Rule 1 General provisions
The present norms establish the conditions and procedure for registration of topographies of semiconductor products.
Rule 2 Definitions
For the purposes of the present norms, the terms below are defined as follows:
a) law - Law no.16/1995 on the protection of topographies of semiconductor products, as republished; b) O.S.I.M. - the State Office for Inventions and Trademarks;
c) topography - the topography of semiconductor product, within the meaning of Art. 2 letter c) of the law;
d) application printed form - the written application containing the express request for the grant of protection for a topography;
e) applicant - the person requesting the registration of a topography;
f) owner - the natural person or legal entity having the rights conferred by the registration of the topography;
g) professional representative - the industrial property attorney carrying on the activity within the meaning of the Government Ordinance no. 66/2000 on the organization and exercise of the profession of industrial property attorney, as republished).

Rule 3 Conditions Required for Registration of Topographies
(1) O.S.I.M. shall register the topographies in the National Register of Topographies, if:
a) the subject-matter of the application fulfils the provisions of Art. 2 letters b) and c) and of Art. 3 of the law;
b) the applicant is entitled to obtain protection for the topography that is the subject-matter of the application, in compliance with Art. 6, 8 and 9 of the law;
c) the regular filing of the application is constituted according to Art. 13 of the Law;
d) the topography was not previously registered with O.S.I.M.;
e) the application was filed with O.S.I.M. within 2 years from the date of the first commercial exploitation of the topography, or, as the case may be, if the topography was not exploited commercially and the application was filed with O.S.I.M. before the expiry of a 15-year period from the date of creating or coding the topography for the first time.
(2) In case of non-compliance with the provisions of paragraph (1), the topography cannot be registered and O.S.I.M. shall refuse the application
Rule 4 Subject - Matter of Application
(1) The following cannot be the subject-matter of an application:
a) designs, technological processes and means used for carrying out the topographies of
semiconductor products;
b) information stored in the semiconductor products;
c) semiconductor products carried out based on the topographies;
d) other creations that can be named topographies, but which do not correspond to the meaning defined in Art. 2 letter c) of the law.
- (2)
- The applications having as a subject-matter creations belonging to the category of those already mentioned in paragraph (1) are refused.
- (3)
- The applicant can claim the originality of the topography as a whole or only of a part thereof. In case where only a part of the topography is original, the protection conferred by the registration refers only to this claimed part, the non-original part of the topography not constituting an object of protection.
- (4)
- A topography consisting of a combination of usual elements and interconnections is original if the combination in whole is original; an original combination may also consist of usual elements and interconnections associated with original elements and interconnections.
- (5)
- An application shall be unitary, namely it shall have one single topography as a subject-matter.
- (6)
- The application having two or more topographies as a subject-matter is not unitary and the applicant has the possibility to divide it into a number of unitary applications corresponding to the number of topographies that are the subject-matter of this application.
- (7)
- In case of a non-unitary application, the subject-matter of the application is a single topography, namely the one indicated by the applicant within a two-month period from the date on which O.S.I.M. notified the lack of unity of the application; in case when the applicant does not communicate, within the said time period, the topography that shall remain the subject-matter of the application, the subject-matter thereof shall be the first of the topographies mentioned in the application.
- (8)
- The subsequently filed applications, which have as a subject-matter the other topographies of the non-unitary application, are deemed being divisional applications resulting from this application filing, if they are submitted to O.S.I.M within 3 months from the date of notifying the lack of unity and are accorded as a filing date, the date of filing the initial non-unitary application; if filed with O.S.I.M. after the expiry of the 3-month period, the applications are no longer recognized as divisional applications and are accorded as a filing date, the date of filing at the General Registry of O.S.I.M.
- (9)
- The lack of unity of an application does not constitute a reason for rejection thereof.fusal.
Rule 5
Regular filing of application
(1) The application filing is regularly constituted if the following elements are filed with
O.S.I.M. in two copies:
a) printed form of the application for registration of the topography, drawn up according to the provisions of Rule 7 and signed:
b) the technical documentation, drawn up in compliance with the provisions of Rule 8, necessary for the identification of the topography and for underlining the electronic function of the semiconductor product carried out based on the topography;
c) the semiconductor product made on the basis of the topography, if the topography was exploited commercially;
d) empowerment for the representation of the professional representative, where appropriate;
e) proof of payment of the fees for: filing the application, examination of the application, registration of the topography, publication of the topography registration and issuance of the topography registration certificate.
