ACT INTRODUCING PATENT TREATIES 1978

(Federal Act on the Introduction of the European Patent Convention and the
Patent Cooperation Treaty)
as amended

DEFINITIONS

1.-
For the purposes of this Federal Act:
1. "EPC" means the Convention on the Grant of European Patents (European Patent Convention) signed at Munich on October 5, 1973;
2. "Protocol on Centralisation" means the Protocol on the Centralisation of the European Patent System and on its Introduction, which is an integral part of the EPC under Article 164 thereof;
3. "PCT" means the Patent Cooperation Treaty done at Washington on June 19, 1970;
4. "European patent application" means an application filed under the EPC in which the Republic of Austria is designated as Contracting State, and according to which protection is therefore sought in that State for the invention;
5. "European patent" means a patent granted under the EPC for the Republic of Austria as designated Contracting State;
6. "international application" means an application filed under the PCT in which the Republic of Austria is designated as Contracting State, and according to which protection is therefore sought in that State for the invention on the basis of the said international application;
7. "Patents Act" means the Patents Act (Patentgesetz) of 1970, published in the Federal Law Gazette No. 259/1970, as amended.

I. PATENT APPLICATIONS AND PATENTS
UNDER THE EPC

Filing with the Austrian Patent Office

2.-
Patent applications under the EPC may be filed with the Austrian Patent Office in addition to the offices specified in Article 75(1)(a) of the EPC, in one of the official languages under Article 14 of the EPC, provided that at least the particulars specified in Article 80 (a) to (c) of the EPC are in German, English or French. Applications that do not meet these requirements shall be deemed not to have been filed.

Publication and Laying Open for Public Inspection;
Information of the Public

3.-
(1) European patent application published under Article 93 of the EPC shall be laid open for public inspection by the Austrian Patent Office, together with the translation filed for that purpose (Section 4 (2)), until such time as a European patent is granted or the European patent application is rejected or withdrawn. Notice of such action shall be published in the Austrian Patent Gazette (Österreichisches Patentblatt), together with a mention of the language in which the European patent application is written. Section 10(1) and (3) of the Patents Act shall apply mutatis mutandis.
(2) The European Patent Gazette, published European patent applications and European patent specifications shall be laid open for public inspection at the Austrian Patent Office.
(3) Registers shall be kept of European patent applications and European patents which shall provide the public with rapid and reliable information concerning the protective rights concerned.

Rights Deriving from the European Patent Application
after Publication; Translation

4.-
(1) The European patent application shall give the applicant, as from the date of publication under Article 93 of the EPC, a provisional claim to compensation appropriate to the circumstances from any person who has unlawfully made use of the subject matter of the application (Patents Act. Section 22 (1)). The European application shall not benefit from protection under Article 64 of the EPC.
(2) Where the European patent application has not been published in German, the claim under paragraph (1) shall exist only as from the date on which a translation of the patent claims in German, submitted by the applicant, has been published by the Austrian Patent Office in accordance mutatis mutandis with the provisions of Section 3 (1) and after payment of the publication fee (Section 22); or has been communicated by the Austrian Patent Office to the user of the subject matter of the application.

Translation of the European Patent Specification

5.-
(1) Where the European patent specification is not issued in German, a German translation of the patent shall be filed with the Austrian Patent Office within three months at the latest after publication of the mention of grant of the European patent in the European Patent Gazette, and a publication fee (Section 22) shall be paid. The Austrian Patent Office shall publish the translation in printed form.
(2) Subsection (1) shall apply mutatis mutandis to the submitting of the translation of the European patent specification as amended by a decision of the Opposition Division (EPC, Article 102 (3)).
(3) If the period (subsections 1 and 2) for filing the required translation and for the payment of the publication fee is not complied with, if a publication fee which was paid only in part is not completely paid within the period set for such complete payment, if the payment of the publication fee is not duly proved (Sec. 169 Patents Act) or if other formal defects are not remedied, the European patent shall be deemed never to have had effect ab initio.

Authentic Version of a European Patent
Application and of a European Patent;
Correction of the Translation

6.-
(1) Where a German translation is required under Section 4 or 5, the scope of protection of the European patent application or European patent shall be determined by that translation insofar as the scope of protection resulting from the translation is narrower than the scope of protection in the language of the proceedings. This shall not apply, however, to proceedings for revocation or forfeiture of the patent.
(2) The applicant for or owner of a European patent may request correction of the translation. The correction shall be effective on the date on which it is published by the Austrian Patent Office after payment of the publication fee (Section 22).
(3) The correction shall be published by display in the display hall of the Austrian Patent Office (Section 3 (1)) in the case of patent applications, and by the issue of a print in the case of patents.
(4) A notice of the correction shall be published in the Austrian Patent Gazette.
(5) Where a person appeals against the narrower scope of protection of the German translation of a published patent application, the correction shall also be effective against the appellant when the applicant has communicated the corrected German translation to him.
(6) The correction shall not be effective against a person who, before it became effective, had, in good faith, started to use the subject matter of the European patent application or European patent in Austria, or had made the necessary arrangements for such use (interim user). The rights of the interim user shall be determined by application, mutatis mutandis, of the provisions of Section 23 (2) to (4) of the Patents Act. Where a license agreement the scope of which extends to the protected subject matter affected by the correction has been concluded prior to the correction, and where the right of the licensee is adversely affected by the correction, the licensee may demand a reduction appropriate to the circumstances in the remuneration under the license agreement, or may withdraw from the license agreement where the adverse effect is such that he has no further interest in its implementation.

Patent Register

7.-
Entries relating to European patents shall be recorded in a special part of the Patent Register (Patents Act, Section 80) and shall have the same effect as entries in other parts of the Register.

Annual Fees Payable to the Austrian Patent Office

8.-
(1) Annual fees shall be paid to the Austrian Patent Office in respect of European patents for all years following that specified in Article 86 (4) of the EPC.
(2) The amount of the annual fees payable to the Austrian Patent Office under subsection (1) shall be determined pursuant to Section 166 (3) of the Patents Act, subject, however, to the following modifications:
1. for the third year of the term of the European patent the same annual fee as for the first year shall be payable, not taking into account the fees for additional pages of the description and additional sheets of drawings;
2. for the fourth to twentieth years of the term of the European patent the same annual fees shall be paid as for the second to eighteenth years.
(3) Annual fees for each coming year shall fall due on the last day of the month having the same name as the month of the application date.
(4) Annual fees may be paid not earlier than three months prior to their due date. The first annual fee to be paid to the Austrian Patent Office shall be paid within one year of falling due, and subsequent annual fees within six months of falling due.
(5) For payment after the due date, a 20% surcharge shall be paid in addition to the annual fee. This surcharge shall not be payable in respect of the first annual fee to be paid to the Austrian Patent Office when it is paid within three months of falling due.
(6) Annual fees may be paid by any person having an interest in the patent.
(7) Annual fees that are not yet due shall be refunded to the payer when the patent is renounced or lapses for other reasons before the said annual fees fall due.

Request for Conversion

9.-
(1) At the request of the applicant for a European patent, the Austrian Patent Office shall initiate the procedure for the grant of a patent when the European patent application is deemed withdrawn under Article (77 (5) or 162 (4) of the EPC.
(2) Where the request for conversion has been forwarded to the Austrian Patent Office, or has been filed at the Austrian Patent Office if it was to be filed there at the outset, the applicant shall be called upon by preliminary decision (Patents Act, Section 99) to do the following within three months:
(a) pay the application fee (Patents Act, Section 166(1));
(b) where applicable, file a German translation of the European patent application as originally filed and also, where applicable, of an amended version on which the applicant wishes to have the granting procedure before the Austrian Patent Office based.
(3) For patent applications converted in the manner prescribed, the filing date of the European patent application shall be regarded as the filing date under Section 87(2) of the Patents Act.
(4) Annual fees under Section 166 of the Patents Act shall be paid for the patent granted on the basis of the converted patent application.

Grounds for Revocation

10.-
(1) European patents may be revoked on the grounds specified in Article 138(1)(a) to (d) of the EPC including section 48(1)4. Patents Act and may be forfeited on the ground specified in Article 138(1)(c) of the EPC.
(2) Insofar and as long as a reservation in respect of Austria under article 167(2)(a) of the EPC is effective, European patents may be revoked insofar as they afford protection to chemical compounds as such or to foodstuffs of human beings or pharmaceutical products as such, except where the patent relates to a process for the manufacture or use of a chemical compound or a process for the manufacture of a foodstuff for human beings or pharmaceutical products.
(3) The European patent may also be revoked when it is found that the invention is the subject of an earlier Austrian patent.

Suspension of Opposition Procedure

11.-
(Constitutional provision) Proceedings before the Austrian Patent Office for the revocation of a European patent shall be suspended ex officio where an opposition procedure (EPC, Article 99) relating to the same subject matter is pending or brought before the European Patent Office. The suspended proceedings shall be resumed on request after the opposition procedure has been terminated by a decision having the force of res judicata when no decision on the matter at issue has been rendered by the European Patent Office. Otherwise the proceedings shall be discontinued on request or ex officio.

Infringement Proceedings

Where the prosecution of an infringement action under Section 156(3) of the Patents Act has been suspended the defendant may, instead of submitting proof that he has filed a revocation claim with the Austrian Patent Office, or that revocation proceedings are already pending between the parties, or that he has already joined in such proceedings as an intervening party, submit proof that he has filed opposition to the European patent with the European Patent Office (EPC, Article 99) or is otherwise party to an opposition procedure concerning the European patent that is already pending between the parties to the dispute.

Complementary Search by the Austrian Patent Office

13.-
(1) Any person may file a request with the Austrian Patent Office for the making of a complementary search in relation to any published European patent application or European patent. The search shall cover such Austrian patent specifications as are not included in the search file of the European Patent Office and shall identify patents issued by the Austrian Patent Office that have an earlier application date than the European patent application or European patent.
(2) The carrying out of a complementary search shall be recorded in the Patent Register. Any person may inspect the search report.
(3) The request for the issue of a search report shall be subject to a fee in the same amount as the application fee (Sec. 166(1) Patents Act). Payment of the fee shall be duly proved (Sec. 169 Patents Act).

