ZC 0012《专利数据元素标准》分为三个部分:

——第1部分:关于用XML处理复审请求审查决定、无效请求审查决定和司法判决文件的暂行办法;

——第2部分:关于用XML处理中国发明、实用新型专利文献数据的暂行办法;

——第3部分:关于用XML处理中国专利审批业务相关数据的暂行办法;

本部分为ZC 0012的第2部分

本部分的附录为规范性附录。

本部分由中华人民共和国国家知识产权局批准。

本部分由中华人民共和国国家知识产权局标准化委员会提出并归口。

本部分起草单位:中华人民共和国国家知识产权局《专利数据元素标准》制订工作组。

本部分主要起草人:张宇、陆新年、严笑卫、朱仁秀、翟薇、吴大章、王占三、张微、赵军、冯晓玲、黄迎燕、那英、方克、赵盛。


 

 

 

为使用XML技术处理中国发明、实用新型专利文献数据,实现数据生成、维护、加工的电子化和数码化,进一步提高数据的质量,方便数据交换,ZC 0012的本部分作出了针对中国发明、实用新型专利文献数据的XML DTD定义。

 


 

关于用XML处理中国发明、实用新型专利文献数据的暂行办法

 

1           范围

ZC 0012的本部分ZC 0012的本部分规定了在使用XML技术对中国发明、实用新型专利文献数据加工、交换、处理时所应遵循的规则。

2           术语和定义

下列术语和定义适用于ZC 0012的本部分。除国家法律另有明确规定外,国家知识产权局对于ZC 0012的本部分中采用的术语和定义拥有最终解释权。

2.1     专利申请

ZC 0012的本部分所称“专利申请”包括发明专利申请、实用新型专利申请。

2.2      公布

ZC 0012的本部分所称“公布” 是指发明专利申请经初步审查合格后,自申请日(或优先权日)起18个月期满时的公布或根据申请人的请求提前进行的公布。

2.3      公告

ZC 0012的本部分所称“公告” 是指对发明专利申请经实质审查没有发现驳回理由,授予发明专利权时的授权公告;对实用新型专利申请经初步审查没有发现驳回理由,授予实用新型专利权时的授权公告

2.4      专利文献

ZC 0012的本部分所称“专利文献” 是指国家知识产权局按照法定程序公布的发明、实用新型专利申请文件和公告的授权专利文件。

2.5      XML

ZC 0012的本部分所称“XML”是Extensible Markup Language的缩写(意为可扩展的标记语言)。XML是一套定义语义标记的规则,这些标记将文档分成许多部件并对这些部件加以标识。它也是元标记语言,即定义了用于定义其他于特定领域有关的、语义的、结构化的标记语言的句法语言。

3           XML元素及其属性的定义和说明

ZC 0012的本部分涉及的DTD定义见附录的DTD定义文件cn-patent-document-06-10-27.dtd,该附录直接附在标准正文之后。在该文件中有所有元素及其属性的中、英注解。

4           参考文献

ZC 0012的本部分主要参考了WIPO ST.36[1]标准中公共元素(ICE2005-02-20版)的定义和其专利文献模板DTD定义(xx-patent-document-v1-0-20050220.dtd)。

5           电子数据格式的基本要求

5.1      字符集

ZC 0012的本部分的文档实例应当采用UTF-8字符集,即在每一个文档的第一行,应当出现

<?xml version="1.0" encoding="UTF-8"?>

对于UTF-8[2]中且wipo.ent中未定义的字符,应当通过sipo.ent进行定义。

5.2      属性

5.2.1          id

id属性可以用来标识文档中的特定对象。对于不同类型的对象,建议使用不同的前缀和后缀进行区分。例如,段落的各个元素的属性可以考虑依次设置为“p0001”, “p0002” … “p0101”等。

5.2.2          idref

可以通过idref属性来引用文档中的特定的具有id属性的对象,如权利要求claim-ref、交叉引用crossref、附图引用figref等。应保证idref仅作为文档中特定对象的引用使用,不应用作其他用途。

5.3      文档实例

5.3.1          有效性

文档实例应当是有效的,即格式符合XML v1.1标准的要求。

5.3.2          合法性

文档实例应当是合法的。文档实例中必须通过!DOCTYPE指名文档的类型。如

并且文档实例应当符合DTD的要求。

5.3.3          版本标注

文档实例应当通过根元素的相关属性明确指出文档使用的DTD的版本。如

5.3.4          元素内容

文档中的元素应当尽可能的避免不必要的空格和回车等字符。如应当使用

<postcode>20231</postcode>

而不要使用

<postcode>   20231   </postcode>.

5.4      外部实体

文档实例中可以引用符合以下规定的外部实体,包括TIFFJPEGST.33定义的传真数据、ST.35定义的混合模式数据、ST25定义的序列表数据、PDF等。

5.4.1          PDF 格式

所有的该格式的文件必须作为XML文件中的参照文件,并且满足以下要求:

              Adobe Acrobat v1.4 兼容

              没有压缩的文本。

              没有加密的文本。

              没有数字签名。

              没有嵌入的OLE对象。

              所有的字体应该是内嵌的并且是许可发布的。

5.4.2  Tagged Image File Format (TIFF) 格式

所有的该格式的文件必须作为XML文件中的参照文件,并且满足以下要求:

              TIFF V6.0 版,使用Group 4 压缩方式, strip,使用 Intel 编码方式。

              分辨率300------400DPI

图像尺寸: 建议使用 A4210x297mm, 或者 Letter 7 size215.9x279.4mm, 不要超过 170mm x 255mm

5.4.3  JPEG File Interchange Format (JFIF) 格式 

所有的该格式的文件必须作为XML文件中的参照文件,并且满足以下要求:

              分辨率150------400DPI

图像尺寸: 建议使用 A4210x297mm, 或者 Letter 7 size215.9x279.4mm, 不要超过 170mm x 255mm

5.4.8  符合table-external DTD的外部表格XML格式 

所有的该格式的文件必须作为XML文件中的参照文件,该格式的文件可以用来表示外部表格数据,包括数量巨大的化学公式或者结构式、数学公式、计算机程序源代码、表格等数据。
