Act on Utility Model Rights No. 800 of May 10, 1991, as amended by Acts No. 580 of June 26, 1992, No. 1037 of November 13, 1992, No. 1410 of December 12, 1992, No. 720 of April 21, 1995, No. 1396 of December 8, 1995, No. 1696 of December 22, 1995 and No. 686 of 21 July 2006. Chapter 1 General provisions Section 1 Anyone who has made an invention, or his successor in title, shall be entitled, on application, to a utility model right to his invention, and thereby to the exclusive right to exploit the invention commercially, in accordance with the provisions of this Act. For the purposes of this Act, "invention" shall mean a technical solution that is commercially exploitable. The following, as such, shall not be regarded as inventions: (1) discoveries, scientific theories and mathematical methods; (2) aesthetic creations: (3) schemes, rules and methods for performing mental acts, playing games or doing business, and programs for computers; and (4) presentations of information. Utility model rights shall not be granted for: (1) inventions the exploitation of which would be contrary to morality or public policy; (2) plant or animal varieties; or (3) processes. Section 2 An invention must be new in relation to what was known before the filing date of the utility model right application and must differ distinctly therefrom. The prior art shall be held to comprise everything made available to the public by means of a written or oral description, by use or in any other way. Additionally, the content of utility model right, patent and design applications as filed in this country prior to the above-mentioned filing date shall be regarded as comprised in the prior art if such applications are made available to the public under Section 18 of this Act, Section 22 of the Patents Act or Section 19 of the Registered Designs Act. The requirement set out in the first paragraph, that the invention must differ distinctly from the prior art known before the filing date of the application for a utility model right, shall not apply, however, in such cases. Applications refered to in Chapter 8 a shall, for the purposes of the second paragraph, have the same legal effect as applications for utility model right filed in this country, pursuant to provisions laid down in Sections 45b and 45f. A utility model may be nevertheless be registered for inventions made available to the public within the six months preceding the filing date of the application if disclosure was the result of: 1) an evident abuse in relation to the applicant or his predecessor in title; or 2) the fact that the applicant or his predecessor in title had displayed the invention at an official or officially recognized international exhibition falling within the terms of the Convention on International Exhibitions (Finnish Treaty Series 36/37). For the purposes of the second paragraph, publication according to Article 93 of the European Patent Convention (Finnish Treaty Series 8/96) shall be equated with the making available to the public of application documents according to Section 22 of the Patents Act. What is said above, also applies to publication according to Article 158(1) of the European Patent Convention where the European Patent Office equates such publication with publication according to Article 93. Section 3 The exclusive right conferred by registration of a utility model shall imply, subject to the exceptions stated below, that no one may exploit an invention without the consent of the proprietor of the utility model right by making, offering, putting on the market or using a product protected by the utility model right, or by importing or possessing such product for these purposes. The exclusive right shall also confer on its proprietor the exclusive right to prevent any person not having his consent from supplying or offering to supply any person not entitled to exploit the invention with the means of working the invention in this country in relation to an essential element of the invention where such other person knows, or on the basis of the circumstances should have known , that the means are suitable and intended for working the invention. This provision shall not apply where the means are staple commercial products, except where such other person attempts to induce the receiver to commit any act infringing the exclusive right referred to in the first paragraph of this Section. For the purposes of this paragraph, any person using the invention in a manner referred to in the third paragraph, item (1), or (3), shall not be regarded as entitled to exploit the invention. The exclusive right shall not apply to: 1) use which is not commercial; 2) use of a product protected by registration of a utility model right that has been put on the market within the European Economic Area by or with the consent of the proprietor of the utility model right; or 3) use in experiments relating to the invention as such. Section 4 The provisions of Sections 4 and 5 of the Patents Act regarding commercial use or exploitation of an invention on foreign vessels, aircraft or other means of transport for their needs shall apply mutatis mutandis on an invention for the purposes of this Act. Section 5 An application for registration of a utility model right relating to an invention disclosed not earlier than 12 months before the date of filing in an application for a patent or for registration of a utility model filed in Finland, or in an application for a patent, an inventor’s certificate or utility model protection filed in another country party to the Paris Convention for the Protection of Industrial Property (Finnish Treaty Series 36/70 and 43/75) or the Agreement Establishing the World Trade Organization (Finnish Treaty Series 5/95), shall be deemed, for the purposes of the first and second paragraphs of Section 2, and Section 4, to have been filed at the same time as the earlier application if the applicant so requests. Such priority may also be enjoyed under an earlier application for protection filed in a country not party to the above mentioned conventions if the corresponding priority deriving from a Finnish application is granted in such country and if the laws of such country substantially conform to those conventions. The Government, or a Registering Authority appointed by the Government, shall lay down the manner in which priority claims shall be filed and the documents to be submitted in support of claims. Chapter 2 Applications for Utility Model Rights and Their Processing Section 6 Applications for utility model rights, hereinafter referred to as "utility model applications", shall be filed in writing with the National Board of Patents and Registration, acting as Registering Authority. In the cases referred to in Chapter 8 a applications may also be filed with the patent authority of another country or with an international organization. The application shall contain a description of the invention, accompanied by drawings where necessary, and a precise statement of the subject matter for which utility model right protection is sought (a claim). More specific provisions regarding drawings accompanying the application shall be laid down by decree. The description shall be sufficiently clear to enable a person skilled in the art to carry out the invention with the guidance thereof. Where the invention relates to a product of a microbiological process, Section 8a and paragraphs 6 and 8 of Section 22 of the Patents Act shall apply mutatis mutandis. The inventor’s name shall be stated in the application. If a utility model right is applied for by a person other than the inventor, the applicant shall be required to prove his title to the invention. Section 7 The description and claim shall be written in Finnish or Swedish in compliance with the language laws in force. If the claim is written in one only of the two national languages, the Registering Authority shall have the claim translated into the other national language before the utility model is registered. The applicant shall pay the prescribed translation fee. Where the applicant is a foreigner, the description shall be written in Finnish and the claim in Finnish and Swedish. However, all applicants shall be entitled to write the description of the invention and the claim in both Finnish and Swedish. The applicant shall pay the prescribed registration fee. The application shall be deemed not to have been filed until the fee has been paid. Section 8 A utility model application may also result from conversion of a pending patent application relating to the same invention into an application for a utility model right, which shall be deemed to have been made on the filing date of the patent application. However, conversion shall not be allowed after expiry of ten years from the day the patent application is deemed to have been filed. In other respects, the provisions relating to applications for utility models shall also apply in the case of such utility model applications. A patent application shall remain pending even if it is converted into a utility model application unless the applicant specifically withdraws the patent application. Section 8 a If a European patent application under the European Patent Convention is to be deemed withdrawn because it has not in due time been received by the European Patent Office from the national Registering Authority of the Contracting State of the European Patent Convention with which the application was filed, it shall, at the applicant’s request, be converted into a utility model application, provided that: 1) the request is submitted to the national Registering Authority of the Contracting State of the European Patent Convention within three months of the date the European Patent Office notified the applicant that the application is deemed withdrawn; 2) the request is received by the Registering Authority within 20 months of the filing date of the application or, where priority is claimed, from the date of priority; and 3) the applicant pays the prescribed application fee and submits the translation pursuant to Section 7 of the utility model application within the prescribed time limit. If a European patent application is to be deemed withdrawn because no translation in its language of proceedings has been submitted to the European Patent Office within the prescribed time limit, it may, at the request of the applicant, be converted into a national utility model application in compliance with the provisions of Articles 135 and 136 of the European Patent Convention. The applicant shall additionally pay the Registering Authority the prescribed application fee and submit a translation pursuant to Section 7 of the utility model application within the prescribed time limit. If a utility model application within the meaning of paragraphs 1 and 2 satisfies the requirements as to form of the European Patent Convention and its Implementing Regulations, it shall be accepted in these respects. Section 9 A utility model right may not be applied for in respect of two or more mutually independent inventions in the same application. At the applicant’s request, a utility model application may be divided, in which case the new application shall be deemed to be filed at the same time as the original application. Section 10 An applicant for and a proprietor of a utility model right not domiciled in Finland shall be required to appoint a representative domiciled in the country to represent him in all matters concerning the application and the registered utility model. Section 11 A utility model application may not be amended in such a way that a utility model right is claimed for matter not disclosed in the original application. Section 12 The Registering Authority shall check that the application complies with the provisions of the second and third paragraphs of Section 1, and Sections 6 to 11. The Registering Authority shall classify the application. The applicant or, after the utility model has been entered into the Register or been made available to the public under Section 18, anyone may submit a request in writing for an examination to assess whether an invention for which utility model registration has been granted or a utility model application filed satisfies the requirements laid down in the first paragraph of Section 2. The prescribed fee is payable for the examination. Section 13 If the applicant fails to satisfy the requirements for the application, or if the authority finds other obstacles to the registration of the utility model, the applicant shall be notified thereof by official action and be invited to file his comments or the necessary corrections within the specified period of time. If the applicant fails to file his comments or to take steps to remove, within the specified period of time, the obstacles, the application shall be dismissed. The official action issued pursuant to the first paragraph shall include a notice to that effect. A dismissed application may be reinstated if, within two months of the expiration of the time limit laid down in the official action, the applicant so requests and files comments or takes steps to correct the application and, within the same period of time, pays the prescribed reinstatement fee. An application may be reinstated only once. Section 14 If, after the applicant has filed his comments, there still remains an obstacle to the registration of the utility model which the applicant has had an opportunity to comment on, the application shall be rejected, unless there is reason to issue a further official action to the applicant. Section 15 If a person other than the applicant claims title to the invention before the Registering Authority, and if the circumstances are held to be uncertain, the Registering Authority may invite such other person to institute legal proceedings before a court of law within a specified period of time, failing which the claim will not be taken into consideration. If proceedings for title to an invention in respect of which utility model protection has been applied for are pending before a court, the processing of the utility model application may be suspended until a final decision has been given in such proceedings. Section 16 If a person proves to the Registering Authority that he has title to the invention and not the applicant, the Registering Authority shall, if such person so requests, transfer the application to him. At the same time, he shall pay a new application fee. The application shall not be dismissed, rejected, granted or withdrawn until a final decision has been taken on the request. Section 17 If the application satisfies the requirements of the second and third paragraphs of Section 1, and of Sections 6 to 11, the utility model shall be recorded in the