Transmittal of European Patent Applications to the
Austrian Patent Office for Processing

14.-
(Constitutional provision) Agreements concerning the processing of European patent applications by the Austrian Patent Office that are concluded under Section IV(1) and (2) of the Protocol on Centralisation between the President of the European Patent Office and the Federal Minister of Commerce, Trade and Industry may specify, among other things, the nature, origin and number of European patent applications to be processed, the period for transmittal, the procedure for calculation of the costs to be refunded to the Austrian Patent Office for the processing of European patent applications and the obligation on the Austrian Patent Office to adhere to the guidelines of the European Patent Office for European searches and examinations.

Letters Rogatory

14a.-
(1) The Austrian Patent Office shall accept the letters rogatory of the European Patent Office (Art. 131(2) EPC). The letters rogatory shall be answered by the member of the Legal Division responsible under the schedule of responsibilities with the assistance of the legally qualified member responsible for the respective technical field.
(2) The Law on the Scale of Fees, Federal Law Gazette No. 136, as amended shall apply.

II. APPLICATIONS UNDER THE PCT

Receiving Office

15.-
(1) The Austrian Patent Office shall be a Receiving Office within the meaning of Article 10 of the PCT for applicants who are Austrian citizens or have their residence (headquarters) in the Republic of Austria. Applications shall be filed in German. The priority of applications under the Patents Act may also be claimed.
(2) For every application under subsection 1 a transmittal fee in the same amount as the application fee (Sec. 166(1) Patents Act) shall be paid not later than on the filing date. Payment of the fee shall be duly proved (Sec. 169 Patents Act).

Designated Office

16.-
(1) The Austrian Patent Office shall be a Designated Office for international applications except where the applicant has applied for the grant of a European patent.
(2) Where the Austrian Patent Office is the Designated Office, the applicant shall file a copy of the international application within the period set therefor in PCT Art. 22 unless it has been transmitted under PCT Art. 20 and, if the Austrian Patent Office is not also the Receiving Office, pay a fee in the same amount as the application fee (Patents Act, Section 166(1)). Where the application is not in German, a German translation shall be filed within the same period.
(3) A decision on the further processing of an international application under Article 25(2)(a) of the PCT shall be taken by the Austrian Patent Office only if a fee in the same amount as the application fee (Patents Act, Section 166(1)) is paid, and where applicable a German translation of the international application is filed, in due time.
(4) If the timely payment of fees under subsections (2) and (3) has not been duly proved (Sec. 169 Patents Act), an additional time limit of two months shall be set.

Elected Office

17.-
(1) Where, under Article 31(4)(a) of the PCT, the Republic of Austria is named in the international applications as the Contracting State in which the applicant intends to use the results of the international preliminary examination, and provided he has not applied for the grant of a European patent, the Austrian Patent Office shall be the Elected Office (PCT, Article 2(xiv), and subsections (2) and (3) shall apply.
(2) Where the election is made before expiry of the nineteenth month from the priority date, the Period under PCT, Art. 39(1)(a) shall be decisive for the actions referred to in Section 16(2). This shall not apply, however, when the applicant intends to avail himself of the provisions of Article 37(4)(b) of the PCT.
(3) Examination reports that are not established in German, English or French shall be translated into German according to Article 36(2) of the PCT.

International Searching Authority and
International Preliminary Examining Authority

18.-
(1) (Constitutional provision) The consent to the appointment of the Austrian Patent Office as International Searching Authority (PCT, Article 16(3)(b) or as International Preliminary Examining Authority (PCT, Article 32 (3)) shall be issued by the Federal Minister of Commerce, Trade and Industry.
(2) After the entry into force for the Republic of Austria of the EPC the Federal Minister of Commerce, Trade and Industry may issue his consent insofar as the conditions set forth in paragraph (3) or in the Protocol on Centralisation are met.
(3) (Constitutional provision) The Austrian Patent Office may, by virtue of an agreement between the President of the European Patent Office and the Federal Minister of Commerce, Trade and Industry, be entrusted with the independent carrying out of international searches and international preliminary examinations under the PCT on behalf of developing countries.
(4) (Constitutional provision) The agreements between the Director General of the World Intellectual Property Organization and the Federal Minister of Commerce, Trade and Industry (PCT, Articles 16(3)(b) and 32(3)) shall specify the rights and obligations of the Parties in the carrying out of the international search and international preliminary examination, and in particular the formal undertaking to apply and observe the common rules of international search and international preliminary examination.

International Search Fee and
International Preliminary Examination Fee

19.-
(1) The fee for international search and for all other tasks entrusted to International Searching Authorities by the PCT and the Regulations thereunder ("search fee") shall be in the same amount as the fee for the request for the carrying out of a search under Section 57a(1) of the Patents Act.
(2) Where the international application does not meet the requirement of unity of invention (PCT, Article 3(4)(iii)), the international search report shall be made for the parts of the international application that relate to the invention first mentioned in the claims. For any further invention or group of inventions that are interconnected in such a way as to constitute a single general inventive idea, an additional fee in the same amount as the search fee shall be payable.
(3) Where an international application claims the priority of an earlier international application which has been searched by the Austrian Patent Office as International Searching Authority, 75% of the search fee paid shall be refunded when the first search report can be used entirely or to an essential extent in the making of the international search report. The same shall apply where reference is made in the international application to an earlier international-type search (PCT, Article 15(5)), and where the international-type search can be used entirely or to an essential extent in the making of the international search report.
(4) The fee for international preliminary examination and all other tasks entrusted to International Preliminary Examining Authorities by the PCT and the Regulations thereunder ("preliminary examination fee") shall be in the same amount as the fee for the request for the making of an expert opinion under Section 57a(2) of the Patents Act when the state of the art is communicated by the applicant. The fee shall be payable at the same time as the handling fee to be paid to the International Bureau of the World Intellectual Property Organization.
(5) Where the Austrian Patent Office finds that the international application does not meet the requirement of unity of invention and calls upon the applicant to limit the claims or pay additional fees, the amount of the additional fees and the grounds therefor shall be stated. Where the applicant limits his claims to a unified invention or group of inventions, an additional fee in the same amount as the fee for preliminary examination shall be paid for each additional invention or group of inventions that are interconnected in such a way as to constitute a single general inventive idea.
(6) Payment of fees under subsections 1 to 5 shall not be deemed to have been made until it has been duly proved (Sec. 169 Patents Act).
(7) Appeals against decisions on the objection of an applicant to an additional fee set by the Austrian Patent Office under Article 17(3)(a) or 34(3)(a) of the PCT shall be determined by the Appeal Division of the Austrian Patent Office.

Publication and Laying Open for Public Inspection;
Information of the Public: Rights Deriving from
Publication of the International Application

20.-
(1) International applications that are published by the International Bureau of the World Intellectual Property Organization under Article 21 of the PCT shall be published and laid open for public inspection by the Austrian Patent Office, together with any translations that may have been filed (Section 21), until such time as a patent is granted or the patent application rejected or withdrawn. Section 101(1) and (3) of the Patents Act shall apply mutatis mutandis.
(2) The rights deriving from an international application published under Article 21 of the PCT shall be determined by application mutatis mutandis of the provisions of Section 4. This shall be without prejudice to Article 158(1) of the EPC.
(3) The Gazette of the International Bureau of the World Intellectual Property Organization (PCT, Article 55(4)) and published international applications shall be laid open for public inspection at the Austrian Patent Office.
(4) Registers shall be kept of international applications which shall provide the public with rapid and reliable information on those applications.

III. COMMON PROVISIONS

Formal Requirements of Translation

21.-
The formal requirements of a translation or correction of a translation, filed by the applicant under this Federal Act, shall be specified in detail by an order issued by the President of the Austrian Patent Office. Consideration shall be given in the issue of this order to ensuring the greatest possible conciseness and simplicity and to meeting the requirements of the type of publication of the translation envisaged. Authentication may not be demanded.

Fees for the Publication of Translations

22.-
(1) A publication fee shall be paid for every publication of a translation or a correction thereof provided for in this Federal Act.
(2) The publication fee shall amount to ATS 1,600 plus ATS 350 for the sixth and for every subsequent page of the translation filed or of the correction thereof as well as ATS 350 for the third and for every subsequent sheet of enclosed drawings, Sec. 166(10) Patents Act shall apply.
(3) Payment of the publication fee shall not be deemed to have been made until it has been duly proved (Sec. 169 Patents Act).

Competence to Handle Business: Form Examiners

23.-
(1) Competence to handle business connected with European and international patent applications and European patents shall be determined, unless otherwise provided in this Federal Act, by application mutatis mutandis of the provisions of the Patents Act.
(2) Employees who are not members of the Patent Office may be authorized, by an order of the President of the Austrian Patent Office, to handle business connected with European and international patent applications, as well as European patents the nature of which business shall be specifically stated, notably examination as to form, insofar as this is appropriate in view of the simplicity of the business and the training of the employees (form examiners /Formalprüfer/) affords a guarantee of orderly handling of the business. Form examiners shall be under the instructions of the member of the Austrian Office staff who is competent according to the distribution of responsibilities. That member may at any time reserve the handling of business for himself or take over business already being handled.
(3) Section 76(1), (4) and (5) of the Patents Act shall apply mutatis mutandis to form examiners.
(4) Decisions of form examiners may be appealed against in the same way as those of the competent member of the Patent Office staff. The competent member may grant the legal remedy himself; if he considers that the legal remedy should not be granted or should be granted only partially, he shall submit the appeal to the Appeal Division and state the reasons therefor in his report to it.

Complementary Application of the Patents Act

24.-
European and international patent applications and European patents, and procedures concerning these protection rights, shall be subject, mutatis mutandis and on a complementary basis, to application of the provisions of the Patents Act, in addition to the provisions of the EPC, the PCT and this Federal Act.

IV. FINAL AND TRANSITIONAL PROVISIONS

Entry into Force

25.-
For European patent applications and patents this Federal Act shall enter into force on the entry into force of the EPC for the Republic of Austria (EPC, Article 169), and for international applications on the entry into force of the PCT for the Republic of Austria (PCT, Article 63).

