This Act establishes the International Trade Administration Commission and provides for its functions and procedures and for the implementation of certain aspects of the Southern African Customs Union (SACU) Agreement, and makes provisions, within the framework of the SACU Agreement, for control of import and export of goods and for amendment of customs duties.
The Act contains provisions on undisclosed information relating to trade, business or industrial information that (1) belongs to a person or the State; (2) has a particular economic value; and (3) is not generally available to or known by others and the disclosure of which could (a) result in a significant adverse effect on the owner, or on the person that provided the information; (b) give significant competitive advantage to a competitor of the owner (see Section 1(2), Chapter 1; Section 10 (1)(2), Part A, Chapter 3; Part D, Chapter 4); and Section 42(6)(7), Part E, Chapter 4).
