Section I.
GENERAL PROVISIONS
Article 1. Relationships Regulated by the Patent Law
This law shall regulate economic as well as related to them, personal non-economic relationships arising in the territory of the Kyrgyz Republic in connection with creation, legal protection and use of inventions, utility models and industrial designs (hereinafter referred to as objects of industrial property).
Article 2. The Authorized State Structure of the Kyrgyz Republic in the field of
Intellectual Property
In compliance with this Law, the State Structure of the Kyrgyz Republic in the field of Intellectual Property (hereinafter referred to as Kyrgyzpatent), shall accept applications for the examination of objects of industrial property, conduct examination, the state registration, grant patents, publish official data on objects of industrial property, issue clarifications on the application of this Law and perform other functions in accordance with the Regulation thereon approved by the Government of the Kyrgyz Republic.
Kyrgyzpatent shall manage the National Patent Fund, provide its storage and complexion by the way of acquisition and exchange with international organizations and foreign patent agencies.
In order to improve the activity of Kyrgyzpatent on provision of legal protection to the objects of industrial property, the Appellate Council is being established under Kyrgyzpatent, which is the obligatory initial body for examination of disputes arising with respect to the objects of industrial property due to its jurisdiction. The order of consideration objections by the Appellate Council shall be established by Kyrgyzpatent
The sources of financing the activities of the Kyrgyzpatent shall be means of republican budget, patent fees, payment for services and materials provided by Kyrgyzpatent and other non-budget sources.
(Version of the Law of the Kyrgyz Republic of February 27, 2003 # 46) Article 3. Legal Protection of the Objects of Industrial Property
The right to the object of industrial property shall be protected by this Law and shall be confirmed by a patent, which certifies priority, authorship and patent owner’s exclusive right for this object of industrial property.
The scope of legal protection provided by a patent for an invention and utility model shall be determined by their formula and that for a patent for an industrial design, by the whole of its essential features shown in the depiction of an article (model) and listed
essential features.
Legal protection of the objects of industrial property recognized as a secret by the state shall be regulated by the legislation of the Kyrgyz Republic.

A patent for an invention shall be effective during twenty years as of the date of submission the application to Kyrgyzpatent. At the request of the owner, Kyrgyzpatent may extend the effective period of the patent for an invention related to pharmaceutics for a term not longer than five years.
The patent for utility model shall be effective within the period of five years as of the date of file of an application with Kyrgyzpatent. At the request of the owner, Kyrgyzpatent may extend the effective period of the patent for an invention for utility model for a term not longer than three years.
Patent for an industrial design shall be effective within ten years as of the date of file of an application with Kyrgyzpatent. At the request of the patent owner, Kyrgyzpatent may
extend the effective term of the patent for an industrial design for a term not longer than five years.

CONDITIONS OF PATENTABILITY OF THE OBJECTS OF INDUSTRIAL PROPERTY
Article 5. Conditions of Patentability of an Invention
An object claimed as an invention shall enjoy legal protection if it is new, has an inventive level and applicable in industry.
An invention shall be considered new if it is not known from the standard of technology. An invention shall be considered as having an inventive level if it does not obviously
follow from the standard of technology.
The standard of technology shall include any information, which has become generally available in the world before the priority date of the invention.
While establishing the novelty of an invention, the information on the standard of technology shall include non-withdrawn applications of other persons, submitted to Kyrgyzpatent with an earlier priority, as well as inventions and utility models patented in the Kyrgyz Republic.
An invention shall be considered applicable in industry if it may be used in industry, agriculture, public health service and in other branches of public economy.
No public disclosure of information shall be considered as affecting patentability if it was made by the applicant, author or by any other person who obtained it from him directly under which the information about the substance of an invention became publicly open not earlier than twelve months before the date of file of an application or before the priority date if it is sought. The obligation of proof of this fact lies with the applicant.
The objects of inventions may be a device, method, composition of matter, a strain of microorganism, cells of plants and animals, as well as application of previously known device, method, composition of matter and strain for a new purpose or any other new achievement in the area of technology and technique.
Shall not be deemed as inventions:
1) scientific theories and methods of mathematics;
2) methods of organization and management of economy;
3) signs, schedules and rules;
4) methods of performance of mental activities;
5) algorithms and computer programs as such;
6) drafts and schemes for planned structures, buildings and territories;
7) decisions regarding only the appearance of articles aimed for satisfaction of aesthetic needs;
8) integrated circuits topography;
9) varieties of plants and breeds of animals;
10)decisions contradicting with public interests, principles of humanity and morals, hazardous to the environment.
The objects listed in items 5, 8, 9, of paragraph 9 shall be protected by separate laws.
The presence of algorithm and software programs in the invention shall not be deemed as a fact influencing the patentability of an invention, if they are considered as a part of
an invention.
Article 6. Conditions of Patentability of Utility Model
Devices shall be related to utility models.
The object claimed as a utility model shall be provided with legal protection if it is new and applicable in industry.
Utility model shall be considered new if the whole of its significant features is not known from the level of engineering.
The information on the level of engineering shall include data published on the means designed for the same purpose as the utility model claimed, which have become generally available before the date of priority of the application for utility model, the data on their use in the Kyrgyz Republic, not withdrawn applications for inventions and utility models submitted earlier by other persons as well as inventions and utility models patented in the Kyrgyz Republic.
No disclosure of information related to the utility model shall be recognized as affecting novelty of the utility model if made by the applicant or by any other persons who obtained from him the information directly or indirectly under which the information on
the essence of the utility model became public, not earlier that six months before the date of submission of a application or the priority date if its sought. The burden of proof of that fact lies with the applicant.
A utility model is applicable in industry if it can be practically used.
Objects mentioned in paragraph 9, Article 5 of this Law are not protected as utility models.
Article 7. Conditions of Patentability of an Industrial Design
Industrial designs shall be artistic and structural embodiments of an article, which determine its exterior. At that a term “article” means industrial or home-made good.
An object claimed as an industrial design shall be given legal protection if it is new and original.
An industrial design shall be considered new if the whole of its essential features presented in the depiction of an article (model) and in the list of essential features is not known from the information available to the public before the date of priority of the industrial design.
In the course of establishing the novelty of an industrial design, all not recalled applications for industrial designs filed earlier by other persons in the Kyrgyz Republic and the industrial designs patented in the Kyrgyz Republic shall be taken
into consideration.
An industrial design shall be considered as original if its essential features determine creative character of peculiarities of the article.
Features that determine aesthetic and (or) ergonomic peculiarities of the exterior of an article, its form and configuration, ornament and combination of colors are considered to be the essential features of an industrial design.
No disclosure of information which became generally available to the public, related to the industrial design shall be recognized as affecting patentability of the industrial design if such disclosure is made by an applicant, the author, or any other person who has obtained this information from him, under which the information on the essence of an industrial design became public, not earlier than six months before the date of file of an application or the priority date if its sought. The burden of proof of this fact lies with
the applicant.
The following shall not be deemed as industrial designs:
1) decisions conditioned by solely technical function of the article;
2) architectural units (except for small architectural forms), industrial, hydro technical and other stationary structures;
3) printed matter as such;
4) objects of unstable shape such as liquid, gas, bulk substances or like that;
5) articles that contradict public interests, the principles of humanity and morals. (Version of the Law of the Kyrgyz Republic of February 27, 2003 # 46)
Section III. SUBJECTS OF LAW
Article 8. The Author of the Object of Industrial Property
The natural person by whose creative labor the work is done shall be considered the author of an object of industrial property.
If several natural persons participated in the creation of an object of industrial property, all of them shall be recognized as its authors. The order of using the rights, which belong to the authors shall be determined by agreement between them.
Natural persons who have not made personal contribution in the creation of an object of industrial property but who have provided only technical, organizational or material assistance to the author (authors) or who have only helped to form rights for it and the use thereof shall not be recognized the authors.
The right of authorship shall be inalienable personal right and protected without time limits.
Article 9. The Patent Owner
The right to obtain patent shall belong to:
1) the author (authors) of the object of industrial property;
2) employer in the cases stipulated in item two of the present Article;
3) their successor, including a person obtained appropriate right in the assignment order; The right to obtain patent for the object of industrial property created by the employee
due to execution of his service duties or a specific task of the employer shall belong to the employer, unless otherwise is provided by the agreement between the employer and employee. .
If the employer, within four months from the date of notification by the author on the created object of industrial property, does not file an application with Kyrgyzpatent, does not reassign the right to the other person to obtain patent and does not inform the author that the object of industrial property is kept secret, than the right to obtain patent is transferred to the author. In that case, the employer shall have the right to use the object of industrial property in his production paying compensation to the patent owner that is determined on contractual basis.
The right to obtain patent for the object of industrial property created by the employee with the use of experience, material, technical and other means of the employer but not in connection of execution of working duties by the employee or concrete task of the employer shall belong to the employee if otherwise is not specified in the agreement between him and employer. In this case the employer has the right to use the object of an industrial property in his production paying the compensation to the patent owner determined on contractual basis.
Article 10. The Right of the Author to Remuneration
The author who has no right to obtain patent has the right to get remuneration from the employer paid in the amount and under conditions determined on the basis of the agreement between them.
In the event the agreement between the parties on the amount and the order of payment of remuneration or compensation is not reached the dispute shall be considered by the court.
Should the remuneration or compensation provided in the agreement not be paid in time, the employer guilty of that shall bear responsibility pursuant to the legislation of the Kyrgyz Republic.
Other relations arising in connection with the creation of the object of industrial property by an employee shall be regulated by the legislation of the Kyrgyz Republic on work inventions, utility models and industrial designs.
Section IV.
THE EXCLUSIVE RIGHT TO THE OBJECTS OF INTELLECTUAL PROPERTY Article 11. The Rights of Patent Owner
The patent owner shall have the exclusive right to protected by the patent for Intellectual Property subject-matters, including the right to prohibit the use of these objects by other persons, except for the cases when such use does not infringe the exclusive right of the patent owner according to this Law.
The exclusive right to protected Intellectual Property subject-matters appears since the date of publication of the information concerning patent issue in the Official Bulletin issued by Kyrgyzpatent.
Relationships regarding the use of an object of industrial property the patent for which belongs to several persons shall be determined by the agreement between them. In the absence of such agreement, each of them may use the protected object at his own discretion but shall have no right to provide an exclusive license for it or assign the patent to the another person without the agreement of other owners.
If an agreement on granting an exclusive license or assignment of a patent is not achieved between patent owners, division of the rights to the object of industrial property may be decided in the court.
Manufacture, application, import, offer for sale, sale and any other introduction to the economic turnover or storage of a product for this purpose that contains objects of industrial property protected by a patent as well as exploitation of the method protected by a patent for an invention shall be considered as the exploitation of an object of industrial property.
The product shall be deemed containing an invention protected by a patent for invention, utility model if it contains every feature of the invention, utility model listed in an independent point of the formula or a feature equivalent thereto, which is known as such in this field of technology at the date of beginning exploitation. The method protected by a patent for an invention shall be deemed applicable if every feature of the invention listed in an independent point of the formula or equivalent to it feature which is know as such in the field of technology on the date of beginning the exploitation is applied.
The product is deemed containing an industrial design protected by a patent if it includes all of its essential features presented in the depiction of an article (model) and in the list of essential features.
The use of a method protected by a patent shall be also deemed introduction into an economic turnover or storage with the same purpose of a device by functioning or exploitation of which, pursuant to its assignment, the present method is automatically provided.
The use of a method for production of a good protected by a patent shall be also deemed introduction into an economic turnover or storage with the same purpose of a good produced directly by this method. Under this condition the new product is considered to be manufactured by a patented method if otherwise is not proved.
Manufacture, experimental examination or examination of an experimental design of a product is not deemed the use of an object of industrial property.
The patent owner may assign the obtained patent to any natural person or legal entity. The agreement on assignment of a patent shall be registered at Kyrgyzpatent and published in the Official Bulletin of Kyrgyzpatent. The agreement shall not be valid without registration.
Patents and the right to obtain them shall be inherited.
(Version of the Law of the Kyrgyz Republic of February 27, 2003 # 46) Article 12. Obligations of the Patent Owner and Compulsory Licenses
If the object of industrial property is not used or insufficiently used by the patent owner or persons to whom the rights for it has been transferred, within three years as of the date of granting a patent, that leads to insufficient supply of the appropriate goods or services at the market of goods and services, any person wishing and ready to use patent of an industrial property, in the event of refusal of the patent owner to conclude licensing agreement with this person on the conditions pursuant to the common practice, has the right to apply to court with an action to provide him a compulsory license for the use of this object.
If the patent owner fails to prove that the non-use or insufficient use of an object of industrial property is conditioned by excusable reasons, the court shall grant the indicated license specifying the scope of use, the amount, time limits and procedures of payment. The amount of payment must not be lower than the price of the license, which is determined in compliance with the established practice.
The patent owner that can not use an invention without infringing the rights of the other owner of a patent for an invention or for a utility model, who has refused to conclude a licensing agreement based on the conditions that are in compliance with the common practice, has the right to apply to court with an appeal to grant him a compulsory license for the exploitation of an invention or utility model under condition that his invention presents an important technological achievement of the significant economic value with respect to the invention or utility model patent for which belongs to the other person.
If the indicated license is provided, the court must establish the limits for the use of an invention or utility model, patent for which belongs to the other person, in the scope necessary to exploit an invention patented by the person requiring to provide him a compulsory license, as well as the amount, terms and payment order. The amount of payment must be established not less than the price for a license, which is determined in compliance with the common practice.
In the emergency situations (disasters, catastrophes, big accidents), as well as in the interests of the national security, the Government of the Kyrgyz Republic shall have the right to grant a compulsory license coupled to payment of an applicable compensation to a patent owner, in this case the volume and time of exploitation of the patented object of
industrial property shall be restricted by the purposes for which it was allowed. Disputes arising due to such exploitation shall be decided by court.
The compulsory license shall always be non-exclusive license, it cannot be reassigned to another person.
Article 13. Actions Not Considered as an Infringement of the Exclusive Right of the
Patent Owner
The following is not recognized as an infringement of the exclusive right of the patent owner:
1) application of the means containing objects of industrial property protected by patents in the construction or during exploitation of transport facilities (sea-going, river, air, land and cosmic) of other countries under condition that said facilities temporarily or accidentally stay in the territory of the Kyrgyz Republic and are used for the needs of transport facility. Such actions shall not be considered as an infringement of the exclusive right of the patent owner if transport facilities belong to natural persons or legal entities
of the countries that provide the same rights to the owners of transport facilities of the
Kyrgyz Republic;
2) conducting scientific research or an experiment with an article containing an object of industrial property;
3) application of such means during emergency situation (natural calamities, catastrophes, big accidents) with subsequent payment of a commensurate compensation to the patent owner;
4) application of means containing objects of industrial property protected by patents if these means are introduced into an economic turnover in a legal way in compliance with the rights granted by a patent owner. In this case the person who under the permission of the patent owner acquires a mean containing patented object of an industrial property or manufactured with the use of the patented method, shall have the right to use or dispose this mean without additional permission, unless otherwise is provided by the agreement.
Article 14. The Right of Prior Use and Provisional Legal Protection
Any natural person or a legal entity who before the date of priority of an object of industrial property, regardless from the author, has created and used on the territory of the Kyrgyz Republic a solution similar to the object of an industrial property or made the required preparations shall keep the right to use it free of charge without enlarging the scope of such use.
The right of prior use may be assigned to another natural person or legal entity but together with the production where the use of identical solution has taken place or the required preparations has been made for that purpose.
The claimed invention since the date of publication of the information concerning application to the date of publication of the information concerning patent issue is provided by provisional legal protection in the scope of published formula but no more than the scope determined by the formula contained in the issued patent.
Provisional legal protection shall not be considered if an application was withdrawn or considered as withdrawn or if decision on the refusal in patent issue was made and the possibilities for its appeal are exhausted.
Any natural person or legal entity, using the claimed invention within the provisional legal protection period shall pay an appropriate pecuniary compensation to the patent owner after patent getting. Size of this compensation shall be determined by the agreement between appropriate parties.
Provision of paragraph 5 of this Article are also cover the objects of industrial property since the date of placement of means containing such objects of industrial property at official or officially recognized international exhibition arranged on the territory of member-state of the Paris Convention on Industrial Property Protection, provided that an application for patent grant was filed with Kyrgyzpatent no later than six months since indicated date.
A person beginning the use of the object of industrial property since priority date but before the date of publication of the information concerning application for granting of a patent for invention as well as information concerning registration of utility models or industrial designs must dissolve a further use at the request of an applicant.
However such person must not pay applicant’s damages incurred as a result of such use. In case of failure to execute the applicant’s request provided by paragraph 7 of this Article the infringer is liable for the infringement of rights of patent owner in accordance with the Law of the Kyrgyz Republic.
(Version of the Law of the Kyrgyz Republic of February 27, 2003 # 46) Article 15. Granting the Right to Use the Object of Industrial Property
Any person who is not the patent owner shall have the right to use an object of industrial property protected by a protected document only with the permission of a patent owner on the basis of licensing agreement.
According to the licensing agreement, the patent owner (licenser) takes an obligation to give the right to use a protected object within the scope provided in the agreement to another person (licensee) and the latter takes an obligation to make payments to the licenser provided in the agreement and perform other actions provided in the agreement.
In the case of an exclusive license the licensee shall be given an exclusive right to use an object of industrial property within the limits provided in the agreement, retaining the
right to use the object of industrial property with the licenser in the part, which is not transferred to the licensee.
In the case of non-exclusive license, the licenser while giving the right to the licensee to use an object of industrial property shall retain all the rights which come out from the patent, including the right to transfer the license to a third party.
A license may contain provisions different from the ones indicated in this Article on the basis of mutual agreement between a licenser and a licensee.
A license agreement shall be subject to registration at Kyrgyzpatent and shall not be valid without such registration. The license agreement shall become effective as of the date of its registration at Kyrgyzpatent, and shall be published in the official bulletin
of Kyrgyzpatent.
A patent owner may file an application with Kyrgyzpatent to the effect that he is granting the right to use an object of industrial property (open license) to any person under conditions established in the agreement. In this case the fee, in order to keep patent effective, shall be reduced by 50% as of the year following the year of publication of the information about such application by Kyrgyzpatent.
The application of a patent owner on granting the right to an open license cannot be withdrawn.
Disputes on the refusal to conclude an agreement as well as on the condition of the agreement shall be examined in court.
Article 16. Violation of a Patent
The use of an object of industrial property protected by a patent without maintenance of conditions established by the present Law is considered violation of a patent.
The patent owner has the right to require:
* discontinue violation of a patent;
* indemnification of losses caused, including lost profit and compensation of moral damage by a person guilty of violation of a patent;
* exaction of income received by the infringer of a patent instead of indemnification of losses;
* payment of compensation by an infringer in the amount of 10 to 50.000 minimum salaries established by the legislation of the Kyrgyz Republic, determined at the discretion of court instead of indemnification of losses or exaction of income;
* confiscation of products to ones own benefit introduced to an economic turnover or stored for this purpose and considered as infringing a patent as well as means specially directed for the infringement of a patent;
* publication of court decision in order to rehabilitate his\her business reputation. Demands to the infringer of patents may also be made by the owner of the exclusive
license if otherwise is not specified by the licensing agreement or the owner of non-
exclusive license, if this is provided by the licensing agreement. Section V.
THE RECEIPT OF PATENTS
Article 17. File of an Application for the Grant of a Patent
An application for the grant of a patent shall be filed with Kyrgyzpatent by a person who has the right to receipt patent in accordance with Article 9 of the present Law (hereinafter referred to as an applicant).
An application for the grant of a patent shall be filed in the Kyrgyz or Russian language. The formula of the invention or utility model, the list of essential features of industrial design, the name of the object of industrial property, the name of an applicant and patent owner must be submitted in the Kyrgyz or Russian language. If other documents of the application as well as documents presented during examination of an application are submitted in the other language, the translation into Kyrgyz or Russian shall be attached. The applicant must present the translation into Kyrgyz or Russian no later than three months as of the date of file of an application with Kyrgyzpatent.
At the petition of an applicant the term of presenting indicated documents may be prolonged and reinstated in the event of its violation under the proof of valid reasons and payment of corresponding fee.
An application may be filed through a patent agent registered at Kyrgyzpatent. Natural persons residing out of the Kyrgyz Republic or foreign legal entities or their patent agents shall conduct operations related to obtaining patents as well as protection of object of industrial property through the patent agents registered at Kyrgyzpatent, except the procedures related to establishing date of application filing, fees payment, provision of
the copy of previous application, if conventional priority is required, provision of the copy of the application filed earlier, getting of receipts and notifications of Kyrgyzpatent in respect of above-mentioned procedures, fee payment for maintenance of the patent.
The authority of a patent agent shall be attested by a power of attorney issued to him by a person, in whose name the patent is requested.
Kyrgyzpatent shall determine the order of attestation and registration of patent agents and implement it.