(2) All the documents subsequently submitted by the applicant or the professional representative thereof in connection with the application, the documents drawn up by the examiner with regard to solving the application as well as the correspondence O.S.I.M. had with the applicant or with the professional representative thereof shall be annexed to the regular filing of the application.
Rule 6
Official language
- (1)
- All the documents filed with O.S.I.M. in connection with the protection of the

- topographies as well as the correspondence held by O.S.I.M. with the applicants and the professional representatives thereof shall be drawn up in Romanian.
(2) The use of specialized technical terms in English is allowed in the technical documentation of the application filing, if these terms have already been taken over and used as such in the Romanian language by the specialists in the field. Otherwise, these terms can only be used if accompanied by equivalent terms expressed in the Romanian language.
Rule 7
Application for Registration of Topography
- (1)
- The application for the registration of a topography is submitted on a printed form, according to the model established by O.S.I.M. and rendered available to the public.
- (2)
- The application printed form shall compulsorily contain:
a) the applicant’s identification data, namely the surname and name, or where appropriate, the applicant’s denomination as well as full address of the applicant, the phone number, fax and e-mail included; if there are more applicants, the identification data will be presented separately for each of them; in case of foreign legal entities having subsidiaries or branch offices in Romania, there shall be specified the names and headquarters of these subsidiaries or branch offices;
b) declaring the creator of the topography in case this is other person than the applicant, there being mentioned the surname, name and domicile of the creator; if there are more creators, co-authors, the same mentions shall be made for each of them; in case the creators of the topography do not desire to have their name and authorship of the topography mentioned in the registration certificate and/or in the publications issued by O.S.I.M. in connection with the registered topography, the applicant will make a statement to this effect and will inscribe the creators’ names only on one copy of the application;
c) indicating the legal ground according to which the applicant is entitled to the topography protection, namely: Art. 8 of the law when the applicant is the creator of the topography; Art. 9 paragraph (1) of the law when the topography was created within the tasks deriving from an employment contract; Art. 9 paragraph (2) of the law when the topography was created based on a research/designing agreement;
d) where appropriate, indication of the fact that the applicant acquired the right to register the topography by assignment or succession;
e) denomination and destination of semiconductor product carried out on the basis of the topography; the denomination of the product will be formulated briefly, preferably within maximum 15 words;
f) applicant’s statement that the topography was not previously registered with O.S.I.M;
g) applicant’s statement concerning the originality of the topography; there will be stated precisely whether the topography is original in whole or the originality relates only to a part of the topography, in such case, there will be stated precisely the manner in which the original part is pointed out in the technical documentation annexed to the application;
h) making known the date of the first commercial exploitation in case the topography was exploited commercially;
i) making known the date of creation or of first coding of the topography;
j) the professional representative’s identification data, in case a professional representative is appointed; the identification data will be similar to the ones mentioned under letter a) for the applicant; if there are 2 or more applicants and a professional representative has not been appointed, there will be mentioned the one who will be the representative of the applicants in the proceedings before O.S.I.M., and in default of such a mention, O.S.I.M. shall consider the first one inscribed in the application as the representative of the applicants;
k) list of documents annexed to the file;
l) applicant’s signature/applicants’ signatures; when the applicant is a legal entity, the application will be signed by the leader of the institution and stamped; if a professional representative is appointed, this can sign the application on behalf of the applicant, provided that the power of attorney is submitted to O.S.I.M. at the time of filing the application or within two months, at the most, from the date of filing the same, otherwise, the application will be refused..
Rule 8
Technical documentation for Identification of Topography
- (1)
- The technical documentation for identifying the topography consists of graphical materials and an explanatory text.
- (2)
- The graphical materials will be presented in one or more of the following forms:
a) drawing or photo representing the layout of the set of layers of the semiconductor product;
b) drawings or photos of the individual layers of the semiconductor product;
c) drawings or photos of masks employed for manufacturing the semiconductor product.
- (3)
- The drawings and photos shall be clear and carried out at a sufficiently large scale to allow the identification of the topography; the A4 format or another format which, by folding, can be brought to A4 format will be used.
- (4)
- In case when only one part of the topography is original, this part will be pointed out in a distinct manner in the graphical materials.
- (5)
- In the case when the applicant declares that a part of the graphical materials for the identification of the topography contains trade secrets, said part shall be covered, by hatching or by other process, on one of the copies of these graphical materials; the second copy of said graphical materials shall not be covered, so that all required information for the identification of the topography should exist in the application filing.