Utility Model Register. Public notice shall be given of the registration and a certificate of registration shall be issued to the applicant. Section 18 The application file shall be available to the public as from the date of registration or no later than when 15 months have elapsed since the date the application was filed or is deemed to have been filed, or, where priority is claimed, from the priority date. At the request of the applicant, registration may be postponed for a period of no more than 15 months from the date the applications was filed or is deemed to have been filed, or, where priority has been claimed, from the priority date. If the application has been dismissed or rejected, the file shall become available to the public only if the applicant requests for reinstatement of the application or appeals against the decision by which the application was rejected. A prescribed fee is payable for the postponement of the registration. At the applicant’s request, the application file may be made available to the public earlier than provided for in the first paragraph. Chapter 3 Opportunity to require that the registration be declared invalid Section 19 If an invention for which a utility model right has been registered or an application for a utility model right does not satisfy the requirements laid down in the second to fourth paragraphs of Section 1, Section 2, the second paragaph of Section 6, or Sections 8 or 11, any person may request that the registration of the utility model be declared invalid in whole or in part. The request shall be made to the Registering Authority in writing and state the facts on which it is based. The person making the request shall pay the prescribed fee. If the payment is not made, the request will not be considered. A request that a registration be declared invalid shall not be considered if proceedings concerning transfer of the registration are pending. Section 20 The Registering Authority shall notify the proprietor of the utility model right of any request made under Section 19 and give him an opportunity to file comments on the request within a specified period of time. If a partial invalidation of the registration is concerned, the proprietor shall submit a reworded claim to the Registering Authority within the same specified period of time. If he does not oppose the request within the specified period of time, the registration shall be declared invalid in whole. If the proprietor of the utility model right opposes the request, it shall be examined by the Registering Authority. Section 21 If the Registering Authority ascertains, as a result of the request, that the invention to which the utility model right relates, or the application for a utility model does not fulfill the requirements of the second to fourth paragraphs of Section 1, of the second paragraph of Section 6, or of Section 8, 9 or 11 of the Act, the registration of the utility model shall be declared invalid in whole or in part. If a registration has been declared invalid, the decision shall be published once it becomes final. Chapter 4 Appeals Section 22 A utility model right applicant or proprietor may seek appeal of a final decision concerning registration or declaration of invalidation of the utility model right, if the decision is not in his favor. The person requesting a declaration of invalidation of a utility model may seek appeal if his request is rejected by the decision. Appeal of a decision rejecting a request for reinstatement under the third paragraph of Section 13 or a decision granting a request for transfer of an application under Section 16 may be sought by the applicant. Appeal of a decision rejecting a request for transfer of an application may be sought by the person making the request. Section 23 An appeal from a decision taken by the Registering Authority under the present Act shall be brought by filing an appeal with the Board of Appeal of the National Board of Patents and Registration. Separate provisions shall apply to the appeal procedure and the proceedings before the Board of Appeal. Chapter 5 Scope and Term of Protection Section 24 The scope of protection conferred by a utility model right shall be determined by the claim. The description and illustrations may be used to interpret the claim. Section 25 The term of protection of a utility model registration shall be four years from the filing date of the application and may, on request, be renewed twice, first for a period of four years and then for a period of two years. Section 26 Renewal of a registration shall be requested in writing from the Registering Authority not earlier than one year before and not later than six months after the registration term expires. Within the same period of time the proprietor of the utility model shall pay the prescribed renewal fee. After the expiration of the running registration term the renewal fee shall be paid raised by a prescribed amount. The renewal of a registration shall be announced. Chapter 6 Assignment, Licences and Compulsory Licences Section 27 A utility model right may be transferred. If another person has obtained the right to exploit the invention commercially (licence), such person may transfer his right to a further person only if such has been agreed. However, if the licence has been granted to an enterprise, it may be transferred together with the enterprise, unless otherwise agreed. In such case the assignor shall remain liable for compliance with the licence agreement. Section 28 The transfer of a utility model right or the grant of a licence shall be recorded in the Utility Model Register on request and on payment of the prescribed fee,. This shall also apply to the pledging of a utility model right. On proof that a licence or a pledge recorded in the Register is no longer in force, the entry shall be deleted from the Register. The first paragraph of this Section shall apply mutatis mutandis to compulsory licences and to the right referred to in the first paragraph of Section 32. The person last recorded in the Utility Model Register as the proprietor of the utility model right shall be deemed the proprietor for the purposes of legal proceedings and for other matters concerning the utility model. Section 29 If a person acting in good faith has requested the Registering Authority to record in the Register that a utility model right has been transferred to him or that he has obtained a licence to a utility model or a pledge in a utility model, an earlier transfer of the utility model right or of rights therein shall not be enforceable against him, if the other party has not previously requested registration of his acquisition in the Utility Model Register. Section 30 Where two years have elapsed since the registration of the utility model and the invention has not been worked or brought into use to a reasonable extent in Finland, any person who wishes to work the invention in the country may obtain a compulsory licence to do so unless there are legitimate grounds for the failure to work. The provisions of Sections 46 to 50 of the Patent Law relating to compulsory licences to exploit inventions protected by patents shall apply mutatis mutandis with respect to utility model rights. Chapter 7 Termination of Utility Model Right and Obligation to Furnish Information Section 31 Where a utility model has been registered in the name of a person other than the person entitled under Section 1 and where an action is brought by the person having the right to the utility model, the court shall transfer the utility model to the entitled person. Such actions shall be brought within one year of the plaintiff’s gaining knowledge of the registration and of any other circumstances on which the action is founded. Such action may not be brought more than three years after registration of the utility model if the proprietor of the utility model acted in good faith at the time the utility model was registered or was transferred to him. Section 32 Where a person dispossessed of a registration in accordance with Section 31 had, in good faith, begun commercial exploitation of the invention in this country or had made substantial preparations therefor, he shall be entitled, against reasonable remuneration and on other reasonable terms, to continue the exploitation or to commence the intended exploitation, provided that its general nature is maintained. A licensee recorded in the Utility Model Register shall have the same right subject to equivalent conditions. The right referred to in the first paragraph of this Section may only be transferred to others together with the enterprise in which it is exploited or intended to be exploited. Section 33 Where the proprietor of a utility model right notifies in writing that he relinquishes his registration,, the Registering Authority shall delete the utility model from the Register. Where a utility model is seized for debt or is subject to a pledge that has been recorded in the Register or if an action for transfer of the registration is pending, the utility model may not be deleted from the Register at the proprietor’s request as long as the seizure or pledge is in force or until a final decision has been given in the action. Section 34 Where a utility model registration has been transferred by final decision of a court, the Registering Authority shall publish a notice to that effect. Section 35 The provisions of Section 56 of the Patents Act concerning the obligation to furnish information in respect of a patent shall apply mutatis mutandis to a utility model right. Chapter 8 Liability, Payment of Compensation and Court Proceedings Section 36 The court may forbid any person who infringes the exclusive right conferred by a utility model right from continuing or repeating the act.
Section 36 a
When hearing an action referred to in section 36 the court may at the utility model holder’s request prohibit the keeper of a transmitter, server or other similar device or other service provider acting as an intermediary, under penalty of a fine, from continuing the use alleged to infringe the utility model (injunction order) unless it can be considered disproportionate in view of the rights of the alleged infringer of the utility model or in view of the rights of the intermediary or utility model holder.
Before the bringing of an action referred to in section 36 the court referred to in that section may, at the utility model holder’s request, issue an injunction, if the preconditions for that set out in subsection 1 exist and if it is obvious that the realisation of the utility model holder’s rights otherwise would be seriously endangered. The court must provide both for the party against whom the injunction is sought and for the party who is claimed to infringe the utility model an opportunity to be heard. Communications to the parties against whom the injunctions have been sought may be delivered by mail or by facsimile or e-mail. Otherwise the provisions of Chapter 8 of the Code of Judicial Procedure apply to the processing of the case.
The court may, on request, issue the injunction referred to in subsection 2 as an interlocutory injunction without hearing the alleged infringer, if the urgency of the case of necessity requires that. The injunction remains in force until ordered otherwise. After the injunction is issued, the alleged infringer must without delay be provided an opportunity to be heard. When the alleged infringer has been heard, the court must decide without delay whether to keep the injunction in force or withdraw it.
An injunction issued under this section must not endanger the right of a third party to send and receive messages. Subject to the provisions of Chapter 7, section 7, of the Code of Judicial Procedure, the injunction comes into force when the plaintiff gives the bailiff the security referred to in Chapter 7, section 16, of the Execution Act (37/1895). An injunction issued under subsection 2 or 3 of this section lapses if the action referred to in section 36 is not brought within a month from the issuance of the injunction.
The party who has demanded the injunction must compensate the party against whom the injunction is issued as well as the alleged infringer for the damage caused by the implementation of the injunction and for any other costs resulting from the case, if the action referred to in section 36 is rejected or ruled inadmissible, or if the processing of the case is removed from the cause list because the plaintiff has abandoned his/her action or failed to arrive to the court. The same applies if the injunction is withdrawn under subsection 3 or lapses under subsection 4. When an action is brought for compensation for damage and costs, the provisions of Chapter 7, section 12, of the Code of Judicial Procedure apply.
Section 37 Any person who intentionally or negligently infringes a utility model right shall be liable to pay reasonable compensation for the exploitation of the invention, as also compensation for other damages caused by the infringement. If there is only slight negligence, the compensation may be adjusted accordingly. A person found guilty of utility model right infringement that is neither intentional nor negligent shall pay compensation for the exploitation of the invention if and to the extent held reasonable. An action for compensation for utility model right infringement may only be brought with respect to damages suffered during the five years preceding the institution of the action. If an action is not instituted within that period, the right to compensation shall be forfeited. Section 38 The provisions of Section 59 of the Patents Act concerning measures to prevent further infringement shall apply mutatis mutandis to utility model rights.
Section 38 a
(In a dispute that concerns an infringement of a utility model the court may, at the plaintiff’s request, order the defendant to compensate the plaintiff for the cost occurred to him/her for publishing, by taking suitable measures, information concerning the final decision in which the defendant is found to have infringed the utility model right. Such an order may not be given if the dissemination of the information is limited elsewhere in the law. In considering the issuance and contents of the order, the court must pay attention to the general significance of the publication of the issue, the kind and scope of the infringement, the costs involved in the publishing process and other corresponding facts.
The court lays down a maximum amount for the reasonable publishing cost to be paid by the defendant. The plaintiff is not entitled to the compensation, if information about the decision has not been published within a period laid down by the court counted from the date when the final decision was issued.
