Erstreckung

Abschnitt 1

Erstreckung auf das in Artikel 3 des Einigungsvertrages genannte Gebiet

§ 1 Erstreckung von gewerblichen Schutzrechten und Schutzrechtsanmeldungen

(1) Die am 1. Mai 1992 in der Bundesrepublik Deutschland mit Ausnahme des in Artikel 3 des Einigungsvertrages genannten Gebiets bestehenden gewerblichen Schutzrechte (Patente, Gebrauchsmuster, Halbleiterschutzrechte, Warenzeichen und Dienstleistungsmarken) und Anmeldungen von solchen Schutzrechten werden unter Beibehaltung ihres Zeitrangs auf das in Artikel 3 des Einigungsvertrages genannten Gebiet erstreckt.

(2) Das gleiche gilt für die auf Grund internationaler Abkommen mit Wirkung für die Bundesrepublik Deutschland mit Ausnahme des in Artikel 3 des Einigungsvertrages genannten Gebiets eingereichten Anmeldungen und eingetragenen oder erteilten Schutzrechte.

§ 2 Löschung von eingetragenen Warenzeichen

(1) Die Löschung eines nach § 1 erstreckten Warenzeichens, das auf Grund einer in der Zeit vom 1. Juli bis zum Ablauf des 2. Oktober 1990 eingereichten Anmeldung eingetragen worden ist, kann ein Dritter nach § 11 Abs. 1 Nr. 1 des Warenzeichengesetzes auch dann beantragen, wenn das Zeichen für ihn auf Grund einer beim ehemaligen Patentamt der Deutschen Demokratischen Republik eingereichten Anmeldung mit älterem Zeitrang für gleiche oder gleichartige Waren oder Dienstleistungen eingetragen und nach § 4 erstreckt worden ist. Einer solchen Eintragung steht eine nach § 4 erstreckte international registrierte Marke nach dem Madrider Abkommen über die internationale Registrierung von Marken gleich.

(2) Absatz 1 ist auf Anträge auf Entziehung des Schutzes einer nach § 1 erstreckten international registrierten Marke gemäß § 10 der Verordnung über die internationale Registrierung von Fabrik- oder Handelsmarken entsprechend anzuwenden.

§ 3 Widerspruch gegen angemeldete Warenzeichen

(1) Gegen die Eintragung eines in der Zeit vom 1. Juli bis zum Ablauf des 2. Oktober 1990 beim Deutschen Patentamt angemeldeten Zeichens, das nach § 1 erstreckt worden ist, kann Widerspruch nach § 5 Abs. 4 oder § 6a Abs. 3 des Warenzeichengesetzes auch erheben, wer für gleiche oder gleichartige Waren oder Dienstleistungen ein mit dem angemeldeten Zeichen übereinstimmendes Zeichen (§ 31 des Warenzeichengesetzes) mit älterem Zeitrang, das nach § 4 erstreckt worden ist, beim ehemaligen Patentamt der Deutschen Demokratischen Republik angemeldet hat. Einer solchen Anmeldung steht eine nach § 4 erstreckte international registrierte Marke nach dem Madrider Abkommen über die internationale Registrierung von Marken gleich.

(2) Hat das Deutsche Patentamt ein in Absatz 1 genanntes Zeichen nach § 5 Abs. 2 des Warenzeichengesetzes bekanntgemacht und ist die Widerspruchsfrist nach § 5 Abs. 4 oder § 6a Abs. 3 des Warenzeichengesetzes am 1. Mai 1992 noch nicht abgelaufen, so kann Widerspruch auf Grund eines in Absatz 1 genannten früheren Zeichens noch bis zum Ablauf von drei Monaten nach diesem Zeitpunkt erhoben werden.

(3) Die Absätze 1 und 2 sind auf Widersprüche nach § 2 der Verordnung über die internationale Registrierung von Fabrik- oder Handelsmarken, die gegen eine nach § 1 erstreckte international registrierte Marke erhoben werden, entsprechend anzuwenden.

Abschnitt 2

Erstreckung der in dem in Artikel 3 des Einigungsvertrages genannten Gebiet bestehenden gewerblichen Schutzrechte auf das übrige Bundesgebiet

Unterabschnitt 1

Allgemeine Vorschriften

§ 4 Erstreckung von gewerblichen Schutzrechten und Schutzrechtsanmeldungen

(1) Die am 1. Mai 1992 in dem in Artikel 3 des Einigungsvertrages genannten Gebiet bestehenden gewerblichen Schutzrechte (Ausschließungspatente und Wirtschaftspatente, Marken) und Anmeldungen von solchen Schutzrechten werden unter Beibehaltung ihres Zeitrangs auf das übrige Bundesgebiet erstreckt.

(2) Das gleiche gilt für die auf Grund internationaler Abkommen mit Wirkung für das in Artikel 3 des Einigungsvertrages genannte Gebiet eingereichten Anmeldungen und eingetragenen oder erteilten Schutzrechte.

(3) Für Herkunftsangaben, die mit Wirkung für das in Artikel 3 des Einigungsvertrages genannte Gebiet eingetragen oder angemeldet sind, gelten die §§ 33 bis 38.

§ 5 Anzuwendendes Recht

Unbeschadet der nachfolgenden Bestimmungen sind auf die nach § 4 erstreckten gewerblichen Schutzrechte und Schutzrechtsanmeldungen die bisher für sie geltenden Rechtsvorschriften (Anlage I Kapitel III Sachgebiet E Abschnitt II Nr. 1 § 3 Abs. 1 des Einigungsvertrages vom 31. August 1990, BGBl. 1990 II S. 885, 961) nur noch anzuwenden, soweit es sich um die Voraussetzungen der Schutzfähigkeit und die Schutzdauer handelt. Im übrigen unterliegen sie den mit dem Einigungsvertrag übergeleiteten Vorschriften des Bundesrechts.

Unterabschnitt 2

Besondere Vorschriften für Patente

§ 6 Wirkung erteilter Patente

Die Erteilung eines Patents nach den Rechtsvorschriften der Deutschen Demokratischen Republik steht der Veröffentlichung der Erteilung des Patents nach § 58 Abs. 1 des Patentgesetzes gleich.

§ 6a Patentdauer

Die Dauer der nach § 4 erstreckten Patente, die am 31. Dezember 1995 noch nicht abgelaufen sind, beträgt 20 Jahre, die mit dem auf die Anmeldung folgenden Tag beginnen.

§ 7 Wirtschaftspatente

(1) Nach § 4 erstreckte Wirtschaftspatente gelten als Patente, für die eine Lizenzbereitschaftserklärung nach § 23 Abs. 1 Satz 1 des Patentgesetzes abgegeben worden ist. Dies gilt auch für Wirtschaftspatente, die auf Grund des Abkommens vom 18. Dezember 1976 über die gegenseitige Anerkennung von Urheberscheinen und anderen Schutzdokumenten für Erfindungen (GBl. II Nr. 15 S. 327) mit Wirkung für das in Artikel 3 des Einigungsvertrages genannte Gebiet anerkannt worden sind.

(2) Der Inhaber eines auf das Vorliegen aller Schutzvoraussetzungen geprüften Patents kann zu jedem Zeitpunkt schriftlich gegenüber dem Deutschen Patent- und Markenamt erklären, daß die Lizenzbereitschaftserklärung nach Absatz 1 als widerrufen gelten soll. Ein Hinweis auf diese Erklärung wird im Patentblatt veröffentlicht. Wird der Unterschiedsbetrag nicht innerhalb der Frist des Satzes 2 gezahlt, so kann er mit dem Verspätungszuschlag noch bis zum Ablauf einer Frist von weiteren vier Monaten gezahlt werden. § 17 Abs. 3 Satz 2 und 3 des Patentgesetzes ist entsprechend anzuwenden mit der Maßgabe, daß an die Stelle der Fälligkeit der Ablauf der Monatsfrist des Satzes 3 tritt.

(3) Wer vor der Veröffentlichung des Hinweises auf die Erklärung nach Absatz 2 Satz 2 dem Patentinhaber die Absicht mitgeteilt hat, die Erfindung zu benutzen, und diese in Benutzung genommen oder die zur Benutzung erforderlichen Veranstaltungen getroffen hat, bleibt auch weiterhin zur Benutzung in der von ihm in der Anzeige angegebenen Weise berechtigt.

§ 8 Nicht in deutscher Sprache vorliegende Patente

(1) Ist ein nach § 4 erstrecktes Patent nicht in deutscher Sprache veröffentlicht worden, so kann der Patentinhaber die Rechte aus dem Patent erst von dem Tag an geltend machen, an dem eine von ihm eingereichte deutsche Übersetzung der Patentschrift auf seinen Antrag vom Deutschen Patentamt veröffentlicht worden ist.

(2) Ein Hinweis auf die Veröffentlichung der Übersetzung ist im Patentblatt zu veröffentlichen und im Patentregister zu vermerken.

(3) Ist die Übersetzung der Patentschrift fehlerhaft, so kann der Patentinhaber die Veröffentlichung einer von ihm eingereichten berichtigten Übersetzung beantragen. Absatz 2 ist entsprechend anzuwenden.

(4) Der Wortlaut der Patentschrift stellt die verbindliche Fassung dar. Ist die Übersetzung der Patentschrift fehlerhaft, so darf derjenige, der in gutem Glauben die Erfindung in Benutzung genommen oder wirkliche und ernsthafte Veranstaltungen zur Benutzung der Erfindung getroffen hat, auch nach Veröffentlichung der berichtigten Übersetzung die Benutzung für die Bedürfnisse seines eigenen Betriebs in eigenen oder fremden Werkstätten im gesamten Bundesgebiet unentgeltlich fortsetzen, wenn die Benutzung keine Verletzung des Patents in der fehlerhaften Übersetzung der Patentschrift darstellen würde.

§ 9 Benutzungsrechte an Ausschließungspatenten

Das in Artikel 3 Abs. 4 Satz 1 des Gesetzes zur Änderung des Patentgesetzes und des Gesetzes über Warenkennzeichen der Deutschen Demokratischen Republik vom 29. Juni 1990 (GBl. I Nr. 40 S. 571) vorgesehene Recht, eine durch ein in ein Ausschließungspatent umgewandeltes Wirtschaftspatent geschützte Erfindung weiterzubenutzen, bleibt bestehen und wird auf das übrige Bundesgebiet erstreckt. Der Patentinhaber hat Anspruch auf eine angemessene Vergütung.

§ 10 Patentanmeldungen

(1) Ist für eine nach § 4 erstreckte Patentanmeldung eine der Offensichtlichkeitsprüfung nach § 42 des Patentgesetzes entsprechende Prüfung noch nicht erfolgt, so ist die Offensichtlichkeitsprüfung nachzuholen.

(2) Liegt die Anmeldung nicht in deutscher Sprache vor, so fordert das Deutsche Patent- und Markenamt den Anmelder auf, eine deutsche Fassung der Anmeldung innerhalb von drei Monaten nachzureichen. Wird die deutsche Fassung nicht innerhalb der Frist vorgelegt, so gilt die Anmeldung als zurückgenommen.

(3) Bei einer nach § 4 erstreckten Patentanmeldung wird, sofern die Erteilung des Patents noch nicht beschlossen worden ist, die freie Einsicht in die Akten nach § 31 Absatz 2 Satz 1 Nummer 2 des Patentgesetzes gewährt und die Anmeldung als Offenlegungsschrift veröffentlicht.

(4) Ist für eine nach § 4 erstreckte Patentanmeldung ein Prüfungsantrag wirksam gestellt worden, so wird er weiterbehandelt. Ist die Prüfung von Amts wegen begonnen worden, so wird die Prüfung nur fortgesetzt, wenn der Anmelder den Prüfungsantrag nach § 44 Abs. 1 und 2 des Patentgesetzes stellt.

§ 11 Recherche

Auf Antrag des Patentinhabers oder eines Dritten ermittelt das Deutsche Patentamt zu einem nach § 4 erstreckten Patent die öffentlichen Druckschriften, die für die Beurteilung der Patentfähigkeit der Erfindung in Betracht zu ziehen sind (Recherche). § 43 Abs. 3 bis 6 und 7 Satz 1 des Patentgesetzes ist entsprechend anzuwenden.

§ 12 Prüfung erteilter Patente

(1) Ein nach § 4 erstrecktes Patent, das nicht auf das Vorliegen aller Schutzvoraussetzungen geprüft ist, wird auf Antrag von der Prüfungsstelle des Deutschen Patent- und Markenamt geprüft. Der Antrag kann vom Patentinhaber und jedem Dritten gestellt werden. § 44 Abs. 1, 2 und 4 Satz 1 und § 45 des Patentgesetzes sind entsprechend anzuwenden; § 44 Abs. 3 Satz 1 und 2 des Patentgesetzes ist entsprechend anzuwenden, wenn ein Antrag nach § 11 gestellt worden ist.

(2) Ein für ein nach § 4 erstrecktes Patent bereits wirksam gestellter Prüfungsantrag wird von der Prüfungsstelle weiterbehandelt. Eine von Amts wegen bereits begonnene Prüfung eines Patents wird fortgesetzt.

(3) Die Prüfung nach den Absätzen 1 und 2 führt zur Aufrechterhaltung oder zum Widerruf des Patents. § 58 Abs. 1 Satz 1 und 2 des Patentgesetzes ist entsprechend anzuwenden. Gegen die Aufrechterhaltung kann Einspruch nach § 59 des Patentgesetzes erhoben werden.

(4) Auf Patente im Sinne des Absatzes 1 ist § 81 Abs. 2 des Patentgesetzes nicht anzuwenden.

(5) § 130 des Patentgesetzes ist auf Prüfungsverfahren nach den Absätzen 1 und 2 entsprechend anzuwenden.

§ 13 Einspruchsverfahren in besonderen Fällen

Ist vom Deutschen Patentamt ein nach § 4 erstrecktes Patent nach § 18 Abs. 1 oder 2 des Patentgesetzes der Deutschen Demokratischen Republik bestätigt oder erteilt worden, so kann bis zum Ablauf des 31. Juli 1992 noch Einspruch beim Deutschen Patentamt erhoben werden. Die §§ 59 bis 62 des Patentgesetzes sind anzuwenden.

§ 14 Überleitung von Berichtigungsverfahren

Berichtigungsverfahren nach § 19 des Patentgesetzes der Deutschen Demokratischen Republik, die am 1. Mai 1992 beim Deutschen Patentamt noch anhängig sind, werden in der Lage, in der sie sich befinden, als Beschränkungsverfahren nach § 64 des Patentgesetzes weitergeführt.

