act is communicated to the public via satellite, the act which is relevant from the point of view of copyright and neighbouring rights shall be deemed to take place in the country where the broadcasting organisation, under its control and its responsibility, introduces the subject matter into an uninterrupted chain of communication to the satellite and from there down towards the earth.

What has been said now does not apply if the introduction has taken place in a country which is not part of the European Economic Area and which does not apply the level of protection provided for in Chapter 2 of the Directive of the European Communities No 93/83/EEG of September 27, 1993.

If, in cases referred to in the second Paragraph, the transmission to the satellite takes place in a country member of the European Economic Area, the act which is relevant from the point of view of copyright and neighbouring rights shall be deemed to occur in the country from where the transmission takes place. If the transmission to the satellite does not take place in a country member of the European Economic Area but the sound radio or television organisation which has decided the transmission has its registered office in a country member of that Area, the act relevant from the point of view of copyright and neighbouring rights shall be deemed to occur in that country. (Act 1995:1273).

Article 62. On condition of reciprocity, or where this follows from such an agreement with a foreign State or with an intergovernmental organisation which has been approved by the Parliament, the Government may provide for the application of this Act in relation to other countries. The Government may also provide for the application of the Act to works and photographic pictures first published by an intergovernmental organisation and to unpublished works and

photographic pictures which such an organisation may publish. (Act 1995:1273).

CHAPTER 9. Provisions Governing the Entry into Force and Transitional Provisions

Article 63. This Act enters into force on July 1, 1961.

(Other provisions on the entry into force of this Act and of subsequent amendments to the Act are not included).

Chapitre 9 : Dispositions régissant l’entrée en vigueur de la loi et dispositions transitoires [non reproduites ici]

Chapitre premier Objet et portée

Art. premier. Tout créateur d’une œuvre littéraire ou artistique jouit du droit d’auteur sur cette œuvre, qu’il s’agisse

1. d’une œuvre de fiction ou d’un exposé descriptif sous forme écrite ou orale, 2. d’un programme d’ordinateur, 3. d’une œuvre musicale ou dramatique, 4. d’une œuvre cinématographique, 5. d’une œuvre photographique ou d’une autre œuvre des beaux-arts, 6. d’une œuvre d’architecture ou d’une œuvre des arts appliqués, 7. d’une œuvre relevant d’une quelconque autre forme d’expression. Les cartes géographiques et les autres œuvres de caractère descriptif exécutées sous la forme de

dessins ou de gravures ou en trois dimensions sont considérées comme des œuvres littéraires. Les prescriptions de la présente loi visant les programmes d’ordinateur s’appliquent aussi, mutatis

mutandis, au matériel de conception préparatoire.

Art. 2. Dans les limites énoncées ci-après, le droit d’auteur comprend le droit exclusif de disposer d’une œuvre pour la reproduire et la rendre accessible au public, sous sa forme originale ou sous une forme modifiée, par traduction ou adaptation dans un autre genre littéraire ou artistique ou bien par un autre procédé.

L’enregistrement d’une œuvre sur des supports qui en permettent la reproduction est assimilé à la fabrication d’exemplaires.

Une œuvre est rendue accessible au public lorsqu’elle est représentée ou exécutée en public ou lorsque des copies ou exemplaires en sont offerts à la vente, en location ou en prêt, diffusés dans le public ou exposés de toute autre façon en public. La représentation ou l’exécution d’une œuvre dans le cadre d’une activité commerciale à l’intention d’un groupe déterminé de personnes relativement important est considérée comme une représentation ou une exécution publique.

Art. 3. Le nom de l’auteur doit être indiqué, dans la mesure et de la manière conforme aux usages, lorsque l’œuvre est reproduite ou lorsqu’elle est rendue accessible au public.

Aucune œuvre ne peut être modifiée d’une façon préjudiciable à la réputation littéraire ou artistique de l’auteur ou à son individualité ni être rendue accessible au public sous une forme et dans des circonstances qui fassent subir un préjudice de cet ordre à l’auteur.

L’auteur ne peut renoncer au droit qui lui est conféré par le présent article qu’en ce qui concerne des utilisations de l’œuvre strictement délimitées quant à leur nature et leur portée.

Art. 4. Quiconque a traduit ou adapté une œuvre ou l’a transposée dans un autre genre littéraire ou artistique jouit du droit d’auteur sur l’œuvre dans sa nouvelle forme, mais le droit de disposer de cette œuvre est subordonné au droit d’auteur sur l’œuvre d’origine.

Celui qui, en s’inspirant librement d’une œuvre, a créé une œuvre nouvelle et indépendante, jouit d’un droit d’auteur qui n’est pas subordonné au droit existant sur l’œuvre d’origine.

Art. 5. Quiconque, en réunissant des œuvres ou des parties d’œuvres, crée une œuvre littéraire ou artistique composite jouit du droit d’auteur sur cette œuvre, sans préjudice toutefois des droits pouvant exister sur les différentes œuvres qui la composent.

Art. 6. Lorsqu’une œuvre a été créée par plusieurs auteurs dont les contributions ne constituent pas des œuvres indépendantes, les auteurs jouissent conjointement du droit d’auteur sur cette œuvre. Chacun d’entre eux peut toutefois intenter seul une action en cas d’atteinte au droit d’auteur.

Art. 7. Sauf preuve contraire, est présumée être l’auteur d’une œuvre la personne dont le nom, ou le pseudonyme ou la signature notoire, figure selon les usages sur les copies ou exemplaires de l’œuvre, ou est indiqué lorsque l’œuvre est rendue accessible au public.

Si une œuvre est publiée sans que le nom de l’auteur soit indiqué de la façon visée à l’alinéa précédent, le directeur de publication, s’il est mentionné, ou sinon l’éditeur représente l’auteur jusqu’à ce que l’identité de celui-ci soit indiquée dans une nouvelle édition de l’œuvre ou dans une déclaration adressée au Ministère de la justice.

Art. 8. Une œuvre est considérée comme ayant été divulguée lorsqu’elle a été licitement rendue accessible au public.

Une œuvre est considérée comme publiée lorsque des copies ou exemplaires en ont été mis en vente ou diffusés de toute autre façon dans le public avec l’autorisation de l’auteur.

Art. 9. Ne sont pas protégés par le droit d’auteur 1. les lois et règlements, 2. les décisions des pouvoirs publics, 3. les rapports des pouvoirs publics suédois, 4. les traductions officielles des textes visés aux points 1 à 3. Restent toutefois protégées par le droit d’auteur, lorsqu’elles sont incorporées à un document visé au

premier alinéa, les œuvres des catégories suivantes : 1. cartes géographiques, 2. dessins, peintures ou gravures, 3. œuvres musicales ou 4. œuvres de poésie.

Art. 10. Une œuvre reste protégée au titre du droit d’auteur même si elle a été enregistrée en tant que dessin ou modèle.

Les schémas de configuration de produits semi-conducteurs ne sont pas protégés par le droit d’auteur. Les droits existant sur ces schémas sont régis par des dispositions spéciales.

Chapitre 2 Limitations du droit d’auteur

Dispositions générales

Art. 11. Les dispositions du présent chapitre n’apportent pas au droit d’auteur défini à l’article 3 d’autres restrictions que celles qui découlent de l’article 26c.

Lors de toute utilisation publique d’une œuvre en application des dispositions du présent chapitre, la source doit être indiquée dans la mesure et de la manière conformes aux usages, et l’œuvre ne peut pas être modifiée plus que ne l’exige l’utilisation licite.

Reproduction à des fins privées

Art. 12. Une œuvre divulguée peut être reproduite par quiconque sous la forme de copies isolées à des fins d’utilisation privée. Ces copies ne peuvent pas être utilisées à d’autres fins.

Les dispositions énoncées au premier alinéa ne s’appliquent pas aux programmes d’ordinateur et n’emportent pas le droit de construire une œuvre d’architecture.

Les dispositions énoncées au premier alinéa ne confèrent à quiconque le droit de faire copier par un tiers, pour un usage personnel,

1. des œuvres musicales ou cinématographiques, 2. des objets utilitaires ou des sculptures, 3. l’œuvre artistique d’autrui au moyen d’un procédé de reproduction artistique.

Reproduction dans le cadre d’activités d’enseignement

Art. 13. La reproduction reprographique d’une œuvre publiée ou la fixation d’une œuvre radiodiffusée ou télévisée sont autorisées aux fins de l’enseignement si une licence collective élargie est applicable en vertu de l’article 26i. Les copies et les enregistrements ainsi réalisés ne peuvent être utilisés que pour les activités d’enseignement visées par l’accord sur lequel se fonde cette licence collective élargie.

Une œuvre ne peut être reproduite en vertu du premier alinéa si l’auteur a avisé par écrit l’une ou l’autre des parties contractantes que cette reproduction était interdite.

Art. 14. Les enseignants et les élèves peuvent, aux fins de l’enseignement, faire des fixations de leurs propres interprétations ou exécutions d’œuvres. Ces fixations ne peuvent pas être utilisées à d’autres fins.

Art. 15. Les hôpitaux et les établissements d’accueil ou de soins pour personnes âgées ou handicapées sont autorisés à faire des fixations d’émissions de radiodiffusion sonores ou visuelles. Ces fixations ne peuvent être utilisées qu’au sein de l’établissement et à bref délai après leur réalisation.

Reproduction par certains services d’archives et bibliothèques

Art. 16. Les services d’archives et bibliothèques énumérés aux troisième et quatrième alinéas du présent article peuvent faire des copies d’œuvres, sauf de programmes d’ordinateur, dans les circonstances suivantes :

1. à des fins de préservation, pour compléter une collection ou dans un but de recherche, 2. pour fournir aux utilisateurs des articles isolés ou de courts extraits d’œuvres ou encore des

documents dont l’original, pour des raisons de sécurité, ne doit pas être remis au public ou 3. pour utilisation dans des dispositifs de lecture. La reproduction visée aux points 2 et 3 du premier alinéa ne peut être effectuée que par reprographie. Sont autorisés à faire des copies d’œuvres en vertu du présent article

1. les services d’archives nationaux et municipaux, 2. le Dépôt national des enregistrements sonores et des images en mouvement, 3. les bibliothèques scientifiques et de recherche qui sont gérées par les pouvoirs publics et 4. les bibliothèques publiques. Le gouvernement peut en outre, dans des circonstances particulières, accorder à certains services

d’archives et bibliothèques autres que ceux qui sont indiqués au troisième alinéa, le droit de réaliser des copies d’œuvres en vertu du présent article.

Reproduction à l’usage des personnes ayant un handicap visuel ou autre

Art. 17. Toute personne a le droit de réaliser des exemplaires imprimés en braille d’œuvres littéraires ou musicales publiées.

Dans certaines circonstances, le gouvernement peut accorder à des bibliothèques et à des organismes le droit de faire des copies d’œuvres littéraires publiées, soit par fixation directe d’une interprétation orale de l’œuvre, soit par report effectué à partir d’un autre enregistrement, pour les prêter aux aveugles ou malvoyants et à d’autres personnes ayant un handicap qui les empêche d’accéder aux œuvres sous leur forme écrite. Cette faculté ne s’étend toutefois pas aux œuvres dont des enregistrements ont été mis sur le marché.

Œuvres composites destinées à des activités d’enseignement

Art. 18. Le compilateur d’un ouvrage destiné à l’enseignement qui rassemble des œuvres de nombreux auteurs peut, pour ce travail, reproduire des fragments d’œuvres littéraires ou musicales ou de courtes œuvres de cette nature, à condition que cinq ans se soient écoulés depuis la publication de l’œuvre. Des œuvres d’art peuvent aussi être reproduites en relation avec le texte, à la condition que cinq ans se soient écoulés depuis leur divulgation. Les auteurs ont droit à une rémunération.

Les dispositions du premier alinéa ne s’appliquent pas aux œuvres qui ont été créées pour l’enseignement.

Diffusion de copies ou d’exemplaires

Art. 19. Lorsqu’une copie ou un exemplaire d’une œuvre littéraire ou musicale ou d’une œuvre des beaux-arts a été cédé avec l’autorisation de l’auteur, il peut faire l’objet d’une nouvelle diffusion. En ce qui concerne les exemplaires de programmes d’ordinateur, cette possibilité de nouvelle diffusion est assortie de la condition que la cession de l’exemplaire, avec l’autorisation de l’auteur, ait eu lieu à l’intérieur de l’Espace économique européen.

Les dispositions du premier alinéa ne permettent pas de mettre à la disposition du public 1. des copies ou exemplaires d’œuvres, à l’exception des édifices et des œuvres des arts appliqués,

par voie de location ou d’une activité similaire ni 2. des exemplaires de programmes d’ordinateur sous une forme déchiffrable par machine, par voie

de prêt.

Exposition de copies ou d’exemplaires

Art. 20. Lorsqu’une œuvre a été publiée, les copies ou exemplaires faisant partie de cette publication peuvent être exposés en public. Il en va de même lorsque l’auteur a cédé des copies ou exemplaires d’une œuvre des beaux-arts.

Les dispositions du premier alinéa ne confèrent pas le droit de présenter des copies ou exemplaires d’œuvres des beaux-arts dans un film ou dans une émission de télévision. Les copies ou exemplaires d’œuvres d’art visées au premier alinéa peuvent toutefois figurer dans un film ou dans une émission de télévision, à condition de n’avoir qu’une importance mineure par rapport au contenu du film ou de l’émission.

Représentation ou exécution publique

Art. 21. Toute personne peut représenter ou exécuter en public une œuvre publiée 1. lors de manifestations dont la représentation ou l’exécution d’œuvres n’est pas l’objet essentiel,

sous réserve que le public soit admis gratuitement et que la manifestation ne soit pas organisée dans un but lucratif et

2. dans le cadre de l’enseignement et à l’occasion de services religieux. Les dispositions du premier alinéa du présent article ne s’appliquent pas aux œuvres dramatiques ni

aux œuvres cinématographiques; elles ne confèrent pas non plus le droit d’utiliser une œuvre dans le cadre d’une émission de radiodiffusion sonore ou visuelle.

L’utilisation de l’œuvre doit toutefois rester à la mesure du but d’information recherché.

Toute personne a le droit d’utiliser une œuvre qui est incorporée à un document visé au premier alinéa de l’article 9 et qui appartient à l’une des catégories visées aux points 2 à 4 du second alinéa de l’article 9. 1. des activités d’une administration, 2. d’une chronique portant sur l’action judiciaire ou l’affaire dans laquelle l’œuvre a figuré, et

Art. 26b. Nonobstant le droit d’auteur, les documents officiels sont rendus accessibles au public de la façon prescrite au chapitre 2 de la loi sur la liberté de la presse.

Le droit d’auteur sur une œuvre photographique ne s’oppose pas à ce que l’œuvre soit utilisée dans l’intérêt de la justice ou de la sécurité publique.

Art. 26c. Le propriétaire d’un édifice ou d’un objet utilitaire a le droit d’y apporter des transformations sans l’autorisation de l’auteur.

