The Constitution of December 17, 1962 repealed the Constitution of January 5, 1911 and was last amended by Law No. 1.249 of April 2, 2002.
The Constitution outlines the separation of powers among the three branches of government. The legislative branch consists of a unicameral National Council which is the Principality’s legislative body. The executive branch in Monaco is composed of the Prince and the Minister of State who presides over a six-member Council of Government, responsible for enforcing the laws. The judiciary in Monaco is invested in the Prince, who delegates legal procedures to the Courts of the Principality.
The Constitution does not contain provisions concerning the protection of intellectual property rights. However, Article 24 of Title III entitled “Fundamental Freedoms and Rights' protects the right to private property.