- (6)
- The explanatory text shall be drawn up briefly and shall contain the presentation of the minimum information strictly required for the identification of the topography, pointing out the original part of the topography (where appropriate), pointing out the electronic function of the semiconductor product and stating precisely the destination of this circuit.
- (7)
- The semiconductor product denomination as mentioned in the application shall be inscribed on all documents for the identification of the topography.
- (8)
- Besides the materials mentioned in paragraphs (2) and (6) above, the applicant can file with O.S.I.M. data carriers on which the topography is recorded in a coded form.
Rule 9
Payment of Fees
(1) The fees owed for the registration of a topography or for the services carried out by
O.S.I.M. in compliance with the provisions in force are deemed being paid, if said sums of money have been paid, in the amount provided for by the law, into the O.S.I.M. account and if a copy of the payment document has been submitted to O.S.I.M.
(2) The amounts paid in smaller values than the legal amounts are not considered as payment of the fees; if these sums have subsequently been completed to the level of the amount provided for by the law, said fees shall be deemed to have been paid at the date when the sum corresponding to the legal amount has been completed.
Rule 10
Representation by professional representative
- (1)
- Any applicant may be represented in the proceedings before O.S.I.M. by an authorized representative, with the domicile and residence or professional headquarters in Romania.
- (2)
- A professional representative can only be an industrial property attorney attested by
O.S.I.M. for the field of protection of topographies of semiconductor products and entered in the National Register for Industrial Property Attorneys.
- (3)
- The professional representative can be appointed by the applicant upon filing the application or subsequently. If the applicant is a foreigner with the domicile abroad, the representation by professional representative is compulsory even from the filing of the application.
- (4)
- In all the cases when a professional representative was appointed, the power of attorney for the representation thereof shall be submitted to O.S.I.M.. Failure to submit the power of attorney, O.S.I.M. shall not take into account the representation by the professional representative mentioned in the application or in other documents.
Rule 11
Filing of applications
- (1)
- The applications for registration of the topographies may be filed directly to the General Registry of O.S.I.M, open to the public on work days, or can be transmitted to O.S.I.M by mail, as registered letter with acknowledging of receipt. The General Registry of O.S.I.M. writes the number and the date of filing with O.S.I.M. on each application received directly or by mail, thereafter the application is sent to the Topography Examination Bureau.
- (2)
- The applications for the registration of topographies can also be filed electronically.
Rule 12
Examination of applications
- (1)
- The applications registered in the accounts of the Topography Examination Bureau are examined in respect of fulfilling the conditions necessary for the registration of the topographies, mentioned in Rule 3.
- (2)
- If after the application examination there has been ascertained that the conditions for constituting the regular filing and the other legal conditions for the grant of protection have been fulfilled, the topography is registered in the National Register of topographies; the regular filing date is the date of submitting the application with O.S.I.M.
- (3)
- In case when drawbacks or deficiencies of the documents necessary for constituting the regular filing result from the application examination, the examiner shall notify the ascertained facts to the applicant, within 15 days from the date of submitting the application, granting the same a two-month time period for remedying such drawbacks or deficiencies; if the applicant submits to O.S.I.M. all required completions and corrections within the granted time period, the application filing is regular and the topography is registered in the National Register of Topographies; in this case, the regular filing date of the application is the date when all the required completions and corrections were received with O.S.I.M; if the required completions and corrections are not submitted to O.S.I.M. within the granted time period, the application shall be rejected.
- (4)
- The applications for which the filing and examination fees have not been paid shall be returned to the applicant, accompanied by a notification communicating the grounds for the return. O.S.I.M. shall keep a copy of the application as a witness copy.
- (5)
- Where from the application examination it results that:
- -
- the subject-matter of the application does not constitute a topography within the meaning of Art. 2 letter c) of the law, or cannot be the subject-matter of an application according to Rule 4 paragraph (1);
- -
- the applicant is not entitled to obtain protection for the topography that is the subject-matter of the application;
- -
- the topography was previously registered with O.S.I.M.;
- -
- the application was filed after the expiry of the 2-year time period from the date of the first commercial exploitation of the topography;
- -
- the topography was not exploited commercially and the application for registration was filed after the expiry of the 15-year time period from the creation or first encoding of the topography;
- -
- the examiner of the application notifies the applicant about the ascertained facts and that the legal conditions for the registration of the topography have not been fulfilled, granting the same a two-month time period for preparing the answer.
- (6)
- If, within the granted period of time, the applicant does not submit to O.S.I.M. justifications, or where appropriate, relevant documents to demonstrate that the legal conditions for the registration of the topography are fulfilled, the application is rejected.