Dispositions particulières concernant la radiodiffusion sonore ou visuelle

Art. 26d. Les organismes de radio ou de télévision désignés par le gouvernement compte tenu de circonstances particulières sont autorisés à radiodiffuser des œuvres littéraires et musicales publiées et des œuvres des beaux-arts divulguées, pour autant qu’une licence collective élargie soit applicable en vertu de l’article 26i.

Les dispositions du premier alinéa ne s’appliquent pas aux œuvres dramatiques, ni aux autres œuvres si l’auteur en a interdit la radiodiffusion ou s’il existe des raisons particulières de supposer qu’il est opposé à la radiodiffusion de l’œuvre. Les dispositions du premier alinéa ne s’appliquent pas aux retransmissions visées à l’article 26f.

S’agissant d’une transmission par satellite, la licence collective élargie n’est applicable que si l’organisme émetteur diffuse simultanément l’émission par un émetteur terrestre.

Art. 26e. Tout organisme de radio ou de télévision qui a acquis le droit de radiodiffuser une œuvre peut également enregistrer cette œuvre sur un support matériel à partir duquel l’œuvre pourra être perçue, à condition qu’il le fasse

1. pour l’utiliser dans ses propres émissions, quelques fois seulement et au cours d’une période déterminée,

2. pour disposer d’une preuve quant à la teneur de l’émission ou 3. pour permettre à une autorité publique d’exercer la supervision des activités de radiodiffusion. Les enregistrements effectués en vertu des dispositions des points 2 et 3 du premier alinéa ne peuvent

être utilisés qu’aux fins qui y sont indiquées. Si ces enregistrements ont une valeur documentaire, ils peuvent être conservés au Dépôt des enregistrements sonores et des images en mouvement.

Une autorité publique chargée de surveiller la publicité à la radio et à la télévision peut utiliser des enregistrements d’émissions dans la mesure nécessaire à l’accomplissement de sa tâche.

Art. 26f. Toute personne a le droit de communiquer au public, simultanément et sans aucune modification, au moyen d’un système sans fil ou par câble (retransmission), des œuvres faisant partie d’une émission de radiodiffusion sonore ou visuelle si une licence collective élargie est applicable en vertu de l’article 26i.

Les dispositions du premier alinéa ne s’appliquent pas aux œuvres dont les droits de retransmission appartiennent à l’organisme de radio ou de télévision qui effectue l’émission initiale.

Dispositions particulières relatives aux programmes d’ordinateur

Art. 26g. Toute personne ayant acquis le droit d’utiliser un programme d’ordinateur est autorisée à en faire les copies et les adaptations qui lui sont nécessaires pour utiliser ce programme d’une manière conforme à sa destination, y compris pour corriger des erreurs.

Toute personne jouissant du droit d’utiliser un programme d’ordinateur peut en faire des copies de sauvegarde, si cela lui est nécessaire pour utiliser le programme conformément à sa destination.

Les copies qui ont été réalisées en vertu des dispositions des premier et deuxième alinéas ne peuvent pas être utilisées à d’autres fins et ne doivent plus être utilisées lorsque le droit d’utiliser le programme d’ordinateur est expiré.

Toute personne jouissant du droit d’utiliser un programme d’ordinateur peut observer, étudier ou tester le fonctionnement de ce programme afin de déterminer les idées et les principes qui sont à la base des différents éléments du programme, pour autant qu’elle le fasse lors d’une opération de chargement, d’affichage, de traitement, de transmission ou de stockage du programme d’ordinateur qu’elle est en droit d’effectuer.

Toute disposition contractuelle restreignant les droits de l’utilisateur énoncés aux deuxième et quatrième alinéas est nulle et non avenue.

Art. 26h. La reproduction du code d’un programme d’ordinateur ou la traduction de la forme de ce code est autorisée lorsqu’elle est indispensable pour obtenir l’interfonctionnement du programme d’ordinateur avec un autre programme, sous réserve que les conditions suivantes soient réunies :

1. ces actes sont accomplis par une personne jouissant du droit d’utiliser le programme, ou pour son compte par une personne habilitée à les accomplir;

Les dispositions du premier alinéa ne peuvent justifier que les informations obtenues 1. soient utilisées à des fins autres que la réalisation de l’interfonctionnement recherché, 2. soient communiquées à des tiers, sauf si cela s’avère nécessaire pour obtenir

l’interfonctionnement recherché, 3. soient utilisées pour la mise au point, la production ou la commercialisation d’un programme

Dispositions communes concernant la licence par extension d’accord collectif

(licence collective élargie)

Art. 26i. La licence collective élargie mentionnée aux articles 13, 26d et 26f permet d’utiliser une œuvre d’une manière déterminée, lorsqu’un accord a été conclu pour cette utilisation avec un organisme représentatif d’un nombre important d’auteurs suédois du domaine considéré. Par extension de cet accord collectif, l’utilisation d’œuvres de même nature que celles sur lesquelles porte l’accord est autorisée en dépit du fait que les auteurs de ces œuvres ne sont pas représentés par l’organisme.

Pour qu’une œuvre puisse être utilisée en vertu de l’article 13, l’accord doit avoir été conclu avec une personne qui poursuit des activités d’enseignement sous une forme organisée.

L’auteur dont l’œuvre est utilisée en application de l’article 26d a droit à une rémunération.

Lorsqu’une œuvre est utilisée en vertu des articles 13 ou 26f, les dispositions ci-après sont applicables. Les conditions d’utilisation des œuvres stipulées dans l’accord doivent être respectées. En ce qui concerne la rémunération découlant de l’accord et en ce qui concerne les autres prestations de l’organisme qui sont pour l’essentiel financées par cette rémunération, l’auteur est assimilé aux auteurs affiliés à l’organisme. Sans préjudice des dispositions qui précèdent, l’auteur a toujours le droit d’exiger une rémunération au titre de l’utilisation de son œuvre, à condition d’en faire la demande dans les trois ans suivant l’année au cours de laquelle a eu lieu l’utilisation. Cette demande ne peut être adressé qu’à l’organisme [qui a perçu la rémunération].

Seuls les organismes contractants peuvent percevoir une rémunération de qui utilise une œuvre en vertu de l’article 26f. Toutes les demandes de rémunération doivent être présentées simultanément.

Chapitre 2a Rémunération en cas de revente de copies ou d’exemplaires d’œuvres des beaux-arts

Art. 26j. Lorsqu’une copie ou un exemplaire d’une œuvre des beaux-arts qui a déjà fait l’objet d’une cession est revendue pendant la durée du droit d’auteur par un négociant dans le cadre de son activité commerciale, l’auteur a droit à une rémunération de la part du vendeur. L’auteur a également droit à une rémunération lorsque la vente a lieu par l’intermédiaire d’un négociant agissant dans le cadre de son activité commerciale. Le paiement de la rémunération incombe dans ce cas au négociant. Cette rémunération est de cinq pour cent du prix de vente, hors taxe sur la valeur ajoutée.

L’auteur n’a toutefois pas droit à une rémunération 1. lorsque le prix de revente, hors taxe sur la valeur ajoutée, ne dépasse pas un vingtième du

montant de base prévu par la loi sur les assurances générales (loi n° 381 de 1962), 2. lorsque la copie ou l’exemplaire de l’œuvre des beaux-arts est une copie ou un exemplaire

d’une œuvre d’architecture, ou 3. lorsque la copie de l’œuvre des beaux-arts est une œuvre des arts appliqués qui a été produite

en plusieurs exemplaires identiques. Le droit à rémunération est personnel et incessible. Toutefois, nonobstant les dispositions de

l’article 3 du chapitre 10 du Code du mariage, les règles relatives au partage des biens entre époux et à la succession ab intestat ou testamentaire s’appliquent à ce droit après le décès de l’auteur.

Seul un organisme représentatif d’un nombre important d’auteurs suédois du domaine considéré peut percevoir la rémunération. Il doit la demander au nom de la personne qui y a droit et lui en reverser le montant, déduction faite d’une somme raisonnable en compensation de ses frais administratifs. Si l’organisme n’a pas réclamé la rémunération à la personne qui en est redevable dans les trois ans suivant la fin de l’année civile au cours de laquelle la vente a eu lieu, le droit à rémunération ne peut plus être invoqué.

La personne redevable de la rémunération est tenue de fournir, sur demande de l’organisme, des précisions concernant les ventes soumises à cette rémunération qui ont eu lieu au cours des trois années précédentes.

Chapitre 3 Transfert du droit d’auteur

Dispositions générales concernant la cession

Art. 27. Dans les limites de l’article 3, le droit d’auteur peut être cédé en tout ou en partie. La cession d’une copie ou d’un exemplaire n’emporte pas cession du droit d’auteur. Toutefois, dans le

cas d’un portrait exécuté sur commande, l’auteur ne peut pas exercer son droit sans l’autorisation de la personne qui a passé la commande ou, si cette personne est décédée, de l’époux survivant et des héritiers.

Les dispositions régissant la cession du droit d’auteur dans certains cas particuliers sont énoncées aux articles 30 à 40a. Elles ne s’appliquent toutefois qu’en l’absence de convention contraire.

Art. 28. Sauf convention contraire, la personne à laquelle un droit d’auteur a été cédé ne peut pas modifier l’œuvre ni céder le droit d’auteur à un tiers. Si le droit d’auteur appartient à une entreprise, il peut être cédé avec l’entreprise ou une partie de celle-ci; toutefois, le cédant reste responsable de la bonne exécution du contrat passé.

Art. 29. [Abrogé par la loi n° 192 de 1976]

Contrats de représentation ou d’exécution publique

Art. 30. En cas de cession du droit de représenter ou d’exécuter une œuvre en public, la cession vaut pour une période de trois ans et ne confère pas l’exclusivité. Si la durée du contrat excède trois ans et qu’un droit exclusif a été cédé, l’auteur peut néanmoins représenter ou exécuter l’œuvre lui-même ou céder le droit de représentation ou d’exécution de l’œuvre à des tiers lorsque ce droit n’a pas été exercé pendant trois ans.

Le présent article ne s’applique pas aux œuvres cinématographiques.

Contrats d’édition

Art. 31. Par le contrat d’édition, l’auteur cède à l’éditeur le droit de reproduire une œuvre littéraire ou artistique par impression ou tout autre procédé analogue et le droit de la publier.

Le manuscrit ou tout autre exemplaire de l’œuvre utilisé pour la reproduction de celle-ci reste la propriété de l’auteur.

Art. 32. L’éditeur a le droit de publier une édition n’excédant pas 2000 exemplaires s’il s’agit d’une œuvre littéraire, 1000 exemplaires s’il s’agit d’une œuvre musicale et 200 exemplaires s’il s’agit d’une œuvre artistique.

Par édition, il faut entendre les exemplaires que l’éditeur fabrique en un seul tirage.

Art. 33. L’éditeur est tenu de publier l’œuvre dans un délai raisonnable, de veiller à ce qu’elle soit diffusée de la manière habituelle et d’assurer le suivi de la publication dans la mesure déterminée par les conditions de commercialisation et d’autres circonstances. En cas d’inexécution, l’auteur peut résilier le contrat et conserver la rémunération qu’il a déjà reçue. Si l’auteur a subi un préjudice qui n’est pas entièrement réparé par cette rémunération, il est aussi indemnisé de ce préjudice.

Art. 34. Si l’œuvre n’est pas publiée dans un délai de deux ans ou, s’il s’agit d’une œuvre musicale, dans un délai de quatre ans à compter du jour où l’auteur a remis le manuscrit ou tout autre exemplaire aux fins de la reproduction, l’auteur peut résilier le contrat et conserver la rémunération qu’il a reçue, même si aucune négligence ne peut être imputée à l’éditeur. La même règle s’applique lorsque les exemplaires de

l’œuvre sont épuisés et que l’éditeur, alors qu’il a le droit de publier une nouvelle édition, ne le fait pas dans un délai d’un an après en avoir été prié par l’auteur.

Art. 35. L’éditeur remet à l’auteur une attestation établie par l’imprimeur, ou par toute autre personne qui reproduit l’œuvre, quant au nombre d’exemplaires produits.

Si, au cours d’un exercice donné, il a été réalisé des ventes donnant droit au versement d’une rémunération à l’auteur, l’éditeur lui remet, dans les neuf mois qui suivent la fin de l’exercice en question, un relevé indiquant le nombre d’exemplaires vendus pendant l’exercice ainsi que le stock d’exemplaires restant à la fin de l’exercice. Sinon, à la fin de l’exercice, l’auteur a le droit de recevoir, sur sa demande, un état mentionnant le nombre des exemplaires en stock à la fin de l’exercice.

Art. 36. Si une nouvelle édition est lancée plus d’un an après la parution de l’édition précédente, l’auteur doit avoir eu, préalablement, la possibilité d’apporter à l’œuvre des modifications n’entraînant pas de frais excessifs et ne modifiant pas son caractère.

Art. 37. L’auteur n’a pas le droit de publier de nouveau l’œuvre sous la forme ou de la manière prévue dans le contrat tant que l’édition ou les éditions que l’éditeur peut publier ne sont pas épuisées.

Toutefois, l’auteur peut insérer une œuvre littéraire dans une édition de ses œuvres complètes ou choisies lorsque 15 ans se sont écoulés depuis la première publication.

Art. 38. Les dispositions relatives aux contrats d’édition ne s’appliquent pas aux contributions aux journaux et revues. Les articles 33 et 34 ne s’appliquent pas aux contributions à d’autres œuvres composites.

Contrats d’adaptation cinématographique

Art. 39. La cession du droit de réaliser un film à partir d’une œuvre littéraire ou artistique comprend le droit de rendre l’œuvre accessible au public par la projection du film dans une salle de cinéma, à la télévision ou d’une autre façon et le droit de faire le sous-titrage ou le doublage des textes. Cette disposition ne s’applique pas aux œuvres musicales.

Art. 40. En cas de cession du droit d’utiliser une œuvre littéraire ou musicale pour réaliser un film destiné à être projeté en public, le cessionnaire doit réaliser le film et le rendre accessible au public dans un délai raisonnable. S’il néglige de le faire, l’auteur peut résilier le contrat et conserver la rémunération qu’il a reçue. Si l’auteur a subi un préjudice qui n’est pas entièrement réparé par cette rémunération, il est aussi indemnisé de ce préjudice.

Si le film n’a pas été réalisé dans un délai de cinq ans à compter du jour où l’auteur s’est acquitté de ses obligations, ce dernier peut résilier le contrat et conserver la rémunération qu’il a reçue, même si aucune négligence ne peut être imputée au cessionnaire.

Le programme d’ordinateur qui est une création de service

Art. 40a. Sauf stipulation contraire, le droit d’auteur sur un programme d’ordinateur créé par un employé dans l’exercice de ses fonctions ou sur instruction de son employeur est cédé à l’employeur.

