TITRE PREMIER
DISPOSITIONS GÉNÉRALES

Chapitre premier
Relations avec l'Institut fédéral de la propriété intellectuelle

Compétence

Art. premier. L'Institut fédéral de la Propriété intellectuelle (l'Institut) exécute les tâches administratives découlant de la loi1.

Date de présentation des envois postaux

Art. 2. - 1 Pour les envois postaux en provenance de Suisse, le jour de la consignation postale est considéré comme date de présentation. La preuve en est apportée par le timbre à date de l'office postal expéditeur, ou par le timbre de l'office postal récepteur, si celui de l'office postal expéditeur fait défaut ou est illisible; si le timbre de l'office postal récepteur manque également ou s'il est illisible, le jour de la réception de l'envoi à l'Institut est considéré comme date de présentation. L'expéditeur est admis à prouver une date de consignation antérieure.

2 Pour les envois postaux en provenance de l'étranger, la date prise en considération est celle du premier timbre apposé par un office postal suisse; si le timbre manque ou s'il est illisible, c'est le jour de la réception de l'envoi à l'Institut qui est considéré comme date de présentation. L'expéditeur est admis à prouver une date antérieure de réception par un office postal suisse.

Signature

Art. 3. - 1 Toute communication qui doit être faite à l'Institut par écrit sera valablement signée.

2 Lorsque la signature fait défaut, la date de présentation de l'écrit non signé est néanmoins reconnue, à condition que ce défaut ait été éliminé dans le délai fixé par l'Institut.

Langue

Art. 4. - 1 Les écrits adressés à l'Institut doivent être rédigés en allemand, en français ou en italien (langues officielles).

2 La langue officielle choisie par le requérant au moment du dépôt constitue la langue dans laquelle se déroulera la procédure.

3 La langue choisie initialement pour la rédaction des pièces techniques sera maintenue. Des modifications apportées à ces pièces dans une autre langue ne sont pas admises. Cette règle s'applique également à la renonciation partielle (art. 24 de la loi).

4 Lorsque d'autres écrits ne sont pas présentés dans la langue adoptée pour la procédure, une traduction dans cette langue peut être exigée.

5 Les documents remis à titre de preuve, qui ne sont pas rédigés dans une langue officielle, ne seront pris en considération que s'ils sont accompagnés d'une traduction dans une langue officielle. Les articles 40, 2e alinéa, 45, 3e alinéa, et 75, 3e alinéa, sont réservés.

6 Lorsque la traduction d'un document doit être produite, il peut être exigé que son exactitude soit attestée dans le délai fixé à cet effet. Si l'attestation n'est pas présentée, le document est réputé n'avoir pas été produit.

7 Lorsque les pièces d'une demande scindée (art. 57 de la loi), d'une requête en constitution d'un nouveau brevet (art. 25, 27 et 30 de la loi) ou d'une demande revendiquant un droit de priorité basé sur une première demande suisse (priorité interne, art. 17, al. 1er de la loi) ne sont pas rédigées dans la même langue que la demande de brevet initiale ou le brevet initial, l'Institut impartit au requérant ou au titulaire du brevet un délai jusqu'à l'expiration duquel une traduction dans cette langue peut être produite.

Pluralité de requérants

Art. 5. - 1 Lorsque plusieurs personnes sont cotitulaires d'une demande de brevet, elles doivent soit désigner celle d'entre elles à qui l'Institut peut envoyer chaque communication, ayant effet pour toutes, soit désigner un mandataire commun.

2 Tant que l'une ou l'autre de ces conditions n'est pas remplie, la personne nommée la première dans la requête est réputée destinataire des communications au sens du 1er alinéa. Si l'une des autres personnes soulève une objection, l'Institut invite tous les intéressés à agir conformément au 1er alinéa.

Impossibilité de signifier une communication

Art. 6. - 1 Lorsque l'adresse du requérant, du titulaire ou du mandataire ne suffit pas pour qu'une communication officielle parvienne à son destinataire, l'Institut cherche à obtenir l'adresse exacte, ses recherches devant se limiter à la Suisse.

2 Si ces recherches sont demeurées vaines ou que le destinataire n'ait pas pris possession d'un envoi postal expédié à l'adresse exacte, les conséquences de l'inobservation du délai indiquées dans la communication produisent néanmoins effet. Si la communication contient une décision, celle-ci est notifiée par publication dans la Feuille suisse des brevets, dessins et marques.

Succession

Art. 7. En cas de décès du requérant, l'Institut impartit aux héritiers connus de lui un délai pour régler la succession quant à la demande de brevet; il peut prolonger ce délai de façon appropriée.

Chapitre 2
Représentation

Relations de l'Institut avec le mandataire

Art. 8. - 1 Tant que le requérant ou le titulaire du brevet a un mandataire, l'Institut n'accepte en règle générale du mandant ni communications ni requêtes écrites, hormis la révocation de la procuration, le retrait de la demande de brevet et la renonciation au brevet.

2 Le mandataire reste autorisé à recevoir les pièces et les taxes que l'Institut restitue.

Droit de représentation

Art. 9. - 1 Peuvent être désignées comme mandataires auprès de l'Institut, outre les personnes physiques domiciliées en Suisse, les sociétés qui ont leur siège en Suisse.

2 Si le comportement en affaires d'un mandataire donne lieu à des plaintes, le Département fédéral de justice et police peut, après avoir entendu le mandataire,

a. Lui donner un avertissement;

b. Autoriser l'Institut à l'exclure, temporairement ou définitivement, de cette fonction;

c. Ordonner la publication de ces mesures.

3 Pour juger du comportement en affaires au sens du 2e alinéa, il est tenu compte de l'ensemble de l'activité économique du mandataire, tant en Suisse qu'à l'étranger.

4 En règle générale, l'Institut ne sera autorisé à exclure un mandataire que lorsqu'un avertissement préalable se sera révélé vain.

Chapitre 3
Délais

Calcul

Art. 10. - 1 Les délais se calculent selon la loi fédérale sur la procédure administrative.

2 Lorsqu'un délai se calcule en mois ou en années et que la date à laquelle se produit l'événement qui le déclenche ou que la date de réception de la communication est le dernier jour d'un mois, le délai prend fin le dernier jour du mois durant lequel il arrive à expiration.

3 Lorsqu'un délai court à partir de la date de priorité et que plusieurs priorités sont revendiquées, la date de priorité antérieure est déterminante.

Durée

Art. 11. - 1 Les délais impartis au cours de la procédure d'examen seront fixés en fonction du volume probable de travail du requérant. Ils seront de deux mois au moins et de cinq mois au plus.

2 L'article 74, 2e alinéa, s'applique à la procédure d'opposition.

Prolongation des délais

Art. 12. - 1 Les délais dont la durée est fixée dans la loi ou dans l'ordonnance ne peuvent être prolongés.

2 Les autres délais sont prolongés:

a. Dans la procédure d'examen, une fois d'un mois, lorsqu'une requête est présentée avant l'expiration du délai et que la taxe facturée à cet effet a été payée dans le délai fixé par l'Institut; une seconde fois de trois mois au plus, lorsqu'une requête motivée est présentée avant l'expiration du délai prolongé

et que la taxe majorée de moitié est payée dans le délai fixé par l'Institut;

b. Dans les autres cas, lorsque la personne qui en demande la prolongation fait valoir des motifs suffisants avant l'expiration du délai.

3 Un délai n'est pas suspendu par des demandes de précisions, à moins que la réponse de l'Institut n'implique le contraire.

4 L'article 74, 2e alinéa, s'applique à la procédure d'opposition.

Conséquences de l'inobservation d'un délai

Art. 13. - 1 L'inobservation du délai entraîne le rejet de la requête par l'Institut, à moins que la loi ou la présente ordonnance ne prévoie d'autre conséquence.

2 Toute communication qui fixe un délai doit indiquer les conséquences qu'entraîne l'inobservation de celui-ci.

3 L'inobservation d'un délai ne peut entraîner que les conséquences qui ont été indiquées.

Poursuite de la procédure

Art. 14. La poursuite de la procédure (art. 46a de la loi) est exclue lorsque les délais suivants n'ont pas été observés:

a. Délai pour remédier au défaut de signature (art. 3);

b. Délais pour remettre les déclarations de priorité et pour payer les taxes (art. 39, al. 2, 2bis et 4; art. 39a);

c. Délai pour demander le renvoi de l'examen (art. 62, al. 1 et 1bis, 62a, 1er al.);

d. Délai pour demander l'ajournement de la publication ou de la délivrance du brevet (art. 70, 1er al.);

e. Délais pour payer la taxe de transmission, la taxe de recherche et la taxe internationale (art. 121, 122 et 122a);

f. Délais pour présenter une requête concernant une recherche de type international (art. 126, 2e et 5e al.);

g. Délai pour demander le remboursement des annuités (art. 127m, 6e al.);

h. Délai fixé pour communiquer le motif du paiement (art. 5, 2e al., de l'O du 25 octobre 1995 sur les taxes de l'Institut fédéral de la Propriété intellectuelle; OT-IPI);

i. Délai pour rétablir la couverture du compte courant (art. 7, 3e al., OT-IPI);

k. Délai supplémentaire pour les paiements effectués selon l'ancien droit (art. 9, 2e al., OT-IPI).

Réintégration en l'état antérieur

a. Forme et contenu de la demande

Art. 15. - 1 La demande de réintégration en l'état antérieur (art. 47 de la loi) sera présentée par écrit. Elle contiendra un exposé des faits sur lesquels elle repose. Dans le délai requis pour présenter la demande, l'acte omis sera intégralement exécuté. Si l'une de ces conditions n'est pas remplie, la demande de réintégration sera déclarée irrecevable.

2 La taxe de réintégration doit être payée.

b. Examen de la demande

Art. 16. - 1 Si la taxe de réintégration n'a pas été payée au moment où la demande a été introduite, l'Institut impartit au requérant un délai supplémentaire pour effectuer le paiement.

2 Si les faits exposés à l'appui de la demande ne sont pas rendus vraisemblables, l'Institut impartit au requérant un délai pour remédier au défaut. Si les motifs invoqués sont insuffisants, il rejette le demande.

3 Si la demande est acceptée, la taxe de réintégration peut être restituée au requérant en tout ou en partie.

Chapitre 4
Taxes

Ordonnance sur les taxes

Art. 17. Le montant des taxes prévues par la loi et la présente ordonnance ainsi que les modalités de paiement sont fixés dans l'OT-IPI.

Genres de taxes

Art. 17a. - 1 Pour obtenir ou maintenir un brevet, les taxes suivantes doivent être payées:

a. la taxe de dépôt;

b. la taxe de revendication;

c. la taxe d'examen;

d. le cas échéant, la taxe d'impression;

e. les annuités.

2 Pour les demandes de brevet qui sont soumises à l'examen préalable (art. 87 ss de la loi), le requérant doit payer en outre:

a. la taxe de recherche;

b. la taxe d'examen préalable en lieu et place de la taxe d'examen.

Annuités

a. Échéance en général

Art. 18. - 1 Pour toute demande de brevet et tout brevet, les annuités sont payables d'avance chaque année dès le début de la troisième année qui suit le dépôt de la demande.

2 Les annuités échoient le dernier jour du mois au cours duquel la demande a été déposée.

3 Les annuités sont payables dans les six mois qui suivent l'échéance; une surtaxe sera perçue lorsque le paiement a lieu durant les trois derniers mois.

b. Échéance pour les demandes scindées et la constitution de nouveaux brevets

Art. 18a. - 1 Pour une demande issue de la scission d'une demande de brevet antérieure, le montant et l'échéance des annuités sont établis d'après la date de dépôt visée à l'article 57 de la loi.

2 Pour un brevet nouvellement constitué (art. 25, 2e al., 27 ou 30, de la loi), le montant et l'échéance des annuités sont établis d'après la date du dépôt du brevet initial.

3 Les annuités échues à la date de dépôt de la demande scindée ou de la requête sollicitant la constitution du nouveau brevet seront payées dans les six mois à compter de cette date; une surtaxe sera perçue lorsque le paiement a lieu durant les trois derniers mois.

c. Délai de paiement non respecté

Art. 18b. - 1 Une demande de brevet pour laquelle une annuité échue n'a pas été payée à temps est rejetée; un brevet pour lequel une annuité échue n'a pas été payée à temps est radié du registre.

2 L'Institut radie le brevet avec effet à la date d'échéance de l'annuité non payée; lorsque le brevet n'est délivré qu'après cette date, il est radié avec effet à la date de sa délivrance. Le titulaire est avisé de la radiation.

d. Paiement anticipé

Art. 18c. - 1 Les annuités ne peuvent être payées plus de deux mois avant leur échéance. Si l'Institut radie un brevet, il restitue l'annuité non encore échue.

2 Les trois premières annuités ainsi que chaque tranche supplémentaire de cinq annuités peuvent être payées à l'avance en un seul montant, compte tenu d'une réduction.

3 Les délais prévus pour le paiement de la troisième, de la sixième, onzième et seizième annuité, de même que la réglementation concernant le paiement de la surtaxe (art. 18, 3e al.), sont applicables au paiement anticipé.

4 Après l'échéance de la première annuité de chaque tranche payée à l'avance, les annuités ne sont plus restituées.

e. Rappel du paiement

Art. 18d. L'Institut attire l'attention du requérant ou du titulaire du brevet sur l'échéance d'une annuité et, le cas échéant, sur la possibilité d'effectuer un paiement anticipé et lui indique le terme du délai de paiement ainsi que les conséquences de l'inobservation de ce délai. À la demande du requérant ou du titulaire du brevet, l'Institut peut également adresser des avis aux tiers qui effectuent régulièrement les paiements pour le compte du requérant ou du titulaire du brevet. Aucun avis n'est expédié à l'étranger.

Sursis

Art. 19. - 1 Les requérants et titulaires de brevets qui établissent leur état d'indigence peuvent bénéficier du sursis jusqu'à l'expiration de la cinquième année à compter de la date de dépôt, pour le paiement des taxes nécessaires à l'obtention ou au maintien en vigueur du brevet, à l'exception de la taxe de dépôt.

2 Le titulaire du brevet qui, après l'expiration de cette période, voudra maintenir son brevet devra payer, outre les nouvelles annuités venant à échéance, au début de chacune des sixième, septième, huitième et neuvième années, un quart des montants qui ont fait l'objet du sursis.

3 Si le brevet n'est pas maintenu au-delà de cinq ans à compter de la date du dépôt, les montants qui ont fait l'objet du sursis ne seront pas réclamés.

Conditions et effet

Art. 19a. - 1 Celui qui entend être mis au bénéfice d'un sursis doit en faire la demande par écrit et y joindre un extrait du registre de l'impôt, certifié conforme, ou une autre attestation officielle appropriée, qui établit son état d'indigence.

2 Si l'attestation officielle est jugée insuffisante, l'Institut impartit au requérant un délai pour remédier à ce défaut.

3 La demande de sursis n'a pas d'effet suspensif.

4 Le sursis devient caduc lorsque la demande de brevet ou le brevet est cédé à un tiers. L'Institut impartit au nouveau requérant ou au nouveau titulaire du brevet inscrit au registre un délai de six mois pour payer l'ensemble des taxes sur lesquelles porte le sursis; une surtaxe sera perçue lorsque le paiement a lieu durant les trois derniers mois de ce délai. Si le délai de paiement n'est pas observé, l'Institut rejette la demande de brevet ou radie le brevet avec effet à la date de la mise en demeure de payer.

Restitution

Art. 20. Lorsqu'une demande de brevet est retirée ou rejetée dans sa totalité, l'Institut restitue les taxes suivantes:

a. Toute annuité payée d'avance, non encore échue;

b. La taxe d'impression, si l'Institut n'a pas encore ordonné l'impression du fascicule du brevet ou de la demande;

c. La taxe de recherche et la taxe d'examen préalable, aux conditions prévues aux articles 59 et 61;

d. La taxe d'examen, pour autant que l'Institut n'ait pas encore commencé l'examen quant au fond.

TITRE DEUXIÈME
DEMANDE DE BREVET

Chapitre premier
Généralités

Pièces requises, Taxes

Art. 21. - 1 Doivent être produits le jour du dépôt:

a. La requête en délivrance du brevet;

b. La description de l'invention;

c. Une ou plusieurs revendications;

d. Les dessins auxquels se réfèrent la description ou les revendications.

2 Doivent être produits le jour du dépôt, ou au plus tard dans le délai fixé par l'Institut:

a. L'abrégé;

b. Deux exemplaires supplémentaires des pièces techniques;

c. Le cas échéant, la procuration du mandataire.

3 Seront produits le jour du dépôt, ou au plus tard seize mois après la date de dépôt ou la date de priorité:

a. La mention de l'inventeur;

b. Le cas échéant, le document de priorité.

3bis Doivent être payées dans le délai fixé par l'Institut:

a. La taxe de dépôt et, le cas échéant, les taxes de revendication;

b. Le cas échéant, la taxe de recherche et la taxe d'examen préalable.

4 Dans le délai d'un mois à compter de la fin de l'examen, le requérant doit payer, le cas échéant, la taxe d'impression facturée par l'Institut.

5 Seront payées dès la troisième année à compter de la date de dépôt: les annuités.

Correction d'erreurs

Art. 22. - 1 Les fautes d'expression ou de transcription et les erreurs contenues dans les pièces de la demande peuvent être corrigées, sur requête ou d'office; les articles 37 et 52, 3e à 5e alinéas, sont réservés.

2 La correction de la description, des revendications ou des dessins n'est autorisée que s'il est manifeste que la partie erronée ne signifiait point autre chose.

Chapitre 2
Requête en délivrance du brevet

Forme

Art. 23. La requête doit être présentée au moyen de la formule que l'Institut fournit gratuitement.

Contenu

Art. 24. - 1 La requête doit contenir les indications suivantes:

a. La pétition en délivrance d'un brevet;

b. Le titre de l'invention (art. 26, 1er al.);

c. Les nom et prénom ou la raison sociale ou de commerce, le domicile ou le siège et l'adresse du requérant;

d. Un bordereau des pièces présentées;

e. La signature du requérant ou de son mandataire.

2 La requête doit en outre contenir:

a. Lorsqu'un mandataire est désigné, les nom, domicile ou siège et adresse du mandataire;

b. Lorsqu'il y a pluralité de requérants, la désignation du destinataire;

c. Lorsqu'il s'agit d'une demande scindée, sa désignation comme telle ainsi que le numéro de la demande initiale et la date de dépôt revendiquée;

d. Lorsqu'une priorité est revendiquée, la déclaration de priorité (art. 39);

e. Lorsqu'une immunité dérivée d'une exposition est alléguée, la déclaration y relative (art. 44).

Chapitre 3
Pièces techniques

En général

Art. 25. - 1 La description de l'invention, les revendications, les dessins et l'abrégé constituent les pièces techniques. Le début de chacune de ces parties doit figurer sur une nouvelle feuille.

2 Les pièces techniques doivent être produites en trois exemplaires.

3 Elles doivent se prêter à une reproduction directe. Les feuilles ne doivent pas être pliées et ne doivent être utilisées que d'un seul côté.

4 Elles doivent être remises sur papier souple, blanc, lisse, mat et durable, de format A4 (21 × 29,7 cm).

5 Les pages de texte doivent comporter à gauche une marge vierge d'au moins 2,5 cm; les autres marges devraient être de 2 cm.

6 Toutes les feuilles doivent être numérotées en chiffres arabes.

7 Les pages doivent être dactylographiées ou imprimées. Les symboles et autres signes, les formules chimiques ou mathématiques peuvent être écrits à la main ou dessinés. L'interligne doit être de 1 1/2 au moins. Les caractères doivent être choisis de telle sorte que les majuscules aient au moins 0,21 cm de haut. L'écriture doit être indélébile.

8 La description, les revendications et l'abrégé ne doivent pas comporter de dessins.

9 Les unités de mesure doivent être exprimées selon les prescriptions de la loi fédérale du 9 juin 1977 sur la métrologie; d'autres unités de mesure peuvent être utilisées pour des indications supplémentaires. Pour les formules mathématiques et chimiques, il y a lieu d'utiliser les symboles en usage dans le domaine considéré.

10 En règle générale, seuls doivent être utilisés les termes, signes et symboles techniques communément admis dans le domaine considéré. La terminologie et les signes utilisés dans la demande de brevet doivent être uniformes.

Description

Art. 26. - 1 La description débute par un titre qui donne de l'invention une désignation technique claire et concise. Le titre ne contiendra aucune dénomination fantaisiste.

2 [Abrogé]

3 L'introduction présentera l'invention en des termes permettant de comprendre le problème technique et sa solution.

4 La description comprendra une énumération des figures représentées dans les dessins et indiquera brièvement le contenu de chaque figure.

5 Elle doit contenir au moins un exemple de réalisation de l'invention, à moins que celle-ci ne soit suffisamment exposée d'une autre manière.

6 Dans la mesure où cela n'est pas évident, la description doit expliquer comment l'objet de l'invention peut être utilisé industriellement.

7 et 8 [Abrogés]

Inventions dans le domaine de la microbiologie

Art. 27. - 1 Lorsqu'une invention concernant un procédé microbiologique ou un produit obtenu par un tel procédé comporte l'utilisation ou l'obtention d'un micro-organisme auquel le public n'a pas accès et qui ne peut être décrit dans les pièces techniques de façon à permettre à un homme du métier d'exécuter l'invention, le requérant doit compléter l'exposé de l'invention par le renvoi, dans la description, au dépôt d'une culture du micro-organisme.