§ 15 Abzweigung

(1) Die Erklärung nach § 5 Abs. 1 Satz 1 des Gebrauchsmustergesetzes kann auch in bezug auf nach § 4 erstreckte Patente oder Patentanmeldungen abgegeben werden. Dies gilt nicht für Patente, die vom ehemaligen Patentamt der Deutschen Demokratischen Republik nach Prüfung auf das Vorliegen aller Schutzvoraussetzungen erteilt oder bestätigt worden sind.

(2) Bei den in Absatz 1 genannten Patenten kann die Erklärung bis zum Ablauf von zwei Monaten nach dem Ende des Monats, in dem ein etwaiges Prüfungsverfahren oder ein etwaiges Einspruchsverfahren abgeschlossen ist, jedoch längstens bis zum Ablauf des zehnten Jahres nach dem Anmeldetag des Patents abgegeben werden.

(3) Rechte nach § 9 oder auf Grund von § 7 Abs. 1 und 3, die Erfindung gegen Zahlung einer angemessenen Vergütung zu benutzen, und Weiterbenutzungsrechte nach § 28 gelten auch gegenüber einem nach Absatz 1 abgezweigten Gebrauchsmuster.

(1) Die Löschung einer nach § 4 erstreckten Marke erfolgt von Amts wegen oder auf Antrag nach § 10 Abs. 2 Nr. 2 des Warenzeichengesetzes nur dann, wenn die Marke sowohl nach den bisher anzuwendenden Rechtsvorschriften als auch nach den Vorschriften des Warenzeichengesetzes nicht schutzfähig ist.

(2) Absatz 1 ist auf Anträge auf Entziehung des Schutzes einer nach § 4 erstreckten international registrierten Marke gemäß § 10 der Verordnung über die internationale Registrierung von Fabrik- oder Handelsmarken entsprechend anzuwenden.

§ 21 Löschung eingetragener Marken nach § 11 des Warenzeichengesetzes

(1) Die Löschung einer nach § 4 erstreckten Marke, die auf Grund einer in der Zeit vom 1. Juli bis zum Ablauf des 2. Oktober 1990 eingereichten Anmeldung eingetragen worden ist, kann ein Dritter nach § 11 Abs. 1 Nr. 1 des Warenzeichengesetzes auch dann beantragen, wenn das Zeichen für ihn auf Grund einer Anmeldung mit älterem Zeitrang für gleiche oder gleichartige Waren in der Zeichenrolle eingetragen steht und nach § 1 erstreckt worden ist. Einer solchen Eintragung steht eine nach § 1 erstreckte international registrierte Marke nach dem Madrider Abkommen über die internationale Registrierung von Marken gleich.

(2) Absatz 1 ist auf Anträge auf Entziehung des Schutzes einer nach § 4 erstreckten international registrierten Marke gemäß § 10 der Verordnung über die internationale Registrierung von Fabrik- oder Handelsmarken entsprechend anzuwenden.

§ 22 Prüfung angemeldeter Marken

(1) Auf nach § 4 erstreckte Markenanmeldungen sind die Vorschriften des Warenzeichengesetzes anzuwenden, soweit nachfolgend nichts anderes bestimmt ist.

(2) Die Versagung der Eintragung kann nicht darauf gestützt werden, daß es sich bei dem angemeldeten Zeichen um eine nach dem Warenzeichengesetz nicht eintragbare Markenform handelt.

(3) Die Absätze 1 und 2 sind auf nach § 4 erstreckte international registrierte Marken nach dem Madrider Abkommen über die internationale Registrierung von Marken entsprechend anzuwenden.

§ 23 Bekanntmachung angemeldeter Marken, Widerspruch

(1) Nach § 4 erstreckte Markenanmeldungen werden, auch soweit eine Prüfung nach den bisher anzuwendenden Rechtsvorschriften bereits stattgefunden hat, nach § 5 Abs. 2 oder § 6a Abs. 3 des Warenzeichengesetzes bekanntgemacht.

(2) Gegen die Eintragung der in Absatz 1 genannten angemeldeten Zeichen kann nach § 5 Abs. 4 Satz 1 Nr. 1 des Warenzeichengesetzes Widerspruch nur erheben,

1. wer für gleiche oder gleichartige Waren oder Dienstleistungen ein mit dem angemeldeten Zeichen übereinstimmendes Zeichen (§ 31 des Warenzeichengesetzes) mit älterem Zeitrang, das nach § 4 erstreckt worden ist, beim ehemaligen Patentamt der Deutschen Demokratischen Republik angemeldet hat oder

2. wer, soweit das bekanntgemachte Zeichen in der Zeit vom 1. Juli bis zum Ablauf des 2. Oktober 1990 beim ehemaligen Patentamt der Deutschen Demokratischen Republik angemeldet worden ist, für gleiche oder gleichartige Waren ein mit dem angemeldeten Zeichen übereinstimmendes Zeichen (§ 31 des Warenzeichengesetzes) mit älterem Zeitrang, das nach § 1 erstreckt worden ist, beim Deutschen Patentamt angemeldet hat.

Den in Nummer 1 und Nummer 2 bezeichneten früheren Anmeldungen stehen nach § 1 oder § 4 erstreckte international registrierte Marken nach dem Madrider Abkommen über die internationale Registrierung von Marken gleich.

(3) Die Absätze 1 und 2 sind auf Widersprüche nach § 2 der Verordnung über die internationale Registrierung von Fabrik- oder Handelsmarken, die gegen eine nach § 4 erstreckte international registrierte Marke erhoben werden, entsprechend anzuwenden.

§ 24 Schutzdauer

Auf die Berechnung der Dauer des Schutzes von nach § 4 erstreckten Marken ist § 9 Abs. 1 des Warenzeichengesetzes anzuwenden.

§ 25 Übertragung einer Marke, Warenzeichenverbände

(1) Eine vor dem 1. Mai 1992 vorgenommene Übertragung der sich aus einer Marke oder Markenanmeldung, die nach § 4 erstreckt worden ist, ergebenden Rechte ist abweichend von § 17 Abs. 1 Satz 2 des Gesetzes über Warenkennzeichen vom 30. November 1984 (GBl. I Nr. 33 S. 397), das durch Artikel 2 des Gesetzes vom 29. Juni 1990 (GBl. I Nr. 40 S. 571) geändert worden ist, auch ohne entsprechende Eintragung in Register wirksam.

(2) Die Löschung eines nach § 1 erstreckten Verbandszeichens oder einer nach § 4 erstreckten Kollektivmarke oder die Versagung der Eintragung eines solchen Zeichens kann nicht darauf gestützt werden, daß der Verband, für den das Zeichen eingetragen oder angemeldet ist, nicht rechtsfähig ist, wenn dieser am 1. Mai 1992 in das Verbandsregister nach § 7 des Gesetzes über Warenkennzeichen eingetragen war und er oder derjenige, dem das durch die Anmeldung oder Eintragung des Zeichens begründete Recht von dem Verband übertragen worden ist, dem Deutschen Patentamt bis zum Ablauf des 30. April 1993 nachweist, daß er die Voraussetzungen für die Anmeldung eines Verbandszeichens nach § 17 Abs. 1 oder 2 und § 18 Satz 1 des Warenzeichengesetzes erfüllt; § 20 des Warenzeichengesetzes ist insoweit nicht anzuwenden.

Unterabschnitt 1

Erfindungen

§ 26 Zusammentreffen von Rechten

(1) Soweit Patente, Patentanmeldungen oder Gebrauchsmuster, die nach diesem Gesetz auf das in Artikel 3 des Einigungsvertrages genannte Gebiet oder das übrige Bundesgebiet erstreckt werden, in ihrem Schutzbereich übereinstimmen und infolge der Erstreckung zusammentreffen, können die Inhaber dieser Schutzrechte oder Schutzrechtsanmeldungen ohne Rücksicht auf deren Zeitrang Rechte aus den Schutzrechten oder Schutzrechtsanmeldungen weder gegeneinander noch gegen die Personen, denen der Inhaber des anderen Schutzrechts oder der anderen Schutzrechtsanmeldung die Benutzung gestattet hat, geltend machen.

(2) Der Gegenstand des Schutzrechts oder der Schutzrechtsanmeldung darf jedoch in dem Gebiet, auf das das Schutzrecht oder die Schutzrechtsanmeldung erstreckt worden ist, nicht oder nur unter Einschränkung benutzt werden, soweit die uneingeschränkte Benutzung zu einer wesentlichen Beeinträchtigung des Inhabers des anderen Schutzrechts oder der anderen Schutzrechtsanmeldung oder der Personen, denen er die Benutzung des Gegenstands seines Schutzrechts oder seiner Schutzrechtsanmeldung gestattet hat, führen würde, die unter Berücksichtigung aller Umstände des Falles und bei Abwägung der berechtigten Interessen der Beteiligten unbillig wäre.

§ 27 Vorbenutzungsrechte

(1) Ist die Wirkung eines nach § 1 oder § 4 erstreckten Patents oder Gebrauchsmusters durch ein Vorbenutzungsrecht eingeschränkt (§ 12 des Patentgesetzes, § 13 Abs. 3 des Gebrauchsmustergesetzes, § 13 Abs. 1 des Patentgesetzes der Deutschen Demokratischen Republik), so gilt dieses Vorbenutzungsrecht mit den sich aus § 12 des Patentgesetzes ergebenden Schranken im gesamten Bundesgebiet.

(2) Absatz 1 ist entsprechend anzuwenden, wenn die Voraussetzungen für die Anerkennung eines Vorbenutzungsrechts in dem Gebiet vorliegen, in dem das Schutzrecht bisher nicht galt.

§ 28 Weiterbenutzungsrechte

(1) Die Wirkung eines nach § 1 oder § 4 erstreckten Patents oder Gebrauchsmusters tritt gegen denjenigen nicht ein, der die Erfindung in dem Gebiet, in dem das Schutzrecht bisher nicht galt, nach dem für den Zeitrang der Anmeldung maßgeblichen Tag und vor dem 1. Juli 1990 rechtmäßig in Benutzung genommen hat. Dieser ist befugt, die Erfindung im gesamten Bundesgebiet für die Bedürfnisse seines eigenen Betriebs in eigenen oder fremden Werkstätten mit den sich aus § 12 des Patentgesetzes ergebenden Schranken auszunutzen, soweit die Benutzung nicht zu einer wesentlichen Beeinträchtigung des Inhabers des Schutzrechts oder der Personen, denen er die Benutzung des Gegenstandes seines Schutzrechts gestattet hat, führt, die unter Berücksichtigung aller Umstände des Falles und bei Abwägung der berechtigten Interessen der Beteiligten unbillig wäre.

(2) Bei einem im Ausland hergestellten Erzeugnis steht dem Benutzer ein Weiterbenutzungsrecht nach Absatz 1 nur zu, wenn durch die Benutzung im Inland ein schutzwürdiger Besitzstand begründet worden ist, dessen Nichtanerkennung unter Berücksichtigung aller Umstände des Falles für den Benutzer eine unbillige Härte darstellen würde.

§ 29 Zusammentreffen mit Benutzungsrechten nach § 23 des Patentgesetzes

Soweit Patente oder Patentanmeldungen, für die eine Lizenzbereitschaftserklärung nach § 23 des Patentgesetzes abgegeben worden ist oder nach § 7 als abgegeben gilt, mit Patenten, Patentanmeldungen oder Gebrauchsmustern in ihrem Schutzbereich übereinstimmen und infolge der Erstreckung nach diesem Gesetz zusammentreffen, können die Inhaber der zuletzt genannten Patente, Patentanmeldungen oder Gebrauchsmuster die Rechte aus diesen Schutzrechten oder Schutzrechtsanmeldungen ohne Rücksicht auf deren Zeitrang gegen denjenigen geltend machen, der nach § 23 Abs. 3 Satz 4 des Patentgesetzes berechtigt ist, die Erfindung zu benutzen. § 28 bleibt unberührt.

Unterabschnitt 2

Warenzeichen, Marken und sonstige Kennzeichen

§ 30 Warenzeichen und Marken

(1) Trifft ein Warenzeichen, das nach § 1 auf das in Artikel 3 des Einigungsvertrages genannte Gebiet erstreckt wird, infolge der Erstreckung mit einer übereinstimmenden Marke zusammen, die nach § 4 auf das übrige Bundesgebiet erstreckt wird, so darf jedes der Zeichen in dem Gebiet, auf das es erstreckt wird, nur mit Zustimmung des Inhabers des anderen Zeichens benutzt werden.

(2) Das Zeichen darf auch ohne Zustimmung des Inhabers des anderen Zeichens in dem Gebiet, auf das es erstreckt wird, benutzt werden

1. zur Werbung in öffentlichen Bekanntmachungen oder in Mitteilungen, die für einen größeren Kreis von Personen bestimmt sind, wenn die Verbreitung dieser öffentlichen Bekanntmachungen oder Mitteilungen nicht in zumutbarer Weise auf das Gebiet beschränkt werden kann, in dem das Zeichen bisher schon galt,

2. wenn der Inhaber des Zeichens glaubhaft macht, daß ihm nach den Vorschriften des Vermögensgesetzes ein Anspruch auf Rückübertragung des anderen Zeichens oder des Unternehmens, zu dem das andere Zeichen gehört, zusteht,

3. soweit sich der Ausschluß von der Benutzung des Zeichens in diesem Gebiet unter Berücksichtigung aller Umstände des Falles und bei Abwägung der berechtigten Interessen der Beteiligten und der Allgemeinheit als unbillig erweist.

(3) In den Fällen des Absatzes 2 Nr. 1 und 3 kann der Zeicheninhaber von demjenigen, der das andere Zeichen benutzt, eine angemessene Entschädigung verlangen, soweit er durch die Benutzung über das zumutbare Maß hinaus beeinträchtigt wird.

(4) Erweist sich im Falle des Absatzes 2 Nr. 2 der Rückübertragungsanspruch als unbegründet, so ist der Inhaber des Warenzeichens verpflichtet, den Schaden zu ersetzen, der dem Inhaber der übereinstimmenden Marke dadurch entstanden ist, daß das Zeichen in dem Gebiet, auf das es erstreckt worden ist, ohne seine Zustimmung benutzt worden ist.