Repeal and Transitional Provisions

26.-
(1) (Constitutional provisions) This Federal Act shall be repealed:
1. in respect of applications under the EPC, when the EPC ceases to have effect in the Republic of Austria;
2. in respect of applications under the PCT, when the PCT ceases to have effect in the Republic of Austria.
(2) Article 175 of the EPC shall remain unaffected.
(3) Article 66(2) of the PCT shall remain unaffected.

Implementation

27.-
The implementation of this Federal Act is entrusted to the Federal Government insofar as such implementation is not incumbent on the Federal Minister of Commerce, Trade and Industry and the Federal Minister for Foreign Affairs by virtue of the Federal Ministries Law (Bundesministeriengesetz), Federal Law Gazette No. 389.

1er. Dans la présente loi fédérale,

1. “CBE” s’entend de la Convention sur la délivrance de brevets européens, faite à Munich le 5 octobre 1973 (Convention sur le brevet européen);

2. “Protocole sur la centralisation” s’entend du Protocole sur la centralisation et l’introduction du système européen des brevets qui fait, conformément à l’article 164 de la CBE, partie de cette Convention;

3. “PCT” s’entend du Traité de coopération en matière de brevets, fait à Washington le 19 juin 1970;

4. “demande de brevet européen” s’entend d’une demande déposée sur la base de la CBE, désignant la République d’Autriche en tant qu’État contractant dans lequel la protection de l’invention est par conséquent demandée;

5. “brevet européen” s’entend d’un brevet délivré sur la base de la CBE pour la République d’Autriche en tant qu’État désigné;

6. “demande internationale” s’entend d’une demande effectuée sur la base du PCT, désignant la République d’Autriche en tant qu’État contractant dans lequel la protection est par conséquent demandée sur la base de la demande internationale;

7. “loi sur les brevets” s’entend de la loi sur les brevets (Patentgesetz) de 1970, publiée dans le Journal officiel n° 259/1970, sous sa forme modifiée.

Demandes de brevet et brevets fondés sur la CBE

Dépôt auprès de l’Office autrichien des brevets

2. Les demandes de brevet fondées sur la CBE peuvent être déposées, abstraction faite des services de dépôt prévus à l’article 75(1)a) de la CBE, auprès de l’Office autrichien des brevets (ci-après dénommé “Office des brevets”) dans l’une des langues admises selon l’article 14 de la CBE, lorsqu’au moins les indications visées à l’article 80.a) à c) de la CBE sont rédigées en langues allemande, anglaise ou française. Les demandes qui ne remplissent pas ces conditions sont réputées n’avoir pas été déposées.

Publication et exposition; information du public

3. — 1) Les demandes de brevet européen publiées selon l’article 93 de la CBE sont exposées, avec les traductions déposées à cet effet (art. 4.2)), par l’Office des brevets jusqu’à la délivrance d’un brevet européen ou jusqu’au rejet ou au retrait de la demande de brevet européen. Il est publié un avis à cet égard, avec l’indication de la langue dans laquelle la demande de brevet européen est rédigée, dans la gazette autrichienne des brevets (Österreichisches Patentblatt). L’article 101.1) et 3) de la loi sur les brevets est applicable par analogie.

2) Le Bulletin européen des brevets, les demandes de brevet européen publiées et les fascicules de brevets européens sont soumis à l’inspection publique auprès de l’Office des brevets.

3) Il est tenu des registres des demandes de brevet européen et des brevets européens permettant une information rapide et exacte du public au sujet de ces droits de protection.

Droits conférés par la demande de brevet européen après sa publication; traduction

4. — 1) La demande de brevet européen donne provisoirement au déposant, à compter du jour de sa publication selon l’article 93 de la CBE, un droit à des dommages-intérêts appropriés aux circonstances à l’encontre de celui qui a utilisé l’objet de la demande sans droit (art. 22.1) de la loi sur les brevets). La protection prévue à l’article 64 de la CBE n’est pas assurée à la demande de brevet européen.

2) Lorsque la demande de brevet européen n’a pas été publiée en langue allemande, le droit prévu à l’alinéa 1) n’existe qu’à compter du jour où une traduction allemande des revendications, produite par le déposant, a été publiée par l’Office des brevets, après paiement de la taxe de publication (art. 22), en application par analogie de l’article 3.1), ou communiquée par l’Office des brevets à l’utilisateur de l’objet de la demande.

Traduction du fascicule du brevet européen

5. — 1) Lorsque le fascicule de brevet européen n’est pas publié en langue allemande, il y a lieu de déposer, dans les trois mois impérativement suivant la publication de l’avis de délivrance du brevet européen dans le Bulletin européen des brevets, une traduction allemande du brevet et de payer une taxe de publication (art. 22). L’Office des brevets publie la traduction en tant qu’imprimé.

2) L’alinéa 1) est applicable par analogie à la production de la traduction de la version du fascicule du brevet européen modifié par décision de la division d’opposition (art. 102(3) CBE).

3) Si le délai prévu (alinéas 1) et 2)) pour la fourniture de la traduction requise et pour le paiement de la taxe de publication n’est pas respecté, si la taxe de publication n’a été payée que partiellement et n’est pas entièrement payée dans le délai fixé pour ce faire, si le paiement de la taxe de publication n’est pas dûment prouvé (art. 169) de la loi sur les brevets) ou si d’autres erreurs de forme ne sont pas corrigées, le brevet européen est réputé n’avoir jamais eu d’effet ab initio.

Texte de la demande de brevet européen ou du brevet européen faisant foi; correction de la traduction

6. — 1) Lorsqu’une traduction en allemand est prescrite par les articles 4 ou 5, l’étendue de la protection de la demande de brevet européen ou du brevet européen est déterminée d’après cette traduction, dans la mesure où l’étendue de la protection découlant de

la traduction est plus restreinte que celle découlant de la langue de la procédure. La présente disposition n’est toutefois pas applicable à la procédure de déclaration de nullité ou de déchéance du brevet.

2) Le déposant d’une demande de brevet européen ou le titulaire d’un brevet européen peut demander la correction de la traduction. La correction prend effet au jour de sa publication par l’Office des brevets après paiement de la taxe de publication (art. 22).

3) La correction est publiée par exposition dans la salle d’exposition de l’Office des brevets (art.3.1)), et celle des brevets par publication d’un imprimé.

4) Un avis relatif à la correction est publié dans la gazette autrichienne des brevets.

5) Lorsqu’il est fait recours contre l’étendue de la protection plus restreinte de la traduction allemande d’une demande de brevet publiée, la correction déploie également ses effets à l’encontre du recourant lorsque le déposant lui a communiqué la traduction allemande corrigée.

6) La correction ne produit pas d’effet à l’encontre de celui qui, avant son entrée en vigueur, avait déjà de bonne foi utilisé l’objetde la demande de brevet européen ou du brevet européen en Autriche ou avait pris des mesures nécessaires pour son utilisation (exploitant intérimaire). Les droits de l’exploitant intérimaire sont déterminés en appliquant par analogie l’article 23.2) à 4) de la loi sur les brevets. Lorsqu’un contrat de licence portant sur l’étendue de la protection comprise par la correction a été conclu avant la correction et que la correction porte atteinte au droit du preneur de licence, celui-ci peut demander une diminution, appropriée aux circonstances de l’espèce, de la rémunération due ou résilier le contrat lorsqu’il n’a plus, en raison de cette atteinte, intérêt à l’exécution ultérieure du contrat.

Registre des brevets

7. Les enregistrements de brevets européens sont inscrits dans une partie spéciale du registre des brevets (art. 80 de la loi sur les brevets) et ont le même effet que les enregistrements inscrits dans l’autre partie du registre.

Taxes annuelles à payer à l’Office des brevets

8. — 1) Pour les brevets européens, des taxes annuelles doivent être payées à l’Office des brevets pour les années suivant l’année mentionnée à l’article 86(4) de la CBE.

2) Le montant des taxes annuelles à payer à l’Office des brevets selon l’alinéa 1) est déterminé selon l’article 166.3) de la loi sur les brevets, avec toutefois les modifications suivantes :

1. pour la troisième année de durée du brevet européen, il y a lieu de payer la taxe annuelle pour la première année, compte non tenu des montants supplémentaires pour des pages de la description et des feuilles de dessins;

2. de la quatrième à la 20e année de la durée du brevet européen, il y a lieu de payer respectivement les annuités de la deuxième à la 18e année.

3) Les annuités échoient, pour l’année suivante, au dernier jour du mois correspondant au mois anniversaire du jour dépôt.

4) Les annuités peuvent être payées au plus tôt trois mois avant leur échéance. La première annuité due à l’Office des brevets doit être payée dans le délai d’une année, les suivantes dans le délai de six mois après leur échéance.

5) Le paiement de l’annuité après l’échéance donne lieu au paiement d’un supplément de 20%. Ce supplément n’est pas applicable à la première annuité due à l’Office des brevets lorsqu’elle est payée dans les trois mois suivant son échéance.

6) Les annuités peuvent être payées par toute personne intéressée au brevet.

7) Les annuités non encore échues sont restituées à la personne qui les a payées si le brevet fait l’objet d’une renonciation ou s’il tombe en déchéance d’une autre manière avant l’échéance.

Requête en transformation

9. — 1) Sur requête du déposant d’une demande de brevet européen, l’Office des brevets commence la procédure de délivrance d’un brevet lorsque la demande de brevet européen est réputée retirée selon l’article 77(5) ou l’article 162(4) de la CBE.

2) Lorsque la requête en transformation a été transmise à l’Office des brevets, ou lui a été présentée au moment où elle devait l’être, le requérant est invité sur décision préalable (art. 99 de la loi sur les brevets), dans un délai de trois mois,

a) à payer la taxe de dépôt (art. 166.1) de la loi sur les brevets) et, le cas échéant,

b) à produire une traduction allemande de la demande de brevet européen, dans la version déposée à l’origine ainsi que, le cas échéant, dans la version modifiée sur laquelle le déposant souhaite fonder la procédure de délivrance devant l’Office des brevets.

3) Pour les demandes de brevet transformées régulièrement, le jour du dépôt de la demande de brevet européen est réputé être le jour du dépôt au sens de l’article 87.2) de la loi sur les brevets.

4) Pour le brevet délivré sur la base de la demande transformée, il y a lieu de payer des annuités selon l’article 166 de la loi sur les brevets.

