Erster Abschnitt
Der Schutz der Topographien
§ 1 Schutzgegenstand, Eigenart
- (1)
-
Dreidimensionale Strukturen von mikroelektronischen Halbleitererzeugnissen
(Topographien) werden nach Maßgabe dieses Gesetzes geschützt, wenn und soweit
sie Eigenart aufweisen. Satz 1 ist auch auf selbständig verwertbare Teile sowie
Darstellungen zur Herstellung von Topographien anzuwenden.
- (2)

Eine Topographie weist Eigenart auf, wenn sie als Ergebnis geistiger Arbeit nicht
nur durch bloße Nachbildung einer anderen Topographie hergestellt und nicht alltäglich
ist.
- (3)
-
Besteht eine Topographie aus einer Anordnung alltäglicher Teile, so wird sie
insoweit geschützt, als die Anordnung in ihrer Gesamtheit Eigenart aufweist.
- (4)
-
Der Schutz nach Absatz 1 erstreckt sich nicht auf die der Topographie
zugrundeliegenden Entwürfe, Verfahren, Systeme, Techniken oder auf die in einem
mikroelektronischen Halbleitererzeugnis gespeicherten Informationen, sondern nur auf
die Topographie als solche.
§ 2 Recht auf den Schutz
- (1)
-
Das Recht auf den Schutz der Topographie steht demjenigen zu, der die Topographie
geschaffen hat. Haben mehrere gemeinsam eine Topographie geschaffen, steht ihnen das
Recht gemeinschaftlich zu.
- (2)
-
Ist die Topographie im Rahmen eines Arbeitsverhältnisses oder im Auftrag eines
anderen geschaffen worden, so steht das Recht auf den Schutz der Topographie dem
Arbeitgeber oder dem Auftraggeber zu, soweit durch Vertrag nichts anderes bestimmt ist.
- (3)

Inhaber des Rechts auf den Schutz der Topographie nach den Absätzen 1 und 2 kann
jeder Staatsangehörige eines Mitgliedstaates der Europäischen Wirtschaftsgemeinschaft
sowie jede natürliche oder juristische Person sein, die ihren gewöhnlichen Aufenthalt
oder eine Niederlassung in dem Gebiet eines Mitgliedstaates hat, in dem der Vertrag

zur Gründung der Europäischen Wirtschaftsgemeinschaft gilt; den juristischen Personen
sind Gesellschaften gleichgestellt, die nach dem auf sie anwendbaren Recht Träger von
Rechten und Pflichten sein können, ohne juristische Personen zu sein.

Das Recht auf den Schutz der Topographie steht unbeschadet der Absätze 1 und 2
auch demjenigen zu, der die Topographie auf Grund eines ausschließlichen Rechts zur
geschäftlichen Verwertung in der Europäischen Wirtschaftsgemeinschaft erstmals in
einem ihrer Mitgliedstaaten nicht nur vertraulich geschäftlich verwertet und die
Voraussetzungen des Absatzes 3 erfüllt. Die Topographie darf zuvor von einem anderen
noch nicht oder nur vertraulich geschäftlich verwertet worden sein.

Die Rechte nach den Absätzen 1 bis 4 stehen auch den jeweiligen Rechtsnachfolgern
zu.
- (6)
-
Anderen Personen steht ein Recht auf den Schutz der Topographie nur zu, wenn
- sie auf Grund einer völkerrechtlichen Vereinbarung oder des Rechts der Europäischen
Gemeinschaften wie Inländer zu behandeln sind oder
- der Staat, dem sie angehören oder in dem sich ihr Sitz oder ihre Niederlassung
befindet, nach einer Bekanntmachung des Bundesministers der Justiz im
Bundesgesetzblatt Deutschen im Sinne des Grundgesetzes und Personen mit Sitz
oder Niederlassung im Geltungsbereich dieses Gesetzes einen entsprechenden Schutz
gewährt.
§ 3 Anmeldung
- (1)
-
Eine Topographie, für die Schutz geltend gemacht wird, ist beim Patentamt
anzumelden. Für jede Topographie ist eine besondere Anmeldung erforderlich.
- (2)
-
Die Anmeldung muß enthalten:
- einen Antrag auf Eintragung des Schutzes der Topographie, in dem diese kurz und
genau bezeichnet ist;
- Unterlagen zur Identifizierung oder Veranschaulichung der Topographie oder eine
Kombination davon und Angaben über den Verwendungszweck, wenn eine Anordnung nach §
4 Abs. 4 in Verbindung mit § 9 des Gebrauchsmustergesetzes in Betracht kommt;
- das Datum des Tages der ersten nicht nur vertraulichen geschäftlichen Verwertung
der Topographie, wenn dieser Tag vor der Anmeldung liegt;
- Angaben, aus denen sich die Schutzberechtigung nach § 2 Abs. 3 bis 6 ergibt.
(3) Das Bundesministerium der Justiz regelt durch Rechtsverordnung, die nicht der
Zustimmung des Bundesrates bedarf,
- die Einrichtung und den Geschäftsgang des Deutschen Patent- und Markenamts sowie
die Form des Verfahrens in Topografieangelegenheiten, soweit nicht durch Gesetz
Bestimmungen darüber getroffen sind,
- die Form und die sonstigen Erfordernisse der Anmeldung.
Es kann diese Ermächtigung durch Rechtsverordnung, die nicht der Zustimmung des
Bundesrates bedarf, ganz oder teilweise auf das Deutsche Patent- und Markenamt
übertragen.
- (4)