Application for the grant of a patent for an invention (hereinafter referred to as the application for an invention) shall be related to one invention or a group of inventions so closely linked with each other that they meet the requirements of the unity of
an invention.
The application for an invention must include:
1) application for the grant of a patent with the indication of the author (authors) of an invention and the person (persons) in whose name the patent is sought, their place of residence or destination;
2) description of the invention disclosing it fully enough to embody it by the specialist in this field;
3) the formula of an invention expressing its essence and fully based on the description;
4) draughts and other materials if these are necessary for understanding the subject matter\essence of an invention;
5) essay.
The application for an invention shall enclose the document that proves payment of fee in the established amount or grounds for the exemption from payment of fee as well as reduction of its amount, which may be provided at submission of an application or within two months under condition of payment of additional fee.
The application is considered to be withdrawn if this document is not provided in the established term.
The date of file of an application with Kyrgyzpatent is set as of the date of receipt of the documents necessary to establish the priority pursuant to the requirement of paragraph 1, Article 21 of the present Law, but if these documents are not presented simultaneously, than it is established on the date of receipt of the last one of the documents presented.

An application for the grant of a patent for a utility model (hereinafter referred to as application for the utility model) shall be related to one utility model or a group of utility models so closely linked with each other that they meet the requirement of the unity of utility model.
The application for a utility model must include:
1) application for granting of the patent with specification of the author (authors) of the utility model and a person (persons), in whose name the patent is requested, as well as the place of their residence or destination;
2) description of the utility model disclosing it fully enough to embody it;
3) the formula for a utility model fully based on the description;
4) draughts if necessary for understanding the essence of a utility model;
5) essay.
The application for a utility model shall be enclosed with the document that proves payment of a due fee in the established amount or grounds for exemption from payment for the file of an application as well as reduction of the amount which may be provided at submission of an application or within two months under condition of payment of additional fee.
The application is considered to be withdrawn if this document is not provided in the established term.
The date of file of an application with Kyrgyzpatent is set as of the date of receipt of the documents necessary to establish the priority pursuant to the requirement of paragraph 1, Article 21 of the present Law, but if these documents are not presented simultaneously, than it is established due to the date of receipt of the last one of presented documents.

An application for the grant of a patent for an industrial design (hereinafter referred to as the application for industrial design) must be related to one industrial design or a group of industrial designs so closely linked with each other that they meet the requirement of the unity of an industrial design).
The application for an industrial design must include:
1) application for granting of a patent with specification of the author (authors) of an industrial design and a person (persons), in whose name the patent is requested, as well as the place of their residence or destination;
2)set of depiction of an article (model) which give full and detailed idea of the exterior of an article.
3) the draught of the whole exterior of an article, ergonomic scheme, confection map, if they are necessary for the disclosure of the essence of an industrial design;
4) description of the industrial design;
5) the list of its essential features.
The application for an industrial design shall be enclosed with the document that proves payment of a due fee in the established amount or grounds for the exemption from payment of fee as well as reduction of the amount which may be provided at submission of an application or within two months under condition of payment of additional fee.
The application is considered to be withdrawn if this document is not provided in the established term.
The date of file of an application with Kyrgyzpatent is set as of the date of receipt of the documents necessary to establish the priority pursuant to the requirement of paragraph 1, Article 21 of the present Law, but if these documents are not presented simultaneously, than it is established due to the date of receipt of the last one of the documents presented.
Kyrgyzpatent shall also determine any other requirements to application documents. (Version of the Law of the Kyrgyz Republic of February 27, 2003 # 46)
Article 21. Priority of the Object of Industrial Property
Priority of an invention and utility model shall be established on the date of file of an application with Kyrgyzpatent, which contains the following:
1) application for the grant of a patent for invention, utility model - with indication of applicant;
2) description of invention, utility model or part of description of invention, utility model, including all essential features of the claimed invention, utility model or draught as an element of mentioned description or a reference to application of any kind filed earlier provided by paragraphs 6-10 of this Article. If the application does not contain above- mentioned documents, Kyrgyzpatent shall notify promptly the applicant on necessity of submission of these documents within two months since the date of receipt of
this notification.
Priority of an industrial design shall be established on the date of file of an application with Kyrgyzpatent containing the following:
1) application for the grant of a patent for industrial design with indication of the applicant;
2) a set of depiction of article (model), a list of essential features of an industrial design. If the application does not contain required documents Kyrgyzpatent shall notify
promptly the applicant on necessity of submission of these documents within two months since the date of receipt of this notification.
Priority may be established on the date of filing of the original application in a country- member of the Paris Convention on Protection of Industrial Property (conventional priority) if the application for an invention or a utility model is filed with Kyrgyzpatent during twelve months, and the application for an industrial design, during six months from said date. The day of filing of the original application is not included to calculation of the said terms.
If due to the circumstances beyond control of an applicant the application claiming conventional priority could not be filed within the required term, the time period may be extended but not more than for two months.
An applicant wishing to use the right of conventional priority must indicate this during filing of an application or during two months from the date of file of an application with Kyrgyzpatent and attach a copy of the initial application or present it not later than four months from the date of receipt of the application by Kyrgyzpatent.
Priority may be established on the date of submission the additional materials if they have been prepared by an applicant as an independent application filed before expiration of a three-month-period from the date of receipt a notification from Kyrgyzpatent to the effect that it is not possible to accept additional documents since they are deemed to change the subject matter of the solution claimed.
Priority may be established on the date of submission to Kyrgyzpatent an earlier application of the same applicant disclosing that invention, utility model, industrial design if the application on which the priority is sought has been filed not later than twelve months from the date of filing of an earlier application for invention and six months in case of earlier application for a utility model, an industrial design. An earlier application shall be considered withdrawn.
Priority may be established on the basis of several earlier filed applications, under condition that the established terms are complied for each of them.
Priority may not be established on the date of file of an application on which an earlier priority was sought.
Priority of the object of industrial property on selected application shall be established on the date of filing an initial application with Kyrgyzpatent disclosing this object of industrial property, if selected application is filed before the decision to refuse to grant a patent on the initial application is made and the opportunity to appeal is exhausted and in the case of granting a patent on that application, before the date of registration of the object of industrial property in the State Register.
If during the examination it is established that identical objects of industrial property have the same priority date, the patent shall be granted on the application for which an earlier mailing date to Kyrgyzpatent is proved, and if these dates coincide, on the application having an earlier registration number of Kyrgyzpatent.