- (7)
- Where the examination reveals that the application is not unitary, the examiner of the application shall notify the applicant about the ascertained facts, in compliance with the provisions of Rule 4 paragraph (7) concerning the manner of solving the non-unitary applications.
Rule 13
Decision to Grant Protection
- (1)
- The decision to grant protection shall be made based on an examination report and shall be justified.
- (2)
- The decision shall be made in compliance with the procedures provided for by Art. 14 and 15 of the law, Rule 12 of the present Norms and within the time limits stipulated by the law.
- (3)
- The decisions may be:
a) decision to enter the topography in the National Register for topographies;
b) the decision to reject the application for registration of the topography.
- (4)
- The decision for registration of the topography shall be communicated to the applicant together with the topography registration certificate.
- (5)
- The decision to reject the application shall be communicated to the applicant, within 15 days from the date it was made.
- (6)
- Where during the application examination the applicant communicates to O.S.I.M. the request to withdraw the application, to abandon it or any other request that means the giving up of the registration of the topography, the application examination shall cease and a report is drawn up where through O.S.I.M. takes into account the request. The report shall be communicated to the applicant, and to the professional representative, respectively, within 15 days from the date it was concluded.
Rule 14 Registration of topographies
- (1)
- The decision to register a topography is entered in the National Register of Topographies.
- (2)
- The date of registration of the topography is the date on which the regular filing of the application for registration was constituted.
- (3)
- All the data concerning the legal status of the registered topography as well as all the modifications occurring during the protection period shall be entered in the National Register.
- (4)
- The National Register of Topographies contains at least the following headings:
- -
- topography registration number ;
- -
- application filing date and number;
- -
- denomination of semiconductor product that can be carried out based on the topography;
- -
- application regular filing date;
- -
- date of first commercial exploitation of the topography - date of creation or first encoding of the topography; - owner’s identification data ;
- -
- surname, first name, locality and country of domicile of topography creator/creators;
- -
- professional representative’s identification data;
- -
- assignments;
- -
- licenses;
- -
- modifications relating to the owner;
- -
- modifications in respect of the creator/creators;
- -
- ceasing the protection.
Rule 15 Publication of Topography Registration
- (1)
- O.S.I.M. shall publish the registration of topographies in the Official Industrial Property Bulletin (B.O.P.I), “Patents Section”, Subsection “Topographies of Semiconductor Products”.
- (2)
- The publication shall be made within two months from the date of registering the topography and shall contain the following data:
- topography registration number;
-regular filing date;
- -
- denomination of semiconductor product that can be carried out based on the registered topography; - owner’s name/denomination;
- -
- surname and first name of topography creator/creators;
- -
- date of first commercial exploitation of the topography;
- -
- date of creation or of first encoding of the topography;
-protection period.
(3) O.S.I.M. shall publish in B.O.P.I. all the modifications with regard to the registered topographies, in compliance with the provisions of Art. 17 (2), Art. 30, Art. 31 (3), Art. 32 (4), Art. 33, 37 and 40 of the law.
Rule 16
Insurance of Registration Certificate
- (1)
- The registration certificate of a topography shall be drawn up based on the decision of registration of the topography.
- (2)
- The topography registration certificate, signed by the Director General of O.S.I.M. shall be issued to the owner within 3 months from the date of publishing the topography registration.
- (3)
- Upon request, duplicates of the topography registration certificate shall be issued to the authors; the application shall be accompanied by the proof of payment of the legal fees for the issuance of the certified copies.
Rule 17
Consulting the Materials Constituting the Application Filing
- (1)
- After the publication of the registration of a topography, O.S.I.M. renders the documentation contained in the application regular filing available to the public for consultation; to this end, a file containing a copy of each document in the regular filing shall be drawn up.
- (2)
- In case of topographies where the applicant declares that a certain part of the technical documentation contains trade secrets, only the documents not disclosing trade secrets shall be introduced into the file meant for the public consultation.
- (3)
- In case where, according to the applicant’s statement, the creators mentioned in the application do not want their names to be rendered available to the public, the application copy not mentioning the creators’ names shall be introduced into the file rendered available for public consultation.
- (4)
- The files of rejected or withdrawn applications are not available for public consultation.