2 La culture doit être déposée, au plus tard à la date du dépôt de la demande, auprès d'un organisme détenant une collection de cultures, reconnu par l'Institut.

3 La culture déposée fait partie intégrante de la description à partir du moment où celle-ci y renvoie.

4 Le renvoi contient les indications suivantes:

a. La désignation dudit organisme détenant une collection de cultures;

b. Le jour du dépôt;

c. Le numéro d'ordre sous lequel la culture est enregistrée auprès de l'organisme détenant une collection de cultures.

5 Lorsque le renvoi est produit dans le délai de seize mois à compter de la date de dépôt ou de priorité, il est réputé l'avoir été à cette première date.

6 La remise d'échantillons de la culture à des tiers peut être subordonnée à la condition que ceux-ci communiquent à l'organisme détenant la collection de cultures leurs nom et adresse à l'intention du déposant et s'engagent:

a. À ne pas donner à d'autres personnes accès à la culture déposée ou à une culture qui en est dérivée;

b. À ne pas utiliser celle-ci hors du champ d'application de la loi;

c. En cas de litige, à prouver qu'ils n'ont pas violé leurs engagements au sens des lettres a et b.

Dessins

Art. 28. - 1 La surface utile des feuilles contenant Ies dessins ne doit pas excéder 17 × 26,2 cm, ni être encadrée.

2 Les dessins doivent être exécutés en lignes et traits indélébiles, uniformément épais et bien délimités, sans couleurs ni lavis; ils doivent pouvoir être imprimés tels quels.

3 Les coupes sont indiquées par des hachures qui ne doivent pas entraver la lecture des signes de référence et des lignes directrices.

4 L'échelle des dessins et leur exécution graphique doivent être telles que la reproduction photographique permette d'en distinguer sans peine tous les détails. Si l'échelle figure sur un dessin, elle doit être représentée graphiquement; d'autres indications de grandeur ne sont généralement pas admises.

5 Les chiffres, lettres et signes de référence figurant dans les dessins doivent être simples et clairs.

6 Les signes de référence utilisés dans les dessins doivent correspondre à ceux qui sont utilisés dans la description ou les revendications.

7 S'il le faut, les éléments d'une figure peuvent être représentés sur plusieurs feuilles, à condition que la figure puisse être aisément composée par juxtaposition de celles-ci.

8 Les diverses figures doivent être nettement séparées les unes des autres, mais disposées sans perte de place. Elles doivent être numérotées consécutivement en chiffres arabes, indépendamment de la numérotation des feuilles.

9 Les dessins ne doivent pas contenir de texte; sont seulement admis de courtes indications ou des mots-clés qui rendent le dessin plus compréhensible et sont exprimés dans la même langue que la demande.

Revendications

Art. 29. - 1 Les revendications doivent indiquer les caractéristiques techniques de l'invention.

2 Les revendications doivent être rédigées de manière claire et aussi concise que possible.

3 Elles doivent, être ordonnées de manière systématique, claire et logique.

4 Elles ne doivent, en règle générale, pas contenir de renvois à la description ou aux dessins ni, en particulier, d'expressions du genre «comme décrit dans la partie de la description» ou «comme illustré dans la figure des dessins».

5 Les signes de référence qui, dans les dessins, renvoient aux caractéristiques techniques de l'invention, seront reportés, entre parenthèses, dans les revendications, si la compréhension de celles-ci s'en trouve facilitée. Ils n'ont pas pour effet de limiter les revendications.

6 Les revendications doivent être numérotées consécutivement en chiffres arabes.

Revendications indépendantes

Art. 30. - 1 Lorsque la demande de brevet contient plusieurs revendications indépendantes, de même catégorie ou de catégories différentes (art. 52 de la loi), le lien technique qui exprime le concept inventif général doit ressortir de ces revendications mêmes.

2 Cette condition est en particulier réputée remplie lorsque la demande de brevet contient l'une des combinaisons suivantes de revendications indépendantes:

a. Outre une première revendication pour un procédé: une revendication pour un moyen de mise en œuvre de ce procédé, une revendication pour le produit en résultant, et une revendication, soit pour une application de ce procédé, soit une utilisation de ce produit;

b. Outre une première revendication pour un produit: une revendication pour un procédé de fabrication de ce produit, une revendication pour un moyen de mise en œuvre de ce procédé, et une revendication pour une utilisation de ce produit;

c. Outre une première revendication pour un dispositif: une revendication pour un procédé de mise en action de ce dispositif, et une revendication pour un procédé de fabrication de ce dispositif.

Revendications dépendantes

Art. 31. - 1 Toute revendication dépendante doit se référer pour le moins à une revendication précédente et contenir les caractéristiques marquant la forme spéciale d'exécution qu'elle a pour objet.

2 Une revendication dépendante peut se référer à plusieurs revendications précédentes, pour autant qu'elle les énumère de façon claire et exhaustive.

3 Toutes les revendications dépendantes doivent être groupées de façon claire.

Forme et contenu de l'abrégé

Art. 32. - 1 L'abrégé contiendra l'information technique permettant d'apprécier s'il y a lieu de consulter le fascicule du brevet ou le fascicule de la demande.

2 L'abrégé doit comprendre un résumé de ce qui est exposé et indiquer les principaux usages de l'invention.

3 Lorsque les pièces techniques contiennent des formules chimiques propres à caractériser l'invention, l'une de ces dernières au moins doit figurer dans l'abrégé; ses symboles seront expliqués.

4 Lorsque les pièces techniques comportent des dessins propres à caractériser l'invention, l'un de ceux-ci au moins doit être désigné pour être repris dans l'abrégé; les signes de référence les plus importants de ce dessin figureront entre parenthèses dans l'abrégé.

5 Toute figure choisie doit se prêter à la réduction photographique.

6 L'abrégé ne comportera pas plus de cent cinquante mots.

Abrégé définitif

Art. 33. - 1 La teneur définitive de l'abrégé est arrêtée d'office.

Chapitre 4
La mention de l'inventeur

Forme

Art. 34. - 1 La mention de l'inventeur sera faite par un écrit séparé ne comprenant que les indications suivantes:

a. Les nom et prénom ainsi que l'adresse de l'inventeur; lors de changements d'état civil, le nom précédent sera également indiqué;

b. La déclaration du requérant selon laquelle personne d'autre n'a, à sa connaissance, participé à l'invention;

c. Si le requérant n'est pas l'inventeur ou n'est pas l'inventeur unique, une déclaration précisant comment il a acquis le droit à la délivrance du brevet;

d. Le titre de l'invention et, s'il est connu, le numéro de la demande de brevet;

e. Les nom et prénom ou la raison sociale ou de commerce ainsi que l'adresse du requérant.

3 Si la mention de l'inventeur n'est rédigée ni dans une langue officielle ni en anglais, une traduction dans l'une de ces langues sera jointe.

Délai

Art. 35. - 1 Si la mention de l'inventeur n'a pas été produite en même temps que la requête, elle peut encore l'être dans un délai de seize mois à compter de la date de dépôt ou de la date de priorité.

2 L'Institut impartit au requérant qui présente une demande scindée (art. 57 de la loi) un délai de deux mois pour produire la mention de l'inventeur, lorsque le délai prévu au 1er alinéa n'expire pas plus tard.

3 Si la mention de l'inventeur n'est pas produite en temps utile, l'Institut rejette la demande de brevet.

Art. 36. [Abrogé]

Rectification

Art. 37. - 1 Le requérant ou le titulaire du brevet peut demander la rectification de la mention de l'inventeur. À cette demande sera jointe la déclaration de consentement de la personne mentionnée à tort comme inventeur. La taxe facturée à cet effet devra être payée dans le délai fixé par l'Institut.

2 Si la personne mentionnée à tort comme inventeur est déjà portée au registre des brevets, la rectification sera également enregistrée et publiée.

3 Une fois produite, la mention de l'inventeur n'est pas restituée.

Renonciation à être mentionné

Art. 38. - 1 Une renonciation de l'inventeur à être mentionné dans le registre des brevets et dans les publications de l'Institut n'est prise en considération que si le requérant présente à l'Institut, avant la fin de l'examen, une déclaration de renonciation de l'inventeur.

2 La déclaration doit contenir le titre de l'invention ainsi que le numéro de la demande de brevet, si celui-ci est connu; elle doit en outre être datée et munie de la signature de l'inventeur.

3 L'article 34, 3e alinéa, est applicable par analogie.

4 La déclaration de renonciation qui satisfait aux prescriptions ainsi que la mention de l'inventeur sont classées à part; l'existence de ces titres est mentionnée dans le dossier.

Chapitre 5
Priorité et immunité dérivée d'une exposition

SECTION 1
PRIORITÉ

Déclaration de priorité

Art. 39. - 1 La déclaration de priorité comprend les indications suivantes:

a. La date du premier dépôt;

b. Le pays dans lequel ou pour lequel ce dépôt a été effectué;

c. Le numéro de ce dépôt.

2 La déclaration de priorité, à l'exception du numéro, doit être produite avec la requête en délivrance du brevet.

2bis La déclaration de priorité peut aussi être produite dans le délai de deux mois à compter de la date de dépôt, à condition que la taxe facturée à cet effet soit payée dans le délai fixé par l'Institut. Si ces délais ne sont pas observés, le droit de priorité s'éteint.

3 Le numéro doit être indiqué dans le délai de production du document de priorité (art. 40, 4e al., et 43, 3e al.), s'il n'apparaît pas dans ce document.

4 Si une déclaration de priorité a été produite en temps utile, d'autres déclarations de priorité (art. 42), relatives à des premiers dépôts non antérieurs, peuvent être présentées dans les trois mois suivant la date de dépôt.

Déclaration de priorité en cas de priorité interne

Art. 39a. - 1 Pour la déclaration de priorité, il suffit d'indiquer le numéro de la première demande. Cette indication doit être produite avec la requête en délivrance du brevet.

2 La déclaration de priorité peut aussi être produite dans le délai de deux mois à compter de la date de dépôt, à condition que la taxe facturée à cet effet soit payée dans le délai fixé par l'Institut. Si ces délais ne sont pas observés, le droit de priorité s'éteint.

3 Si une déclaration de priorité a été produite en temps utile, d'autres déclarations de priorité (art. 42) relatives à des premiers dépôts non antérieurs peuvent être présentées dans les trois mois suivant la date de dépôt.

Document de priorité

Art. 40. - 1 Le document de priorité comprend:

a. Une copie des pièces techniques du premier dépôt, dont la conformité avec les pièces originales est attestée par l'autorité auprès de laquelle a eu lieu ce premier dépôt;

b. L'attestation de cette autorité relative à la date du premier dépôt.

2 Si le document n'est rédigé ni dans une langue officielle ni en anglais, une traduction en sera produite dans l'une de ces langues.

3 Si le document de priorité doit servir à plusieurs demandes de brevet, il suffit de le présenter pour une demande de brevet et de s'y référer à temps pour les autres. La référence au document de priorité a les mêmes effets que la production de celui-ci.

4 Le document de priorité doit être produit dans le délai de seize mois à compter de la date de priorité. Si le délai n'est pas observé, le droit de priorité s'éteint.

5 L'attestation mentionnée au 1er alinéa, lettre a, n'est pas nécessaire lorsque le premier dépôt a eu lieu ou a produit ses effets dans l'un des pays qui accorde la réciprocité à la Suisse; le droit de l'Institut d'exiger l'attestation aux fins de l'examen quant au fond est réservé.

6 Lorsque la demande de brevet revendique une priorité interne, l'indication du numéro de la première demande de brevet a les mêmes effets que la production du document de priorité.

Pièces de priorité complémentaires

Art. 41. S'il ressort du document de priorité que le dépôt sur lequel se fonde la priorité revendiquée ne constitue que partiellement un premier dépôt au sens de la Convention de Paris du 20 mars 1883 pour la protection de la propriété industrielle, l'Institut peut exiger la remise de pièces de dépôts antérieurs, nécessaires pour élucider les faits.

Priorité multiple

Art. 42. - 1 Lorsque plusieurs inventions ont fait séparément l'objet de demandes de protection et qu'elles sont groupées en Suisse dans une seule demande de brevet, il peut être remis, aux conditions prévues à l'article 17 de la loi, autant de déclarations de priorité qu'il y a eu de dépôts.

2 Le 1er alinéa s'applique également lorsqu'une priorité interne est revendiquée.

Priorité en cas de demandes scindées

Art. 43. - 1 En cas de scission de la demande (art. 57 de la loi), la priorité revendiquée valablement pour la demande initiale vaut également pour une demande scindée, pour autant que le requérant ne renonce pas par écrit au droit de priorité. L'article 57, 2e alinéa, de la loi est réservé.

2 Lorsque plusieurs priorités ont été revendiquées (art. 42), le requérant doit spécifier celles qui ont trait à la demande scindée.

3 L'Institut impartit au requérant un délai de deux mois pour produire le document de priorité (art. 40), lorsque le délai prévu à l'article 40, 4e alinéa, n'expire pas plus tard.

4 Les 1er et 2e alinéas s'appliquent également lorsqu'une priorité interne est revendiquée.

Document de priorité relatif au premier dépôt en Suisse

Art. 43a. Sur requête, l'Institut délivre un document de priorité à condition que la taxe facturée à cet effet ait été payée.

SECTION 2
IMMUNITÉ DÉRIVÉE D'UNE EXPOSITION

Déclaration relative à l'immunité dérivée d'une exposition

Art. 44. - 1 La déclaration concernant l'immunité dérivée d'une exposition (art. 7b, let. b, de la loi) comprend les indications suivantes:

a. La désignation exacte de l'exposition;

b. Une déclaration relative à la présentation effective de l'invention.

2 Elle doit être produite avec la requête en délivrance du brevet, faute de quoi l'immunité dérivée de l'exposition s'éteint.

3 L'article 43, 1er et 2e alinéas, s'applique par analogie aux demandes scindées.

Pièces requises

Art. 45. - 1 Les pièces relatives à l'immunité dérivée d'une exposition doivent être remises dans les quatre mois suivant la date dépôt.

2 Ces pièces doivent avoir été délivrées durant l'exposition par l'autorité compétente et contenir les indications suivantes:

a. Une attestation selon laquelle l'invention a effectivement été exposée;

b. Le jour d'ouverture de l'exposition;

c. Le jour de la première divulgation de l'invention, s'il ne coïncide pas avec le jour d'ouverture;

d. Une pièce, authentifiée par l'autorité susmentionnée, permettant d'identifier l'invention.

3 Si ces pièces ne sont rédigées ni dans une langue officielle ni en anglais, une traduction dans l'une de ces langues doit être produite.

4 L'article 43, 3e alinéa, s'applique par analogie aux demandes scindées.

TITRE TROISIÈME
EXAMEN DE LA DEMANDE DE BREVET

Chapitre premier
Examen lors du dépôt et examen quant à la forme

SECTION 1
EXAMEN LORS DU DÉPÔT

Attribution de la date de dépôt

Art. 46. - 1 La date de dépôt est attribuée à la demande de brevet déposée dans une langue officielle et qui contient:

a. Une requête en délivrance du brevet;

b. Une description de l'invention;

c. Une ou plusieurs revendications;

d. Les dessins auxquels se réfèrent la description ou les revendications;

e. Des indications permettant d'identifier le requérant.

2 La date de dépôt est également attribuée lorsque les documents énumérés au 1er alinéa, lettres a à d, ne satisfont pas intégralement à la loi et à l'ordonnance.

3 Lorsque les conditions énoncées au 1er alinéa ne sont pas remplies, l'Institut tient la demande pour non déposée. Il renvoie les pièces déposées au requérant, lorsque celui-ci est identifié, ou lui donne l'occasion de satisfaire aux conditions que requiert encore l'attribution de la date de dépôt.

4 Si un dessin manque, l'Institut invite le requérant à le remettre ou à demander, aux fins d'assurer le maintien de la date de dépôt, que le renvoi à ce dessin soit réputé ne pas avoir été fait.

5 Une fois la date de dépôt fixée, l'Institut délivre un certificat de dépôt au requérant.

6 Lorsqu'une demande scindée est conforme à l'article 57, 1er alinéa, lettres a et b, de la loi, l'Institut admet que la date de dépôt revendiquée subsiste à bon droit, aussi longtemps qu'une autre conclusion ne résulte pas de l'examen quant au fond.

SECTION 2
EXAMEN QUANT À LA FORME

Objet

Art. 47. Une fois la date de dépôt fixée à la suite de l'examen lors du dépôt, l'Institut examine:

a. S'il y a lieu qu'un mandataire soit institué (art. 48);

b. Si la taxe de dépôt et, le cas échéant, les taxes de revendication sont payées (art. 49 et 51, 4e al.);

c. Si les pièces techniques sont conformes aux prescriptions qui ne concernent pas leur contenu (art. 50 et 51);

d. Si les autres pièces de la demande ont été déposées à temps et sont conformes aux prescriptions (art. 52).

Institution d'un mandataire en cas de domicile à l'étranger

Art. 48. Si, lors du dépôt de la demande de brevet, le requérant non domicilié en Suisse n'a pas désigné de mandataire, l'Institut l'invite à indiquer, dans le délai fixé, le nom, le domicile ou le siège et l'adresse de son mandataire.

Taxe de dépôt et taxe de revendication

Art. 49. - 1 L'Institut invite le requérant à payer la taxe de dépôt dans le délai fixé.

2 Chaque demande de brevet peut contenir dix revendications exemptes de taxe; pour chaque revendication supplémentaire, une taxe de revendication est due.

3 Si les pièces techniques déposées initialement comptent plus de dix revendications, l'Institut invite le requérant à payer, dans le délai fixé, une taxe de revendication pour chaque revendication supplémentaire. En cas de non-paiement ou de paiement partiel, les revendications surnuméraires sont biffées à partir de la dernière.

Vices de forme des pièces techniques

Art. 50. - 1 L'examen des pièces techniques quant à la forme ne porte que sur:

a. [Abrogé]

b. Le choix de la langue adéquate (art. 4, 3e et 7e al.);

c. Le nombre d'exemplaires prescrit (art. 25, 2e al., et 51, 3e al.);

d. La présentation requise (art. 25, 1er al., et 3e à 7e al.; art. 28, 1er et 2e al.).

2 Si l'Institut constate un vice de forme, il invite le requérant à y remédier.

Modifications des pièces techniques

Art. 51. - 1 Des modifications des pièces techniques ne sont admises que s'il est indiqué à quelle demande de brevet elles se rapportent.

2 La lettre accompagnant la remise des modifications doit être signée du requérant ou de son mandataire.

3 Les modifications doivent être présentées en deux exemplaires.

4 Si les pièces techniques modifiées contiennent plus de revendications soumises à la taxe qu'avant la modification ou pour la première fois plus de dix revendications, l'Institut invite le requérant à payer les taxes de revendication manquantes jusqu'au terme fixé. En cas de non-paiement ou de paiement partiel, les revendications surnuméraires sont biffées à partir de la dernière. Les taxes de revendication échues ne sont pas remboursées.

Autres pièces de la demande

Art. 52. - 1 Si la requête en délivrance du brevet n'a pas été présentée au moyen de la formule prescrite (art. 23), l'Institut invite le requérant à le faire.

2 Lorsque le requérant a institué un mandataire, l'Institut vérifie si une procuration en faveur de ce mandataire a été déposée. Si la procuration fait défaut, l'Institut invite le requérant à la déposer.

3 Si la désignation de l'inventeur, produite en temps voulu, présente des défauts, l'Institut invite le requérant à y remédier.

4 L'Institut invite le requérant à corriger les défauts, auxquels il est possible de remédier, que présentent des déclarations de priorité ou des documents de priorité remis en temps voulu et, s'il le faut, à produire la traduction du document de priorité (art. 40, 2e al.) et des pièces concernant un dépôt antérieur (art. 41). Si le requérant ne donne pas suite à l'invitation, le droit de priorité s'éteint.

5 Le 4e alinéa s'applique par analogie à la déclaration et aux pièces concernant l'immunité dérivée d'une exposition (art. 44 et 45).

Chapitre 2
Détermination de la procédure d'examen quant au fond

Tri

Art. 53 - 1 Lorsque, à la suite de l'examen lors du dépôt, la date de dépôt a été fixée, l'Institut communique au requérant:

a. Soit que sa demande ne sera pas portée devant l'examinateur (art. 89 de la loi) parce qu'elle n'est manifestement pas soumise à l'examen préalable (art. 87, 2e al., de la loi),

b. Soit que sa demande sera portée devant l'examinateur pour décision quant à l'assujettissement.

2 À la demande du requérant qui a reçu une communication selon le 1er alinéa, lettre a, la demande de brevet est portée devant l'examinateur pour décision quant à l'assujettissement.

Décision concernant l'assujettissement

Art. 54. - 1 Lorsque la demande de brevet a été portée devant l'examinateur (art. 53, 1er al., let. b, ou 2e al.), celui-ci se prononce sur l'assujettissement.

2 Lorsque les pièces techniques ne permettent pas de prendre une décision au sens du 1er alinéa, l'examinateur invite le requérant à remédier à ce défaut.