Article 22. Correction of the Application Documents at the Initiative of the Applicant
During two months from the date of receipt of the application, an applicant shall have the right to introduce amendments and specifications to the documents without changing the essence of the object of an industrial property.
Such amendments and specifications may be submitted on the applications for the objects of industrial property and after expiration of the indicated term, under condition of payment of the fee, but no later than the decision to grant a patent is made.
Article 23. Examination of the Application for an Invention
Kyrgyzpatent shall conduct formal and preliminary examination of an application.
At the petition of the applicant, which can be filed with Kyrgyzpatent simultaneously with application filing or within 30 months since the date of filing, consideration of the application can be made with or without examination on the essence. If petition is not submitted within said period, the application is considered as withdrawn.
(Version of the Law of the Kyrgyz Republic of February 27, 2003 # 46) Article 23-1. Formal Examination of the Application for an Invention
During the formal examination of the application for an invention within two-month- period the constitution and accuracy of required documents provided by Article 18 of this Law are checked as well as accordance of the claimed proposal to the objects for which the legal protection is provided.
If after completion of formal examination it is determined that application is filed for proposal not related to the objects for which the legal protection is provided, the decision on refusal on patent grant is made.
If an application is filed with violations of requirements prescribed to registration and compilation, the applicant shall receive a request with proposal to submit corrected or absent materials within two-month-period since the date of receipt of the request.
If applicant shall not submit requested documents or petition for prolongation of effective terms, the application is considered as withdrawn.
If the application meets all the requirements of formal examination, a notification that the application is accepted for consideration shall be sent to the applicant.
(Version of the Law of the Kyrgyz Republic of February 27, 2003 # 46) Article 23-2. Preliminary Examination of the Application for an Invention
While conducting preliminary examination, Kyrgyzpatent within ten-month-period shall check compliance of the prescribed requirements to contents of the application documents, compliance of the claimed invention with the criteria of patentability of the
materials of an application provided by the applicant, non-withdrawn applications with an earlier priority, the fund of issued protected documents of the Kyrgyz Republic, as well
as published Eurasian applications and patents and shall establish the priority of the invention and check compliance of the application with requirements for the unity of the invention.
The applicant upon the payment of appropriate fee may submit a petition for conduct of rapid preliminary examination for the application for invention. In the event that before expiration of twelve-month-period since the date of filing of the application with Kyrgyzpatent or when priority is required since the date of priority, the decision on patent grant is made or patent is granted and similar application concerning vindication of
earlier priority is filed, the decision on patent grant or patent is canceled.
If the applicant, in accordance with Article 22 of this Law, provided additional materials, in the course of the preliminary examination it shall be checked, that they do not change the essence of the claimed invention.
Additional materials shall change the essence of the claimed invention if they contain features that are supposed to be included into the formula of an invention which have been absent from the initial materials of an application. Additional materials of the part, which change the essence of the claimed invention, shall be taken into account in the course of consideration of an application and may be registered by the applicant as an independent application.
On applications, which had been filed with violations of the requirements of unity, an applicant shall be offered to inform, within two-month-period, which of the proposals must be considered, and clarify documents of the application.
Other decisions, included in the materials of the initial application, may be formalized as separate applications.
In the event, if the applicant within two months from the date of receipt of the notification on the violation of the requirement of the unity of an invention does not inform which of the proposals should be considered and does not submit specified documents, the first mentioned in the formula proposal shall be considered.
During the preliminary examination Kyrgyzpatent may request from the applicant any additional materials, which are necessary for examination conduct. The additional materials by the request of examination should be submitted within two-month-period since the date of receipt of the request.
In the event, if the applicant fails to provide required materials or the petition for extension of the established term, within the indicated term, the application shall be deemed withdrawn.
On the application, which has passed preliminary examination with a positive result, a decision to grant preliminary patent shall be made which is granted under responsibility of the applicant.
According to the results of preliminary examination in the presence of petition to conduct examination on the essence or in the absence of said petition or petition on patent grant without examination of the application on the essence, the applicant shall receive
a notification.
If in the result of the preliminary examination it is established that the claimed proposal is not patentable, a decision on refusal to grant a patent shall be made.
The applicant may file an objection to this decision with the Appellate Council within two months after the receipt of refusal to grant a patent. The Appellate Council must consider the objection within two months as of the date of its receipt.
In the event the applicant does not agree with the decision of the Appellate Council he may appeal to court within six months as of the date of its receipt.
After expiration of 18 months since the date of application filing or if priority is required since the date of priority Kyrgyzpatent shall publish the information related to the application in Official Bulletin with the exception of cases when application is withdrawn or when decision on patent grant or refusal is made. Kyrgyzpatent shall determine the list and completeness of published information.
On the applicant’s petition provided that appropriate fee is paid Kyrgyzpatent may publish the information related to application till 18 months since the date of its filing, or if priority is required since the date of priority.
While petition on patent grant without examination on essence is filed after preliminary examination completion, the decision on patent grant is made within two-month-period since the date of receipt of said petition.
(Version of the Law of the Kyrgyz Republic of February 27, 2003 # 46) Article 24. Examination of Application for Invention on Essence\Substance
Kyrgyzpatent within 18 months since the date of petition submission shall conduct examination of the application on the essence. An applicant shall be notified about petitions submitted by the third parties.
During conduct of the examination on the essence compliance of the claimed invention to conditions of patentability specified in Article 5 of this Law.
During examination of an application on substance Kyrgyzpatent shall be entitled to request the applicant to submit materials without which examination procedure is not possible, including changed formula of the invention.
Additional documents on the request of examination shall be submitted without changing the essence of the invention during two months from the date of receipt of the request.
The order established by paragraphs 11 and 12 of this Article shall extent to additional documents in the part that changes the essence of an invention.
If in the result of scientific-technological examination of an application on essence Kyrgyzpatent finds that the claimed proposal, within the scope of legal protection required by an applicant, meets the requirements of patentability of the invention, the decision to grant a patent with the formula of an invention suggested and agreed with the applicant is made.
If the claimed proposal does not meet the requirements of patentability within the scope of legal protection required by an applicant, the decision on rejection to grant a patent shall be issued.
The applicant may file an objection against the decision on rejection to grant a patent
with the Appellate Council during three months from the date of its receipt. The objection must be considered by the Appellate Council during four months from the date of
its receipt.
Should the applicant not agree with the decision of the Appellate Council he may, within six months from the date of its receipt, appeal to court.
The applicant shall have the right to familiarize himself with all the materials indicated in the decision of examination or in the search report. Copies of the patent materials
requested by the applicant shall be sent by Kyrgyzpatent during one month from receipt of the request.
The terms provided in Article 23-1, 23-2 and this Article, except for the terms established in paragraph 15 of Article 23-2 and paragraphs 9 of this Article, elapsed by the applicant, may be reinstated by Kyrgyzpatent in the presence of proof of excusable reasons and payment of the fee.
The petition to reinstate the term may be filed by an applicant not later than twelve months from the date of expiration of the elapsed term.
Both applicant and third parties may submit a petition on informational search conduct on the application for invention to determine technical level in comparison with which valuation of patentability of the invention is made. Kyrgyzpatent determine the order of informational search and information provision.
(Version of the Law of the Kyrgyz Republic of February 27, 2003 # 46) Article 25. Examination of the Application for a Utility Model
Examination of the application for utility model shall consist of formal and preliminary examination.
During formal examination of an application for utility model the provisions of Article
23-1 of the present Law shall be applied appropriately.
During preliminary examination of an application for utility model the provisions of paragraphs 1-10 and 13-15 of Article 23-2 as well as paragraph 13 of Article 24 of the present Law shall be applied appropriately.
If an application for utility model has successfully passed the preliminary examination, the decision to grant a patent for utility model shall be made.

Before publication of the information on the application for an invention but no later than date of receipt of the decision on patent grant, an applicant has the right to reorganize the application for invention by filling an appropriate declaration to the application for the utility model.
In the case of indicated reorganizations of applications the priority of the original application is preserved.

Article 27. Examination of the Application for an Industrial Design
Kyrgyzpatent shall conduct formal and preliminary examination of the application for an industrial design.
According to applicant’s petition, which can be submitted simultaneously with application filing or within twelve months since the date of filing, the application consideration may be arranged with or without examination on the essence. If the petition shall not submitted within said terms, the application should be considered as withdrawn.
During formal examination of the application for an industrial design, provisions of
Article 23-1 of this Law shall be applied appropriately.
During preliminary examination of the application Kyrgyzpatent within four months shall check compliance of prescribed requirements to the contents of the application
documents, compliance of the claimed industrial design to the conditions of patentability according to materials of the application provided by the applicant, fund of issued protected documents of Kyrgyzpatent, non-withdrawn applications with earlier priority, and shall check compliance of the application to requirements of industrial design unity.
During preliminary examination of the application for an industrial design, provisions of paragraphs 3-15, 18 of Article 23-2 of this Law shall be applied appropriately.
According to applicant’s or third parties’ petition Kyrgyzpatent within twelve months since the date of petition submission shall conduct the examination of the application on the essence. An applicant shall be notified about petitions submitted by the third parties.
During examination of an application on the essence, provisions of paragraphs 2-13 of
Article 24 of this Law shall be applied appropriately.

Article 28. Registration of the Objects of Industrial Property, Publication of the
Information on Patent Granting and Granting of the Patents
After the decision to grant a patent is made, provided that the fee for registration and granting of a patent is paid, Kyrgyzpatent shall enter in the State Register of Inventions of the Kyrgyz Republic, the State Register of Utility models of the Kyrgyz Republic or the State Register of Industrial Designs of the Kyrgyz Republic the invention, utility model
or an industrial design respectively.
In the event that there are several persons in whose names the patent is required, only one patent shall be granted them.
The document certifying payment of the fee for registration and grant of a patent shall be provided within two months as of the date the applicant receives the decision to grant a
patent of within three months after the date of expiration of two-month-period under the condition of payment of additional fee.
In the event the document certifying payment of the fee for registration and grant of the patent is not provided in the established order, registration of the object of industrial property, publication and grant of the patent shall not be carried out and the application shall be considered withdrawn.
Kyrgyzpatent shall determine the list and completeness of the information published in the Official Bulletin.
After publication of the information related to patent grant, any person has a right to become acquainted with materials of the application.
Kyrgyzpatent shall determine the patent form and composition of the information provided.
In case of finding the obvious and technical errors, on the request of patent owner and author Kyrgyzpatent shall make appropriate corrections into granted patent without payment of the fee.

Section VI.
TERMINATION OF THE VALIDITY OF PATENTS Article 31. Disputes Against Patents
Within the whole period of its validity a patent may be considered invalid in full or in part, due to the objection against its granting in the following cases:
1) the protected decision does not meet requirements of patentability as provided by this Law,
2) the formula of the invention, utility model or the list of the essential features of the industrial design contain features missing in the initial documents of the application;
3) author (authors) or their owners have been incorrectly indicated in the patent.
A person who filed an objection must give his/her reasons for it and submit a document certifying payment of a fee.
An objection against the grant of a patent on the grounds provided in points 1) and 2) of this Article must be examined by the Appellate Council within the term of six months after the date of its receipt; the patent owner must get acquainted with the objection.
A person who filed an objection and the patent owner may participate in its consideration. In this case, the Appellate Council shall not go beyond the reasons, contained in the objection against the grant of a patent.
Should the Applicant not agree with the decision of the Appellate Council on the objection against the grant of a patent, any of the parties may, within the period of six months from the date of making a decision, file an appeal with court.
Article 32. Invalidation and Termination of Patents
The patent shall fully or partly invalidated on the grounds of the Appellate Council decision or court decision entered into effect.
The period of validity of patents shall be terminated, if:
1) the period of validation of a patent provided in accordance with this Law is expired;
2) the fee, in order to support a patent, is not paid in the established term;
3) on the basis of a declaration filed by the patent owner with Kyrgyzpatent if the refusal does not violate the interests of the third parties - since the date of publication of the information related to ahead of schedule termination of the patent validity due to declaration of the patent owner.
Kyrgyzpatent shall publish information on the ahead of schedule termination of a patent in the Official Bulletin.