Sind die Erfordernisse für eine ordnungsgemäße Anmeldung nach Absatz 2 Nr. 1 bis 3
nicht erfüllt, so teilt das Patentamt dem Anmelder die Mängel mit und fordert ihn auf,
diese innerhalb einer Frist von zwei Monaten nach Zustellung der Nachricht zu beheben.
Wird der Mangel innerhalb der Frist behoben, so gilt der Zeitpunkt des Eingangs des
Schriftsatzes beim Patentamt als Zeitpunkt der Anmeldung der Topographie. Das Patentamt
stellt diesen Zeitpunkt fest und teilt ihn dem Anmelder mit.

Werden die in Absatz 4 genannten Mängel innerhalb der Frist nach Absatz 4 nicht
behoben, so gilt die Anmeldung als zurückgenommen.
§ 4 Eintragung, Bekanntmachung, Änderungen

Entspricht die Anmeldung den Anforderungen des § 3, so verfügt das Patentamt die
Eintragung in das Register für Topographien, ohne die Berechtigung des Anmelders zur
Anmeldung, die Richtigkeit der in der Anmeldung angegebenen Tatsachen und die Eigenart
der Topographie zu prüfen.

Die Vorschriften des Gebrauchsmustergesetzes über die Eintragung in das Register,
die Bekanntmachung im Patentblatt und Änderungen im Register (§ 8 Abs. 2 bis 4) sind
entsprechend anzuwenden.
- (3)
-
Die Vorschriften des Gebrauchsmustergesetzes über die Einsicht in das Register
sowie in die Akten eingetragener Gebrauchsmuster einschließlich der Akten von
Löschungsverfahren (§ 8 Abs. 5) sind mit der Maßgabe anzuwenden, daß Einsicht in
Unterlagen, die Betriebs- oder Geschäftsgeheimnisse enthalten und vom Anmelder
als solche gekennzeichnet worden sind, nur in einem Löschungsverfahren vor dem
Patentamt auf Anordnung der Topographieabteilung oder in einem Rechtsstreit über die
Rechtsgültigkeit oder die Verletzung des Schutzes der Topographie auf Anordnung des
Gerichts gegenüber den Personen gewährt wird, die an dem Löschungsverfahren oder an dem
Rechtsstreit beteiligt sind. Unterlagen, die zur Identifizierung oder Veranschaulichung
der Topographie eingereicht worden sind, können nicht in ihre Gesamtheit als Betriebsoder Geschäftsgeheimnisse gekennzeichnet werden. Außer in einem Löschungsverfahren vor
dem Patentamt oder in einem Rechtsstreit über die Rechtsgültigkeit oder die Verletzung
des Schutzes der Topographie wird Einsicht in Unterlagen nur durch unmittelbare
Einsichtnahme gewährt.

Für Anträge in Angelegenheiten des Schutzes der Topographien
(Topographieschutzsachen) mit Ausnahme der Löschungsanträge (§ 8) wird im Patentamt
eine Topographiestelle gebildet, die von einem vom Präsidenten des Patentamts
bestimmten rechtskundigen Mitglied geleitet wird. Über Löschungsanträge (§ 8)
beschließt eine im Patentamt zu bildende Topographieabteilung, die mit zwei technischen
Mitgliedern und einem rechtskundigen Mitglied zu besetzen ist. Im übrigen sind die
Vorschriften des Gebrauchsmustergesetzes über die Gebrauchsmusterstelle und die
Gebrauchsmusterabteilungen (§ 10), über die Rechtsmittel und Rechtsmittelverfahren (§
18) und über die Geheimgebrauchsmuster (§ 9) entsprechend anzuwenden.
§ 5 Entstehung des Schutzes, Schutzdauer
(1) Der Schutz der Topographie entsteht
- an dem Tag der ersten nicht nur vertraulichen geschäftlichen Verwertung der
Topographie, wenn sie innerhalb von zwei Jahren nach dieser Verwertung beim
Patentamt angemeldet wird, oder
- an dem Tag, an dem die Topographie beim Patentamt angemeldet wird, wenn sie zuvor
noch nicht oder nur vertraulich geschäftlich verwertet worden ist.
- (2)

Der Schutz der Topographie endet mit Ablauf des zehnten Kalenderjahres nach dem
Jahr des Schutzbeginns.
- (3)
-
Der Schutz der Topographie kann nur geltend gemacht werden, wenn die Topographie
beim Patentamt angemeldet worden ist.
- (4)
-
Der Schutz der Topographie kann nicht mehr in Anspruch genommen werden, wenn die
Topographie nicht innerhalb von fünfzehn Jahren nach dem Tag der ersten Aufzeichnung
nicht nur vertraulich geschäftlich verwertet oder beim Patentamt angemeldet wird.
§ 6 Wirkung des Schutzes
(1) Der Schutz der Topographie hat die Wirkung, daß allein der Inhaber des Schutzes
befugt ist, sie zu verwerten. Jedem Dritten ist es verboten, ohne seine Zustimmung
- die Topographie nachzubilden;
- die Topographie oder das die Topographie enthaltende Halbleitererzeugnis
anzubieten, in Verkehr zu bringen oder zu verbreiten oder zu den genannten Zwecken
einzuführen.