Transfert du droit d’auteur au décès de l’auteur, etc.

Art. 41. Au décès de l’auteur, nonobstant les dispositions du premier alinéa de l’article 3 du chapitre 10 du Code du mariage, les règles relatives au partage des biens entre époux et à la succession ab intestat et testamentaire s’appliquent au droit d’auteur. Un liquidateur chargé d’administrer la succession indivise ne peut, sans l’autorisation des héritiers, exploiter l’œuvre d’une autre manière qu’auparavant.

L’auteur peut, par testament, donner des instructions ayant force obligatoire pour le conjoint survivant et les descendants en ce qui concerne l’exercice du droit d’auteur ou autoriser un tiers à donner des instructions de ce genre.

Le droit d’auteur est insaisissable tant que l’auteur ou toute autre personne qui l’a acquis en vertu du partage des biens entre époux ou par succession ab intestat ou testamentaire en demeure titulaire. La même règle s’applique aux manuscrits ainsi qu’aux œuvres d’art qui n’ont pas été exposées ou mises en vente ou dont la divulgation n’a pas été autorisée par ailleurs.

Chapitre 4 Durée du droit d’auteur1

Art. 43. Le droit d’auteur sur une œuvre produit ses effets jusqu’à la fin de la soixante -dixième année qui suit l’année du décès de l’auteur ou, pour les œuvres visées à l’article 6, du décès du dernier survivant des coauteurs. Toutefois, s’il s’agit d’une œuvre cinématographique, le droit d’auteur produit ses effets jusqu’à la fin de la soixante-dixième année qui suit l’année du décès du dernier survivant des personnes suivantes : le réalisateur principal, le scénariste, le dialoguiste et le compositeur de la musique spécialement créée pour l’œuvre.

Art. 44. Lorsqu’une œuvre est divulguée sans que soit indiqué le nom de l’auteur ou sa signature notoire, le droit d’auteur produit ses effets jusqu’à la fin de la soixante -dixième année qui suit l’année au cours de laquelle elle a été divulguée. Si l’œuvre se compose de plusieurs parties qui présentent une continuité, la durée est calculée séparément pour chaque partie.

Si l’auteur révèle son identité avant la fin de la durée indiquée au premier alinéa, ce sont les dispositions de l’article 43 qui s’appliquent.

Cependant les dispositions du troisième alinéa de l’article 44, une fois entrées en vigueur, s’appliquent dans tous les cas.

En ce qui concerne les œuvres qui n’ont pas été divulguées et dont l’auteur est inconnu, le droit d’auteur produit ses effets jusqu’à la fin de la soixante -dixième année qui suit l’année de création de l’œuvre.

Artistes interprètes ou exécutants

Art. 45. Lorsqu’un artiste interprète ou exécute une œuvre littéraire ou artistique, nul ne peut, sans son autorisation,

1. fixer sa prestation sur un disque, un film ou tout autre support matériel permettant de la reproduire ni

2. radiodiffuser sa prestation par voie sonore ou visuelle ou la rendre accessible au public dans le cadre d’une communication directe.

Une prestation qui a été fixée sur un support matériel visé au point 1 du premier alinéa ne peut pas être transférée sans l’autorisation de l’artiste sur un autre support de ce genre ni être rendue accessible au public avant l’expiration d’un délai de 50 ans à compter de l’année au cours de laquelle a eu lieu la prestation ou, si la fixation a été publiée ou divulguée dans les 50 ans suivant la prestation, à compter de l’année de la première publication ou divulgation de la fixation.

Les dispositions de l’article 3, des articles 6 à 9, des articles 11 à 13, des articles 15, 16, 21 et 22, des articles 25 à 26b, des articles 26e, 26f, 27 et 28, de la première phrase de l’article 39 et des articles 41 et 42 sont applicables aux prestations visées dans le présent article.

Lorsqu’un exemplaire d’une fixation visée dans le présent article a été cédé, avec l’autorisation de l’artiste interprète ou exécutant, à l’intérieur de l’Espace économique européen, il peut faire l’objet d’une nouvelle diffusion.

Les dispositions du quatrième alinéa ne permettent pas de mettre à la disposition du public 1. des exemplaires de fixations, par voie de location ou autre acte juridique similaire, ni 2. des copies d’un film ou des exemplaires de tout autre support matériel sur lequel ont été fixées

des images en mouvement, par voie de prêt.

Art. 46. Nul ne peut, sans l’autorisation du producteur, reproduire ou rendre accessible au public un disque, un film ou tout autre support matériel sur lequel ont été fixés des sons ou des images en mouvement avant l’expiration d’un délai de 50 ans à compter de l’année au cours de laquelle la fixation a été réalisée ou, si la fixation a été publiée ou divulguée dans les 50 ans suivant sa réalisation, à compter de l’année de la première publication ou divulgation de la fixation. Est également considéré comme une reproduction tout transfert effectué de l’un de ces supports matériels sur un autre.

Utilisation d’une fixation sonore dans une représentation ou exécution publique

Art. 47. Nonobstant les dispositions du deuxième alinéa de l’article 45 et du premier alinéa de l’article 46, une fixation sonore peut être utilisée dans une émission de radiodiffusion sonore ou visuelle ou dans toute autre représentation ou exécution publique. Dans ce cas, le producteur et les artistes interprètes ou exécutants dont les prestations font l’objet de la fixation ont droit à une rémunération. Si plusieurs artistes ont participé à une représentation ou exécution, ils ne peuvent exercer leur droit qu’en commun. Les artistes interprètes ou exécutants et les producteurs doivent faire valoir simultanément leur droit envers la personne qui a utilisé la fixation.

Les dispositions du premier alinéa du présent article sur les émissions de radiodiffusion sonores ou visuelles s’appliquent aussi lorsqu’une émission de ce type est communiquée au public, simultanément et sans modification, au moyen d’un système sans fil ou par câble (retransmission). Le droit à rémunération ne peut être exercé envers la personne qui effectue la retransmission que par l’intermédiaire des organismes représentatifs d’un nombre important d’artistes interprètes ou exécutants ou de producteurs suédois. Les organismes doivent présenter leurs demandes de rémunération en même temps que celles qui sont visées au cinquième alinéa de l’article 26i.

Les dispositions des articles 8 et 9, du deuxième alinéa de l’article 11, des articles 21 et 22 et des articles 25 à 26a sont applicables dans les cas visés par le présent article. Les dispositions des articles 27, 28, 41 et 42 s’appliquent en outre à l’égard des droits des artistes interprètes ou exécutants.

Les films sonores ne sont pas visés par le présent article.

[Loi n° 447 de 1995]

Organismes de radio ou de télévision

Art. 48. Une émission de radiodiffusion sonore ou visuelle ne peut pas, sans l’autorisation de l’organisme de radio ou de télévision,

1. être fixée sur un support matériel permettant de la reproduire ni 2. être réémise ou rendue accessible au public en des lieux où le public est admis moyennant le

versement d’un droit d’entrée. Une émission qui a été fixée sur un support matériel visé au point 1 du premier alinéa ne peut pas être

transférée sans l’autorisation de l’organisme de radiodiffusion sur un autre support de ce genre avant l’expiration d’un délai de 50 ans à compter de l’année au cours de laquelle l’émission a eu lieu. En outre, pendant toute cette période, les supports matériels ne peuvent pas être rendus accessibles au public sans l’autorisation de l’organisme.

Les dispositions des articles 6 à 9, du deuxième alinéa de l’article 11, des articles 12, 15, 16, 21 et 22, des articles 25 à 26b et de l’article 26e sont applicables aux émissions de radiodiffusion sonores ou visuelles visées dans le présent article.

Art. 49. Un catalogue, un tableau ou une autre compilation similaire qui réunit un grand nombre d’éléments d’information ne peut pas être reproduit sans l’autorisation du producteur de l’ouvrage avant l’expiration d’un délai de 10 ans à compter de l’année au cours de laquelle l’ouvrage a été publié.

Les dispositions des articles 6 à 9, du deuxième alinéa de l’article 11, du premier alinéa de l’article 12, de l’article 13, des articles 16 à 18, des articles 26 à 26b et de l’article 26e sont applicables aux ouvrages visés dans le présent article. Si un tel ouvrage est protégé, en tout ou en partie, par le droit d’auteur, ce droit peut aussi être exercé.

Photographes

Art. 49a. Quiconque a réalisé une image photographique jouit du droit exclusif de reproduire cette image et de la rendre accessible au public. Peu importe à cet égard que l’image soit utilisée dans sa forme d’origine ou sous une forme modifiée, et peu importe la technique utilisée.

Est également considérée comme une image photographique une image produite par un procédé analogue à la photographie.

Le droit énoncé au premier alinéa reste valable jusqu’à l’expiration de la cinquantième année à compter de l’année au cours de laquelle la photographie a été réalisée.

Les dispositions des deuxième et troisième alinéas de l’article 2, de l’article 3, des articles 7 à 9, de l’article 11, du premier alinéa de l’article 12, des articles 13, 15 et 16, des articles 18 à 20, de l’article 23, du premier alinéa de l’article 24, des articles 25 à 26b, des articles 26d à 26f, des articles 26i à 28, des articles 31 à 38, des articles 41 et 42 et des articles 50 à 52 sont applicables aux images visées dans le présent article. Si une photographie est protégée par le droit d’auteur, ce droit peut aussi être exercé.

Chapitre 6 Dispositions spéciales

Art. 50. Une œuvre littéraire ou artistique ne peut pas être rendue accessible au public sous un titre, un pseudonyme ou une signature susceptible de provoquer facilement une confusion avec une œuvre déjà rendue accessible au public ou avec l’auteur de celle-ci.

Art. 51. Si une œuvre littéraire ou artistique est représentée ou exécutée ou reproduite d’une façon qui porte préjudice à des intérêts culturels, les tribunaux peuvent, à la suite d’une plainte émanant de l’autorité désignée par le gouvernement, rendre une ordonnance interdisant l’utilisation en question sous peine d’amende. La présente disposition ne s’applique pas du vivant de l’auteur.

Art. 52. En prononçant une peine d’amende, les tribunaux peuvent ordonner des mesures raisonnables visant à empêcher l’utilisation abusive des copies ou exemplaires frappés par l’interdiction visée à l’article 51 et des dispositifs qui ne peuvent servir qu’à fabriquer de tels copies ou exemplaires. Une mesure de ce genre peut prévoir la destruction de l’objet en cause ou sa modification d’une manière déterminée.

Les dispositions du présent article ne s’appliquent pas à une personne qui a acquis de bonne foi l’objet en question ou tout droit sur celui-ci.

L’objet visé au premier alinéa peut être placé sous la garde de l’autorité judiciaire dans l’attente des mesures visées au premier alinéa; ce sont les règles générales régissant cette procédure dans les actions pénales qui s’appliquent.

Art. 52a. Quiconque désire retransmettre par fil des œuvres incorporées à une émission de radiodiffusion sonore ou visuelle et cherche à conclure à cet effet un accord avec un organisme représentatif des titulaires de droits suédois ou avec un organisme de radio ou de télévision effectuant des émissions à l’intérieur de l’Espace économique européen, mais n’obtient pas satisfaction aux conditions souhaitées, peut demander l’ouverture de négociations, qui ne peuvent lui être refusées, avec l’organisme représentatif ou l’organisme de radio ou de télévision, selon le cas.

Toute partie ayant l’obligation de participer à des négociations de cette nature est tenue d’assister en personne ou de se faire représenter aux réunions de négociation et, le cas échéant, de proposer une solution raisonnée pour trancher la question faisant l’objet de la négociation. Les parties peuvent toutefois convenir de mener ce type de négociation sous une forme autre que la réunion.

Quiconque enfreint les dispositions du deuxième alinéa est tenu au versement de dommages-intérêts en réparation du préjudice causé. Pour apprécier l’existence et l’étendue d’un préjudice, il est tenu compte de l’intérêt qu’aurait eu la personne concernée à l’application de ces dispositions, mais aussi de considérations autres que purement économiques.

Chapitre 7 Sanctions pénales et civiles

Art. 53. Est passible d’une amende ou d’une peine d’emprisonnement de deux ans au plus quiconque a, intentionnellement ou par négligence grave, commis à l’égard d’une œuvre littéraire ou artistique un acte qui porte atteinte à l’un des droits de l’auteur visés au chapitre 1 ou 2, qui viole des instructions données en vertu du second alinéa de l’article 41 ou qui est contraire à la disposition de l’article 50.

Quiconque reproduit, pour son usage personnel, un programme d’ordinateur qui a été publié ou dont un exemplaire a été cédé avec l’autorisation de l’auteur n’encourt aucune sanction pénale si l’exemplaire d’origine ne sert pas à des activités commerciales ou publiques et à condition de n’utiliser les copies réalisées du programme d’ordinateur qu’à des fins strictement personnelles.

Les dispositions du premier alinéa s’appliquent également lorsqu’une personne importe en Suède, aux fins de diffusion publique, des copies ou exemplaires d’une œuvre, lorsque ceux-ci ont été fabriqués à l’étranger dans des conditions telles qu’une fabrication analogue réalisée en Suède aurait été punissable en vertu de cet alinéa.

Quiconque a enfreint une ordonnance prononcée sous astreinte en application de l’article 53a ne peut pas être condamné à une sanction pénale pour l’infraction faisant l’objet de l’ordonnance.

Toute tentative visant à commettre l’un des actes mentionnés aux premier et troisième alinéas ainsi que tout préparatif à cet effet sont punissables en vertu des dispositions du chapitre 23 du Code pénal.

Art. 53a. À la requête de l’auteur ou de son ayant cause, ou d’une personne habilitée en vertu d’une licence à exploiter l’œuvre, le tribunal peut rendre une ordonnance interdisant, sous astreinte, à l’auteur d’un acte constitutif d’une atteinte ou d’une violation visée à l’article 53 de continuer à commettre cet acte.

Si le demandeur apporte des éléments suffisants pour démontrer l’existence d’un acte constitutif d’une atteinte ou d’une violation visée à l’article 53 et s’il peut être raisonnablement considéré que le défendeur, en continuant à commettre cet acte, fait subir une perte au titulaire de la protection, le tribunal peut rendre une ordonnance avant dire droit en attendant que l’affaire soit définitivement jugée ou résolue d’une autre manière. Sauf s’il y a risque de préjudice, aucune ordonnance ne peut être rendue avant que le défendeur ait eu la possibilité de se faire entendre.

L’ordonnance visée au deuxième alinéa ne peut être rendue que si le demandeur constitue auprès du tribunal des garanties pour couvrir le préjudice qui pourrait être causé au défendeur. Si le demandeur n’est pas en mesure de constituer ces garanties, le tribunal peut l’en exempter. En ce qui concerne la nature des garanties, les dispositions de l’article 25 du chapitre 2 du Code d’exécution des décisions de justice sont applicables. Les garanties sont soumises à l’examen du tribunal, à moins que le défendeur ne les ait acceptées.

