Program of the Dialogue on IP and Insurance

As IP and other intangible assets become increasingly central to business value, competitiveness and growth, businesses face a range of IP-related risks that remain difficult to identify, assess and insure. These include infringement disputes, enforcement costs, uncertainty over IP ownership and validity, loss of IP asset value, and emerging exposures associated with technological developments, including generative artificial intelligence.

Despite the growing economic importance of intangible assets, their integration into conventional insurance frameworks remains limited, raising important questions about how businesses can better manage IP-related risks and how the insurance industry can respond to their evolving needs.

The Dialogue aims to foster a multidisciplinary exchange on the relationship between IP, risk management and insurance, with particular attention to its practical implications for businesses, including small and medium-sized enterprises (SMEs).

In particular, the discussions will explore:

  • How IP-related risks interact with business strategy, competitiveness and growth.
  • Existing and emerging insurance approaches to IP-related risks, including coverage models and pathways to insurability.
  • The role of effective IP management, governance and documentation in improving the visibility and assessment of intangible assets and associated risks.
  • The opportunities and challenges presented by technological developments, including AI, for IP risk assessment and insurance.
  • Practical experiences and initiatives that can contribute to improving businesses' understanding of, and access to, IP insurance solutions.

Through exchanges among public and private sector stakeholders, the Dialogue seeks to identify practical insights and opportunities for further work at the intersection of IP and insurance.