3 Toute opposition à la décision de l'examinateur (art. 87, 5e al., de la loi) doit être faite par écrit et motivée, dans le délai d'un mois à compter de la notification de la décision.

4 Si l'opposition est manifestement infondée, l'examinateur met, dans la décision sur opposition, les frais de cette procédure à la charge du requérant.

5 La demande de brevet définitivement soumise à l'examen préalable le demeure, même si les pièces techniques sont ultérieurement modifiées.

Chapitre 3
Recherche sur l'état de la technique dans la procédure d'examen préalable

Paiement de la taxe de recherche

Art. 55. - 1 En même temps qu'est prise la décision de soumettre la demande de brevet à l'examen préalable, le requérant est invité à payer la taxe de recherche dans le délai de deux mois.

2 Lorsque cette décision est frappée d'opposition puis confirmée, un nouveau délai de paiement de deux mois est imparti au requérant.

3 Lorsque, au moment de la décision, une requête en renvoi de l'examen quant au fond (art. 62 et 62a) a été présentée ou lorsqu'une telle requête est présentée durant le délai de paiement, celui-ci est prolongé jusqu'au terme du renvoi. L'Institut en informe le requérant, mais ne lui adresse par la suite aucun rappel.

Examen préliminaire

Art. 56. Une fois la taxe de recherche payée, l'examinateur vérifie si la demande de brevet permet une recherche sensée sur l'état de la technique. Si tel n'est pas le cas, il invite le requérant à remédier aux défauts.

Rapport sur l'état de la technique

Art. 57. - 1 L'examinateur entreprend la recherche sur l'état de la technique en se fondant sur les pièces dont il dispose à ce moment-là.

2 Pour procéder à la recherche sur l'état de la technique, l'Institut est autorisé à conclure des accords de co-opération avec d'autres autorités ou organisations.

3 Le rapport sur l'état de la technique énumère les documents accessibles au service chargé de la recherche, qui entrent en ligne de compte pour apprécier la brevetabilité (art. 1er de la loi).

4 Le rapport, accompagné d'une copie des documents qui y sont mentionnés, est adressé au requérant.

Exemption de la taxe de recherche

Art. 58. - 1 Une exemption de la taxe de recherche n'est accordée que si, avant que le requérant n'ait été invité à payer (art. 55, 1er al.) ou, si le renvoi de l'examen quant au fond a été requis, un mois avant l'expiration du délai de paiement prolongé (art. 55, 3e al.), l'examinateur est déjà en possession d'un rapport sur l'état de la technique, qui

a. Émane du service de la recherche pour les demandes de brevet suisses et,

b. Se fondant sur la même date de dépôt ou la même date de priorité, prend en considération l'objet de la demande de brevet de manière exhaustive.

2 Un tel rapport peut notamment avoir trait:

a. À la demande de brevet initiale, lorsqu'il s'agit d'une demande scindée (art. 57 de la loi);

b. Au premier dépôt dont la priorité est revendiquée;

c. À un autre dépôt, lorsque la demande de brevet constitue un premier dépôt dont la priorité est revendiquée pour cet autre dépôt.

Restitution de la taxe de recherche

Art. 59. - 1 La taxe de recherche est entièrement restituée:

a. Lorsque le requérant fournit un rapport répondant aux exigences posées à l'article 58, 1er alinéa, avant que la recherche sur l'état de la technique ne soit entreprise (art. 57, 1er al.), ou

b. Lorsque, pour un autre motif, il n'est pas nécessaire d'établir l'état de la technique.

2 Si le rapport prévu au 1er alinéa, lettre a, ne répond que partiellement aux exigences posées à l'article 58, 1er alinéa, le montant que l'Institut économise du fait de ce rapport est restitué.

Taxe de recherche additionnelle

Art. 60. - 1 Lorsque l'état de la technique n'a pas été établi pour toutes les revendications parce que la demande de brevet n'est pas unitaire (art. 52 et 55 de la loi), l'examinateur invite le requérant à payer dans le délai de deux mois les taxes de recherche additionnelles; si le requérant parvient à démontrer l'unité de la demande de brevet dans le délai de paiement, les taxes de recherches additionnelles lui sont restituées.

2 Si le requérant ne donne pas suite à l'invitation, l'examinateur rejette la demande de brevet dans la mesure où l'état de la technique n'est pas établi. Cette partie peut, jusqu'à, l'entrée en force du rejet, faire l'objet d'une demande scindée (art. 57 de la loi).

3 Si la date de dépôt est reportée après la recherche sur l'état de la technique, le requérant est invité à payer une taxe de recherche additionnelle dans le délai de deux mois. L'article 59, 2e alinéa, s'applique par analogie.

Taxe d'examen préalable

Art. 61. - 1 Lorsque la recherche sur l'état de la technique est achevée, le requérant est invité à payer la taxe d'examen préalable dans les trois mois. L'examen est repris après le paiement de la taxe.

2 La taxe d'examen préalable est restituée si la demande de brevet est retirée ou rejetée avant qu'une notification au sens de l'article 68 ou l'annonce au sens de l'article 69, 1er alinéa, ait été faite.

3 Si la taxe d'examen préalable n'est pas payée, la demande de brevet est rejetée.

Taxe d'examen

Art. 61a. Avant le début de l'examen quant au fond, le requérant doit, à la demande de l'Institut, payer la taxe d'examen dans le délai fixé.

Chapitre 4
Examen quant au fond

SECTION 1
DISPOSITIONS GÉNÉRALES

Renvoi de l'examen

Art. 62. - 1 Tant que la procédure d'examen n'est pas terminée, le requérant peut demander que l'examen quant au fond soit différé de dix-huit mois au plus à compter de la date de dépôt ou de la date de priorité.

1bis Tant que la procédure d'examen n'est pas terminée, le requérant peut demander que l'examen quant au fond soit différé jusqu'à la date prévue à l'article 125 de la loi, s'il établit:

a. Qu'il a présenté pour la même invention, en plus de sa demande de brevet suisse, une demande de brevet européen désignant la Suisse; et

b. Que les demandes ont la même date de dépôt ou de priorité.

1ter Si, dans le cas visé à l'alinéa 1bis, la demande de brevet européen est définitivement rejetée ou retirée, ou si le brevet européen est révoqué, l'examen quant au fond est repris.

2 Les demandes au sens des alinéas 1 et 1bis doivent être présentées par écrit; elles ne sont réputées présentées que lorsque la taxe de renvoi facturée par l'Institut a été payée.

3 Ces demandes n'ont pas pour effet de suspendre les délais déjà fixés, sauf si ceux-ci sont prolongés en vertu des articles 55, 3e alinéa, et 61, alinéa 1bis.

Renvoi de l'examen en cas de revendication de la priorité interne

Art. 62a. - 1 Lorsqu'une demande sert de base à la revendication d'une priorité interne et tant que la procédure d'examen n'est pas terminée, le requérant peut demander que l'examen quant au fond soit différé jusqu'à la date de délivrance du brevet issu de la demande ultérieure.

2 La demande de renvoi de l'examen doit être présentée par écrit; elle n'est réputée présentée que lorsque la taxe de renvoi facturée par l'Institut a été payée.

3 Si la demande ultérieure est définitivement rejetée ou retirée, l'examen quant au fond est repris.

4 Des demandes selon le 1er alinéa n'ont pas pour effet de suspendre des délais déjà fixés, sauf si ceux-ci sont prolongés en vertu des articles 55, 3e alinéa, et 61, alinéa 1bis.

Procédure accélérée

Art. 63. - 1 Le requérant peut demander que l'examen quant au fond soit entrepris selon une procédure accélérée.

2 La demande doit être présentée par écrit; elle n'est réputée présentée que lorsque la taxe facturée à cet effet par l'Institut a été payée.

Pièces techniques modifiées

Art. 64. - 1 Lorsqu'une revendication est modifiée dans son contenu, ou nouvelle, le requérant doit, à la demande de l'Institut, indiquer dans quelle partie des pièces de la demande de brevet a été exposé pour la première fois l'objet nouvellement défini.

2 S'il résulte de l'article 58, 2e alinéa, de la loi, que la date de dépôt doit être reportée au jour de la production des pièces modifiées, un délai est imparti au requérant pour lui donner la possibilité:

a. Soit de renoncer à la modification entraînant le report de la date, dans la mesure où l'exposé de l'invention n'est de ce fait pas mis en cause,

b. Soit d'apporter la preuve que l'invention est déjà exposée dans des pièces de la demande de brevet présentées antérieurement.

3 Si le requérant ne renonce pas à la modification ou s'il ne parvient pas à réfuter les objections, le report de la date de dépôt est prononcé, de même que la perte du droit de priorité lorsque le délai de priorité est dépassé.

4 Une fois cette décision passée en force, la renonciation à la modification n'a pas pour effet de rétablir une date de dépôt antérieure.

5 Le dépôt réitéré de modifications ne doit pas entraver le déroulement normal de la procédure. Les demandes de modification non conformes à cette prescription ne sont pas prises en considération.

Date de dépôt d'une demande scindée

Art. 65. - 1 A la demande de l'Institut, le requérant doit indiquer dans quelle partie des pièces de la demande antérieure a été exposé pour la première fois l'objet défini dans la demande scindée.

2 S'il se révèle que la date de dépôt provisoirement attribuée à une demande scindée au moment de l'examen opéré lors du dépôt (art. 46, 6e al.) est revendiquée à tort, l'article 64, 2e à 4e alinéas, s'applique par analogie.

Classement

Art. 66. - 1 Chaque demande de brevet est classée selon la classification internationale des brevets instituée par l'Arrangement de Strasbourg du 24 mars 1971. Le requérant doit fournir les indications nécessaires à cet effet.

2 Jusqu'à l'inscription au registre des brevets, l'Institut peut modifier le classement.

SECTION 2
OBJET ET FIN DE L'EXAMEN

Procédure sans examen préalable

Art. 67. - 1 Dans la procédure sans examen préalable, l'Institut examine d'abord si la demande de brevet doit faire l'objet d'une notification en vertu de l'article 59, 1er alinéa, de la loi. Si tel est le cas, il rejette la demande de brevet lorsque le requérant ne parvient pas à infirmer les objections soulevées en modifiant les pièces techniques ou d'une autre manière.

2 Si l'Institut estime que la demande de brevet ne satisfait pas aux dispositions des articles 50, 51, 52, 55 et 57 de la loi ainsi qu'à celles de la présente ordonnance, il impartit au requérant un délai pour remédier au défaut. Si le défaut n'est que partiellement corrigé, l'Institut peut, lorsqu'il le juge utile, faire d'autres notifications.

Procédure d'examen préalable

Art. 68. - 1 Une fois la taxe d'examen payée, l'examinateur (art. 89 de la loi) détermine d'abord si la demande de brevet doit faire l'objet d'une notification en vertu de l'article 96, 2e alinéa, de la loi. Si tel est le cas, il rejette la demande de brevet lorsque le requérant ne parvient pas à infirmer les objections soulevées en modifiant les pièces techniques ou d'une autre manière.

2 Si l'examinateur estime que la demande de brevet ne satisfait pas aux dispositions des articles 50, 51, 52, 55 et 57 de la loi ainsi qu'à celles de la présente ordonnance, il impartit au requérant un délai pour remédier au défaut. Si le défaut n'est que partiellement corrigé, l'examinateur peut, lorsqu'il le juge utile, faire d'autres notifications.

Fin de l'examen

Art. 69. - 1 Si les conditions dont dépend la publication de la demande de brevet, dans la procédure avec examen préalable, ou la délivrance du brevet, dans la procédure sans examen préalable, sont remplies, la date prévue pour la fin de la procédure d'examen est annoncée au requérant au moins un mois à l'avance; en même temps, ce dernier est avisé de l'annuité à payer avant la fin de l'examen. Avec cette annonce, lui sont également communiqués les modifications éventuelles de l'abrégé et les corrections au sens de l'article 22, 2e alinéa, ainsi que, le cas échéant, le montant de la taxe d'impression (art. 71) et la date d'expiration du délai de paiement.

2 Lorsque la taxe d'impression et l'annuité échue avant la date de la fin de l'examen ont été payées, la date probable de la publication de la demande ou de la délivrance du brevet est communiquée au requérant.

3 Si les pièces techniques satisfont d'emblée ou après notification aux dispositions de la loi ainsi qu'à celles de la présente ordonnance, le requérant est réputé approuver la version dans laquelle la demande de brevet, dans la procédure avec examen préalable, doit être publiée ou dans laquelle le brevet, dans la procédure sans examen préalable, doit être délivré.

4 Si les modifications des pièces techniques après la fin de la procédure d'examen (art. 105 de la loi) nécessitent une nouvelle publication, lesdites modifications ne seront admises que si le requérant a payé, le cas échéant, la taxe d'impression.

5 [Abrogé]

Chapitre 5
Préparation de la publication de la demande ou préparation de la délivrance du brevet

Ajournement de la publication ou de la délivrance

Art. 70. - 1 Le requérant qui souhaite ajourner la publication de la demande de brevet, dans la procédure avec examen préalable, ou la délivrance du brevet, dans la procédure sans examen préalable, doit le demander par écrit à l'Institut dans les deux mois qui suivent l'annonce de la fin de l'examen.

2 Lorsque l'ajournement demandé n'excède pas six mois à compter de l'annonce de la fin de l'examen, il n'est pas nécessaire de motiver la requête.

3 Lorsqu'il est établi que le requérant y consent, l'ajournement excédant six mois peut également être demandé par l'autorité fédérale qui, selon l'objet de l'invention, a intérêt à ce que le secret soit maintenu. La demande doit être motivée. Le Département fédéral de justice et police se prononce sur proposition de l'Institut, après que celui-ci a consulté l'autorité qualifiée en l'espèce. L'Institut examine chaque année s'il subsiste un intérêt à maintenir le secret de l'invention.

Calcul de la taxe d'impression

Art. 71. - 1 La taxe d'impression est calculée d'après les pièces techniques produites par le requérant.

2 La version des pièces mentionnées dans l'annonce de la fin de l'examen est déterminante.

3 L'impression des dix premières pages du manuscrit du fascicule du brevet est exempte de taxe.

Délai suspensif

Art. 72. Les demandes tendant à faire inscrire provisoirement ou définitivement des modifications au registre, ainsi que le retrait de la demande de brevet, qui parviennent à l'Institut moins d'un mois avant la date prévue pour la publication de la demande ou pour la délivrance du brevet, telle qu'elle a été communiquée au requérant, ne sont réputés présentés qu'après la publication de la demande ou la délivrance du brevet.

Chapitre 6
Opposition dans la procédure d'examen préalable

Forme et contenu

Art. 73. - 1 L'opposition doit être produite en deux exemplaires dans les trois mois qui suivent la publication, et contenir:

a. Les nom et prénom ou la raison sociale ou de commerce, le domicile ou le siège ainsi que l'adresse de l'opposant;

b. La désignation de la demande de brevet attaquée;

c. La déclaration précisant dans quelle mesure il est fait opposition à la délivrance du brevet;

d. Les causes d'opposition (art. 1er, 1a et 2 de la loi);

e. L'exposé des motifs indiquant tous les faits et moyens de preuve invoqués.

2 Lorsque le second exemplaire de l'acte d'opposition fait défaut, l'opposant peut le produire dans les quatorze jours après y avoir été invité.

3 Lorsque des écrits sont invoqués comme moyens de preuve, la date de leur parution ainsi que les passages pertinents de ceux-ci doivent être indiqués. Si, même après y avoir été invité, l'opposant ne fournit pas ces indications, la division d'opposition n'est pas tenue de prendre ces moyens de preuve en considération.

4 L'article 5 s'applique par analogie.

Compétence du président de la division

Art. 74. - 1 Le président de la division d'opposition désigne parmi les fonctionnaires et employés de l'Institut ayant une formation technique ou juridique les membres nécessaires pour traiter une affaire.

2 Il mène la procédure; il est notamment compétent pour ordonner les mesures propres à élucider les faits et pour fixer et prolonger les délais dans la procédure d'opposition.

Langue

Art. 75. - 1 Sous réserve de l'article 37 de la loi fédérale sur la procédure administrative, la procédure d'opposition se déroule dans la langue dans laquelle est rédigée la demande attaquée.

2 Si l'opposition ou une autre pièce présentée par l'opposant sont produites dans une autre langue officielle, l'opposant remettra sur invitation une traduction dans la langue adoptée pour la procédure.

3 Lorsqu'une pièce invoquée comme moyen de preuve n'est rédigée ni dans une langue officielle ni en anglais, une traduction dans l'une de ces langues peut être exigée. Si une telle traduction n'est pas produite, la division d'opposition n'est pas tenue de prendre ce moyen de preuve en considération.

Représentation de l'opposant

Art. 76. - 1 L'opposant qui doit instituer un mandataire établi en Suisse (art. 13 de la loi) est tenu d'en indiquer, dans le délai d'opposition, le nom, le domicile ou le siège et l'adresse.

2 Le mandataire doit produire une procuration dans le délai qui lui est imparti.

3 Pour le surplus, les articles 8 et 9 s'appliquent par analogie.

Opposant exclu de la procédure

Art. 77. - 1 Si l'opposition n'est pas conforme aux articles 73, 1er alinéa, et 76, ou si le délai prévu à l'article 73, 2e alinéa, n'est pas observé, la division d'opposition exclut l'opposant de la procédure.

2 Si, après l'expiration du délai d'opposition, de nouveaux motifs, faits ou moyens de preuve (art. 73, 1er al., let. d et e) sont invoqués sans que, notamment, une modification des pièces techniques postérieure à la publication semble le justifier, la division d'opposition peut exclure l'opposant de la procédure en ce qui concerne cette extension.

Réponse à l'opposition

Art. 78. - 1 L'opposition est signifiée au requérant qui est invité à y répondre et, le cas échéant, à produire des pièces modifiées (art. 105 de la loi).

2 La réponse et les pièces modifiées doivent être remises en autant d'exemplaires qu'il y a d'oppositions; il y a lieu d'y ajouter un exemplaire de la réponse et deux exemplaires des pièces modifiées.

Modification des revendications

Art. 79. Lorsque les revendications sont modifiées au moyen de caractéristiques non contenues dans le fascicule de la demande ou entraînant un report de date, la publication doit être répétée.

Échange de mémoires. Débats

Art. 80. - 1 La division d'opposition communique à tous les opposants la réponse du requérant et les modifications des pièces techniques et porte simultanément les autres oppositions à leur connaissance.

2 Si le requérant a modifié les pièces techniques ou si la division d'opposition le juge utile pour d'autres motifs, elle invite les opposants à se prononcer.

3 La division d'opposition peut inviter les parties à un nouvel échange de mémoires ou à participer à des débats. Des débats peuvent aussi avoir lieu sur requête d'une partie, s'il apparaît qu'ils sont propres à élucider les faits.

4 Lorsque la division d'opposition décide de procéder à des débats, elle en communique le lieu et la date aux parties.

5 Les débats ne sont pas publics. Les personnes qui comparaissent doivent justifier de leur droit d'y participer. Un procès-verbal sommaire des débats est dressé.

6 Les délibérations se déroulent à huis clos.

Décision finale de la division d'opposition

Art. 81. - 1 Lorsque les pièces sont en état, la division d'opposition décide:

a. Que la demande de brevet est entièrement ou partiellement rejetée et que, dans cette mesure, l'opposition est admise, ou

b. Que le brevet peut être délivré au vu des pièces exposées ou des pièces modifiées au cours de la procédure d'opposition et que l'opposition est rejetée pour le surplus.

2 Lorsqu'une demande de brevet est partiellement rejetée, la division d'opposition invite le requérant, une fois la décision passée en force, à adapter les pièces techniques aux revendications modifiées. Si le requérant ne donne pas suite à l'invitation, la partie qui subsiste est rejetée.

3 L'article 69, 3e alinéa, s'applique par analogie à la délivrance du brevet au vu de pièces modifiées.

TITRE QUATRIÈME
RECOURS DANS LA PROCÉDURE D'EXAMEN PRÉALABLE

Droit applicable

Art. 82. Dans la procédure d'examen préalable, le recours est régi par les articles 106 et 106a de la loi.

Art. 85. Sous réserve de l'article 37 de la loi fédérale sur la procédure administrative, la réglementation touchant la langue à utiliser devant l'autorité inférieure s'applique également à la procédure de recours.

TITRE CINQUIÈME
DOSSIER ET REGISTRE DES BREVETS

Chapitre premier
Dossier

Contenu

Art. 89. - 1 L'Institut tient pour chaque demande de brevet et chaque brevet un dossier renseignant sur le cours suivi par la procédure d'examen et sur les modifications concernant l'existence du brevet et le droit au brevet.

2 Celui qui joint aux pièces un titre probant et déclare que celui-ci divulgue des secrets de fabrication ou d'affaires peut demander qu'il soit classé à part. L'existence de tels titres est mentionnée dans le dossier.

Consultation des pièces

Art. 90. - 1 Avant la publication d'une demande de brevet, dans la procédure avec examen préalable, ou avant la délivrance d'un brevet, dans la procédure sans examen préalable, sont autorisés à consulter le dossier moyennant paiement d'une taxe:

a. Le requérant et son mandataire;

b. Les personnes en mesure de prouver que le requérant leur fait grief de violer les droits découlant de sa demande de brevet ou qu'il les met en garde contre une telle violation;

c. Les tiers en mesure de prouver que le requérant ou son mandataire y consent.