Anwendung. Hat der Verpflichtete durch die Verletzung auf Kosten des Berechtigten etwas
erlangt, findet § 852 des Bürgerlichen Gesetzbuchs entsprechende Anwendung.
(4) § 24g des Gebrauchsmustergesetzes gilt entsprechend.
§ 10 Strafvorschriften
(1) Mit Freiheitsstrafe bis zu drei Jahren oder mit Geldstrafe wird bestraft, wer
- entgegen § 6 Abs. 1 Satz 2 Nr. 1 die Topographie nachbildet oder
- entgegen § 6 Abs. 1 Satz 2 Nr. 2 die Topographie oder das die Topographie
enthaltende Halbleitererzeugnis anbietet, in Verkehr bringt, verbreitet oder zu den
genannten Zwecken einführt.
- (2)
-
Handelt der Täter gewerbsmäßig, so ist die Strafe Freiheitsstrafe bis zu fünf
Jahren oder Geldstrafe.
- (3)
-
Der Versuch ist strafbar.
- (4)
-
In den Fällen des Absatzes 1 wird die Tat nur auf Antrag verfolgt, es sei denn,
daß die Strafverfolgungsbehörde wegen des besonderen öffentlichen Interesses an der
Strafverfolgung ein Einschreiten von Amts wegen für geboten hält.
- (5)
-
Die Vorschrift des Gebrauchsmustergesetzes über die Einziehung (§ 25 Abs. 5) ist
entsprechend anzuwenden.
- (6)
-
Wird auf Strafe erkannt, so ist, wenn der Verletzte es beantragt und ein
berechtigtes Interesse daran dartut, anzuordnen, daß die Verurteilung auf Verlangen
öffentlich bekanntgemacht wird. Die Art der Bekanntmachung ist im Urteil zu bestimmen.
§ 11 Anwendung von Vorschriften des Patentgesetzes und des
Gebrauchsmustergesetzes
- (1)
-
Die Vorschriften des Patentgesetzes über die Erstattung von Gutachten (§ 29
Abs. 1 und 2), über die Wiedereinsetzung in den vorigen Stand (§ 123), über die
Weiterbehandlung der Anmeldung (§ 123a), über die Wahrheitspflicht im Verfahren (§
124), über die elektronische Verfahrensführung (§ 125a), über die Amtssprache (§ 126),
über Zustellungen (§ 127) und über die Rechtshilfe der Gerichte (§ 128) sind auch für
Topographieschutzsachen anzuwenden.

Die Vorschriften des Gebrauchsmustergesetzes über die Bewilligung von
Verfahrenskostenhilfe (§ 21 Abs. 2), über die Übertragung und die Lizenz (§ 22), über
die Streitwertherabsetzung (§ 26), über die Gebrauchsmusterstreitsachen (§ 27), über
die Inlandsvertretung (§ 28), über die Ermächtigungen zum Erlaß von Rechtsverordnungen
(§ 29) und über die Schutzberühmung (§ 30) sind entsprechend anzuwenden.

§ 26 Übergangsvorschriften
- (1)
-
Der Schutz der Topographie kann nicht für solche Topographien in Anspruch
genommen werden, die früher als zwei Jahre vor Inkrafttreten dieses Gesetzes nicht nur
vertraulich geschäftlich verwertet worden sind. Rechte aus diesem Gesetz können nur für
die Zeit ab Inkrafttreten dieses Gesetzes geltend gemacht werden.
- (2)
-
Artikel 229 § 6 des Einführungsgesetzes zum Bürgerlichen Gesetzbuche findet mit der
Maßgabe entsprechende Anwendung, dass § 9 Abs. 1 Satz 4 in der bis zum 1. Januar 2002
geltenden Fassung den Vorschriften des Bürgerlichen Gesetzbuchs über die Verjährung in
der bis zum 1. Januar 2002 geltenden Fassung gleichgestellt ist.
§ 27 Berlin-Klausel
Dieses Gesetz gilt nach Maßgabe des § 13 Abs. 1 des Dritten Überleitungsgesetzes
auch im Land Berlin. Rechtsverordnungen, die auf Grund dieses Gesetzes, des
Gebrauchsmustergesetzes und des Patentgesetzes erlassen werden, gelten im Land Berlin
nach § 14 des Dritten Überleitungsgesetzes.
§ 28 Inkrafttreten
Dieses Gesetz tritt am 1. November 1987 in Kraft.