Section 39 Any person who infringes an exclusive right in a utility model right intentionally, shall, unless the act is punishable as an industrial property right offence under Section 2 of Chapter 49 of the Penal Code, be liable to a fine for violation of a utility model right. Indictment for an offence referred to in the first paragraph may be brought by the Public Prosecutor only if so requested by the injured party. Section 40 Any person who intentionally or by negligence, other than slight negligence, fails to comply with an obligation under Section 35, shall be liable to a fine for failure to comply with the obligation to furnish information relating to a utility model. Any person who provides false information in a case referred to in the said Section shall also be liable to the same penalty, unless the act is punishable under the Penal Code. Indictment for an offence referred to in the present Section may be brought by the Public Prosecutor only if so requested by the injured party. Section 41 Where a utility model registration has been declared invalid by a final decision, no penalty, payment of compensation or other sanction may be ordered under Section 2 of Chapter 49 of the Penal Code or Sections 36 to 39 of this Act. Where the plaintiff in an action for infringement of a utility model right claims that the registration does not comply with this Act, the court may, at the defendant’s request, stay proceedings or the decision until a final decision has been taken on the invalidity claim. Where no request for invalidation has been filed with the Registering Authority, the court shall order the defendant, in connection with the stay of proceedings, to file such request within the period of time it shall determine. Section 42 Any person who wishes to bring an action for transfer of a utility model right or for grant of a compulsory licence shall give the Registering Authority notice thereof and shall notify all persons recorded in the Utility Model Register as licensees under the utility model right or as proprietors of a pledge therein. If a licensee wishes to bring an action for utility model infringement he shall notify the proprietor of the right thereof. The requirement to notify pursuant to the first paragraph shall be deemed satisfied when notification by registered letter has been sent to the addresses recorded in the Utility Model Register. If the plaintiff cannot prove, at the time the action is brought, that he has given notice pursuant to the first paragraph, he shall be given a sufficient period of time to do so. If he does not avail himself of that period of time, the action shall be dismissed. Section 43 The District Court of Helsinki shall be the competent court to hear proceedings in respect of: 1) proper title to an invention for which a utility model right has been sought; 2) transfer of a utility model right; 3) grant of compulsory licences, amendment of conditions for compulsory licences or revocation of a right referred to in the first paragraph of Section 32; 4) infringement of a utility model right or non-compliance with the obligation to furnish information relating to a utility model; or 5) assessment of the compensation due under Section 37. Section 44 The provisions of Sections 66 and 67 of the Patents Act shall apply mutatis mutandis to the proceedings referred to in Section 43. Section 45 The court shall communicate to the Registering Authority a copy of decisions given in the proceedings referred to in Section 43 together with a statement as to whether the decision is final. Chapter 8 a International Applications Section 45 a In this Act "an international application" shall mean an application relating to a utility model filed under the Patent Cooperation Treaty (Finnish Treaty Series 58/80). International applications shall be filed with a registering authority or an international organization (receiving office) authorized under the Patent Cooperation Treaty and its Regulations to receive such applications. The receiving office in Finland shall be the National Board of Patents and Registration, as laid down by Government decree. Applicants filing an international utility model application in Finland shall pay the prescribed fees. Unless otherwise provided in Sections 45b to 45f, the provisions Chapter 3 of the Patents Act in respect of the processing of international patent applications shall mutatis mutandis apply to the processing of international utility model applications designating Finland. Section 45b An international utility model application to which a receiving office has assigned an international filing date shall have the same effect in this country as a Finnish utility model application filed on the same date. The second sentence in the second paragraph of Section 2 shall only apply to an international application that has been pursued under Section 45d. Section 45c An international utility model application shall be deemed withdrawn as far as the designation of Finland is concerned in the cases referred to in Article 24(1)(i) and (ii) of the Patent Cooperation Treaty. Section 45d If an applicant wishes to pursue an international utility model application in Finland, he shall file with the Patent Authority a translation in Finnish or Swedish of the international application within 31 months of the international filing date or, where priority is claimed, of the priority date, or a copy of the application where it is written in Finnish or Swedish. The applicant shall pay the prescribed registration fee to the Registering Authority within the same period. If the applicant has paid the prescribed registration fee within the time limit laid down in the first or second paragraph, the required translation or a copy of the application may be filed within a further period of two months, provided the prescribed additional fee is paid within that same period. If the application, in cases referred to in the first and second paragraphs of this Section, does not satisfy the requirements of this Act, the applicant may within a period of two months from the time limits referred to in the first and second paragraphs render the application to comply with the requirements as to form and content of the Implementing Regulations of the Patent Cooperation Treaty. If the applicant does not satisfy the requirements of this Section, the application shall be deemed withdrawn as far as Finland is concerned. Section 45e Where an applicant withdraws his request for international preliminary examination or his statement of his intention to use the results of such examination in applying for a utility model right for Finland, the international utility model application shall be deemed withdrawn as far as Finland is concerned. The application shall not be deemed withdrawn, however, if withdrawal is made prior to the expiration of the time limit laid down in the first paragraph of Section 45d and if the applicant also pursues the application within the time limit laid down in the first, third or fourth paragraph of Section 45d. Section 45f Where an international application has been pursued under Section 45d, provisions of Chapters 2 and 5 shall apply in respect of the application and examination, unless otherwise provided in this Section or in Sections 34 to 38 of the Patents Act. However, the application may be taken up for examination prior to expiration of the period laid down in the first and second paragraphs of Section 45d only if so requested by the applicant. The obligation under Section 10 of the applicant to have a representative domiciled in the country does not begin until the date when the application may be taken up for examination. When 18 months have elapsed since the date of filing of the application or, if priority is claimed, from the priority date, and the applicant has satisfied his obligation under Section 45d to submit a translation or, where the application has been written in Finnish or Swedish, the applicant has submitted a copy of the application to the Registering Authority, the application documents shall be made available to the public even before the applicant has pursued the application. Chapter 9 Special Provisions Section 46 Separate provisions shall apply to the amounts of fees to be paid under the present Act. Section 47 More detailed provisions to regulate utility model applications, the Utility Model Register and also the Registering Authority shall be issued by Government decree. Detailed regulations concerning utility model applications and their processing may be issued by the Registering Authority. Section 48 The provisions of Section 75 of the Patents Act concerning the obligation to surrender rights in an invention in certain cases and the compensation to be paid therefor shall apply mutatis mutandis to utility model rights. Separate provisions shall apply in respect of inventions of importance to the defence of the country. Chapter 10 Entry into Force and Transitional Provisions Section 49 This Act shall enter into force on a date to be decreed by the Government. Applications filed prior to the entry into force of this Act may not serve as a basis for a priority claim under Section 5. Patent applications filed or deemed to have been filed prior to the entry into force of this Act may not be converted into applications for utility models under Section 8.
Act 686/2006 comes into force on 1 September 2006.
Section 36 a of this Act also applies to disputes that have been pending before the entry into force of this Act.
The provisions applicable at the entry into force of this Act apply to disputes pending before the entry into force of this Act, instead of the provisions of section 38 a of this Act.

La protection en tant que modèle d’utilité n’est pas accordée pour
1) � les inventions dont l’exploitation serait contraire à l’ordre public ou aux bonnes mœurs;
2) � les variétés végétales ou les races animales; ou

Art. 2. L’invention doit être nouvelle par rapport à l’état de la technique connu avant la date de dépôt de la demande de modèle d’utilité et en différer nettement.
L’état de la technique est réputé comprendre tout ce qui a été rendu accessible au public par une description écrite ou orale, un usage ou tout autre moyen. Est en outre considéré comme compris dans l’état de la technique le contenu des demandes de modèle d’utilité, de brevet et d’enregistrement d’un dessin ou modèle déposées en Finlande avant la date de dépôt précitée à condition qu’elles aient été rendues accessibles au public conformément à l’article 18de la présente loi, à l’article22 de la loi sur les brevets1 [Patenttilaki] ou à l’article 19 de la loi sur les dessins et modèles enregistrés2 [Mallioikeuslaki]. Toutefois, la condition énoncée au premier alinéa, selon laquelle l’invention doit différer nettement de l’état de la technique connu avant la date de dépôt de la demande de modèle d’utilité, n’est pas applicable dans ces cas.

Cependant, un modèle d’utilité peut être enregistré pour une invention rendue accessible au public au cours des six mois précédant la date de dépôt de la demande si la divulgation a résulté
1) � d’un abus évident à l’égard du déposant ou de son prédécesseur en droit; ou
2) � du fait que le déposant ou son prédécesseur en droit a présenté l’invention lors d’une exposition internationale officielle ou officiellement reconnue aux

Aux fins du deuxième alinéa, la publication des documents de la demande, conformément à l’article 93 de la Convention sur le brevet européen3 (Série des traités finlandais no 8/96) est considérée comme équivalant au fait de rendre accessible au public les pièces de la demande en vertu de l’article22de la loi sur les brevets. Ce qui précède s’applique également à la publication en vertu de l’article 158(1) de la Convention sur le brevet européen, lorsque l’Office européen des brevets considère que cette publication équivaut à la publication selon l’article 93. Art. 3. Sous réserve des exceptions mentionnées ci-après, le droit exclusif conféré par l’enregistrement d’un modèle d’utilité comporte celui d’interdire à tout tiers auquel le titulaire du modèle d’utilité n’a pas donné son consentement d’exploiter l’invention par la fabrication, l’offre, la mise dans le commerce ou l’utilisation d’un produit protégé par le modèle d’utilité, ou l’importation ou la détention d’un tel produit à l’une de ces fins.
Ce droit exclusif confère également à son propriétaire le droit exclusif d’empêcher toute personne n’ayant pas son autorisation de fournir ou d’offrir de fournir à tout tiers qui n’est pas habilité à exploiter l’invention les moyens d’exécuter l’invention en Finlande en ce qui concerne un élément essentiel de celle-ci lorsque ce tiers sait, ou devrait savoir compte tenu des circonstances, que lesdits moyens sont adaptés et destinés à cette exploitation. La présente disposition ne s’applique pas lorsque les moyens sont des produits commerciaux courants, sauf lorsque cette personne incite leur destinataire à commettre des actes portant atteinte au droit exclusif visé au premier alinéa du présent article. Aux fins du présent alinéa, toute personne qui utilise l’invention de la façon visée au point 1) ou 3) du troisième alinéa est considérée comme n’étant pas habilitée à exploiter l’invention. Art. 4. Les dispositions des articles 4et 5 de la loi sur les brevets relatives à l’utilisation commerciale ou à l’exploitation d’une invention à bord de navires, d’aéronefs ou d’autres moyens de transport étrangers, pour leurs besoins, sont applicables par analogie aux inventions visées par la présente loi.
Art. 5. Sur requête du déposant, une demande d’enregistrement de modèle d’utilité portant sur une invention divulguée, au cours des 12 mois précédant sa date de dépôt, dans une demande de brevet ou d’enregistrement de modèle d’utilité déposée en Finlande, ou dans une demande de brevet, de certificat d’auteur d’invention ou de modèle d’utilité déposée dans un autre État partie à la Convention de Paris pour la protection de

la propriété industrielle4 (Série des traités finlandais nos 36/70 et 43/75) ou à l’Accord instituant l’Organisation mondiale du commerce (Série des traités finlandais no 5/95), est réputée, aux fins des premier et deuxième alinéas de l’article2 , et aux fins de l’article4 , avoir été déposée à la date de dépôt de la demande antérieure. Cette priorité peut aussi découler d’une demande de protection déposée antérieurement dans un État qui n’est pas partie aux conventions susmentionnées si cet État accorde une priorité correspondante sur la base de demandes déposées en Finlande et si sa législation est, pour l’essentiel, conforme à ces conventions. Les règles relatives à la présentation des revendications de priorité et aux pièces devant être produites à l’appui de ces revendications seront édictées par le gouvernement ou par un service d’enregistrement désigné par le gouvernement.
Chapitre 2 Dépôt et instruction des demandes de modèle d’utilité
Art. 6. Les demandes de modèle d’utilité doivent être déposées par écrit auprès de l’Office national des brevets et de l’enregistrement, qui agit en tant que service d’enregistrement. Dans les cas visés au chapitre 8a, les demandes peuvent aussi être déposées auprès du service compétent en matière des brevets d’un autre pays ou auprès d’une organisation internationale. La demande doit contenir une description de l’invention et être accompagnée de dessins, si nécessaire, et d’un exposé précis de l’objet pour lequel la protection en tant que modèle d’utilité est demandée (revendication). Des prescriptions plus détaillées concernant les dessins accompagnant la demande seront adoptées par décret. La description doit être suffisamment claire pour qu’une personne du métier puisse, en se fondant sur celle-ci, exécuter l’invention. Lorsque l’invention concerne le produit d’un processus micro biologique, les dispositions de l’article 8a et des sixième et huitième alinéas de l’article22 de la loi sur les brevets s’appliquent mutatis mutandis. Le nom de l’inventeur doit être indiqué dans la demande. Lorsque la demande de modèle d’utilité n’est pas déposée par l’inventeur, le déposant doit justifier de son droit sur l’invention.