§ 31 Sonstige Kennzeichenrechte

Treffen Warenzeichen oder Marken, die nach diesem Gesetz auf das in Artikel 3 des Einigungsvertrages genannte Gebiet oder auf das übrige Bundesgebiet erstreckt werden, infolge der Erstreckung mit einem Namen, einer Firma, einer besonderen Bezeichnung eines Unternehmens oder einem sonstigen durch Benutzung erworbenen Kennzeichenrecht zusammen, so ist § 30 entsprechend anzuwenden.

§ 32 Weiterbenutzungsrecht

Die Wirkung einer nach § 4 auf das übrige Bundesgebiet erstreckten eingetragenen Marke oder Markenanmeldung, die nach § 1 oder § 4 Abs. 1 oder Abs. 2 Nr. 1 des Warenzeichengesetzes von der Eintragung ausgeschlossen wäre, tritt gegen denjenigen nicht ein, der ein mit der Marke übereinstimmendes Zeichen für gleiche oder gleichartige Waren oder Dienstleistungen im übrigen Bundesgebiet bereits vor dem 1. Juli 1990 rechtmäßig benutzt hat. Dieser ist befugt, das Zeichen im gesamten Bundesgebiet zu benutzen, soweit die Benutzung nicht zu einer wesentlichen Beeinträchtigung des Markeninhabers oder der Personen, denen er die Benutzung der Marke gestattet hat, führt, die unter Berücksichtigung aller Umstände des Falles und bei Abwägung der berechtigten Interessen der Beteiligten und der Allgemeinheit unbillig wäre.

Teil 2

Umwandlung von Herkunftsangaben in Verbandszeichen

§ 33 Umwandlung

(1) Die in das Register für Herkunftsangaben eingetragenen Herkunftsangaben und die zur Eintragung in dieses Register angemeldeten Herkunftsangaben werden auf Antrag gemäß den nachfolgenden Bestimmungen in Verbandszeichen (§§ 17 bis 23 des Warenzeichengesetzes) umgewandelt.

(2) Die in Verbandszeichen umgewandelten Herkunftsangaben erhalten im übrigen Bundesgebiet denselben Zeitrang wie in dem in Artikel 3 des Einigungsvertrages genannten Gebiet.

§ 34 Antrag auf Umwandlung

(1) Der Antrag auf Umwandlung kann nur von den in § 17 des Warenzeichengesetzes aufgeführten rechtsfähigen Verbänden oder juristischen Personen des öffentlichen Rechts gestellt werden.

(2) Der Antrag auf Umwandlung ist bis zum Ablauf des 30. April 1993 zu stellen. Der Antrag ist gebührenfrei. Gegen die Versäumung der Frist findet keine Wiedereinsetzung in den vorigen Stand statt.

(3) Wird der Antrag nicht innerhalb der in Absatz 2 genannten Frist gestellt, so erlischt das Recht aus der Eintragung in das Register für Herkunftsangaben oder das mit der Anmeldung der Herkunftsangabe begründete Recht. Das Erlöschen ist in dem Register oder in den Akten der Anmeldung zu vermerken.

(4) Das Erlöschen von Rechten gemäß Absatz 3 beeinträchtigt nicht die Befugnis, Ansprüche hinsichtlich der betroffenen Herkunftsangaben nach den allgemeinen Vorschriften geltend zu machen.

§ 35 Anwendung des Warenzeichengesetzes

Der Antrag auf Umwandlung wird, soweit nachfolgend nichts anders bestimmt ist, als Anmeldung eines Verbandszeichens nach den §§ 17 bis 23 des Warenzeichengesetzes behandelt.

§ 36 Zusammentreffen von umgewandelten Herkunftsangaben und Warenzeichen

Die §§ 2 und 3, 20 bis 24 und 30 bis 32 sind auf Anträge auf Umwandlung von Herkunftsangaben in Verbandszeichen und als Verbandszeichen eingetragene umgewandelte Herkunftsangaben entsprechend anzuwenden.

§ 37 Schutzfähigkeit umgewandelter Herkunftsangaben

Liegen die Voraussetzungen für die Eintragung eines Verbandszeichens im übrigen vor, so kann die Umwandlung einer eingetragenen oder angemeldeten Herkunftsangabe in ein Verbandszeichen nicht mit der Begründung abgelehnt werden, daß es sich nicht um eine Herkunftsangabe handelt, es sei denn, daß die Bezeichnung ihre ursprüngliche Bedeutung als geographische Angabe verloren hat und von den in Betracht kommenden Verkehrskreisen im gesamten Bundesgebiet ausschließlich als Warenname oder als Bezeichnung einer Sorte oder Art eines Erzeugnisses aufgefaßt wird.

§ 38 Weiterbenutzungsrecht

(1) Trifft eine in ein Verbandszeichen umgewandelte Herkunftsangabe im übrigen Bundesgebiet auf eine übereinstimmende Bezeichnung, die dort vor dem 1. Juli 1990 rechtmäßig als Gattungsbezeichnung benutzt worden ist, so darf die Bezeichnung zur Kennzeichnung von Waren oder Verpackungen oder in Ankündigungen, Preislisten, Geschäftsbriefen, Empfehlungen, Rechnungen und dergleichen noch bis zum Ablauf von zwei Jahren nach der Eintragung des Verbandszeichens benutzt werden. Nach Ablauf dieser Frist noch vorhandene, so gekennzeichnete Waren oder Verpackungen oder vorhandene Ankündigungen, Preislisten, Geschäftsbriefe, Empfehlungen, Rechnungen oder dergleichen dürfen noch bis zum Ablauf von weiteren zwei Jahren abgesetzt und aufgebraucht werden.

(2) Trifft eine in ein Verbandszeichen umgewandelte Herkunftsangabe im übrigen Bundesgebiet auf eine übereinstimmende Bezeichnung, die dort vor dem 1. Juli 1990 rechtmäßig von einem Unternehmen benutzt worden ist, das hinsichtlich der Benutzung dieser Bezeichnung die Tradition eines ursprünglich in dem in Artikel 3 des Einigungsvertrages genannten Gebiet ansässigen Geschäftsbetriebs fortführt, so ist Absatz 1 entsprechend anzuwenden mit der Maßgabe, daß die Frist zur Weiterbenutzung nach Satz 1 zehn Jahre beträgt.

§ 49 Arbeitnehmererfindungen

Auf Erfindungen, die vor dem 3. Oktober 1990 in dem in Artikel 3 des Einigungsvertrages genannten Gebiet gemacht worden sind, sind die Vorschriften des Gesetzes über Arbeitnehmererfindungen über das Entstehen und die Fälligkeit des Vergütungsanspruchs bei unbeschränkter Inanspruchnahme einer Diensterfindung, soweit bis zum 1. Mai 1992 der Vergütungsanspruch noch nicht entstanden ist, sowie die Vorschriften über das Schiedsverfahren und das gerichtliche Verfahren anzuwenden. Im übrigen verbleibt es bei den bisher für sie geltenden Vorschriften (Anlage I Kapitel III Sachgebiet E Abschnitt II Nr. 1 § 11 des Einigungsvertrages vom 31. August 1990, BGBl. 1990 II S. 885, 962).

§ 50 Überleitung von Schlichtungsverfahren

Verfahren, die am 1. Mai 1992 bei der Schlichtungsstelle für Vergütungsstreitigkeiten des Deutschen Patentamts noch anhängig sind, gehen in der Lage, in der sie sich befinden, auf die beim Deutschen Patentamt nach dem Gesetz über Arbeitnehmererfindungen errichtete Schiedsstelle über.

§ 51 Überleitung von Beschwerde- und Nichtigkeitsverfahren

(1) Verfahren, die am 1. Mai 1992 bei einer Beschwerdespruchstelle oder einer Spruchstelle für Nichtigerklärung des Deutschen Patentamts noch anhängig sind, gehen in der Lage, in der sie sich befinden, auf das Bundespatentgericht über.

(2) Verfahren, die am 1. Mai 1992 bei einer Spruchstelle für die Löschung von Warenkennzeichen des Deutschen Patentamts noch anhängig sind, werden von der Warenzeichenabteilung des Deutschen Patentamts fortgeführt.

§ 52 Fristen

Ist Gegenstand des Verfahrens ein nach § 4 erstrecktes Schutzrecht oder eine nach § 4 erstreckte Schutzrechtsanmeldung, so richtet sich der Lauf einer verfahrensrechtlichen Frist, der vor dem 1. Mai 1992 begonnen hat, nach den bisher anzuwendenden Rechtsvorschriften.

§ 53 Gebühren

(1) Gebühren für nach § 4 erstreckte Schutzrechte und Schutzrechtsanmeldungen, die vor dem 1. Mai 1992 fällig geworden sind, sind nach den bisher anzuwendenden Rechtsvorschriften zu entrichten.

(2) Ist eine Gebühr, die ab dem 1. Mai 1992 fällig wird, bereits vor diesem Zeitpunkt nach den bisherigen Gebührensätzen wirksam entrichtet worden, so gilt die Gebührenschuld als getilgt.

§ 54 Anwendung des Gesetzes gegen den unlauteren Wettbewerb und sonstiger Rechtsvorschriften

Die Anwendung des Gesetzes gegen den unlauteren Wettbewerb und der allgemeinen Vorschriften über den Erwerb oder die Ausübung von Rechten, wie insbesondere über den Rechtsmißbrauch, wird durch die Bestimmungen dieses Gesetzes nicht berührt.

§ 55 Inkrafttreten

Dieses Gesetz tritt am ersten Tage des auf die Verkündung folgenden Kalendermonats in Kraft.

Extension of Industrial Property Rights
and of Applications for Industrial
Property Rights
1.-
(1) The industrial property rights (patents, utility models, semiconductor rights, industrial designs and type faces, trademarks and service marks) and the applications for such rights already existing on May 1, 1992, in the Federal Republic of Germany, with the exception of the territory designated in Article 3 of the Unification Treaty, shall extend to the territory designated in Article 3 of the Unification Treaty and shall maintain their priority.
(2) The same shall apply to applications filed and rights that have been registered or granted on the basis of international agreements with effect for the Federal Republic of Germany, with the exception of the territory designated in Article 3 of the Unification Treaty.
Cancellation of Registered Trademarks
2.-
(1) A third party may also request cancellation under Section 11(1), item 1, of the Trademark Law of a trademark extended under Section 1 that has been registered on the basis of an application filed during the period from July 1 to October 2, 1990, inclusive, if the mark has been registered in his name on the basis of an application with earlier priority filed with the former Patent Office of the German Democratic Republic for the same or similar goods or services and has been extended under Section 4. Such registration shall have the same status as an internationally registered mark under the Madrid Agreement concerning the International Registration of Marks that has been extended under Section 4.
(2) Subsection (1) shall apply mutatis mutandis to requests for withdrawal of protection under Section 10 of the Ordinance on the International Registration of Trademarks from an internationally registered mark extended under Section 1.

(1) Opposition under Section 5(4) or Section 6a(3) of the Trademark Law against the registration of a mark filed with the German Patent Office between July 1 and October 2, 1990, inclusive, that has been extended under Section 1, may be lodged by any person who has filed an application with the former Patent Office of the German Democratic Republic with earlier priority, for the same or similar goods or services and which is the same as the mark applied for (Section 31 of the Trademark Law), that has been extended under Section 4. Such application shall have the same status as an internationally registered mark under the Madrid Agreement Concerning the International Registration of Marks that has been extended under Section 4.
(2) Where the German Patent Office has published a mark as referred to in subsection (1) in accordance with Section 5(2) of the Trademark Law and if the time limit for opposition under Section 5(4) or Section 6a(3) of the Trademark Law has not expired on May 1, 1992, opposition may be lodged on the basis of an earlier mark as referred to in subsection (1) within three months of that date.
(3) Subsections (1) and (2) shall apply mutatis mutandis to opposition under Section 2 of the Ordinance on the International Registration of Trademarks lodged against an internationally registered mark extended under Section 1.

Chapter 2
Extension of Industrial Property Rights Existing
in the Territory Designated in Article 3 of the
Unification Treaty to the Remaining Federal
Territory

SUBCHAPTER 1
GENERAL PROVISIONS
Extension of Industrial Property Rights and
Applications for Industrial Property Rights
4.-
(1) The industrial property rights (exclusive patents and economic patents, inventors' certificates and patents for industrial designs, marks) that were in existence on May 1, 1992, in the territory designated in Article 3 of the Unification Treaty and applications for such industrial property rights shall be extended to the remaining Federal territory and shall maintain their priority.
(2) The same shall apply to applications filed and rights registered or granted on the basis of international agreements with effect for the territory designated in Article 3 of the Unification Treaty.
(3) Sections 33 to 38 shall apply to indications of source registered or applied for with effect for the territory designated in Article 3 of the Unification Treaty.
Applicable Law
5.-
Notwithstanding the provisions below, the industrial property rights and the applications for industrial property rights extended under Section 4 shall be governed by the statutory provisions hitherto applicable to them (Annex I, Chapter III, Field E, Part II, item 1, Article 3(1) of the Unification Treaty of August 31, 1990, Bundesgesetzblatt (BGBl.) 1990 II, pp. 885, 961) only where they concern the qualifying requirements for protection and the term of protection. In all other cases they shall be governed by the provisions of Federal law transferred to them under the Unification Treaty.
SUBCHAPTER 2
SPECIAL PROVISIONS ON PATENTS
Effect of Granted Patents
6.-
The grant of a patent under the statutory provisions of the German Democratic Republic shall have the same status as the publication of the grant of a patent under Section 58(1) of the Patent Law.
6a.-
The term of patents extended under Section 4 that have not expired on December 31, 1995, shall be 20 years commencing on the day after the date of filing of the application.
Economic Patents
7.-
(1) Economic patents extended under Section 4 shall be deemed patents for which a declaration of willingness to grant licenses under Section 23(1), first sentence, of the Patent Law has been given. This shall also apply to economic patents that have been recognized as having effect in the territory designated in Article 3 of the Unification Treaty on the basis of the Agreement of December 18, 1976, on the reciprocal recognition of inventors' certificates and other titles of protection for inventions (Gesetzblatt der Deutschen Demokratischen Republik (GBl.) II, No. 15, p. 327).
(2) The owner of a patent that has been examined as to compliance with all requirements for protection may declare in writing at any time to the German Patent Office that the declaration of willingness to license under subsection (1) shall be deemed withdrawn. Notification of such declaration shall be published in the Patent Gazette. The amount by which the annual fees due since May 1, 1992, have been reduced shall be paid within one month after publication of the notification. Section 17(3), second and third sentences, of the Patent Law shall apply mutatis mutandis with the proviso that the one-month time limit referred to in the third sentence shall replace the due date.
(3) Anyone who, prior to publication of the notification of a declaration under subsection (2), second sentence, has informed the owner of the patent of his intention to use the invention and has begun such use or has made the necessary preparation for use, shall remain entitled to continue the use in the way stated by him in the communication.
Patents Not Available in German
8.-
(1) Where the patent extended under Section 4 has not been published in German, the owner of the patent may assert the rights under the patent only as from the day on which a German translation of the patent specification filed by him has been published at his request by the German Patent Office. The request shall be subject to payment of a fee in accordance with the schedule of fees. If the fee is not paid, the request shall be deemed not to have been made.
(2) A notification of publication of the translation shall be published in the Patent Gazette and noted in the Patent Register.
(3) If the translation of the patent specification contains errors, the owner of the patent may request publication of a corrected translation to be filed by him. Subsection (1), second and third sentences, and subsection (2) shall apply mutatis mutandis.
(4) The wording of the patent specification shall constitute the binding version. If the translation of the patent specification contains errors, anyone who has in good faith begun to use the invention or has made serious and effective preparations for using the invention shall still be entitled to use the invention after publication of the corrected translation for the needs of his own business in his own plant or workshops or the plant or workshops of others free of cost throughout the whole Federal territory if such use would not constitute an infringement of the patent in the faulty translation contained in the patent specification.
Rights of Use in Exclusive Patents

