This Act includes all amendments up to Cultural Laws Amendment Act 36 of 2001.
The purpose of this Act is to make provisions for the establishment of a Bureau of Heraldry for the registration of heraldic representations, names and special names or uniforms (Section 1). The bureau may examine applications for the registration of names or uniforms or their deletion; it also keeps a register and issues certificates (Section 2). The register may contain the coat of arms of the Republic or the provinces, the national flag or other heraldic representation instituted by any law.
The Act provides that a person who misuses a registered name or special name or uniform shall be guilty of an offence and convicted to a fine of a maximum of one thousand rand. With regards to the coat of arms of the Republic, the person found guilty of an offence shall be convicted to a fine not exceeding ten thousand rand or in default of payment to imprisonment for a period not exceeding five years (Section 22).
Section 28 of this Act stipulates that it takes effect on a date determined by the State President by proclamation in the Gazette.