Art. 7. La description et la revendication doivent être rédigées en finnois ou en suédois conformément aux dispositions en vigueur relatives aux langues. Si la revendication est rédigée dans l’une des deux langues nationales seulement, le service d’enregistrement en fait établir une traduction dans l’autre langue avant d’enregistrer le modèle d’utilité. Le déposant doit acquitter la taxe de traduction prescrite. Si le déposant est étranger, la description doit être rédigée en finnois et la revendication en finnois et en suédois. Toutefois, tous les déposants peuvent rédiger la description et la revendication dans les deux langues.

Le déposant doit acquitter la taxe d’enregistrement prescrite. La demande est réputée ne pas avoir été déposée avant le paiement de la taxe.
Art. 8. (8.12.1995/1396) Une demande de modèle d’utilité peut également résulter de la transformation d’une demande de brevet en instance pour la même invention en une demande de modèle d’utilité, celle-ci étant réputée déposée à la date de dépôt de la demande de brevet. Toutefois, cette transformation n’est plus possible après l’expiration d’un délai de 10 ans à compter de la date à laquelle la demande de brevet est réputée avoir été déposée. Les autres dispositions relatives au dépôt des demandes de modèle d’utilité s’appliquent également aux demandes de modèle d’utilité résultant d’une telle transformation.
La demande de brevet demeure en instance même si elle est transformée en demande de modèle d’utilité, à moins que le déposant ne la retire expressément.
Art. 8a. (22.12.1995/1696) Si une demande de brevet européen déposée en vertu de la Convention sur le brevet européen doit être réputée retirée parce que l’Office européen des brevets ne l’a pas reçue en temps voulu du service d’enregistrement de l’État partie à la Convention sur le brevet européen auprès duquel elle a été déposée, elle est transformée, à la requête du déposant, en demande de modèle d’utilité, à condition que
1) � la requête soit présentée au service d’enregistrement de l’État partie à la Convention sur le brevet européen dans les trois mois suivant la date à laquelle l’Office européen des brevets a notifié au déposant que la demande est réputée retirée;
2) � la requête soit reçue par le service d’enregistrement dans les 20 mois suivant la date de dépôt de la demande ou, lorsqu’une priorité est revendiquée, suivant la date de priorité; et que
3) � le déposant s’acquitte de la taxe de dépôt prescrite et présente la traduction du texte de la demande de modèle d’utilité, conformément à l’article 7, dans le délai prescrit.
Si une demande de brevet européen est réputée retirée parce que sa traduction dans la langue de la procédure n’a pas été remise à l’Office européen des brevets dans le délai prescrit, elle peut, à la requête du déposant, être transformée en demande nationale de modèle d’utilité conformément aux dispositions des articles 135 et 136 de la Convention sur le brevet européen. Le déposant est tenu en outre de payer au service d’enregistrement la taxe de dépôt prescrite et de lui remettre, dans le délai prescrit, une traduction du texte de la demande de modèle d’utilité conformément à l’article 7.
Si une demande de modèle d’utilité au sens des premier et deuxième alinéas satisfait aux conditions de forme prescrites par la Convention sur le brevet européen et par son règlement d’exécution, elle doit être acceptée à cet égard.
Art. 9. (8.12.1995/1396) Une demande de modèle d’utilité ne peut pas porter sur plusieurs inventions indépendantes.
À la requête du déposant, une demande de modèle d’utilité pourra être divisée, auquel cas la nouvelle demande sera réputée avoir été déposée à la date de la demande initiale.
Art. 10. Le déposant d’une demande de modèle d’utilité ou le titulaire d’un modèle d’utilité qui n’est pas domicilié en Finlande doit y constituer un mandataire chargé de le représenter pour toutes les démarches relatives à la demande et au modèle d’utilité enregistré.
Art. 11. Il ne peut être apporté à une demande de modèle d’utilité de modifications ayant pour effet de revendiquer la protection au titre du modèle d’utilité pour un élément qui ne figurait pas dans la demande initiale.
Art. 12. Le service d’enregistrement vérifie si la demande satisfait aux conditions énoncées aux deuxième et troisième alinéas de l’article premier et aux articles 6 à 11.
Le service d’enregistrement procède à la classification de la demande.
Le déposant ou, après que le modèle d’utilité a été inscrit au registre ou rendu accessible au public en vertu de l’article 18, toute personne peut présenter par écrit une demande d’examen aux fins d’évaluer si une invention pour laquelle un enregistrement en tant que modèle d’utilité a été accordé ou pour laquelle une demande de modèle d’utilité a été déposée satisfait aux conditions stipulées au premier alinéa de l’article2 . L’examen donne lieu au paiement de la taxe prescrite.

Art. 13. Lorsque le déposant ne remplit pas les conditions de dépôt ou que le service d’enregistrement refuse pour d’autres motifs de procéder à l’enregistrement du modèle d’utilité, il en avise officiellement le déposant en l’invitant à présenter ses observations ou à régulariser la demande dans le délai prescrit.
Si le déposant ne présente pas ses observations ou ne prend pas des mesures pour régulariser la demande dans le délai prescrit, la demande est classée. L’avis officiel visé au premier alinéa doit en porter mention.
L’examen de la demande peut reprendre si, dans les deux mois qui suivent l’expiration du délai officiellement prescrit, le déposant soumet une requête à cet effet, présente ses observations ou prend des mesures pour régulariser la demande et paie la taxe prescrite pour la reprise de la procédure. La procédure d’examen ne peut être reprise qu’une seule fois.
Art. 14. Lorsque le déposant a présenté ses observations en réponse à l’avis officiel mais qu’il subsiste un obstacle s’opposant à l’enregistrement du modèle d’utilité, et si le déposant a eu la faculté de présenter des observations à ce sujet, la demande est rejetée, sauf s’il existe une raison d’envoyer un second avis officiel au déposant.
Art. 15. Lorsqu’une personne autre que le déposant revendique le droit à l’invention auprès du service d’enregistrement et que les circonstances ne paraissent pas claires, le service d’enregistrement peut inviter cette personne à engager une action en justice dans un certain délai, faute de quoi la revendication n’est pas prise en considération.
Lorsqu’une action en revendication d’une invention faisant l’objet d’une demande de modèle d’utilité est en instance devant un tribunal, l’instruction de la demande de modèle d’utilité peut être suspendue jusqu’à ce que la procédure ait donné lieu à une décision définitive.
Art. 16. Lorsqu’une personne prouve devant le service d’enregistrement que c’est à elle, et non au déposant, qu’appartient l’invention, le service lui transfère la demande si elle présente une requête à cet effet. Elle doit alors acquitter une nouvelle taxe de dépôt.
Tant que la requête tendant au transfert de la demande n’a pas fait l’objet d’une décision définitive, la demande ne peut être classée, rejetée, acceptée ou retirée.
Art. 17. Lorsque la demande satisfait aux conditions énoncées aux deuxième et troisième alinéas de l’article premier et aux articles 6 à 11, le modèle d’utilité est inscrit au registre des modèles d’utilité. L’enregistrement est publié dans un avis au public et un certificat d’enregistrement est délivré au déposant.
Art. 18. (8.12.1995/1396) Les pièces de la demande sont rendues accessibles au public à compter de la date d’enregistrement ou, au plus tard, 15 mois après la date à laquelle la demande a été déposée ou est réputée avoir été déposée ou, lorsqu’une priorité est revendiquée, à compter de la date de priorité.
À la requête du déposant, l’enregistrement peut être différé pendant 15 mois au maximum à compter de la date à laquelle la demande a été déposée ou est réputée avoir été déposée ou, lorsqu’une priorité a été revendiquée, à compter de la date de priorité. Si la demande a été écartée ou rejetée, les pièces de la demande ne sont rendues accessibles au public que si le déposant requiert le rétablissement de la demande ou conteste la décision de rejet. L’ajournement de l’enregistrement donne lieu au paiement de la taxe prescrite.
Sur requête du déposant, les pièces de la demande peuvent être rendues accessibles au public plus tôt que prévu au premier alinéa.
Chapitre 3 Possibilité de requérir l’annulation d’un enregistrement Art. 19. Si une invention pour laquelle un modèle d’utilité a été enregistré ou une
demande de modèle d’utilité ne satisfait pas aux conditions énoncées aux deuxième à quatrième alinéas de l’article premier, à l’article2 , au deuxième alinéa de l’article 6, ou aux articles 8 ou 11, toute personne peut présenter une requête en annulation totale ou partielle de l’enregistrement. La requête doit être présentée par écrit au service d’enregistrement et indiquer les motifs sur lesquels elle se fonde. Son auteur doit payer la taxe prescrite, faute de quoi la requête n’est pas examinée.
La requête en annulation d’un enregistrement n’est pas examinée si une action aux fins du transfert de l’enregistrement est en instance.
Art. 20. Le service d’enregistrement doit aviser le titulaire du modèle d’utilité de toute requête présentée en vertu de l’article19et lui donner la possibilité de présenter ses observations dans le délai prescrit. S’il s’agit d’une requête tendant à l’annulation partielle de l’enregistrement, le titulaire doit, dans le même délai, présenter une revendication modifiée au service d’enregistrement. Si le titulaire ne conteste pas la requête dans le délai prescrit, l’enregistrement est déclaré nul en totalité.
Si le titulaire du modèle d’utilité conteste la requête, celle-ci est examinée par le service d’enregistrement.
Art. 21. Lorsque le service d’enregistrement conclut, après examen de la requête, que l’invention à laquelle se rapporte le modèle d’utilité ou que la demande de modèle d’utilité ne satisfait pas aux conditions énoncées aux deuxième à quatrième alinéas de l’article premier, à l’article2 , au deuxième alinéa de k, ou aux articles 8 ou 11 de la loi, l’enregistrement du modèle d’utilité est annulé en tout ou en partie. Si un enregistrement est annulé, la décision est publiée lorsqu’elle est devenue définitive.
Chapitre 4 � Recours �
Art. 22. Le déposant d’une demande de modèle d’utilité ou le titulaire d’un modèle d’utilité peut former un recours contre une décision définitive relative à l’enregistrement ou à l’annulation du modèle d’utilité si cette décision lui est défavorable. En cas de rejet d’une requête en annulation de l’enregistrement du modèle d’utilité, le requérant peut former un recours contre la décision.
Le déposant peut former un recours contre une décision rejetant sa requête aux fins de la reprise de la procédure présentée en vertu du troisième alinéa de l’article13 ou contre une décision accueillant une requête tendant au transfert de la demande présentée en vertu de l’article 16. En cas de rejet d’une requête tendant au transfert de la demande, le requérant peut former un recours contre la décision.
Art. 23. (26.6.1992/580) Le recours contre une décision rendue par le service d’enregistrement en vertu de la présente loi doit être formé devant la Commission des recours de l’Office national des brevets et de l’enregistrement. La procédure de recours et la procédure devant la Commission des recours font l’objet de dispositions distinctes.
Chapitre 5 � Portée et durée de la protection �
Art. 24. La portée de la protection conférée par un modèle d’utilité est déterminée par la revendication. La description et les illustrations peuvent servir à interpréter la revendication.
Art. 25. (8.12.1995/1396) La durée de la protection conférée par l’enregistrement d’un modèle d’utilité est de quatre ans à compter de la date de dépôt de la demande et peut, sur requête, être prorogée deux fois, d’abord pour une période de quatre ans, puis pour une période de deux ans.