RIGHTS AND PRIVILEGES OF THE AUTHORS AND PATENT OWNERS Article 33. Rights and privileges of Authors
An author shall have the right to assign his name or a specific title to the object of industrial property at any stage of examination of the application.
The authors of most important or widely used inventions may be granted an honorary title
“Honored Inventor of the Kyrgyz Republic”.
Article 34. State Incentives for Creation and Exploitation the Objects of
Industrial Property
In order to stimulate scientific-technological development, strengthen intellectual potentials of the Kyrgyz Republic, promote the development of technical and artistic creation as well as create and exploit the objects of industrial property, The State Intellectual Property Fund of the Kyrgyz Republic (hereinafter referred to as the State Fund) is being established under Kyrgyzpatent.
The State Fund on behalf of the State has the right to obtain the rights of the patent owner for the patented objects of industrial property in order to implement them in future and
use in the interests of the State.
The State Fund shall provide its activities in accordance with the regulation approved by Kyrgyzpatent.
The sources of financing of the State Fund shall be means of the republican budget, deductions from the patent fees, collections, means received due to the activities of the Fund and other receipts.
Pursuant to legislation of the Kyrgyz Republic, the State shall establish preferential taxation as well as provide other rights and privileges to the authors and economic entities exploiting objects of industrial property.
Section VIII.
PROTECTION OF THE RIGHTS OF PATENT OWNERS AND AUTHORS Article 35. Consideration of Disputes in Court
Disputes related to the application of the present Law shall be examined in accordance with the order established by the legislation of the Kyrgyz Republic.
The courts in accordance with their jurisdiction, shall consider the following disputes:
1) authorship to the objects of industrial property;
2) granting of a protected document;
3) establishing the patent owner;
4) issuance of a compulsory license;
5) infringement of the exclusive right to use the protected object of industrial property and other economic rights of the patent owner;
6) conclusion and execution of licensing agreements for the use of a protected object of industrial property;
7) right to the prior use;
8) payment of remuneration to the author by the employer pursuant to the agreement stipulated in paragraph 1, Article 10 of this Law;
9) other disputes related to the protection of rights.
Article 36. Liability for Infringement of the Authors’ Rights
Appropriation of authorship, forced co-authorship, illegal disclosure of the information about the object of industrial property shall entail liability stipulated in the legislation of the Kyrgyz Republic.
Section IX.
FINAL PROVISIONS Article 37. Patent Fee
The fees shall be collected for file of an application in order to grant patents for the objects of industrial property, examination and granting of patents for the objects of industrial property, keeping them in effect, extension of validity term and other legally valid acts. The list of actions for which the fee shall be collected, its amount and terms of payment and also grounds for exemption from payment, reduction of the amount or reimbursement of the fee shall be established by the Government of the Kyrgyz Republic.
The fee shall be paid to Kyrgyzpatent by the applicant, patent owner or any natural or legal entity, under agreement with them.
All means entered the account of Kyrgyzpatent in the form of fees, including currency and payment for services and materials shall be used by Kyrgyzpatent for technical provision, creation and exploitation of automated system, complexion of patent information’s fund as well as training and stimulation of the personnel.
Article 38. Patenting of the Object of Industrial Property in Foreign Countries
Submission of applications to foreign countries for the objects of industrial property created in the Kyrgyz Republic shall be exercised after expiration of three months as of the date of file of an appropriate application with Kyrgyzpatent.
In the necessary cases, Kyrgyzpatent may allow patenting of the objects of industrial property in foreign countries earlier than the indicated term, after the examination of an application for the presence of information which is of the state secret has been conducted in the order established by Kyrgyzpatent.
In the event of submission of an application to foreign countries or international organizations for the object of industrial property created in the Kyrgyz Republic, with violation of the order established by the present Article, the protected document for this object of industrial property shall not be provided in the Kyrgyz Republic
Article 39. Rights of Foreign Natural Persons and Legal Entitles
Foreign natural persons and legal entities shall have the rights provided in the present Law and other normative legal acts related to legal protection of the objects of industrial property on an equal basis with natural persons and legal entities of the Kyrgyz Republic by virtue of international agreements of the Kyrgyz Republic or on the principle
of reciprocity.
Stateless persons residing in the territory of the Kyrgyz Republic shall exercise rights provided by this Law and other acts related to legal protection of the objects of industrial property equally with natural persons and legal entities of the Kyrgyz Republic, unless otherwise follows from this Law and other acts of the legislation of the Kyrgyz Republic.
Article 40. International Agreements
If an international agreement of the Kyrgyz Republic establishes rules other than those contained in this Law, the rules of the international agreement shall be applied.
Article 41. Transitional Provisions
In accordance with alterations and additions made into this Law related to transition to unified protected document (patent) the following was established:
1) regarding applications for grant of preliminary patent of the Kyrgyz Republic for invention or industrial design, which were filed before entering into effect of the Law providing the transition to unified protected document (patent), the applicant has a right to submit a petition for granting of the patent of the Kyrgyz republic for invention or industrial design with the examination on the essence or for granting of the patent under applicant’s responsibility, provided that appropriate fees are paid. If the applicant does not take appropriate measures, the application shall be considered withdrawn;
2) regarding effective preliminary patents of the Kyrgyz Republic for invention or industrial design, which five-year-period since the date of application filing is not expired before entering into effect of the Law providing transition to unified protected document (patent), the owner of preliminary patent has a right to submit a petition on granting of
the patent of the Kyrgyz Republic for invention or industrial design with examination on
the essence. In case of absence of such petition, preliminary patent of the Kyrgyz Republic shall be reregistered as a patent of the Kyrgyz Republic under the applicant’s responsibility for residuary terms;
3) effective preliminary patents of the Kyrgyz Republic for invention or industrial design, which five-year-period since the date of application filing is expired before entering into effect of the Law providing transition to unified protected document (patent), shall be reregistered as patents of the Kyrgyz Republic under the applicant’s responsibility for residuary terms;
4) regarding applications for granting of the certificate of the Kyrgyz Republic for utility model filed before entering into effect of the Law providing transition to unified protected document (patent), the decision on granting of the patent of the Kyrgyz Republic for utility model is made, provided that all appropri
ate fees are paid;
5) effective certificates of the Kyrgyz Republic for utility models shall be reregistered as the patent of the Kyrgyz Republic for utility model.
Kyrgyzpatent shall determine the terms and order of above-mentioned procedures. (Version of the Law of the Kyrgyz Republic of February 27, 2003 # 46)
Article 42. Entering into effect of the Present Law
The Patent Law of the Kyrgyz Republic enters into effect since the moment of its publication. (“Erkin-Too” of February 4, 1998 # 10-11).

Dispositions générales

Rapports régis par la présente loi

1er. La présente loi régit les rapports patrimoniaux et rapports personnels non patrimoniaux s’y rattachant qui naissent sur le territoire de la République kirghize en liaison avec la réalisation, la protection juridique et l’exploitation ou l’utilisation des inventions, des modèles d’utilité et des dessins et modèles industriels (ci-après dénommés “objets de propriété industrielle”).

L’Office national de la propriété intellectuelle de la République kirghize

2. Conformément à la présente loi, l’Office national de la propriété intellectuelle de la République kirghize (ci-après dénommé “Kirghizpatent”) reçoit les demandes de protection des objets de propriété industrielle, procède à leur examen et à leur enregistrement officiel, délivre des titres de protection, assure la publication officielle de données relatives aux objets de propriété industrielle, édicte les règles d’interprétation des dispositions de la présente loi, et s’acquitte d’autres fonctions conformément à l’ordonnance le concernant adoptée par le Gouvernement de la République kirghize.

Kirghizpatent est responsable de la collection nationale de brevets dont il assure la conservation et qu’il enrichit par le biais d’acquisitions et d’échanges avec des organisations internationales et des offices de brevets étrangers.
Afin de renforcer ses activités dans le domaine de la protection juridique des objets de propriété industrielle, Kirghizpatent est doté d’une Chambre de recours, qui constitue l’organe de première instance obligatoire pour les litiges relatifs aux objets de propriété industrielle, dont elle connaît selon ses compétences. Les procédures d’examen des oppositions par la Chambre de recours sont établies par Kirghizpatent.
Les sources de financement des activités de Kirghizpatent sont constituées par les crédits du budget, les taxes de brevet, la rémunération perçue par Kirghizpatent en échange des services et des documents qu’il fournit, ainsi que par d’autres crédits extrabudgétaires.

Protection juridique des objets de propriété industrielle

3. Le droit relatif à un objet de propriété industrielle est protégé par la présente loi et attesté par un brevet provisoire d’invention ou de dessin ou modèle industriel, un brevet d’invention ou de dessin ou modèle industriel ou un certificat de modèle d’utilité (ci-après dénommés “titres de protection”), attestant la priorité, la paternité de l’invention, du dessin ou

modèle industriel ou du modèle d’utilité et le droit exclusif du titulaire du titre de protection
(ci-après dénommé “titulaire”) sur l’objet de propriété industrielle correspondant.
Le brevet provisoire et le certificat sont délivrés après un examen préliminaire de la demande.
Le brevet est délivré après un examen de la demande quant au fond.
La portée de la protection juridique conférée par le brevet provisoire d’invention, le brevet d’invention ou le certificat de modèle d’utilité est déterminée par les revendications. La portée de la protection juridique conférée par le brevet provisoire de dessin ou modèle industriel et le brevet de dessin ou modèle industriel est déterminée par l’ensemble des caractéristiques essentielles de celui-ci qui sont représentées sur les reproductions de l’article auquel il est incorporé (de la maquette) et énumérées dans la liste des caractéristiques essentielles.
La protection juridique des objets de propriété industrielle considérés comme secrets par l’État est régie par la législation de la République kirghize.

Durée de validité du brevet provisoire, du brevet et du certificat

4. Le brevet provisoire d’invention produit ses effets pendant sept ans à compter de la date de dépôt de la demande auprès de Kirghizpatent.

Le brevet d’invention produit ses effets pendant 20 ans à compter de la date de dépôt de la demande auprès de Kirghizpatent.
Le certificat de modèle d’utilité produit ses effets pendant cinq ans à compter de la date de dépôt de la demande auprès de Kirghizpatent. Sur requête du titulaire du certificat, la durée de validité de celui-ci peut être prolongée par Kirghizpatent de trois ans au maximum.
Le brevet provisoire de dessin ou modèle industriel produit ses effets pendant sept ans à compter de la date de dépôt de la demande auprès de Kirghizpatent.
Le brevet de dessin ou modèle industriel produit ses effets pendant 10 ans à compter de la date de dépôt de la demande auprès de Kirghizpatent. Sur requête du titulaire, sa durée de validité peut être prolongée par Kirghizpatent de cinq ans au maximum.

Titre II

Conditions de la brevetabilité des objets de propriété industrielle

Conditions de la brevetabilité de l’invention

5. Un objet pour lequel un brevet d’invention est demandé bénéficie d’une protection juridique s’il est nouveau, s’il implique une activité inventive et s’il est susceptible d’application industrielle.

Une invention est nouvelle si elle ne fait pas partie de l’état de la technique.
Une invention implique une activité inventive si elle ne découle pas d’une manière évidente de l’état de la technique.
L’état de la technique comprend toutes les informations qui sont devenues généralement accessibles dans le monde avant la date de priorité de l’invention.
Aux fins de la détermination de la nouveauté de l’invention, sont également inclus dans l’état de la technique les demandes de tiers déposées auprès de Kirghizpatent et non retirées dont la date de priorité est antérieure, ainsi que les inventions et les modèles d’utilité brevetés en République kirghize.
Une invention est considérée comme susceptible d’application industrielle si elle peut être utilisée dans l’industrie, l’agriculture, la santé publique et d’autres branches de l’économie.
Ne porte pas préjudice à la brevetabilité de l’invention la divulgation d’informations relatives à celle-ci qui a pour effet de rendre généralement accessibles des renseignements sur l’objet de l’invention et qui est le fait du déposant, de l’inventeur ou d’un tiers ayant obtenu ces informations directement ou indirectement de l’inventeur ou du déposant, pour autant que cette divulgation n’ait pas eu lieu plus de 12 mois avant la date de dépôt de la demande ou, lorsqu’une priorité est revendiquée, avant la date de priorité de la demande. La charge de la preuve incombe en l’espèce au déposant.
Peuvent faire l’objet d’une invention un dispositif, un procédé, une substance, une souche de micro-organisme, des cultures de cellules végétales ou animales ainsi que l’utilisation à une fin nouvelle d’un dispositif, d’un procédé, d’une substance ou d’une souche connus auparavant, ou toute autre réalisation technique ou technologique nouvelle.
Ne sont pas reconnus comme inventions
i) les théories scientifiques et les méthodes mathématiques; ii) les méthodes d’organisation et de gestion de l’économie; iii) les signes conventionnels, les horaires et les règles;
iv) les méthodes d’exécution d’opérations mentales;
v) les algorithmes et programmes d’ordinateur en tant que tels;
vi) les projets et schémas de conception d’ouvrages et de bâtiments et d’aménagement du territoire;
vii) les solutions qui ne touchent que l’aspect extérieur d’articles manufacturés et qui répondent à des considérations esthétiques;
viii) les schémas de configuration de circuits intégrés;
ix) les variétés végétales et les races animales;
x) les solutions qui sont contraires à l’intérêt général, aux principes humanitaires ou à la morale, ou qui portent atteinte à l’environnement.
Les objets indiqués aux points v), viii) et ix) du neuvième alinéa du présent article sont protégés par des lois distinctes.
Ne porte pas préjudice à la brevetabilité de l’invention la présence dans celle-ci d’algorithmes et de programmes d’ordinateur s’ils font partie intégrante de l’invention.

