Year of Version 2003 Dates Entry into force: December 1, 2003 Published: August 19, 2003 Promulgated: August 14, 2003 Adopted: July 28, 2003 Type of Text IP-related Laws Subject Matter Patents (Inventions), Competition, Undisclosed Information (Trade Secrets), Industrial Property Notes This Law, which repealed the Law No. 8044 of December 7, 1995 on Competition, introduces the concept of abuse of dominant position, defines and sets up a legal framework for a fair and effective market competition and an independent competition authority. It has separated antitrust legislation from the unfair competition regime, which is regulated by the provisions of the Albanian Civil Code. For provisions regarding the specific treatment of agreements on intellectual and industrial property rights, see: -Part II, Chapter I, Article 7 (see p. 4) -Part III, Chapter III, Section II, Articles 50 & 52 (see p. 22). For the provisions concerning the protection of undisclosed information (trade secrets), see Part III, Chapter I, Article 30 (see p. 15), Chapter II, Article 33; Part VII, Article 71, paragraph 1.