Lorsque l’affaire passe en jugement, le tribunal décide si l’interdiction qui a pu être prononcée en vertu du deuxième alinéa reste valable.

Les dispositions relatives aux voies de recours énoncées au chapitre 15 du Code de procédure judiciaire s’appliquent en ce qui concerne les recours qui peuvent être formés contre des décisions prises en vertu des deuxième et troisième alinéas et en ce qui concerne les actions qui peuvent être intentées devant des instances supérieures.

La personne à la requête de qui l’ordonnance a été prise peut demander l’imposition d’une amende. À cette fin, elle peut déposer une requête tendant à ce que le tribunal rende une nouvelle ordonnance, assortie d’une astreinte.

Les dispositions de la loi sur la radiodiffusion (n° 755 de 1966) s’appliquent à l’égard du contenu des émissions tant radiodiffusées que transmises par fil.

Art. 54. Quiconque exploite une œuvre en violation de la présente loi ou d’instructions données en vertu du second alinéa de l’article 41 doit verser à l’auteur ou au titulaire du droit d’auteur une indemnité raisonnable au titre de l’exploitation.

Si l’acte d’exploitation a été commis intentionnellement ou par négligence grave, des dommages-intérêts sont aussi exigibles au titre des pertes subies en sus du manque à gagner, ainsi qu’à titre de réparation du préjudice moral et autre qui en résulte.

Quiconque commet par ailleurs, intentionnellement ou par négligence, un acte constitutif d’une atteinte ou d’une violation visée à l’article 53 verse à l’auteur ou à son ayant cause des dommages-intérêts au titre de la perte ou du préjudice moral ou autre résultant de l’acte en question.

Art. 55. Quiconque commet un acte constitutif d’une atteinte ou d’une violation visée à l’article 53 est tenu, si cela est considéré comme justifié, de remettre à l’auteur ou à son ayant cause, à titre de compensation, les objets liés à l’atteinte ou à la violation. Cette disposition vaut aussi pour les compositions typographiques, clichés, matrices, moules et instruments analogues ne pouvant être utilisés que pour la fabrication d’objets du type visé ci-dessus.

À la requête de l’auteur ou de son ayant cause, le tribunal peut, au lieu d’ordonner la remise des objets comme le prévoit le premier alinéa, ordonner, dans la mesure où cela est considéré comme justifié, que les objets en question soient détruits ou transformés d’une manière déterminée ou que d’autres mesures soient prises pour en prévenir tout usage non autorisé. Une requête en ce sens peut aussi être présentée par le ministère public, si cela est considéré comme souhaitable du point de vue de l’intérêt public. Aucune des décisions visées au présent alinéa ne peut être prise lorsque c’est le Code pénal qui doit être appliqué pour décider de la remise de l’objet ou de mesures destinées à prévenir tout usage non autorisé de celui-ci.

Les dispositions des premier et deuxième alinéas du présent article ne s’appliquent ni au cas où un tiers a acquis de bonne foi l’objet ou un droit sur celui-ci ni au cas où l’atteinte a consisté en la construction d’une œuvre d’architecture.

Si un objet autre que ceux qui sont visés au premier alinéa a été utilisé pour la fabrication de copies ou d’exemplaires d’une œuvre en violation des dispositions pénales de la présente loi, la remise de l’objet en

question ou de sa contre-valeur peut être ordonnée si cela est jugé nécessaire pour empêcher qu’il y ait infraction ou pour toute autre raison particulière. Cette disposition vaut aussi pour un objet qui a été utilisé dans le cadre d’une tentative faite en vue de commettre une infraction visée ci-dessus ou dans la préparation d’une telle infraction.

Art. 56. Nonobstant les dispositions de l’article 55, le tribunal peut, s’il estime que la valeur artistique ou économique des exemplaires d’une œuvre ou toute autre circonstance le justifie, permettre, sur requête présentée à cet effet, que les exemplaires soient rendus accessibles au public ou soient utilisés autrement aux fins qui sont les leurs, moyennant le versement d’une rémunération à l’auteur ou à son ayant cause.

Art. 57. Les dispositions des articles 53 à 56 sont applicables aux droits protégés en vertu du chapitre 5.

Sauf dans les cas visés à l’article 53, est passible d’une amende ou d’une peine d’emprisonnement de six mois au plus quiconque vend, loue ou offre à la vente, ou quiconque détient pour le vendre, le louer ou à d’autres fins commerciales, un dispositif ayant pour seul but de faciliter la suppression non autorisée ou la neutralisation d’un dispositif technique mis en place pour protéger un programme d’ordinateur contre toute reproduction non autorisée.

Art. 58. Le tribunal de première instance de Stockholm est compétent pour connaître de toute action portant sur une émission de radiodiffusion sonore ou visuelle faite en violation de la présente loi. Il en va de même en ce qui concerne les actions tendant à faire valoir un droit à rémunération au titre de l’article 18, du premier alinéa de l’article 26a, du troisième alinéa de l’article 26i ou de l’article 47 et, par le jeu d’un renvoi, au titre des articles 45, 46, 48, 49 ou 49a, ainsi que les actions concernant toute rémunération due au titre d’une retransmission en vertu de l’article 26f.

Art. 59. Une action pénale pour infraction à la présente loi ne peut être intentée par le ministère public que sur plainte de la partie lésée ou si l’intérêt public l’exige.

Une action en violation des dispositions de l’article 3 ou d’instructions données en vertu du second alinéa de l’article 41 peut être intentée par le conjoint survivant, les héritiers descendants ou ascendants en ligne directe ou les frères ou sœurs de l’auteur.

S’il existe des raisons de croire qu’il y a eu infraction à la présente loi, les objets visés à l’article 55 peuvent être placés sous la garde de l’autorité judiciaire; ce sont les règles générales régissant cette procédure de garde dans les actions pénales qui s’appliquent.

Chapitre 8 Champ d’application de la loi

Art. 60. Les dispositions de la présente loi qui régissent le droit d’auteur proprement dit sont applicables

1. aux œuvres des ressortissants suédois ou des personnes qui résident habituellement en Suède, 2. aux œuvres publiées pour la première fois en Suède ou publiées simultanément en Suède et à

l’étranger,

3. aux œuvres cinématographiques dont le producteur a son siège ou sa résidence habituelle en Suède,

sol de façon permanente dans ce pays. Aux fins de l’application du point 2 du premier alinéa, il y a publication simultanée si l’œuvre est

publiée en Suède dans les 30 jours qui suivent sa publication dans un autre pays. Aux fins de l’application du point 3 du premier alinéa, la personne dont le nom est indiqué sur une œuvre cinématographique est présumée, sauf preuve contraire, en être le producteur.

Les dispositions de l’article 26j s’appliquent aux œuvres des ressortissants suédois ou des personnes qui résident habituellement en Suède.

Les dispositions de l’article 44a sont applicables aux actes de publication ou de divulgation des ressortissants suédois ou des personnes qui résident habituellement en Suède. Ces dispositions sont également applicables aux actes de publication ou de divulgation des personnes morales ayant leur siège en Suède.

Les dispositions des articles 50 et 51 s’appliquent à toutes les œuvres littéraires ou artistiques, indépendamment de leur origine.

Art. 61. Les dispositions des articles 45, 47 et 48 sont applicables aux représentations ou exécutions, aux fixations sonores et aux émissions de radiodiffusion sonores ou visuelles qui ont lieu en Suède. En outre, les dispositions de l’article 45 sont applicables aux prestations de ressortissants suédois ou de personnes qui résident habituellement en Suède, celles de l’article 47 aux fixations sonores dont le producteur est un ressortissant suédois, une personne morale suédoise ou une personne résidant habituellement en Suède, et les dispositions de l’article 48 aux émissions des organismes de radio ou de télévision ayant leur siège dans ce pays. Les dispositions de l’article 46 sont applicables aux fixations sonores et aux fixations d’images en mouvement dont le producteur est un ressortissant suédois, une personne morale suédoise ou une personne résidant habituellement en Suède ainsi qu’aux fixations d’images en mouvement réalisés en Suède. Les dispositions de l’article 46 concernant la reproduction sont cependant applicables à toutes les fixations sonores.

Les dispositions de l’article 49 sont applicables aux productions de ressortissants suédois, de personnes morales suédoises ou de personnes résidant habituellement en Suède, ainsi qu’aux productions publiées pour la première fois dans ce pays.

À l’article 49a, la référence aux articles 50 et 51 s’applique à toutes les images photographiques et les autres dispositions s’appliquent aux images photographiques

1. dont le producteur est un ressortissant suédois ou une personne résidant habituellement en Suède,

2. qui ont été publiées pour la première fois en Suède ou simultanément en Suède et à l’étranger, 3. qui font corps avec un édifice ou à toute autre construction fixée au sol de façon permanente, si

cet édifice ou cette construction se situe en Suède. Aux fins de l’application du point 2 du troisième alinéa, il y a publication simultanée si l’œuvre est

publiée en Suède dans les 30 jours qui suivent sa publication dans un autre pays.

Art. 61a. Lorsqu’une œuvre ou un autre objet protégé en vertu de la présente loi est communiqué au public par satellite, l’acte pertinent du point de vue du droit d’auteur et des droits voisins est réputé se produire dans le pays où l’organisme de radiodiffusion, sous son contrôle et sa responsabilité, introduit l’objet dans une chaîne ininterrompue de communication conduisant au satellite et revenant vers la terre.

La disposition qui précède ne s’applique pas si l’introduction a lieu dans un pays qui n’appartient pas à l’Espace économique européen et qui n’assure pas le niveau de protection prévu au chapitre 2 de la directive 93/83/CEE du Conseil des Communautés européennes, du 27 septembre 1993.

Si, dans les cas visés au deuxième alinéa, la transmission vers le satellite a lieu dans un pays faisant partie de l’Espace économique européen, l’acte pertinent du point de vue du droit d’auteur et des droits voisins est réputé s’être produit dans le pays à partir duquel la transmission a eu lieu. Si la transmission vers le satellite n’a pas lieu dans un pays faisant partie de l’Espace économique européen mais que l’organisme de radio ou de télévision qui a décidé la transmission a son siège dans un pays qui en fait partie, l’acte pertinent du point de vue du droit d’auteur et des droits voisins est réputé s’être produit dans ce pays.

Sous réserve de réciprocité, ou en application d’un accord conclu avec un État étranger ou avec une organisation intergouvernementale qui a été entériné par le Parlement, le gouvernement peut décider que les dispositions de la présente loi s’appliquent à d’autres pays. 1 Kap. Upphovsrättens föremål och innehåll

1 § Den som har skapat ett litterärt eller konstnärligt verk har upphovsrätt till verket oavsett om det är

1. skönlitterär eller beskrivande framställning i skrift eller tal,

2. datorprogram,

3. musikaliskt eller sceniskt verk,

4. filmverk,

5. fotografiskt verk eller något annat alster av bildkonst,

6. alster av byggnadskonst eller brukskonst, eller

7. verk som har kommit till uttryck på något annat sätt.

Till litterära verk hänförs kartor, samt även andra i teckning eller grafik eller i plastisk form utförda verk av beskrivande art.

.Vad som i denna lag sägs om datorprogram skall i tillämpliga delar gälla även förberedande designmaterial för datorprogram. Lag (1994:190).

2 § Upphovsrätt innefattar, med de inskränkningar som nedan stadgas, uteslutande rätt att förfoga över verket genom att framställa exemplar därav och genom att göra det tillgängligt för allmänheten, i ursprungligt eller ändrat skick, i översättning eller bearbetning, i ånnan litteratur-eller konstart eller i annan teknik.

Såsom framställning av exemplar anses även att verket överföres på anordning, genom vilken det kan återgivas.

Verket göres tillgängligt för allmänheten då det framföres offentligt, så ock då exemplar därav utbjudes till försäljning, uthyrning eller utlåning eller eljest sprides till allmänheten eller visas offentligt. Lika med offentligt framförande anses framförande som i förvärvsverksamhet anordnas inför en större sluten krets.

3 § Då exemplar av ett verk framställes eller verket göres tillgängligt för allmänheten, skall upphovsmannen angivas i den omfattning och på det sätt god sed kräver. .

Ett verk må icke ändras så, att upphovsmannens litterära eller konstnärliga anseende eller egenart kränkes; ej heller må verket göras

tillgängligt för allmänheten i sådan form eller i sådant sammanhang som är på angivet sätt kränkande för upphovsmannen.

Sin rätt enligt denna paragraf kan upphovsmannen med bindande verkan eftergiva endast såvitt angår en till art och omfattning begränsad användning av verket.

4 § Den som översatt eller bearbetat ett verk eller överfört det till annan litteratur- eller konstart har upphovsrätt till verket i denna gestalt, men han äger icke förfoga däröver i strid mot upphovsrätten till originalverket.

Har någon i fri anslutning till ett verk åstadkonunlt ett nytt och självständigt verk, är hans upphovsrätt ej beroende av rätten till originalverket.

5 § Den som genom att sammanställa verk eller delar av verk åstadkommit ett litterärt eller konstnärligt samlingsverk har upphovsrätt till detta, men hans rätt inskränker icke rätten till de särskilda verken.

6 § Har ett verk två eller flera upphovsmän, vilkas bidrag icke utgöra självständiga verk, tillkommer upphovsrätten dem gemensamt: De äga dock var för sig beivra intrång i rätten.

7 § Såsom upphovsman anses, där ej annat visas, den vars namn eller ock allmänt kända pseudonym eller signatur på sedvanligt sätt utsättes på exemplar av verket eller angives då detta göres tillgängligt för allmänheten.

Är ett verk utgivet utan att upphovsmannen är angiven såsom i första stycket sägs, äger utgivaren, om sådan är nämnd, och eljest förläggaren företräda upphovsmannen, till dess denne blivit angiven på ny upplaga eller genom anmälan i justitiedepartementet.

8 § Ett verk anses offentliggjort, då det lovligen gjorts tillgängligt för allmänheten.

Verket anses utgivet, då exemplar därav med upphovsmannens samtycke förts i handeln eller eljest blivit spridda till allmänheten. Lag (1973:363).

9 § Upphovsrätt gäller inte till

1. författningar,

2. beslut av myndigheter,

3. yttranden av svenska myndigheter och

4. officiella översättningar av sådant som avses i 1--3.

Upphovsrätt gäller dock till verk vilka ingår i en handling som avses i första stycket och är av följande slag: '

1. kartor,

2. alster av bildkonst,

3. musikaliska verk eller

4. diktverk. Lag (1993:1007).

10 § Upphovsrätt till ett verk gäller även om verket har registrerats som mönster.

Upphovsrätt gäller inte till kretsmönster får halvledarprodukter. Om rätten till sådana kretsmönster finns särskilda bestämmelser. Lag (1994:190).

2 Kap. Inskränkningar i upphovsrätten

Allmänna bestämmelser om inskränkningar

11 § Bestämmelserna i detta kapitel medfår inga inskränkningar i upphovsmannens rätt enligt 3 § utöver dem som följer av 26 c §.