Conditions de la brevetabilité du modèle d’utilité

6. Est considéré comme modèle d’utilité tout dispositif.

Un objet pour lequel un certificat de modèle d’utilité est demandé bénéficie d’une protection juridique s’il est nouveau et s’il est susceptible d’application industrielle.
Un modèle d’utilité est nouveau si l’ensemble de ses caractéristiques essentielles ne fait pas partie de l’état de la technique.
L’état de la technique comprend les informations qui ont été publiées dans le monde sur des moyens ayant la même fin que le modèle d’utilité faisant l’objet de la demande et qui sont devenues généralement accessibles avant la date de priorité de la demande, les informations sur l’application de tels moyens dans la République kirghize, les demandes de brevet d’invention et de modèle d’utilité déposées antérieurement par des tiers en République kirghize et non retirées, ainsi que les inventions et les modèles d’utilité brevetés en
République kirghize.
Ne porte pas préjudice à la nouveauté du modèle d’utilité la divulgation d’informations relatives à celui-ci qui a pour effet de rendre généralement accessibles des renseignements sur l’objet du modèle d’utilité et qui est le fait du déposant, du créateur ou d’un tiers ayant obtenu ces informations directement ou indirectement du déposant ou du créateur, pour autant que cette divulgation n’ait pas eu lieu plus de six mois avant la date de dépôt de la demande ou, lorsqu’une priorité est revendiquée, avant la date de priorité. La charge de la preuve incombe en l’espèce au déposant.
Un modèle d’utilité est susceptible d’application industrielle s’il peut être utilisé dans la pratique.
Ne sont pas protégés en tant que modèles d’utilité les objets indiqués au neuvième alinéa de l’article 5 de la présente loi.

Conditions de la brevetabilité du dessin ou modèle industriel

7. Est considérée comme dessin ou modèle industriel toute solution à la fois artistique et technique qui est adoptée pour un article et qui en détermine l’aspect extérieur.

Un objet pour lequel un brevet de dessin ou modèle industriel est demandé bénéficie d’une protection juridique s’il est nouveau, s’il est original et s’il est susceptible d’application industrielle.
Un dessin ou modèle industriel est considéré comme nouveau si l’ensemble de ses caractéristiques essentielles, représentées sur les reproductions de l’article auquel il est incorporé (de la maquette) et énumérées dans la liste des caractéristiques essentielles, n’était pas connu par des informations devenues généralement accessibles dans le monde avant sa date de priorité.
Aux fins de la détermination de la nouveauté du dessin ou modèle industriel, sont pris en considération les demandes de brevet de dessin ou modèle industriel déposées antérieurement par des tiers en République kirghize et non retirées, ainsi que les dessins et modèles industriels brevetés en République kirghize.
Un dessin ou modèle industriel est considéré comme original si ses caractéristiques essentielles déterminent le caractère créatif des particularités de l’article auquel il est incorporé.
Il faut entendre par caractéristiques essentielles d’un dessin ou modèle industriel les caractéristiques qui déterminent les particularités esthétiques et (ou) ergonomiques de l’aspect extérieur d’un article, sa forme et sa configuration, l’ornementation ou l’association de couleurs.
Un dessin ou modèle industriel est considéré comme susceptible d’application industrielle s’il peut être reproduit en de nombreux exemplaires.
Ne porte pas préjudice à la brevetabilité du dessin ou modèle industriel la divulgation d’informations relatives à celui-ci qui a pour effet de rendre généralement accessibles des renseignements sur l’objet du dessin ou modèle industriel et qui est le fait du déposant, du créateur ou d’un tiers ayant obtenu ces informations du déposant ou du créateur, pour autant que cette divulgation n’ait pas eu lieu plus de six mois avant la date de dépôt de la demande ou, lorsqu’une priorité est revendiquée, avant la date de priorité. La charge de la preuve incombe en l’espèce au déposant.
Ne sont pas considérés comme dessins ou modèles industriels
i) les solutions qui découlent exclusivement de la fonction technique de l’article manufacturé;
ii) les ouvrages architecturaux (à l’exception des formes architecturales de petites dimensions) et les constructions industrielles, les ouvrages hydrauliques et autres constructions stationnaires;
iii) les produits imprimés en tant que tels;
iv) les objets de forme instable constitués par des substances liquides, gazeuses, pulvérulentes ou analogues;
v) les articles incompatibles avec l’intérêt général, les principes humanitaires ou la morale.

Titre III Sujets de droit

Le créateur de l’objet de propriété industrielle

8. Est reconnue comme créateur de l’objet de propriété industrielle la personne physique dont le travail créateur est à l’origine de l’objet.

Si l’objet de propriété industrielle est le fruit du travail de plusieurs personnes physiques, celles-ci sont toutes reconnues comme inventeurs (ou créateurs). Les modalités d’exercice des droits appartenant aux inventeurs ou créateurs sont déterminées par accord entre ceux-ci.
Ne sont pas reconnues comme inventeurs (ou créateurs) les personnes physiques qui n’ont pas apporté de contribution créatrice personnelle à la réalisation de l’objet de propriété industrielle et qui ont seulement fourni à l’inventeur ou créateur (ou aux inventeurs ou créateurs) une aide technique, organisationnelle ou matérielle, ou ont seulement apporté leur concours à l’obtention des droits ou à l’exploitation de l’objet de propriété industrielle.
Le droit à la paternité de l’invention (ou du modèle d’utilité ou du dessin ou modèle industriel) constitue un droit personnel inaliénable et bénéficie d’une protection illimitée dans le temps.

Le titulaire de la protection

9. Le droit d’obtenir un titre de protection appartient

i) à l’inventeur ou créateur (ou aux inventeurs ou créateurs) de l’objet de propriété industrielle;
ii) à l’employeur, dans les cas prévus au deuxième alinéa du présent article;
iii) à leur ayant droit, y compris à la personne ayant obtenu un droit correspondant par voie de cession.
Lorsqu’un salarié crée un objet de propriété industrielle dans le cadre de l’accomplissement de ses fonctions ou de tâches concrètes qui lui ont été confiées par son employeur, le droit à un titre de protection pour cet objet de propriété industrielle appartient à l’employeur, sauf disposition contractuelle contraire.
Si, dans un délai de quatre mois à compter de la date à laquelle l’inventeur (ou créateur) a informé l’employeur de l’objet de propriété industrielle créé, l’employeur n’a ni déposé une demande auprès de Kirghizpatent, ni cédé son droit à un titre de protection à un tiers, ni
notifié à l’inventeur (ou créateur) qu’il tenait l’objet de propriété industrielle secret, l’inventeur (ou créateur) a le droit de se faire délivrer un titre de protection. Dans ce cas, l’employeur a le droit d’exploiter l’objet de propriété industrielle dans sa propre production moyennant le paiement au titulaire d’une indemnité déterminée sur une base contractuelle.
Lorsqu’un salarié crée un objet de propriété industrielle grâce à l’expérience et aux moyens matériels, techniques et autres appartenant à l’employeur, mais pas dans le cadre de l’accomplissement de ses fonctions ou de tâches concrètes qui lui ont été confiées par celui-ci, le droit au titre de protection pour cet objet de propriété industrielle appartient au salarié, sauf disposition contractuelle contraire. Dans ce cas, l’employeur a le droit d’exploiter l’objet de propriété industrielle dans sa propre production moyennant le paiement au titulaire d’une indemnité déterminée sur une base contractuelle.

Droit de l’inventeur ou du créateur à une rémunération

10. L’inventeur ou créateur auquel n’appartient pas le droit de se faire délivrer un titre de protection peut obtenir de son employeur une rémunération dont le montant et les modalités de paiement sont déterminés par accord entre eux.

Si les parties ne sont pas parvenues à un accord sur le montant et les modalités de paiement de la rémunération ou de l’indemnité, le litige relève de la compétence des tribunaux.
En cas de non-paiement dans les délais de la rémunération ou de l’indemnité contractuelles, l’employeur fautif est passible des sanctions prévues par la législation de la République kirghize.
Les autres rapports qui naissent en liaison avec la réalisation par un salarié d’un objet de propriété industrielle sont régis par la législation de la République kirghize sur les inventions, modèles d’utilité et dessins et modèles industriels de service.

Titre IV

Droit exclusif sur les objets de propriété industrielle

Droits du titulaire

11. Le titulaire a un droit exclusif sur l’invention ou le dessin ou modèle industriel protégé par le brevet ou brevet provisoire, ou le modèle d’utilité protégé par le certificat, et il a le droit d’interdire à des tiers l’utilisation de l’objet en question, sauf si, selon la présente loi, cette utilisation ne porte pas atteinte à son droit exclusif.

Lorsque plusieurs personnes sont titulaires d’un même titre de protection, leurs rapports concernant l’exploitation de l’objet de propriété industrielle faisant l’objet de ce titre de protection sont déterminés d’un commun accord. En l’absence d’accord, chacun des titulaires
peut exploiter l’objet protégé à sa guise, mais il n’a pas le droit de concéder une licence exclusive sur cet objet ou de céder le titre de protection à un tiers sans le consentement des autres titulaires.
Si les titulaires ne sont pas parvenus à un accord sur la concession d’une licence exclusive ou la cession du titre de protection, le partage des droits sur l’objet de propriété industrielle peut faire l’objet d’une décision judiciaire.
Constituent exploitation de l’objet de propriété industrielle la fabrication, l’application, l’importation, l’offre à la vente, la vente et toute autre forme de mise dans le commerce, ou la conservation à cette fin, du produit qui incorpore l’invention ou le dessin ou modèle industriel protégé par le brevet ou brevet provisoire, ou le modèle d’utilité protégé par le certificat, ainsi que l’utilisation du procédé protégé par le brevet ou brevet provisoire d’invention.
Le produit est réputé contenir l’invention protégée par le brevet ou brevet provisoire, ou le modèle d’utilité protégé par le certificat, s’il incorpore chacune des caractéristiques de l’invention ou du modèle d’utilité comprises dans une revendication indépendante, ou une caractéristique équivalente connue en tant que telle dans un domaine technique donné à la
date à laquelle commence l’exploitation. Un procédé protégé par un brevet ou brevet provisoire d’invention est réputé avoir été appliqué s’il met en œuvre chacune des caractéristiques de l’invention comprises dans une revendication indépendante, ou une caractéristique équivalente connue en tant que telle dans un domaine technique donné à la date à laquelle commence l’exploitation.
Un produit est réputé contenir le dessin ou modèle industriel protégé par le brevet ou brevet provisoire s’il incorpore toutes ses caractéristiques essentielles, représentées sur les reproductions de l’article (de la maquette) et énumérées dans la liste des caractéristiques essentielles.
Constitue aussi utilisation du procédé protégé par le brevet ou brevet provisoire la mise dans le commerce ou la conservation à cette fin d’un dispositif dont le fonctionnement ou l’exploitation, conformément à sa destination, met automatiquement en œuvre le procédé en question.
Constitue également utilisation du procédé d’obtention d’un produit protégé par le brevet ou brevet provisoire la mise dans le commerce ou la conservation à cette fin du produit fabriqué directement au moyen de ce procédé. En l’absence de preuve du contraire, le produit nouveau est réputé obtenu par le procédé breveté.
Ne sont pas réputées constituer exploitation de l’objet de propriété industrielle la fabrication, l’expérimentation et la mise à l’épreuve du prototype d’un produit.
Le titulaire peut céder son titre de protection à toute personne physique ou morale. Le contrat de cession du titre de protection doit être enregistré par Kirghizpatent et publié dans le bulletin officiel de Kirghizpatent. À défaut d’enregistrement, il est réputé nul.
Le titre de protection et le droit à ce titre sont transmissibles par voie successorale.