Art. 26. Le renouvellement de l’enregistrement doit être demandé par écrit auprès du service d’enregistrement au plus tôt un an et au plus tard six mois après l’expiration de la durée de validité de l’enregistrement. Dans le même délai, le titulaire du modèle d’utilité doit payer la taxe de renouvellement prescrite. Après l’expiration de la durée de
validité de l’enregistrement en cours, la taxe de renouvellement devra être payée avec la surtaxe prescrite. (8.12.1995/1396)
Le renouvellement d’un enregistrement fait l’objet d’une publication.
Chapitre 6 � Cession, licences et licences obligatoires �
Art. 27. Le modèle d’utilité est cessible. Lorsque le titulaire a concédé à un tiers le droit d’exploiter commercialement
l’invention (licence), le preneur de licence ne peut céder son droit à un tiers qu’avec l’accord du titulaire.
Toutefois, si le preneur de licence est une entreprise, la licence peut être cédée avec l’entreprise, sauf convention contraire. Dans ce cas, l’exécution des obligations découlant du contrat de licence continue d’incomber au cédant.
Art. 28. La cession d’un modèle d’utilité ou la concession d’une licence est, sur requête et moyennant le paiement de la taxe prescrite, inscrite au registre des modèles d’utilité. Il en est de même du nantissement d’un modèle d’utilité. Sur présentation d’une pièce prouvant que la licence ou le nantissement inscrit au registre a pris fin, la mention correspondante est radiée du registre.
Le premier alinéa est applicable par analogie aux licences obligatoires et au droit visé au premier alinéa de l’article32.
La dernière personne inscrite au registre en tant que titulaire du modèle d’utilité est réputée telle aux fins de toute action en justice et de tous actes concernant le modèle d’utilité.
Art. 29. Lorsqu’une personne a demandé de bonne foi au service d’enregistrement d’inscrire au registre qu’un modèle d’utilité lui a été cédé ou qu’elle a obtenu la concession d’une licence ou la constitution d’un nantissement sur un modèle d’utilité, une cession antérieure du modèle d’utilité ou de droits sur le modèle d’utilité ne lui est pas opposable si l’autre partie n’avait pas demandé antérieurement l’inscription de son acquisition au registre des modèles d’utilité.
Art. 30. Lorsque deux ans se sont écoulés depuis l’enregistrement du modèle d’utilité et que l’invention n’a pas été exploitée ou qu’il n’en a pas été fait une utilisation suffisante en Finlande, toute personne qui souhaite y exploiter l’invention peut obtenir une licence obligatoire à cet effet, à moins que le défaut d’exploitation ne soit justifié par des motifs légitimes. Les dispositions des articles 46à 50 de la loi sur les brevets relatives aux licences obligatoires d’exploitation d’une invention protégée par un brevet sont applicables par analogie aux modèles d’utilité.
Chapitre 7 � Expiration du modèle d’utilité et obligation de fournir des �
renseignements � Art. 31. Lorsqu’un modèle d’utilité a été enregistré au nom d’une personne autre
que celle qui y avait droit en vertu de l’article premier et que l’ayant droit intente une action à cet effet, le tribunal doit lui transférer le modèle d’utilité.
L’action doit être intentée dans un délai d’un an à compter de la date à laquelle le demandeur a eu connaissance de l’enregistrement et de toutes autres circonstances sur lesquelles est fondée l’action. Elle se prescrit par trois ans à compter de l’enregistrement du modèle d’utilité si le titulaire de l’enregistrement était de bonne foi au moment où le modèle d’utilité a été enregistré à son nom ou lui a été cédé.
Art. 32. Si la personne dont l’enregistrement est transféré en vertu de l’article 31 avait, de bonne foi, commencé à exploiter commercialement l’invention en Finlande ou fait des préparatifs importants à cet effet, elle peut, moyennant le paiement d’une indemnité raisonnable et à des conditions par ailleurs raisonnables, poursuivre ou commencer l’exploitation, à condition que celle-ci conserve ses caractères généraux. Le preneur d’une licence inscrite au registre des modèles d’utilité bénéficie du même droit sous réserve des mêmes conditions.
Le droit prévu à l’alinéa précédent ne peut être cédé qu’avec l’entreprise dans laquelle il est exploité ou dans laquelle il est prévu de l’exploiter.
Art. 33. Si le titulaire d’un modèle d’utilité informe par écrit le service d’enregistrement qu’il renonce à l’enregistrement, le service d’enregistrement radie du registre le modèle d’utilité.
Si un modèle d’utilité a été saisi pour dettes ou est grevé d’un nantissement inscrit au registre, ou si une action aux fins du transfert de l’enregistrement est en instance, le modèle d’utilité ne peut être radié du registre sur requête du titulaire aussi longtemps que la saisie ou le nantissement n’a pas fait l’objet d’une mainlevée ou que l’action n’a pas donné lieu à une décision définitive.
Art. 34. Lorsqu’un enregistrement de modèle d’utilité a été transféré par décision judiciaire ayant acquis force de chose jugée, le service d’enregistrement porte ce fait à la connaissance du public.
Art. 35. Les dispositions de l’article 56 de la loi sur les brevets relatives à l’obligation de fournir des renseignements sur un brevet sont applicables par analogie aux modèles d’utilité.
Chapitre 8 � Responsabilité, obligation d’indemnisation et procédures �
judiciaires � Art. 36. Le tribunal peut interdire à quiconque viole le droit exclusif conféré par un
modèle d’utilité de continuer ou de recommencer à le faire.
Art. 37. Quiconque, intentionnellement ou par négligence, porte atteinte à un modèle d’utilité est tenu au versement d’une indemnité raisonnable pour l’exploitation de l’invention et de dommages intérêts pour tous autres préjudices résultant de la violation. Si la négligence a été légère, l’indemnité peut être réduite en conséquence.
Quiconque porte atteinte à un modèle d’utilité sans intention ni négligence est tenu au versement d’une indemnité pour l’exploitation de l’invention dans la mesure jugée raisonnable.
Une indemnité et des dommages intérêts ne peuvent être réclamés, en cas d’atteinte au modèle d’utilité, que pour la période de cinq ans précédant l’introduction de l’action. Si une action n’est pas introduite durant cette période, le droit à l’indemnité et aux dommages-intérêts cesse d’exister.
Art. 38. Les dispositions de l’article 59 de la loi sur les brevets relatives à l’action en cessation sont applicables par analogie aux modèles d’utilité.
Art. 39. Quiconque enfreint volontairement un droit exclusif concernant un modèle d’utilité est passible, sauf si cet acte est constitutif du délit d’atteinte à un droit de propriété industrielle prévu à l’article 2 du chapitre 49 du code pénal, d’une amende pour violation d’un droit relatif à un modèle d’utilité. Les poursuites de ce chef ne peuvent être engagées par le ministère public que sur plainte de la partie lésée.
Art. 40. Quiconque, intentionnellement ou par négligence autre que légère, manque à l’obligation de fournir des renseignements qui lui incombe en vertu de l’article 35 est passible de ce chef d’une peine d’amende. Quiconque, dans les cas visés audit article, fournit de faux renseignements est passible de la même peine sauf si cet acte est déjà réprimé par le code pénal.
Les poursuites de ce chef ne peuvent être engagées par le ministère public que sur plainte de la partie lésée.
Art. 41. Si l’enregistrement d’un modèle d’utilité a été annulé par une décision définitive, le tribunal ne peut prononcer aucune peine, ni ordonner le versement d’aucune indemnité en vertu de l’article 2 du chapitre 49 du code pénal ou des articles 36 à 39 de la présente loi. (21.4.1995/720)
Si, au cours d’une action intentée pour atteinte à un modèle d’utilité, le défendeur allègue que l’enregistrement est contraire aux dispositions de la présente loi, le tribunal peut, sur sa requête, suspendre la procédure jusqu’à ce qu’une décision définitive ait été rendue sur l’exception d’invalidité. Si le défendeur n’a pas demandé l’annulation de l’enregistrement au service d’enregistrement, le tribunal doit, lorsqu’il suspend la procédure, lui ordonner de le faire dans le délai qu’il fixe.
Art. 42. Quiconque veut intenter une action en vue du transfert d’un modèle d’utilité ou de la concession d’une licence obligatoire doit en aviser le service d’enregistrement et en donner notification à toutes les personnes inscrites au registre des modèles d’utilité en tant que preneurs de licence ou bénéficiaires d’un nantissement sur ce modèle d’utilité. Si un preneur de licence veut intenter une action pour atteinte à un modèle d’utilité, il doit notifier son intention au titulaire du modèle d’utilité.
L’obligation de notifier visée au premier alinéa est réputée remplie lorsque la notification est adressée par lettre recommandée aux adresses figurant au registre des modèles d’utilité.
Si le demandeur n’est pas en mesure de prouver, dans une action, qu’il a envoyé une notification ou un avis conformément au premier alinéa, le tribunal lui impartit un délai à cet effet. L’inobservation du délai entraîne l’irrecevabilité de l’action.
Art. 43. Le Tribunal de district d’Helsinki est compétent pour connaître des actions relatives
1) � au droit à une invention pour laquelle un modèle d’utilité a été demandé;
2) � au transfert d’un modèle d’utilité;
3) � à la concession d’une licence obligatoire, à la modification des conditions d’une telle licence ou à la révocation d’un droit visé au premier alinéa de l’article 32;
4) � à l’atteinte à un modèle d’utilité ou à l’inobservation de l’obligation de fournir des renseignements relatifs à un modèle d’utilité; et
5) � au calcul du montant de l’indemnité et des dommages intérêts dus en vertu de l’article 37.
Art. 44. Les dispositions des articles 66 et 67 de la loi sur les brevets sont applicables par analogie aux actions visées à l’article43 .
Art. 45. Une expédition des décisions rendues en vertu de l’article43 est transmise par le tribunal au service d’enregistrement avec une mention relative à l’entrée en force de chose jugée de la décision.
Chapitre 8a � Demandes internationales (8.12.1995/1396) �
Art. 45a. (8.12.1995/1396) Dans la présente loi, on entend par «demande internationale» une demande de modèle d’utilité déposée conformément au Traité de coopération en matière de brevets5 (Série des traités finlandais no 58/80).
Les demandes internationales doivent être déposées auprès d’un service d’enregistrement ou d’une organisation internationale (office récepteur) habilité à les recevoir en vertu du Traité de coopération en matière de brevets et de son règlement d’exécution6. En Finlande, l’office récepteur est l’Office national des brevets et de l’enregistrement, en vertu d’un décret du gouvernement. Les déposants de demandes internationales de modèle d’utilité en Finlande doivent payer les taxes prescrites.

Sauf dispositions contraires des articles 45b à 45f, les dispositions du chapitre 3 de la loi sur les brevets concernant l’instruction des demandes internationales de brevet s’appliquent mutatis mutandis à l’instruction des demandes internationales de modèle d’utilité désignant la Finlande.
Art. 45b. (8.12.1995/1396) Une demande internationale de modèle d’utilité à laquelle un office récepteur a attribué une date de dépôt international produit les mêmes effets en Finlande qu’une demande finlandaise de modèle d’utilité déposée à la même date. La deuxième phrase du deuxième alinéa de l’article2 ne s’applique qu’aux demandes internationales pour lesquelles la procédure est poursuivie conformément aux dispositions de l’article 45d.