- (5)
- Upon request by any interested person, O.S.I.M. may issue certified copies of the public documents contained in the regular filing of the registered topographies or on the sheets of the National Register of Topographies. The request shall be accompanied by the proof of payment of the legal fees for the issuance of the requested copies

Dispositions générales
Règle 1. — 1) Les topographies de circuits intégrés sont protégées sur le territoire de la Roumanie dans les conditions prévues par la loi n°16/1995 sur la protection des topographies de circuits intégrés, publiée dans le Monitorul Oficial al României, partie 1, n° 45, du 9 mars 1995, sous réserve des conventions, traités et accords auxquels la Roumanie est partie.
2) Le présent règlement établit les conditions et la procédure d’enregistrement des topographies de circuits intégrés.
Définitions
Règle 2. Aux fins du présent règlement,
— «loi» s’entend de la loi n° 16/1995 sur la protection des topographies de circuits intégrés;
— «OSIM» s’entend de l’Office d’État pour les inventions et les marques;
— «topographie» s’entend de la topographie de circuit intégré telle qu’elle est définie à l’article 2 de la loi;
— «demande» s’entend d’une demande d’enregistrement d’une topographie;
— «déposant» s’entend d’une personne qui demande l’enregistrement d’une topographie et qui est mentionnée comme telle dans la demande;
— «propriétaire» s’entend de la personne au nom de laquelle la topographie est enregistrée à l’OSIM et à laquelle appartiennent les droits conférés par l’enregistrement;
— «date officielle d’enregistrement d’une topographie» s’entend de la date officielle du dépôt régulier de la demande.
Conditions d’enregistrement des topographies
Règle 3. L’OSIM inscrit les topographies au registre national des topographies si les conditions suivantes sont remplies :
a) l’objet de la demande répond aux conditions légales de protection énoncées aux articles 2 et 3 de la loi;
b) le déposant a droit à la protection de la topographie qui fait l’objet de la demande, conformément aux articles 6, 8 et 9 de la loi;
c) la demande a été régulièrement déposée, conformément à l’article 13 de la loi;
d) la topographie n’a pas été déjà enregistrée à l’OSIM;
e) la demande a été déposée auprès de l’OSIM dans les deux ans à compter de la date de la première exploitation commerciale de la topographie ou, si la topographie n’a pas fait l’objet d’une telle exploitation, la demande a été déposée auprès de l’OSIM avant l’expiration d’un délai de 15 ans à compter de la date à laquelle la topographie a été créée ou codée pour la première fois.
Lorsqu’une ou plusieurs des conditions énoncées aux HUsous-alinéas a) à e)UH ne sont pas remplies, la topographie ne peut pas être enregistrée et l’OSIM rejette la demande.
Objet de la demande
Règle 4. — 1) Les demandes d’enregistrement ne peuvent porter que sur les topographies définies à l’article 2 de la loi.
Les éléments suivants ne peuvent pas faire l’objet d’une demande d’enregistrement :
— dessins et modèles, procédés techniques et moyens servant à la fabrication des topographies de circuits intégrés;
— information gravée dans les circuits intégrés;
— circuits intégrés pouvant être fabriqués à l’aide de ces topographies;
— autres créations appelées «topographies» mais ne correspondant pas à la définition donnée à l’article 2 de la loi.
Les demandes d’enregistrement qui portent sur des créations ressortissant à la catégorie visée à l’alinéa précédent sont rejetées.
2) Le déposant peut revendiquer l’originalité de l’ensemble ou d’une partie seulement de la topographie.
Lorsque seule une partie de la topographie est originale, la protection conférée par l’enregistrement ne porte que sur la partie revendiquée; la partie non originale n’est pas protégée.
Une topographie consistant en une combinaison d’éléments et d’interconnexions qui sont courants n’est réputée être originale que si la combinaison, prise dans son ensemble, est originale; une combinaison originale peut être constituée d’éléments et d’interconnexions courants associés à des éléments et à des interconnexions originaux.
3) La demande d’enregistrement est unitaire, c’est-à-dire qu’elle ne peut porter que sur une seule topographie.
Une demande portant sur deux topographies ou plus est réputée être non unitaire; le déposant a la faculté de la diviser en autant de demandes unitaires qu’il y a de topographies dans la demande.
En cas de demande non unitaire, une seule topographie est retenue comme objet de la demande, à savoir celle qui est désignée par le déposant dans les deux mois à compter de la date à laquelle l’OSIM l’a avisé que la demande n’était pas unitaire; lorsque le déposant ne désigne pas dans le délai prescrit la topographie qui doit être retenue comme
constituant l’objet de la demande, c’est la première des topographies mentionnées dans la demande qui est l’objet de celle-ci.