När ett verk återges offentligt med stöd av detta kapitel skall källan anges i den omfattning och på det sätt som god sed kräver samt får verket inte ändras i större utsträckning än användningen kräver. Lag (1993:1007).

11 a § har upphävts genom lag (1993: 1007).

11 b § har upphävts genom lag (1993: 1007).

Framställning av exemplar för enskilt bruk

12 § Var och en får framställa enstaka exemplar av offentliggjorda verk får enskilt bruk. Exemplaren får inte användas för andra ändamål.

Första stycket gäller inte datorprogram och ger inte rätt att uppfåra byggnadsverk.

Första stycket ger inte heller rätt att för eget bruk låta en utomstående

1. framställa exemplar av musikaliska verk eller filmverk,

2. framställa bruksfåremål eller skulpturer eller

3. genom konstnärligt fårfarande efterbilda andra konstverk. Lag (1993:1007).

Framställning av exemplar inom undervisningsverksamhet

13 § För undervisningsändamål får exemplar av utgivna verk framställas genom reprografiskt förfarande och upptagningar av verk som sänds ut i ljudradio eller television göras, om avtalslicens gäller enligt 26 i §. Exemplaren och upptagningarna får användas endast i undervisningsverksamhet som omfattas av det avtal som fårutsätts för uppkomsten av avtalslicensen.

Första stycket gäller inte om upphovsmannen hos någon av de avtalsslutande parterna har meddelat förbud mot exemplarframställningen. Lag (1993: 1007).

14 § För undervisningsändamål får lärare och elever göra upptagningar av sina egna framföranden av verk. Upptagningarna får inte användas för andra ändamål. Lag (1993: 1007).

Framställning av exemplar inom sjukhus m.m.

15 § Sjukhus och inrättningar med särskild service eller vård för äldre eller funktionshindrade får göra upptagningar av ljudradio­ och televisionsutsändningar. Upptagningarna får användas endast inom institutionen och inom kort tid efter upptagningen. Lag (1993:1007).

15 a § har upphävts genom lag (1993:1007).

Framställning av exemplar inom vissa arkiv och bibliotek

16 § De arkiv och bibliotek som avses i tredje och fjärde styckena har rätt att framställa exemplar av verk, dock inte datorprogram,

1. för bevarande-, kompletterings- eller forskningsändamål,

2. för utlämning till lånesökande av enskilda artiklar eller korta avsnitt eller av material som av säkerhetsskäl inte bör utlämnas i original eller

3. för användning i läsapparater.

I de fall som avses i första stycket 2 och 3 får exemplar framställas endast genom reprografiskt förfarande.

Rätt till exemplarframställning enligt denna paragrafhar

1. de statliga och kommunala arkivmyndighetema,

2. Arkivet för ljud och bild,

3. de vetenskapliga bibliotek och fackbibliotek som drivs av det allmänna samt

4. folkbiblioteken.

Regeringen får i enskilda fall besluta att vissa andra arkiv och bibliotek än de som anges i tredje stycket skall ha rätt till exemplarframställning enligt denna paragraf. Lag (1994:190).

17 § Var och en får framställa exemplar i blindskrift av utgivna litterära och musikaliska verk.

De bibliotek och organisationer som regeringen beslutar i enskilda fall skall ha rätt att genom ljudupptagning med hjälp av inläsning eller överföring från en annan ljudupptagning framställa exemplar av utgivna litterära verk för utlåning till synskadade och andra funktionshindrade som inte kan ta del av verken i skriftlig form. Exemplarframställningen får dock inte avse verk, av vilka ljudupptagning kommit ut i handeln. Lag (1993:1007).

Framställning av samlingsverk för användning vid undervisning

18 § Den som framställer ett samlingsverk, sammanställt ur verk från ett större antal upphovsmän, för användning vid undervisning, får återge mindre delar av litterära och musikaliska verk och sådana verk av litet omfång, om det har gått fem år efter det år då verken gavs ut. Konstverk får återges i anslutning till texten, om det har gått fem år efter det år då verket offentliggjordes. Upphovsmännen har rätt till ersättning.

Första stycket gäller inte sådana verk som har skapats för att användas vid undervisning. Lag (1993:1007).

Spridning av exemplar

19 § När ett exemplar av ett litterärt eller musikaliskt verk eller ett konstverk med upphovsmannens samtycke har överlåtits, får exemplaret spridas vidare. För exemplar av datorprogram gäller i stället att spridningen är tillåten sedan exemplaret med upphovsmannens samtycke har överlåtits inom Europeiska ekonomiska samarbetsområdet.

Första stycket ger inte rätt att tillhandahålla allmänheten

1. exemplar av verk, utom byggnader och brukskonst, genom uthyrning eller andra jämförliga rättshandlingar, eller

2. exemplar av datorprogram i maskinläsbar form genom utlåning. Lag (1995:447).

Visning av exemplar

20 § När ett verk har utgivits får de exemplar som omfattas av utgivningen visas offentligt. Motsvarande gäller när upphovsmannen har överlåtit exemplar av ett konstverk.

Första stycket ger inte rätt att visa exemplar av konstverk genom film eller i television. Exemplar av konstverk som avses i första stycket får dock återges genom film eller i television, om återgivningen är av mindre betydelse med hänsyn till filmens eller televisionsprogrammets innehåll. Lag (1993:1007).

Offentliga framföranden

21 § Var och en får framföra utgivna verk offentligt

1. vid tillfällen där framförandet av sådana verk inte är det huvudsakliga, tillträdet är avgiftsfritt och anordnandet sker utan förvärvssyfte samt

2. vid undervisning eller gudstjänst.

Första stycket gäller inte sceniska verk och filmverk och ger inte rätt att sända ut verk i ljudradio eller television. Lag (1993: 1007).

Återgivning av konstverk och byggnader

23 § Offentliggjorda konstverk får återges

1. i en kritisk eller vetenskaplig framställning i anslutning till texten och

2. i en tidning eller tidskrift i samband med en redogörelse för en dagshändelse, dock inte om verket har skapats för att återges i en sådan publikation.

Första stycket gäller endast om återgivningen sker i överensstämmelse med god sed och i den omfattning som motiveras av ändamålet. Lag (1993:1007).

24 § Konstverk får avbildas

1. om de stadigvarande är placerade på eller vid allmän plats utomhus eller

2. om de ställs ut, är till salu eller ingår i en samling, men i dessa fall endast i meddelanden om utställningen eller försäljningen och i kataloger.

Byggnader får fritt avbildas. Lag (1993:1007).

24 a § har upphävts genom lag (1993:1007).

Information om dagshändelser genom ljudradio och television m.m.

25 § Verk som syns eller hörs under en dagshändelse får återges vid information om dagshändelsen genom ljudradio, television, direkt överföring eller film. Verken får dock återges endast i den omfattning som motiveras av informationssyftet. Lag (1993:1007).

Offentliga debatter, allmänna handlingar m.m.

26 § Var och en får återge vad som muntligen eller skriftligen anförs

1. inföt myndigheter,

2. i statliga eller kommunala representationer,

3. vid offentliga debatter om allmänna angelägel'lheter eller

4. vid offentliga utfrågningar om sådana angelägenheter.

Vid tillämpning av första stycket gäller dock

1. att skrifter vilka åberopas som bevis, utlåtanden och liknande får återges endast i samband med en redogörelse för det mål eller ärende i vilket de förekommit och endast i den omfattning som motiveras av ändamålet med redogörelsen,

2. att en upphovsman har ensamrätt att ge ut samlingar av sina anföranden och

3. att det som anförs vid sådana utfrågningar som avses i första stycket 4 inte får återges i ljudradio eller television med stöd av den bestämmelsen. Lag (1993:1007).

26 a § Var och en får återge verk, vilka ingår i de handlingar som avses i 9 § första stycket och är av de slag som anges i 9 § andra stycket 2--4. Upphovsmannen har rätt till ersättning, utom när återgivningen sker i samband med

1. en myndighets verksamhet eller

2. en redogörelse för ett mål eller ärende i vilket verket förekommit· och verket återges endast i den omfattning som motiveras av ändamålet med redogörelsen.

Var och en får återge handlingar som är upprättade hos svenska myndigheter men inte är sådana som avses i 9 § första stycket.

Andra stycket gäller inte beträffande

1. kartor,

2. tekniska förebilder,

3. datorprogram,

. 4. verk som skapats för undervisning,

5. verk som är resultatet av vetenskaplig forskning,

6. alster av bildkonst,

7. musikaliska verk,

8. diktverk eller

9. verk av vilka exemplar genom en myndighets försorg tillhandahålls allmänheten i samband med affärsverksamhet. Lag (1993:1007).

26 b § Allmänna handlingar skall oavsett upphovsrätten tillhandahållas enligt 2 kap. tryckfrihetsförordningen.

Upphovsrätten till ett fotografiskt verk hindrar inte att verket används i rättsvårdens eller den allmänna säkerhetens intresse. Lag (1994:190).

Ändringar av byggnader och bruksföremål

26 c § Ägaren till en byggnad eller ett bruksföremål får ändra egendomen utan upphovsmannens samtycke. Lag (1993:1007).

Särskilda bestämmelser om ljudradio och television

26 d § De radio- och televisionsföretag som regeringen i enskilda fall beslutar får sända ut utgivna litterära och musikaliska verk samt offentliggjorda konstverk, om avtalslicens gäller enligt 26 i §.

Första stycket gäller inte sceniska verk och inte heller andra verk om upphovsmannen har förbjudit företaget att sända ut verket eller det av andra skäl finns särskild anledning att anta att han motsätter sig utsändningen. Första stycket gäller inte sådan vidaresändning som avses i 26 f §.

Vid utsändning över satellit gäller avtalslicensen endast om sändarföretaget samtidigt verkställer utsändning genom en marksändare. Lag (1995:447).

26 e § Ett radio- eller televisionsföretag som har rätt att sända ut ett verk får ta upp verket på en anordning genom vilken det kan återges, om det görs

1. för användning vid egna utsändningar ett fåtal gånger under begränsad tid,

2. för att säkerställa bevisning om utsändningens innehåll eller

3. för att en statlig myndighet skall kunna utöva tillsyn över utsändningsverksamheten.

Upptagningar som avses i första stycket 2 och 3 får användas endast för de ändamål som anges där. Om sådana upptagningar har dokumentariskt värde, får de dock bevaras i Arkivet för ljud och bild.

En statlig myndighet som har till uppgift att utöva tillsyn över reklamen i ljudradio- och televisionsutsändningar får återge utsändningar i den omfattning som motiveras av ändamålet med tillsynen. Lag (1994:190).

26 f § Var och en har rätt att till allmänheten trådlöst eller genom kabel samtidigt och oförändrat återutsända (vidaresända) verk som ingår i en trådlös ljudradio- eller televisionsutsändning, om avtalslicens gäller enligt 26 i §.

Första stycket gäller inte verk till vilka rättigheterna till vidaresändning innehas av det radio- eller televisionsföretag som sänder ut den ursprungliga sändningen. Lag (1995 :447).

Särskilda bestämmelser om datorprogram

26 g § Den som har förvärvat rätt att använda ett datorprogram får framställa sådana exemplar av programmet och göra sådana ändringar i programmet som är nödvändiga för att han skall kunna

använda programmet för dess avsedda ändamål. Detta gäller även rättelse av fel.

Den som har rätt att använda ett datorprogram får framställa säkerhetsexemplar av programmet, om detta är nödvändigt för den avsedda användningen av programmet.

Exemplar som framställs med stöd av första eller andra stycket får inte utnyttjas för andra ändamål och får inte heller användas när rätten att utnyttja programmet har upphört.

Den som har rätt att använda ett datorprogram får iaktta, undersöka eller prova programmets funktion för att fastställa de ideer och principer som ligger bakom programmets olika detaljer. Detta gäller under förutsättning att det sker vid sådan laddning, visning på skärm, körning, överföring eller lagring av programmet som han har rätt att utföra.

Avtalsvillkor som inskränker användarens rätt enligt andra och fjärde styckena är ogiltiga. Lag (1993:1007).

26 h § Återgivning av ett datorprograms kod eller översättning av kodens form är tillåten om åtgärderna krävs för att få den information som är nödvändig för att uppnå samverkansförmåga mellan programmet och ett annat program. Detta gäller dock endast under förutsättning att följande villkor är uppfyllda:

1. åtgärderna utförs aven person som har rätt att använda programmet eller för hans räkning aven person som har fått rätt att utföra åtgärderna,

2. den information som är nödvändig för att uppnå samverkansförmåga har inte tidigare varit lätt åtkomlig för de i 1 angivna personerna och

3. åtgärderna är begränsade till de delar av originalprogrammet som är nödvändiga för att uppnå den avsedda samverkansförmågan.

Första stycket innebär inte att informationen får

1. användas för andra ändamål än att uppnå den avsedda samverkansförmågan,

2. överlämnas till andra personer, utom när detta är nödvändigt för att uppnå den avsedda samverkansförmågan,

3. användas för utveckling, tillverkning eller marknadsföring av ett datorprogram som i förhållande till det skyddade programmet har en väsentligen likartad uttrycksform eller

4. användas för andra åtgärder som utgör intrång i upphovsrätten.

Avtalsvillkor som inskränker användarens rätt enligt denna paragraf är ogiltiga. Lag (1993:1007).

Gemensamma bestämmelser om avtalslicenser

26 i § En avtalslicens som avses i 13, 26 d och 26 f §§ gäller för verksutnyttjande på visst sätt, när ett avtal har ingåtts om verksutnyttjande på sådant sätt med en organisation som företräder ett flertal svenska upphovsmän på området. Avtalslicensen ger användaren rätt att utnyttja verk av det slag som avses med avtalet trots att verkens upphovsmän inte företräds av organisationen.

För att ett verk skall få utnyttjas med stöd av 13 § krävs att avtalet med organisationen har ingåtts av någon som bedriver undervisningsverksamhet i organiserade former.

När ett verk utnyttjas med stöd av 26 d § har upphovsmannen rätt till ersättning.

När ett verk utnyttjas med stöd av 13 eller 26 f § tillämpas följande. De villkor i fråga om rätten att utnyttja verket som följer av avtalet gäller. Upphovsmannen skall i fråga om ersättning som lämnas enligt avtalet och förmåner från organisationen vilka väsentligen bekostas genom ersättningen vara likställd med de upphovsmän som organisationen företräder. Upphovsmannen har dock oavsett detta alltid rätt till ersättning som hänför sig till utnyttjandet, om han begär det inom tre år efter det år då verket utnyttjades. Krav på ersättning får riktas endast mot organisationen.

Gentemot den som använder ett verk med stöd av 26 f § får krav på ersättning göras gällande endast av de avtalsslutande organisationerna. Kraven skall framställas samtidigt. Lag (1993:1007).