Art. 45c. (8.12.1995/1396) Une demande internationale de modèle d’utilité est réputée retirée en ce qui concerne la désignation de la Finlande dans les cas prévus à l’article 24.1)i) et ii) du Traité de coopération en matière de brevets.
Art. 45d. (8.12.1995/1396) Lorsqu’un déposant souhaite que la procédure relative à une demande internationale de modèle d’utilité soit poursuivie en Finlande, il doit déposer auprès de l’administration des brevets une traduction en finnois ou en suédois de la demande internationale dans les 20 mois suivant la date de dépôt international ou, lorsqu’une priorité est revendiquée, suivant la date de priorité, ou une copie de la demande lorsqu’elle est rédigée en finnois ou en suédois. Dans le même délai, il doit payer au service d’enregistrement la taxe d’enregistrement prescrite.
Lorsqu’un déposant a demandé que sa demande internationale de modèle d’utilité fasse l’objet d’un examen préliminaire international et que, dans les 19 mois suivant la date visée au premier alinéa du présent article, il a déclaré, conformément au Traité de coopération en matière de brevets et à son règlement d’exécution, qu’il a l’intention d’utiliser les résultats de l’examen préliminaire international pour demander la délivrance d’un modèle d’utilité en Finlande, il doit satisfaire aux conditions du premier alinéa dans les 30 mois suivant cette date.
Si le déposant a payé la taxe d’enregistrement prescrite dans le délai prévu au premier ou au deuxième alinéa, il peut déposer la traduction requise ou une copie de la demande dans un nouveau délai de deux mois, à condition de payer dans le même délai la taxe additionnelle prescrite.
Si, dans les cas visés au premier et au deuxième alinéas du présent article, la demande ne satisfait pas aux conditions de la présente loi, le déposant peut, dans un délai de deux mois à compter des dates visées au premier et au deuxième alinéas, régulariser la demande pour la rendre conforme aux conditions prescrites, en ce qui concerne la forme et le contenu, par le règlement d’exécution du Traité de coopération en matière de brevets. Si le déposant ne satisfait pas aux exigences du présent article, la demande est réputée retirée en ce qui concerne la Finlande.
Art. 45e. (8.12.1995/1396) Lorsque le déposant retire sa demande d’examen préliminaire international ou la déclaration indiquant son intention d’utiliser les résultats de cet examen pour demander un modèle d’utilité en Finlande, la demande internationale de modèle d’utilité est réputée retirée en ce qui concerne la Finlande. Toutefois, la demande n’est pas réputée retirée si le retrait est effectué avant l’expiration du délai
prévu au premier alinéa de l’article45d et si le déposant demande aussi la poursuite de la procédure relative à sa demande dans le délai fixé au premier, troisième ou quatrième alinéa de l’article 45d.
Art. 45f. (8.12.1995/1396) Lorsque la procédure relative à une demande internationale a été poursuivie conformément aux dispositions de l’article 45d, les dispositions des chapitres 2 et 5 s’appliquent à la demande et à la poursuite de la procédure, sauf dispositions contraires du présent article ou des articles 34 à 38 de la loi sur les brevets. Toutefois, la poursuite de la procédure relative à la demande ne peut commencer avant l’expiration du délai prévu aux premier et deuxième alinéas de l’article 45d que sur requête du déposant.
Le déposant n’est pas tenu de constituer un mandataire domicilié en Finlande conformément à l’article 10avant la date à laquelle la procédure relative à la demande peut se poursuivre.
Lorsque 18 mois se sont écoulés depuis la date de dépôt de la demande ou, si une priorité est revendiquée, depuis la date de priorité, et que le déposant a satisfait à l’obligation que lui impose l’article 45d de remettre une traduction ou, lorsque la demande a été rédigée en finnois ou en suédois, de remettre une copie de la demande au service d’enregistrement, les documents relatifs à la demande sont rendus accessibles au public avant même que le déposant ait demandé la poursuite de la procédure.
Chapitre 9 � Dispositions spéciales �
Art. 46. (13.11.1992/1037) Le montant des taxes payables en vertu de la présente loi fait l’objet de dispositions distinctes.
Art. 47. Des dispositions plus détaillées relatives aux demandes de modèle d’utilité, au registre des modèles d’utilité et au service d’enregistrement seront édictées par décret du gouvernement. Le service d’enregistrement pourra édicter un règlement détaillé relatif aux demandes de modèle d’utilité et à leur instruction.
Art. 48. Les dispositions de l’article 75 de la loi sur les brevets relatives à l’obligation de dévolution du droit à une invention et à l’indemnité due dans ce cas sont applicables par analogie aux modèles d’utilité.
Des dispositions spéciales s’appliqueront aux inventions importantes pour la défense de la Finlande. (8.12.1995/1396)
Chapitre 10 � Entrée en vigueur et dispositions transitoires �
Art. 49. La présente loi entrera en vigueur à une date qui sera fixée par décret du gouvernement.
Les demandes déposées avant l’entrée en vigueur de la loi ne peuvent pas servir de base à une revendication de priorité en vertu de l’article5 .
Les demandes de brevet déposées ou réputées déposées avant l’entrée en vigueur de la présente loi ne peuvent pas être transformées en demandes de modèle d’utilité en vertu de l’article 8.

hyödyllisyysmallioikeudesta
Eduskunnan päätöksen mukaisesti säädetään:
1 luku
Yleiset säännökset
1§
Se, joka on tehnyt keksinnön, tai se, jolle keksijän oikeus on siirtynyt, voi hakemuksesta
saada hyödyllisyysmallioikeuden keksintöön ja siten yksinoikeuden sen ammattimaiseen
hyväksikäyttöön sen mukaan kuin tässä laissa säädetään.
Keksinnöllä tarkoitetaan tässä laissa esineen muotona, rakenteena tai niiden yhdistelmänä
toteutuvaa teknistä ratkaisua, jota voidaan käyttää teollisesti.
Hyödyllisyysmallioikeutta ei voi saada keksintöön, jonka hyväksikäyttö on siveellisyyden tai
yleisen järjestyksen vastaista.
2§
Keksinnön tulee olla uusi siihen verrattuna, mikä on tullut tunnetuksi ennen
hyödyllisyysmallioikeuden hakemispäivää, ja lisäksi selvästi erota siitä.
Tunnetuksi katsotaan kaikki, mikä on tullut julkiseksi, joko kirjoituksen tai esitelmän
välityksellä, hyväksi käyttämällä tai muulla tavalla. Myös ennen hyödyllisyysmallioikeuden
hakemispäivää tässä maassa tehdyn hyödyllisyysmallioikeutta koskevan hakemuksen,
patenttihakemuksen ja mallioikeushakemuksen sisältö katsotaan tunnetuksi, jos mainittu
hakemus tämän lain 18§:n, patenttilain 22§:n tai mallioikeuslain 19§:n säännösten mukaisesti
tulee julkiseksi. Edellä 1 momentissa olevaa säännöstä, jonka mukaan keksinnön tulee selvästi
erota siitä, mikä on tullut tunnetuksi ennen hyödyllisyysmallioikeuden hakemispäivää, ei
tällöin sovelleta.
Hyödyllisyysmalli voidaan rekisteröidä, vaikka keksintö on kuuden kuukauden kuluessa
ennen hakemuksen tekemistä tullut julkiseksi:
1) sellaisen ilmeisen väärinkäytöksen johdosta, joka on kohdistunut hakijaan tai siihen, jolta
tämä johtaa oikeutensa; tai
2) sen johdosta, että hakija tai se, jolta tämä johtaa oikeutensa, on pannut keksinnön näytteille
sellaisessa virallisessa tai virallisesti tunnustetussa kansainvälisessä näyttelyssä, jota
tarkoitetaan kansainvälisiä näyttelyjä koskevassa sopimuksessa (SopS 36/37).
3§
Hyödyllisyysmallin rekisteröinnillä saavutettu yksinoikeus sisältää jäljempänä säädetyin
poikkeuksin sen, ettei muu kuin hyödyllisyysmallioikeuden haltija ilman tämän lupaa saa
käyttää hyväkseen keksintöä valmistamalla, tarjoamalla, saattamalla vaihdantaan tai
käyttämällä hyödyllisyysmallioikeudella suojattua tuotetta tai tuomalla maahan tai pitämällä
hallussaan tällaista tuotetta edellä sanottua tarkoitusta varten.
Yksinoikeus ei käsitä:
1) hyväksikäyttöä, joka ei ole ammattimaista;
2) sellaisen hyödyllisyysmallioikeudella suojatun tuotteen hyväksikäyttöä, joka tässä maassa
on saatettu vaihdantaan hyödyllisyysmallioikeuden haltijan toimesta tai tämän suostumuksella;
eikä
3) keksinnön käyttöä kokeissa, jotka koskevat itse keksintöä.
4§
Mitä patenttilain 4 ja 5§:ssä on säädetty keksinnön ammattimaisesta hyväksikäytöstä tai
hyväksikäytöstä ulkomaisessa aluksessa, ilmaaluksessa tai muussa kulkuneuvossa niiden
tarpeisiin, koskee soveltuvin osin tässä laissa tarkoitettua keksintöä.
5§
Hyödyllisyysmallioikeutta koskeva hakemus, jonka tarkoittama keksintö on hakemispäivää
edeltävän kahdentoista kuukauden aikana esitetty Suomessa myönnettävää patenttia tai
hyödyllisyysmallin rekisteröintiä koskevassa hakemuksessa, taikka teollisoikeuden
suojelemista koskevaan Pariisin yleissopimukseen (SopS 36/70 ja 43/75) liittyneessä toisessa
valtiossa tehdyssä patenttia, keksijäntodistusta tai hyödyllisyysmallisuojaa koskevassa
hakemuksessa, on katsottava 2§:n 1 ja 2 momenttia sekä 4§:ää sovellettaessa tehdyksi
samanaikaisesti aikaisemman hakemuksen kanssa, jos hakija sitä pyytää. Tällainen etuoikeus
voidaan saada myös sellaisesta aikaisemmasta suojahakemuksesta, joka ei tarkoita
yleissopimukseen liittynyttä valtiota, jos siellä, missä aikaisempi hakemus on tehty,
myönnetään suomalaisesta hakemuksesta vastaava etuoikeus ja jos siellä voimassa oleva
lainsäädäntö on pääosin yhdenmukainen yleissopimuksen kanssa.
Asetuksella säädetään tai asetuksen nojalla annettavalla rekisteriviranomaisen päätöksellä
määrätään, miten etuoikeutta koskeva pyyntö on esitettävä ja mitkä asiakirjat on annettava
pyynnön tueksi.
2 luku
Hyödyllisyysmallihakemus ja sen käsittely
6§
Hyödyllisyysmallioikeutta koskeva hakemus, jäljempänä hyödyllisyysmallihakemus, tehdään
kirjallisesti patentti ja rekisterihallitukselle, joka toimii rekisteriviranomaisena.
Hakemuksen tulee sisältää keksinnön selitys ja tarvittavat kuvat sekä täsmällisesti ilmaistuna
se, mitä hyödyllisyysmallioikeudella halutaan suojata (suojavaatimus). Asetuksella annetaan
tarkempia säännöksiä hakemukseen liitettävistä kuvista. Selityksen tulee olla niin selvä, että
ammattimies voi sen perusteella käyttää keksintöä.
Hakemuksessa on ilmoitettava keksijän nimi. Jos hyödyllisyysmallioikeutta hakee muu kuin
keksijä, hakijan on selvitettävä oikeutensa keksintöön.
