The first Constitution of Southern Sudan was the 2005 Interim Constitution of Southern Sudan, as established by the Government of Sudan and the Sudan People’s Liberation Movement within the framework of the Comprehensive Peace Agreement (CPA), ending the Second Sudanese Civil War and signed into practice on 9 January 2005.
The current Constitution of South Sudan was signed by the President on Independence Day on July 9, 2011 and came into force on the same day. It is the supreme law of the country and supersedes the Interim Constitution of 2005. The constitution establishes a mixed presidential system of government headed by a President who is Head of State, Head of Government, and Commander-in-Chief of the armed forces. It also established the National Legislature comprising two Houses: a directly elected assembly, the National Legislative Assembly; and a second chamber of representatives of the States, the Council of States. The Constitution also provides for an independent judiciary, the highest organ being the Supreme Court.
This Constitution does not contain provisions concerning the protection of intellectual property rights, however, article 28 thereof guarantees the right to own property, and schedule A on National Powers, reserves Intellectual Property Rights, the National Flag, Emblem and Anthem to Federal authorities.