2 a kap. ITräder i kraft 1:9601011 Ersättning vid vidareförsäljning av exemplar av konstverk

26 j § ITräder i kraft I:9601OII Om ett exemplar av ett konstverk som har överlåtits säljs vidare inom upphovsrättens giltighetstid aven näringsidkare i hans yrkesmässiga verksamhet, har upphovsmannen rätt till ersättning av säljaren. Upphovsmannen har rätt till ersättning även i annat fall, om försäljningen förmedlas aven näringsidkare i dennes yrkesmässiga verksamhet. I ett sådant fall skall ersättningen betalas av näringsidkaren. Ersättningen skall vara fem procent av försäljningspriset exklusive mervärdesskatt.

Upphovsmannen har dock inte rätt till ersättning,

1. om försäljningspriset exklusive mervärdesskatt inte överstiger en tjugondel av basbeloppet enligt lagen (1962:381) om allmän försäkring,

2. om exemplaret av konstverket är ett alster av byggnadskonst eller

3. om exemplaret av konstverket är ett alster av brukskonst som har framställts i flera identiskt lika exemplar.

Rätten till ersättning är personlig och kan inte överlåtas. Efter upphovsmannens död är, utan hinder av 10 kap. 3 § första stycket äktenskapsbalken, föreskrifterna om bodelning, arv och testamente tillämpliga på rätten.

Endast orgarusation som företräder ett flertal svenska upphovsmän på

området har rätt att kräva in ersättningen. Organisationen skall kräva in ersättningen och betala beloppet till den ersättningsberättigade, efter avdrag för skälig ersättning till organisationen för dess omkostnader. Om organisationen inte kräver den ersättningsskyldige på ersättningen inom tre år efter utgången av det kalenderår då försäljningen ägde rum, är fordringen preskriberad.

Den som är ersättningsskyldig skall på begäran av organisationen redovisa de ersättningsgrundande försäljningar som gjorts under de tre närmast föregående kalenderåren. Lag (1995:1273).

3 Kap. Upphovsrättens övergång

Allmänna bestämmelser om överlåtelse

27 § Upphovsrätt må, med den begränsning som följer av vad i 3 § sägs, helt eller delvis överlåtas. Överlåtelse av exemplar innefattar icke överlåtelse av upphovsrätt. I fråga om beställd porträttbild äger. upphovsmannen dock icke utöva sin rätt utan tillstånd av beställaren eller, efter dennes död, av hans efterlevande make och arvingar.

Beträffande överlåtelse av upphovsrätt i vissa särskilda avseenden föreskrivs i 30--40 §§. Dessa bestämmelser tillämpas dock endast i den mån ej annat avtalats. Lag (1992: 1687).

28 § Om ej annat avtalats, äger den till vilken upphovsrätt överlåtits icke ändra verket samt ej heller överlåta rätten vidare. Ingår rätten i en rörelse, må den överlåtas i samband med överlåtelse av rörelsen eller del därav; överlåtaren svarar dock alltjämt för avtalets fullgörande.

29 § Har upphört att gälla genom lag (1976: 192).

Avtal om offentligt framförande

3O§ Överlåtes rätt att framföra ett verk offentligt, skall överlåtelsen gälla för en tid av tre år och icke medföra ensamrätt. Har längre giltighetstid än tre år bestämts och är ensamrätt avtalad, må upphovsmannen likväl själv framföra verket eller överlåta rätt därtill åt annan, såframt rätten under en tid av tre år ej tagits i bruk.

Vad i denna paragraf är stadgat gäller icke filmverk.

Förlagsavtal

31 § Genom förlagsavtal överlåter upphovsmannen till förläggare rätt att genom tryck eller liknande förfarande mångfaldiga och utgiva litterärt eller konstnärligt verk.

Manuskript eller annat exemplar av verket, efter vilket detta skall återgivas, förblir i upphovsmannens ägo.

32 § Förläggaren har rätt att utgiva en upplaga, vilken ej må överstiga av litterärt verk 2 000, av musikaliskt verk 1 000 och av konstverk 200 exemplar.

Med upplaga förstås vad förläggaren på en gång låter framställa.

33 § Förläggaren är pliktig att utgiva verket inom skälig tid, på

sedvanligt sätt sörja för dess spridning samt fullfölja utgivningen i den omfattning som betingas av möjligheterna till avsättning och övriga omständigheter. Försummas det, äger upphovsmannen häva avtalet och därvid behålla uppburet honorar. Har upphovsmannen lidit skada, som ej täckes därav, skall den ock ersättas.

34 § Om verket icke är utgivet inom två år eller, såvitt angår musikaliskt verk, inom fyra år från det upphovsmannen avlämnat fullständigt manuskript eller annat exemplar som skall mångfaldigas, äger upphovsmannen, ändå att försummelse ej ligger förläggaren till last, häva avtalet och därvid behålla uppburet honorar. Samma lag vare, om verket är utgånget och förläggaren har rätt att utgiva ny upplaga men icke inom ett år efter det upphovsmannen hos honom begärt sådan utgivning utnyttjar sin rätt.

35 § Förläggaren är skyldig att tillställa upphovsmannen intyg från tryckeriet eller den som eljest mångfaldigar verket om antalet framställda exemplar.

Har under räkenskapsår skett försäljning för vilken upphovsmannen har rätt till honorar, skall förläggaren inom nio månader efter årets slut tillställa honom redovisning, angivande försäljningen under året samt restupplagan vid årsskiftet. Även eljest äger upphovsmannen efter redovisningsfristens utgång på begäran erhålla uppgift om restupplagan vid årsskiftet.

36 § Påbörjas framställning av ny upplaga senare än ett år efter det föregående upplaga utgavs, skall upphovsmannen före framställningen erhålla tillfålle att göra sådana ändringar i verket, som kunna vidtagas utan oskälig kostnad och icke ändra verkets karaktär.

37 § Upphovsmannen har icke rätt att på nytt utgiva verket i den form och på det sätt som avses i avtalet, förrän den eller de upplagor som förläggaren äger utgiva blivit slutsålda.

Litterärt verk må dock sedan femton år förflutit efter det år, då utgivningen påbörjades, av upphovsmannen intagas i upplaga av hans samlade eller valda arbeten.

38 § Bestämmelserna om förlagsavtal äga icke tillämpning på bidrag till tidning eller tidskrift. För bidrag till annat samlingsverk gälla icke 33 och 34 §§.

Avtal om filmning

39 § Överlåtelse av rätt till inspelning av litterärt eller konstnärligt verk på film omfattar rätt att genom filmen på biograf, i television eller annorledes göra verket tillgängligt för allmänheten samt att i filmen återgiva talade inslag i text eller översätta dem till annat språk. Vad sålunda stadgats gäller icke musikaliskt verk. Lag (1973:363).

40 § Överlåtes rätt att utnyttja ett litterärt eller musikaliskt verk för film, som är avsedd för offentlig visning, är förvärvaren pliktig att inom skälig tid inspela filmverket och sörja för att det göres tillgängligt för allmänheten. Försummas det, äger upphovsmannen häva avtalet och därvid behålla uppburet honorar. Har upphovsmannen lidit skada, som ej täckes därav, skall den ock ersättas.

Om :filmverket icke är inspelat inom fem år från det upphovsmannen fullgjort vad på honom ankommer, äger upphovsmannen, ändå att försummelse ej ligger förvärvaren till last, häva avtalet och därvid behålla uppburet honorar.

Datorprogram skapade i anställningsförhållanden

40 a § Upphovsrätten till ett datorprogram, som skapas aven arbetstagare som ett led i hans arbetsuppgifter eller efter instruktioner av arbetsgivaren, övergår till arbetsgivaren, såvida inte något an nat har avtalats. Lag (1992: 1687). .

Upphovsrättens övergång vid upphovsmannens död, m.m.

41 § Efter upphovsmannens död är, utan hinder av 10 kap. 3 § första stycket äktenskapsbalken, föreskrifterna om bodelning, arv och testamente tillämpliga på upphovsrätten. Avträds boet till förvaltning av boutredningsman, får denne inte utan dödsbodelägarnas samtycke utnyttja verket på annat sätt än som förut har skett.

Upphovsmannen äger genom testamente, med bindande verkan även för efterlevande make och bröstarvingar, giva föreskrifter om rättens utövande eller bemyndiga annan att meddela dylika föreskrifter. Lag (1987:800).

42 § Upphovsrätt må ej tagas i mät hos upphovsmannen själv eller hos någon, till vilken rätten övergått på grund av bodelning, arv eller testamente. Samma lag vare beträffande rrianuskript, så ock i fråga om exemplar av sådant konstverk som ej blivit utställt, utbjudet till salu eller eljest godkänt för offentliggörande. Lag (1987:800).

4 Kap. Upphovsrättens giltighet

43 § Upphovsrätt till ett verk gäller intill utgången av sjuttionde året efter det år då upphovsmannen avled eller, i fråga om verk som avses i 6 §, efter den sist avlidne upphovsmannens dödsår. Upphovsrätt till ett :filmverk gäller i stället intill utgången av sjuttionde året efter dödsåret för den sist avlidne av huvudregissören, manusförfattaren, dialogförfattaren och kompositören av musik som har skapats speciellt för verket. Lag (1995: 1273).

44 § För verk som har offentliggjorts utan att upphovsmannenhar blivit angiven med sitt namn eller med sin allmänt kända pseudonym eller signatur gäller upphovsrätten intill utgången av sjuttionde året efter det år då verket offentliggjordes. Om verket består av två eller flera delar, räknas tiden för varje del för sig.

Om upphovsmannen inom den tid som anges i första stycket avslöjar sin identitet, gäller bestämmelserna i 43 §.

För verk som inte har offentliggjorts och vars upphovsman inte är känd gäller upphovsrätten intill utgången av sjuttionde året efter det år då verket skapades.

44 a § Om ett verk inte har getts ut inom den tid som avses i 43 eller 44 §, har den som därefter för första gången ger ut eller offentliggör verket sådan rätt till verket som svarar mot de

ekonomiska rättigheter som innefattas i upphovsrätten. Rätten gäller intill utgången av tjugofemte året efter det år då verket gavs ut eller offentliggjordes. Lag (1995: 1273).

5 Kap. Vissa upphovsrätten när~tående rättigheter

Utövande konstnärer

45 § En utövande konstnärs framförande av ett litterärt eller konstnärligt verk får inte utan hans samtycke

1. tas upp på en grammofonskiva, en :film eller en annan anordning, genom vilken det kan återges, eller

2. sändas ut i ljudradio eller television eller genom direkt överföring göras tillgängligt för allmänheten.

Ett framförande som har tagits upp på en anordning som avses i första stycket 1 får inte utan konstnärens samtycke föras över från en sådan anordning till en annan eller göras tillgängligt för allmänheten förrän femtio år har förflutit efter det år då framförandet skedde eller, om upptagningen har getts ut eller offentliggjorts inom femtio år från framförandet, efter det år då upptagningen först gavs ut eller offentliggjordes.

Bestämmelserna i 3, 6-9, 11-13, 15, 16,21,22,25-26 b, 26 e, 26 f, 27 och 28 §§, 39 § första meningen samt 41 och 42 §§ skall tillämpas i fråga om framföranden som avses i denna paragraf.

När ett exemplar aven upptagning enligt denna paragrafmed den utövande konstnärens samtycke har överlåtits inom Europeiska ekonomiska samarbetsområdet får exemplaret spridas vidare.

Fjärde stycket ger inte rätt att tillhandahålla allmänheten

1. exemplar aven upptagning genom uthyrning eller andra jämförliga rättshandlingar, eller

2. exemplar aven film eller annan anordning på vilken rörliga J 'bilder tagits upp genom utlåning. Lag (1995:\1273).

Framställare av ljud- eller bildupptagningar

46 § En grammofonskiva, en film eller en annan anordning på vilken ljud eller rörliga bilder har tagits upp får inte utan framställarens samtycke eftergöras eller göras tillgänglig för allmänheten förrän femtio år har förflutit efter det år då upptagningen gjordes eller, om upptagningen har getts ut eller offentliggjorts inom femtio år från upptagningen, efter det år då upptagningen först gavs ut eller offentliggjordes. Som eftergörande anses även att upptagningen förs över från en sådan anordning till en annan.

Bestämmelserna i 6~9 §§, 11 § andra stycket, 12, 13, 15, 16, 21, 22, 25 - 26 b och 26 e §§ skall tillämpas i fråga om upptagningar som avses i denna paragraf Dessutom skall 26 f § tillämpas i fråga om andra upptagningar än sådana som avses i 47 §.

När ett exemplar aven upptagning enligt denna paragrafmed

framställarens samtycke har överlåtits inom Europeiska eko1;lomiska samarbetsområdet får exemplaret spridas vidare.

Tredje stycket ger inte rätt att tillhandahålla allmänheten

1. exemplar aven upptagning genom uthyrning eller andra jämförliga rättshandlingar, eller

2. exemplar aven film eller annan anordning på vilken rörliga bilder tagits upp genom utlåning. Lag (1995: 1273).

Användning av ljudupptagningar för offentligt framförande

47 § Oavsett bestämmelserna i 45 § andra stycket och 46 § första stycket får ljudupptagningar användas vid en ljudradio- eller televisionsutsändning eller vid ett annat offentligt framförande. När så sker har framställaren samt de utövande konstnärer vars framförande finns på upptagningen rätt till ersättning. Om två eller flera konstnärer har samverkat vid framförandet, kan den rätt som tillkommer dem göras gällande endast av dem gemensamt. Mot den som har använt anordningen skall konstnärer och framställare göra gällande sina krav samtidigt.

Vad som sägs i första stycket om ljudradio- och televisionsutsändning gäller också när en trådlös sådan utsändning samtidigt och oförändrat återutsänds (vidaresänds) till allmänheten trådlöst eller genom kabel. Gentemot den som vidaresänder får krav på ersättning göras gällande endast genom sådana organisationer som företräder ett flertal svenska utövande konstnärer eller framställare. Organisationerna skall framställa kraven samtidigt med de krav som avses i 26 i § femte stycket.

Bestämmelserna i 8 och 9 §§, 11 § andra stycket, 21, 22 och 25--26 a §§ skall tillämpas i de fall som avses i denna paragraf. Beträffande utövande konstnärers rätt skall också 27,28,41 och 42 §§ tillämpas.

Denna paragraf gäller inte ljudfilm. Lag (1995:447).

Radio- och televisionsföretag

48 § En ljudradio- eller televisionsutsändning får inte utan radio­ eller televisionsföretagets samtycke

1. tas upp på en anordning, genom vilken den kan återges, eller

2. återutsändas eller återges för allmänheten på platser där allmänheten har tillträde mot inträdesavgift.

En utsändning som har tagits upp på en anordning som avses i första stycket 1 får inte utan radio- eller televisionsföretagets samtycke föras över från en sådan anordning till en annan förrän femtio år har förflutit efter det år då utsändningen ägde rum. Anordningarna får inte heller utan företagets samtycke spridas till allmänheten förrän samma tid har förflutit.