7§
Keksinnön selitys ja suojavaatimus on laadittava suomeksi tai ruotsiksi voimassa olevan
kielilainsäädännön mukaan. Milloin suojavaatimus on laadittu vain toisella kotimaisella
kielellä, rekisteriviranomaisen on huolehdittava suojavaatimuksen kääntämisestä toiselle
näistä kielistä ennen kuin hyödyllisyysmalli rekisteröidään. Hakijan on suoritettava
vahvistettu käännösmaksu. Jos hakija on ulkomaalainen, keksinnön selitys on laadittava
suomeksi ja suojavaatimus suomeksi ja ruotsiksi. Jokaisella on kuitenkin oikeus laatia
keksinnön selitys ja suojavaatimus sekä suomeksi että ruotsiksi.
Hakijan on suoritettava vahvistettu rekisteröintimaksu. Hakemus katsotaan tehdyksi vasta kun
maksu on suoritettu.
8§
Hyödyllisyysmallihakemus voidaan tehdä myös muuntamalla samaa keksintöä koskeva
vireillä oleva patenttihakemus hyödyllisyysmallihakemukseksi, jolloin
hyödyllisyysmallihakemus katsotaan tehdyksi samana päivänä kuin patenttihakemus.
Muuntamista ei kuitenkaan voida tehdä enää sen jälkeen, kun kahdeksan vuotta on kulunut
siitä päivästä, jona patenttihakemus katsotaan tehdyksi. Tällaista hyödyllisyysmallihakemusta
tehtäessä on muutoin noudatettava mitä hyödyllisyysmallihakemuksen tekemisestä on
säädetty.
9§
Samassa hakemuksessa ei saa hakea hyödyllisyysmallioikeutta kahteen tai useampaan
keksintöön.
10§
Hyödyllisyysmallioikeuden hakijalla ja haltijalla, jolla ei ole kotipaikkaa Suomessa, tulee olla
täällä asuva asiamies, joka on oikeutettu edustamaan häntä kaikissa hakemusta ja rekisteröityä
hyödyllisyysmallia koskevissa asioissa.
11§
Hyödyllisyysmallihakemusta ei saa muuttaa siten, että hyödyllisyysmallioikeus tulisi
koskemaan jotakin, mikä ei käynyt selville alkuperäisestä hakemuksesta.
12§
Rekisteriviranomainen tarkastaa, että hakemus täyttää 1§:n 2 ja 3 momentin sekä 611§:n
vaatimukset.
Rekisteriviranomainen luokittelee hakemuksen.
13§
Jos hakija ei ole noudattanut hakemusta koskevia säännöksiä tai viranomainen havaitsee
olevan muita esteitä hyödyllisyysmallin rekisteröinnille, hakijaa on välipäätöksessä
kehotettava määräajassa antamaan lausumansa tai korjaamaan puutteellisuuden.
Jollei hakija välipäätöksessä määrätyn ajan kuluessa anna lausumaa tai ryhdy toimenpiteisiin
korjatakseen puutteellisuuden, josta on huomautettu, hakemus on jätettävä sillensä. Edellä 1
momentin mukaan annetussa välipäätöksessä on ilmoitettava tästä seuraamuksesta.
Sillensä jätetty hakemus otetaan uudelleen käsiteltäväksi, mikäli hakija kahden kuukauden
kuluessa välipäätöksessä määrätyn ajan päättymisestä sitä pyytää sekä antaa lausumansa tai
ryhtyy toimenpiteisiin puutteellisuuden korjaamiseksi ja saman ajan kuluessa suorittaa
vahvistetun uudelleenkäsittelymaksun. Uudelleen käsiteltäväksi ottaminen voi tapahtua vain
kerran.
14§
Jos hakijan antaman lausuman jälkeen vielä on olemassa este hyödyllisyysmallin
rekisteröinnille ja hakijalla on ollut tilaisuus antaa lausumansa esteestä, on hakemus hylättävä,
jollei ole aihetta antaa hakijalle uutta välipäätöstä.
15§
Jos joku väittää rekisteriviranomaiselle, että hänellä on parempi oikeus keksintöön kuin
hakijalla, ja jos asiaa pidetään epäselvänä, viranomainen voi välipäätöksessä kehottaa häntä
nostamaan kanteen tuomioistuimessa määrätyn ajan kuluessa uhalla, että väite jätetään
huomioon ottamatta.
Jos tuomioistuimessa on vireillä riita paremmasta oikeudesta keksintöön,
hyödyllisyysmallihakemuksen käsittely voidaan keskeyttää siihen asti, kunnes asia on
lopullisesti ratkaistu.
16§
Jos joku rekisteriviranomaiselle näyttää, että hänellä on parempi oikeus keksintöön kuin
hakijalla, rekisteriviranomaisen tulee hänen vaatimuksestaan siirtää hakemus hänelle. Samalla
hänen on suoritettava uusi rekisteröintimaksu.
Ennen kuin siirtovaatimus on lopullisesti ratkaistu, hakemusta ei saa jättää sillensä, hylätä,
hyväksyä eikä peruuttaa.
17§
Jos hakemus täyttää 1§:n 2 ja 3 momentin sekä 611§:n vaatimukset, hyödyllisyysmalli
merkitään hyödyllisyysmallirekisteriin. Rekisteröinnistä on kuulutettava ja hakijalle annettava
rekisteröintitodistus.
18§
Hakemusta koskevat asiakirjat ovat julkisia rekisteröintipäivästä lukien.
3 luku
Mahdollisuus vaatia rekisteröinnin mitättömäksi julistamista
19§
Jos keksintö, jota hyödyllisyysmallioikeus koskee, tai hyödyllisyysmallioikeutta koskeva
hakemus ei täytä 1§:n 2 tai 3 momentissa, 2§:ssä, 6§:n 2 momentissa taikka 8, 9 tai 11§:ssä
säädettyjä vaatimuksia, kuka tahansa voi esittää vaatimuksen hyödyllisyysmallin
rekisteröinnin julistamisesta kokonaan tai osittain mitättömäksi.
Vaatimus tulee tehdä rekisteriviranomaiselle kirjallisesti ja siinä tulee esiintuoda ne seikat,
joihin vaatimus perustuu. Vaatimuksen tekijän on suoritettava vahvistettu maksu. Jollei
maksua suoriteta, ei vaatimusta oteta tutkittavaksi.
Vaatimusta rekisteröinnin julistamisesta mitättömäksi ei saa käsitellä, jos riita rekisteröinnin
siirtämisestä on vireillä.
20§
Rekisteriviranomaisen on tiedotettava 19§:n nojalla tehdystä vaatimuksesta
hyödyllisyysmallioikeuden haltijalle ja varattava hänelle tilaisuus antaa lausumansa
määräajan kuluessa. Jos on kysymys rekisteröinnin osittaisesta mitätöimisestä, tulee haltijan
esittää viranomaiselle uudelleen muotoiltu suojavaatimus saman määräajan kuluessa. Jos hän
ei annetun määräajan kuluessa vastusta vaatimusta, rekisteröinti julistetaan kokonaan
mitättömäksi.
Jos hyödyllisyysmallioikeuden haltija vastustaa vaatimusta, rekisteriviranomaisen on
tutkittava esitetty vaatimus.
21§
Jos rekisteriviranomainen vaatimuksen johdosta toteaa, että keksintö jota
hyödyllisyysmallioikeus koskee, tai hyödyllisyysmallioikeutta koskeva hakemus ei täytä lain
1§:n 2 tai 3 momentissa, 2§:ssä, 6§:n 2 momentissa taikka 8, 9 tai 11§:ssä säädettyjä
vaatimuksia, hyödyllisyysmallin rekisteröinti on julistettava kokonaan tai osittain
mitättömäksi.
Jos rekisteröinti julistetaan mitättömäksi, on päätöksestä kuulutettava sen saatua lainvoiman.
4 luku
Muutoksenhaku
22§
Hyödyllisyysmallin rekisteröintiä tai mitättömäksijulistamisvaatimusta koskevaan lopulliseen
päätökseen hakija tai hyödyllisyysmallioikeuden haltija voi hakea muutosta, jos päätös on
hänelle kielteinen. Se, joka on esittänyt vaatimuksen hyödyllisyysmallin rekisteröinnin
julistamisesta mitättömäksi, voi hakea muutosta päätökseen, jolla vaatimus on hylätty.
Päätökseen, jolla 13§:n 3 momentissa tarkoitettu pyyntö hakemuksen ottamisesta uudelleen
käsiteltäväksi on hylätty tai 16§:ssä tarkoitettu vaatimus hakemuksen siirtämisestä hyväksytty,
hakija voi hakea muutosta. Päätökseen, jolla vaatimus hakemuksen siirtämisestä on hylätty,
vaatimuksen tekijä voi hakea muutosta.
23§
Muutosta rekisteriviranomaisen tämän lain nojalla antamaan päätökseen haetaan valittamalla
patentti ja rekisterihallituksen valitusosastoon 60 päivän kuluessa siitä päivästä, jona päätös
on annettu asianomaiselle tiedoksi. Saman ajan kuluessa valittajan on suoritettava vahvistettu
valitusmaksu uhalla, ettei valitusta oteta tutkittavaksi.
Muutosta valitusosaston päätökseen haetaan valittamalla korkeimpaan hallintooikeuteen 60
päivän kuluessa siitä päivästä, jona päätös on annettu asianomaiselle tiedoksi.
5 luku
Suojan laajuus ja voimassaoloaika
24§
Suojavaatimus määrää hyödyllisyysmallisuojan laajuuden. Suojavaatimusta tulkittaessa
voidaan selitystä ja kuvia käyttää apuna.
25§
Hyödyllisyysmallin rekisteröinti on voimassa neljä vuotta rekisteröinnin hakemispäivästä ja
se voidaan hakemuksesta uudistaa kerran neljäksi vuodeksi.
26§
Rekisteröinnin uudistamista haetaan kirjallisesti rekisteriviranomaiselta aikaisintaan vuotta
ennen rekisteröintikauden päättymistä ja viimeistään kuuden kuukauden kuluessa sen
päättymisen jälkeen. Saman ajan kuluessa on suoritettava vahvistettu uudistamismaksu.
Rekisteröinnin uudistamisesta on kuulutettava.
6 luku
Luovutus sekä käyttö ja pakkolupa
27§
Hyödyllisyysmallioikeus voidaan luovuttaa toiselle.
Milloin toiselle on annettu oikeus ammattimaisesti käyttää hyväksi keksintöä (käyttölupa),
tämä saa luovuttaa oikeutensa edelleen ainoastaan jos siitä on sovittu.
Milloin käyttölupa kuuluu liikkeeseen, saadaan se kuitenkin luovuttaa liikkeen mukana, jollei
muuta ole sovittu. Tällöin luovuttaja vastaa edelleen siitä, että käyttöluvan ehtoja noudatetaan.
28§
Milloin hyödyllisyysmallioikeus on siirtynyt toiselle tai sen käyttölupa on luovutettu, siitä on
pyynnöstä vahvistettua maksua vastaan tehtävä merkintä hyödyllisyysmallirekisteriin. Sama
koskee hyödyllisyysmallioikeuden panttausta. Jos näytetään, että rekisteriin merkitty
käyttölupa tai panttioikeus on lakannut olemasta voimassa, merkintä on poistettava
rekisteristä.