Les demandes ultérieures qui ont pour objet les autres topographies de la demande non unitaire sont considérées comme des demandes divisionnaires de la première si elles sont déposées auprès de l’OSIM dans les trois mois à compter de la date de notification du défaut d’unité et il leur est affecté une date de dépôt qui est celle de la demande non unitaire initiale. Si ces demandes sont déposées auprès de l’OSIM après l’expiration du délai de trois mois, elles ne sont plus reconnues comme des demandes divisionnaires et il leur est affecté comme date de dépôt la date de leur réception au service de l’enregistrement de l’OSIM.
Le défaut d’unité d’une demande ne peut pas constituer un motif de rejet de la demande.
Dépôt régulier de la demande
Règle 5. — 1) Une demande d’enregistrement est réputée avoir été régulièrement déposée si les documents suivants sont déposés en deux exemplaires auprès de l’OSIM :
a) demande établie conformément aux dispositions de la HUrègle 7UH et signée;
b) documentation technique nécessaire pour permettre d’identifier la topographie et faire apparaître la fonction électronique du circuit intégré qu’elle permet de fabriquer, établie conformément aux dispositions de la HUrègle 8UH;
c) circuit intégré fabriqué sur la base de la topographie, si celle-ci a fait l’objet d’une exploitation commerciale;
d) pouvoir, lorsqu’un conseil a été désigné;
e) récépissé du paiement des taxes de dépôt, d’examen de la demande, d’enregistrement de la topographie, de publication de l’enregistrement et de délivrance du certificat d’enregistrement de la topographie.
La date officielle du dépôt régulier est la date prévue au deuxième alinéa de l’article 14 ou, le cas échéant, au troisième alinéa de l’article 15 de la loi.
2) Le dépôt régulier est accompagné de tous les documents relatifs à la demande déposés ultérieurement par le déposant ou par son mandataire, des documents établis par le service d’examen pour se prononcer sur la demande ainsi que de la correspondance entre l’OSIM et le déposant ou son mandataire professionnel.
Langue officielle
Règle 6. Tous les documents concernant la protection des topographies déposés auprès de l’OSIM ainsi que la correspondance entre l’office et les déposants ou leurs mandataires professionnels sont rédigés en roumain.
L’emploi de termes techniques anglais, si ces termes ont été repris et utilisés en tant que tels en roumain par les spécialistes de la branche, est accepté pour les documents
techniques régulièrement déposés. Dans le cas contraire, ces termes ne peuvent être employés que s’ils sont accompagnés de leur équivalent roumain.
Demande d’enregistrement d’une topographie
Règle 7. — 1) La demande d’enregistrement d’une topographie doit être dactylographiée sur la formule réglementaire exigée par l’OSIM et mise à la disposition du public.
2) La demande d’enregistrement comprend obligatoirement les éléments suivants :
a) renseignements concernant l’identité du déposant :
— nom et prénom(s) et, le cas échéant, dénomination du déposant;
— adresse complète du déposant, avec numéros de téléphone, de télécopie et de télex.
En cas de pluralité de déposants, les renseignements seront indiqués pour chacun d’eux.
Pour les personnes morales étrangères ayant une agence ou une succursale en Roumanie, on précisera le nom et l’adresse de l’agence ou de la succursale;
b) identité du créateur de la topographie, s’il ne s’agit pas du déposant : nom et prénom(s) et domicile.
En cas de pluralité de créateurs ou d’auteurs, les renseignements seront donnés pour chacun d’eux.
Si les créateurs de la topographie ne souhaitent pas être désignés nommément et comme tels dans le certificat d’enregistrement ou s’ils ne souhaitent pas que ces indications soient imprimées dans les publications de l’OSIM concernant la topographie enregistrée, le déposant fait une déclaration à cet effet dans la demande et il inscrit le nom des créateurs sur un seul exemplaire de la demande;
c) indication du droit du déposant à la protection de la topographie : le déposant est le créateur de la topographie (article 8 de la loi), la topographie a été créée dans le cadre de ses fonctions (article 9, premier alinéa, de la loi) ou sur la base d’un contrat de recherche/création (article 9, deuxième alinéa, de la loi), les dispositions d’un contrat s’appliquent (article 9, troisième alinéa, de la loi), le déposant a acquis le droit d’enregistrer la topographie par voie de cession ou de succession (légale ou testamentaire);
d) nom et destination du circuit intégré qui peut être fabriqué à l’aide de la topographie. Le nom doit être court, consistant de préférence en 15 mots au maximum;
e) déclaration du déposant certifiant que la topographie n’a pas été enregistrée antérieurement auprès de l’OSIM;
f) déclaration du déposant concernant l’originalité de la topographie. La déclaration doit préciser si la topographie est originale dans son ensemble ou si l’originalité ne concerne qu’une partie de la topographie; dans ce dernier
cas, le déposant indique la manière dont la partie originale est signalée dans les documents techniques annexés à la demande;
g) indication de la date de première exploitation commerciale, si la topographie a fait l’objet d’une telle exploitation;
h) indication de la date à laquelle la topographie a été créée ou a été codée pour la première fois;
i) le cas échéant, renseignements concernant l’identité du mandataire professionnel. Ces renseignements sont analogues à ceux qui sont mentionnés au HUsous-alinéa a)UH à propos du déposant.