10. — 1) Les brevets européens peuvent être déclarés nuls pour les motifs prévus aux articles 138(1)a) à d) de la CBE et à l’article 48.1)4 de la loi sur les brevets, ainsi que pour le motif prévu à l’article 138(1)e) de la CBE.

2) Dans la mesure où et aussi longtemps qu’une réserve de l’Autriche, conformément à l’article 167(2)a) de la CBE, est en vigueur, les brevets européens peuvent être déclarés nuls, dans la mesure où ils prévoient une protection pour les produits chimiques en tant que tels,

pour les produits alimentaires, pour les êtres humains ou pour les produits pharmaceutiques en tant que tels, sauf si le brevet concerne un procédé pour l’obtention ou l’application d’un produit chimique ou un procédé pour la production d’un produit alimentaire pour les êtres humains ou d’un produit pharmaceutique.

3) Le brevet européen peut en outre être déclaré nul lorsqu’il s’avère que l’invention fait l’objet d’un brevet autrichien antérieur.

Suspension de la procédure d’opposition

11. (Disposition constitutionnelle) Une procédure en nullité d’un brevet européen pendante devant l’Office des brevets est d’office suspendue si une procédure d’opposition (art. 99 de la CBE) concernant le même objet est pendante ou devient pendante devant l’Office européen des brevets. La procédure suspendue est reprise sur demande après que la procédure d’opposition entre en force de chose jugée lorsque l’Office européen des brevets ne s’est pas prononcé sur l’objet lui-même. Sinon, la procédure est suspendue, sur demande ou d’office.

Actions en contrefaçon

12. Lorsqu’une procédure concernant une action en contrefaçon selon l’article 156.3) de la loi sur les brevets a été suspendue, au lieu d’apporter la preuve qu’il a intenté une action en nullité auprès de l’Office des brevets, qu’une procédure en nullité est déjà pendante entre les parties ou qu’il s’est joint à une telle action en tant que partie intervenante, le défendeur peut apporter la preuve qu’il a fait opposition au brevet européen auprès de l’Office européen des brevets (art. 99 de la CBE) ou qu’il est d’une autre manière partie à une procédure d’opposition au brevet européen déjà pendante entre les parties.

Recherche complémentaire effectuée par l’Office des brevets

13. — 1) Toute personne peut demander à l’Office des brevets de procéder à une recherche complémentaire sur une demande de brevet européen publiée ou sur un brevet européen. La recherche doit porter sur les fascicules de brevets autrichiens qui ne sont pas contenus dans le matériel d’examen de l’Office européen des brevets et doit rechercher les brevets délivrés par l’Office des brevets qui portent une date de dépôt antérieure à la demande de brevet européen ou au brevet européen.

2) L’exécution d’une recherche complémentaire est inscrite dans le registre des brevets. Le rapport de recherche peut être consulté par quiconque.

3) La demande d’établissement du rapport de recherche est soumise au paiement d’une taxe égale à la taxe de dépôt (art. 166.1) de la loi sur les brevets). Le paiement de la taxe doit être dûment prouvé (art. 169 de la loi sur les brevets).

Demandes de brevet européen confiées à l’Office européen des brevets pour instruction

14. (Disposition constitutionnelle) Les accords concernant l’instruction de demandes de brevet européen par l’Office des brevets, conclus en vertu de la Section IV(1) et (2) du Protocole sur la centralisation entre le Président de l’Office européen des brevets et le ministre fédéral du commerce, de l’artisanat et de l’industrie, peuvent en particulier établir le genre, l’origine et le nombre des demandes de brevet européen à instruire, la durée de la transmission de ces tâches, la procédure de détermination des frais à rembourser à l’Office des brevets pour l’instruction des demandes de brevet européen et l’obligation pour l’Office des brevets de suivre les directives de l’Office européen des brevets pour la recherche européenne.

Commissions rogatoires

14a. — 1) L’Office des brevets doit accepter les commissions rogatoires émanant de l’Office européen des brevets (art. 131.2) de la CBE). Le membre compétent de la division juridique selon la répartition des tâches doit donner suite à ces commissions rogatoires, avec l’aide du membre juridiquement qualifié compétent pour le domaine technique concerné.

2) La loi sur le barème des taxes (Journal officiel n° 136), sous sa forme modifiée, est applicable.

Dépôt de demandes sur la base du PCT

Office récepteur

15. — 1) Pour les déposants qui sont ressortissants autrichiens ou qui ont leur domicile (siège) en République d’Autriche, l’Office des brevets est office récepteur au sens de l’article 10 du PCT. Les demandes doivent être déposées en langue allemande. La priorité de demandes déposées selon la loi sur les brevets peut également être revendiquée.

2) Toute demande déposée selon l’alinéa 1) donne lieu au paiement, au plus tard au jour de son dépôt, d’une taxe de transmission égale à la taxe de dépôt (art. 166.1) de la loi sur les brevets). Le paiement de la taxe doit être dûment prouvé (art. 169 de la loi sur les brevets).

Office désigné

16. — 1) L’Office des brevets est office désigné pour les demandes internationales, à moins que le déposant n’ait demandé la délivrance d’un brevet européen.

2) Si l’Office des brevets agit en tant qu’office désigné, le déposant doit remettre dans le délai prévu à cet effet à l’article 22 du PCT un exemplaire de la demande internationale, si celui-ci n’a pas déjà été transmis conformément à l’article 20 du PCT, et, si l’Office des brevets n’agit pas en même temps en tant qu’office récepteur, payer une taxe égale à la taxe de dépôt (art. 166.1) de la loi sur les brevets). Si la demande n’est pas rédigée en langue allemande, il y a en outre lieu de produire dans le même délai une traduction allemande.

3) Une décision sur la poursuite de l’instruction d’une demande internationale selon l’article 25.2)a) du PCT n’est prise par l’Office des brevets que lorsqu’une taxe égale à la taxe de dépôt (art. 166.1) de la loi sur les brevets) a été payée, et, le cas échéant, qu’une traduction allemande de la demande internationale a été produite dans le délai fixé.

4) Si le paiement dans les délais des taxes visées aux alinéas 2) et 3) n’a pas été dûment prouvé (art. 169 de la loi sur les brevets), un délai supplémentaire de deux mois est accordé.

Office élu

17. — 1) Lorsque la République d’Autriche est indiquée selon l’article 31.4)a) du PCT en tant qu’État contractant où le déposant a l’intention d’utiliser les résultants de l’examen préliminaire international et si le déposant n’a pas demandé la délivrance d’un brevet européen, l’Office des brevets est office élu (art. 2)xiv) du PCT) et les alinéas 2) et 3) sont applicables.

2) Lorsque la déclaration d’élection est faite avant l’expiration du 19e mois à compter de la date de priorité, le délai prévu à l’article 39.1)a) du PCT est déterminant pour les actes mentionnés dans l’article 16.2). La présente disposition n’est toutefois pas applicable lorsque le déposant souhaite bénéficier de la faculté prévue à l’article 37.4)b) du PCT.

3) Les rapports d’examen qui ne sont pas rédigés en langue allemande, anglaise ou française doivent être traduits en allemand conformément à l’article 36.2) du PCT.

Administration chargée de la recherche internationale et administration chargée de l’examen préliminaire international

18. — 1) (Disposition constitutionnelle) L’approbation de la nomination de l’Office des brevets en tant qu’administration chargée de la recherche internationale (art. 16.3)b) du PCT) ou qu’administration chargée de l’examen préliminaire international (art. 32.3) du PCT) est donnée par le ministre fédéral du commerce, de l’artisanat et de l’industrie.

2) Après l’entrée en vigueur de la CBE à l’égard de la République d’Autriche, le ministre fédéral du commerce, de l’artisanat et de l’industrie peut donner l’approbation lorsque les conditions de l’alinéa 3) ou du Protocole sur la centralisation sont réunies.

3) (Disposition constitutionnelle) L’exécution autonome de recherches internationales et d’examens préliminaires internationaux selon le PCT en faveur de pays en développement peut être confiée à l’Office des brevets par accord entre le Président de l’Office européen des brevets et le ministre fédéral du commerce, de l’artisanat et de l’industrie.

4) (Disposition constitutionnelle) Les accords à conclure entre le Directeur général de l’Organisation Mondiale de la Propriété Intellectuelle et le ministre fédéral du commerce, de l’artisanat et de l’industrie (art. 16.3)b) et 32.3) du PCT) spécifieront les droits et obligations des parties concernant l’exécution de la recherche internationale et de l’examen préliminaire international, en particulier l’obligation formelle d’appliquer et d’observer les règlements communs de la recherche internationale et de l’examen préliminaire international.

Taxes de recherche internationale et d’examen préliminaire international

19. — 1) La taxe de recherche internationale et d’exécution de toutes les autres tâches confiées par le PCT et son règlement d’exécution aux administrations chargées de la recherche internationale (“taxe de recherche”) est égale à la taxe de recherche selon l’article 57a.1 de la loi sur les brevets.

2) Lorsque la demande internationale ne satisfait pas à l’exigence d’unité (art. 3.4)iii) du PCT), le rapport de recherche internationale est établi sur les parties de la demande internationale qui ont trait à l’invention mentionnée en premier lieu dans les revendications. Pour toute invention supplémentaire ou tout groupe supplémentaire d’inventions liées entre elles de telle sorte qu’elles ne forment qu’un seul concept inventif général, il y a lieu de payer une taxe supplémentaire égale à la taxe de recherche.

3) Lorsque la priorité d’une demande internationale antérieure qui a fait l’objet d’une recherche par l’Office des brevets en tant qu’administration chargée de la recherche internationale est revendiquée pour la demande internationale, la taxe de recherche acquittée est remboursée à raison de 75%, lorsque le premier rapport de recherche peut être utilisé dans sa totalité ou pour l’essentiel pour l’établissement du rapport de recherche internationale. Ils en va de même lorsque la demande internationale se réfère à une recherche de type international antérieure (art. 15.5) du PCT) et que la recherche de type international peut être utilisée dans sa totalité ou pour l’essentiel pour l’établissement du rapport de recherche internationale.