Mitä 1 momentissa on säädetty, on vastaavasti sovellettava pakkolupaan ja 32§:n 1
momentissa tarkoitettuun oikeuteen.
Hyödyllisyysmallia koskevissa riita ja muissa asioissa katsotaan hyödyllisyysmallioikeuden
haltijaksi se, joka sellaisena on viimeksi merkitty hyödyllisyysmallirekisteriin.
29§
Milloin joku on pyytänyt rekisteriin merkittäväksi, että hyödyllisyysmallioikeus on siirtynyt
hänelle tai että hän on saanut hyödyllisyysmalliin käyttöluvan tai panttioikeuden ja jos hän
silloin oli oikeuteensa nähden vilpittömässä mielessä, ei hyödyllisyysmallioikeuden tai
hyödyllisyysmallia koskevan muun oikeuden aikaisempi luovutus toiselle ole voimassa häntä
vastaan, ellei toinen sitä ennen ollut pyytänyt saantonsa merkitsemistä
hyödyllisyysmallirekisteriin.
30§
Milloin kaksi vuotta on kulunut hyödyllisyysmallin rekisteröinnistä, eikä keksintöä käytetä
tässä maassa kohtuullisessa laajuudessa, voi se, joka haluaa täällä käyttää keksintöä, saada
siihen pakkoluvan, jollei keksinnön käyttämättä jättämiseen ole hyväksyttävää syytä.
Mitä patenttilain 4650§:ssä on säädetty pakkoluvasta patentilla suojatun keksinnön
hyväksikäyttöön, noudatetaan vastaavasti hyödyllisyysmallioikeuteen.
7 luku
Hyödyllisyysmallioikeuden lakkaaminen ja hyödyllisyysmallia koskeva
ilmoitusvelvollisuus
31§
Jos hyödyllisyysmalli on rekisteröity muulle kuin 1§:n mukaan siihen oikeutetulle,
tuomioistuimen on hyödyllisyysmalliin oikeutetun kanteesta siirrettävä se hänelle.
Kanne on pantava vireille vuoden kuluessa siitä, kun kantaja on saanut tiedon rekisteröinnistä
ja muista kanteen perusteena olevista seikoista. Jos hyödyllisyysmallioikeuden haltija on ollut
vilpittömässä mielessä, kun hyödyllisyysmalli rekisteröitiin tai se siirtyi hänelle, kannetta ei
saa panna vireille myöhemmin kuin kolme vuotta hyödyllisyysmallin rekisteröinnin jälkeen.
32§
Jos se, jolta rekisteröinti 31§:n mukaisesti siirretään, on ollut vilpittömässä mielessä
alkaessaan ammattimaisesti käyttää hyödyllisyysmallia tässä maassa tai ryhtyessään sitä
varten olennaisiin toimenpiteisiin, hän saa kohtuullisesta vastikkeesta ja muutoin
kohtuullisilla ehdoilla jatkaa hyödyllisyysmallin hyväksikäyttöä tai aloittaa aiotun
hyväksikäytön pysyttämällä sen yleinen luonne. Sellainen oikeus on vastaavilla edellytyksillä
rekisteriin merkityn käyttöluvan haltijalla.
Edellä 1 momentissa tarkoitettu oikeus voi siirtyä toiselle ainoastaan sen liikkeen mukana,
jossa sitä käytetään hyväksi tai jossa se oli tarkoitettu hyväksikäytettäväksi.
33§
Jos hyödyllisyysmallioikeuden haltija kirjallisesti ilmoittaa luopuvansa rekisteröinnistä,
rekisteriviranomaisen on poistettava hyödyllisyysmalli rekisteristä.
Jos hyödyllisyysmallioikeus on ulosmitattu tai siihen on olemassa rekisteriin merkitty
panttioikeus tai riita rekisteröinnin siirtämisestä toiselle on vireillä, hyödyllisyysmallia ei saa
haltijan pyynnöstä poistaa rekisteristä niin kauan kuin ulosmittaus tai panttioikeus on
voimassa tai riita ei ole lopullisesti ratkaistu.
34§
Kun hyödyllisyysmallin rekisteröinti on lainvoimaisella tuomiolla siirretty toiselle,
rekisteriviranomaisen on kuulutettava siitä.
35§
Mitä patenttilain 56§:ssä on säädetty patenttia koskevasta ilmoitusvelvollisuudesta,
noudatetaan vastaavasti hyödyllisyysmallioikeuteen.
8 luku
Vastuu, korvausvelvollisuus ja tuomioistuinmenettely
36§
Jos joku loukkaa hyödyllisyysmallioikeuden tuottamaa yksinoikeutta, tuomioistuin voi kieltää
häntä jatkamasta tai toistamasta tekoa.
37§
Joka tahallaan tai tuottamuksesta loukkaa hyödyllisyysmallioikeutta, on velvollinen
suorittamaan kohtuullisen korvauksen keksinnön hyväksi käyttämisestä sekä korvauksen
muusta vahingosta, jonka loukkaus on aiheuttanut. Jos tuottamus on vähäinen, voidaan
vahingonkorvausta sovitella.
Milloin hyödyllisyysmallioikeuden loukkaus ei ole tahallinen eikä tuottamuksellinen,
loukkaaja on velvollinen suorittamaan korvausta keksinnön hyväksi käyttämisestä siinä
määrin kuin se katsotaan kohtuulliseksi.
Hyödyllisyysmallioikeuden loukkauksen perusteella voidaan korvausta vahingosta vaatia
ainoastaan viiden viimeisen vuoden ajalta ennen kanteen vireille panoa. Oikeus korvaukseen
vahingosta, jota koskevaa kannetta ei ole pantu vireille sanotun ajan kuluessa, on menetetty.
38§
Mitä patenttilain 59§:ssä on säädetty toimista jatketun loukkauksen estämiseksi, noudatetaan
vastaavasti hyödyllisyysmalleihin.
39§
Joka loukkaa tahallaan hyödyllisyysmallioikeuden tuottamaa yksinoikeutta on tuomittava
hyödyllisyysmallioikeuden loukkauksesta sakkoon tai enintään kuudeksi kuukaudeksi
vankeuteen.
Virallinen syyttäjä ei saa nostaa syytettä 1 momentissa mainitusta rikoksesta, ellei
asianomistaja ole ilmoittanut rikosta syytteeseen pantavaksi.
40§
Joka tahallaan tai tuottamuksesta, joka ei ole vähäinen, laiminlyö täyttää sen, mihin hän 35§:n
mukaan on velvollinen, on tuomittava hyödyllisyysmallia koskevan ilmoitusvelvollisuuden
laiminlyönnistä sakkoon.
Samaan rangaistukseen on tuomittava myös se, joka sanotussa pykälässä tarkoitetuissa
tapauksissa antaa väärän tiedon, jollei teosta ole säädetty rangaistusta rikoslaissa.
Virallinen syyttäjä ei saa nostaa syytettä tässä pykälässä tarkoitetusta rikoksesta, ellei
asianomistaja ole ilmoittanut rikosta syytteeseen pantavaksi.
41§
Jos hyödyllisyysmallin rekisteröinti on lainvoiman saaneella päätöksellä julistettu
mitättömäksi, ei 3639§:ssä säädettyä korvausta, rangaistusta tai muuta seuraamusta tuomita.
Milloin hyödyllisyysmallioikeuden loukkausta koskevassa asiassa väitetään, että rekisteröinti
on tämän lain vastainen, tuomioistuin voi vastaajan vaatimuksesta lykätä asian käsittelyn tai
ratkaisemisen siihen saakka kunnes rekisteröinnin mitättömäksi julistamista koskeva vaatimus
on lopullisesti ratkaistu. Jollei vaatimusta ole esitetty rekisteriviranomaiselle, tuomioistuimen
on jutun lykätessään asetettava vastaajalle määräaika, jonka kuluessa tällainen vaatimus on
esitettävä.
42§
Sen joka aikoo nostaa kanteen hyödyllisyysmallioikeuden siirtämisestä tai pakkoluvan
myöntämisestä, on siitä ilmoitettava rekisteriviranomaiselle sekä annettava siitä tieto
jokaiselle, jolla hyödyllisyysmallirekisterin mukaan on käyttölupa tai panttioikeus
hyödyllisyysmallioikeuteen. Jos käyttöluvan haltija aikoo nostaa kanteen
hyödyllisyysmallioikeuden loukkauksesta, hänen on annettava siitä tieto
hyödyllisyysmallioikeuden haltijalle.
Edellä 1 momentissa tarkoitettu tiedoksiantovelvollisuus katsotaan täytetyksi, kun ilmoitus on
kirjattuna lähetyksenä annettu postin kuljetettavaksi hyödyllisyysmallirekisteriin merkityllä
osoitteella.
Jos kannetta nostettaessa ei näytetä, että ilmoitus tai tiedoksianto on tapahtunut 1 momentin
säännösten mukaisesti, on kantajalle varattava sitä varten tarpeellinen aika. Jos hän laiminlyö
tämän ajan, kannetta ei oteta tutkittavaksi.
43§
Helsingin raastuvanoikeus on laillinen tuomioistuin asioissa, jotka koskevat:
1) parempaa oikeutta keksintöön, johon hyödyllisyysmallioikeutta on haettu;
2) hyödyllisyysmallioikeuden siirtämistä;
3) pakkoluvan myöntämistä, pakkoluvan ehtojen muuttamista tai 32§:n 1 momentissa
tarkoitetun oikeuden kumoamista;
4) hyödyllisyysmallioikeuden loukkausta ja hyödyllisyysmallia koskevan
ilmoitusvelvollisuuden laiminlyöntiä; tai
5) 37§:ssä tarkoitetun korvauksen määräämistä.
44§
Käsiteltäessä 43§:ssä tarkoitettuja asioita noudatetaan vastaavasti patenttilain 66 ja 67§:n
säännöksiä.
45§
Tuomioistuimen on lähetettävä rekisteriviranomaiselle jäljennös 43§:ssä tarkoitetussa asiassa
annetusta tuomiosta sekä samalla ilmoitettava, onko tuomio saanut lainvoiman.
9 luku
Erinäiset säännökset
46§
Tässä laissa tarkoitetut maksut vahvistetaan asetuksella.
47§
Tarkemmat säännökset hyödyllisyysmallihakemuksesta, hyödyllisyysmallirekisteristä ja sen
pitämisestä sekä rekisteriviranomaisesta annetaan asetuksella. Rekisteriviranomainen voi
antaa yksityiskohtaisia määräyksiä hyödyllisyysmallihakemuksesta ja sen käsittelystä.
48§
Mitä patenttilain 75§:ssä on säädetty keksintöä koskevan oikeuden
luovuttamisvelvollisuudesta eräissä tapauksissa ja siitä suoritettavasta korvauksesta,
noudatetaan vastaavasti hyödyllisyysmallioikeuteen.
10 luku
Voimaantulo ja siirtymäsäännökset
49§
Tämä laki tulee voimaan asetuksella säädettävänä päivänä.
Ennen lain voimaantuloa tehty hakemus ei ole 5§:ssä tarkoitetun etuoikeuden perustana.
Patenttihakemusta, joka on tehty tai katsotaan tehdyksi ennen tämän lain voimaantuloa, ei
voida 8§:n mukaan muuntaa hyödyllisyysmallihakemukseksi.