Obligations du titulaire et licences obligatoires

12. Si l’objet de propriété industrielle n’est pas exploité par le titulaire ou les personnes auxquelles ont été cédés les droits sur cet objet dans les trois ans suivant la date de délivrance du titre de protection, ou l’est insuffisamment, ce qui a pour effet de rendre insuffisante l’offre de produits ou services correspondants sur le marché des produits ou services, toute personne qui souhaite exploiter l’objet de propriété industrielle protégé et est en mesure de le faire peut, en cas de refus du titulaire de conclure un contrat de licence aux conditions qui correspondent

à la pratique établie, intenter une action en justice en vue d’obtenir une licence obligatoire pour l’exploitation de l’objet en question.
Si le titulaire ne peut pas prouver que des motifs légitimes justifient le défaut ou l’insuffisance d’exploitation de l’objet de propriété industrielle, le tribunal accorde la licence en question en fixant les limites de l’exploitation de l’objet, le montant des redevances ainsi que les délais et modalités de leur paiement. Le montant des redevances ne doit pas être inférieur à la valeur de la licence, celle-ci étant déterminée conformément à la pratique établie.
Si le titulaire d’un brevet ne peut pas exploiter son invention sans porter atteinte aux droits du titulaire d’un autre brevet ou brevet provisoire d’invention ou d’un certificat de modèle d’utilité qui a refusé de conclure un contrat de licence à des conditions correspondant à la pratique établie, il a le droit d’intenter une action en justice en vue d’obtenir une licence obligatoire lui permettant d’exploiter l’invention ou le modèle d’utilité dont le titre de protection appartient à l’autre personne, pour autant que son invention représente par rapport à l’autre invention ou modèle d’utilité une réalisation technique d’une importance économique notable.
Lorsqu’il ordonne la concession de la licence indiquée, le tribunal doit fixer les limites de l’exploitation de l’invention ou du modèle d’utilité dont le titre de protection appartient au tiers de façon à permettre l’exploitation de l’invention dont le demandeur de la licence obligatoire est titulaire, ainsi que le montant des redevances et les délais et modalités de leur paiement. Le montant des redevances ne doit pas être inférieur à la valeur de la licence, celle­ ci étant déterminée conformément à la pratique établie.
Le Gouvernement de la République kirghize peut, dans des circonstances exceptionnelles (cataclysmes naturels, catastrophes, accidents graves), ou à des fins liées à la sécurité nationale, ordonner la concession d’une licence obligatoire moyennant le paiement au titulaire d’une indemnité appropriée; la portée et la durée de l’exploitation de l’objet de propriété industrielle breveté sont limitées par les fins pour lesquelles elle a été autorisée. Les litiges liés à une telle exploitation relèvent de la compétence des tribunaux.
Une licence obligatoire est toujours une licence non exclusive qui ne peut pas être cédée à un tiers.

Actes ne constituant pas une atteinte au droit exclusif du titulaire

13. Ne sont pas considérées comme constituant une atteinte au droit exclusif du titulaire i) l’utilisation de moyens incorporant des objets de propriété industrielle protégés par

des brevets provisoires, des brevets ou des certificats dans la construction ou le fonctionnement des moyens de transport (maritime, fluvial, aérien, terrestre et spatial)
d’autres pays, lorsque les moyens incorporant les objets protégés pénètrent temporairement ou accidentellement sur le territoire de la République kirghize et y sont utilisés pour les besoins
du moyen de transport. Un tel acte n’est pas considéré comme portant atteinte au droit exclusif du titulaire si les moyens de transport appartiennent à des personnes physiques ou morales de pays qui accordent les mêmes droits aux propriétaires de moyens de transport de la République kirghize;
ii) l’utilisation d’un moyen incorporant un objet de propriété industrielle à des fins de recherche ou d’expérimentation scientifique;
iii) l’utilisation de tels moyens dans des circonstances exceptionnelles (cataclysmes naturels, catastrophes, accidents graves), moyennant le paiement au titulaire d’une indemnité appropriée;
iv) l’utilisation de moyens incorporant des objets de propriété industrielle protégés par des brevets provisoires, des brevets ou des certificats si ces moyens ont été mis légalement dans le commerce en vertu de droits concédés par le titulaire. Sauf convention contraire, la personne qui acquiert, avec l’autorisation du titulaire, un moyen incorporant l’objet de propriété industrielle breveté ou fabriqué à l’aide d’un procédé breveté a le droit d’utiliser ou de disposer de ce moyen sans avoir à demander d’autorisation supplémentaire.

Droit de l’utilisateur antérieur

14. Toute personne physique ou morale qui, avant la date de priorité de l’invention, du modèle d’utilité ou du dessin ou modèle industriel, a conçu et exploité sur le territoire de la République kirghize, indépendamment de l’inventeur ou du créateur, une solution identique, ou qui a accompli les préparatifs nécessaires à cette exploitation, conserve le droit de continuer à exploiter cette solution à titre gratuit, à condition de ne pas en étendre la portée.

Le droit de l’utilisateur antérieur ne peut être transmis à une autre personne physique ou morale qu’avec l’unité de production dans laquelle a eu lieu l’exploitation de la solution identique ou ont été effectués les préparatifs nécessaires à celle-ci.

Concession du droit d’exploiter l’objet de propriété industrielle

15. Toute personne qui n’est pas le titulaire de la protection n’a le droit d’exploiter l’objet de propriété industrielle protégé qu’avec l’autorisation du titulaire, sur la base d’un contrat de licence.

Par le contrat de licence, le titulaire (donneur de licence) accorde le droit d’exploiter l’objet protégé, dans les limites prévues par le contrat, à un tiers (preneur de licence) et ce dernier s’engage à effectuer au profit du donneur de licence les paiements, et à accomplir les autres actes, prévus par le contrat.
Un contrat de licence exclusive confère au preneur de licence le droit exclusif d’exploiter l’objet de propriété industrielle dans les limites stipulées dans le contrat, au-delà desquelles le donneur de licence conserve son droit d’exploitation.
Une licence non exclusive permet au donneur de licence, qui concède au preneur de licence le droit d’exploiter l’objet de propriété industrielle, de conserver tous les droits qui découlent du brevet, y compris celui de concéder des licences à des tiers.
La licence peut prévoir, sur la base d’un commun accord entre le donneur de licence et le preneur de licence, des dispositions différentes de celles qui sont indiquées dans le présent article.
Le contrat de licence doit être enregistré auprès de Kirghizpatent et, à défaut, il est réputé nul. Le contrat de licence entre en vigueur à la date de son enregistrement auprès de Kirghizpatent et est publié dans le bulletin officiel de Kirghizpatent.
Le titulaire d’un brevet peut remettre à Kirghizpatent une déclaration par laquelle il s’engage à accorder à toute personne intéressée le droit d’exploiter l’objet de propriété industrielle (licence ouverte) aux conditions stipulées dans un contrat. Dans ce cas, la taxe de maintien en vigueur du brevet est réduite de 50 % à compter de l’année qui suit l’année de publication de données sur cette déclaration par Kirghizpatent.
La déclaration par laquelle le titulaire accorde le droit à une licence ouverte ne peut pas être retirée.
Les litiges liés au refus de conclure un contrat ainsi qu’aux clauses du contrat relèvent de la compétence des tribunaux.

Atteinte au titre de protection

16. Toute exploitation non conforme aux dispositions de la présente loi d’une invention ou d’un dessin ou modèle industriel protégés par un brevet ou brevet provisoire, ou d’un modèle d’utilité protégé par un certificat, est réputée constituer une atteinte au titre de protection.

Le titulaire est en droit d’exiger
— la cessation de l’atteinte au titre de protection;
— un dédommagement, par le responsable de l’atteinte, du préjudice subi, y compris du manque à gagner, et des dommages-intérêts pour préjudice moral;
— en lieu et place du dédommagement du préjudice subi, le recouvrement des gains perçus par l’auteur de l’atteinte;
— en lieu et place du dédommagement du préjudice subi ou du recouvrement des gains, le versement, par l’auteur de l’atteinte, d’une indemnité dont le montant, compris entre 10 et 50 000 fois celui du salaire minimum fixé par la législation de la République kirghize, sera fixé à la discrétion du tribunal;
— la confiscation à son profit des produits mis dans le commerce ou conservés à cette fin et réputés porter atteinte au titre de protection, ainsi que des moyens affectés destinés spécialement à cette atteinte;
— la publication de la décision judiciaire afin de rétablir sa réputation commerciale. Sauf disposition contraire du contrat de licence, le titulaire d’une licence exclusive ou,
si le contrat de licence le prévoit, le titulaire d’une licence non exclusive peuvent aussi
poursuivre l’auteur d’une atteinte au titre de protection.

Titre V

Obtention des titres de protection

Dépôt de la demande de titre de protection

17. La demande de titre de protection doit être déposée auprès de Kirghizpatent par une personne habilitée, conformément aux dispositions de l’article 9 de la présente loi, à obtenir

ce titre de protection (ci-après dénommée “déposant”).
La requête en délivrance d’un titre de protection doit être rédigée en langue kirghize ou en langue russe. Les revendications de l’invention ou du modèle d’utilité, la liste des caractéristiques essentielles du dessin ou modèle industriel, la dénomination de l’objet de propriété industrielle ainsi que la raison sociale (le nom) du déposant et du titulaire du brevet doivent être communiquées en kirghize et en russe. Si d’autres éléments de la demande, ou des éléments présentés au cours de l’examen de la demande, sont rédigés dans une autre langue, une traduction de ces éléments en kirghize ou en russe doit être jointe à la demande. Le déposant doit remettre la traduction en kirghize ou en russe dans un délai de trois mois à compter de la date de dépôt de la demande auprès de Kirghizpatent.
Sur requête du déposant, le délai de présentation des éléments indiqués peut être prorogé, ou rétabli s’il n’a pas été respecté, à condition que le déposant justifie d’une excuse légitime et acquitte la taxe correspondante.
La demande peut être déposée par l’intermédiaire d’un agent de brevets enregistré auprès de Kirghizpatent. Les personnes physiques domiciliées hors de la République kirghize ou les personnes morales étrangères ainsi que leurs agents de brevets doivent, pour l’obtention et le maintien en vigueur des titres de protection relatifs aux objets de propriété industrielle, agir par l’intermédiaire d’agents de brevets enregistrés auprès de Kirghizpatent.
Les pouvoirs de l’agent de brevets sont attestés par une procuration que lui remet la personne au nom de laquelle le titre de protection est demandé.
Kirghizpatent détermine les modalités de l’examen d’aptitude et de l’enregistrement auxquels sont soumis les agents de brevets et se charge de leur application.

Demande de brevet provisoire d’invention ou de brevet d’invention

18. La demande de brevet provisoire d’invention ou de brevet d’invention (ci-après dénommée “demande de brevet d’invention”) doit porter sur une invention ou sur une pluralité d’inventions liées entre elles de telle sorte qu’elles satisfont à la règle de l’unité de l’invention.

La demande de brevet d’invention doit contenir
i) une requête en délivrance d’un brevet provisoire ou d’un brevet dans laquelle doivent être indiqués le ou les inventeurs et la ou les personnes au nom desquelles le brevet provisoire ou le brevet est demandé, ainsi que leur domicile ou leur siège;
ii) une description qui expose l’invention d’une manière suffisamment complète pour permettre à un homme du métier de l’exécuter;
iii) une ou des revendications définissant l’objet de l’invention et entièrement fondées sur la description;
iv) des dessins et d’autres éléments, s’ils sont nécessaires à l’intelligence de l’objet de l’invention;
v) un abrégé.
À la demande de brevet d’invention doit être joint un justificatif du paiement de la taxe prescrite ou de l’existence de conditions autorisant l’exonération de la taxe de dépôt ou une réduction de cette taxe, qui peut être présenté lors du dépôt de la demande ou dans un délai de deux mois, moyennant paiement d’une taxe supplémentaire.
Si le justificatif susmentionné n’est pas présenté dans le délai prescrit, la demande est réputée retirée.
La date de dépôt de la demande auprès de Kirghizpatent est déterminée d’après la date de réception des pièces nécessaires à l’établissement de la priorité conformément aux conditions prévues au premier alinéa de l’article 21 de la présente loi ou, si les pièces indiquées ne sont pas toutes présentées en même temps, d’après la date de réception de la dernière pièce fournie.
Les autres conditions que doivent remplir les pièces constitutives d’une demande de brevet d’invention sont établies par Kirghizpatent.

Demande de certificat de modèle d’utilité

19. La demande de certificat de modèle d’utilité doit porter sur un modèle d’utilité ou sur une pluralité de modèles d’utilité liés entre eux de telle sorte qu’ils satisfont à la règle de l’unité du modèle d’utilité.

La demande de certificat de modèle d’utilité doit contenir
i) une requête en délivrance d’un certificat, dans laquelle doivent être indiqués le ou les créateurs du modèle d’utilité et la ou les personnes au nom desquelles le certificat est demandé, ainsi que leur domicile ou leur siège;
ii) une description qui expose le modèle d’utilité d’une manière suffisamment complète pour permettre de l’exécuter;
iii) une ou des revendications entièrement fondées sur la description;
iv) des dessins, s’ils sont nécessaires à l’intelligence de l’objet du modèle d’utilité;
v) un abrégé.
À la demande de certificat de modèle d’utilité doit être joint un justificatif du paiement de la taxe de dépôt prescrite ou de l’existence de conditions autorisant l’exonération de cette taxe ou une réduction de la taxe, qui peut être présenté lors du dépôt de la demande ou dans un délai de deux mois, moyennant paiement d’une taxe supplémentaire.
Si le justificatif susmentionné n’est pas présenté dans le délai prescrit, la demande est réputée retirée.
La date de dépôt de la demande auprès de Kirghizpatent est déterminée d’après la date de réception des pièces nécessaires à l’établissement de la priorité conformément aux conditions prévues au premier alinéa de l’article 21 de la présente loi ou, si les pièces indiquées ne sont pas toutes présentées en même temps, d’après la date de réception de la dernière pièce fournie.
Les autres conditions que doivent remplir les pièces constitutives d’une demande de certificat de modèle d’utilité sont établies par Kirghizpatent.