4) La taxe d’examen préliminaire international et d’exécution de toutes les autres tâches confiées par le PCT et son règlement d’exécution aux administrations chargées de l’examen préliminaire aux international (“taxe d’examen préliminaire”) est égale à la taxe de demande d’un avis d’expert selon l’article 57a.2 de la loi sur les brevets, lorsque l’état de la technique est indiqué par le requérant. La taxe échoit en même temps que la taxe d’instruction au profit du Bureau international de l’Organisation Mondiale de la Propriété Intellectuelle.

5) Lorsque l’Office des brevets constate que la demande internationale ne satisfait pas à l’exigence d’unité et qu’il invite le déposant à limiter les revendications ou à payer des taxes supplémentaires, le montant des taxes supplémentaires et leur motif doiventêtre indiqués. Lorsque le déposant limite ses revendications à une invention unitaire ou à un groupe d’inventions, une taxe supplémentaire égale à la taxe d’examen préliminaire est due pour chaque invention supplémentaire ou chaque groupe d’inventions liées entre elles de telle sorte qu’elles ne forment qu’un seul concept inventif général.

6) Le paiement de taxes en vertu des alinéas 1) à 5) n’est réputé effectué que lorsqu’il est dûment prouvé (art. 169 de la loi sur les brevets).

7) La division des recours de l’Office des brevets statue sur les recours contre les décisions prises sur l’opposition d’un déposant contre une taxe supplémentaire fixée par l’Office des brevets selon l’article 17.3)a) ou 34.3)a) du PCT.

Publication et exposition; information du public; droits découlant de la publication

de la demande internationale

20. — 1) Les demandes internationales publiées selon l’article 21 du PCT par le Bureau international de l’Organisation Mondiale de la Propriété Intellectuelle sont, le cas échéant avec les traductions remises à cet effet (art. 21), publiées et exposées par l’Office des brevets jusqu’à la délivrance d’un brevet ou au rejet de la demande de brevet. L’article 101.1)et 3) de la loi sur les brevets est applicable par analogie.

2) Les droits découlant d’une demande internationale publiée selon l’article 21 du PCT sont déterminés en appliquant par analogie les dispositions del’article 4. L’article 158(1) de la CBE n’en est pas affecté.

3) La Gazette du Bureau international de l’Organisation Mondiale de la Propriété Intellectuelle (art. 55.4) du PCT) et des demandes internationales publiées sont soumises à l’inspection publique auprès de l’Office des brevets.

4) Il est tenu des registres des demandes internationales qui permettent une information rapide et exacte du public sur ces demandes.

Dispositions communes

Conditions de forme de la traduction

21. Les conditions de forme auxquelles doit satisfaire la traduction ou sa correction à produire par le déposant en vertu de la présente loi fédérale seront réglées plus en détail par arrêté du Président de l’Office des brevets. Lors de la promulgation de cet arrêté, il y aura lieu de tenir compte des considérations d’opportunité et de simplification, ainsi que des exigences de la publication de la traduction. La légalisation ne peut pas être exigée.

Taxes de publication des traductions

22. — 1) La publication des traductions prévues par la présente loi fédérale ou de leurs corrections donne lieu au paiement d’une taxe de publication.

2) La taxe de publication s’élève à 1600 schillings, plus 350 schillings par page à compter de la sixième page de traduction déposée ou de correction ainsi que 350 schillings par page à compter de la troisième page de dessins. L’article 166.10) de la loi sur les brevets est applicable.

3) Le paiement de la taxe de publication n’est pas réputé avoir été effectué tant qu’il n’a pas été dûment prouvé (art. 169 de la loi sur les brevets).

Compétence pour instruire des affaires; examinateurs de forme

23. — 1) La compétence d’instruire les demandes de brevet européen, les demandes internationales et les brevets européens est déterminée, dans le mesure où la présente Loi fédérale n’en dispose pas autrement, en appliquant par analogie la loi sur les brevets (de la loi sur les brevets).

2) Des employés qui ne sont pas membres de l’Office des brevets peuvent être autorisés, par arrêté du Président de l’Office des brevets, à instruire des affaires d’un genre déterminé, indiquées spécifiquement, en ce qui concerne des demandes de brevet européen et des demandes internationales de brevet ainsi que des brevets européens, en particulier à procéder à l’examen de forme, dans le mesure où cela est approprié en raison de la simplicité de l’instruction et où la formation de ces employés (examinateurs de forme) offre une garantie pour une instruction régulière. Les examinateurs de forme sont liés par les directives du membre compétent de l’Office des brevets d’après la répartition des tâches. Celui-ci peut en tout temps se réserver l’instruction d’une affaire ou s’en ressaisir.

3) L’article 76.1), 4) et 5) de la loi sur les brevets est applicable par analogie aux examinateurs de forme.

4) Les décisions des examinateurs de forme peuvent être attaquées de la même manière que celles du membre compétent de l’Office des brevets. Le membre compétent peut lui- même donner suite au recours; s’il estime qu’il n’y aurait pas lieu d’y donner suite ou qu’il n’y aurait lieu d’y donner suite que partiellement, il doit soumettre le recours à la division des recours en en indiquant les motifs dans son rapport.

Application complémentaire de la loi sur les brevets

24. Les dispositions de la loi sur les brevets sont applicables par analogie, à titre de complément aux dispositions de la CBE, du PCT et de la présente loi fédérale, aux demandes de brevet européen, aux demandes internationales et aux brevets européens, ainsi qu’aux procédures concernant ces droits de protection.

Dispositions finales et transitoires

Entrée en vigueur

25. La présente loi fédérale entre en vigueur, en ce qui concerne les demandes de brevet européen et les brevets européens, au moment de l’entrée en vigueur de la CBE à l’égard de la République d’Autriche (art. 169 de la CBE), et, en ce qui concerne les demandes internationales, au moment de l’entrée en vigueur du PCT à l’égard de la République d’Autriche (art. 63 du PCT).

Abrogations et dispositions transitoires

26. — 1) (Disposition constitutionnelle) La présente loi fédérale cessera d’être en vigueur :

1. en ce qui concerne les demandes selon la CBE, lorsque la CBE cessera d’être en vigueur à l’égard de la République d’Autriche;

2. en ce qui concerne les demandes selon le PCT, lorsque le PCT cessera d’être en vigueur à l’égard de la République d’Autriche.

2) L’article 175 de la CBE n’en est pas affecté.

3) L’article 66.2) du PCT n’en est pas affecté.

Exécution

27. Le Gouvernement fédéral est chargé de l’exécution de la présente loi fédérale dans la mesure où elle n’incombe pas, selon la loi sur les ministères fédéraux de 1973 (Bundesministeriengesetz) publiée dans le Journal officiel n° 389/1973, au ministre fédéral du commerce, de l’artisanat et de l’industrie et au ministre fédéral des affaires étrangères.

Der Nationalrat hat beschlossen:

Begriffsbestimm ungen

§ 1. In diesem Bundesgesetz bedeuten 1. "EPü" das am 5. Oktober 1973 in Mün-

chen abgeschlossene übereinkommen über die Erteilung europäischer Patente (Europäisches Patentübereinkommen) ;

2. "ZentraEsierungsprotokoll" das Protokoll über die Zentralisierung des europäischen F.atent- systems und seine Einführung, das gemäß Art. 164 EPü Bestandteil dieses übereinkom- mens ist;

3. "PCT" ,den am 19. Juni 1970 in Washing- ton abgeschlossenen Vertrag über die internatio- nale Zusammenarbeit auf dem Gebiet des Patent- wesens;

4. "europäische Patel1tanmeldung" eine auf Grund des EPü eingereichte AnmeMl\lng, in der die Republik österreich als Vertragsstaat be- nannt und .demgemäß in diesem Staat für die Erfindung Schutz begehrt wird;

5. "europäisches Patent" ,ein Patent, das auf Grund des EPü für die Republik österreich als benannten Vertragsstaat erteilt wurde;

6. ",internationale Anmeldung" eine auf Grund des PCT getätigte Anmeldung, .in der die Repu- blik österreich als Vertragsstaat bestimmt und demgemäß ,in diesem Staat Schutz für die Erfin- dung auf Grundlage der ·internationalen Anmel- dung begehrt wird;

7. "PatG" das Patentgesetz 1970, BGBI. Nr. 259/1970, in der jeweils geltenden Fassung.

Patentanmeldungen und Patente auf Grund des EPü

Einreichung beim österreichischen Patentamt

§ 2. P.atentanmeldungen auf Grund ·des EPü können, abgesehen von den in Art. 75 A:bs. 1

lit. a EPü vorgesehenen EinreichungssteIlen, beim österreichischen Patentamt in einer der nach Art. 14 EPü zulässigen Sprache eingereicht werden, wenn zumindest die in Art. 80 lit. a bis c EPü bezeichneten Angaben ,in deutscher, englischer oder fra·nzösischer Sprache abgefaßt sind. Anmddungen, die diesen Voraussetzungen nicht entsprechen, gelten als nicht eingereicht.

Bekanntmachung und Auslegung; Unterrich- tung der öffentlichkeit

§ 3. (1) Gemäß Art. 93 EPü veröffentlichte europä;ische F.atentanmeldungen sind samt hiezu eingereichten übersetzungen (§ 4 Abs. 2) bis zur Erteilung eines europäischen Patentes oder bis zum Untergang der europäischen Patenta.nmel- dung vom österreichischen Patentamt auszule- gen. Im österreichischen P,atentblatt ist ein Hin- weis darauf zusammen mit der Angabe der Sprache >bekanntzumachen, !in der die europäische Patentanmeldung abgefaßt ist. § 101 Abs. 1 und 3 PatG gilt sinngemäß.

(2) Das Europäische P.atentblatt, die veröffent- lichten europäischen Patentanmeldungen und die europäischen Patentschriften sind im öster- reichischen Patentamt zur allgemeinen Einsicht zur Verfügung zu halten.

(3) über europäische PatentanmeIdun,gen und europäische Patente sind Verzeichnisse zu füh- ren, die .eine rasche und zuverlässige Unterrich- tung der öffentlichkeit über diese Schutzrechte ermöglichen.