2 Ces personnes sont aussi autorisées à consulter des demandes de brevet rejetées ou retirées.

3 Après la phase visée au 1er alinéa, toute personne peut consulter le dossier moyennant paiement d'une taxe.

4 Celui qui, en vertu du 1er ou du 2e alinéa, entend consulter le dossier doit indiquer à l'Institut, d'avance et par écrit, la date à laquelle il envisage de le faire.

5 Si la consultation de titres probants classés à part (art. 89, 2e al.) est requise, l'Institut se prononce après avoir entendu le requérant ou le titulaire du brevet. Dans la procédure d'opposition ainsi que dans la procédure de recours, c'est le président de la division d'opposition ou de la chambre de recours qui statue.

6 Lorsque l'intérêt public l'exige, le Département fédéral de justice et police peut autoriser l'Institut à laisser les directeurs de division de l'administration fédérale consulter le dossier.

7 Sur demande et moyennant paiement d'une taxe, les pièces à consulter seront délivrées sous forme de copies.

8 Les prescriptions générales en matière d'entraide judiciaire sont réservées.

Renseignements sur des demandes de brevet

Art. 91. - 1 Contre paiement d'une taxe, l'Institut donne aux tiers, sans garantir qu'ils soient complets, les renseignements suivants sur des demandes de brevet pendantes:

a. Nom et adresse du requérant et de son mandataire;

b. Nom et domicile de l'inventeur, si celui-ci n'a pas renoncé à être mentionné;

c. Numéro de la demande de brevet;

d. Date de dépôt;

e. Indications concernant la priorité et l'immunité dérivée d'une exposition;

f. Titre de l'invention;

g. Classement provisoire;

h. Assujettissement ou non-assujettissement de la demande à l'examen préalable;

i. Requêtes en renvoi de l'examen quant au fond, de la publication de la demande ou de la délivrance du brevet;

k. Data de la publication et numéro du fascicule de la demande;

l. Procédure d'opposition en cours;

m. Droits concédés, de même que restrictions au droit de disposer ordonnées par des tribunaux ou des autorités chargées de l'exécution forcée.

2 L'Institut donne ces informations si le nom du requérant ou le numéro de la demande de brevet est indiqué. Dans la mesure du possible, l'Institut fournit également les informations en se fondant sur d'autres indications.

Conservation des documents

Art. 92. L'Institut conserve l'original ou la copie des documents relatifs à des demandes de brevet retirées ou rejetées, pendant cinq ans à compter du retrait ou du rejet, mais au moins pendant dix ans à compter du dépôt.

Chapitre 2
Registre des brevets

Tenue du registre

Art. 93. - 1 L'Institut tient un registre des brevets délivrés.

2 Les demandes de brevet publiées y sont inscrites provisoirement. Une fois le brevet délivré, les inscriptions provisoires sont tenues pour définitives.

Contenu du registre

Art. 94. - 1 Les brevets sont inscrits définitivement au registre avec les indications suivantes:

a. Numéro du brevet;

b. Symboles de classification;

c. Titre de l'invention;

d. Date de dépôt;

e. Numéro de la demande de brevet;

f. Date de publication de la demande de brevet dans la procédure avec examen préalable;

g. Date de délivrance du brevet;

h. Priorités et immunités dérivées d'expositions;

i. Nom et prénom ou raison sociale ou de commerce, domicile ou siège et adresse du titulaire du brevet;

k. Nom, domicile ou siège et adresse du mandataire;

l. Nom et domicile de l'inventeur, si celui-ci n'a pas renoncé à être mentionné;

m. Droits concédés, de même que restrictions au droit de disposer ordonnées par des tribunaux ou des autorités chargées de l'exécution forcée;

n. Modifications relatives à l'existence du brevet ou au droit au brevet;

o. Changements de domicile ou de siège social du titulaire du brevet;

p. Changements de mandataire ou de son domicile ou siège.

2 Les demandes de brevet publiées sont inscrites provisoirement avec les indications correspondantes sous le numéro de brevet envisagé.

3 L'Institut peut encore inscrire provisoirement ou définitivement d'autres indications jugées utiles.

Consultation. Extraits du registre

Art. 95. - 1 Contre paiement d'une taxe, chacun est admis à consulter le registre des brevets.

2 Sur requête et contre paiement d'une taxe, l'Institut établit des extraits du registre des brevets.

Chapitre 3
Modifications

SECTION 1
MODIFICATIONS RELATIVES À L'EXISTENCE DU BREVET

Renonciation partielle

a. Forme

Art. 96. - 1 La déclaration de renonciation partielle à un brevet (art. 24 de la loi) doit être présentée par écrit en deux exemplaires.

2 Elle sera inconditionnelle.

3 Elle n'est réputée présentée que lorsque la taxe facturée à cet effet par l'Institut a été payée.

b. Contenu

Art. 97. - 1 La déclaration de renonciation partielle ne doit donner lieu à aucun doute quant à la portée juridique des revendications; les articles premier, 1a, 2, 51, 52 et 55 de la loi régissent également le nouvel agencement des revendications.

2 La description, les dessins et l'abrégé ne peuvent être modifiés. La renonciation partielle comprendra néanmoins une déclaration de ce genre:

Les parties de la description et des dessins qui seraient incompatibles avec le nouvel agencement des revendications doivent être considérées comme éliminées.

3 Si la déclaration de renonciation partielle n'est pas conforme aux prescriptions, l'Institut impartit au titulaire du brevet un délai pour remédier au défaut. Lorsque le défaut n'a été que partiellement corrigé, l'Institut peut, s'il le juge utile, faire d'autres notifications.

4 Lorsque la renonciation partielle porte sur un brevet délivré selon la procédure d'examen préalable, l'objet des nouvelles revendications ne donne pas lieu à un nouvel examen de sa brevetabilité au regard de l'état de la technique.

c. Enregistrement et publication

Art. 98. - 1 Si la déclaration de renonciation partielle est conforme aux prescriptions, elle est enregistrée.

2 L'Institut la publie et la joint au fascicule du brevet; un nouveau document de brevet est remis au titulaire du brevet.

3 Simultanément, l'Institut impartit au titulaire du brevet un délai de trois mois pour requérir la constitution de nouveaux brevets (art. 25 de la loi).

Limitation par le juge

Art. 99. L'article 98 est applicable par analogie lorsque le brevet a été limité par le juge (art. 27 ou 30 de la loi).

Constitution de nouveaux brevets

a. Requête

Art. 100. Les dispositions régissant les demandes de brevet s'appliquent à la requête en constitution d'un nouveau brevet (art. 25, 27, 3e al., ou 30, 2e al., de la loi); les articles 101 et 102 sont réservés.

b. Revendication

Art. 101. - 1 Pour chaque nouveau brevet à constituer selon l'article 100, une nouvelle revendication au moins sera formulée dans les limites des revendications éliminées du brevet initial et compte tenu de l'article 24 de la loi.

2 Si le brevet initial a été délivré selon la procédure d'examen préalable, l'objet des nouvelles revendications ne donne pas lieu à un nouvel examen de sa brevetabilité au regard de l'état de la technique.

c. Description

Art. 102. - 1 En ce qui concerne la description et les dessins, on peut renvoyer au fascicule du brevet initial; il y a lieu d'ajouter une déclaration de ce genre:

Les parties de la description et des dessins figurant dans le fascicule du brevet nº…, qui seraient incompatibles avec les revendications du présent brevet, doivent être considérées comme éliminées.

2 Si le renvoi prévu au 1er alinéa suscite un doute quant à la portée juridique du brevet, les parties du fascicule du brevet initial nécessaires à l'intelligence des revendications du nouveau brevet seront reproduites sous une forme appropriée.

SECTION 2
MODIFICATIONS CONCERNANT LE DROIT À LA DÉLIVRANCE DU BREVET ET LE DROIT AU BREVET; CHANGEMENTS DE MANDATAIRE

Admission partielle d'une action en cession

Art. 103. - 1 Si le juge a ordonné la cession d'une demande de brevet en éliminant certaines revendications (art. 30 de la loi), le requérant qui succombe pourra former au moyen des revendications éliminées une ou plusieurs demandes de brevet. Elles auront pour date de dépôt celle de la demande cédée et seront, pour le surplus, traitées comme des demandes scindées (art. 57 de la loi).

2 Si le juge a ordonné la cession d'un brevet en éliminant certaines revendications (art. 30 de la loi), le titulaire du brevet qui succombe pourra, au moyen des revendications éliminées, requérir la constitution d'un ou de plusieurs nouveaux brevets (art. 100 à 102).

3 Une fois en possession du jugement définitif de cession, l'Institut impartit au requérant ou au titulaire du brevet qui a succombé un délai pour présenter de nouvelles demandes de brevet ou une requête en constitution de nouveaux brevets.

Mention dans le dossier

Art. 104. - 1 Avant la publication d'une demande de brevet, dans la procédure avec examen préalable, ou la délivrance d'un brevet, dans la procédure sans examen préalable, sont mentionnés dans le dossier:

a. Les changements de requérant;

b. Les changements de raison sociale ou de commerce;

c. Les autres modifications, telles que les changements de mandataire, la concession de droits et les restrictions au droit de disposer ordonnées par des tribunaux ou des autorités chargées de l'exécution forcée.

2 L'article 105, 2e à 6e alinéas, est applicable par analogie.

3 L'acquéreur d'une demande de brevet reprend celle-ci en l'état où elle se trouve au moment où le titre probant parvient à l'Institut.

Inscription provisoire ou définitive au registre des brevets

Art. 105. - 1 Sont inscrits provisoirement ou définitivement dans le registre des brevets:

a. Les modifications concernant le droit à la délivrance du brevet intervenues après la publication de la demande de brevet dans la procédure avec examen préalable;

b. Les modifications concernant le droit au brevet;

c. Les changements de raison sociale ou de commerce;

d. Les autres modifications, telles que le changement de mandataire, la concession de droits et les restrictions au droit de disposer ordonnées par des tribunaux ou des autorités chargées de l'exécution forcée.

2 Toutes les modifications doivent être attestées au moyen d'une déclaration écrite du titulaire ou du requérant précédent ou au moyen d'un autre titre probant; les articles 106 et 107 sont réservés. Les titres probants font partie du dossier.

2bis Pour toutes les modifications, l'Institut peut, lorsque les circonstances l'imposent, exiger que la signature du requérant ou du titulaire soit légalisée ou que d'autres moyens de preuve tels qu'un extrait du registre du commerce soient présentés.

3 Tant qu'une licence exclusive est provisoirement ou définitivement inscrite au registre, aucune autre licence incompatible avec elle ne sera provisoirement ou définitivement inscrite pour le même brevet.

4 Une sous-licence est inscrite provisoirement ou définitivement lorsqu'elle est attestée par une déclaration écrite du licencié provisoirement ou définitivement inscrit, ou par un autre titre probant suffisant. Au surplus, le droit de licencié de concéder des sous-licences doit être établi.

5 La requête d'inscription provisoire ou définitive d'une modification n'est réputée présentée que lorsque la taxe facturée à cet effet par l'Institut a été payée. Lorsque, pour un même brevet, l'enregistrement simultané de plusieurs modifications est requis, une seule taxe est due.

6 Sont provisoirement ou définitivement inscrites sans frais les modifications qui reposent sur un jugement exécutoire ou sur une adjudication résultant d'une exécution forcée, de même que les restrictions au droit de disposer ordonnées par des tribunaux ou des autorités chargées de l'exécution forcée.

Radiation de droits de tiers

Art. 106. Sur demande du requérant ou du titulaire du brevet, l'Institut radie le droit en faveur d'un tiers, mentionné dans le dossier ou inscrit provisoirement ou définitivement au registre des brevets, si, simultanément, une déclaration expresse de renonciation du tiers ou un autre titre probant suffisant est présenté et que la taxe facturée à cet effet par l'Institut est payée. L'article 105, alinéa 2bis, est réservé.

Changements de mandataire

Art. 107. - 1 Les changements de mandataire sont mentionnés dans le dossier ou inscrits provisoirement ou définitivement au registre des brevets dès présentation de la procuration en faveur du nouveau mandataire.

2 Pour l'Institut, la désignation d'un nouveau mandataire tient lieu de révocation de la procuration en faveur du précédent.

3 La première désignation d'un mandataire ainsi que la radiation de mandataires désignés sont exemptes de taxe.

TITRE SIXIÈME
PUBLICATIONS DE L'INSTITUT

Organe de publication

Art. 108. - 1 Les publications que la loi et la présente ordonnance prescrivent de faire dans la Feuille suisse des brevets, dessins et marques ont lieu deux fois par mois.

2 L'Institut publie également dans ce périodique des informations d'intérêt général.

Fascicule du brevet et fascicule de la demande

Art. 109. - 1 Le fascicule du brevet est publié le jour de la délivrance du brevet. La délivrance est annoncée le même jour dans la Feuille suisse des brevets, dessins et marques.

2 Dans la procédure avec examen préalable, le fascicule de la demande est publié le même jour que la demande de brevet. Les dossiers sont ouverts le même jour à la consultation.

Autres publications officielles

Art. 110. - 1 L'Institut publie chaque année un catalogue des affaires traitées durant l'exercice précédent.

2 À l'aide de la documentation en matière de brevets qui est en sa possession, l'Institut peut faire paraître des recueils d'intérêt général, notamment une collection des abrégés publiés.

Art. 111 à 113. [Abrogés]

TITRE SEPTIÈME
DEMANDES DE BREVET EUROPÉEN ET BREVETS EUROPÉENS

Champ d'application de l'ordonnance

Art. 114. - 1 Le présent titre s'applique aux demandes de brevet européen et aux brevets européens, qui produisent effet en Suisse.

2 Les autres dispositions de la présente ordonnance sont également applicables, à moins que l'article 109 de la loi et le présent titre n'en disposent autrement.

Dépôt auprès de l'Institut

Art. 115. - 1 Les personnes qui ont leur domicile ou leur siège en Suisse sont habilitées, à titre de déposant ou de mandataire, à déposer auprès de l'Institut des demandes de brevet européen, à l'exclusion de demandes divisionnaires.

2 L'Institut mentionne sur les pièces de la demande le jour où elles lui sont parvenues.

3 Les taxes perçues en vertu de la Convention sur le brevet européen doivent être payées directement à l'Office européen des brevets.

Traduction

Art. 116. - 1 Celui qui présente à l'Institut une traduction des revendications d'une demande de brevet européen publiée (art. 112 de la loi) ou du fascicule, original ou modifié, du brevet européen (art. 113 de la loi) doit indiquer le numéro de cette demande ou de ce brevet.

2 Si, à la suite de la procédure d'opposition, le brevet européen a été maintenu sous une forme modifiée, la nouvelle traduction peut être intégralement ou partiellement remplacée par une déclaration précisant dans quelle mesure la traduction antérieure vaut aussi pour le fascicule du brevet modifié.

3 L'Institut consigne le jour de réception de la traduction. Il se borne à examiner si celle-ci est complète.

4 Aux fins de consultation, l'Institut met sans délai la traduction à disposition et consigne la date à partir de laquelle celle-ci a pu être consultée.

5 Si la traduction est révisée (art. 114 de la loi), les alinéas 1er à 4 s'appliquent par analogie.

6 Si la traduction du fascicule du brevet ou la déclaration selon le 2e alinéa n'a pas été remise à temps (art. 113, 2e al., de la loi), l'Institut déclare que le brevet n'a pas produit effet en Suisse. Lorsque cette décision est passée en force, il radie le brevet avec effet à la date de la délivrance.

Registre et dossier

Art. 117. - 1 Dans le registre suisse des brevets européens (art. 117 de la loi) sont enregistrées:

a. Les indications mentionnées dans le registre européen des brevets lors de la délivrance;

b. Les indications mentionnées dans le registre européen des brevets au sujet de la procédure d'opposition;

c. En sus, les indications prévues pour les brevets suisses.

2 L'Institut enregistre les indications dans la langue utilisée dans la procédure de l'Office européen des brevets; lorsque cette langue est l'anglais, l'enregistrement a lieu dans la langue officielle suisse dans laquelle la traduction du fascicule du brevet a été fournie et, si cette traduction fait défaut, dans la langue officielle choisie par l'Institut.

3 La langue adoptée selon le 2e alinéa devient la langue dans laquelle se déroulera la procédure (art. 4).

4 L'Institut tient un dossier de chaque brevet européen.

Signe du brevet

Art. 117a. Pour les brevets européens produisant effet en Suisse, le signe du brevet (art. 11 de la loi) se compose de l'indication «EP/CH» suivie du numéro du brevet.

Transformation

Art. 118. - 1 Lorsqu'une demande de brevet européen ou un brevet européen est transformé en demande de brevet suisse, l'Institut impartit au requérant un délai pour effectuer les opérations suivantes:

a. Payer la taxe de dépôt (art. 17a, 1er al., let. a);

b. Produire la traduction (art. 123 de la loi);

c. Instituer un mandataire (art. 13 de la loi).

2 Si la date de dépôt de la demande de brevet suisse issue de la transformation remonte à plus de deux ans, les annuités exigibles doivent être payées dans les six mois suivant l'invitation de l'Institut; si le paiement est effectué dans les trois derniers mois, une surtaxe sera perçue.

Annuités

Art. 118a. Le brevet européen donne lieu chaque année au paiement par avance d'annuités perçues par l'Institut; le premier paiement est dû pour l'année qui, à compter du dépôt de la demande, suit celle au cours de laquelle la délivrance du brevet européen a été mentionnée dans le Bulletin européen des brevets.

TITRE HUITIÈME
DEMANDES INTERNATIONALES DE BREVET

Chapitre premier
Champ d'application de l'ordonnance

Art. 119. - 1 Le présent titre s'applique aux demandes internationales de brevet pour lesquelles l'Institut agit en tant qu'Institut récepteur, Institut désigné ou Institut élu.

2 Les autres dispositions de la présente ordonnance sont également applicables, à moins que l'article 131 de la loi ou le présent titre n'en disposent autrement.

Chapitre 2
L'Institut en tant qu'Institut récepteur

Dépôt de la demande internationale

Art. 120. La demande internationale déposée auprès de l'Institut doit être rédigée dans une langue officielle suisse constituant une langue de travail de l'administration chargée de la recherche internationale, compétente pour la Suisse. L'Institut indique ces langues dans la Feuille suisse des brevets, dessins et marques.

Taxe de transmission et taxe de recherche

Art. 121. - 1 La taxe de transmission (art. 133, 2e al., de la loi) doit être payée à l'Institut dans le mois qui suit la réception de la demande internationale.

2 Le 1er alinéa s'applique par analogie à la taxe de recherche, dont le montant est fixé d'après l'accord conclu avec l'administration chargée de la recherche internationale, compétente pour la Suisse. L'Institut indique dans la Feuille suisse des brevets, dessins et marques le montant de la taxe de recherche fixé par l'autorité internationale.

Taxe internationale; autres taxes de désignation et taxe de confirmation

Art. 122. - 1 La taxe internationale, comprenant une taxe de base et des taxes de désignation selon la règle 15.1 ii) du règlement d'exécution du 19 juin 1970 du Traité de coopération en matière de brevets (règlement d'exécution du traité de coopération), doit être payée à l'Institut.

2 L'article 121, 1er alinéa, s'applique par analogie au paiement de la taxe de base.

3 Les taxes de désignation selon la règle 15.1 ii) du règlement d'exécution du traité de coopération doivent être payées dans les douze mois qui suivent la date de dépôt ou la date de priorité. Si la demande internationale contient une revendication de priorité, ces taxes peuvent encore être payées dans le mois suivant le dépôt lorsque ce délai expire plus tard.

4 Les taxes de désignation et la taxe de confirmation selon la règle 15.5, lettre a), du règlement d'exécution du traité de coopération doivent être payées à l'Institut dans les quinze mois qui suivent la date de dépôt ou la date de priorité.

5 Les montants de ces taxes sont ceux qui figurent au barème de taxes du règlement d'exécution du traité de coopération.

Invitation au paiement

Art. 122a. - 1 Lorsque ne sont pas payées à temps la taxe de transmission, la taxe de base, la taxe de recherche ainsi que les taxes de désignation selon la règle 15.1 ii) du règlement d'exécution du traité de coopération, l'Institut impartit au requérant un délai d'un mois pour payer le montant dû ainsi qu'une taxe pour paiement tardif selon la règle 16bis. 2 du règlement d'exécution du traité de coopération.

2 En cas de non-paiement ou de paiement partiel pendant ce délai, la demande internationale ou les désignations des pays pour lesquels la taxe n'a pas été payée sont considérées comme retirées.

Chapitre 3
L'Institut en tant qu'Institut désigné

Traduction des revendications

Art. 123. L'article 116, 1er, 3e et 4e alinéas, s'applique par analogie à la traduction des revendications de la demande internationale publiée, pour laquelle l'Institut est l'Institut désigné (art. 137 de la loi).

Conditions de forme

Art. 124. - 1 Lorsque, pour la demande internationale, la traduction ou la mention de l'inventeur n'est pas produite à temps ou que la taxe nationale de dépôt n'est pas payée dans les délais (art. 138 de la loi), la demande internationale est considérée comme retirée en ce qui concerne la Suisse.

