Decision No. 391 was issued in Caracas, Venezuela by the Commission of the Cartagena Agreement (also known as ‘the Commission of the Andean Community’) on July 2, 1996, and published in the Official Gazette of the Cartagena Agreement No. 213 of July 17, 1996, in Lima, Peru.
The Decision is divided into 11 titles: Title I (Article 1) on the Definitions, Title II (Article 2) on the Purpose and Aims, Title III (Articles 3-4) on the Scope, Title IV (Articles 5-15) on the Principles, Title V (Articles 16-40) on the Access Procedure, Title VI (Articles 41-44) on the Ancillary Contracts to the Access Contract, Title VII (Article 45) on the Limitations to Access, Title VIII (Articles 46-47) on Violations and Sanctions, Title IX (Articles 48-49) on the Notifications between Member Countries, Title X (Article 50) on the Competent National Authority, and Title XI (Article 51) on the Andean Committee on Genetic Resources and Final, Complementary and Temporary Provisions.
Title IV, Chapter II, Article 7 provides recognition of know-how, innovations and traditional practices.
Title IV, Chapter II, Articles 8 and 9 refer to scientific and technical training programs, research projects, and transfer of technology.