Chapter 1
The Protection of Topographies
Subject of Protection, Originality
1.—(1) Three-dimensional structures of microelectronic semiconductor products (topographies) shall be protected under this Law if and insofar as they are original. The first sentence shall also apply to independently usable parts and to representations for the manufacture of topographies.
(2) A topography shall be original if it is the result of intellectual effort and has not been produced by simple reproduction of another topography and if it is not commonplace.
(3) A topography consisting of an arrangement of commonplace parts shall be protected insofar as the arrangement is original as a whole.
(4) The protection under subsection (1) shall not apply to the concepts, processes, systems or techniques on which the topography is based or to any information stored in a microelectronic semiconductor product, but only to the topography as such.
Right to Protection
2.—(1) The right to protection of the topography shall apply in favor of the person who has created the topography. Where several persons have jointly created a topography, the right shall apply in favor of all of them in common.
(2) If the topography has been created in the course of employment or on commission, the right to protection of the topography shall apply in favor of the employer or the person by whom the topography has been commissioned, when not otherwise provided by contract.
(3) Any national of a Member State of the European Economic Community and any natural or legal person with habitual residence or establishment on the territory of a Member State to which the Treaty establishing the European Economic Community is applicable can be the owner of the right to topography protection under subsection (1) and subsection (2). Companies which may be subjects of rights and duties according to the law applicable to them, without having legal personality, shall be assimilated to legal persons.
(4) Notwithstanding subsection (1) and subsection (2), the right to protection of the topography shall also apply in favor of a person who, on the basis of an exclusive right of commercial exploitation in the European Economic Community, first commercially exploits the topography, other than confidentially, in one of its Member States and who fulfills the requirements of subsection (3). The topography may not have been previously exploited commercially, other than confidentially, by another person.
(5) The rights under subsection (1) to subsection (4) shall also apply in favor of the respective successors in title.
(6) Other persons shall be entitled to a right to topography protection only where
1. they are to be treated as nationals under an international treaty or the law of the European Communities, or
2. the State of which they are nationals or in which they have their residence or establishment affords equivalent protection, according to a notice by the Federal Minister of Justice in the Bundesgesetzblatt, to Germans within the meaning of the Basic Law and to persons with residence or establishment within the jurisdiction of this Law.
Application
3.—(1) Applications in respect of topographies for which protection is sought shall be filed in writing with the Patent Office. A separate application shall be filed for each topography.
(2) Applications shall contain:
1. a request for registration of protection, which must clearly and concisely designate the topography;
2. material identifying or illustrating the topography or a combination of such material and details of the intended use if an order under Section 4(4), in conjunction with Section 9 of the Utility Model Law,1 is to be considered;
3. the date of the day of first commercial exploitation, other than confidential, of the topography, where such day is earlier than the application;
4. particulars establishing the entitlement to protection under Section 2(3) to Section 2(6).
(3) The Federal Minister of Justice shall have power to issue by statutory order regulations concerning other requirements for the application. He may delegate such power by statutory order to the President of the Patent Office.
(4) Where the application does not duly comply with the requirements of Section 2(1) to Section 2(3), the Patent Office shall notify the defects to the applicant and invite him to remedy them within two months of service of notification. If the defect is remedied within the time limit, the date of receipt of the written communication at the Patent Office shall be deemed the date of the application for the topography. The Patent Office shall confirm this date and communicate it to the applicant.
(5) A fee as prescribed by the schedule of fees shall be paid with each application for protection of a topography. If the fee is not paid, the Patent Office shall notify the applicant that the application will be deemed to have been withdrawn unless payment is made within one month of service of the notification. If the application fee has not been paid within that time limit or if the defects mentioned in subsection (4) have not been remedied within the time limit mentioned in subsection (4), the application shall be deemed not to have been filed. The Patent Office shall establish this fact and refuse the registration.
Registration, Publication, Amendments
4.—(1) Where the application complies with the requirements of Section 3, the Patent Office shall order registration in the Register of Topographies without examination of the applicant’s entitlement to file an application, the correctness of the facts stated in the application and the originality of the topography.
(2) The provisions of the Utility Model Law concerning entry in the Register, publication in the Patent Journal [Patentblatt] and amendments to the Register (Section 8(2) to Section 8(4)) shall apply mutatis mutandis.
(3) The provisions of the Utility Model Law concerning inspection of the Register and of files of registered utility models, including files of cancellation proceedings (Section 8(5)), shall apply with the proviso that inspection of material containing trade or business secrets and marked as such by the applicant shall only be permitted in cancellation proceedings before the Patent Office, by order of the Topography Division, or in a lawsuit concerning the validity or the infringement of protection of the topography, by order of the court, and only for the parties to the cancellation proceedings or lawsuit. Material that has been filed for identifying or illustrating the topography may not be marked as trade or business secrets in its entirety. Except in cancellation proceedings before the Patent Office or a lawsuit concerning the validity or infringement of topography protection, inspection of material shall only be permitted in the form of direct inspection.
(4) For requests relating to the protection of topographies (topography protection matters), with the exception of cancellation requests (Section 8), a Topography Section shall be established within the Patent Office, under the direction of a legal member appointed by the President of the Patent Office. Decisions on cancellation requests (Section 8) shall be taken by a Topography Division to be set up within the Patent Office, which shall consist of two technical members and one legal member. In other respects, the provisions of the Utility Model Law concerning the Utility Model Section and Utility Model Divisions (Section 10), legal remedies and procedures (Section 18) and secret utility models (Section 9) shall apply mutatis mutandis.