2 Le requérant qui n'a ni son domicile ni son siège en Suisse doit désigner un mandataire dans les vingt mois suivant la date de dépôt ou de priorité. Lorsque la Suisse a été élue avant la fin du dix-neuvième mois à compter de la date de dépôt ou de la date de priorité, le délai est de trente mois.

2bis Si les délais fixés au 2e alinéa ne sont pas observés, l'Institut impartit au requérant un délai supplémentaire d'un mois pour désigner un mandataire.

3 Si le document de priorité n'a pas été produit auprès de l'Institut récepteur ou du Bureau international dans les seize mois suivant la date de priorité, le droit de priorité s'éteint.

4 L'article 52, 4e alinéa, s'applique par analogie lorsque le document de priorité n'est pas rédigé dans une langue officielle suisse ou en anglais.

Rapport de recherche

Art. 125. - 1 Si la demande internationale est soumise à l'examen préalable et que le rapport de recherche internationale émane de l'administration chargée de la recherche internationale, compétente pour la Suisse, la recherche sur l'état de la technique n'est pas complétée.

2 Un rapport complémentaire sur l'état de la technique (art. 139, 2e al., de la loi) est établi:

a. Lorsque la recherche internationale n'a pas été effectuée pour toutes les revendications;

b. Lorsque le rapport de recherche internationale n'a pas été établi par l'administration compétente pour la Suisse, et qu'il ressort du rapport que la recherche a été moins étendue;

c. Lorsque, à la suite d'un report de date, une recherche additionnelle est devenue nécessaire (art. 60, 3e al.).

3 La taxe de recherche pour le rapport complémentaire doit être payée dans les deux mois qui suivent l'invitation de l'examinateur.

4 Pour le surplus, les articles 55 à 60 s'appliquent par analogie.

L'Institut en tant qu'institut élu

Traduction des annexes du rapport d'examen préliminaire international

Art. 125a. - 1 Dans les cas où une traduction doit être remise en vertu de l'article 138, 1er alinéa, lettre c, de la loi, les annexes du rapport d'examen préliminaire international doivent être traduites dans la même langue officielle suisse que celle de la demande internationale dans un délai de 30 mois suivant la date de dépôt ou de priorité.

2 Si le délai fixé au 1er alinéa n'est pas observé, l'Institut impartit au requérant un délai supplémentaire de deux mois. Si ce délai supplémentaire n'est pas observé, l'Institut déclare la demande irrecevable.

Contenu et consultation du dossier

Art. 125b. - 1 Le dossier d'une demande internationale contient, outre le contenu prévu à l'article 89, le rapport d'examen préliminaire international.

2 Dès que la demande internationale est entrée en phase nationale, le dossier peut être consulté librement.

TITRE NEUVIÈME
RECHERCHES DE TYPE INTERNATIONAL

Conditions

Art. 126. - 1 Une recherche de type international au sens de l'article 15, 5e alinéa, du traité de coopération peut être requise pour une demande de brevet suisse.

2 La requête doit être présentée à l'Institut dans les six mois qui suivent la date de dépôt. La taxe pour une recherche de type international, dont le montant est fixé par l'administration chargée de la recherche internationale, compétente pour la Suisse, doit être payée en même temps.

3 Si la Langue dans laquelle est rédigée la demande de brevet n'est pas une langue de travail de l'administration chargée de la recherche internationale, compétente pour la Suisse, une traduction dans une langue de travail doit être présentée simultanément.

4 L'Institut n'examine pas si la demande de brevet et la traduction satisfont aux autres conditions fixées dans le traité de coopération, notamment aux prescriptions de forme valables pour les demandes internationales.

5 La recherche de type international est effectuée sur la base de pièces techniques modifiées si:

a. Le requérant en a fait la demande dans les six mois ayant suivi la date de dépôt;

b. Les pièces techniques modifiées ont été présentées à l'Institut dans les six mois ayant suivi la date de dépôt;

c. Les pièces techniques modifiées remplissent les conditions fixées aux articles 51 et 64;

d. Le requérant a demandé que l'examen quant au fond soit effectué selon la procédure accélérée et l'Institut a fixé la date de dépôt déterminante pour la recherche.

6 Après la présentation de la requête pour l'exécution d'une recherche de type international au sens des 1er à 5e alinéas, des modifications des pièces techniques ne peuvent plus être prises en considération pour l'exécution de la recherche demandée.

Procédure

Art. 127. - 1 Si les conditions prévues à l'article 126, 1er à 3e alinéas, sont remplies, l'Institut transmet les documents

requis à l'administration chargée de la recherche internationale, qui est compétente.

2 L'Institut adresse au requérant le rapport de recherche avec une copie des documents qui y sont mentionnés; une copie est versée au dossier de la demande de brevet.

TITRE DIXIÈME
CERTIFICATS COMPLÉMENTAIRES DE PROTECTION POUR LES MÉDICAMENTS

Chapitre premier
Champ d'application

Art. 127a. - 1 Le présent titre s'applique aux certificats complémentaires de protection pour les médicaments.

2 Les autres dispositions de la présente ordonnance sont applicables à moins que le titre septième de la loi ou le présent titre n'en disposent autrement.

Chapitre 2
Demande de certificat

Demande; taxe

Art. 127b. - 1 La demande doit contenir:

a. Une requête en délivrance du certificat;

b. Une copie de la première autorisation officielle de mise sur le marché en Suisse, y compris:

1. Une copie de l'attestation d'enregistrement;

2. Une copie de l'information concernant le médicament telle qu'elle a été autorisée par l'autorité compétente;

c. Le cas échéant, la procuration du mandataire.

2 La taxe de dépôt doit être payée dans le délai fixé par l'Institut.

Contenu de la requête

Art. 127c. La requête en délivrance du certificat doit contenir les indications suivantes:

a. Le nom ou la raison sociale du requérant ainsi que son adresse;

b. Le cas échéant, le nom et l'adresse du mandataire;

c. Le numéro du brevet sur lequel se fonde la demande (brevet de base);

d. Le titre de l'invention protégée par le brevet de base;

e. La date de la première autorisation officielle de mise sur le marché du produit en Suisse;

f. Une identification du produit désigné par l'autorisation de mise sur le marché ainsi que son numéro d'enregistrement;

g. La signature du requérant ou de son mandataire.

Publication d'une mention de la demande

Art. 127d. - 1 Une mention de la demande est publiée.

2 Les indications suivantes sont publiées:

a. Le nom ou la raison sociale du requérant ainsi que son adresse;

b. Le cas échéant, le nom et l'adresse du mandataire;

c. La date de dépôt de la demande;

d. Le numéro du brevet de base;

e. Le titre de l'invention protégée par le brevet de base;

f. La date de la première autorisation officielle de mise sur le marché du produit en Suisse;

g. Une désignation du produit couvert par l'autorisation ainsi que son numéro d'enregistrement.

3 La publication a lieu après la conclusion de l'examen selon l'article 127e.

Chapitre 3
Examen de la demande

Examen lors du dépôt de la demande

Art. 127e. - 1 Lorsqu'il reçoit la demande, l'Institut examine si elle a été déposée dans le délai requis et si elle remplit les conditions fixées aux articles 127b et 127c.

2 Si la demande ne remplit pas les conditions fixées au 1er alinéa, l'Institut impartit au requérant un délai de deux mois pour la compléter.

3 Si ce délai n'est pas observé, l'Institut déclare la demande irrecevable.

Examen des conditions de délivrance du certificat

Art. 127f. - 1 L'Institut examine si les conditions requises pour la délivrance du certificat (art. 140a, 2e al., et 140b de la loi) sont remplies.

2 Si ces conditions ne sont pas remplies, l'Institut rejette la demande.

Chapitre 4
Délivrance du certificat

Art. 127g. - 1 Si les conditions requises pour la délivrance du certificat sont remplies, l'Institut délivre le certificat en l'inscrivant au registre des brevets.

2 La délivrance du certificat est publiée avec les indications suivantes:

a. Le numéro du brevet de base pourvu d'une adjonction;

b. Le nom ou la raison sociale du titulaire du certificat ainsi que son adresse;

c. Le cas échéant, le nom et l'adresse du mandataire;

d. La date de dépôt de la demande;

e. Le numéro du brevet de base;

f. Le titre de l'invention protégée par le brevet de base;

g. La date de la première autorisation officielle de mise sur le marché du produit en Suisse;

h. Une désignation du produit couvert par l'autorisation ainsi que son numéro d'enregistrement;

i. La date d'expiration de la durée de protection du certificat.

Chapitre 5
Publication du rejet de la demande de certificat, de l'extinction prématurée du certificat, de sa nullité et de sa suspension

Art. 127h. - 1 Le rejet de la demande de certificat, l'extinction prématurée du certificat, sa nullité et sa suspension sont publiés.

2 Les indications suivantes sont publiées:

a. Le numéro du brevet de base pourvu d'une adjonction, sauf en cas de rejet de la demande de certificat;

b. Le nom ou la raison sociale du requérant ou du titulaire du certificat ainsi que son adresse;

c. Le numéro du brevet de base;

d. Le titre de l'invention protégée par le brevet de base;

e. La date de la première autorisation officielle de mise sur le marché du produit en Suisse;

f. Une désignation du produit couvert par l'autorisation ainsi que son numéro d'enregistrement;

g. La date du rejet de la demande de certificat, de l'extinction prématurée du certificat, de sa nullité ou de sa suspension.

Chapitre 6
Dossier et registre

Dossier

Art. 127i. - 1 Le dossier concernant le certificat est annexé au dossier du brevet de base.

2 Le dossier du certificat peut être consulté librement.

3 Le certificat reçoit le numéro du brevet de base pourvu d'une adjonction.

Registre

Art. 127k. - 1 Les inscriptions concernant le certificat figurent sur la feuille du registre se rapportant au brevet de base.

2 Les indications suivantes doivent y figurer:

a. Le numéro du brevet de base pourvu d'une adjonction;

b. Le nom ou la raison sociale du titulaire du certificat ainsi que son adresse;

c. Le cas échéant, le nom et l'adresse du mandataire;

d. La date de dépôt de la demande;

e. Le numéro du brevet de base;

f. Le titre de l'invention protégée par le brevet de base;

g. La date de la première autorisation officielle de mise sur le marché du produit en Suisse;

h. Une désignation du produit couvert par l'autorisation ainsi que son numéro d'enregistrement;

i. La date de délivrance du certificat;

k. La date d'expiration de la durée de protection du certificat;

l. Les droits concédés, de même que les restrictions au droit de disposer ordonnées par des tribunaux ou des autorités chargées de l'exécution forcée;

m. Les modifications relatives à l'existence du certificat ou au droit au certificat;

n. Les changements de domicile ou de siège social du titulaire du certificat;

o. Les changements de mandataire ou de son domicile ou siège.

3 L'Institut peut inscrire provisoirement ou définitivement d'autres indications jugées utiles.

4 Les inscriptions concernant des droits concédés sur le brevet de base, de même que les restrictions au droit de disposer du brevet ordonnées par des tribunaux ou des autorités chargées de l'exécution forcée, sont présumées valables pour le certificat dans la même mesure que pour le brevet de base.

Chapitre 7
Taxes

Annuités

Art. 127l. Lorsque l'annuité à payer ne porte pas sur une année entière, son montant équivaut, pour chaque mois entier ou commencé de la durée du certificat, à un douzième de l'annuité qui serait due pour l'année en question, arrondi au franc supérieur.

Remboursement des annuités

Art. 127m. - 1 En cas de nullité du certificat, les annuités sont remboursées pour la durée qui s'est écoulée entre le moment de l'entrée en force de chose jugée de la constatation de la nullité et la date à laquelle le certificat aurait expiré.

2 En cas de renonciation au certificat, les annuités sont remboursées au prorata de la durée du certificat pour laquelle le titulaire a renoncé au certificat.

3 Lorsque l'autorisation officielle de mise sur le marché d'un produit est révoquée, les annuités sont remboursées au prorata de la durée du certificat pour laquelle l'autorisation est révoquée.

4 Lorsque l'autorisation officielle de mise sur le marché d'un produit est suspendue, les annuités sont remboursées au prorata de la période pendant laquelle l'autorisation est suspendue.

5 Dans tous ces cas, seules sont remboursées les annuités entières.

6 Le remboursement n'est effectué que sur demande; celle-ci doit être présentée dans les deux mois à compter de:

a. La constatation de la nullité du certificat;

b. La renonciation au certificat;

c. La révocation de l'autorisation officielle selon le 3e alinéa;

d. La fin de la suspension de l'autorisation officielle selon le 4e alinéa.

TITRE ONZIÈME
DISPOSITIONS FINALES

Chapitre premier
Abrogation du droit en vigueur

Art. 128. L'ordonnance (1) du 14 décembre 1959 et l'ordonnance (2) du 8 septembre 1959 relatives à la loi fédérale sur les brevets d'invention sont abrogées.

Chapitre 2
Dispositions transitoires

Délais

Art. 129. Les délais qui ont commencé à courir avant le 1er janvier 1978 demeurent inchangés.

Taxes

Art. 130. - 1 Le montant des annuités exigibles à partir du 1er janvier 1978 est déterminé par le nouveau droit, même si ces annuités ont été payées avant cette date.

2 Pour les demandes de brevet dont la date de dépôt est de plus de deux ans antérieure au 1er janvier 1978, les annuités doivent être payées, conformément au nouveau droit, dans les six mois suivant l'invitation de l'Institut.

3 Le 2e alinéa s'applique par analogie aux demandes de brevet additionnel à un brevet principal, dont la transformation est requise après le 1er janvier 1978.

Demandes de brevet additionnel

Art. 131. Les demandes de brevet additionnel pendantes le 1er janvier 1978, subordonnées à des demandes de brevet également pendantes sont, à compter de cette date, considérées comme des demandes indépendantes.

Mention de l'inventeur

Art 132. Si, pour une demande de brevet pendante le 1er janvier 1978, l'inventeur n'est pas encore mentionné, il doit l'être dans un délai de trois mois à compter de l'invitation de l'Institut ou, si le délai prévu à l'article 35, 1er alinéa, expire plus tard, dans ce délai.

Priorité

Art. 133. - 1 Les déclarations de priorité se rapportant aux demandes de brevet pendantes le 1er janvier 1978 peuvent être produites jusqu'au 31 mars 1978.

2 Pour les demandes de brevet pendantes le 1er janvier 1978, les documents de priorité ainsi que les indications manquantes concernant le numéro du premier dépôt doivent, sur invitation de l'Institut, être produits dans les trois mois ou, si le délai prévu à l'article 40, 4e alinéa, expire plus tard, dans ce délai.

3 Les 1er et 2e alinéas ne s'appliquent pas lorsque, selon le droit antérieur, le délai pour la remise de la déclaration de priorité ou pour la production du document de priorité est arrivé à expiration ou a commencé à courir avant le 1er janvier 1978.

Consultation des dossiers

Art. 134. Les dossiers des brevets délivrés avant le 1er janvier 1978 ne pourront être consultés conformément à l'article 90, 3e alinéa, qu'après la publication des fascicules de brevets.

Chapitre 3
Entrée en vigueur

Art. 135. - 1 La présente ordonnance entre en vigueur le 1er janvier 1978, à l'exception des titres septième, huitième et neuvième.

2 Le titre septième entre en vigueur le 1er juin 1978.

3 Les titres huitième et neuvième entrent en vigueur en même temps que le titre sixième de la loi (demandes internationales de brevet).

Dispositions finales de la modification du 12 août 1986

1 Les demandes de brevet pendantes le jour de l'entrée en vigueur du nouveau droit sont régies par ce dernier.

2 Toutefois, les requêtes déposées avant le jour de l'entrée en vigueur, ne pourront faire l'objet de notifications de la part de l'Institut lorsqu'elles satisfont aux prescriptions de l'ancien droit; l'Institut peut cependant demander les renseignements au sens des articles 64, 1er alinéa, et 65, 1er alinéa.

3 Les communications de l'Institut selon l'ancien droit, expédiées avant le jour de l'entrée en vigueur, restent valables, avec les conséquences qu'elles indiquent.

4 Les délais impartis par l'Institut qui ont commencé à courir avant le jour de l'entrée en vigueur ne sont pas modifiés.

5 Si l'examen de la demande de brevet a pris fin avant le jour de l'entrée en vigueur, la procédure se poursuit selon l'ancien droit jusqu'à la publication de la demande de brevet ou la délivrance du brevet.

Part I: General Provisions

Chapter 1: Relations with the Federal Intellectual Property Office

(Competence)

1. The Federal Intellectual Property Office (hereinafter referred to as “the Office”) shall carry out the administrative operations arising from the Law.1

2. — (1) For material sent by mail from Switzerland, the mailing date shall be regarded as the date of

submission. Proof thereof shall be constituted by the postmark affixed by the post office of consignment, or by the postmark of the receiving post office where that of the post office of consignment is missing or illegible; if the postmark of the receiving post office is also missing or illegible, the date of receipt of the material by the Office shall be regarded as the date of submission. The sender shall be allowed to prove an earlier date of submission.

(2) For material sent by mail from abroad, the date to be taken into consideration shall be that of the first postmark affixed by a Swiss post office; if that postmark is missing or illegible, the date of receipt of the material by the Office shall be regarded as the date of submission. The sender shall be allowed to prove an earlier date of receipt by a Swiss post office.

(Signature)

3. — (1) Any communication that is to be made in writing to the Office must bear a valid signature. (2) In the absence of a signature, the submission date of the unsigned written matter shall be

recognized on condition that, at the request of the Office, the defect is remedied within 14 days.

(Language)

4. — (1) Written matter sent to the Office shall be in French, German or Italian (official languages). (2) The official language chosen by the applicant at the time of filing shall be the language in which

the procedure takes place. (3) The language originally chosen for the drafting of the technical documents shall be maintained.

Changes made to those documents in another language shall not be allowed. This rule shall apply also to partial renunciation (Section 24 of the Law).

(4) Where other written matter is not submitted in the language adopted for the procedure, a translation into that language may be demanded.

(5) Documents submitted as proof that are not in an official language shall not be taken into consideration unless they are accompanied by a translation in an official language. Sections 40(2), 45(3) and 75(3) are reserved.

(6) Where a translation of a document has to be produced, it may be required that its accuracy be certified within a term specified for the purpose. If such certification is not submitted, the document shall be regarded as not having been filed.

(7) Where the documents relating to a divisional application or to a request for the constitution of a new patent (Sections 25, 27, 30 and 57 of the Law) are not written in the same language as the original patent application or patent, the Office shall allow the patent applicant or patent owner a term by the expiration of which a translation in that language has to be produced.

(More than One Applicant)

5. —

(1) Where two or more persons are joint owners of a patent application, they shall designate from among themselves the person to whom the Office may send all communications, such comminications being applicable to all of them, or shall appoint a common agent.

(2) Where neither of these conditions is met, the person mentioned first in the application shall be regarded as the recipient of communications within the meaning of subsection (1). Where one of the other persons raises an objection, the Office shall invite all those concerned to act in accordance with subsection (1).

(Impossibility of Delivering a Communication)

6.— (1) Where the address of the applicant or that of the agent is not sufficient for an official

communication to reach its recipient, the Office shall endeavor to obtain the exact address. (2) If this endeavor is without result, or if the recipient has not taken possession of material mailed

to the exact address, the consequences of failure to observe the terms specified in the communications shall nevertheless apply. If the communication contains a decision, that decision shall be notified through publication in the Swiss Journal of Patents, Designs and Marks.

(Succession)

7. In the event of the death of the applicant, the Office shall give the heirs known to it a term within which to settle the matter of the succession to the patent application; it may extend this term as appropriate.

Chapter 2: Representation

(Relation of the Office with the Agent)

8.— (1) Insofar as the patent applicant or the patent owner has an agent, the Office shall, in general, not

accept either communications or written requests from the mandator, with the exception of revocation of the power of attorney, withdrawal of the patent application and renunciation of the patent. (2) The agent shall remain authorized to receive such documents and fees as are returned by the Office.

(Right of Representation)

9.— (1) In addition to natural persons domiciled in Switzerland, corporations that have their

headquarters in Switzerland may be designated as agents in dealings with the Office. (2) If the professional conduct of an agent gives rise to complaint, the Federal Department of

Justice and Police may, after having heard the agent, either: (a) give him a warning; (b) authorize the Office to exclude him either temporarily or permanently from the exercise

of this activity; (c) order the publication of the above measures.

(3) In order to judge professional conduct for the purposes of subsection (2), account shall be taken of the entire business activity of the agent, both in Switzerland and abroad.

(4) In general, the Office shall not be authorized to exclude an agent unless a prior warning has proved to be without effect.

Chapter 3: Terms

(Calculation)

10.— (1) Where a term initiated by a communication by the Office is calculated in days and where its

duration is specified in the Law or in this Ordinance, that term shall start on the day following its notification.

(2) Where a term the duration of which is specified in the Law or in this Ordinance is calculated in months or years, the calculation shall be made in the following manner:

(a) the term shall start on the day following the day on which the event that sets it in motion occurs;

(b) where that day is the last day of the month, the term shall end on the last day of the month during which it expires. (3) Other terms shall be specified by the indication of the date of their expiration. The dates

between July 15 and August 16 may not constitute expiration dates. (4) Where the last day of the term is a Saturday, a Sunday or another day on which the Office is

closed, or a day regarded as an official public holiday at the applicant's domicile in Switzerland or at his agent's domicile or headquarters, the term shall expire on the following working day.

