The notification by the Philippines to the WTO under article 63.2 of TRIPS states:
'The Revised Rules of Civil Procedure provide for the rules concerning the protection and enforcement of civil rights (Rules 1-56), and provide for the procedures in all courts involving civil action and provisional remedies (Rules 57-71).
Rule 57 sets out the procedure and requisites for the availment of the writ of preliminary attachment.
Rule 58 sets out the procedures and requisites for the availment of the writ of preliminary injunction.
Rule 141 sets out the amount of filing fees in court.'
The Rules of Civil Procedure are the first of four parts of the Rules of Court of Philippines, which include: Part I, The Rules of Civil Procedure (Rules 1-71); Part II, Special Proceedings (Rules 72-109); Part III, The Revised Rules of Criminal Procedure (Rules 110-127); and Part IV, The Rules of Evidence (Rules 128-134).
The Supreme Court approved the Rules of Court pursuant to the power vested upon it by Section 5(5) of Article VIII of the Constitution to promulgate rules concerning the protection and enforcement of constitutional rights, pleading, practice and procedure in all courts, the admission to the practice of law, the Integrated Bar, and legal assistance to the underprivileged.