Commencement and Duration of Protection
5.—(1) Topography protection shall commence:
1. on the day of the first commercial exploitation, other than confidential, of the topography, if the latter is filed with the Patent Office within two years of such exploitation, or
2. on the day on which the topography is filed with the Patent Office if it has not been previously exploited commercially, other than confidentially.
(2) Topography protection shall terminate at the end of the tenth calendar year after the year of commencement of protection.
(3) Topography protection can only be asserted if the topography has been filed with the Patent Office.
(4) Topography protection can no longer be claimed if the topography has not been commercially exploited, other than confidentially, or has not been filed with the Patent Office within 15 years after the day of its first fixation.
Effect of Protection
6.—(1) Topography protection shall have the effect that the owner of protection alone is authorized to exploit the topography. Any other person not having his consent shall be prohibited:
1. from reproducing the topography;
2. from offering, putting on the market or distributing, or importing for such purposes, the topography or the semiconductor product containing the topography.
(2) The effect of topography protection shall not extend to:
1. acts done privately for non-commercial purposes;
2. the reproduction of the topography for the purposes of analysis, evaluation or teaching;
3. the commercial exploitation of a topography which is the result of analysis or evaluation under item 2 and is original within the meaning of Section 1(2).
(3) A person who acquires a semiconductor product without knowing or without having reason to believe that it contains a protected topography shall be entitled to continue exploiting it without the consent of the owner of the protection. As soon as that person knows or has reason to believe that topography protection exists, the owner of protection shall be entitled to claim reasonable compensation in accordance with circumstances for the continued commercial exploitation of the semiconductor product.
Limitation of Protection
7.—(1) Topography protection shall not be afforded where a claim to cancellation, assertable by any person, exists against the person registered as owner (Section 8(1) and Section 8(3)).
(2) If the essential content of the application has been taken from the topography of another person without his consent, protection under this Law may not be invoked against the injured party. The provisions of the Patent Law2 concerning the right to assignment (Section 8) shall apply mutatis mutandis.
Claim for Cancellation, Cancellation Proceedings
8.—(1) Any person may assert a claim against the person registered as owner for cancellation of the registration of the topography:
1. if the topography does not qualify under Section 1,
2. if the applicant or the person registered as owner is not entitled to protection under Section 2(3) to Section 2(6), or
3. if the topography has not been filed within the time limit under Section 5(1).1, or has been filed after expiration of the time limit under Section 5(4).
(2) In the case under Section 7(2), only the injured party may assert a claim for cancellation.
(3) Where the grounds for cancellation relate only to a part of the topography, only that part of the registration shall be canceled.
(4) A request for cancellation of the registration of the topography under subsection (1) to subsection (3) shall be filed with the Patent Office in writing. The request shall state the grounds on which it is based. A fee as prescribed by the schedule of fees shall be paid with the request; if the fee is not paid, the request shall be deemed not to have been filed. The provisions of Section 81(7) and Section 125 of the Patent Law shall apply mutatis mutandis.
(5) The provisions of the Utility Model Law concerning the cancellation proceedings (Section 17) and the effect of the cancellation proceedings on a lawsuit (Section 19) shall apply mutatis mutandis.
Infringement
9.—(1) Any person who infringes topography protection contrary to the provisions of Section 6(1) may be sued by the injured party to enjoin such infringement. Any person who undertakes such action intentionally or negligently shall be liable for compensation to the injured party for the damage suffered therefrom. If the infringer is charged with only slight negligence, the court may fix, in lieu of compensation, an indemnity within the limits of the damage to the injured party and the profit which has accrued to the infringer. The provisions of Section 24c of the Utility Model Law shall apply mutatis mutandis.
(2) The provisions of the Utility Model Law as regards the claim to destruction (Section 24a), the claim to information in respect of third parties (Section 24b) and measures by the customs authorities (Section 25a) shall apply mutatis mutandis.
Penal Provisions
1. reproduces the topography contrary to Section 6(1), second sentence, item 1, or
2. offers, puts on the market, distributes or imports for such purposes the topography or the semiconductor product containing the topography contrary to Section 6(1), second sentence, item 2,
shall be punished by imprisonment not exceeding three years or by a fine.
(2) Where the person committing the offense does so on a commercial basis, the penalty shall be imprisonment for up to five years or a fine.
(3) The attempt to commit such an offense shall be punishable.
(4) In the cases referred to in subsection (1), criminal prosecution shall only be instituted upon request, unless, in the opinion of the prosecuting authorities, ex officio intervention is required in view of the particular public interest in criminal prosecution.
(5) The provision of the Utility Model Law regarding confiscation (Section 25(5)) shall apply mutatis mutandis.
(6) In the event of conviction, the sentence shall be published if the injured party so requests and if he has a legitimate interest in so doing. The scope and nature of the publication shall be determined in the judgment.
Application of Provisions of the Patent Law and the Utility Model Law
11.—(1) The provisions of the Patent Law concerning the giving of opinions (Section 29(1) and Section 29(2)), reinstatement (Section 123), the obligation to observe the truth in proceedings (Section 124), the official language (Section 126), the service of documents (Section 127) and legal assistance from the courts (Section 128) shall apply also to topography protection cases.
(2) The provisions of the Utility Model Law concerning the award of legal aid (Section 21(2)), transfer and license (Section 22), reduction of the value in dispute (Section 26), utility model litigation (Section 27), domestic representation (Section 28), authorization to issue statutory orders (Section 29) and allusion to protection (Section 30) shall apply mutatis mutandis.