(5) Where a term is counted from the priority date and where several priorities are claimed, the earliest priority date shall be decisive.

(Duration)

11.— (1) The terms set in the course of the examination procedure shall be determined in relation to the

probable amount of work of the applicant. They shall be not less than two months and not more than five months.

(2) Section 74(2) shall apply to the opposition procedure.

(Extension Terms)

12.— (1) Terms of a duration specified in the Law or in this Ordinance may not be extended. (2) Other terms shall be extended:

(a) in the examination procedure, once for a month, where the appropriate fee is paid prior to the expiration of the term, and a second time for a maximum of three months, where a reasoned request is submitted and the fee, increased by one-half, is paid prior to the expiration of the extended term;

(b) in other cases, where the person requesting extension produces sufficient reasons prior to the expiration of the term. (3) A term shall not be suspended by requests for further details, except where the reply from the

Office implies the contrary. (4) Section 74(2) shall apply to the opposition procedure.

(Consequences of Failure to Observe a Time Limit)

13.— (1) Failure to observe a time limit shall cause the application to be rejected by the Office, except

where the Law or this Ordinance provides for other consequences. (2) Any communication that specifies a time limit shall indicate the consequences of failure to

observe that time limit. (3) Failure to observe a time limit may only have consequences that have been indicated.

(Continuation of the Procedure)

14.— (1) Where a patent application has been rejected for failure to observe a time limit within the

meaning of subsection (2), such rejection shall be cancelled if the continuation of the procedure is requested. (2) Such a request shall be accepted only if one of the following time limits has not been observed:

(a) time limits the duration of which is fixed by the Office; (b) time limits for the payment of application fees, printing fees, search fees or examination

fees; (c) time limit for furnishing the mention of the inventor.

(3) The request for continuation of the procedure shall be filed in writing within two months following notification of the decision to reject; at the same time, the omitted act must be fully executed, the patent application supplemented and the fee for continuation of the procedure paid.

(4) Subsections (1) to (3) shall apply mutatis mutandis to the rejection of a declaration of partial renunciation or to the rejection of a request for the constitution of a new patent.

(Restoration to Prior State)

a. Form and Contents of the Application

15.— (1) The request for restoration to the prior state (Section 47 of the Law) shall be submitted in

writing. It shall contain a statement of the facts on which it is based and, in particular, the dates of the beginning and end of the preventive circumstances. At the same time, the unperformed act shall be fully performed. If one of these conditions is not met, the request for restoration shall not be taken into consideration.

(2) The restoration fee shall be paid.

b. Examination of the Request

16.— (1) If the restoration fee has not been paid at the time of filing the request, the Office shall allow the

applicant an additional period of one month in which to do so. (2) If the facts stated in support of the request are not substantiated, the Office shall allow the

applicant a period in which to remedy this defect. If the reasons given are insufficient, it shall reject the request.

(3) If the request is accepted, the restoration fee may be repaid to the applicant either in full or in part.

Chapter 4: Fees

(Ordinance on Fees)

17. The amount of the fees provided for in the Law and in this Ordinance, and the procedure for their payment, shall be governed by the Ordinance of October 19, 1977, on the Fees of the Federal Intellectual Property Office.

(Annual Fees)

18.— (1) The patent applicant or patent owner alone shall be responsible to the Office for the payment of

annual fees.

(2) The Office shall draw the attention of the patent applicant or patent owner to the fact that an annual fee is due, and shall inform him of the time limit for payment as well as the consequences of failure to observe that time limit. At the request of the patent applicant or patent owner, the Office may also send notification to third parties who regularly effect payments on behalf of the patent applicant or patent owner. No notification shall be sent abroad.

(3) The Confederation shall not be liable for damages resulting from failure to send notification. (4) A patent application in respect of which an annual fee due has not been paid in time shall be

rejected; a patent in respect of which an annual fee due has not been paid in time shall be struck off the Register.

(5) The Office shall strike off the patent with effect from the date on which the unpaid annual fee was due; where the patent is not granted until after that date, it shall be struck off with effect from the date of such grant. The owner shall be notified that his patent has been struck off.

(6) Annual fees may not be paid more than one year prior to their falling due. If the Office strikes off a patent, it shall repay any annual fee that has not yet fallen due.

(Respite)

19.— (1) Any person who wishes to benefit from a respite within the meaning of Section 44 of the Law

shall make the appropriate request in writing and shall attach to it a certified extract from the Tax Register, or any other appropriate official certificate, establishing his state of indigence.

(2) If the official certificate is considered insufficient, the Office shall allow the applicant a period within which to remedy this defect.

(3) The request for respite shall have no staying effect. (4) The respite shall lapse when the patent application or patent is assigned to a third party. The

Office shall allow the registered new applicant or patent owner a period of six months for the payment of all the fees to which the respite applies; a surcharge shall be collected when payment is effected during the last three months of that period. If the time limit for payment is not observed, the Office shall reject the patent application or cancel the patent with effect from the date of the formal notice to pay.

(Repayment)

20. When the patent application is entirely withdrawn or rejected, the Office shall repay the following fees:

(a) any annual fee paid in advance and not yet due; (b) the printing fee, if the Office has not yet ordered the printing of the patent specification or

application specification; (c) the search fee and examination fee, under the conditions set forth in Sections 59 and 61.

Part II: Patent Application

Chapter 1: General

(Documents Required. Fees)

21.— (1) The following shall be produced on the filing date of the application:

(a) the request for the grant of a patent; (b) the description of the invention; (c) one or more claims; (d) the drawings to which the description or claims refer.

(2) The following shall be produced or paid, as the case may be, on the filing date, or not later than within the period specified:

(a) the application fee, and the claim fees, if any; (b) the abstract; (c) two additional copies of the technical documents; (d) the power of attorney of the agent, if any; (e) the search fee and examination fee, if any.

(3) The following shall be produced on the filing date of the application, or not later than 16 months following the filing date of the application or the priority date:

(a) the indication of the name of the inventor; (b) the priority document, if any.

(4) The printing fee shall be paid within one month of the completion of the examination. (5) The following shall be paid as from the third year following the filing date: the annual fees.

(Correction of Errors)

22.— (1) Errors in meaning or transcription and errors contained in the application documents may be

corrected on request or ex officio; Sections 37 and 52(3) to (5) are reserved. (2) Correction of the description, claims or drawings shall not be allowed unless it is obvious that

the incorrect part had no other possible meaning.

Chapter 2: Requests for the Grant of a Patent

(Form)

23. The request shall be submitted on the form supplied free of charge by the Office.

(Contents)

24.— (1) The request shall contain the following particulars:

(a) the request for the grant of a patent; (b) the title of the invention (Section 26(1)); (c) the surname and given name or corporate name or business style, the domicile or

headquarters and the address of the applicant; (d) an inventory of the documents submitted and fees paid to the Office; (e) the signature of the applicant or his agent.

(2) The request shall also contain: (a) when an agent has been appointed, the name, domicile or headquarters and address of the

agent; (b) where there are two or more applicants, the designation of the addressee; (c) where the application is a divisional application, its designation as such and the number

of the initial application and the filing date claimed; (d) when priority is claimed, the declaration of priority (Section 39); (e) when immunity derived from an exhibition is alleged, a declaration to that effect

(Section 44).

Chapter 3: Technical Documents

(General)

25.— (1) The description of the invention, the claims, the drawings and the abstract shall constitute the

technical documents. The beginning of each of these parts shall appear on a new leaf. (2) The technical documents shall be produced in triplicate. (3) They must be capable of being reproduced directly. The leaves must not be folded and only one

side of them shall be used. (4) They shall be submitted on light, white, smooth, matt, durable paper of A4 format (21 x

29.7 cm). (5) The pages of the text shall leave an empty margin on the left-hand side of at least 2.5 cm; the

other margins should be 2 cm. (6) All the sheets shall be numbered in Arabic figures. (7) The pages shall be typewritten or printed. Symbols and other signs and chemical or

mathematical formulae may be written by hand or drawn. The spacing between lines must be at least 1 1/2. The type face shall be chosen in such a way that the capital letters are at least 0.21 cm high. The type must be indelible.

(8) The description, claims and abstract shall not contain any drawings. (9) Units of measurement shall be expressed in accordance with the Federal Law on Metrology of

June 9, 1977; other units of measurement may be used for additional information. In the case of mathematical and chemical formulae, the symbols generally accepted in the field concerned should be used.

(10) In general, use shall be made only of technical terms, signs and symbols that are generally accepted in the field concerned. The terminology and signs used in the patent application shall be uniform.

(Description)

26.— (1) The description shall begin with a title that gives the invention a clear and concise technical

designation. The title shall not contain any fanciful denomination. (2) [Repealed.] (3) The introduction shall set out the invention in terms that allow the technical problem and its

solution to be understood. (4) The description shall contain a list of the figures included in the drawings and shall indicate

briefly the contents of each figure. (5) It shall contain at least one example of the execution of the invention, except where it is

sufficiently described in another manner. (6) Insofar as this is not evident, the description shall explain how the subject matter of the

invention may be used industrially. (7) [Repealed.] (8) [Repealed.]

(Inventions in the Microbiological Field)

27.— (1) Where an invention concerning a microbiological process or a product obtained by such a

process entails the use or production of a microorganism to which the public does not have access and which cannot be described in the technical documents in such a way as to enable a person skilled in the art to carry out the invention, the applicant shall supplement the description of the invention by the reference in it to the deposit of a microorganism culture.

(2) The culture shall be deposited, not later than on the filing date of the application, with an institution recognized by the Office possessing a culture collection.

(3) The deposited culture shall form an integral part of the description by virtue of the fact that the description refers to it.

(4) The reference shall contain the following information: (a) the designation of the institution possessing the culture collection; (b) the date of deposit; (c) the serial number under which the culture is registered with the institution possessing the

culture collection. (5) When the reference is furnished within 16 months of the date of deposit or of priority, it shall be

deemed to have been furnished at that first date. (6) The release of samples of a culture to third parties may be made subject to the condition that

those third parties communicate to the institution possessing the culture collection their names and addresses for the information of the depositor and that they undertake:

(a) not to afford other persons access to the deposited culture or to a culture derived therefrom;

(b) not to use it outside the scope of the Law; (c) to prove, in the event of litigation, that they have not failed to honor their undertakings

under items (a) and (b).

(Drawings)

28.— (1) The usable surface of the leaves containing the drawings shall not exceed 17 x 26.2 cm, or be

framed. (2) The drawings shall be executed in indelible, even and well-defined lines, without colors or

washes; they must permit direct printing. (3) Cross sections shall be indicated by hatching, which must not affect the reading of reference

marks and the clarity of outlines. (4) The scale of the drawings and the graphic execution shall be such that all details may be readily

distinguished in a photographic reproduction. If the scale is indicated on a drawing, it must be represented graphically; other indications of size shall in general not be allowed.

(5) Numbers, letters and reference marks appearing on the drawings shall be simple and clear. (6) The reference marks used on the drawing shall correspond to those used in the description or

claims. (7) If necessary, the elements of a figure may be represented on several sheets, on condition that the

complete figure may be readily assembled by placing the sheets side by side. (8) The various figures shall be clearly separated from one another but arranged without loss of

space. They shall be numbered consecutively in Arabic figures, independently of the numbering of the sheets.

(9) The drawings shall not contain any textual matter; only short indications or keywords making the drawing more comprehensible and in the same language as the application shall be allowed.

(Claims)

29.— (1) The claims shall indicate the technical characteristics of the invention. (2) The claims shall be drafted as clearly and concisely as possible. (3) They shall be arranged in a systematic, clear and logical manner. (4) In general, they shall not contain references to the description or to the drawings or, in

particular, expressions like “as described in part... of the description” or “as illustrated in figure... of the drawings.”

(5) The reference marks which, in the drawings refer to the technical characteristics of the invention shall be repeated between brackets in the claims if the understanding of the claims is thereby facilitated. They shall not have the effect of limiting the claims.

(6) The claims shall be numbered consecutively in Arabic numerals.

(Independent Claims)

30.— (1) Where a patent application contains more than one independent claim, of the same or different

categories (Section 52 of the Law), the technical link expressing the general inventive concept should transpire from the claims themselves.

(2) This condition shall be deemed met, in particular, where the patent application contains one of the following combinations of independent claims:

(a) in addition to a first claim for a process: a claim for a means of implementing that process, a claim for the product resulting therefrom, and a claim for either an application of the process or a use of the product;

(b) in addition to a first claim for a product: a claim for a process for the manufacture of that product, a claim for a means of implementing the process and a claim for the use of the product;

(c) in addition to a first claim for a device: a claim for a process for the operation of the device and a claim for the manufacture of the device.

(Dependent Claims)

31.— (1) A dependent claim shall refer to at least one previous claim and contain the characteristics

identifying the special form of execution that constitutes its subject matter. (2) A dependent claim may refer to more than one previous claim on condition that such claims be

clearly and exhaustively enumerated. (3) All the dependent claims shall be grouped together in a clear manner.

(Form and Content of the Abstract)

32.— (1) The abstract shall contain the technical information whereby it may be ascertained whether the

patent specification or the application specification should be consulted. (2) The abstract shall contain a summary of the invention described and state the main uses of the

invention. (3) Where the technical documentation contains chemical formulae for characterizing the invention,

one at least of those formulae must be given in the abstract; its symbols must be explained. (4) Where the technical documentation contains drawings needed to characterize the invention, one

of those drawings at least should be designated for inclusion in the abstract; the most important reference signs given in that drawing will be shown in brackets in the abstract.

(5) Any figure selected must be capable of being reduced by photographic means. (6) The abstract shall not contain more than 150 words.

(Final Abstract)

33.— (1) The final wording of the abstract shall be decided upon ex officio. (2) [Repealed.]

Chapter 4: Mention of the Inventor

(Form)

34.— (1) The name of the inventor shall be mentioned in a separate text that shall contain only the

following particulars: (a) the name and given name and the address of the inventor; in the event of changes of civil

status, the previous name shall also be indicated; (b) the declaration by the applicant that no one else has, to his knowledge, contributed to the

invention; (c) if the applicant is not the inventor, or is not the only inventor, a declaration stating the

manner in which he acquired the right to the grant of the patent; (d) the title of the invention and, if known, the number of the patent application; (e) the name and the given name or corporate name or business style and the address of the

applicant. (2) [Repealed.] (3) If the mention of the inventor is not written in either an official language or in English, a

translation into one of those languages shall be attached.

(Time Limit)

35.— (1) If the mention of the inventor is not produced at the same time as the application, it may be filed

within a period of 16 months from the filing date or priority date. (2) The Office shall allow an applicant who files a divisional application (Section 57 of the Law) a

period of two months within which to produce the mention of the inventor, insofar as the time limit provided for in subsection (1) does not expire later.

(3) If the mention of the inventor is not produced in good time, the Office shall reject the patent application.

(Transmittal to the Inventor)

36. [Repealed.]

(Rectification)

37.— (1) The patent applicant or patent owner may request rectification of the mention of the inventor.

Such request shall be accompanied by a declaration of the consent of the person wrongly mentioned as the inventor, and the appropriate fee shall be paid.

(2) If the person wrongly mentioned as the inventor has already been registered in the Patent Register, the rectification shall also be registered and published.

(3) Once produced, the mention of the inventor shall not be returned.

(Renunciation of Mention)

38.— (1) The renunciation by the inventor of a mention in the Patent Register and in the publications of

the Office shall be taken into consideration only if the applicant files with the Office, prior to the end of the examination, a declaration of renunciation made by the inventor.

(2) The declaration shall indicate the title of the invention and the number of the patent application, if the latter is known; it shall also be dated and shall bear the authenticated signature of the inventor.

(3) Section 34(3) shall apply mutatis mutandis. (4) The declaration of renunciation meeting the requirements and the mention of the inventor shall

be filed separately; the existence of these documents shall be recorded in the file.

Chapter 5: Priority and Immunity Derived from an Exhibition

I. PRIORITY

(Priority Declaration)

39.— (1) The priority declaration shall include the following particulars:

(a) the filing date of the first application; (b) the country in which or in respect of which the application was filed; (c) the number of that application.

(2) The priority declaration, with the exception of the number, shall be produced together with the application for the grant of a patent, failing which the right of priority shall lapse.

(3) The number shall be indicated within the period allowed for the production of the priority document (Sections 40(4) and 43(3)) if it does not appear in that document.

(4) If a priority declaration has been produced in good time, other priority declarations (Section 42), relating to non-prior first applications, may be filed within three months following the filing date.

(Priority Document)

40.— (1) The priority document shall include:

(a) a copy of the technical document of the first application, the conformity of which with the original documents shall be certified by the authority with which the first application was filed.

(b) a certificate from that authority attesting to the filing date of the first application. (2) If the document is written neither in a Swiss official language nor in English, a translation

thereof shall be produced in one of those languages. (3) If the priority document has to serve for more than one patent application, it shall be sufficient

to file it for one patent application and refer to it in good time for the others. Reference to the priority document shall have the same effects as its actual filing.

(4) The priority document shall be produced within 16 months following the priority date. Failure to comply with the time limit shall cause the priority right to lapse (Section 19(2) of the Law); the right may be revived if, within two months of the official communication of lapse of the right, the priority document is furnished and a fee equal to the fee for continuation of the procedure (Section 14(3)) is paid.

(5) The certification referred to in subsection (1)(a) shall not be required when the first filing took place or produced its effects in one of the countries that grants reciprocity to Switzerland; the right of the Office to demand certification for the purposes of the examination as to substance is reserved.

(Additional Priority Documents)

41. If it is apparent from the priority document that the application on which the priority claimed is based constitutes only in part a first application within the meaning of the Paris Convention for the Protection of Industrial Property of March 20, 1883, the Office may demand the provision of such documents relating to prior applications as are necessary to clarify the facts.

(Multiple Priority)

42. Where separate applications for protection have been filed for more than one invention, those inventions being then grouped in Switzerland in a single patent application, as many priority declarations as there were applications may be filed, subject to the conditions specified in Section 17 of the Law.

(Priority in the Case of Divisional Applications)

43.— (1) In the case of a divisional application (Section 57 of the Law), the applicant may invoke a

priority that was validly claimed for the initial application if, to that end, he filed a priority declaration at the time of filing the divisional application.

(2) Where more than one priority has been claimed (Section 42), the applicant shall specify the priorities that relate to the divisional application.

(3) The Office shall allow the applicant a period of two months within which to produce the priority document (Section 40), insofar as the time limit provided for in Section 40(4) does not expire later.

II. IMMUNITY DERIVED FROM AN EXHIBITION

(Declaration of Immunity Derived from an Exhibition)

44.— (1) The declaration of immunity derived from an exhibition (Section 7b(b) of the Law) shall include

the following particulars: (a) the exact designation of the exhibition; (b) a declaration concerning the actual presentation of the invention.

(2) It shall be produced with the application for the grant of a patent, failing which the immunity derived from the exhibition shall lapse.

(3) Section 43(1) and (2) shall apply mutatis mutandis to divisional applications.

(Requisite Documents)

45.— (1) The documents concerning the immunity derived from an exhibition shall be filed within four

months following the date of filing. (2) These documents shall have been issued in the course of the exhibition by the competent

authority and shall contain the following particulars: (a) a certificate attesting that the invention actually was displayed; (b) the opening date of the exhibition; (c) the date of the first disclosure of the invention where it does not coincide with the

opening date; (d) a document, authenticated by the above-mentioned authority, whereby the invention may

be identified. (3) If these documents are not written in either an official language or English, a translation into

one of these languages shall be filed. (4) Section 43(3) shall apply mutatis mutandis to divisional applications.

Part III: Examination of the Patent Application

Chapter 1: Examination on Filing and Examination as to Form

I. EXAMINATION ON FILING

(Assignment of Filing Date)

46.— (1) The filing date shall be assigned to the patent application filed in an official language which

contains: (a) a request for the grant of the patent; (b) a description of the invention; (c) one or more claims; (d) the drawings to which the descriptions or claims refer; (e) indications whereby the applicant may be identified.

(2) The filing date shall also be assigned when the documents listed in subsection (1)(a) to (d) do not fully comply with the Law and the Ordinance.

(3) When the conditions laid down in subsection (1) are not met, the Office shall regard the application as not having been filed. It shall return the documents filed to the applicant, if he is identified, or shall give him the opportunity of meeting the conditions still required for the assignment of the filing date.

(4) If a drawing is missing, the Office shall invite the applicant to supply it or to request, for the purpose of ensuring the maintenance of the filing date, that the reference to the drawing concerned be regarded as not having been made.

(5) Once the filing date has been established, the Office shall issue a certificate of filing to the applicant.

(6) Where a divisional application is in conformity with Section 57(1)(a) and (b) of the Law, the Office shall allow the filing date claimed to stand as of right, as long as examination as to substance does not produce another conclusion.