En cas de pluralité de déposants et si aucun mandataire n’a été désigné, les déposants précisent lequel d’entre eux les représentera dans les procédures engagées devant l’OSIM; faute de cette indication, l’OSIM considère comme mandataire le premier déposant mentionné dans la demande;
j) liste des documents annexés à la demande;
k) signature du ou des déposants. Lorsqu’il s’agit d’une personne morale, la demande est signée par le directeur de l’établissement et porte le timbre de l’établissement.
Lorsqu’un mandataire professionnel a été désigné, il peut signer la demande au nom du déposant si le pouvoir (autorisation pour le mandataire de représenter le déposant) est déposé auprès de l’OSIM en même temps que la demande ou au plus tard dans les deux mois qui suivent, faute de quoi la demande est rejetée.
Documentation technique permettant d’identifier la
topographie
Règle 8. — 1) La documentation technique permettant d’identifier la topographie comprend des éléments graphiques et un texte explicatif.
2) Les éléments graphiques sont présentés sous une ou plusieurs formes :
a) dessin ou photographie représentant la configuration de l’ensemble des couches du circuit intégré;
b) dessin ou photographie de chaque couche du circuit;
c) dessin ou photographie des masques utilisés pour la fabrication du circuit.
3) Les dessins et photographies doivent être clairs et réalisés à une échelle suffisamment grande pour permettre d’identifier la topographie.
On utilisera le format A4 ou un autre format qui, après pliage, est réduit au format A4.
4) Lorsque seule une partie de la topographie est originale, cette partie doit être signalée distinctement dans les éléments graphiques.
5) Lorsque le déposant déclare qu’une partie des éléments graphiques permettant d’identifier la topographie comprend des secrets d’affaires, cette partie est hachurée ou
masquée d’une autre façon dans un des exemplaires de la documentation graphique; le deuxième exemplaire n’est pas masqué, afin que l’on puisse trouver dans le dossier de la demande tous les renseignements nécessaires à l’identification de la topographie.
6) Le texte explicatif doit être bref et comprendre le minimum d’information nécessaire à l’identification de la topographie, le signalement de la partie originale (s’il y a lieu), le signalement de la fonction électronique du circuit intégré et l’indication de la destination du circuit.
7) Le nom du circuit intégré, tel qu’il est mentionné dans la demande, est reproduit dans tous les documents permettant d’identifier le circuit.
8) Outre les documents visés aux HUalinéas 2)UH et HU6)UH, le déposant peut remettre aussi à l’OSIM des supports d’information lorsque la topographie est enregistrée sous forme codée.
Paiement des taxes
Règle 9. — 1) Les taxes exigibles pour l’enregistrement d’une topographie ou pour des services fournis par l’OSIM en vertu des dispositions de l’article 44 de la loi sont réputées acquittées si le montant prévu par la loi a été versé sur le compte bancaire de l’OSIM et si une copie du récépissé de paiement a été déposée auprès de l’Office.
2) Les versements d’un montant inférieur au montant légal ne sont pas réputés constituer le paiement des taxes. Si, ultérieurement, ces versements sont complétés de manière à atteindre le total prévu par la loi, les taxes sont réputées avoir été payées à la date de versement du complément nécessaire.
3) Les déposants qui bénéficient d’une réduction des taxes ou d’une exonération de taxes, en vertu du deuxième, troisième ou quatrième alinéa de l’article 44 de la loi, doivent déposer auprès de l’OSIM les documents attestant que l’un des alinéas susmentionnés leur est applicable. En cas de pluralité de déposants, chacun d’eux doit prouver par des documents pertinents qu’il entre dans le champ d’application de l’alinéa qui prévoit la réduction des taxes ou l’exonération de toute taxe.
Faute de déposer les documents attestant son droit à réduction ou exonération, le déposant est tenu au versement intégral des taxes.