26. Topography protection shall not be available for topographies which have been commercially exploited, other than confidentially, more than two years before the entry into force of this Law. Chapitre premier Protection des topographies
Objet de la protection, originalité
1er. — 1) Les structures tridimensionnelles de produits semi-conducteurs microélectroniques (topographies) sont protégées aux termes de la présente loi si et dans la mesure où elles présentent une originalité. La première phrase est applicable aussi aux parties exploitables séparément ainsi qu’aux représentations servant à la fabrication de topographies.
2) Une topographie est originale si, étant le résultat d’un travail intellectuel, elle n’a pas été fabriquée par simple reproduction d’une autre topographie et si elle n’est pas courante.
3) Si une topographie est constituée par un agencement de parties courantes, elle est protégée dans la mesure où cet agencement, pris comme un tout, est original.

4) La protection visée à l’alinéa 1) ne s’étend pas aux projets, procédés, systèmes ou techniques qui ont servi de base à la topographie ni aux informations stockées dans un produit semi-conducteur microélectronique, mais uniquement à la topographie en tant que telle.
Droit à la protection
2. — 1) Le droit à la protection de la topographie appartient au créateur de celle-ci. Lorsqu’une topographie a été créée en commun par plusieurs personnes, le droit leur appartient en commun.
2) Si la topographie a été créée dans le cadre d’un contrat de travail ou sur commande d’un tiers, le droit à sa protection appartient à l’employeur ou au donneur d’ouvrage, sauf disposition contractuelle différente.
3) Peuvent être titulaires du droit visé aux alinéas 1) et 2) tout ressortissant d’un État membre de la Communauté économique européenne ainsi que toute personne physique ou morale qui a sa résidence habituelle ou un établissement sur le territoire d’un État membre où le Traité instituant la Communauté économique européenne est applicable; les sociétés qui ne sont pas des personnes morales mais qui peuvent, en vertu du droit qui leur est applicable, assumer des droits et des obligations sont assimilées à des personnes morales.
4) Sans préjudice des alinéas 1) et 2), le droit à la protection de la topographie appartient aussi à quiconque procède pour la première fois à une exploitation commerciale, autrement que d’une façon uniquement secrète, de la topographie dans un pays membre de la Communauté économique européenne en vertu d’un droit exclusif portant sur l’exploitation commerciale dans la Communauté et remplit les conditions énoncées à l’alinéa 3). Auparavant, la topographie ne doit pas avoir fait l’objet d’une exploitation commerciale par un tiers autrement que d’une façon uniquement secrète.
5) Peuvent aussi bénéficier des droits visés aux alinéas 1) à 4) les ayants cause correspondants.
6) D’autres personnes ne peuvent bénéficier du droit à la protection de la topographie que si
1. elles sont assimilées à des nationaux en vertu d’un traité international ou du droit des Communautés européennes, ou
2. l’État dont elles sont ressortissantes ou dans lequel elles ont leur domicile, leur siège ou leur établissement accorde, conformément à un avis publié par le ministre fédéral de la justice au journal officiel [Bundesgesetzblatt], une protection équivalente aux Allemands, au sens de la loi fondamentale, et aux personnes ayant leur domicile, leur siège ou leur établissement sur un territoire auquel s’applique la présente loi.

Demande d’enregistrement
3. — 1) Quiconque veut faire valoir son droit à la protection d’une topographie doit déposer une demande d’enregistrement écrite auprès de l’office des brevets. Pour chaque topographie, il y a lieu de déposer une demande distincte.
2) La demande doit comprendre :
1. une requête en enregistrement de la protection de la topographie, dans laquelle celle- ci est décrite de manière brève et précise;
2. le matériel permettant d’identifier ou représentant la topographie, ou une combinaison de matériel de ces catégories, et, s’il s’agit d’un cas visé conjointement par l’alinéa 4) de l’article 4 et par l’article 9 de la loi sur les modèles d’utilité1 des indications sur l’utilisation à laquelle la topographie est destinée;
3. la date de la première exploitation commerciale non uniquement secrète de la topographie, si cette date est antérieure à la date de la demande;
4. des indications justifiant du droit à la protection selon les alinéas 3) à 6) de l’article 2.
3) Le ministre fédéral de la justice peut, par voie d’ordonnance, fixer d’autres conditions pour le dépôt des demandes. Il peut, par voie d’ordonnance, déléguer ses pouvoirs à cet égard au président de l’office des brevets.
4) Si une demande ne remplit pas les conditions énoncées aux points 1 à 3 de l’alinéa 2), l’office des brevets informe le déposant des défauts et l’invite à les corriger dans un délai de deux mois à compter de la notification de cette invitation. Si le défaut est corrigé dans ce délai, la date de réception de la communication correspondante par l’office des brevets est réputée être la date de dépôt de la demande d’enregistrement de la topographie. L’office des brevets constate cette date et en informe le déposant.
5) Toute demande d’enregistrement d’une topographie doit être accompagnée du versement d’une taxe prévue au barème. Si ce paiement fait défaut, l’office des brevets avise le déposant que sa demande d’enregistrement sera réputée retirée si la taxe n’est pas acquittée dans un délai d’un mois à compter de la notification de l’avis. Si la taxe de dépôt n’est pas acquittée dans ce délai ou si les défauts visés à l’alinéa 4) ne sont pas corrigés dans le délai qui y est prévu, la demande est réputée ne pas avoir été déposée; l’office des brevets constate ce fait et refuse l’enregistrement.
Enregistrement, publication, modifications
4. — 1) Si la demande d’enregistrement remplit les conditions énoncées à l’article 3, l’office des brevets fait procéder à l’inscription au registre des topographies sans vérifier le droit du déposant au dépôt de la demande, l’exactitude des indications fournies dans la demande ni l’originalité de la topographie.