Demande de brevet provisoire de dessin ou modèle industriel ou de brevet de dessin ou modèle industriel

20. La demande de brevet provisoire de dessin ou modèle industriel ou de brevet de dessin ou modèle industriel (ci-après dénommée “demande de brevet de dessin ou modèle industriel”) doit porter sur un seul dessin ou modèle industriel ou sur une pluralité de dessins

et modèles industriels liés entre eux de telle sorte qu’ils satisfont à la règle de l’unité du dessin ou modèle industriel.
La demande de brevet de dessin ou modèle industriel doit contenir
i) une requête en délivrance d’un brevet provisoire ou d’un brevet, dans laquelle doivent être indiqués le ou les créateurs du dessin ou modèle industriel et la ou les personnes au nom desquelles le brevet provisoire ou le brevet est demandé, ainsi que leur domicile ou leur siège;
ii) un jeu de reproductions de l’article manufacturé (de la maquette), constituant une représentation complète et détaillée de l’aspect extérieur de cet article;
iii) un plan d’ensemble de l’article manufacturé, une représentation de ses caractéristiques ergonomiques ou un schéma d’assemblage, s’ils sont nécessaires à la divulgation de l’objet du dessin ou modèle industriel;
iv) une description du dessin ou modèle industriel;
v) une liste de ses caractéristiques essentielles.
À la demande de brevet de dessin ou modèle industriel doit être joint un justificatif du paiement de la taxe de dépôt prescrite ou de l’existence de conditions autorisant l’exonération de cette taxe ou une réduction de la taxe, qui peut être présenté lors du dépôt de la demande
ou dans un délai de deux mois, moyennant paiement d’une taxe supplémentaire.
Si le justificatif susmentionné n’est pas présenté dans le délai prescrit, la demande est réputée retirée.
La date de dépôt de la demande auprès de Kirghizpatent est déterminée d’après la date de réception des pièces nécessaires à l’établissement de la priorité conformément aux conditions prévues au premier alinéa de l’article 21 de la présente loi ou, si les pièces indiquées ne sont pas toutes présentées en même temps, d’après la date de réception de la dernière pièce fournie.
Les autres conditions que doivent remplir les pièces constitutives d’une demande de brevet de dessin ou modèle industriel sont établies par Kirghizpatent.

Priorité d’une invention, d’un modèle d’utilité ou d’un dessin ou modèle industriel

21. La priorité d’une invention et d’un modèle d’utilité est déterminée d’après la date de dépôt auprès de Kirghizpatent d’une demande contenant une requête en délivrance d’un brevet provisoire, d’un brevet ou d’un certificat, une description, une ou des revendications et des dessins s’il y est fait référence dans la description.

La priorité d’un dessin ou modèle industriel est déterminée d’après la date de dépôt auprès de Kirghizpatent d’une demande contenant une requête en délivrance d’un brevet ou d’un brevet provisoire, un jeu de reproductions, une description et une liste des caractéristiques essentielles du dessin ou modèle industriel.
La priorité peut être déterminée d’après la date de dépôt d’une première demande dans un État partie à la Convention de Paris pour la protection de la propriété industrielle (priorité conventionnelle), si Kirghizpatent reçoit la demande dans un délai, compté à partir de cette date, de 12 mois dans le cas d’une invention ou d’un modèle d’utilité, ou de six mois dans le cas d’un dessin ou modèle industriel.
Si, pour des raisons indépendantes de la volonté du déposant, la demande revendiquant la priorité conventionnelle n’a pas pu être déposée dans le délai susmentionné, celui-ci peut être prolongé, de deux mois au maximum.
Le déposant qui souhaite bénéficier du droit de priorité conventionnelle doit l’indiquer lors du dépôt de la demande ou dans les deux mois qui suivent la date de dépôt de la demande auprès de Kirghizpatent, et joindre une copie de la première demande ou la faire parvenir au maximum trois mois après la date de réception de la demande par Kirghizpatent.
La priorité peut être déterminée d’après la date de dépôt d’éléments supplémentaires, si le déposant les a présentés sous forme d’une demande distincte qu’il a déposée avant l’expiration d’un délai de trois mois à compter de la date à laquelle il a reçu une notification
de Kirghizpatent selon laquelle ces éléments supplémentaires ne pouvaient pas être pris en considération du fait qu’ils modifient l’objet de la solution sur laquelle porte la demande.
La priorité peut être déterminée d’après la date de dépôt auprès de Kirghizpatent d’une demande antérieure du même déposant, divulguant l’invention, le modèle d’utilité ou le dessin ou modèle industriel en question, à condition que la demande qui revendique cette
priorité soit déposée au plus tard 12 mois après la date de dépôt de la demande antérieure dans le cas d’une invention, et au plus tard six mois après la date de dépôt de la demande antérieure dans le cas d’un modèle d’utilité ou d’un dessin ou modèle industriel. Dans ce cas, la
demande antérieure est réputée retirée.
La priorité peut être déterminée sur la base de plusieurs demandes déposées antérieurement si pour chacune d’elles les conditions susmentionnées sont remplies.
La priorité ne peut pas être déterminée d’après la date de dépôt d’une demande dans laquelle était déjà revendiquée une priorité antérieure.
La priorité d’une invention, d’un modèle d’utilité ou d’un dessin ou modèle industriel faisant l’objet d’une demande divisionnaire est déterminée d’après la date de dépôt auprès de Kirghizpatent de la demande initiale divulguant l’objet de propriété industrielle en question, à condition que l’office reçoive la demande divisionnaire avant que la demande initiale ait fait l’objet d’une décision définitive de refus ou, si un titre de protection a été délivré, avant l’inscription de l’objet de propriété industrielle au registre officiel.
S’il est constaté au cours de l’examen que des objets de propriété industrielle identiques ont la même date de priorité, c’est la demande dont il est établi qu’elle a été envoyée en premier à Kirghizpatent ou, si la date d’expédition est la même, celle dont le numéro d’enregistrement auprès de Kirghizpatent est antérieur qui pourra donner lieu à la délivrance d’un titre de protection.

Correction des éléments de la demande à l’initiative du déposant

22. Au cours des deux mois qui suivent la date de dépôt de la demande, le déposant a le droit de corriger ou de préciser les éléments de la demande à condition de ne pas modifier l’objet de l’invention, du modèle d’utilité ou du dessin ou modèle industriel sur lequel elle porte.

Moyennant le paiement d’une taxe, le déposant peut faire parvenir des corrections ou précisions à apporter à la demande de protection d’un objet de propriété industrielle même après l’expiration du délai indiqué, tant que n’est pas intervenue la décision d’octroi du titre de protection.

Examen de la demande de brevet d’invention quant à la forme et examen préliminaire

23. Kirghizpatent procède à un examen de la demande quant à la forme à l’expiration d’un délai de deux mois à compter de la date de dépôt de la demande.

Sur requête du déposant, l’examen quant à la forme peut être commencé avant l’expiration de ce délai. Dans ce cas, le déposant perd, à compter de la date de dépôt de la requête, le droit prévu au premier alinéa de l’article 22 de la présente loi.
L’examen de la demande quant à la forme vise à vérifier si les pièces nécessaires, prévues à l’article 18 de la présente loi, sont toutes présentes et si elles remplissent les conditions requises, et à examiner si la solution sur laquelle porte la demande fait partie des objets de propriété industrielle susceptibles de bénéficier d’une protection juridique.
Si la demande satisfait aux conditions prévues par l’examen quant à la forme, le déposant reçoit une notification l’informant que sa demande est prise en considération.
Si, à l’issue de l’examen quant à la forme, il est constaté que la demande porte sur une solution qui ne fait pas partie des objets susceptibles de bénéficier d’une protection juridique, le déposant reçoit une notification l’informant que sa demande ne peut pas être prise en considération.
Lorsque l’examen quant à la forme est achevé, la demande de brevet d’invention fait l’objet, dans un délai de 12 mois, d’un examen préliminaire.
L’examen préliminaire vise à vérifier, sur la base des pièces constitutives de la demande présentées par le déposant, des titres de protection déjà délivrés en République kirghize et des demandes non retirées dont la date de priorité est antérieure, si l’invention faisant l’objet de la demande répond aux critères de brevetabilité.
Si, conformément à l’article 22 de la présente loi, le déposant présente des éléments supplémentaires, l’examen préliminaire vise à vérifier si ces éléments ne modifient pas l’objet de l’invention sur laquelle porte la demande.
Les éléments supplémentaires modifient l’objet de l’invention sur laquelle porte la demande s’ils contiennent des caractéristiques qui ne figuraient pas dans la demande initialement déposée et qui devraient être reprises dans les revendications. Les éléments supplémentaires qui modifient l’objet de l’invention sur laquelle porte la demande ne sont pas pris en considération lors de l’examen et le déposant peut les présenter sous forme d’une demande distincte.
Lorsque la demande ne satisfait pas à la règle de l’unité, le déposant est invité à faire savoir, dans un délai de deux mois, quelle proposition doit être prise en considération, et à préciser en conséquence les éléments de la demande.
Les autres solutions qui figuraient dans la demande initiale peuvent faire l’objet de demandes divisionnaires.
Si, dans les deux mois qui suivent la date à laquelle le déposant a reçu la notification de l’inobservation de la règle de l’unité de l’invention, il n’a pas fait savoir quelle proposition doit être prise en considération et n’a pas présenté de pièces contenant des précisions, l’examen porte sur la proposition qui est indiquée en premier dans les revendications.
En ce qui concerne une demande dont les pièces ne remplissent pas les conditions requises, le déposant est invité à présenter, dans un délai de deux mois à compter de la date de l’invitation, des pièces corrigées ou les pièces manquantes.
Si, dans le délai fixé, le déposant n’a pas remis les pièces indiquées dans l’invitation et n’a pas présenté de requête en prorogation du délai, la demande est réputée retirée.
Lorsque le résultat de l’examen préliminaire de la demande est positif, il est décidé de délivrer un brevet provisoire sous la responsabilité du déposant.
Si, sur requête du déposant, la décision de délivrer un brevet provisoire est prise avant l’expiration d’un délai de 12 mois à compter de la date de dépôt de la demande auprès de Kirghizpatent et si celui-ci reçoit dans ce délai une demande identique revendiquant une priorité antérieure, la décision de délivrance est réputée nulle et non avenue.
Si Kirghizpatent reçoit une requête en examen quant au fond en même temps que les pièces constitutives de la demande ou avant l’expiration d’un délai de deux mois à compter de la décision de délivrer un brevet provisoire sur requête du déposant, le brevet provisoire n’est pas délivré.
Si, à l’issue de l’examen préliminaire, il est constaté que la demande porte sur une proposition qui n’est pas brevetable conformément aux conditions prévues par le présent article, il est décidé de refuser la délivrance d’un brevet provisoire.
Le déposant a la faculté de faire appel de cette décision auprès de la Chambre de recours dans un délai de deux mois à compter de la date de réception de la décision. L’appel doit être examiné par la Chambre de recours dans un délai de deux mois à compter de la date de sa réception.
En cas de désaccord avec la décision rendue par la Chambre de recours, le déposant peut, dans un délai de six mois à compter de la date de sa réception, introduire une action en justice.

Examen de la demande de brevet d’invention quant au fond

24. Sur requête présentée par le déposant ou un tiers au cours des cinq ans qui suivent

la date de dépôt de la demande, Kirghizpatent procède, dans un délai de 24 mois, à un examen scientifico-technique quant au fond de toute demande dont l’examen préliminaire a donné un résultat positif. Kirghizpatent notifie au déposant toute requête d’un tiers.
Au cours de l’examen de la demande quant au fond, Kirghizpatent a le droit d’inviter les déposants à fournir des éléments supplémentaires sans lesquels l’examen est impossible, y compris des revendications modifiées.
Les éléments supplémentaires demandés par l’examinateur doivent être présentés dans un délai de deux mois à compter de la date de réception par le déposant de l’invitation et ils ne doivent pas modifier l’objet de l’invention.
La procédure définie à l’article 23 de la présente loi s’applique aux éléments supplémentaires qui modifient l’objet de l’invention.
Si, à l’issue de l’examen scientifico-technique quant au fond de la demande, Kirghizpatent constate que, compte tenu de l’étendue de la protection juridique revendiquée par le déposant, la proposition faisant l’objet de la demande répond aux critères de brevetabilité de l’invention définis à l’article 5 de la présente loi, il décide de délivrer un brevet avec les revendications proposées et négociées avec le déposant.
Si Kirghizpatent constate que, compte tenu de l’étendue de la protection juridique revendiquée par le déposant, la proposition faisant l’objet de la demande ne répond pas aux critères de brevetabilité de l’invention, il décide de refuser la délivrance du brevet.
S’il est décidé de refuser la délivrance du brevet, le déposant a la faculté de faire appel de cette décision auprès de la Chambre de recours dans un délai de trois mois à compter de la date de réception de la décision. L’appel doit être examiné par la Chambre de recours dans un délai de quatre mois à compter de la date de sa réception.
En cas de désaccord avec la décision rendue par la Chambre de recours, le déposant peut, dans un délai de six mois à compter de la date de réception, introduire une action en justice.
Le déposant a le droit de prendre connaissance de tous les éléments indiqués dans la décision de l’examinateur ou dans le rapport de recherche. Une copie des documents de brevet demandés par le déposant est envoyée par Kirghizpatent dans un délai d’un mois à compter de la date à laquelle celui-ci a reçu la demande de copies du déposant.
Sauf pour les délais établis au vingtième alinéa de l’article 23 de la présente loi et aux premier et huitième alinéas du présent article, le déposant qui n’a pas respecté les délais
prévus à l’article 23 de la présente loi et dans le présent article peut être rétabli dans ses droits par Kirghizpatent s’il justifie d’une excuse légitime et acquitte la taxe prescrite.
La requête en rétablissement d’un droit lié à un délai peut être présentée par le déposant au plus tard 12 mois après l’expiration du délai en question.