Rechte aus der europäischen Patentanmeldung nach ihrer Veröffentlichung; übersetzung

§ 4. (1) Die europäische Patentanmeldung gibt dem Anmelder vom Tag ihrer Veröffentlichung gemäß Art. 93 EPü an einstweilen gegen denje- nigen einen Anspruch auf eine den Umständen ·ang·emessene Entschädigung, 'derden Gegenstand ·der Anmeldung unbefugt benützt hat (§ 22 ~bs. 1 PatG). Der europäischen Anmeldung w,ird der Schutz nach Art. 64 EPü nicht ge- währt.

(2) Ist die europäische Patentanmeldung nicht in deutscher Sprache veröffentlicht worden, so

besteht der Anspruch gemäß Abs. 1 erst von dem Tag an, an dem eine vom Anmelder einge- reidlte übersetzung der Patentansprüche ins Deutsche vom österreichischen Patentamt nach Entrichtung der Veröffentlichungsgebühr (§ 22) in sinngemäßer Anwendung des § 3 Abs. 1 veröffentlicht oder dem Benützer d-es Gegenstan- des der Anmeldung übermittelt worden ist.

§ 5. (1) Wird die europäische Patentschrift nicht in deutscher Sprache herausgegeben, so ist innerhalb von sedlS Monaten nach dem Beginn der für die Einzahlung der Erteilungsgebühr und der Druckkostengebühr (Art. 97 Abs. 2 lit. b EPü) vorgesehenen Fr.ist beim österreichischen Patentamt eine übersetzung der Patentschrift ins Deutsche einzureichen und eine Veröffent- lichungsgebühr (§ 22) zu bezahlen. Das öster- reichische Patentamt veröff-entLicht die überset- zung in Form einer Druckschr-ift.

(2) Abs. 1 ist s,inngemäß auf die Vorlage der übersetzung der durch die Entscheidung der Einspruchsabteilung geänderten Fassung der europäischen Patentschrift (Art. 102 Abs. 3 EPü) anzuwenden.

(3) Werden .gemäß Abs. 1 oder 2 erforderliche übersetzungen nicht fristgerecht beim öster- reichischen Patentamt eingereicht, werden Form- gebrechen der übersetzung (§ 21) trotz Auf- forderung nicht innerhalb der zu ihrer Behe- bung gesetzten Frist behoben oder wird die Ent- richtung der Gebühr nicht ordnungsgemäß (§ 168 Ahs. 3 PatG) innerhalb der zur Nachreichung der Belege eingeräumten Fr-ist nachgewiesen, so gelten die Wirkungen des europäisdlen Patentes als von Anfang an nicht eingetreten. In der Auf- for.derung zur Nachreichung der Belege ist der zu zahlende Betr,ag anzugeben.

Verbindliche Fassung einer europäischen Patent- anmeldung und eines europäischen Patentes; Be-

richtigung der übersetzung

§ 6. (1) Ist nach ,den §§ 4 oder 5 eine über- setzung ins Deutsche vorgeschrieben, so richtet sich ,der Schutzbereich der europäischen Patent- anmeldung oder des europäischen Patentes nach dieser übersetzung, sofern der sich aus der über- setzung ergebende Schut~bereich enger ist als der Schutzbereich .in der Verfahrenssprache. Dies gilt jedoch nicht für das Verfahren auf Nichtigerklärung oder Aberkennung des Pa- tentes.

(2) Der AnmeLder eines europäischen P,aten- tes oder dessen Inhaber kann die Berichtigung der übersetzung beantragen. Sie wird mit dem Tag wirksam, an dem sie vom österreichischen Patentamt nach Entrichtung der Veröffentli- chungsgebühr (§ 22) veröffentlicht worden ist.

(3) Die Berichtigung wird bei Patentanmc,- dungen durch Auslegung in der Auslegehalle des österreichischen Platentamtes (§ 3 Abs. 1), bei Patenten durch Herausgabe einer Druckschnift veröffentlicht.

(4) Im österreichischen Patentblatt ist t!1I1 Hinweis auf die Berichtigung zu veröffentlichen.

(5) Beruft sich jemand auf den engeren Schutz- bereidl der deutschen übersetzung einer ver- öffentlichten Patentanmeldung, so wird die Be- richtigung ihm gegenüber auch dann wirksam, wenn der Anmelder ihm die berichtigte deutsche übersetzung übermittelt hat.

(6) Die Wirkung der Berichtigung tritt gegen denjenigen nicht ein, der vor ihrem Wirks-am- werden den Gegenstand der europäischen Patent- anmeldung oder des europäischen Patentes in gutem Glauben im Inland in Benützung ge- nommen oder die zu solcher Benützung erfor- derlichen Veranstaltungen getroffen hat (Zwi- schenbenützer). Die Rechte -des Zwischenbe- nützers richten sich nach den sinngemäß anzu- wendenden Bestimmungen des § 23 Abs. 2 bis 4 PatG. Besteht hinsichtlich des von der Berich- tigung erfaßten Schutzbereidles ein vor der Be- richtigung abgeschlossener Lizenzvertrag und w-ird das Recht des Lizenznehmers durch die Berichtigung beeinträchtigt, so kann der Lizenz- nehmer eine den Umständen des F,alles ange- messene Minderung des bedungenen Entgeltes verl'angen oder den Vertrag auflösen, wenn für ihn wegen dieser Beeintdichtigung an der wei- teren Erfüllung des Vertrages kein Interesse be- steht.

Patentregister

§ 7. Eintragungen zu europäischen Paten- ten sind in einen besonderen Teil des Patentre- gisters (§ 80 PatG) vorzunehmen und haben dieselbe Wirkung wie Eint1'1agungen im übrigen Teil des Registers.

An das österreichische Patentamt zu zahlende Jahresgebühren

§ 8. (1) Für europäische P,atente sind für die an das ~n Art. 86 Abs. 4 EPü genannte Jahr an- schLießenden Jahre Jahresgebühren an das Öster- reichische Patentamt zu zahlen.

(2) Die Höhe der gemäß Abs. 1 an das Öster- reichische Patentamt zu entrichtenden Jahresge- bühren bestimmt Slich nach § 166 Abs. 3 PatG, jedoch m.it folgenden Xnderungen:

1. Für das dritte Jahr der Laufzeit des euro- päischen Patentes ist die Jahresgebühr für 'das erste Jahr unter Ausschluß von zuzüg- lichen Beträgen für Seiten der Beschreibung und Blätter der Zeichnungen zu zahlen.

2. Für das vierte bis zwanzigste Jahr der Lauf- zeit des europäischen Patentes sind jeweils Jahresgebühren für das zweite bis achtzehnte Jahr zu zahlen.

(3) Die Jahresgehühren werden jeweils für das konimende Jahr am letzten Tag des Monats fällig, der durch seine Benennung dem Monat entspricht, in den der Anmeldetag fällt.

(4) Die Jahresgebühren können frühes'tens drei Monate vor ihrer Fälligkeit entrichtet werden. Die erste an das österreichische P,atentlamt zu entr,ichtende Jahresgebühr ist innerha'lb eines Jahres, die weiteren Jahresgebühren sind inner- halb von sechs Monaten nach FäHigkeit zu ent- richten.

(5) Bei Zahlung n2ch Fälligkeit ist neben der Jahresgebühr ein Zuschlag von 20 vom Hun- dert zu entrichten. Dieser Zuschlag entfällt bei der ersten an das österreichische Patentamt zu entrichtenden Jahresgebühr, wenn sie innerhalb von drei Monaten nach Fäll~gkeDt eingezahlt wird.

(6) Die Jahresgebühren können von jeder an dem Patent interessierten P,erson eingezahlt werden.

(7) Noch nicht fäHige Jahresgebühren sind dem Binzah'ler zurückzuerstatten, wenn auf das Patent verzichtet wird oder wenn das Patent sonst vor Fälligkeit in Wegfall kommt.

Umwandlungsantrag

§ 9. (1) Auf Antrag des Anme1ders einer europäischen Pat:entanmddung leitet das öster- reichische Patentamt das Verfahren zur Ertei- lung eines Patentes ein, wenn die europäische Patentanmeldung nach Art. 77 Abs. 5 oder Art. 162 Abs. 4 EPü lais zurückgenommen gilt.

(2) Ist der Umwandlungsantragdem öster- reichischen Paten.tamt übermittelt worden oder, wenn ·der Antrag beim österreichischen Patent- amt zu steLlen war, ,dort eingereicht worden, so ist der AntragSiteller mit Vorbescheid (§ 99 PatG) aufzufordern, innerhalb einer Frist von drei Mo- nat,en

a) die Anmeldegebühr (§ 166 Abs. 1 PatG) zu bezahlen und erforderlichenfalls

b) eine Übersetzung der europä'ischen Patent- anmeLdung ,ins Deutsche einzureichen, und zwa:r inder ursprünglich eingereichten F.assung sowie gegebenenfalls in einer ge- änderten Fassung, die der Anmdder dem Enteilungsverfahren vor dem österreichi- schen Patentamt zugrun1de zu legen wünscht.

(3) Bei vorschriftsmäßig umgewandelten Pa- tentanmeldungen gilt der Anmeldetag der euro-

pällschen PateIlitanmeldung als Tag der Anmel- dung im Sinne des § 87 Abs. 2 PatG.

(4) Für das auf die umgewandelte Patentan- meldung erteilte Patent sind Jahresgebühren nach § 166 PatG zu bezahlen. Jedoch erlischt das Pa:tent, unbeschaJdet der Bestimmung des § 46 Abs. 1 Z. 1 PanG. jedenfalls nach zwanzig Jah- ren vom Anmeldetag an.

Nichtigkeitsgründe

§ 10. (1) Europäische Patente können aus den im Art. 138 Abs. 1 lit. abis d EPü vorgesehenen Gründen ruichtig erklärt und aus dem im Art. 138 Abs. 1 lit. e EPü vorgesehenen Grund aberkannt wel'lden.

(2) Insoweit und solange ein Vorbehalt öster- reichs gemäß Art. 167 Abs. 2 lit. a EPü wirk- sam ist, können europäische Patente nichtig er- klärt wenden, soweit sie Schutz für chemische Erzeugnisse als solche oder für Nahrungs- oder Arzneimittel als solche gewähren, es sei denn, das Patent betr·ifft ein Verf.ahren zur Herstellung oder Verwendung eines chemischen Erzeugnisses ader ein VerJahren zur Herstellung eines Nah- rungs- ader Arzneimittels.

