Article 3(2)(5) of this Law indicates the protection of intellectual property rights, as one of the main principles of the publishing industry in Turkmenistan.
Article 4(1)(5) ensures the protection of authors’ rights and publishers’ rights, as one of the objectives of State policy in the field of publishing.
Article 8 provides for the rights and obligations of publishers, which include among others:
(i) right to acquire author’s moral and economic rights, including the right to use the works in foreign countries (Article 8(1)(4));
(ii) right to publish or republish a work subject to copyright protection within the period specified in the publishing contract (Article 8(1)(5));
(iii) duty to comply with the copyright rules as defined in the laws and regulations of Turkmenistan on publishing (Article 8(2)(4);
(iv) right to own intellectual property rights created during the process of preparing and producing printed works, which is represented by the copyright symbol © (a circled capital letter “C”), followed by the publisher’s name and the year of publication; and the duty to obtain permission from the authors or right holders in case the publishing activities involve the clean copies of works (Article 8(3)).
Article 11 defines the rights and obligations of customers of publishing products and authors (co-authors), compilers, translators who have the right to submit to the publishers for the editing, processing, producing and publishing the copyrighted works such as literary works, music works, translations, photographs, collections of works, collections of adaptions of folklore, etc. under conditions specified in the contracts according to the law.
Article 22(1) provides that the publishing contract is a written agreement signed between an author/a customer and a publisher, under which a publisher shall acquire the rights to publish and distribute a work in return for a remuneration.
Article 22(2) contains a non-exhaustive list of conditions in a publishing contract.