Bestämmelserna i 6--9 §§, 11 § andra stycket, 12, 15, 16,21,22, 25--26 b och 26 e §§ skall tillämpas i fråga om ljudradio- och televisionsutsändningar som avses i denna paragraf.

När ett exemplar aven upptagning enligt denna paragrafmed företagets samtycke har överlåtits inom Europeiska ekonomiska samarbetsområdet får exemplaret spridas vidare.

Om ett radio- eller televisionsföretag har krav på ersättning för en sådan vidaresändning som avses i 26 f § och som har skett med företagets samtycke, skall företaget framställa sitt krav samtidigt med de krav som avses i 26 i § femte stycket. Lag (1995:447).

Framställare av kataloger m.m.

49 § En katalog, en t'abell eller ett annat dylikt arbete vari ett stort antal uppgifter/har sammanställts får inte utan framställarens samtycke eftergörås förrän tio år har förflutit efter det år då arbetet gavs ut.

Bestämmelserna i 6--9 §§, 11 § andra stycket, 12 § första stycket, 13, 16--18, 22, 26--2{b och 26 e §§ skall tillämpas beträffande arbeten som avses i denna paragraf. Är ett sådant arbete eller en del av det föremål för upphovsrätt, får den också göras gällande. Lag (1993: 1007).

Fotografer

49 a § Den som har framställt en fotografisk bild har uteslutande rätt att framställa exemplar av bilden och göra den tillgänglig för allmänheten. Rätten gäller oavsett om bilden används i ursprungligt eller ändrat skick och oavsett vilken teknik som utnyttjas.

Med fotografisk bild avses även en bild som har framställts genom ett förfarande som är jämförligt med fotografi.

Rätten enligt första stycket gäller till dess femtio år har förflutit efter det år då bilden framställdes.

Bestämmelserna i 2 § andra och tredje styckena, 3, 7--9 och 11 §§, 12 § första stycket, 13, 15, 16, 18--20 och 23 §§, 24 § första stycket, 25--26 b, 26 d-- 26 f, 26 i -- 28, 31--38, 41, 42 och 50--52 §§ skall tillämpas på bilder som avses i denna paragraf. Är en sådan bild föremål för upphovsrätt, får denna rätt också göras , gällande. Lag (1995:447).

, 6 Kap. Särskilda bestämmelser

50 § Litterärt eller konstnärligt verk må ej göras tillgängligt för allmänheten under sådan titel, pseudonym eller signatur, att verket eller dess upphovsman lätt kan förväxlas med förut offentliggjort verk eller dess upphovsman.

51 § Om litterärt eller konstnärligt verk återgives offentligt på ett sätt som kränker den andliga odlingens intressen, äger domstol på talan av myndighet som regeringen bestämmer vid vite meddela förbud mot återgivandet. Vad nu är sagt skall ej gälla återgivande som sker under upphovsmannens livstid. Lag (1978:488).

52 § I samband med utdömande av vite äger rätten efter vad som finnes skäligt föreskriva åtgärder för att förebygga missbruk av exemplar som avses med förbud enligt 51 §, så ock av föremål som kan användas endast

för framställning därav. Sådan föreskrift må avse, att egendomen skall förstöras eller på visst sätt ändras.

Vad i denna paragraf stadgas gäller ej mot den som i god tro förvärvat egendomen eller särskild rätt därtill.

Egendom som avses i första stycket må i avbidan på föreskrift som där sägs tagas i beslag; därvid skall vad om beslag i brottmål i allmänhet är stadgat äga motsvarande tillämpning.

52 a § Om någon vill företa en vidaresändning genom kabel av verk som ingår i en trådlös ljudradio- eller televisionsutsändmng och begär men inte på önskade villkor får avtal om detta hos en organisation som företräder sven*a rättighetshavare eller hos ett radio- eller televisionsföretag som verkställer utsändningar inom Europeiska ekonomiska samarbetsområdet, har han på begäran rätt till förhandling med organisationen respektive företaget.

En förhandlingsskyldig part skall själv eller genom ombud inställa sig vid förhandlingssammanträde och, om det behövs, lägga fram ett motiverat förslag till lösning av den fråga som förhandlingen avser. Parterna kan gemensamt välja en annan form för förhandling än sammanträde.

Den som bryter mot bestämmelsen i andra stycket skall ersätta uppkommen skada. Vid bedömande av om och i vilken utsträckning skada har uppkommit för någon skall hänsyn tas även till dennes intresse av att bestämmelsen iakttas och till övriga omständigheter av annat än rent ekonomisk betydelse. Lag (1995:447).

7 Kap. Ansvar och ersättningsskyldighet

53 § Den som beträffande ett litterärt eller konstnärligt verk vidtar åtgärder, som innebär intrång i den till verket enligt 1 och 2 kap. knutna upphovsrätten eller som strider mot föreskrift enligt 41 § andra stycket eller mot 50 §, döms, om det sker uppsåtligen eller av grov oaktsamhet, till böter eller fängelse i liOgst två år.

Den som för sitt enskilda bruk kopierar ett datorprogram som är utgivet eller av vilket exemplar har överlåtits med upphovsmannens samtycke, skall inte dömas till ansvar, om förlagan för kopieringen inte används i näringsverksamhet eller offentlig verksamhet och han inte utnyttjar framställda exemplar av datorprogrammet för annat ändamål än sitt enskilda bruk.

Vad som sägs i första stycket gäller också, om någon till Sverige för spridning till allmänheten för in exemplar av verk, där exemplaret framställts utomlands under sådana omständigheter att en sådan framställning här skulle ha varit strafibar enligt vad som sägs i det stycket.

Den som har överträtt ett vitesförbud enligt 53 a § får inte dömas till ansvar för intrång som omfattas av förbudet.

För försök eller förberedelse till brott som avses i första och tredje styckena döms till ansvar enligt 23 kap. brottsbalken. Lag (1994:233).

53 a § På yrkande av upphovsmannen eller hans rättsinnehavare

eller av den som på grund av upplåtelse har rätt att utnyttja verket får domstolen vid vite förbjuda den som vidtar en åtgärd som innebär intrång eller överträdelse som avses i 53 § att fortsätta med åtgärden.

Om käranden visar sannolika skäl för att en åtgärd som innebär intrång eller överträdelse som avses i 53 § förekommer och om det skäligen kan befaras att svaranden genom att fortsätta med åtgärden förringar värdet av den ensamrätt som upphovsrätten medför, får domstolen meddela vitesförbud för tiden intill dess att målet slutligt har avgjorts eller annat har beslutats. Innan ett sådant förbud meddelas skall svaranden ha fått tillfålle att yttra sig, om inte ett dröjsmål skulle medföra risk för skada.

Förbud enligt andra stycket får meddelas endast om käranden ställer säkerhet hos domstolen för den skada som kan tillfogas svaranden. Saknar käranden förmåga att ställa sådan säkerhet, får domstolen befria honom från detta. I fråga om slaget av säkerheten gäller 2 kap. 25 § utsökningsbalken. Säkerheten skall prövas av domstolen, om den inte har godkänts av svaranden.

När målet avgörs skall domstolen pröva om förbud som har meddelats enligt andra stycket fortfarande skall bestå.

I fråga om överklagande av beslut enligt andra eller tredje stycket samt i fråga om handläggningen i högre domstol gäller vad som föreskrivs i rättegångsbalken om överklagande av beslut enligt 15 kap. rättegångsbalken.

Talan om utdömande av vite förs av den som har ansökt om förbudet. I samband med sådan talan får talan föras om nytt vitesförbud.

I fråga om radio- och trådsändningars innehåll gäller bestämmelserna i radiolagen (1966:755). Lag (1994:233).

54 § Den som i strid mot denna lag eller mot föreskrift enligt 41 § andra stycket utnyttjar ett verk skall till upphovsmannen eller hans rättsinnehavare gälda ersättning, utgörande skäligt vederlag för utnyttjandet.

Sker det uppsåtligen eller av oaktsamhet, skall ersättning jämväl utgå för annan förlust än uteblivet vederlag, så ock för lidande eller annat förfång.

Den som eljest uppsåtligen eller av oaktsamhet vidtager åtgärd, som innebär intrång eller överträdelse varom i 53 § sägs, skall ersätta upphovsmannen eller hans rättsinnehavare förlust, lidande eller annat förfång av åtgärden.

55 § Den som vidtager åtgärd som innebär intrång eller överträdelse varom i 53 § sägs är skyldig att, såvitt det finnes skäligt, mot lösen avstå egendom med avseende på vilken intrång eller överträdelse föreligger till upphovsmannen eller hans rättsinnehavare. Detsamma gäller i fråga om trycksats, kliche, form och liknande hjälpmedel, som kan användas endast för framställning av egendom som nu har sagts.

I stället för att förordna om inlösen enligt första stycket får rätten,

på yrkande av upphovsmannen eller hans rättsinnehavare, efter vad som finnes skäligt föreskriva, att egendom som där avses skall förstöras eller på visst sätt ändras eller att andra åtgärder skall vidtagas med den till förebyggande av missbruk. Sådan talan får väckas även av åklagare, om det är påkallat ur allmän synpunkt. Föreskrift som här avses skall inte meddelas, om förverkande eller åtgärd till förebyggande av missbruk skall beslutas enligt brottsbalken.

Bestämmelserna i första och andra styckena gäller ej mot den som i god tro förvärvat egendomen eller särskild rätt till den och ej heller om det olagliga förfarandet bestått i utförande av byggnadsverk.

Har annat föremål än som avses i första stycket använts som hjälpmedel vid sådan framställning av exemplar av verk som utgör brott enligt denna lag, får föremålet eller dess värde förklaras förverkat, om det är påkallat till förebyggande av brott eller annars särskilda skäl föreligger. Vad som nu har sagts skall tillämpas också i fråga om föremål, som har använts vid försök till brott som avses här, eller som omfattas av åtgärd som utgör förberedelse till sådant brott. Lag (1982:284).

56 § Utan hinder av vad i 55 § är stadgat äger rätten, om det med hänsyn till det konstnärliga eller ekonomiska värdet hos exemplar av verk eller övriga omständigheter finnes skäligt, på därom framställt yrkande meddela tillstånd att exemplaret mot särskild ersättning till upphovsmannen eller hans rättsinnehavare göres tillgängligt för allmänheten eller eljest användes för avsett ändamål.

57 § Vad som sägs i 53--56 §§ skall också tillämpas på rättighet som skyddas genom föreskrift i 5 kap. Lag (1995:447).

57 a § Den som i annat fall än som avses i 53 § säljer, hyr ut eller för försäljning, uthyrning eller annat förvärvssyfte innehar ett hjälpmedel som är avsett endast för att underlätta olovligt borttagande eller kr inggående aven anordning som anbringats för att skydda ett datorprogram mot olovlig exemplarframställning, döms till böter eller fångelse i högst sex månader.. Lag (1992:1687).

58 § Rätt domstol i mål om ljudradio- eller televisionsutsändning i strid mot denna lag är Stockholms tingsrätt. Detsamma gäller i mål om ersättning som avses i 18 §, 26 a § första stycket, 26 i § tredje stycket eller 47 § och i mål i vilket motsvarande ersättning begärs på grund aven hänvisning i 45, 46, 48, 49 eller 49 a § samt i mål om ersättning för en sådan vidaresändning som avses i 26 f §. Lag (1994:190).

59 § Brott som avses i denna lag får åtalas av åklagare endast om målsägande angiver brottet till åtal eller åtal är påkallat ur allmän synpunkt.

Överträdelse av stadgandet i 3 § eller av föreskrift enligt 41 § andra stycket må städse beivras av upphovsmannens efterlevande make, skyldeman i rätt upp- och nedstigande led eller syskon.

Egendom varom i 55 § sägs må, där brott som avses i denna lag skäligen kan antagas föreligga, tagas i beslag; därvid skall vad om beslag i brottmål i allmänhet är stadgat äga motsvarande tillämpning. Lag (1982:284).

8 Kap. Lagens tillämpningsområde

60 § Vad i denna lag är stadgat om upphovsrätt är tillämpligt på

1. verk av den som är svensk medborgare eller har sin vanliga vistelseort i Sverige,

2. verk som först utgivits i Sverige eller samtidigt i Sverige och utom riket,

3. filmverk vars producent har.sitt säte eller sin vanliga vistelseort i Sverige,

4. här uppfört byggnadsverk,

5. konstverk som utgör del av här belägen byggnad eller på annat sätt är fast förenat med marken.

Vid tillämpning av första stycket 2. anses samtidig utgivning ha ägt rum, om verket utgivits i Sverige inom trettio dagar efter utgivning utomlands. Vid tillämpning av första stycket 3. anses, där ej annat visas, den vars namn på sedvanligt sätt utsatts på exemplar av filmverket som verkets producent.

Bestämmelserna i 26 j § tillämpas på verk av den som är svensk medborgare eller har sin vanliga vistelseort i Sverige.

Bestämmelserna i 44 a § tillämpas på utgivningar och offentliggöranden av den som är svensk medborgare eller har sin vanliga vistelseort i Sverige. Bestämmelserna tillämpas också på utgivningar och offentliggöranden av juridiska personer som har säte i Sverige.

Bestämmelserna i 50 och 51 §§ tillämpas på varje litterärt eller konstnärligt verk, oberoende av dess ursprung. Lag (1995:1273).

61 § Föreskrifterna i 45, 47 och 48 §§ är tillämpliga på framförande, ljudupptagning samt ljudradio- och televisionsutsändning som äger rum i Sverige. Dessutom tillämpas föreskrifterna i 45 § på framföranden av den som är svensk medborgare eller har sin vanliga vistelseort i Sverige, föreskrifterna i 47 § på ljudupptagningar vars framställare är svensk medborgare eller svensk juridisk person eller har sin vanliga vistelseort i Sverige och föreskrifterna i 48 § på utsändningar av radio- eller televisionsföretag som har sitt säte här i landet. Föreskrifterna i 46 § tillämpas på ljudupptagningar och upptagningar av rörliga bilder vars framställare är svensk medborgare eller svensk juridisk person eller har sin vanliga vistelseort i Sverige liksom på sådana upptagningar av rörliga bilder som äger rum i Sverige. Bestämmelsen i 46 § om eftergörande gäller dock alla ljudupptagningar.

Föreskrifterna i 49 § tillämpas på arbeten vars framställare är svensk medborgare eller svensk juridisk person eller har sin vanliga vistelseort i Sverige liksom på arbeten som först utgivits i Sverige.

Av föreskrifterna i 49 a § tillämpas hänvisningen till 50 och 51 §§ på alla fotografiska bilder och övriga föreskrifter på fotografiska

bilder

1. vars framställare är svensk medborgare eller har sin vanliga vistelseort i Sverige eller

2. som först har utgivits i Sverige eller samtidigt i Sverige och utomlands eller

3. som har infogats i en byggnad eller annan anordning som är fast förenad med marken, om byggnaden eller anordningen är belägen i Sverige.