(3) Das europäische Patemt ~ann ferner nich- tig erklärt werden, wenn sich ergibt, daß die Erfindung Gegenstand eines älteren österreichi- schen Patentes ist.

Unterbrechung des Anfechtungsverfahrens

§ 11. (Verf.assungsbestimmung) Ein vor derr_ österreichischen Patentamt anhängiges Verfah- ren auf Nichtigerklärung eines europäischen Pa- tentes ,ist von Amts wegen insoweit zu unter- brechen, als ein dieselbe Sache betreffendes Ein- spruchsverBahren (Art. 99 EPü) vor dem Euro- päischen Patentamt anhängig ist oder anhängig gemacht wird. Das unterbrochene Verfahren ist nach rechtskräftigem Abschluß des Einspruchs- verfahrens auf Antrag fortzusetzen, wenn vom Europäischen Patentamt eine Entscheidung in der Sache selbst nicht geHllt wurde. Verletzungsklagen

§ 12. Ist ein Verfahren über eine Verletzungs- klage gemäß § 156 Abs. 3 PatG unterbrochen wOl"den, kann der BekLagte anstelle des Nach- weises, daß er beim österreichischen Patentamt einen Nichtigkeitsantrag eingebracht hat, daß ein Nichtigkeitsverfahren zwischen den Streit- teilen bereits anhängig ,ist oder daß er sich einem solchen Verfahren als N cbenintervenient ange- schlossen hat, den Nachweis erbringen, daß er gegen ·das europäische Patent beim Europäischen Patentamt Einspruch (Art. 99 EPü) eingelegt

hat oder sonst Bartei eines bereits zwischen den Streitteilen anhängigen, gegen das europäische Patent gerichteten Einspruchsverfahrens ist.

Ergänzende Recherche des österreichischen Pa- tentamtes

§ 13. (1) Jedermann kann beim Österreichi- schen P,atentamt den Antrag auf Durchführung einer er.gäozenden Recherche zu einer veröffent- lichten europ;iischen Patentanme!dung oder zu einem europäischen Patent stellen. Die Recherche hat sich auf jene österreichischen Patentschriften zu erstrecken, die im Prüfstoff des Europäischen Patentamtes nicht entha!lten sind, und hat vom österreichischen Patentamt enteilte Patente zu ermitteln, die gegenüber der europäischen Pa- tentanme1dung oder dem europäischen Patent einen älteren Anmeldetag aufweisen.

(2) Im Patentregister ist die Durchführung einer ergänzenden Recherche anzumerken. Jeder- mann kann in den Recherchenbericht Einsicht nehmen.

(3) Der Antrag auf Erstellung des Recherchen- berichtes unterJ,iegt einer Gebühr im Ausmaß der Anmeldegebühr (§ 166 Abs. 1 PatG). § 168 Abs. 3 und 4 PatG findet Anwendung.

§ 14. (Verfassungsbestimmung) In Verträgen betrefferud die Bearbeitung europäischer Patent- anmeldungen durch das Österreichische Patent- amt, die gemäß Abschnitt IV NI". 1 und 2 des Zent1"aJ,isierungsprorokolles zwischen dem Prä- sidenten des Europäischen Patentamtes und dem Bundesminister Hir Handel, Gewerbe und In- dustrie abgeschlossen werden, können insbeson- dere die Am, der Ursprung und die Anzahl der europä'ismen Patentanmeldungen, die bearbeitet werden sollen, der Zeitraum der übertragung, das Verf.ahren zur Feststellung der dem Öster- reichischen Patentamt für .die Bearbeitung der europäischen Patentanmeldungen zu ersetzen- den Kosten urud die Verpflichtung des Öster- reichischen Patentamtes festgelegt we1"den, die Richtlinien des Europäischen Patentamtes für europä~sche Recherchen und Prüfungen 'zu be- achten.

Anmeldungen auf Grund des peT

Anmeldeamt

§ 15. (1) Für Anmelder, die österreichische Sta;vtsbürger sind oder ihren Wohnsitz (Sitz) in der Republik Österreich haben, ist dras Öster- reichische P;atentamt Anmeldeamt im Sinne des Art. 10 peT. Die Anmeldungen sind in deut- scher Sprache einzureichen. PI'ioritä,ten können

auch auf Grund von Anmeldungen nach dem PatG beansprucht werden.

(2) Für jede Anmeldung gemäß Abs. 1 ist spä- testens am Tag ihrer Einreichung eine über- mittlungsgebühr in der Höhe der Anmeldege- bühr (§ 166 .Albs. 1 Pa-tG) zu zahlen. § 168 Abs. 3 und 4 PatG .ist sinngemäß anzuwenden.

Bestimmungsamt

§ 16. (1) Das österreichische Patentamt ist für internationale Anmeldungen Best~mmungsamt, es sei denn, ,der Anmelder hat die Erteilung eines europ;iischen Patentes <beantragt.

(2) Ist das österreichische Patentamt Bestim- mungsamt, so hat der Anmelder innerhalb von 20 Monaten seit dem Prrioritäwdatum ein Exem- plar der internationalen Anmeldung einzureichen und, wenn ,da-s Österreichische Patentamt nicht zugleich Anmeldeamt ist, eine Gebühr ,in der Höhe der Anmeldegebühr (§ 166 Abs. 1 PatG) zu zahlen. Ist die Anmeldung nicht in deutscher Sprache abgefaßt, so ,ist ferner innerhalb der gleichen Frist eine übersetzung ins Deutsche ein- zureichen.

(3) Eine Entschei'dung über die Weiterbehand- lung einer internationalen AnmeLdung gemäß Art. 25 Ahs. 2 Lit. a peT ist vom Österreichischen Patentamt nur zu treffen, wenn fristgerecht eine Gebühr in der Höhe der Anmeldegebühr (§ 166 Abs. 1 PatG) gezahlt und gegebenenfalls eine übersetzung ,der internationalen Anmddung ins Deutsche eingereicht wird.

(4) Zur Nachreichung von Belegen über Ge- bührenzahlungen gemäß Abs. 2 und 3 ist eine Nachfrist von zwei Monaten zu setzen. § 168 Abs. 3 PatG findet Anwendung.

Ausgewähltes Amt

§ 17. (1) Wird in der internationalen An- meldung die Republik Österreich gemäß Art. 31 Abs. 4 lit. a peT als v.ertragsstaat angegeben, in dem der Anmelder die Ergebnisse der interna1Jio- nalen vorläufigen Prüfung verwerten will, und hat er ,die Erte.ilung eines europäischen Patentes nicht beantragt, ist ,das Österreichische Patent- amt au~gewähltes Amt (Art. 2 lit. xiv peT), und es finden Abs. 2 und 3 Anw.endung.

(2) Wird die Auswahlerklärung vor Ablauf des 19. Monats seitdem Prioritä~sdatum vorgenom- men, so verlängert sich die im § 16 Abs. 2 vor- gesehene Frist von 20 Monaten auf 25 Monate. Dies gilt jedoch nicht, wenn der Anmelder die Begünsnigung des Art. 37 Abs. 4 lit. b peT in Anspruch nehmen will.

(3) Prüfungsberichte, die nicht in deutscher, englischer oder französischer Sprache abgefaßt sind, sind gemäß Art. 36 Abs. 2 peT ins Deutsche zu übersetzen.

§ 18. (1) (Verfassungbestimmung) Die Zustim- mung zur Einsetzung des österreich.ischen Patent- amtes als Internationale Recherchenbehör·de (Art. 16 Abs. 3 lit. b peT) oder als mit der internationalen vorläufigen Prüfung beauftragten Behörde (Art. 32 .A:bs. 3 peT) erteilt der Bun- desminister für Handel, Gewerbe und Industrie.

(2) Nach dem Inkrafttreten des EPü für die Republik österreich kann der Bundesminister für Handel, Gewerbe und Industrie die Zu- stimmung erteilen, wenn die Voraussetzungen nach Abs. 3 oder nach dem Zentralisierungspro- tokoll gegeben sind.

(3) (Verfassungsbestimmung) In einem Vertrag zwischen dem Präsidenten des Europäischen Patentamtes und dem Bundesminister für Handel, Gewerbe und Industrie kann dem österreichi- schen P,atentamt die selbständig.e Durchführung von internat:ionalen Recherchen und internatio- nalen vorläufigen Prüfungen nach dem peT 2JU- gunsten von Entwicklungsländern übertragen werden.

(4) (Verfassungsbestimmung) In den zwischen dem Generaldirektor der Weltorganisaüion für geistiges Eigentum und dem Bundesminister für Handel, Gewerbe und Industrie abzuschließen- den Verträgen (Art. 16 Abs. 3 lit. b und Art. 32 Abs. 3 peT) sind die die Durchführung der internationalen Recherche und der internatio- rualen vorläufigen Prüfung betreffenden Rechte und Pflichten der Vertrag'5parteien, insbesondere die ausdrückliche Verpflichtung zur Anwendung und Beachtun,g der gemeinsamen Regeln für die Durchführung internationaler Recherchen und internationaler vorläufiger Prüfungen, festzule- gen.

Gebühren für die internationale Recherche und die internationale vorläufige Prüfung

§ 19. (1) Die Gebühr für die Durchführung der internationalen Recherche und aller lan:deren Aufgaben, die internationalen Recherchenbehör- den durch den peT und seine Ausführungsord- nung übertragen wenden ("Recherchengebühr"), entspricht der Gebühr für den Antrag auf Durchführung einer Recherche gemäß § 57 Abs. 2 lit. a PatG.

(2) Ist die ~nternationale Anmeldung nicht ein- heitlich (Art. 3 Abs. 4 lit. üi peT), so ist der internationale Recherchenbericht für die Teile der internationalen Anmeldung zu erstellen, die sich auf die in den Ansprüchen zuerst erwähnte Erfindung beziehen. Für jede weitere Erfindung oder Gruppe von Erfindungen, die so zusammen- hängen, daß sie eine einzige allgemeine erfinde-

(3) Wird für die internationale Anmeldung die Priorität einer früheren internationalen An- meldung in Anspruch genommen, die vom österreichischen Partentarnt als Intemationale Rech·erchenlbehörde recherchiett worden ist, so ist .die geleistete Recherchengebülhr im Ausmaß von 75 vom Hundert zu erstatten, wenn der erste Recherchentbericht ganz oder zum wesent- lich überwiegenden Teil bei der Erstellung des internationalen Recherche!llberichtes verwendet werden kann. Gleiches gilt, wenn im Antrag der internationalen Anmeldung auf eine frühere Re- cherche internationaler Art (Art. 15 Abs. 5 peT) Bezug genommen wurde und die Recherche internationaler Art bei der Erstellung des inter- nationalen Recherchenberichtes ganz oder zum wesentlichen überwiegenden Teil verwendet wer- den kann.