(1) The right afforded by Section 3(4), first sentence, of the Law amending the Patent Law and the Law on Distinctive Signs for Goods of the German Democratic Republic, of June 29, 1990 (GBl. I, No. 40, p. 571), to continue to use an invention protected by an economic patent that has been converted to an exclusive patent, shall be maintained and shall be extended to the remaining Federal territory. The owner of the patent shall be entitled to appropriate remuneration.
Patent Applications
10.-
(1) Where a patent application extended under Section 4 has not been subjected to an examination corresponding to the examination for obvious compliance under Section 42 of the Patent Law, such examination for obvious compliance shall be carried out.
(2) Where the application is not available in German, the German Patent Office shall require the applicant to file a German version of the application within three months. If the German version is not filed within the time limit, the application shall be deemed to have been withdrawn.
(3) If grant of a patent has not yet been decided in the case of a patent application extended under Section 4, free inspection of files shall be afforded under Section 31(2), item 2, and the application published as an unexamined patent application.
(4) If a request for examination has been duly filed with respect to an application extended under Section 4, the request shall be further processed. If examination has already begun ex officio, it shall only be continued if the applicant files a request for examination under Section 44(1) to (3) of the Patent Law.
Searching
11.-
At the request of the owner of the patent or of another person, the German Patent Office shall determine with respect to a patent extended under Section 4 the publicly available documents to be taken into consideration for assessing the patentability of the invention. A fee shall be paid together with the request in accordance with the schedule of fees. If the fee is not paid, the request shall be deemed not to have been filed. Section 43(3) to (6) and (7), first sentence, of the Patent Law shall apply mutatis mutandis.
Examination of Granted Patents
12.-
(1) A patent extended under Section 4 that has not been examined for compliance with all conditions of protection shall be examined, on request, by the Examining Section of the German Patent Office. The request may be filed by the owner of the patent or by any other person. Section 44(1), (3) and (5), first sentence, and Section 45 of the Patent Law shall apply mutatis mutandis; Section 44(4), first and second sentences, of the Patent Law shall apply mutatis mutandis where a request under Section 11 has been filed.
(2) A request for examination already duly filed with respect to a patent extended under Section 4 shall be further processed by the Examining Section. An examination that has been begun ex officio shall be continued.
(3) Examination under subsections (1) and (2) shall result in maintenance or revocation of the patent. Section 58(1), first and second sentences, of the Patent Law shall apply mutatis mutandis. Opposition to maintenance may be lodged under Section 59 of the Patent Law.
(4) Section 81(2) of the Patent Law shall not apply to patents within the meaning of subsection (1).
(5) Section 130 of the Patent Law shall apply mutatis mutandis to examination proceedings under subsections (1) and (2).
Opposition Proceedings in Special Cases
13.-
Where the German Patent Office confirms or grants a patent extended under Section 4 in accordance with Section 18(1) or (2) of the Patent Law of the German Democratic Republic, opposition may be lodged with the German Patent Office up to and including July 31, 1992. Sections 59 to 62 of the Patent Law shall apply.
Transfer of Correction Proceedings
14.-
Correction proceedings under Section 19 of the Patent Law of the German Democratic Republic still pending before the German Patent Office on May 1, 1992, shall be pursued, in the status in which they are, as limitation proceedings under Section 64 of the Patent Law.
Derivation
15.-
(1) The declaration under Section 5(1), first sentence, of the Utility Model Law may also be filed with respect to patents or patent applications extended under Section 4. This shall not apply to patents that have been granted or confirmed, after examination of compliance with all conditions of protection, by the former Patent Office of the German Democratic Republic.
(2) For those patents referred to in subsection (1), the declaration may be filed up to expiry of two months after the end of the month in which any examination proceedings or any opposition proceedings have been completed, but at most up to expiry of the tenth year after the filing date of the patent.
(3) Rights under Section 9, or based on Section 7(1) and (3), to use the invention on payment of appropriate remuneration and rights of continued utilization under Section 28 shall also apply with respect to a utility model derived under subsection (1).
SUBCHAPTER 3
SPECIAL PROVISIONS ON INVENTORS' CERTIFICATES
AND INDUSTRIAL DESIGN PATENTS
Inventors' Certificates and Industrial
Design Patents
16.-
(1) Inventors' certificates and industrial design patents extended under Section 4 shall be deemed designs within the meaning of the Designs Law. Section 5, first sentence, shall remain unaffected.
(2) For inventors' certificates extended under Section 4, the originating enterprise within the meaning of Section 4 of the Ordinance on Industrial Designs of January 17, 1974 (GBl. I, No. 15, p. 140), as amended by ordinance of December 9, 1988 (GBl. I, No. 28, p. 333), or its successor in title, shall be deemed the owner of the right.
Entitlement to Remuneration
17.-
Where the entitlement of a creator of a design or model to remuneration under the hitherto applicable provisions has already arisen, the remuneration shall be paid in accordance with these provisions.
Utilization Rights in Inventors' Certificates
18.-
Any person who has lawfully used a design or model, in accordance with the hitherto applicable provisions, protected by an inventor's certificate extended under Section 4 or in respect of which an inventor's certificate has been sought, may continue to use such design or model within the whole Federal territory. The owner of the right may require appropriate remuneration from the person entitled to use it with respect to its continued utilization.
Applications for Industrial Design Patents
19.-
(1) Where an application for an industrial design patent extended under Section 4 has been published under Section 10(1) of the Ordinance on Industrial Designs, this shall have the same status as the publication of the entry of an application in the Designs Register under Section 8(2) of the Designs Law. Where the application has been entered, but has not yet been published, publication shall be effected in accordance with Section 8(2) of the Designs Law.
(2) Where the application has not yet been entered, also in those cases where examination of the requirements has already been effected under Section 9 of the Ordinance on Industrial Designs, processing of the application and its entry shall be effected in accordance with the provisions of the Designs Law; Section 10(3), second and third sentences, of the Designs Law shall not apply.
(3) If publication of an application has been deferred under Section 10(2) of the Ordinance on Industrial Designs and if the deferral period has not expired on May 1, 1992, publication shall be repeated in accordance with Section 8b(3) of the Designs Law, unless the owner of the design or the model has requested cancellation of the entry of the design or model, on expiry of the deferral period, but 18 months after October 3, 1990, at the latest. The German Patent Office shall notify the registered owner that the publication is to be repeated if no request for cancellation of the entry of the design or model is filed within one month of service of the notification.
(4) Any unfinished examination of the material requirements for protection under Section 11 of the Ordinance on Industrial Designs shall be terminated. The fee paid for the request for examination of the material requirements shall be refunded.
(5) Opposition under Section 10(3) of the Ordinance on Industrial Designs that has not yet been completed shall not be processed further by the German Patent Office.
SUBCHAPTER 4
SPECIAL PROVISIONS ON MARKS
Cancellation of Registered Marks Under
Section 10(2) of the Trademark Law
20.-
(1) Cancellation of a mark extended under Section 4 shall only be effected, either ex officio or on request under Section 10(2), item 2, of the Trademark Law, if the mark is not eligible for protection both under the hitherto applicable provisions and the provisions of the Trademark Law.
(2) Subsection (1) shall apply mutatis mutandis to requests for withdrawal of protection of a mark extended under Section 4 and that has been internationally registered in accordance with Section 10 of the Ordinance on the International Registration of Trademarks.
Cancellation of Registered Marks Under
Section 11 of the Trademark Law
21.-
(1) Cancellation of a mark extended under Section 4 and that has been entered on the basis of an application filed during the period from July 1 to October 2, 1990, inclusive, may also be requested by a third party under Section 11(1), item 1, of the Trademark Law if the mark has been entered in his name in the Trademark Register on the basis of an application with earlier priority for the same or similar goods and has been extended under Section 1. Such entry shall have the same status as an internationally registered mark under the Madrid Agreement Concerning the International Registration of Marks that has been extended under Section 1.
(2) Subsection (1) shall be applied mutatis mutandis to requests for withdrawal of protection for an internationally registered mark extended under Section 4 in accordance with Section 10 of the Ordinance on the International Registration of Trademarks.
Examination of Applications for Marks
22.-
(1) Trademark applications extended under Section 4 shall be subject to the provisions of the Trademark Law unless otherwise stipulated below.
(2) Entry may not be refused on the grounds that the sign applied for is a form of mark that may not be registered under the Trademark Law.
(3) Subsections (1) and (2) shall apply mutatis mutandis to internationally registered marks under the Madrid Agreement Concerning the International Registration of Marks that have been extended under Section 4.
Publication of Applications for Marks;
Opposition
23.-
(1) Trademark applications extended under Section 4 shall be published in accordance with Section 5(2) or Section 6a(3) of the Trademark Law, even where examination has already been effected under the hitherto applicable provisions.
(2) Opposition may be lodged against entry of the application for marks referred to in subsection (1) in accordance with Section 5(4), first sentence, item 1, of the Trademark Law only by such persons who
1. have filed with the former Patent Office of the German Democratic Republic for the same or similar goods or services a mark with earlier priority, that has been extended under Section 4, that is the same as the mark applied for (Section 31 of the Trademark Law) or
2. in the event of the published sign having been filed with the former Patent Office of the German Democratic Republic in the period between July 1 and October 2, 1990, inclusive, have filed with the German Patent Office for the same or similar goods a mark with earlier priority, that has been extended under Section 1, that is the same as the mark applied for (Section 31 of the Trademark Law).
Internationally registered marks under the Madrid Agreement Concerning the International Registration of Marks that have been extended under Section 1 or Section 4 shall have the same status as the earlier applications referred to in items 1 and 2.
(3) Subsections (1) and (2) shall apply mutatis mutandis to opposition under Section 2 of the Ordinance on the International Registration of Trademarks where it is lodged against an internationally registered mark extended under Section 4.
Term of Protection
24.-
Section 9(1) of the Trademark Law shall apply for calculating the term of protection for marks extended under Section 4.
Transfer of Marks; Trademark Associations
25.-
(1) The transfer of rights in a trademark or trademark application extended under Section 4 shall be effective, notwithstanding Section 17(1), second sentence, of the Law on Distinctive Signs for Goods of November 30, 1984 (GBl. I, No. 33, p. 397), as amended by Section 2 of the Law of June 29, 1990 (GBl. I, No. 40, p. 571), without a corresponding entry in the Register.
(2) The cancellation of a collective mark extended under Section 1 or of a collective mark extended under Section 4 or the refusal of entry of such a mark may not be based on the fact that the association for which the mark was entered or filed does not have legal capability if such association was entered on May 1, 1992, in the Register of Associations under Section 7 of the Law on Distinctive Signs for Goods and if it or the person to whom the right in the application or entry of the sign has been transferred by the association proves to the German Patent Office by April 30, 1993, at the latest, that he satisfies the requirements for filing an application for a collective mark under Section 17(1) or (2) and Section 18, first sentence, of the Law on Distinctive Signs for Goods; Section 20 of the Trademark Law shall not apply in such circumstances.