II. EXAMINATION AS TO FORM

(Subject Matter of the Examination)

47. Once the filing date has been established as a result of the examination on filing, the Office shall examine:

(a) whether there is cause for an agent to be appointed (Section 48); (b) whether the filing fee and the claim fees, if any, have been paid (Sections 49 and 51(4)); (c) whether the technical documents are in conformity with the requirements that do not concern

their contents (Sections 50 and 51); (d) whether the other documents relating to the application have been filed in time and are in

conformity with the requirements (Section 52).

(Appointment of an Agent in the Case of Residence Abroad)

48. An applicant who has no domicile in Switzerland and who, at the time of filing the patent application, has not designated an agent shall be invited by the Office to indicate, within a month, the name, domicile or headquarters and address of his agent.

(Application Fee and Claim Fee)

49.— (1) If the application fee has not been paid at the time of filing of the patent application, the Office

shall invite the applicant to pay it within two months. (2) If the technical documents originally filed contain more than 10 claims, the Office shall invite

the applicant to pay the claim fees within the same period. In the event of failure to pay or partial payment, the supernumerary claims shall be deleted, starting from the last.

(Formal Defects in the Technical Documents)

50.— (1) Examination of the technical documents as to form shall relate only to:

(a) [repealed]; (b) the choice of the appropriate language (Section 4(3) and (7)); (c) the prescribed number of copies (Sections 25(2) and 51(3)); (d) the required presentation (Section 25(1) and (3) to (7) and Section 28(1) and (2));

(2) If the Office discovers a formal defect, it shall invite the applicant to remedy it.

(Amendments to the Technical Documents)

51.— (1) Amendments to the technical documents shall be allowed only if an indication is given of the

patent application to which they relate. (2) The letter accompanying the submission of the amendments shall be signed by the applicant or

his agent. (3) Amendments shall be submitted in duplicate. (4) If the amended technical documents contain more claims subject to payment of the fee than they

did prior to amendment, or more than 10 claims for the first time, the Office shall invite the applicant to pay the missing claim fees within a month. In the event of failure to pay or partial payment, the supernumerary claims shall be deleted, starting from the last. Claim fees due and paid shall not be refunded.

(Other Submissions Relating to the Application)

52.— (1) If the request for the grant of the patent has not been submitted on the prescribed form

(Section 23), the Office shall invite the applicant to do so. (2) Where the applicant has appointed an agent, the Office shall ascertain whether a power of

attorney in favor of that agent has been filed. If the power of attorney is missing, the Office shall invite the applicant to file one.

(3) If the designation of the inventor, submitted in good time, contains defects, the Office shall invite the applicant to remedy those defects.

(4) The Office shall invite the applicant to correct those of the defects in the priority declarations or priority documents, submitted in good time, that are susceptible of correction, and, if necessary, to produce the translation of the priority document (Section 40(2)) and of the documents relating to a prior application (Section 41). If the applicant does not comply with this request, the right of priority shall lapse.

(5) Subsection (4) shall apply mutatis mutandis to the declaration and other documents relating to the immunity derived from an exhibition (Sections 44 and 45).

Chapter 2: Decision on the Procedure for Examination as to Substance

(Sorting)

53.— (1) When, as a result of the examination on filing, the filing date has been established, the Office

shall notify the applicant: (a) either that the application will not be submitted to the examiner (Section 89 of the Law)

because it is clearly not subject to preliminary examination (Section 87(2) of the Law); (b) or that his application will be submitted to the examiner for a decision on whether or not

it is subject to examination. (2) At the request of the applicant who has received a notification under subsection (1)(a), the

patent application shall be submitted to the examiner for a decision on whether or not it is subject to examination.

(Decision Regarding Examination)

54.— (1) Where the patent application has been submitted to the examiner (Section 53(1)(b) or (2)), the

examiner shall make a ruling on the subject of examination. (2) Where the technical documents do not allow a decision to be taken according to subsection (1),

the examiner shall invite the applicant to remedy this defect. (3) Any opposition to the examiner's decision (Section 87(5) of the Law) shall be made in writing,

with a statement of reasons, within one month from the notification of the decision. (4) If the opposition is clearly unfounded, the examiner shall, in his decision on the opposition,

charge the cost of the procedure to the applicant. (5) The patent application finally declared subject to preliminary examination shall remain so, even

if the technical documents are subsequently amended.

Chapter 3: Search of the State of the Art in the Preliminary Examination Procedure

(Payment of the Search Fee)

55.— (1) At the same time as the decision is taken to submit the patent application to preliminary

examination, the applicant shall be invited to pay the search fee within two months. (2) If this decision is subject to opposition and subsequently confirmed, a new two-month time limit

for payment shall be afforded to the applicant. (3) Where, at the time of the decision, a request for postponement of the examination as to

substance (Section 62) has been filed or where such a request is filed during the period for payment, the said period for payment shall be extended until the expiration of the postponement. The Office shall inform the applicant accordingly but shall not send him any further reminder.

(Preliminary Examination)

56. Once the search fee has been paid, the examiner shall ascertain whether the patent application is such that a meaningful search of the state of the art may be made. If such is not the case, it shall invite the applicant to remedy the defects.

(Report on the State of the Art)

57.— (1) The examiner shall carry out the search of the state of the art on the basis of the documents at

his disposal at that time. (2) In order to carry out the search of the state of the art, the Office shall be authorized to enter into

cooperation agreements with other authorities or organizations. (3) The report on the state of the art shall list those of the documents to be taken into consideration

for the assessment of patentability that were available to the department responsible for the search (Section 1 of the Law).

(4) The report, together with copies of the documents mentioned in it, shall be sent to the applicant.

(Exemption from the Search Fee)

58.— (1) Exemption from the search fee shall be granted only if, before the applicant is invited to pay

(Section 55(1)) or, if postponement of the examination as to substance has been requested, one month before the expiration of the extended period for payment (Section 55(3)), the examiner already has a report on the state of the art in his possession which:

(a) comes from the search service for Swiss patent applications; and (b) on the basis of the same filing date or the same priority date, deals exhaustively with the

subject matter of the patent application. (2) Such a report may, in particular, relate:

(a) to the original patent application, in the case of a divisional application (Section 57 of the Law);

(b) to the first application the priority of which is claimed; (c) to another application, where the patent application is the first application the priority of

which is claimed for such other application.

(Repayment of the Search Fee)

59.— (1) The search fee shall be repaid in full:

(a) when the applicant supplies a report meeting the requirements set forth in Section 58(1) before the search of the state of the art is carried out (Section 57(1)); or

(b) when, for another reason, it is not necessary to determine the state of the art. (2) If the report referred to in subsection (1)(a) meets the requirements set forth in Section 58(1)

only in part, the amount saved by the Office on account of that report shall be repaid.

(Additional Search Fee)

60.— (1) Where the state of the art has not been determined for all the claims owing to a lack of unity in

the patent application (Sections 52 and 55 of the Law), the examiner shall invite the applicant to pay the additional search fees within two months; where the applicant is able to show that the application does not lack unity within the time limit for payment, the additional search fees shall be refunded to him.

(2) If the applicant does not comply with this invitation, the examiner shall reject the patent application insofar as the state of the art has not been established. The part concerned may, up to the entry into force of the rejection, be made the subject of a divisional application (Section 57 of the Law).

(3) If the filing date is postponed following the state-of-the-art search, the applicant shall be invited to pay an additional search fee within two months. Section 59(2) shall apply mutatis mutandis.

(Examination Fee)

61.— (1) When the search of the state of the art has been completed, the applicant shall be invited to pay

the examination fee within three months. (1bis) Where a request for postponement of examination as to substance (Section 62) has been

submitted at the time of the invitation under subsection (1) or where such request is submitted during the time limit for payment, the Office shall extend the time limit up to the end of the period of postponement.

(2) The examination fee shall be refunded if the patent application is withdrawn or rejected prior to a notification within the meaning of Section 68 or a communication within the meaning of Section 69(1) has been made.

Chapter 4: Examination as to Substance

I. GENERAL PROVISIONS

(Postponement of Examination)

62.— (1) The applicant may request that the examination as to substance be postponed by a maximum of

18 months from the filing date or priority date. (1bis) Where the applicant establishes, on the basis of a priority, that in addition to his Swiss patent

application he has submitted a corresponding application for a European patent in which he requests protection for the invention in Switzerland, he may request that the examination as to substance be deferred until the date specified by Section 125 of the Law. If the European patent application is definitively refused or withdrawn, or if the European patent is annulled, the examination as to substance shall be resumed.

(2) The requests under subsections (1) and (1bis) shall be submitted in writing; they shall not be taken into consideration until the postponement fee has been paid.

(3) These requests shall not stay any time limit already set, except where they have been extended under Sections 55(3) and 61(1bis).

(Rapid Procedure)

63.— (1) The applicant may request that the examination as to substance be carried out according to a

rapid procedure. (2) The request shall be submitted in writing; it will not be taken into consideration until a fee equal

to the postponement fee (Section 62(2)) has been paid.

(Amended Technical Documents)

64.— (1) Where the content of a claim has been amended or the claim is a new one, the applicant shall

state, at the request of the Office, the part of the patent application documentation in which the newly- defined subject matter was described for the first time.

(2) If it transpires, as a result of Section 52(2) that the filing date should be postponed to the date of submission of the amended documents, the applicant shall be allowed a period during which he may:

(a) either renounce the amendment that caused the date to be postponed, insofar as the description of the invention is not thereby affected;

(b) or provide proof that the invention is already described in the documents of the patent application file that were submitted earlier.

(3) If the applicant does not renounce the amendment or if he fails to dispose of the objections, the postponement of the filing date shall be pronounced, as well as the loss of the right of priority when the priority period is thereby exceeded.

(4) Once this decision has come into force, renunciation of the amendment shall not have the effect of restoring an earlier filing date.

(5) The repeated filing of amendments shall not hinder the normal course of the procedure. Applications for amendments that are not in conformity with this rule shall not be taken into consideration.

(Filing Date of Divisional Applications)

65.— (1) At the request of the Office, the applicant shall state the part of the documentation for the

previous application in which the subject matter defined in the divisional application was described for the first time.

(2) If it becomes apparent that the filing date provisionally assigned to a divisional application at the time of the examination carried out on filing (Section 46(6)) has been wrongly claimed, Section 64(2) to (4) shall apply mutatis mutandis.

(Classification)

66.— (1) Every patent application shall be classified according to the International Patent Classification

established by the Strasbourg Agreement of March 24, 1971. The applicant shall provide the necessary information to this end.

(2) The Office may amend the classification until the time of recording in the Patent Register.

II. PURPOSE AND COMPLETION OF EXAMINATION

(Procedure without Prior Examination)

67.— (1) In the procedure without prior examination, the Office shall ascertain first whether the patent

application should be the subject of a notification under Section 59(1) of the Law. If such is the case, it shall reject the patent application when the applicant is not capable of disposing of the objections raised by amending the technical documents or in another way.

(2) If the Office considers that the patent application does not comply with the provisions of Sections 50, 51, 52, 55 and 57 of the Law or with those of the Ordinance, it shall allow the applicant a period for the correction of this defect. If the defect is corrected only in part, the Office may, when it sees fit, make other notifications.

(Prior Examination Procedure)

68.— (1) Once the examination fee has been paid, the examiner (Section 89 of the Law) shall ascertain

first whether the patent application should be the subject of a notification under Section 96(2) of the Law. If such is the case, he shall reject the patent application when the applicant fails to dispose of the objections raised by amending the technical documents or in another way.

(2) If the examiner considers that the patent application does not comply with the provisions of Sections 50, 51, 52, 55 and 57 of the Law or with those of this Ordinance, he shall allow the applicant a period in which to correct this defect. If the defect is corrected only in part, the examiner may, if he sees fit, make other notifications.

(End of Examination)

69.— (1) If the conditions to which publication of the patent application is subject, in the prior

examination procedure, or to which the grant of the patent is subject, in the procedure without prior examination, are met, the scheduled date for the completion of the examination procedure shall be communicated to the applicant at least one month in advance; at the same time, the applicant shall be advised of the annual fee to be paid prior to completion of examination. At the same time, there shall also be communicated to him any amendments to the abstract or corrections within the meaning of Section 22(2) and also the amount of the publication fee (Section 71) and the expiry of the time limit for payment; this time limit shall be one month as from the completion of examination.

(2) Where the publication fee and the annual fee due prior to the date of completion of examination have been paid, the probable date of publication of the application or of issue of the patent shall be communicated to the applicant.

(3) If the technical documents comply with the provisions of the Law and this Ordinance at the outset or after notification, the applicant shall be deemed to have approved the version in which the patent application, in the prior examination procedure, is to be published or in which the patent, in the procedure without prior examination, is to be granted.

(4) [Repealed.] (5) [Repealed.]

Chapter 5: Preparation of Publication of the Application or Grant of the Patent

(Postponement of Publication or Grant)

70.— (1) An applicant wishing to postpone publication of a patent application, in the prior examination

procedure, or the grant of a patent in the procedure without prior examination, shall apply to the Office within two months following the communication of the completion of examination.

(2) Where the requested postponement does not exceed six months as from the communication of completion of the examination, it shall not be necessary to give reasons for the request.

(3) When it is established that the applicant consents thereto, postponement for more than six months may also be requested of the federal authority which, depending on the subject matter of the invention, has an interest in the maintenance of secrecy. Such request shall be accompanied by a statement of reasons. The Federal Department of Justice and Police shall rule on a proposal by the Office, after the Office has consulted the authority that is qualified in the field concerned. The Office shall determine every year whether there is still an interest in the maintenance of the secrecy of the invention.

(Calculation of the Printing Fee)

71.— (1) The printing fee shall be calculated on the basis of the technical documents produced by the

applicant. (2) The version of the documents mentioned in the communication of the completion of

examination shall be decisive. (3) Where that version exists in a form enabling the cost of printing of the application or the patent

to be reduced, the Office may grant a corresponding reduction in the printing fee for each page of text.

(Delaying Period)

72. Requests for the provisional or final recording of amendments in the Register, as well as the withdrawal of the patent application, that reach the Office less than one month before the date set for the publication of the application or grant of the patent, as communicated to the applicant, shall be deemed not to have been filed until after the publication of the application or grant of the patent.

Chapter 6: Opposition During the Prior Examination Procedure

(Form and Content)

73.— (1) Opposition shall be filed in duplicate within three months following publication, and shall

contain: (a) the surname and given name or corporate name or business style, the domicile or

headquarters and the address of the opposing party; (b) the designation of the patent application opposed; (c) the declaration stating the extent to which the grant of the patent is opposed; (d) the grounds for opposition (Sections 1, 1a and 2 of the Law); (e) the statement of the reasons, giving all the facts and proofs invoked.

(2) When the second copy of the opposition document is lacking, the opposing party may produce it within 14 days after having been invited to do so.

(3) When written matter is invoked as proof, the date of its appearance and the relevant passages in it shall be indicated. If, even after having been invited to do so, the opposing party does not provide these indications, the opposition division shall not be bound to take the proof into consideration.

(4) Section 5 shall apply mutatis mutandis.

(Competence of the Chairman of the Division)

74.— (1) The chairman of the opposition division shall designate, from among the officials and

employees of the Office who have technical or legal training, the members necessary to deal with a case. (2) He shall conduct the procedure; he shall, in particular, be competent to order such measures as

are likely to clarify the facts, and to set and extend time limits in the opposition procedure.

(Language)

75.— (1) Subject to Section 37 of the Federal Law on Administrative Procedure, the opposition procedure

shall take place in the language in which the application opposed is written. (2) If the opposition or another document submitted by the opposing party is produced in another

official language, the opposing party shall, on request, submit a translation in the language adopted for the procedure.

(3) When a document invoked as proof is written neither in an official language nor in English, a translation in one of those languages may be demanded. If such a translation is not produced, the opposition division shall not be bound to take this proof into consideration.

(Representation of the Opposing Party)

76.— (1) The opposing party who has to appoint an agent established in Switzerland (Section 13 of the

Law) shall be obliged to indicate, within the opposition period, the name, domicile, or headquarters and address of that agent.

(2) The agent shall produce a power of attorney within the period allowed him. (3) In all other respects, Sections 8 and 9 shall apply mutatis mutandis.

(Opposing Party Excluded from Procedure)

77.— (1) If the opposition is not in conformity with Sections 73(1) and 76, or if the time limit provided

for in Section 73(2) has not been observed, the opposition division shall exclude the opposing party from the procedure.

(2) If, after expiration of the opposition period, new grounds, facts or proof (Section 73(1)(d) and (e) are invoked without appearing to be justified, notably by amendment of the technical documents subsequent to publication, the opposition division may exclude the opposing party from the procedure with respect to that extension.

(Rebuttal of the Opposition)

78.— (1) The opposition shall be notified to the applicant, who shall be invited to make a rebuttal and,

where applicable, to produce the amended documents (Section 105 of the Law). (2) The rebuttal and the amended documents shall be submitted in as many copies as there are

oppositions; to these should be added one copy of the rebuttal and two copies of the amended documents.

(Amendment of the Claims)

79. When the claims are modified by the introduction of characteristics that are not contained in the application specification or cause a date to be postponed, publication shall be repeated.

(Exchange of Statements. Debates)

80.— (1) The opposition division shall communicate to all the opposing parties the reply of the applicant

and the amendments to the technical documents, and shall at the same time bring the other oppositions to their notice.

(2) If the applicant has amended the technical documents, or if the opposition division considers this necessary for other reasons, it shall invite the opposing parties to state their views.

(3) The opposition division may invite the parties to a further exchange of statements or to take part in the debates. The debates may also take place at the request of one party, if it appears that they are likely to clarify the facts.

(4) When the opposition division decides to initiate debates, it shall communicate the place and date to the parties.

(5) The debates shall not be public. The persons appearing shall justify their right to take part. Summary minutes shall be taken of the debates.

(6) The deliberations shall take place in camera.

(Final Decision of the Opposition Division)

81.— (1) When the documents are in order, the opposition division shall decide:

(a) that the patent application is entirely or partly rejected and that, to that extent, the opposition is allowed; or

(b) that the patent may be granted on the basis of the documents presented or the documents amended in the course of the opposition procedure, and that the opposition is rejected with respect to any other matter. (2) When a patent application is partly rejected, the opposition division shall invite the applicant,

once the decision has come into force, to adapt the technical documents to the amended claims. If the applicant does not comply with this request, the remaining part shall be rejected.

(3) Section 69(3) shall apply mutatis mutandis to the grant of the patent on the basis of amended documents.

Part IV: Appeals in the Prior Examination Procedure

(Applicable Law)

82. Appeals in the prior examination procedure (Section 106 of the Law) shall be governed by Chapter 3 of the Federal Law on Administrative Procedure and Part IV of the Patent Law, supplemented by Part IV of this Ordinance.

(Composition of the Board and Objections to Members)

83.— (1) The Chairman of the Board of Appeal shall designate from among the members appointed by

the Federal Council those who are to constitute the Board for the hearing of a case. (2) The composition of the Board shall be communicated in writing to the parties before the case is

heard. At the same time they shall be allowed a period of two months in which to present, in writing, grounds for objection.

(3) On expiration of this period, the members against whom no ground for objection has been presented shall be authorized to inspect the complete file.

(Competence of the Chairman of the Board)

84. The Chairman of the Board of Appeal shall conduct the proceedings; he shall in particular be competent to order such measures as are likely to clarify facts and to set and prolong time limits in the appeal procedure.

(Language)

85. Subject to Section 37 of the Federal Law on Administrative Procedure, the provisions concerning the language to be used before the lower authority shall apply also to the appeal procedure.

(Possibility of Amending and Completing the Appeal)

86.— (1) When the appeal is not in conformity with the requirements as to substance and form, the

appellant shall be allowed an additional period of 10 days in which to amend it. (2) When the appeal is in conformity with the said requirements, the appellant who so requests shall

be allowed a period of 30 days from the expiration of the appeal period to enable him to complete the grounds for appeal.

(Debates)

87. If the Board of Appeal orders debates, Section 80(4) to (6) shall apply mutatis mutandis.

(Force of Res Judicata on Decisions)

88. Decisions of Boards of Appeal shall have force of res judicata as soon as they have been rendered.

Part V: Patent Files and Patent Register

Chapter 1: File

(Contents)

89.— (1) The Office shall keep a file on every patent application and every patent containing information

on the course taken by the examination procedure and on the amendments affecting the existence of the patent and the right to the patent.

(2) Any person who includes a probative document among the documents and states that the said document discloses manufacturing or business secrets may request that it be filed separately. The existence of such documents shall be mentioned in the file.

(Inspection of Documents)

90.— (1) Before the publication of a patent application, in the prior examination procedure, or before the

grant of a patent, in the procedure without prior examination, the following persons shall be authorized to inspect the file:

(a) the applicant and his agent; (b) persons who are in a position to prove that the applicant has alleged violation by them of

the rights deriving from his patent application or that he has warned them against such violation; (c) third parties who are in a position to prove that the applicant or his agent has consented

thereto. (2) These persons shall also be authorized to consult rejected or withdrawn patent applications. (3) After the stage referred to in subsection 1), the file may be inspected by any person. (4) Any person who, by virtue of subsections (1) or (2), intends to inspect the file shall inform the

Office in advance and in writing of the date on which he intends to do so. (5) If the inspection of probative documents filed separately (Section 89(2)) is requested, the Office

shall take a decision after having heard the patent applicant or patent owner. In opposition procedures and appeal procedures the chairman of the opposition division or of the Board of Appeal shall take the decision.

