The General Law on the Protection of the Rights of the Consumer or User provides general regulations for consumer protection. It establishes a National Consumer Rights Protection Institute (known as ''Pro-Consumidor''), a governmental agency that protects consumers from abuses.
The Law is divided into 5 chapters, including Chapter I on General Provisions; Chapter II on the National Consumer Rights Protection Institute (''Pro-Consumidor''); Chapter III on the Executive Director of Pro-Consumidor; Chapter IV on Consumer Rights; and Chapter V on Protection of Health and Safety.
The Law contains provisions regarding confidentiality of commercial or industrial secrets and exemptions to confidentiality, specified in Articles 3p, 25, 85 and 121.
Article 3p speaks of commercial and industrial secrets subject to the rules on confidentiality. Article 25 specifies that the Pro-Consumidor can disclose trade secrets submitted to it if the disclosure is deemed necessary for protecting consumers' health and safety. Article 85 sets out the minimum information requirements for product labels, among other, the information on trade names and geographical indications of product; except the trade secrets or secret formulas used in making products. Article 121 provides that the disclosure of trade secrets submitted to the Pro-Consumidor be authorized by the order of a court of competent authority.