Chapter 3
Concurrent Rights; Rights of Prior
Use and Continued Use

SUBCHAPTER 1
INVENTIONS, DESIGNS AND MODELS
Collision of Rights
26.-
(1) Where patents, patent applications or utility models extended under this Law to the territory designated in Article 3 of the Unification Treaty or to the remaining Federal territory are concurrent in their scope of protection and therefore collide as a result of extension, the owners of such titles or applications may not assert rights deriving from those titles or applications, irrespective of their priority, either against each other or against persons authorized by the owner of the other title or the other application to use them.
(2) However, the subject matter of the title or of the application may not be used or may only be used with restrictions in the territory to which the title or the application has been extended if unlimited use would lead to particular disadvantage for the owner of the other title or the other application or for persons he has authorized to use the subject matter of his title or his application and would be unreasonable when taking into account all the circumstances of the case and when weighing up the justified interests of those concerned.
(3) Subsections (1) and (2) shall apply mutatis mutandis where identical designs, inventors' certificates or industrial design patents or applications for such rights collide as a result of extension.
Rights of Prior Use
27.-
(1) If the effect of a patent or utility model extended under Section 1 or Section 4 is restricted by a right of prior use (Section 12 of the Patent Law, Section 13(3) of the Utility Model Law, Section 13(1) of the Patent Law of the German Democratic Republic), such right of prior use shall apply in the whole Federal territory with those limitations deriving from Section 12 of the Patent Law.
(2) Subsection (1) shall apply mutatis mutandis if the requirements for recognition of a right of prior use are satisfied in that territory in which the title did not hitherto apply.
Rights of Continued Use
28.-
(1) The effect of a patent or utility model extended under Section 1 or Section 4 shall not apply to any person who had lawfully begun to use the invention in that territory in which the title did not previously apply after the day that is operative for the priority of the application and prior to July 1, 1990. Such person shall be authorized to exploit the invention in the whole Federal territory for the needs of his own business in his own plant or workshops or the plant or workshops of others, on condition that the use does not cause particular prejudice to the owner of the title or the persons he has authorized to use the subject matter of his title and which would be unreasonable when taking into account all the circumstances of the case and when weighing up the justified interests of those concerned.
(2) In the case of a product manufactured abroad, the user shall only have a right of continued use under subsection (1) if use in Germany has led to a property situation that warrants protection and whose non-recognition would represent an unreasonable hardship for the user, taking into account all the circumstances of the case.
(3) Subsections (1) and (2) shall apply mutatis mutandis to utility models, inventors' certificates and industrial design patents and semiconductor rights extended under Section 1 or Section 4.
Collision with Rights of Use Under
Section 23 of the Patent Law
29.-
Where patents or patent applications for which a licensing declaration under Section 23 of the Patent Law has been made, or is deemed to have been made under Section 7, have a scope of protection identical with patents, patent applications or utility models and collide as a result of extension under this Law, the owners of the last-mentioned patents, applications or utility models may assert the rights in such titles of protection or such applications irrespective of the priority against the person entitled to use the invention under Section 23(3), fourth sentence, of the Patent Law. Section 28 shall remain unaffected.
SUBCHAPTER 2
TRADEMARKS AND OTHER DISTINCTIVE SIGNS
Trademarks
30.-
(1) Where a trademark extended under Section 1 to the territory designated in Article 3 of the Unification Treaty collides as a result of extension with an identical mark that has been extended under Section 4 to the remaining Federal territory, either mark may only be used in the territory to which it has been extended with the consent of the owner of the other mark.
(2) The mark may be used without the consent of the owner of the other mark in the territory to which it has been extended
1. for advertising in public announcements or in communications intended for a large number of persons where the dissemination of such public announcements or communications cannot reasonably be limited to the territory in which the mark previously applied,
2. if the owner of the mark can convincingly show that he is entitled, under the provisions of the Law on Property, to the return of the other mark or of the undertaking to which the other mark belongs,
3. if exclusion from use of the mark in that territory proves unreasonable taking into account all the circumstances of the case and weighing up the justified interests of those concerned and of the general public.
(3) In the cases referred to in subsection (2), items 1 and 3, the owner of the mark may require appropriate compensation from the person who uses the other mark where he suffers prejudice beyond an acceptable degree due to the use.
(4) Where the claim to return in the case of subsection (2), item 2, proves unfounded, the owner of the trademark shall be obliged to make good the damage suffered by the owner of the identical mark by reason of the fact that the mark has been used without his consent in the territory to which it has been extended.
Other Rights in Distinctive Signs
31.-
Where trademarks extended under this Law to the territory designated in Article 3 of the Unification Treaty or to the remaining Federal territory collide with a name, a company name, a special designation of an undertaking or other right in a distinctive sign that has been acquired by use, Section 30 shall apply mutatis mutandis.
Right of Continued Use
32.-
The effect of a registered mark or an application for a mark extended under Section 4 to the remaining Federal territory, which would be excluded from registration under Section 1 or Section 4(1) or (2), item 1, of the Trademark Law, shall not be assertable against a person who had already lawfully used before July 1, 1990, an identical mark for the same or similar goods or services in the remaining Federal territory. Such person shall be entitled to use the mark in the whole Federal territory insofar as use does not cause particular prejudice to the owner of the mark or to the persons he has authorized to use the mark, which would be unreasonable when taking into account all the circumstances of the case and when weighing up the justified interests of those concerned and of the general public.

PART 2
CONVERSION OF INDICATIONS OF
SOURCE TO COLLECTIVE MARKS

Conversion

33.-
(1) The indications of source entered in the Register of Indications of Source and the indications of source for which entry in that Register has been applied for shall be converted, on request, to collective marks (Sections 17 to 23 of the Trademark Law) in accordance with the provisions below.
(2) Indications of source converted to collective marks shall enjoy in the remaining Federal territory the same priority as in the territory designated in Article 3 of the Unification Treaty.

Request for Conversion

34.-
(1) A request for conversion may only be filed by the associations with legal personality or public law legal persons referred to in Section 17 of the Trademark Law.
(2) A request for conversion must be filed by the close of April 13, 1993. The request shall not be subject to fees. There shall be no reinstatement of rights in the event of failure to comply with the time limit.
(3) If no request is made within the time limit stated in subsection (2), the right deriving from entry in the Register of Indications of Source or the right deriving from the application for an indication of source shall expire. Expiry shall be noted in the Register or in the application file.
(4) The expiry of rights under subsection (3) shall not prejudice the entitlement to assert claims with respect to the indications of source concerned under general rules of law.

Application of the Trademark Law

35.-
A request for conversion shall be dealt with, where not otherwise provided below, as an application for a collective mark under Sections 17 to 23 of the Trademark Law.

Collision of Converted Indications
of Source and Trademarks

36.-
Sections 2 and 3, 20 to 24 and 30 to 32 shall apply mutatis mutandis to requests for conversion of indications of source to collective marks and to converted indications of source registered as collective marks.

Eligibility for Protection of Converted
Indications of Source

37.-
Where the other requirements for registration of a collective mark are satisfied, the conversion to a collective mark of an indication of source that has been registered or applied for may not be refused on the grounds that it does not constitute an indication of source unless the designation has lost its original meaning as a geographical indication and the trade circles concerned throughout the whole Federal territory understand it exclusively as the name of goods or the designation of a type or variety of product.

Right of Continued Use

38.-
(1) Where an indication of source that has been converted to a collective mark collides in the remaining Federal territory with an identical designation that was lawfully used there prior to July 1, 1990, as a generic designation, the designation may continue to be used as a designation for identifying goods or packaging or in announcements, price lists, business letters, recommendations, invoices and the like for two years after the registration of the collective mark. Goods or packaging marked in such way or announcements, price lists, business letters, recommendations, invoices or the like still in stock on expiry of that period may continue to be sold or used up until expiry of a further two years.
(2) Where an indication of source that has been converted to a collective mark collides in the remaining Federal territory with an identical designation that had lawfully been used there prior to July 1, 1990, by an undertaking that has continued the tradition, with regard to the use of that designation, of a commercial undertaking originally located in the territory designated in Article 3 of the Unification Treaty, subsection (1) shall apply mutatis mutandis with the proviso that the time limit for continued use under the first sentence shall be 10 years.

PART 3
CONCILIATION PROCEDURE

Conciliation Board

39.-
(1) In civil law disputes arising from the collision of industrial property rights or rights of use extended under this Law, any of the parties may at any time appeal to the Conciliation Board.
(2) The Conciliation Board shall have the task of negotiating an amicable settlement between the parties in disputes of the type referred to in subsection (1).
(3) The Conciliation Board shall be established at the German Patent Office. It may also meet outside its headquarters.

Composition of the Conciliation Board

40.-
(1) The Conciliation Board shall comprise a Chairman, or his deputy, and two assessors.
(2) The Chairman and his deputy must possess the qualifications required for judicial office under the German Law on Judges and have experience in the field of industrial property. They shall be appointed by the Federal Minister of Justice at the beginning of each calendar year for the duration of that year.
(3) The assessors shall be appointed by the Chairman for each individual dispute from a list of assessors to be drawn up by the President of the German Patent Office each year for that calendar year. Appointment shall be with the consent of the parties. Where the parties make a mutually agreed proposal, the Chairman shall accept that proposal, as a rule, even if the proposed persons are not included in the list.
(4) Sections 41 to 43 and Section 44(2) to (4) of the Code of Civil Procedure shall apply mutatis mutandis to the exclusion and refusal of members of the Conciliation Board. The petition for refusal shall be heard by the Federal Patent Court.

Honorary Office; Supervision

41.-
(1) The members of the Conciliation Board shall carry out their activities in an honorary capacity. The Chairman and his deputy may also be appointed on a full-time basis.
(2) Prior to their first official duties, the Chairman and his deputy shall be bound by the Federal Minister of Justice, and the assessors shall be bound by the Chairman, to conscientious and impartial exercise of their office and to secrecy with regard to the facts that become known to them in their official capacity.
(3) Official supervision of the Conciliation Board shall lie with the Chairman and official supervision of the Chairman with the Federal Minister of Justice.

Proceedings Before the Conciliation Board

42.-
(1) Appeals to the Conciliation Board shall be lodged by means of a written petition. The petition shall contain a brief description of the facts together with the name and address of the other party.
(2) Sections 1035 and 1036 of the Code of Civil Procedure shall apply mutatis mutandis to proceedings before the Conciliation Board. Section 1034(1) of the Code of Civil Procedure shall apply mutatis mutandis with the proviso that patent attorneys, holders of certificates of representation and, in the framework of Section 156 of the Code of Patent Attorneys, patent assessors may not be refused by the Conciliation Board.
(3) In all other cases, the Conciliation Board shall determine its procedure itself. It may require the personal appearance of the parties.

Conciliation Proposal; Settlement

43.-
(1) The Conciliation Board shall take its decisions on a majority vote. Section 196(2) of the Judiciary Law shall apply.
(2) The Conciliation Board may submit the written conciliation proposal to the parties. The conciliation proposal may only be published with the consent of the parties.
(3) A settlement reached before the Conciliation Board shall be enforceable if it is recorded in a separate written document signed by the members of the Conciliation Board who participated in the negotiations and by the parties, bearing the date on which it was reached. Section 797a of the Code of Civil Procedure shall apply mutatis mutandis.

Interruption of Prescription

44.-
An appeal to the Conciliation Board shall interrupt prescription in the same way as the lodging of an appeal. Interruption shall continue until the proceedings before the Conciliation Board are terminated. If no settlement is reached, the Conciliation Board shall determine the time at which the proceedings are ended. The Chairman shall inform the parties thereof. Where appeal to the Conciliation Board is withdrawn, interruption of prescription shall be deemed not to have occurred.

Costs of Conciliation Proceedings

45.-
(1) A fee of DM 300 shall be paid together with the request for appeal to the Conciliation Board. If the fee is not paid, the request shall be deemed not to have been submitted.
(2) The Ordinance on Administrative Costs Before the German Patent Office shall apply mutatis mutandis to payment of the fee in accordance with subsection (1) and the determination of costs.
(3) The Conciliation Board shall endeavor to obtain amicable agreement of the parties on the liability for the costs incurred by the proceedings. This shall also apply where no agreement has been reached in the matter itself. Where no agreement is reached as to the sharing of costs, the Conciliation Board shall decide on the sharing of the costs incurred in accordance with subsection (2) at its discretion; in all other cases, each party shall itself bear the costs it has incurred.
(4) An appeal shall lie to the Federal Patent Court from decisions taken under subsection (2) and subsection (3), third sentence. The provisions of the Patent Law with regard to appeals procedure shall apply mutatis mutandis, with the exception of Sections 76 to 78.

Compensation of Members of the
Conciliation Board

46.-
The members of the Conciliation Board acting in an honorary capacity shall receive compensation in accordance with Sections 2 to 5 and 9 to 11 of the Law on Compensation for Honorary Judges; the condition under Annex I, Chapter III, Field A, Section III, item 24, of the Unification Treaty of August 31, 1990 (BGBl. 1990, II, pp. 885, 936) shall not apply. The compensation shall be determined by the President of the German Patent Office. Section 12 of the Law of Compensation for Honorary Judges shall apply mutatis mutandis. The Federal Patent Court shall be competent for the judicial determination.

Employee Inventions

49.-
The provisions of the Law on Employee Inventions shall apply to inventions made prior to October 3, 1990, in the territory designated in Article 3 of the Unification Treaty with regard to the generation and due date of claims to remuneration in the case of unlimited use of a service invention, where the claim to remuneration has not arisen by May 1, 1992, as also the provisions on arbitration proceedings and on court proceedings. In all other cases, the provisions hitherto applicable shall remain applicable to them (Annex I, Chapter III, Field E, Section II, item 1, Article 11 of the Unification Treaty of August 31, 1990, BGBl. 1990 II, pp. 885, 962).

Transfer of Mediation Proceedings

50.-
Proceedings still pending before the mediation office for remuneration disputes of the German Patent Office on May 1, 1992, shall be transferred, in their current status, to the arbitration board set up at the German Patent Office under the Law on Employee Inventions.

Transfer of Appeal and Revocation Proceedings

51.-
(1) Proceedings still pending before an appeal instance or a revocation instance of the German Patent Office on May 1, 1992, shall be transferred, in their current status, to the Federal Patent Court.
(2) Proceedings still pending before a cancellation instance for trademarks of the German Patent Office on May 1, 1992, shall be pursued by the Trademark Division of the German Patent Office.

Time Limits

52.-
Where the subject matter of proceedings is a right that has been extended under Section 4, or an application for a right extended under Section 4, the course of any procedural time limit that has begun before May 1, 1992, shall be determined by the hitherto applicable provisions.

Fees

53.-
(1) Fees for rights and applications for rights extended under Section 4 that became due before May 1, 1992, shall be paid according to the hitherto applicable provisions.
(2) Where a fee that becomes due after May 1, 1992, has already been effectively paid prior to that date in accordance with the previous schedule of fees, the due fees shall be deemed to have been paid.

Application of the Law on Unfair Competition
and of Other Statutory Provisions

54.-
Application of the Law on Unfair Competition and the general rules of law on the acquisition or exercise of rights, particularly those on the abuse of rights, shall not be effected by the provisions of this Law.

Entry Into Force

55.-
This Law shall enter into force on the first day of the calendar month following its promulgation.

TITRE PREMIER EXTENSION

Section 1 Extension au territoire visé à l'article 3 du traité d'unification

Extension des titres et demandes de titres de propriété industrielle

Art. premier. – 1) Les titres de propriété industrielle (brevets, modèles d'utilité, droits protégeant les

semiconducteurs, dessins et modèles et caractères typographiques, marques de produits et de services) et les

demandes de tels titres existant au 1er mai 1992 dans la. République fédérale d'Allemagne, exception faite du territoire visé à l'article 3 du traité d'unification, sont étendus à ce territoire et conservent leur date de priorité.

2) Cette extension vaut aussi pour les demandes déposées et les titres de propriété enregistrés ou délivrés en vertu d'une convention internationale avec effet sur le territoire de la République fédérale d'Allemagne, exception faite du territoire visé à l'article 3 du traité d'unification.