Vid tillämpningen av tredje stycket 2 anses utgivningen ha skett samtidigt, om bilden har utgivits i Sverige inom trettio dagar efter utgivningen utomlands. Lag (1995 :447).

, 61 a § När verk eller andra prestationer som skyddas enligt denna lag sänds ut till allmänheten över satellit, skall den upphovsrättsligt relevanta åtgärden anses ske i det land där sändarföretaget under sin kontroll och på sitt ansvar för in prestationerna i en oavbruten överföring till satelliten och därifrån till marken.

Detta gäller inte, om införandet äger rum i ett land som inte ingår i Europeiska ekonomiska samarbetsområdet (BES) och som inte heller tillhandahåller den skyddsnivå som föreskrivs i kapitel 2 i Europeiska gemenskapernas råds direktiv 93/83/EEG av den 27 september 1993.12

Om i fall som avses i andra stycket uppsändningen till satelliten äger rum i ett EES-Iand, skall den upphovsrättsligt relevanta åtgärden anses ske i det land där uppsändningen äger rum. Om uppsändningen till satelliten inte äger rum i ett EES-Iand men det radio- eller televisionsföretag som har beslutat om utsändningen har sitt säte i ett EES-Iand, skall den upphovsrättsligt relevanta åtgärden anses ske i det landet. Lag (1995:447).

62 § Regeringen får, under förutsättning av ömsesidighet eller om det följer av ett sådant avtal med en främmande stat eller en mellanfolklig organisation som riksdagen godkänt, meddela föreskrifter om denna lags tillämpning med avseende på andra länder. Regeringen får också meddela föreskrifter om lagens tillämpning på verk och fotografiska bilder som först har utgivits aven mellanfolklig organisation och på inte utgivna verk och fotografiska bilder som en sådan organisation får ge ut. Lag (1995: 1273).

9 Kap. Ikraftträdande- och övergångsbestämmelser

63 § Denna lag träder i kraft den 1 juli 1961; dock att 51 § och därtill anslutande bestämmelser i 6 och 8 kap. skola, såvitt angår återgivande i tryckt skrift, träda i kraft den dag Konungen förordnar. Lag (1970:488). 64 § Genom denna lag upphävas:

1) lagen den 30 maj 1919 (nr 381) om rätt till litterära och musikaliska verk;

2) lagen den 30 maj 1919 (nr 382) om rätt till verk av bildande konst;

3) lagen den 14 december 1956 (nr 590) om skydd för vissa kartor; samt

4) lagen den 1 mars 1957 (nr 32) om tillfållig förlängning av skyddstid för litterära och musikaliska verk.

65 § Den nya lagen skall, med iakttagande av vad i 66-69 §§ sägs, äga tillämpning jämväl med avseende å litterärt eller konstnärligt verk, som. tillkommit före ikraftträdandet. Lag (1970:488). ! /

66 § Sådana exemplar av ett verk, som framställts med stöd av äldre lag, må fritt spridas och visas, dock att vad i 23 § stadgas om uthyrning av noter till musikaliskt verk skall äga tillämpning.

67 § Trycksatser, klicheer, formar och andra hjälpmedel, som med stöd av äldre lag framställts för mångfaldigande av visst verk, må utan hinder av vad i nya lagen är stadgat fritt användas för sitt ändamål till utgången av år 1963. På exemplar, som framställts med stöd härav, skall vad i 66 § sägs äga motsvarande tillämpning.

68 § Beträffande tidning, tidskrift eller annat verk, som består av självständiga bidrag från särskilda medarbetare och som utgivits före nya lagens ikraftträdande, skall upphovsrätt enligt 5 § tillkomma utgivaren eller, om han ej är känd, förläggaren.

Om såsom utgivare angivits offentlig undervisningsanstalt eller akademi eller ock bolag, förening eller annan samfållighet eller, där utgivare ej är känd, dylik samfållighet är förläggare, skall skyddstiden beräknas enligt 44 §.

69 § Äldre lag skall tillämpas på sådant avtal om överlåtelse av upphovsrätt, som tillkömmit före nya lagens ikraftträdande. Lag (1976:192).

70 § Vad i 65-67 §§ sägs skall äga motsvarande tillämpning med avseende å rättighet, som skyddas genom föreskrift i 5 kap.

Har avtal om upptagning som sägs i 45 § tillkommit före nya lagens ikraftträdande, skall vad i 69 § sägs äga motsvarande tillämpning.

Övergångsbestämmelser

1970:488

Denna lag träder i kraft den 1 oktober 1970.

I fråga om alster av konsthantverk eller konstindustri, som tillkommit före ikraftträdandet och då åtnjöt skydd enligt äldre bestämmelser, äger de nya bestämmelserna tillämpning, om alstret är att hänföra under brukskonst, och skall i annat fall upphovsrätten icke upphöra före utgången av september 1980.

1973:363

Denna lag träder i kraft den 1 juli 1973.

Den nya lagen skall tillämpas även på verk som tillkommit före ikraftträdandet, dock med följande undantag:

1. Exemplar av verk som framställts med stöd av äldre lag får fritt spridas och visas.

2. Har någon före ikraftträdandet tillverkat trycksats, kliche, form eller annat sådant hjälpmedel för att med stöd av äldre lag mångfaldiga visst verk, får han använda det för detta ändamål till utgången av år 1975 och fritt sprida och visa exemplar som framställts.

Vad sålunda stadgas om verk skall äga motsvarande tillämpning på framförande, ljudupptagning samt ljudradio- och televisionsutsändning som avses i 45-48 §§ ävensom på arbete som avses i 49 §.

1978:488

Denna lag träder i kraft den 1 juli 1978. Den skall tillämpas även på verk som tillkommit före ikraftträdandet. Vad sålunda har föreskrivits om verk skall ha motsvarande tillämpning på framförande, ljudupptagning, ljudradioutsändning och televisionsutsändning som avses i 45,46 och 48 §§ samt på arbete som avses i 49 §.

1980:610

Denna lag träder i kraft den 1 januari 1981.

Den nya lagen skall tillämpas även på sådant verk och i 49 § avsett arbete som tillkommit före ikraftträdandet.

1982:284

Denna lag träder i kraft den 1 juli 1982. Den gäller inte beträffande intrång eller överträdelse som har skett dessförinnan eller i fråga om brott som har begåtts före ikraftträdandet. .

1982:1059

Denna lag träder i kraft den 1 januari 1983. Den skall tillämpas även på verk som har tillkommit före ikraftträdandet.

1986:367

1. Denna lag träder i kraft den 1 juli 1986.

2. Bestämmelserna i 22 d §, 45 § tredje stycket, i vad avser hänvisningen till 22 d §, och 47 § andra stycket tillämpas även på verk och upptagningar som har tillkommit före ikraftträdandet.

3. Bestämmelserna i 45 § tredje stycket, i vad avser hänvisningen till 6--8 och 26 §§, 46 § andra stycket, 47 § tredje stycket, 48 § tredje stycket, 49 § andra stycket och 61 § första stycket tredje meningen tillämpas även på verk som har tillkommit före ikraftträdandet, på radio- och televisionsutsändningar, upptagningar och framföranden som har ägt rum före ikraftträdandet och på sammanställningar som har gjorts före ikraftträdandet.

4. Bestämmelsen i 47 § första stycket tillämpas även på upptagningar som har gjorts före lagens ikraftträdande, förutsatt att den tid inom vilken en utsändning har gett rätt till ersättning enligt äldre bestämmelser då inte har löpt ut.

5. Bestämmelserna om skyddstid i 45 § andra stycket, 46 § första stycket och 48 § andra stycket tillämpas även på framföranden, ljudupptagningar samt ljudradio- och televisionsutsändningar som har ägt rum före lagens ikraftträdande, förutsatt att skyddstiden enligt äldre bestämmelser då inte har löpt ut.

Denna lag träder i kraft den l apri11987. Lagen tillämpas inte på kretsmönster som har tillkommit före ikraftträdandet.

l. Denna lag träder ikraft den l januari 1988.

2. Har upphovsmannen avlidit före ikraftträdandet, skall äldre bestämmelser fortfarande tillämpas.

1989:396

Denna lag träder i kraft den l juli 1989.

Lagen tillämpas även på verk som har tillkommit före ikraftträdandet. Bestämmelserna i 40 a § tillämpas även på överlåtelser som har ägt rum före ikraftträdandet.

1991:1073

Denna lag träder i kraft den l juli 1991. Den skall tillämpas äve11- på verk som har kommit till före ikraftträdandet. Vad som föreskrivs om verk gäller också framföranden, ljudupptagning, ljudradiosändning och t~levisionssändning som avses i 45,46 och 48 §§ samt arbete som avses i 49 §.

1992:1687

l. Denna lag träder i kraft den l januari 1993 utom i fråga om 23 §. Vad gäller 23 § träder lagen i kraft den dag regeringen bestämmer. Har regeringen inte före den l januari 1994 satt lagen i kraft såvitt gäller 23 §, träder dock lagen i den delen aldrig i kraft. Har regeringen före den l januari 1994 satt lagen i kraft såvitt gäller 23 §, upphör lagen att gälla i den delen vid utgången av år 1993. Lag (1993:1008).

2. Lagen tillämpas även på verk som har tillkommit före ikraftträdandet utom så vitt gäller åtgärder som vidtagits eller rättigheter som förvärvats dessförinnan.

1993:1007

l. Denna lag träder i kraft den l januari 1994 utom i fråga om 19 § tredje meningen som träder i kraft den dag regeringen bestämmer. (l kraft den 1 januari 1994, 1993: 1646).

2. Lagen tillämpas även på verk som har kommit till före ikraftträdandet utom när det gäller åtgärder som har gjorts eller rättigheter som har förvärvats före den tidpunkten. Det som sägs i

() 19 § om uthyrning och andra jämförliga rättshandlingar avseende exemplar av litterära verk skall dock alltid tillämpas från tiden för ikraftträdandet.

3. Det som sägs i 2 tillämpas också i fråga om framföranden, upptagningar, utsändningar och arbeten som avses i 45,46,48, och 49 §§. I fråga om framföranden, ljudupptagningar och utsändningar för vilka skyddstiden enligt äldre bestämmelser löpte ut före den 1 juli 1986, gäller dock fjärde och femte punkterna i ikraftträdande­ och övergångsbestämmelserna till lagen (1986:367) om ändring i lagen (1960:729) om upphovsrätt till litterära och konstnärliga verk. Lag (1993:1213).

1994:190

1. Denna lag träder i kraft den 1 juli 1994, då lagen (1960:730) om rätt till fotografisk bild skall upphöra att gälla.

2. Med de undantag som anges i punkterna 3--7 tillämpas de nya föreskrifterna även på verk och fotografiska bilder som har kommit till före ikraftträdandet.

3. Sådana exemplar aven fotografisk bild som har framställts med stöd av äldre föreskrifter, får även i fortsättningen fritt spridas och visas. De nya föreskrifterna tillämpas inte heller i övrigt när det gäller åtgärder som har gjorts eller rättigheter som har förvärvats före ikraftträdandet.

4. Bestämmelserna om upphovsrättens giltighetstid i 43 och 44 §§ ti111ämpas på fotografiska verk som har kommit till före ikraftträdandet endast under förutsättning att skyddstiden enligt äldre bestämmelser inte har löpt ut vid ikraftträdandet.

5. Bestämmelsen om skyddstid i 49 a § tredje stycket tillämpas på fotografiska bilder som har kommit till före ikraftträdandet endast under förutsättning att skyddstiden enligt äldre bestämmelser inte har löpt ut vid ikraftträdandet.

6. Om de nya föreskrifterna i fråga om en viss fotografisk bild medför en kortare skyddstid än den som följer av äldre bestämmelser, skall de äldre bestämmelserna om skyddstid tillämpas.

7. Bestämmelsen i 10 § andra stycket tillämpas inte på kretsmönster som kom till före den 1 april 1987.

1995:447

1. Denna lag träder i kraft den 1 juni 1995.

2. Bestämmelserna i 26 d § tredje stycket och 61 a § skall i fråga om avtal som har ingåtts före ikraftträdandet inte tillämpas förrän den 1 januari 2000.

3. Bestämmelsen i 45 § tredje stycket såvitt gäller hänvisningen till 39 § första meningen skall inte tillämpas i fråga om avtal om filminspelning som har ingåtts före ikraftträdandet. I fråga om sådana avtal gäller dock att en utövande konstnär genom avtalet skall

:, anses ha överlåtit rätt att genom filmen göra framförandet tillgängligt för allmänheten.

4. Med de undantag som anges i 5 och 6 skall de nya föreskrifterna tillämpas även på verk och prestationer som har kommit till före ikraftträdandet.

5. De nya föreskrifterna skall inte tillämpas när det gäller åtgärder som har vidtagits eller rättigheter som har förvärvats före ikraftträdandet. Bestämmelserna i 19 § andra stycket samt 45 och 46 §§ såvitt gäller hänvisningen till 19 § andra stycket skall dock alltid tillämpas från tiden för ikraftträdandet.

6. har upphävts genom lag (1995: 1274).

1995:1273

1. Denna lag träder i kraft den 1 januari 1996.

2. De nya bestämmelserna tillämpas även på verk som har kommit till före ikraftträdandet.

3. De nya bestämmelserna tillämpas inte när det gäller åtgärder som har vidtagits eller rättigheter som har förvärvats före ikraftträdandet. De exemplar av ett verk som har framställts med stöd av äldre bestämmelser får fritt spridas och visas. Vad som sägs i 19 § andra s.tycket och 26 j § skall dock tillämpas.

4. Om någon efter utgången av upphovsrättens giltighetstid enligt de äldre bestämmelserna men före ikraftträdandet har börjat att förfoga över ett verk genom att framställa exemplar av det eller genom att göra det tillgängligt för allmänheten, får han utan hinder av de nya bestämmelserna om upphovsrättens giltighetstid i nödvändig och sedvanlig utsträckning fortsätta den planerade verksamheten dock längst till den 1 januari 2000. Sådan rätt till förfogande har under motsvarande förutsättningar även den som har vidtagit väsentliga åtgärder för att framställa exemplar av verket eller för att göra det tillgängligt för allmänheten. De exemplar av ett verk som framställs med stöd av dessa bestämmelser får fritt spridas och visas. Vad som sägs i 19 § andra stycket och 26 j § skall dock tillämpas.

5. Om upphovsrättens giltighetstid för ett visst verk vid tillämpningen av de nya bestämmelserna blir kortare än den skulle ha blivit vid tillämpning av äldre bestämmelser, tillämpas de äldre bestämmelserna om giltighetstid. Bestämmelserna i 44 § tredje stycket tillämpas dock alltid efter ikraftträdandet.

6. Det som sägs i punkterna 2 - 5 tillämpas också på framföranden och upptagningar som avses i 45 och 46 §§.