Examen de la demande de certificat de modèle d’utilité

25. L’examen de la demande de certificat de modèle d’utilité consiste en un examen quant à la forme et un examen préliminaire.

Les dispositions de l’article 23 de la présente loi s’appliquent à l’examen des demandes de certificat de modèle d’utilité. S’il est constaté, à l’issue de l’examen, que la demande porte sur une proposition ayant trait à un objet brevetable, et si les pièces de la demande remplissent les conditions requises, la délivrance du certificat est décidée.

Transformation des demandes

26. Le déposant a la faculté de transformer la demande de brevet d’invention en demande de certificat de modèle d’utilité en déposant une requête avant la publication de données sur le brevet ou brevet provisoire d’invention. La demande de certificat de modèle d’utilité peut être transformée en demande de brevet d’invention tant que la décision de délivrance du certificat n’a pas été prise.

En cas de transformation, la priorité de la première demande est conservée. La transformation d’une demande s’effectue moyennant paiement de la taxe
correspondante.

Examen de la demande de brevet de dessin ou modèle industriel

27. En ce qui concerne la demande de brevet de dessin ou modèle industriel, Kirghizpatent procède à un examen quant à la forme, à un examen préliminaire et à un examen quant au fond.

Les dispositions de l’article 23 de la présente loi s’appliquent à l’examen quant à la forme et à l’examen préliminaire des demandes de brevet de dessin ou modèle industriel.
Les dispositions de l’article 24 de la présente loi s’appliquent à l’examen quant au fond des demandes.

Enregistrement des objets de propriété industrielle

28. Lorsqu’il a décidé de délivrer un titre de protection, et lorsque la taxe prévue pour l’enregistrement et la délivrance du titre de protection a été acquittée, Kirghizpatent inscrit l’invention dans le registre officiel des inventions de la République kirghize, le modèle d’utilité dans le registre officiel des modèles d’utilité de la République kirghize ou le dessin ou modèle industriel dans le registre officiel des dessins ou modèles industriels de la République kirghize.

Le justificatif du paiement de la taxe prévue pour l’enregistrement et la délivrance du titre de protection doit être présenté dans un délai de deux mois à compter de la date à laquelle le déposant a reçu la décision de délivrance du titre de protection ou, moyennant paiement d’une taxe supplémentaire, dans un délai de trois mois après l’expiration du délai initial de deux mois.
Si le justificatif du paiement de la taxe prévue pour l’enregistrement et la délivrance d’un titre de protection n’est pas présenté conformément à la procédure prescrite, l’objet de propriété industrielle n’est pas enregistré, le titre de protection n’est pas délivré et la demande correspondante est réputée retirée.

Publication de données sur l’enregistrement des objets de propriété industrielle

29. Kirghizpatent publie dans son bulletin officiel des données sur l’enregistrement des objets de propriété industrielle dans un délai de six mois à compter de la date de leur enregistrement. Kirghizpatent détermine la liste et le degré de détail des données devant être publiées.

Après la publication de données sur l’enregistrement des objets de propriété industrielle, toute personne a le droit de prendre connaissance des pièces constitutives des demandes.

Délivrance des titres de protection

30. Kirghizpatent délivre un titre de protection dans un délai de trois mois à compter de la date de publication officielle des données sur l’enregistrement dans le bulletin officiel.

Le titre de protection est délivré au nom de la République kirghize et il est signé par le directeur de Kirghizpatent.
Si un brevet provisoire, un brevet ou un certificat est demandé au nom de plusieurs personnes, un seul titre de protection leur est délivré.
Lorsque le créateur de l’objet de propriété industrielle n’est pas le titulaire de la protection, Kirghizpatent lui délivre un certificat attestant sa qualité d’inventeur ou de créateur.
La présentation du titre de protection et du certificat précité, ainsi que la liste des données qui y figurent sont déterminées par Kirghizpatent.
Sur requête du titulaire et de l’inventeur ou créateur, Kirghizpatent corrige dans le titre de protection et le certificat délivrés les erreurs manifestes et matérielles.

Titre VI

Fin de la validité des titres de protection

Contestation des titres de protection

31. Pendant toute la durée de sa validité, un titre de protection peut être invalidé en totalité ou en partie par suite d’une opposition à sa délivrance si

i) la solution protégée ne répond pas aux conditions de brevetabilité définies dans la présente loi;
ii) les revendications du brevet d’invention ou du certificat de modèle d’utilité ou la liste des caractéristiques essentielles du dessin ou modèle industriel contiennent des caractéristiques qui ne figuraient pas dans la demande initialement déposée;
iii) le brevet provisoire, le brevet ou le certificat contient une indication erronée du ou des inventeurs ou créateurs ou du ou des titulaires du brevet ou du certificat.
Toute personne qui forme une opposition doit la motiver et présenter également une pièce attestant le paiement de la taxe.
L’opposition à la délivrance du titre de protection formée pour les motifs prévus aux points i) et ii) du présent article doit être examinée par la Chambre de recours dans les six mois qui suivent la date de sa réception, et elle doit être portée à la connaissance du titulaire.
L’opposant et le titulaire peuvent prendre part à l’examen de l’opposition. La Chambre de recours limite son examen aux motifs exposés dans l’opposition à la délivrance du titre de protection.
En cas de désaccord avec la décision rendue par la Chambre de recours au sujet d’une opposition formée contre la délivrance d’un titre de protection, chacune des parties peut, dans un délai de six mois à compter de la date de la décision, introduire une action en justice.

Fin anticipée de la validité des titres de protection

32. La validité des titres de protection prend fin de façon anticipée

i) en cas d’invalidation totale du titre de protection conformément à l’article 31 de la présente loi;
ii) sur requête présentée par le titulaire à Kirghizpatent, à condition que la renonciation ne soit pas contraire aux intérêts de tiers;
iii) en cas de non-paiement dans le délai prescrit de la taxe de maintien en vigueur du titre de protection;
iv) en cas d’annulation de la décision de délivrer un brevet provisoire conformément au seizième alinéa de l’article 23 de la présente loi.
Kirghizpatent publie dans son bulletin officiel des données sur la fin anticipée de la validité du titre de protection.

Titre VII

Droits et privilèges des inventeurs ou créateurs et des titulaires

Droits et privilèges des inventeurs ou créateurs

33. L’inventeur ou créateur a le droit de donner à l’objet de propriété industrielle son nom ou un titre spécial et doit à cet effet présenter une requête à un moment quelconque de l’instruction de la demande.

Les inventeurs qui sont à l’origine des inventions les plus importantes et le plus largement exploitées peuvent être proposés pour l’obtention du titre honorifique d’“inventeur émérite de la République kirghize”.

Encouragement par l’État de la création d’objets de propriété industrielle et de leur exploitation

34. Pour promouvoir les progrès scientifiques et techniques, renforcer le potentiel intellectuel de la République kirghize, contribuer au développement de la création technique et artistique et encourager la création d’objets de propriété industrielle et leur exploitation, il est créé au sein de Kirghizpatent une Fondation de la République kirghize pour la propriété intellectuelle (ci-après dénommée “fondation”).

La fondation peut, au nom de l’État, acquérir les droits du titulaire sur un objet de propriété industrielle breveté afin d’en développer l’exploitation dans l’intérêt public.
La fondation exerce ses activités conformément à son règlement, adopté par
Kirghizpatent.
Les sources de financement de la fondation sont constituées de crédits du budget de la République kirghize, d’une partie des taxes et redevances de brevet, de ressources provenant des activités de la fondation et d’autres recettes.
L’État accorde aux inventeurs ou créateurs et aux agents économiques qui exploitent des objets de propriété industrielle des avantages fiscaux et d’autres droits et privilèges conformément à la législation de la République kirghize.

Titre VIII

Sanction des droits des titulaires et des inventeurs ou créateurs

Examen des litiges en justice

35. La procédure d’examen des litiges liés à l’application de la présente loi est définie par la législation de la République kirghize.

Relèvent de la compétence des tribunaux les litiges concernant i) la paternité de l’objet de propriété industrielle;
ii) la délivrance du titre de protection;
iii) la détermination du titulaire;
iv) la délivrance d’une licence obligatoire;
v) les atteintes portées au droit exclusif d’exploiter l’objet de propriété industrielle protégé et à d’autres droits patrimoniaux du titulaire;
vi) la conclusion et l’exécution de contrats de licence relatifs à l’exploitation de l’objet de propriété industrielle protégé;
vii) le droit de l’utilisateur antérieur;
viii) la rémunération à payer par l’employeur à l’inventeur ou au créateur conformément au contrat visé au premier alinéa de l’article 10 de la présente loi;
ix) d’autres questions liées à la protection des droits.

Responsabilité pour atteinte aux droits des inventeurs ou créateurs

36. Quiconque usurpe la qualité d’inventeur ou créateur, obtient sous contrainte la qualité de coïnventeur ou cocréateur ou divulgue de façon illicite des données sur un objet de propriété industrielle engage sa responsabilité conformément à la législation de la République kirghize.

Titre IX Dispositions finales

Taxes

37. Le dépôt de la demande de titre de protection pour un objet de propriété industrielle, l’examen et la délivrance du titre de protection, le maintien en vigueur de celui­

ci, la prorogation de sa durée de validité ainsi que l’accomplissement d’autres actes juridiques
donnent lieu au paiement de taxes. La liste des actes dont l’accomplissement donne lieu au paiement de taxes, le montant et les délais de paiement des taxes ainsi que les conditions d’exonération, de réduction ou de remboursement sont déterminés par le Gouvernement de la République kirghize.
Les taxes doivent être acquittées auprès de Kirghizpatent par le déposant ou le titulaire ou, en accord avec eux, par toute personne physique ou morale.
Kirghizpatent consacre l’intégralité des ressources qu’il perçoit au titre des taxes, y compris en devises, et en rémunération des services et des documents qu’il fournit à l’acquisition d’équipements techniques, à la mise au point et l’exploitation de systèmes automatisés, à l’élargissement de la collection de documents de brevets et à la formation et l’encouragement du personnel.

Dépôt de demandes de protection d’objets de propriété industrielle à l’étranger

38. Le dépôt à l’étranger d’une demande de protection pour un objet de propriété industrielle créé en République kirghize s’effectue à l’expiration d’un délai de trois mois à compter du dépôt de la demande correspondante auprès de Kirghizpatent.

Kirghizpatent peut, si nécessaire, autoriser le dépôt à l’étranger d’une demande de protection pour un objet de propriété industrielle avant l’expiration du délai indiqué, une fois qu’il a vérifié, conformément à la procédure qu’il a lui-même établie, si la demande contient ou non des renseignements constituant un secret d’État.
Si une demande portant sur un objet de propriété industrielle créé en République kirghize est déposée à l’étranger ou auprès d’une organisation internationale sans que la procédure prévue par le présent article ait été respectée, il n’est pas délivré de titre de protection pour cet objet de propriété industrielle en République kirghize.

Droits des personnes physiques et morales étrangères

39. En vertu des traités internationaux auxquels la République kirghize est partie, ou sur la base du principe de réciprocité, les personnes physiques et morales étrangères bénéficient des droits prévus par la présente loi et par d’autres instruments normatifs traitant de la protection juridique des objets de propriété industrielle au même titre que les personnes physiques et morales de la République kirghize.

Les apatrides domiciliés en République kirghize bénéficient des droits prévus par la présente loi et les autres textes législatifs traitant de la protection juridique des objets de propriété industrielle au même titre que les personnes physiques et morales de la République kirghize, sauf disposition contraire de la présente loi ou d’un autre texte législatif de la République kirghize.

Traités internationaux

40. Si un traité international auquel la République kirghize est partie prévoit des règles différentes de celles qui sont énoncées dans la présente loi, ce sont les dispositions du traité international qui sont applicables.

Entrée en vigueur de la présente loi

41. La loi sur les brevets de la République kirghize entrera en vigueur à la date de sa publication.