2) Les dispositions de la loi sur les modèles d’utilité concernant l’inscription au registre, la publication au bulletin des brevets [Patentblatt] et la modification des inscriptions portées au registre (al. 2) à 4) de l’art. 8) sont applicables mutatis mutandis.
3) Les dispositions de la loi sur les modèles d’utilité concernant la consultation du registre ainsi que des dossiers des topographies enregistrées, y compris les dossiers relatifs à des procédures en radiation (al. 5) de l’art. 8) sont applicables sous la réserve que la consultation des documents qui contiennent des secrets industriels ou commerciaux et qui ont été signalés comme tels par le déposant est autorisée seulement, dans une procédure en radiation devant l’office des brevets, sur décision de la division des topographies ou, dans un procès portant sur la validité ou la violation de la protection de la topographie, sur décision du tribunal aux personnes qui sont parties à la procédure en radiation ou au procès. Les pièces déposées qui sont destinées à permettre d’identifier ou à représenter la topographie ne peuvent pas être considérées dans leur ensemble comme relevant du secret industriel ou commercial. Sauf dans une procédure en radiation devant l’office des brevets ou dans un procès portant sur la validité ou la violation de la protection de la topographie, seule la consultation directe des documents est autorisée.
4) Une section des topographies est instituée à l’office des brevets sous la direction d’un membre juriste désigné par le président de l’office des brevets pour examiner les demandes relatives à la protection des topographies, à l’exception des demandes en radiation (art. 8). Une division des topographies, à créer au sein de l’office des brevets et qui doit être composée de deux membres techniciens et d’un membre juriste, statue sur les demandes en radiation (art. 8). Par ailleurs, les dispositions de la loi sur les modèles d’utilité relatives à la section des modèles d’utilité et aux divisions des modèles d’utilité (art. 10), aux moyens de recours et à la procédure de recours (art. 18) et aux modèles d’utilité dont l’objet constitue un secret (art. 9) sont applicables mutatis mutandis.
Naissance et durée de la protection
5. — 1) La protection de la topographie naît
1. à la date de la première exploitation commerciale non uniquement secrète de la topographie, si celle-ci fait l’objet d’une demande d’enregistrement déposée auprès de l’office des brevets dans les deux ans qui suivent cette exploitation, ou
2. à la date du dépôt auprès de l’office des brevets de la demande d’enregistrement de la topographie, si celle-ci n’a pas fait l’objet auparavant d’une exploitation commerciale autrement que d’une façon uniquement secrète.
2) La protection de la topographie vient à expiration à la fin de la 10e année civile qui suit l’année au cours de laquelle elle a pris effet.
3) N’est opposable à des tiers que la protection d’une topographie qui a fait l’objet d’une demande d’enregistrement déposée auprès de l’office des brevets.
4) Le droit à la protection de la topographie s’éteint lorsque, dans un délai de 15 ans à compter de la date de sa première fixation, la topographie n’a pas fait l’objet d’une

exploitation commerciale autrement que d’une façon uniquement secrète ou n’a pas été enregistrée auprès de l’office des brevets.
Effets de la protection
6. — 1) La protection de la topographie a pour effet que seul son titulaire est autorisé à exploiter la topographie. Il est interdit à tout tiers, sans le consentement du titulaire,
1. de reproduire la topographie;
2. d’offrir, de mettre dans le commerce ou de diffuser, ou d’importer aux fins précitées la topographie ou le produit semi-conducteur incorporant la topographie.
2) Les effets de la protection de la topographie ne s’étendent pas
1. aux actes accomplis dans un cadre privé et à des fins non commerciales;
2. à la reproduction de la topographie aux fins d’analyse, d’évaluation ou d’enseignement;
3. à l’exploitation commerciale d’une topographie créée à partir d’une analyse ou d’une évaluation visées au point 2 et qui est originale au sens de l’alinéa 2) de l’article premier.
3) Une personne qui acquiert un produit semi-conducteur sans savoir ou sans être fondée à croire qu’il contient une topographie protégée peut continuer à l’exploiter sans le consentement du titulaire de la protection. Dès que cette personne sait ou est fondée à croire qu’il existe une protection de la topographie, le titulaire de celle-ci peut exiger une indemnité adaptée aux circonstances pour la poursuite de l’exploitation commerciale du produit semi- conducteur.
Limitation des effets de la protection
7. — 1) La protection de la topographie n’est pas établie dans la mesure où une action en radiation peut être intentée par toute personne à l’encontre de la personne inscrite au registre en tant que titulaire (al. 1) et 3) de l’art. 8).
2) Lorsque le contenu essentiel de la demande d’enregistrement a été emprunté à la topographie d’un tiers sans son consentement, la protection conférée par la présente loi n’est pas opposable à la personne lésée. Les dispositions de la loi sur les brevets2 relatives au droit à la cession (art. 8) sont applicables mutatis mutandis.
Demande en radiation, procédure de radiation
8. — 1) Toute personne peut présenter dans une action dirigée contre la personne inscrite au registre comme titulaire une demande en radiation de la topographie lorsque
1. la topographie n’est pas susceptible de protection en vertu de l’article premier,