Radiation de marques enregistrées

Art. 2. – 1) La radiation d'une marque étendue conformément à l'article premier, qui a été enregistrée sur la

base d'une demande déposée pendant la période allant du 1er juillet au 2 octobre 1990, peut être aussi demandée par un tiers en application de l'article 11.1)1° de la loi sur les marques si la marque a été enregistrée en son nom pour des produits ou des services identiques ou similaires sur la base d'une demande déposée auprès de l'ancien office des brevets de la République démocratique allemande, avec une date de priorité plus ancienne, et a été étendue conformément à l'article 4. L'enregistrement international d'une marque effectué en vertu de l'Arrangement de Madrid concernant l'enregistrement international des marques est assimilé à un tel enregistrement.

2) L'alinéa 1) s'applique mutatis mutandis aux demandes de retrait de la protection présentées conformément à l'article 10 du règlement sur l'enregistrement international des marques de fabrique ou de commerce et portant sur des enregistrements internationaux étendus conformément à l'article premier.

Opposition à des marques ayant fait l'objet d'une demande d'enregistrement

Art. 3. – 1) Peut aussi, conformément à l'article 5.4) ou à l'article 6a.3) de la loi sur les marques, faire

opposition à l'enregistrement d'une marque ayant fait l'objet d'une demande déposée auprès de l'Office allemand des brevets pendant la période allant du 1er juillet au 2 octobre 1990 et étendue conformément à l'article premier, quiconque a déposé, auprès de l'ancien office des brevets de la République démocratique allemande pour des produits identiques ou similaires, une demande tendant à l'enregistrement d'une marque analogue (art. 31 de la loi sur les marques), ayant une date de priorité plus ancienne et étendue conformément à l'article 4. L'enregistrement international d'une marque effectué en vertu de l'Arrangement de Madrid concernant l'enregistrement international des marques et étendu conformément à l'article 4 est assimilé à une telle demande.

2) Si l'Office allemand des brevets a publié, conformément à l'article 5.2) de la loi sur les marques, une marque visée à l'alinéa 1) et si le délai d'opposition prévu à l'article 5.4) ou à l'article 6a.3) de la loi sur les marques n'est pas encore écoulé au 1er mai 1992, il ne peut être fait opposition après cette date sur la base d'une marque plus ancienne comme prévu à l'alinéa 1) que pendant trois mois.

3) Les alinéas 1) et 2) s'appliquent mutatis mutandis aux oppositions formées conformément à l'article 2 du règlement sur l'enregistrement international des marques de fabrique ou de commerce contre l'enregistrement international d'une marque étendu conformément à l'article premier.

Section 2 Extension au reste du territoire fédéral des titres de propriété industrielle

existant sur le territoire visé à l'article 3 du traité d'unification

SOUS-SECTION 1 DISPOSITIONS GÉNÉRALES

Extension des titres et demandes de titres de propriété industrielle

Art. 4. – 1) Les titres de propriété industrielle (brevets d'exclusivité et brevets d'exploitation, certificats

d'auteur et brevets de modèle industriel, marques) et les demandes de tels titres existant au 1er mai 1992 sur

le territoire visé à l'article 3 du traité d'unification sont étendus au reste du territoire de la République fédérale d'Allemagne et conservent leur date de priorité.

2) Cette extension vaut aussi pour les demande déposées et les titres de propriété enregistrés ou délivrés en vertu d'une convention internationale avec effet sur le territoire visé à l'article 3 du traité d'unification.

3) Les indications de provenance enregistrées ou ayant fait l'objet d'une demande d'enregistrement avec effet sur le territoire visé à l'article 3 du traité d'unification sont régies par les articles 33 à 38.

Droit applicable

Art. 5. Sans préjudice des dispositions ci-après, les dispositions jusqu'alors applicables aux titres de propriété industrielle et aux demandes de tels titres étendus conformément à l'article 4 (annexe I, chap. III, partie E, sect. II, n°1, art. 3.1) du traité d'unification du 31 août 1990, Bundesgesetzblatt [BGBl.] 1990 II, p. 885, 961) ne doivent plus leur être appliquées qu'en ce qui concerne les conditions et la durée de la protection. Ces titres ou demandes de titres sont par ailleurs régis par les règles du droit fédéral rendues applicables par le traité d'unification.

SOUS-SECTION 2 DISPOSITIONS PARTICULIÈRES RELATIVES AUX BREVETS

Effet des brevets délivrés

Art. 6. La délivrance d'un brevet conformément aux dispositions légales de la République démocratique allemande équivaut à la publication de la délivrance du brevet conformément à l'article 58.1) de la loi sur les brevets.

Art. 6a. Dans le cas des brevets aux effets étendus en vertu de l'article 4, qui n'auront pas expiré le 31 décembre 1995, la durée de protection est de 20 ans à compter du jour suivant la date de dépôt de la demande.

Brevets d'exploitation

Art. 7. – 1) Les brevets d'exploitation étendus conformément à l'article 4 sont considérés comme ayant fait

l'objet d'une déclaration d'offre de licence d'exploitation conformément à la première phrase de l'article 23.1) de la loi sur les brevets. Il en va de même des brevets d'exploitation qui, en vertu de l'accord du 18 décembre 1976 sur la reconnaissance mutuelle des certificats d'inventeur et autres titres de protection des inventions (Gesetzblatt der Deutschen Demokratischen Republik [GBl.] II, n°15, p. 327), ont été reconnus avec effet sur le territoire visé à l'article 3 du traité d'unification.

2) Le titulaire d'un brevet ayant fait l'objet d'un examen tendant à vérifier que toutes les conditions d'obtention de la protection sont réunies peut à tout moment déclarer par écrit à l'Office allemand des brevets que la déclaration d'offre de licence d'exploitation visée à l'alinéa 1) doit être considérée comme révoquée. La mention de cette déclaration est publiée au Bulletin des brevets. Le montant dont sont réduites les annuités venues à échéance après le 1er mai 1992 doit être versé dans le délai d'un mois après publication de cette mention. Les dispositions des deuxième et troisième phrases de l'article 17.3) de la loi sur les brevets sont applicables mutatis mutandis, avec cette réserve que l'échéance qui y est prévue est remplacée par l'expiration du délai d'un mois visé dans la troisième phrase du présent alinéa.

3) Quiconque a communiqué au titulaire du brevet, avant la publication de la mention de la déclaration visée dans la deuxième phrase de l'alinéa 2), son intention d'utiliser l'invention et a commencé à utiliser celle-ci, ou a fait les préparatifs nécessaires à cette fin, conserve le droit d'utiliser l'invention de la manière annoncée par lui.

Brevets dans des langues autres que l'allemand

Art. 8. – 1) Si un brevet étendu conformément à l'article 4 n'a pas été publié en allemand, le titulaire ne peut

faire valoir ses droits découlant du brevet qu'à compter du jour où une traduction allemande du fascicule de brevet remise par lui a été publiée sur sa requête par l'Office allemand des brevets. Cette requête doit être accompagnée du montant de la taxe prévue au barème. Si la taxe n'est pas acquittée, la requête est considérée comme nulle.

2) La mention de la publication de la traduction doit être publiée dans le Bulletin des brevets et inscrite au registre.

3) Si la traduction du fascicule de brevet est erronée, le titulaire du brevet peut demander la publication d'une traduction corrigée remise par lui. Les deuxième et troisième phrases de l'alinéa 1) et l'alinéa 2) s'appliquent mutatis mutandis.

4) Le libellé du fascicule de brevet fait foi. Si la traduction du fascicule est erronée, quiconque a de bonne foi utilisé ou fait des préparatifs effectifs et sérieux en vue d'utiliser l'invention peut, même après publication de la traduction corrigée, poursuivre gratuitement cette utilisation pour les besoins de son entreprise dans ses propres ateliers ou ceux d'autrui sur l'ensemble du territoire fédéral, à condition que cette utilisation ne constitue pas une atteinte au brevet selon la traduction erronée du fascicule.

Droits d'utilisation afférents aux brevets d'exclusivité

Art. 9. – 1) Le droit que prévoit l'article 3.4), première phrase, de la loi portant modification de la loi sur les

brevets et de la loi sur les signes distinctifs de produits de la République démocratique allemande du 29 juin 1990 (GBl. I, n°40, p. 571) de poursuivre l'utilisation d'une invention protégée par un brevet d'exploitation transformé en brevet d'exclusivité est maintenu et étendu au reste du territoire fédéral. Le titulaire du brevet a droit à une rémunération équitable.

Demandes de brevet

Art. 10. – 1) Si une demande étendue conformément à l'article 4 n'a pas encore fait l'objet d'un examen

correspondant à l'examen des insuffisances manifestes prévu par l'article 42 de la loi sur les brevets, il y a lieu de procéder à cet examen.

2) Si la demande n'a pas été déposée en allemand, l'Office allemand des brevets demande au déposant de lui remettre une traduction allemande de la demande dans un délai de trois mois. Si la traduction allemande n'est pas remise dans ce délai, la demande est considérée comme retirée.

3) Dans la mesure où il n'a pas encore été décidé de délivrer un brevet, les dossiers d'une demande étendue conformément à l'article 4 peuvent être librement consultés en application de l'article 31.2)2° de la loi sur les brevets, et la demande est publiée en tant que fascicule de demande.

4) Si une demande d'examen a été valablement présentée pour une demande de brevet étendue conformément à l'article 4, son instruction se poursuit. Si l'examen a été entrepris d'office, il n'est poursuivi que si le déposant présente la demande d'examen conformément aux alinéas 1) à 3) de l'article 44 de la loi sur les brevets.

Recherche

Art. 11. Sur requête du titulaire du brevet ou d'un tiers, l'Office allemand des brevets recherche les publications relatives à un brevet étendu conformément à l'article 4 qui doivent être prises en considération pour apprécier la brevetabilité de l'invention. La requête doit être accompagnée du montant de la taxe prévue au barème. Si la taxe n'est pas versée, la requête est considérée comme nulle. Les alinéas 3) à 6) et 7), première phrase, de l'article 43 de la loi sur les brevets s'appliquent mutatis mutandis.

Examen des brevets délivrés

Art. 12. – 1) Un brevet étendu conformément à l'article 4 et qui n'a pas fait l'objet d'un examen destiné à

vérifier que toutes les conditions d'obtention de la protection sont réunies est examiné, sur requête, par la Section d'examen de l'Office allemand des brevets. La requête peut être présentée par le titulaire du brevet ou par un tiers. Les alinéas 1), 3) et 5), première phrase, de l'article 44 et l'article 45 de la loi sur les brevets s'appliquent mutatis mutandis; l'alinéa 4), première et deuxième phrases, de l'article 44 de la loi sur les brevets s'applique mutatis mutandis en cas de requête présentée conformément à l'article 11.

2) Si une requête en examen a déjà été présentée pour un brevet étendu conformément à l'article 4, la Section d'examen en poursuit l'instruction. L'examen d'un brevet déjà entrepris d'office est poursuivi.

3) L'examen visé aux alinéas 1) et 2) conduit au maintien ou à la révocation du brevet. L'alinéa 1), première et deuxième phrases, de l'article 58 de la loi sur les brevets s'applique mutatis mutandis. Une opposition peut être formée contre le maintien du brevet conformément à l'article 59 de la loi sur les brevets.

4) L'article 81.2) de la loi sur les brevets ne s'applique pas aux brevets visés à l'alinéa 1). 5) L'article 130 de la loi sur les brevets s'applique mutatis mutandis à la procédure d'examen visée

aux alinéas 1) et 2).

Procédures d'opposition dans des cas particuliers

Art. 13. Si l'Office allemand des brevets a, conformément à l'alinéa 1) ou à l'alinéa 2) de l'article 18 de la loi sur les brevets de la République démocratique allemande, confirmé ou délivré un brevet étendu conformément à l'article 4, une opposition peut encore être formée auprès de lui jusqu'au 31 juillet 1992. Les articles 59 à 62 de la loi sur les brevets sont applicables.

Procédures de rectification en instance

Art. 14. Les procédures de rectification visées à l'article 19 de la loi sur les brevets de la République démocratique allemande, qui sont encore en instance au 1er mai 1992 devant l'Office allemand des brevets, sont poursuivies, en l'état, en tant que procédures de limitation au sens de l'article 64 de la loi sur les brevets.

Priorité dérivée

Art. 15. – 1) La déclaration visée à l'alinéa 1), première phrase, de l'article 5 de la loi sur les modèles d'utilité

peut aussi être faite pour des brevets ou des demandes de brevet étendus conformément à l'article 4. Elle ne peut pas être faite pour des brevets qui ont été délivrés ou confirmés par l'ancien office des brevets de la République démocratique allemande après vérification de l'existence de toutes les conditions de la protection.

2) Pour les brevets visés à l'alinéa 1), la déclaration peut être faite jusqu'à l'expiration d'un délai de deux mois suivant la fin du mois au cours duquel une éventuelle procédure d'examen ou une éventuelle procédure d'opposition a pris fin, mais au plus tard jusqu'à la fin de la dixième année suivant le jour de dépôt de la demande de brevet.

3) Le droit d'utiliser l'invention moyennant le paiement d'une indemnité raisonnable, qui résulte de l'article 9 ou des alinéas 1) et 3) de l'article 7, et le droit de poursuivre l'utilisation, qui résulte de l'article 28, s'appliquent à un modèle d'utilité bénéficiant d'une priorité dérivée selon l'alinéa 1).

SOUS-SECTION 3 DISPOSITIONS PARTICULIÈRES APPLICABLES AUX CERTIFICATS D'AUTEUR

ET AUX BREVETS DE MODÈLE INDUSTRIEL1

Certificats d'auteur et brevets de modèle industriel

Art. 16. – 1) Les certificats d'auteur et brevets de modèle industriel étendus conformément à l'article 4 sont

considérés comme dessins et modèles au sens de la loi sur les dessins et modèles, sans préjudice de la première phrase de l'article 5.

2) A l'égard des certificats d'auteur étendus conformément à l'article 4, est considéré comme titulaire du titre de protection l'entreprise d'origine au sens de l'article 4 de l'ordonnance sur les modèles industriels du 17 janvier 1974 (GBl. I, n°15, p. 140) modifiée par l'ordonnance du 9 décembre 1988 (GBl. I, n°28, p. 333), ou son ayant cause.

Droit à rémunération

Art. 17. Si l'auteur d'un dessin ou modèle avait déjà droit à une rémunération en application des dispositions légales jusqu'alors applicables, la rémunération doit être versée en application de ces dispositions.

