After the Tunisian revolution which deposed the Tunisian President Ben Ali and led to the dissolution of the Government on January 14, 2011, the Constitutional Court (the highest judicial body in Tunisia) announced that the President of the Tunisian Parliament should hold the post of Interim President of the Republic under article 57 of the Tunisian Constitution of 1959 until the parliamentary and presidential elections. The Interim President has the authority to issue legislative decrees, under which Decree Law No.14/2011 was issued on March 23, 2011, providing for the provisional organization of the public authorities. The Decree regulates the functions of the legislative, executive and, judiciary powers until a national constituent assembly is elected. The national constituent assembly elections were held on October 23, 2011 and proclamation of the winners is expected on November 14. The main task of the elected assembly is to draft a new constitution to replace the Tunisian Constitution of 1959. Under Article 18 of Decree Law No.14/2011, it will cease “to be applicable as soon as the national constituent assembly takes its functions and fixes another organization of the public authorities.”