2. le déposant ou la personne inscrite comme titulaire n’est pas admis au bénéfice de la protection en vertu des alinéas 3) à 6) de l’article 2, ou
3. la demande d’enregistrement de la topographie n’a pas été déposée dans le délai prévu à l’alinéa 1), point 1, de l’article 5 ou l’a été à l’expiration du délai prévu à l’alinéa 4) de l’article 5.
2) Dans le cas visé à l’alinéa 2) de l’article 7, la radiation ne peut être demandée que par la personne lésée.
3) Si les motifs de radiation n’affectent la topographie qu’en partie, la radiation n’est opérée que dans la mesure correspondante.
4) La demande en radiation de la topographie fondée sur les alinéas 1) à 3) doit être présentée par écrit à l’office des brevets. Elle doit être motivée et accompagnée du paiement de la taxe prévue dans le barème; à défaut de ce paiement, la demande est réputée nulle et non avenue. Les dispositions de l’alinéa 7) de l’article 81 et de l’article 125 de la loi sur les brevets sont applicables mutatis mutandis.
5) Les dispositions de la loi sur les modèles d’utilité relatives à la procédure en nullité (art. 17) et aux effets de cette procédure sur l’objet d’un litige (art. 19) sont applicables mutatis mutandis.
Contrefaçon
9. — 1) La personne lésée par une atteinte à la protection de la topographie en violation de l’alinéa 1) de l’article 6 peut intenter une action en cessation contre l’auteur de cette atteinte. Si celui-ci a commis l’acte intentionnellement ou par négligence, il doit à la personne lésée réparation du dommage causé. S’il ne s’est rendu coupable que d’une négligence légère, le tribunal peut, au lieu d’allouer la réparation du dommage, fixer une indemnité dans les limites situées entre le préjudice subi par la personne lésée et le bénéfice réalisé par l’auteur de l’atteinte. Les dispositions de l’article 24c de la loi sur les modèles d’utilité s’appliquent mutatis mutandis.
2) Les dispositions de la loi sur les modèles d’utilité relatives à l’exigence de destruction (art. 24a), à l’obligation de renseignement concernant les tiers (art. 24b) et aux mesures prises par l’administration des douanes (art. 25a) s’appliquent mutatis mutandis.
Dispositions pénales
10. — 1) Est passible d’une peine d’emprisonnement de trois ans au maximum ou d’une amende celui qui
1. reproduit la topographie en violation du point 1 de la deuxième phrase de l’alinéa 1) de l’article 6, ou

2. offre, met dans le commerce, diffuse ou importe aux fins précitées la topographie ou le produit semi-conducteur incorporant la topographie, en violation du point 2 de la deuxième phrase de l’alinéa 1) de l’article 6.
2) Si l’auteur du délit agit à titre commercial, il est puni d’un emprisonnement ne dépassant pas cinq ans ou d’une amende.
3) La tentative de délit est punissable.
4) Dans les cas visés à l’alinéa 1), l’auteur du délit n’est poursuivi que sur plainte, à moins que le ministère public ne juge opportun de le poursuivre d’office en raison d’un intérêt public particulier.
5) Les dispositions de la loi sur les modèles d’utilité relatives à la confiscation (al. 5) de l’art. 25) s’appliquent mutatis mutandis.
6) En cas de condamnation, si la partie lésée le demande et démontre un intérêt légitime, le tribunal ordonne la publication du jugement. Les modalités de la publication sont fixées dans le jugement.
Application de dispositions de la loi sur les brevets et de la loi sur les modèles d’utilité
11. — 1) Les dispositions de la loi sur les brevets relatives à la formulation d’avis (al. 1) et 2) de l’art. 29), à la réintégration en l’état antérieur (art. 123), au devoir de vérité dans les procédures (art. 124), à la langue à utiliser devant l’Office des brevets (art. 126), aux notifications (art. 127) et à l’aide juridique des tribunaux (art. 128) sont applicables aussi en matière de protection des topographies.
2) Les dispositions de la loi sur les modèles d’utilité relatives à l’aide judiciaire (al. 2) de l’art. 21), à la cession et aux licences (art. 22), à la réduction de la valeur du litige (art. 26), aux litiges en matière de modèles d’utilité (art. 27), à la représentation dans le pays (art. 28), au pouvoir de rendre des ordonnances (art. 29) et à la mention d’une protection (art. 30) sont applicables mutatis mutandis.

26. Ne peuvent bénéficier de la protection les topographies qui ont été exploitées commercialement plus de deux ans avant l’entrée en vigueur de la présente loi autrement que d’une façon uniquement secrète. Quiconque a des droits découlant de la présente loi ne peut les faire valoir que pour des périodes postérieures à l’entrée en vigueur de celle-ci.