Droits d'utilisation sur les certificats d'auteur

Art. 18. Quiconque a commencé à utiliser, en conformité avec les dispositions légales jusqu'alors applicables, un dessin ou modèle qui est protégé par un certificat d'auteur étendu conformément à l'article 4, ou qui a fait l'objet d'une demande de délivrance d'un certificat d'auteur, peut continuer à utiliser ce dessin ou modèle sur l'ensemble du territoire fédéral. Le titulaire du titre de protection peut exiger de la personne qui a un tel droit d'utilisation une rémunération équitable pour la poursuite de l'utilisation.

Demandes de brevet de modèle industriel

Art. 19. – 1) Si une demande de brevet de modèle industriel étendue conformément à l'article 4 a été publiée

conformément à l'article 10.1) de l'ordonnance sur les modèles industriels, cette publication vaut publication de l'inscription de la demande au registre des dessins et modèles conformément à l'article 8.2) de la loi sur les dessins et modèles. Si la demande a été inscrite, mais que l'inscription n'a pas encore été publiée, il est procédé à la publication conformément à l'article 8.2) de la loi sur les dessins et modèles.

2) Si la demande n'a pas encore été inscrite, son instruction et son inscription se font en application des prescriptions de la loi sur les dessins et modèles, même si l'examen des conditions de dépôt de la demande a déjà eu lieu conformément à l'article 9 de l'ordonnance sur les modèles industriels; les deuxième et troisième phrases de l'article 10.3) de la loi sur les dessins et modèles ne s'appliquent pas.

3) Si la publication d'une demande a été ajournée conformément à l'article 10.2) de l'ordonnance sur les modèles industriels et si le délai d'ajournement n'est pas encore écoulé au 1er mai 1992, il est procédé à la publication ajournée conformément à l'article 8b.3) de la loi sur les dessins et modèles après l'expiration du délai d'ajournement, mais au plus tard à l'expiration d'un délai de 18 mois suivant le 3 octobre 1990, pour autant que le titulaire du dessin ou modèle ne demande pas la radiation de l'inscription. L'Office allemand des brevets avise le titulaire enregistré qu'il procédera à la publication ajournée si, un mois après avoir été avisé, le titulaire n'a pas demandé la radiation du dessin ou modèle.

4) Si l'examen des conditions matérielles de la protection conformément à l'article 11 de l'ordonnance sur les modèles industriels n'est pas encore clos, il est interrompu. La taxe versée pour la requête en examen des conditions matérielles de la protection est remboursée.

5) L'instruction des oppositions formées selon l'article 10.3) de l'ordonnance sur les modèles industriels sur lesquelles il n'a pas encore été statué n'est pas poursuivie par l'Office allemand des brevets.

SOUS-SECTION 4 DISPOSITIONS PARTICULIÈRES RÉGISSANT LES MARQUES

Radiation de marques enregistrées: application de l'article 10.2) de la loi sur les marques

Art. 20. – 1) La radiation d'une marque étendue conformément à l'article 4 a lieu d'office ou sur requête, en

application de l'article 10.2)2° de la loi sur les marques, uniquement dans le cas où la marque n'est susceptible de protection ni selon les dispositions légales jusqu'alors applicables ni selon les prescriptions de la loi sur les marques.

2) L'alinéa 1) s'applique mutatis mutandis aux demandes de retrait de la protection d'un enregistrement international de marque étendu conformément à l'article 4 qui sont présentées en application de l'article 10 du Règlement sur l'enregistrement international des marques de fabrique ou de commerce.

Radiation de marques enregistrées: application de l'article 11 de la loi sur les marques

Art. 21. – 1) Un tiers peut aussi, en application de l'article 11.1)1° de la loi sur les marques, demander la

radiation d'une marque étendue conformément à l'article 4 et enregistrée sur la base d'une demande déposée pendant la période allant du 1er juillet au 2 octobre 1990 si le signe a été enregistré en son nom, sur la base d'une demande d'enregistrement ayant une date de priorité plus ancienne, pour des produits identiques ou similaires, au registre des marques. L'enregistrement international d'une marque effectué en vertu de l'Arrangement de Madrid concernant l'enregistrement international des marques et étendu conformément à l'article premier est assimilé à un tel enregistrement.

2) L'alinéa 1) s'applique mutatis mutandis aux demandes de retrait de la protection d'un enregistrement international de marque étendu conformément à l'article 4 qui sont présentées en application de l'article 10 du Règlement sur l'enregistrement international des marques de fabrique ou de commerce.

Examen des demandes d'enregistrement de marques

Art. 22. – 1) Les demandes d'enregistrement de marques étendues conformément à l'article 4 son régies par

les dispositions de la loi sur les marques sous réserve de dispositions contraires dans les articles ci-après. 2) L'enregistrement ne peut être refusé au motif que le signe dont l'enregistrement est demandé est

une forme de marque qui n'est pas susceptible d'enregistrement selon la loi sur les marques. 3) Les alinéas 1) et 2) s'appliquent mutatis mutandis aux enregistrements internationaux de

marques effectués en vertu de l'Arrangement de Madrid concernant l'enregistrement international des marques et étendus conformément à l'article 4.

Publication des demandes d'enregistrement de marques; opposition

Art. 23. – 1) Les demandes d'enregistrement de marques étendues conformément à l'article 4 sont publiées

conformément à l'article 5.2) ou à l'article 6a.3) de la loi sur les marques, même si elles ont déjà fait l'objet d'un examen selon les prescriptions légales jusqu'alors applicables.

2) Peut seule faire opposition, conformément à l'article 5.4), première phrase, de la loi sur les marques, à l'enregistrement d'un signe ayant fait l'objet d'une demande visée à l'alinéa 1):

1° la personne qui, pour des produits ou des services identiques ou similaires, avait déposé auprès de l'ancien office des brevets de la République démocratique allemande, avec une date de priorité plus ancienne, une demande d'enregistrement d'un signe analogue (art. 31 de la loi sur les marques) qui a été étendue conformément à l'article 4, ou

2° la personne qui, pour autant que le signe publié ait fait l'objet d'une demande auprès de l'ancien office des brevets de la République démocratique allemande pendant la période allant du 1er juillet au 2 octobre 1990, avait déposé pour des produits identiques ou similaires, auprès de l'Office allemand des brevets, avec une date de priorité plus ancienne, une demande d'enregistrement d'un signe analogue (art. 31 de la loi sur les marques) qui a été étendue conformément à l'article premier.

Sont assimilés aux demandes antérieures visées aux chiffres 1° et 2° les enregistrements internationaux de marques effectués en vertu de l'Arrangement de Madrid concernant l'enregistrement international des marques et étendus conformément à l'article premier ou à l'article 4.

3) Les alinéas 1) et 2) s'appliquent mutatis mutandis aux oppositions formées conformément à l'article 2 du Règlement sur l'enregistrement international des marques de fabrique ou de commerce contre l'enregistrement international d'une marque étendu conformément à l'article 4.

Durée de la protection

Art. 24. L'article 9.1) de la loi sur les marques s'applique au calcul de la durée de la protection des marques étendues conformément à l'article 4.

Transfert d'une marque; associations pour le marquage des produits

Art. 25. – 1) Le transfert effectué avant le 1er mai 1992 des droits découlant d'une marque ou d'une demande

d'enregistrement de marque étendue conformément à l'article 4 produit ses effets même en l'absence de l'inscription correspondante au registre, nonobstant les dispositions de l'article 17.1), deuxième phrase, de la loi sur les signes distinctifs de produits du 30 novembre 1984 (GBl. I, n°33, p. 397), modifié par l'article 2 de la loi du 29 juin 1990 (GBl.I, n°40, p. 571).

2) La radiation d'une marque collective [Verbandszeichen ou Kollektivmarke] étendue conformément à l'article premier ou à l'article 4 ou le refus d'enregistrer une telle marque ne peut pas être motivé par le fait que l'association au nom de laquelle la marque a été enregistrée ou a fait l'objet d'une demande d'enregistrement n'a pas la capacité juridique, si, au 1er mai 1992, cette association était inscrite au registre des associations conformément à l'article 7 de la loi sur les signes distinctifs de produits et si cette association, ou la personne à qui les droits découlant de la demande d'enregistrement ou de l'enregistrement de la marque ont été transférés par elle, fournit à l'Office allemand des brevets, avant le 30 avril 1993, la preuve qu'elle remplit les conditions nécessaires à la demande d'enregistrement d'une marque collective conformément aux alinéas 1) ou 2) de l'article 17 et à l'article 18, première phrase, de la loi sur les marques; l'article 20 de la loi sur les marques ne s'applique pas dans ce cas.

Section 3 Concordance de droits; droit de l'utilisateur antérieur

et droit de poursuivre l'utilisation

SOUS-SECTION 1 INVENTIONS, DESSINS ET MODÈLES

Conflits de droits

Art. 26. – 1) Dans la mesure où des brevets, des demandes de brevet ou des modèles d'utilité qui, en vertu de

la présente loi, ont été étendus soit au territoire visé à l'article 3 du traité d'unification, soit au reste du territoire fédéral, concordent dans l'étendue de la protection qu'ils confèrent et entrent en conflit par suite de cette extension, les titulaires de ces titres ou demandes de titre de protection ne peuvent faire valoir les droits qui en découlent ni à l'encontre l'un de l'autre, ni à l'encontre de la personne à laquelle le titulaire de l'autre titre ou demande de titre de protection a donné une autorisation d'utilisation.

2) Cependant, sur le territoire auquel le titre ou la demande de titre de protection a été étendu, l'objet sur lequel porte le titre ou la demande de titre de protection ne peut pas être utilisé, ou ne peut l'être que sous réserve de certaines restrictions, lorsque l'utilisation sans restriction entraînerait pour le titulaire de l'autre titre ou demande de titre de protection, ou pour les personnes qu'il a autorisé à utiliser l'objet de son titre ou de sa demande de titre de protection, un préjudice substantiel injustifié compte tenu de toutes les circonstances et des intérêts légitimes en cause.

3) Les alinéas 1) et 2) s'appliquent mutatis mutandis lorsque, sous l'effet de l'extension, il se produit un conflit entre des dessins et modèles, des certificats d'auteur ou brevets de modèle industriel, ou des demandes de tels titres de protection.

Droits de l'utilisateur antérieur

Art. 27. – 1) Si l'effet d'un brevet ou d'un modèle d'utilité étendu conformément à l'article premier ou

conformément à l'article 4 est limité par un droit d'utilisateur antérieur (art. 12 de la loi sur les brevets, art. 13.3) de la loi sur les modèles d'utilité, art. 13.1) de la loi sur les brevets de la République démocratique allemande), ce droit d'utilisateur antérieur s'exerce sur l'ensemble du territoire fédéral, avec les restrictions découlant de l'article 12 de la loi sur les brevets.

2) L'alinéa 1) s'applique mutatis mutandis lorsque les conditions de la reconnaissance d'un droit d'utilisateur antérieur sont réunies sur le territoire sur lequel le titre de protection n'avait pas d'effet jusqu'alors.

Droit de poursuivre l'utilisation

Art. 28. – 1) Le brevet ou modèle d'utilité étendu conformément à l'article premier ou à l'article 4 n'est pas

opposable au tiers qui a exploité légalement l'invention, sur le territoire sur lequel le titre de protection n'avait pas d'effet jusqu'alors, après le jour déterminant pour la priorité de la demande et avant le 1er juillet 1990. Ce tiers est autorisé à utiliser l'invention pour les besoins de son entreprise dans ses propres ateliers ou dans ceux d'autrui, avec les restrictions découlant de l'article 12 de la loi sur les brevets, à condition que cette utilisation n'entraîne pas pour le titulaire du titre de protection, ou pour les personnes qu'il a autorisé à utiliser l'objet de son titre de protection, un préjudice substantiel injustifié, compte tenu de toutes les circonstances et des intérêts légitimes en cause.

2) Dans le cas d'un produit fabriqué à l'étranger, l'utilisateur n'a le droit de poursuivre l'utilisation en vertu de l'alinéa 1) que lorsque l'utilisation sur le territoire national a fondé des droits acquis dignes de protection dont la non-reconnaissance, compte tenu de toutes les circonstances de l'espèce, entraînerait pour l'utilisateur des répercussions injustifiées.

3) Les alinéas 1) et 2) s'appliquent mutatis mutandis aux dessins et modèles, aux certificats d'auteur et brevets de modèle industriel et aux droits de protection des semi-conducteurs étendus conformément à l'article premier ou à l'article 4.

Conflits avec des droits d'utilisation découlant de l'article 23 de la loi sur les brevets

Art. 29. Dans la mesure où des brevets ou demandes de brevet pour lesquels une déclaration d'offre de licence d'exploitation a été faite conformément à l'article 23 de la loi sur les brevets, ou est considérée comme ayant été faite conformément à l'article 7 de la présente loi, concordent, dans l'étendue de la protection qu'ils confèrent, avec des brevets, des demandes de brevet ou des modèles d'utilité et entrent en conflit avec eux par suite de l'extension effectuée par la présente loi, les titulaires de ces derniers brevets, demandes de brevet ou modèles d'utilité peuvent faire valoir leurs droits découlant de ces titres ou demandes de titre de protection, sans considération de la date de priorité, à l'encontre de la personne qui, en application de l'article 23.3), quatrième phrase, de la loi sur les brevets, a le droit d'exploiter l'invention. Les dispositions de l'article 28 demeurent applicables.

SOUS-SECTION 2 MARQUES ET AUTRES SIGNES DISTINCTIFS

Marques

Art. 30. – 1) Si une marque étendue au territoire visé dans l'article 3 du traité d'unification conformément à

l'article premier entre en conflit par suite de cette extension avec une marque identique étendue au reste du territoire fédéral conformément à l'article 4, chacune de ces marques ne peut être utilisée, sur le territoire auquel elle a été étendue, qu'avec le consentement du titulaire de l'autre marque.

2) La marque peut néanmoins être utilisée même sans le consentement du titulaire de l'autre marque sur le territoire auquel elle a été étendue:

1° aux fins de publicité dans des avis officiels ou dans des communications destinées à un large cercle de personnes, lorsque la diffusion de ces avis officiels ou communications ne paraît pas pouvoir être limitée au territoire sur lequel la marque produisait ses effets jusqu'alors;

2° si le titulaire de la marque démontre de manière vraisemblable que, selon les dispositions de la loi sur le patrimoine, il a droit à la rétrocession de l'autre marque ou de l'entreprise à laquelle appartient l'autre marque;

3° dans la mesure où l'interdiction de l'utilisation de la marque sur ce territoire s'avère injustifiée eu égard à toutes les circonstances et compte tenu des intérêts légitimes en cause.