(6) Where the public interest so requires, the Federal Department of Justice and Police may authorize the Office to allow directors of divisions of the Federal Administration to inspect the file.

(7) On request and against payment of costs, the documents to be inspected shall be issued in the form of copies.

(8) The general provisions on mutual judicial assistance shall be reserved.

(Information on Patent Applications)

91.— (1) Against payment of a fee, the Office shall give to third parties, without any guarantee as to its

completeness, the following information on pending patent applications: (a) name and address of the applicant and of his agent; (b) name and domicile of the inventor, except where the inventor has elected not to be

mentioned; (c) number of the patent application; (d) filing date; (e) information concerning priority and immunity derived from an exhibition; (f) title of the invention; (g) provisional classification; (h) whether or not the application is subject to prior examination; (i) requests for postponement of the examination as to substance, of publication of the

application or of grant of the patent; (k) date of publication and number of the application specification; (l) opposition procedure in progress; (m) rights granted, likewise restrictions to the right of disposal, imposed by courts or

authorities responsible for measures of distraint. (2) The Office shall provide this information if the name of the applicant or the number of the

patent application is indicated. As far as possible, the Office shall also base the information provided on other indications.

(Keeping of Documents)

92. The Office shall keep the original or a copy of the documents relating to withdrawn or rejected patent applications for five years from the withdrawal or rejection, but for at least 10 years from the date of filing.

Chapter 2: Patent Register

(Keeping of the Register)

93.— (1) The Office shall keep a register of patents granted. (2) Published patent applications shall be provisionally registered therein. Once the patent has been

granted, the provisional entries shall be regarded as final.

(Contents of the Register)

94.— (1) Patents shall be finally entered in the Register with the following particulars:

(a) number of the patent; (b) classification symbols; (c) title of the invention; (d) date of filing;

(e) number of the patent application; (f) date of publication of the patent application in the prior examination procedure; (g) date of grant of the patent; (h) priorities and immunities derived from exhibitions; (i) name and first name or corporate name or business style, domicile or headquarters and

address of the owner of the patent; (k) name, domicile or headquarters and address of the agent; (l) name and domicile of the inventor, except where the inventor has elected not to be

mentioned; (m) rights granted, likewise restrictions on the right of disposal ordered by the courts or by

authorities responsible for measures of distraint; (n) changes affecting the existence of the patent or of the right to the patent; (o) changes of domicile or headquarters of the owner of the patent; (p) changes of agent, or of the domicile or headquarters of the agent.

(2) Published patent applications shall be provisionally entered with the corresponding indications under the anticipated patent number.

(3) The Office may also enter, provisionally or finally, such other indications as it considers useful.

(Consultation: Extracts from the Register)

95.— (1) Any person shall be allowed to consult the Patent Register against payment of a fee. (2) On request and on payment of a fee, the Office shall make extracts from the Patent Register.

Chapter 3: Modifications

I. MODIFICATIONS AFFECTING THE EXISTENCE OF THE PATENT

(Partial Renunciation)

a. Form

96.— (1) The declaration of partial renunciation of a patent (Section 24 of the Law) shall be filed in

writing and in two copies. (2) It shall be unconditional. (3) It shall not be deemed to have been filed until the required fee has been paid.

b. Contents

97.— (1) The declaration of partial renunciation shall not give rise to any doubt as to the legal scope of

the claims; Sections 1, 1a, 2, 51, 52 and 55 of the Law shall also govern the rearrangement of the claim. (2) The description, drawings and abstract may not be modified. Partial renunciation nevertheless

includes a declaration of the following kind: Such parts of the description and drawings as are incompatible with the rearranged claims are to be

regarded as deleted. (3) If the declaration of partial renunciation is not in conformity with the requirements, the Office

shall allow the owner of the patent a period in which to remedy the defect. If the defect is remedied only in part, the Office may, if it sees fit, make other notifications.

(4) Where partial renunciation relates to a patent granted according to the prior examination procedure, the subject matter of the new claim shall not give rise to another examination of its patentability in relation to the state of the art.

c. Registration and Publication

98.— (1) If the declaration of partial renunciation is in conformity with requirements, it shall be

registered. (2) The Office shall publish it and attach it to the patent specification; a new patent document shall

be issued to the owner of the patent. (3) At the same time, the Office shall allow the owner of the patent a period of three months in

which to apply for the constitution of new patents (Section 5 of the Law).

(Limitation by the Court)

99. Section 98 shall apply mutatis mutandis when the patent has been limited by the court (Section 27 or 30 of the Law).

(Constitution of New Patents)

a. Request

100. The provisions governing patent applications shall apply to the request for the constitution of a new patent (Sections 25, 27(3) or 30(2) of the Law); Sections 101 and 102 are reserved.

b. Claims

101.— (1) For each new patent to be constituted under Section 100, at least one new claim shall be made

within the limits of the claims deleted from the original patent, account being taken of Section 24 of the Law. (2) If the original patent was granted according to the prior examination procedure, the subject

matter of the new claims shall not give rise to a new examination of patentability in relation to the state of the art.

c. Description

102.— (1) With regard to the description and drawings' reference may be made to the specification of the

original patent; a statement of the following kind shall be added: Such parts of the descriptions and drawings appearing in patent specification No.... as are incompatible

with the claims of this patent are to be regarded as deleted. (2) If the reference provided for in subsection (1) gives rise to doubt as to the legal scope of the

patent, the pans of the specification of the original patent that are necessary for the understanding of the claim of the new patent shall be reproduced in an appropriate form.

II. MODIFICATIONS AFFECTING THE RIGHT TO THE GRANT OF A PATENT AND THE RIGHT TO THE PATENT;

CHANGES OF AGENT

(Partial Allowance of an Action for Assignment)

103.— (1) If the court has ordered the assignment of a patent application with the elimination of certain

claims (Section 30 of the Law), the applicant against whom this ruling is made may, with the eliminated claims, make one or more patent applications. Their filing date shall be that of the assigned application, and in other respects they shall be treated as divisional applications (Section 57 of the Law).

(2) If the court has ordered the assignment of a patent with the elimination of certain claims (Section 30 of the Law), the owner of the patent to which the said ruling applies may, with the eliminated claims request the constitution of one or more new patents (Sections 100 to 102).

(3) When it has the final judgment on the assignment in its possession, the Office shall allow the patent applicant or patent owner against whom the ruling has been made a period of three months within which to file new patent applications or a request for the constitution of new patents.

(Mention in the File)

104.— (1) Before the publication of a patent application, in the prior examination procedure, or the grant

of a patent, in the procedure without prior examination, the following shall be mentioned in the file: (a) changes of applicant; (b) changes of corporate name or business style; (c) other changes such as changes of agent, the grant of right and restrictions on the right of

disposal ordered by the courts or by the authorities responsible for measures of distraint. (2) Section 105(2) to (6) shall apply mutatis mutandis. (3) The party acquiring a patent application shall take over the application in the state in which it

was at the time the probative document reached the Office.

(Provisional or Final Recording in the Patent Register)

105.— (1) The following shall be provisionally or finally entered in the Patent Register:

(a) changes affecting the right to the grant of the patent that occur after publication of the patent application in the prior examination procedure;

(b) changes affecting the right to the patent; (c) changes of corporate name or business style; (d) other modifications, such as changes of agent, the grant of rights and restrictions to the

right of disposal ordered by the courts or by authorities responsible for measures of distraint. (2) All modifications shall be certified by a statement from the previous patent applicant or patent

owner, bearing his authenticated signature, or by another sufficient probative document; Sections 106 and 107 are reserved. Probative documents shall be incorporated in the file.

(3) Insofar as an exclusive license is provisionally or finally entered in the Register, no other license that is incompatible with it shall be either provisionally or finally entered in respect of the same patent.

(4) A sub-license shall be provisionally or finally entered in the Register when it is certified by a statement, bearing the authenticated signature of the licensee who has been provisionally or finally entered, or by another sufficient probative document. In other respects, the right of the licensee to grant sub-licenses shall be established.

(5) The request for the provisional or final registration of a change shall not be deemed to have been filed until the required fee has been paid. If simultaneous registration of several changes is requested in respect of one and the same patent, the fee shall be paid only once.

(6) Provisional or final registration shall be effected without cost in respect of changes that are based on an executory judgment or on an award resulting from a measure of distraint, and also in respect of restrictions on the right of disposal ordered by the courts or by the authorities responsible for measures of distraint.

(Cancellation of Third-Party Rights)

106. At the request of the patent applicant or patent owner, the Office shall cancel rights in favor of a third party that are mentioned in the file or provisionally or finally entered in the Patent Register if, at the same time, a declaration of renunciation bearing the authenticated signature of the third party or another sufficient probative document is submitted.

(Changes of Agent)

107.— (1) Changes of agent shall be mentioned in the file or provisionally or finally entered in the Patent

Register on submission of the power of attorney in favor of the new agent. (2) The appointment of a new agent shall for the Office constitute revocation of the power of

attorney in favor of the previous one. (3) The first appointment of an agent and the revocation of agents already appointed shall be

exempt from fees.

Part VI: Publications of the Office

(Publication Organ)

108.— (1) The publications in the Swiss Journal of Patents, Designs and Marks that are required to be

made under the Law and this Ordinance shall be made twice a month. (2) The Office shall also publish information of general interest in this periodical.

(Patent Specification and Application Specification)

109.— (1) The patent application shall be published on the date of grant of the patent. The grant shall be

announced on the same day in the Swiss Journal of Patents, Designs and Marks. (2) In the prior examination procedure, the application specification shall be published on the same

day as the patent application. The files shall be open to inspection on the same day.

(Other Official Publications)

110.— (1) The Office shall publish annually a catalog of cases handled in the course of the previous

business year. (2) On the basis of the patent documentation in its possession, the Office may issue publications of

general interest, notably a collection of abstracts published.

(Selling Price)

111. The Office shall set the selling price of publications in agreement with the Central Office for Printed Matter and Stationery.

(Provision Free of Charge)

112.— (1) On request, the Office shall supply its publications free of charge:

(a) to the departments of the Federal Administration; (b) to the Federal Tribunal; (c) to the general management of the Federal Railways and the Post, Telephone and

Telegraph Company; (d) to the federal polytechnical colleges and to the higher technical colleges; (e) to cantonal governments and to the courts competent under Section 78(2) of the Law.

(2) With the consent of the Federal Department of Justice and Police, the Office shall supply its publications free of charge:

(a) to public collections in Switzerland; (b) subject to reciprocity, to foreign patent offices and to other bodies that request them.

(Documentation)

113.— (1) It shall be possible to consult or obtain, on payment of a fee, patent specifications, application

specifications and other Swiss or foreign official publications in the Office's possession. (2) The Office shall keep them at the disposal of the public in an appropriate form. (3) On payment of a fee, information on the state of the art may be obtained from the Office, or

from its representative.

Part VII: European Patent Applications and European Patents

(Scope of the Ordinance)

114.— (1) This Part shall apply to European patent applications and European patents that produce their

effects in Switzerland. (2) The other provisions of this Ordinance shall also apply, except where Section 109 of the Law

and this Part provide otherwise.

(Filing with the Office)

115.— (1) Persons who have their domicile or headquarters in Switzerland shall be entitled, as applicants

or agents, to file European patent applications with the Office, with the exception of divisional applications. (2) The Office shall indicate on the application documents the date on which they received them. (3) Fees collected under the European Patent Convention shall be paid directly to the European

Patent Office.

(Translation)

116.— (1) Any person who submits to the Office a translation of a claim of a published European patent

application (Section 112 of the Law) or of the original or amended specification of the European patent (Section 113 of the Law) shall indicate the number of the application or of the patent.

(2) If, as a result of the opposition procedure, the European patent has been maintained in an amended form, the new translation may be entirely replaced by a declaration specifying to what extent the previous translation is also applicable to the amended patent specification.

(3) The Office shall record the date of receipt of the translation. It shall confine itself to examining whether the translation is complete.

(4) For the purposes of consultation, the Office shall immediately make the translation available and shall record the date as from which it is available for consultation.

(5) If the translation is revised (Section 114 of the Law), subsections (1) to (4) shall apply mutatis mutandis.

(6) If the translation of the patent specification or of the declaration under subsection (2) has not been submitted in time (Section 113(2) of the Law), the Office shall state that the patent has not produced its effects in Switzerland. When this decision has come into force, it shall cancel the patent with effect from the date of grant.

(Register and File)

117.— (1) The following shall be entered in the Swiss Register of European Patents (Section 117 of the

Law): (a) the information given in the European Patent Register at the time of grant; (b) the information contained in the European Patent Register on the subject of the opposition

procedure; (c) in addition, the indications provided for Swiss patents.

(2) The Office shall register the information in the language used in the procedure before the European Patent Office; where that language is English, registration shall take place in the Swiss official language in which the translation of the patent specification has been supplied and, if such a translation is lacking, in the official language chosen by the Office.

(3) The language adopted in accordance with subsection (2) shall be the language in which the procedure takes place (Section 4).

(4) The Office shall keep a file on each European patent.

(Transformation)

118.— (1) When a European patent application or a European patent is transformed into a Swiss patent

application, the Office shall allow the applicant a period of two months in which to: (a) pay the application fee (Section 49(3) of the Law); (b) produce the translation (Section 123 of the Law); (c) appoint an agent (Section 13 of the Law).

(2) If more than two years have elapsed since the filing date of the Swiss patent application resulting from transformation, the annual fee due shall be paid within six months following the invitation to do so by the Office; if payment is effected during the last three months, a surcharge shall be collected.

Part VIII: International Patent Applications

Chapter 1: Scope of the Ordinance

119.— (1) This Part shall apply to international applications in respect of which the Office acts as

receiving Office or designated Office. (2) The other provisions of this Ordinance shall also be applicable, except where Section 131 of the

Law or this Part provides otherwise.

Chapter 2: The Office as Receiving Office

(Filing of the International Application)

120. The international application filed with the Office shall be made out in the Swiss official language that is a working language of the International Searching Authority competent for Switzerland. The Office shall indicate these languages in the Swiss Journal of Patents, Designs and Marks.

(Transmittal Fee and Search Fee)

121.— (1) The transmittal fee (Section 133(2) of the Law) shall be paid to the Office during the month

following receipt of the international application. (2) Subsection (1) shall apply mutatis mutandis to the search fee, the amount of which shall be

fixed on the basis of the agreement concluded with the International Searching Authority competent for Switzerland. The Office shall indicate the amount of the search fee fixed by the International Searching Authority in the Swiss Journal of Patents, Designs and Marks.

(International Fee; Other Designation Fees and Confirmation Fee)

122.— (1) The international fee, comprising a basic fee and designation fees according to Rule 15.1(ii) of

the Regulations under the Patent Cooperation Treaty of June 19, 1970 (hereinafter “the Cooperation Treaty Regulations”), shall be paid to the Office.

(2) Section 121(1) shall apply mutatis mutandis to payment of the basic fee. (3) The designation fees according to Rule 15.1(ii) of the Cooperation Treaty Regulations shall be

paid within 12 months following the filing date or priority date. Where the international application contains a priority claim, these fees may be paid within the month following filing where this term expires later.

(4) The designation fees and the confirmation fee according to Rule 15.5(a) of the Cooperation Treaty Regulations shall be paid to the Office within 15 months following the filing date or priority date.

(5) The amounts of these fees shall be those that appear in the Schedule of Fees of the Cooperation Treaty Regulations.

(Invitation to Pay)

122a.— (1) Where the transmittal fee, the basic fee, the search fee and the designation fee according to

Rule 15.1(ii) of the Cooperation Treaty Regulations have not been paid in time, the Office shall accord the applicant one month to pay the amount due as well as a late payment fee according to Rule 16bis.2 of the Cooperation Treaty Regulations.

(2) In case of nonpayment or partial payment within this time, the international application or the designations for the countries for which the fees have not been paid shall be considered withdrawn.

Chapter 3: The Office as Designated Office

(Translation of Claims)

123. Section 116(1), (3) and (4) shall apply mutatis mutandis to the translation of the claims of the published international application in respect of which the Office is the designated Office (Section 137 of the Law).

(Conditions of Form)

124.— (1) When, for the international application, the translation or the mention of the inventor is not

produced in time, or when the national application fee has not been paid within the prescribed time limits (Section 138 of the Law), the international application shall be regarded as having been withdrawn with respect to Switzerland.

(2) When the applicant who is not domiciled in Switzerland has not appointed an agent within 20 months of the filing date or priority date, the Office shall invite him to communicate to it within a month the name, domicile or headquarters and address of his agent.

(3) When the priority document has not been submitted to the receiving Office or to the International Bureau within 16 months of the priority date, the right of priority shall lapse; the right shall be revived when the conditions set out in Section 40(4) have been satisfied.

(4) Section 52(4) shall apply mutatis mutandis when the priority document is not drafted in a Swiss official language or in English.

(Search Report)

125.— (1) If the international application is subject to prior examination and if the international search

report issues from the International Searching Authority competent for Switzerland, the search of the state of the art shall not be completed.

(2) A complementary report on the state of the art (Section 139(2) of the Law) shall be established: (a) when the international search has not been effected for all the claims; (b) when the international search report has not been established by the Authority competent

for Switzerland, and if it is apparent from the report that the search was less extensive; (c) when, as a result of the postponement of a date, an additional search has become

necessary (Section 60(3)). (3) The search fee for the complementary report shall be paid within two months of the invitation to

do so by the examiner. (4) In all other respects, Sections 55 to 60 shall apply mutatis mutandis.

Part IX: International-Type Searches

(Conditions)

126.— (1) An international-type search within the meaning of Article 15(5) of the Patent Cooperation

Treaty may be requested in respect of a Swiss patent application.

(2) The request shall be filed with the Office within six months following the filing date. The international search fee, the amount of which is fixed by the International Searching Authority competent for Switzerland, shall be paid at the same time.

(3) If the language in which the patent application is drafted is not a working language of the International Searching Authority competent for Switzerland, a translation in a working language shall be filed at the same time.

(4) The Office shall not examine whether the patent application and the translation meet the other conditions specified in the Patent Cooperation Treaty, in particular the requirements of form valid for international applications.

(Procedure)

127.— (1) If the conditions specified in Section 126(1) to (3) are met, the Office shall send the required

documents to the International Searching Authority that is competent. (2) The Office shall send the search report to the applicant together with copies of the documents

that are mentioned therein; a copy shall be included in the file of the patent application.

Final Part: Final and Transitional Provisions

Chapter 1: Repeal of the Law in Force

128. Ordinance (1) of December 14, 1959, and Ordinance (2) of September 8, 1959, on the Federal Patent Act are repealed.

Chapter 2: Transitional Provisions

(Terms)

129. Terms that began prior to January 1, 1978, shall remain unchanged.

(Fees)

130.— (1) The amount of annual fees payable as from January 1, 1978, shall be governed by the new Law,

even if the said annual fees have been paid prior to that date. (2) For patent applications the filing date of which dates back more than two years before

January 1, 1978, the annual fees shall be paid, in accordance with the new Law, within six months following a request to do so by the Office.

(3) Subsection (2) shall apply mutatis mutandis to applications for patents of addition to a main patent the transformation of which is required as of January 1, 1978.

(Applications for Patents of Addition)

131. Applications for patents of addition that are pending on January 1, 1978, and are subordinate to patent applications that are also pending shall be regarded, as from that date, as independent applications.

(Mention of the Inventor)

132. If, for a patent application that is pending on January 1, 1978, the inventor has not yet been mentioned, he shall be mentioned within a period of three months from a request to do so by the Office or, if the period provided for in Section 35(1) expires later, within that period.

(Priority)

133.— (1) Declarations of priority relating to patent applications that are pending on January 1, 1978, may

be filed up to March 31, 1978. (2) For patent applications that are pending on January 1, 1978, the priority documents and the

missing information concerning the number of the first filing shall, upon request to do so by the Office, be produced within three months or, if the period provided for in Section 40(4) expires later, within that period.

(3) Subsections (1) and (2) shall not apply when, under the earlier Law, the period for the sending of the priority declaration or for the production of the priority document has expired on or has begun prior to January 1, 1978.

(Consultation of Files)

134. The files of patents granted prior to January 1, 1978, may not be consulted in accordance with Section 90(3) until after publication of the patent specifications.

Chapter 3: Entry into Force

135.— (1) This Ordinance shall enter into force on January 1, 1978, with the exception of Parts VII, VIII

and IX. (2) Part VII shall enter into force on June 1, 1978. (3) Parts VIII and IX shall enter into force at the same time as Part VI of the Law (International

Patent Applications).

Transitional Provisions of the Ordinance of August 12, 1986 (1) Patent applications pending on the day of entry into force of the new Law shall be governed by

that Law. (2) However, requests filed prior to the day of entry into force may not be the subject of

notifications by the Office where they satisfy the requirements of the previous Law; the Office may nevertheless request information within the meaning of Sections 64(1) and 65(1).

(3) Communications by the Office under the previous Law, dispatched prior to the day of entry into force, shall remain valid and shall have the consequences stated therein.

(4) Time limits set by the Office which have begun to run prior to the day of entry into force shall not be amended.

(5) Where examination of an application is completed before the day of entry into force, the procedure shall continue in accordance with the previous Law up to publication of the patent application or grant of the patent.