(4) Die Gebühr für die Durchfuhrung der internationalen vorläufigen Prüfung und aller anderen Au~gaben, die mit der internationalen vorläufigen Prüfung beauftra~en Behörden durch den peT und seine Ausführungsordnung übertragen werden ("Gebühr für die vorläufige Prüfung"), entspricht der Gebühr für den An- trag auf Erstattung eines Gutachtens gemäß § 57 Abs. 2 lit. b PatG, wenn der Stand der Technik vom Antragsteller bekannt,gegeben wird. Die Ge- bühr wird gleichzeitig mit der zugunsten des Internationalen Büros der Weltorganisation für geistiges Eigentum zu zahlenden Bearbeitungs- gebühr fällig.

(5) Stellt das österreichische Patentamt fest, daß die internationale Anmeldung nicht einheit- lich ist und fOl"dert es den Anmelder zur Ein- schränkung ·der Ansprüche oder zur Zahlun,g zu- sätzlicher Gebühren auf, so sind die Höhe der zusätzlichen Gebühren und die Gründe hiefür anzugeben. Schränkt der Anme1der seine An- sprüche auf eine einheitliche Erfindung oder Gr1uppe von Erfindungen ein, so ist für jede weitere Erfindung oder Gruppe von Erfindun- gen, die so ,zusammenhängen, daß sie eine ein- zige aHgemeine erfinderische Idee verwirklichen, eine zusätzEehe Gebühr in der Höhe der Gebühr für die vOl"läufi,ge Prüfung zu bezahlen.

(6) Die Entrichtung von Gebühren gemäß den Abs. 1 bis 5 gilt erst als erfolgt, wenn sie gemäß § 168 Abs. 3 PatG nachgewiesen ist.

(7) über Rech,tsmittel gegen Entscheidungen über den Widerspruch eines Anme1ders gegen eine vom österreichischen Patentamt nach Art. 17 Albs. 3 lit. a peT oder nach Art. 34 Atbs. 3 lit. a peT festgesetzte zusätzliche Gebühr entscheidet die Beschwer.deabteilung des öster- reichischen Patentamtes.

§ 20. (1) Internationale Anmeldungen, die vom Internationalen Büro der Weltor.ganisation für geistiges Eigentum gemäß Art. 21 peT ver- öffentlicht werden, sind, gegebenenfalls samt den hiezueingereichten übersetzungen (§ 21), bis zur Erteilung eines Patentes oder his zum Untergang der Patentanmeldung vom Öster- reichischen Patentamt bekanntzumachen und auszulegen. § 101 Abs. 1 und 3 PatG gi'lt sinn- gemäß.

(2) Die Rechte aus einer gemäß Art. 21 peT veröffentlichten internationalen Anme1dung rich- ten sich nach der sinngemäß anzuwendenden Be- stimmung des § 4. Hiedurch wird Art. 158 Abs. 1 EPü nicht berührt.

(3) Das Blatt des Internationalen Büros der Weltorganisation für geistiges Eigentum (Art. 55 Abs. 4 peT) und die veröffentlichten interna- tionalen Anmeldungen sind im österreichischen Patentamt zur allgemeinen Einsicht zur Verfü- gung zu halten.

(4) über internationale Anmeldungen sind Verzeichnisse zu führen, die eine rasche und zu- verlä·ssige Unterrichtung der öffentlichkeit über diese Anmeldun,gen eI1möglichen.

Gemeinsame Bestimmungen

Formale Erfordernisse der Übersetzung

§ 21. Durch Verordnung des Präsidenten des österreichischen Patentamtes sind die formalen Erfordernisse einer vom Anmelder nach diesem Bundesgesetz einzureichenden übersetzung oder ihrer Berichtigung näher zu regeln. Bei Erlas- sung dieser Verordnun,g ist auf möglichste Zweckmäßigkeit und Einfadlheit sowie auf die Erfordernisse der vorgesehenen Art der Ver- öffentlichung der übersetzung Bedacht rz.u neh- men. Eine Beg1auhigung kann nicht gefordert werden.

Gebühren für die Veröffentlichung von Über- setzungen

§ 22. (1) Für jede in diesem Bundesgesetz vor- gesehene Veröffendichung einer übersetzung oder ihrer Berichtigung ist eine Veröffent- lichungsgebühr im Ausmaß der Jahres,gebühr für das erste Jahr (§ 166 Abs. 3 PatG) zu ent- richten.

(2) Bei der GebührenbemesS'ung treten dabei an die Stelle der sechsten und jeder folgenden Seite der zur A,uslegung gelangenden Beschrei- bung und des dritten und jedes fo~genden Blat- tes der dieser BesCt~reibung angeschlossenen Zeichnungen die entsprechenden Seiten und

Blätter der eingereidlten übersetzung. § 166 Abs. 10 PatG ist anzuwenden.

(3) Die Zahlung der Veröffentlichungsgebühr ist ,gemäß § 168 Abs. 3 PatG nachzuweisen. Die Veröffentlichungsgebühr gilt erst nadl Erbrin- gung dieses Nachweises als entrichtet.

Zuständigkeit für Erledigungen; Formalprüfer

§ 23. (1) Die Zuständigkeit f.ür Erled~gungen hei europäischen und internationalen Patentan- meldungen sowie bei europäischen Patenten rich- tet sich, sofern in diesem Bundesgesetz nidn anders verfügt, nach den sinngemäß anzuwen- denden Bestimmungen des PatG.

(2) Durch Verordnung des Präsidenten .des österreichischen Patentamtes können Bedien- stete, die nicht Mitglieder des Patentamtes sind, zur Besorgun,g von der Art nach bestimmt zu hezeidlllenden Angelegen'heiten europäischer und in~ernationaler Patentanmeldungen, insbeson- dere der Formalprüf.ung, ermächtigt wer.den, sofern dies wegen der Einfachheit der Erled~gung zwed"mäßig ist und .die Ausbil.dung dieser Be- diensteten (Formalprüfer) Gewähr für ordnungs- gemäße Erledigung bietet. Die Formalprüfer sind an die Weisungen des nach der Gesdläftsver- teilung z·uständigen Mitgliedes des österreichi- schen Patentamtes gebunden. Dieses kann die Er- ledigung jederzeit sich vorbehalten oder an sich ziehen.

(3) § 76 Albs. 1, 4 und 5 PatG ist auf die For- maI'prüfer sinngemäß anzuwenden.

(4) Die Besmlüsse der Formalprüfer können wie .die des zuständigen Mitgliedes des Patent- amtes angefoch,ten werden. Das zuständ~g·e Mit- glied kann dem Redltsmittel selbst stattgeben; ist es der Ansicht, ·daß dem Rechtsmittel nicht oder nur teilweise Folge zu geben wäre, so hat es das Rechtsmittel der Besdlwerdeabteilung vor- zu'legen und im Vorlagebericht die Gründe hie- für anzugeben.

Ergänzende Anwendung des PatG

§ 24. Auf europäische und in·ternationale Pa- tentanmeldungen sowie auf europäische Patente und auf Verfa'hren, die diese Schutzrechte betref- fen, sind ergänzend zu den Bestimmungen des EPü, des peT und dieses Bundesgesetzes die Vorschriften des PatG sinngemäß anzuwenden.

dem Inkrafttreten des EPü für die Republik österreich (Art. 169 EPü), hinsichtlich interna- tionaler Anmeldungen mit dem Inkrafttreten des peT für die Republik österreich (Art. 63 peT) in Kraft.

Außerkrafttreten und Übergangsbestimmungen

§ 26. (1) (Verfassungsbestimmung) Dieses Bun- desgesetz tritt

1. für Anmeldungen nach dem EPü mit dem Außerkrafttreten des EPü für die Repu- blik österreich außer Kraft;

(2) Art. 175 EPü bleibt unberührt. (3) Art. 66 Abs. 2 peT bleibt unherührt.

Vollziehung

§ 27. Mit der VoHziehung dieses Bundesge- setzes ist die Bundesregierung betraut, soweit sie nicht gemäß dem Bundesministeriengesetz 1973, BGBI. Nr. 389, dem Bundesminister für Han- del, Gewerbe und Industrie und dem Bundes- minister für Auswärtige Angelegenheiten ob- liegt.

BUNDESGESETZBLATT FÜR DIE REPUBLIK ÖSTERREICH

Der Bezugspreis des Bundesgesetzblattes für die Republik Österreich beträgt vorbehaltlich allfälliger Preiserhöhungen infolge unvorhergesehener Steigerung der Herstellungskosten bis zu einem Jahresumfang von 2000 Seiten S 500,-, inklusive 8 %Umsatzsteuer, für Inlands- und S 590,- für Auslandsabonnements. Für den Fall, daß dieser Umfang überschritten wird, bleibt für den Mehr- umfang eine entsprechende Neu berechnung vorbehalten. Der Bezugspreis kann auch in zwei gleichen Teilbeträgen zum 1. Jänner und 1. Juli entrich- tet werden.

Bezugsanmeldungen werden von der AbonnementsteIle des Verlages der Österreichischen Staatsdruckerei, 1037 Wien, Rennweg 12 a, Tel. 72 61 51-58/ 294 Durchwahl, entgegengenommen.

Als Bezugsanmeldung gilt auch die Überweisung des Bezugspreises oder seines ersten Teilbetrages auf das Postscheckkonto Wien Nr. 5780.002. Die Bezugs- anmeldung gilt bis zu einem allfälligen schriftlich6!n Widerruf. Der W ider ruf istnurmitWirkungfürdas Ende des Kalenderjahres möglich. Er muß, um wirksam zu sei~, spätestens am 15.