3) Dans les cas visés à l'alinéa 2)1° et 3°, le titulaire de la marque peut réclamer à la personne qui utilise l'autre marque une compensation équitable dans la mesure où l'utilisation de cette marque lui cause un préjudice anormal.

4) Si, dans le cas visé à l'alinéa 2)2°, le droit à rétrocession s'avère infondé, le titulaire de la marque a l'obligation de réparer le préjudice qui a résulté, pour le titulaire de la marque identique, du fait que la marque a été utilisée sans son consentement sur le territoire auquel elle a été étendue.

Autres signes distinctifs

Art. 31. Si des marques de produits ou de services qui ont été étendues au territoire visé à l'article 3 du traité d'unification ou au reste du territoire fédéral en vertu de la présente loi entrent en conflit par suite de cette extension avec un nom, une raison sociale, une désignation particulière d'une entreprise ou un autre

signe distinctif faisant l'objet d'un droit acquis par l'usage, les dispositions de l'article 30 s'appliquent mutatis mutandis.

Droit de poursuivre l'utilisation

Art. 32. L'effet d'une marque enregistrée ou d'une demande d'enregistrement de marque étendue au reste du territoire fédéral conformément à l'article 4 et qui, en application de l'article premier ou des alinéas 1) ou 2)1° de l'article 4 de la loi sur les marques, serait exclue de l'enregistrement, n'est pas opposable à la personne qui, avant le 1er juillet 1990, utilisait déjà légalement un signe identique à cette marque, pour des produits ou des services identiques ou similaires, dans le reste du territoire fédéral. Cette personne a le droit d'utiliser le signe dans l'ensemble du territoire fédéral pourvu que cette utilisation n'entraîne pas, pour le titulaire de la marque ou les personnes que celui-ci a autorisé à utiliser la marque, un préjudice substantiel injustifié eu égard à toutes les circonstances et compte tenu des intérêts légitimes en cause et de l'intérêt public.

TITRE 2 TRANSFORMATION D'INDICATIONS DE PROVENANCE

EN MARQUES COLLECTIVES

Transformation

Art. 33. – 1) Les indications de provenance inscrites au registre des indications de provenance et celles qui

ont fait l'objet d'une demande d'inscription à ce registre sont, sur demande, transformées en marques collectives (art. 17 à 23 de la loi sur les marques) conformément aux dispositions ci-après.

2) Les indications de provenance transformées en marques collectives reçoivent dans le reste du territoire fédéral la même date de priorité que sur le territoire visé à l'article 3 du traité d'unification.

Demande de transformation

Art. 34. – 1) La demande de transformation ne peut être présentée que par les associations dotées de la

personnalité juridique ou personnes morales de droit public visées à l'article 17 de la loi sur les marques. 2) La demande de transformation doit être présentée avant le 30 avril 1993. Elle est exempte de

taxe. Si ce délai n'est pas respecté, il n'y a pas réintégration dans l'état antérieur. 3) Si la demande n'est pas présentée dans le délai fixé à l'alinéa 2), le droit découlant de

l'inscription au registre des indications de provenance ou du dépôt de la demande d'enregistrement de l'indication de provenance s'éteint. L'extinction du droit fait l'objet d'une mention dans le registre ou dans le dossier de la demande d'enregistrement.

4) L'extinction des droits conformément à l'alinéa 3) n'empêche pas de faire valoir des droits concernant les indications de provenance en cause conformément aux prescriptions légales générales.

Application de la loi sur les marques

Art. 35. Sous réserve de dispositions contraires dans les articles suivants, la demande de transformation est considérée comme une demande de marque collective conformément aux articles 17 à 23 de la loi sur les marques.

Conflits entre des indications de provenance transformées et des marques

Art. 36. Les articles 2 et 3, 20 à 24 et 30 à 32 s'appliquent mutatis mutandis aux demandes de transformation des indications de provenance en marques collectives et aux indications de provenance transformées enregistrées comme marques collectives.

Caractère protégeable des indications de provenance transformées

Art. 37. Si les conditions d'enregistrement d'une marque collective sont par ailleurs remplies, la transformation en marque collective d'une indication de provenance enregistrée ou d'une demande d'enregistrement d'indication de provenance ne peut être refusée au motif qu'il ne s'agit pas d'une indication de provenance, à moins que la désignation ait perdu sa signification originale d'indication géographique et qu'elle soit perçue par les milieux commerciaux intéressés sur l'ensemble du territoire fédéral exclusivement comme un nom de produit ou comme la désignation d'un type de produit.

Droit de poursuivre l'utilisation

Art. 38. – 1) Si une indication de provenance transformée en marque collective est en conflit dans le reste du

territoire fédéral avec une désignation identique, qui y était légalement utilisée avant le 1er juillet 1990 en tant que désignation d'un type de produit, cette désignation pourra encore être utilisée pendant un délai de deux ans suivant l'enregistrement de la marque collective pour identifier des produits ou emballages, ou dans des annonces, tarifs, lettres d'affaires, prospectus, factures ou autres documents analogues. À l'expiration de ce délai, les produits ou emballages ou les annonces, tarifs, lettres d'affaires, prospectus, factures ou autres documents analogues pourvus de cette désignation qui subsistent pourront encore être écoulés pendant un délai supplémentaire de deux ans.

2) Si une indication de provenance transformée en marque collective entre en conflit dans le reste du territoire fédéral avec une désignation identique qui, avant le ler juillet 1990, y était utilisée légalement par une entreprise poursuivant, du point de vue de l'utilisation de cette désignation, la tradition d'une entreprise commerciale établie à l'origine sur le territoire visé à l'article 3 du traité d'unification, l'alinéa 1) s'applique mutatis mutandis, avec cette réserve que le délai pour la poursuite de l'utilisation selon la première phrase est fixé à 10 ans.

TITRE 3 PROCÉDURE DE CONCILIATION

Commission de conciliation

Art. 39. – 1) Dans les litiges de droit civil découlant des conflits de droits de propriété industrielle ou de

droits d'utilisation étendus en application de la présente loi, chacune des parties peut à tout moment saisir la Commission de conciliation.

2) La Commission de conciliation est chargée, dans le cas d'un litige visé à l'alinéa 1), d'amener les parties à un règlement amiable.

3) La Commission de conciliation est constituée auprès de l'Office allemand des brevets. Elle peut aussi se réunir hors de son siège.

Composition de la Commission de conciliation

Art. 40. – 1) La Commission de conciliation est composée d'un président ou de son adjoint et de deux

assesseurs. 2) Le président et son adjoint doivent avoir les qualifications requises par la loi allemande sur le

statut de la magistrature pour l'exercice de fonctions judiciaires et avoir l'expérience des questions de

propriété industrielle. Ils sont nommés par le ministre fédéral de la justice, au début de l'année civile, pour un an.

3) Les assesseurs sont désignés par le président pour chaque litige sur la liste des assesseurs établie chaque année, pour l'année civile, par le président de l'Office allemand des brevets. La désignation se fait en accord avec les parties. Si une proposition est présentée d'un commun accord par les parties, le président doit normalement l'accepter, même si les personnes proposées ne figurent pas sur la liste.

4) Les articles 41 à 43 et 44.2) à 4) du code de procédure civile s'appliquent mutatis mutandis à l'exclusion et à la récusation de membres de la Commission de conciliation. Le Tribunal fédéral des brevets statue sur les demandes en récusation.

Charge honorifique; contrôle hiérarchique

Art. 41. – 1) Les membres de la Commission de conciliation exercent leurs activités à titre honorifique. Le

président et son adjoint peuvent aussi être des magistrats de carrière. 2) Avant d'exercer pour la première fois leurs fonctions, le président et son adjoint font serment

devant le ministre fédéral de la justice, et les assesseurs devant le président, de s'acquitter consciencieusement et impartialement de leur tâche et d'observer le secret professionnel.

3) Le contrôle hiérarchique sur la Commission de conciliation est exercé par le président, et le contrôle hiérarchique sur le président, par le ministre fédéral de la justice.

Procédure devant la Commission de conciliation

Art. 42. – 1) La Commission de conciliation est saisie par une requête écrite. La requête contient un bref

exposé des faits et indique le nom et l'adresse de la partie adverse. 2) Les articles 1035 et 1036 du code de procédure civile sont applicables mutatis mutandis à la

procédure devant la Commission de conciliation. L'article 1034.1) du code de procédure civile est applicable mutatis mutandis, avec cette réserve que les conseils en brevets exerçant à titre libéral, les conseils non titulaires [Erlaubnisscheininhaber] et, dans le cadre de l'article 156 du règlement sur les conseils en brevets, les conseils en brevets salariés d'une entreprise [Patent-assessoren] ne peuvent être récusés par la Commission de conciliation.

3) Par ailleurs, la Commission de conciliation fixe elle-même ses règles de procédure. Elle peut ordonner la comparution des parties.

Proposition d'accord; règlement

Art. 43. – 1) La Commission de conciliation prend ses décisions à la majorité. L'article 196.2) de la loi sur

l'organisation judiciaire est applicable. 2) La Commission de conciliation peut soumettre par écrit une proposition d'accord aux parties.

Cette proposition d'accord ne peut être publiée qu'avec l'autorisation des parties. 3) L'exécution forcée d'un règlement arrêté par la Commission de conciliation peut être obtenue, si

ce règlement est consigné dans un écrit spécial et s'il est signé et daté par les membres de la Commission de conciliation qui ont participé aux débats et par les parties. L'article 797a du code de procédure civile s'applique mutatis mutandis.

Interruption de la prescription

Art. 44. La saisine de la Commission de conciliation interrompt la prescription de la même manière que l'introduction d'une action en justice. La prescription est interrompue jusqu'à la clôture de la procédure devant la Commission de conciliation. Si aucun règlement n'est arrêté, la Commission de conciliation fixe la date à laquelle la procédure prend fin. Le président en informe les parties. Si la Commission de conciliation est dessaisie, la prescription est considérée comme n'ayant pas été interrompue.

Coût de la procédure de conciliation

Art. 45. – 1) La requête saisissant la Commission de conciliation donne lieu au versement d'une taxe de

300 DM. Si la taxe n'est pas versée, la requête est considérée comme nulle. 2) Le règlement sur les droits couvrant les frais administratifs de l'Office allemand des brevets

s'applique mutatis mutandis au versement de la taxe visée à l'alinéa 1) et aux autres frais. 3) La Commission de conciliation doit amener les parties à s'entendre à l'amiable sur la répartition

des frais de procédure, même dans le cas où aucun accord n'est intervenu sur le fond. A défaut d'accord, la Commission de conciliation décide en équité de la répartition des frais visés à l'alinéa 2); chaque partie assume par ailleurs les dépenses qu'elle a engagées.

4) Les décisions prises selon l'alinéa 2) et l'alinéa 3), troisième phrase, sont susceptibles de recours devant le Tribunal fédéral des brevets. Les dispositions de la loi sur les brevets relatives à la procédure de recours sont applicables mutatis mutandis, à l'exception des articles 76 à 78.

Indemnités versées aux membres de la Commission de conciliation

Art. 46. Les membres honoraires de la Commission de conciliation reçoivent des indemnités conformément aux articles 2 à 5 et 9 à 11 de la loi sur les indemnités des magistrats honoraires; l'annexe I, chapitre III, partie A, section III, n°24 du traité d'unification du 31 août 1990 (BGBl. 1990 II, p. 885, 936) n'est pas applicable. Le montant des indemnités est fixé par le président de l'Office allemand des brevets. L'article 12 de la loi sur les indemnités des magistrats honoraires est applicable mutatis mutandis. La juridiction compétente en la matière est le Tribunal fédéral des brevets.

Inventions de salariés

Art. 49. Les inventions qui ont été faites avant le 3 octobre 1990 dans le territoire visé à l'article 3 du traité d'unification sont régies par les dispositions de la loi sur les inventions de salariés relatives au droit à rémunération dans le cas où l'employeur se fait attribuer tous les droits sur une invention de service, dans la mesure où le droit à rémunération n'était pas né avant le ler mai 1992, ainsi que par les dispositions concernant la procédure d'arbitrage et la procédure judiciaire. Elles continuent par ailleurs d'être régies par

les dispositions jusqu'alors applicables (annexe I, chap. III, partie E, sect. II, n°1, art. 11 du traité d'unification du 31 août 1990, BGBl. 1990 II, p. 885, 962).

Procédures de médiation en instance

Art. 50. Les procédures encore en instance au ler mai 1992 auprès de la Commission de médiation de l'Office allemand des brevets pour les litiges en matière de rémunération sont reprises, en l'état, par la Commission d'arbitrage de l'Office allemand des brevets créée en vertu de la loi sur les inventions de salariés.

Procédures de recours et d'annulation en instance

Art. 51. – 1) Les procédures de recours et d'annulation qui, au ler mai 1992, sont encore en instance auprès

d'une section des recours ou d'une section d'annulation de l'Office allemand des brevets sont reprises, en l'état, par le Tribunal fédéral des brevets.

2) Les procédures qui, au ler mai 1992, sont encore en instance devant une section de radiation des marques de l'Office allemand des brevets sont poursuivies par la Division des marques de l'Office allemand des brevets.

Délais

Art. 52. Si l'objet du litige est un titre de protection étendu conformément à l'article 4 ou une demande de titre de protection étendue conformément à cet article, le délai de procédure qui a commencé à courir avant le ler mai 1992 obéit aux dispositions légales jusqu'alors applicables.

Taxes

Art. 53. – 1) Les taxes afférentes à des titres et des demandes de titre de protection étendus conformément à

l'article 4 qui étaient exigibles avant le ler mai 1992 doivent être versées conformément aux dispositions légales jusqu'alors applicables.

2) Si une taxe qui devient exigible le ler mai 1992 ou à une date ultérieure a déjà été versée avant cette date conformément au barème en vigueur jusqu'alors, elle est considérée comme acquittée.

Application de la loi contre la concurrence déloyale et d'autres dispositions légales

Art. 54. L'application de la loi contre la concurrence déloyale et des dispositions légales générales sur l'acquisition ou l'exercice des droits, et en particulier sur l'abus de droit, n'est pas affectée par les dispositions de la présente loi.

Entrée en vigueur

Art. 55. La présente loi entrera en vigueur le premier jour du mois civil suivant sa publication.