Représentation par un mandataire professionnel
Règle 10. — 1) Tout déposant peut être représenté dans les procédures engagées devant l’OSIM par un mandataire professionnel agréé ayant son domicile ou son établissement principal en Roumanie.
2) Seul un conseil en propriété industrielle agréé par l’OSIM en matière de protection des topographies de circuits intégrés et inscrit au registre national des conseils en propriété industrielle peut agir en qualité de mandataire professionnel.
3) Le mandataire professionnel peut être désigné par le déposant au moment du dépôt de la demande ou ultérieurement.
Lorsque le déposant est un étranger domicilié à l’étranger, la représentation par un mandataire professionnel intervient obligatoirement lors du dépôt de la demande.
4) Dans tous les cas où un mandataire professionnel a été désigné, il est indispensable de déposer auprès de l’OSIM le pouvoir qui l’autorise à agir en cette qualité. Si ce pouvoir fait défaut, l’OSIM ne prend pas en considération la représentation par le mandataire mentionné dans la demande ou dans d’autres documents.
Dépôt de la demande
Règle 11. Les demandes d’enregistrement de topographies peuvent être déposées directement au service de l’enregistrement de l’OSIM, ouvert au public les jours ouvrables, ou bien envoyées à l’OSIM sous pli recommandé avec accusé de réception.
Le service de l’enregistrement inscrit sur chaque demande déposée directement ou envoyée par voie postale le numéro d’ordre et la date de réception à l’OSIM, après quoi il transmet la demande au service d’examen des topographies.
Examen de la demande d’enregistrement
Règle 12. — 1) Le service d’examen des topographies constitue un dossier d’archives des demandes d’enregistrement de topographies qui comprend toutes les demandes accompagnées du justificatif du paiement des taxes de dépôt et d’examen.
Les demandes pour lesquelles aucune taxe de dépôt ou d’examen n’a été acquittée sont renvoyées à l’expéditeur accompagnées d’une note indiquant le motif du renvoi. L’OSIM conserve une copie de la demande à titre de preuve.
2) Les demandes versées au dossier du service d’examen des topographies sont examinées du point de vue de la conformité avec les prescriptions de la règle 3 concernant les conditions d’enregistrement.
3) Lorsque l’examen de la demande révèle que les conditions afférentes à la régularité du dépôt ainsi que les conditions légales d’octroi de la protection sont respectées, la topographie est inscrite au registre national des topographies; la date officielle de dépôt est la date à laquelle la demande a été déposée auprès de l’OSIM.
4) Lorsque l’examen de la demande révèle des omissions ou irrégularités dans les documents requis pour un dépôt régulier, l’examinateur le notifie au déposant dans les 15 jours suivant la date de dépôt, en lui donnant un délai de deux mois pour remédier à ces omissions ou irrégularités.
Lorsque le déposant remet à l’OSIM, dans le délai prescrit, tous les éléments complémentaires et rectifications requis, la demande est réputée avoir été régulièrement déposée et la topographie est inscrite au registre national des topographies; dans ce cas, la date officielle de dépôt est la date à laquelle l’OSIM a reçu tous les compléments et rectifications nécessaires.
Si, dans le délai prescrit, le déposant n’a pas déposé auprès de l’OSIM les compléments et rectifications requis, la demande est rejetée.
5) Lorsque l’examen de la demande révèle
— que l’objet de la demande ne peut pas être considéré comme une topographie au sens de l’article 2 de la loi,
— que le déposant n’a pas droit à la protection de la topographie qui fait l’objet de la demande,
— que la topographie a déjà été enregistrée auprès de l’OSIM,
— que la demande a été déposée après l’expiration d’un délai de deux ans à compter de la date de la première exploitation commerciale de la topographie,
— que la topographie n’a pas fait l’objet d’une exploitation commerciale et que la demande d’enregistrement a été déposée après l’expiration d’un délai de 15 ans à compter de la création ou du premier codage de la topographie,
l’examinateur notifie au déposant ses constatations et l’avise de l’inobservation des conditions légales d’enregistrement de la topographie, en lui donnant un délai de réponse de deux mois.
Si, dans le délai fixé, le déposant ne communique pas à l’OSIM des arguments et, le cas échéant, des documents prouvant que les conditions légales d’enregistrement de la topographie sont respectées, la demande est rejetée.
6) Si l’examen de la demande révèle que la demande n’est pas unitaire, l’examinateur notifie ses constatations au déposant, conformément aux dispositions de la HUrègle 4.3)UH relatives aux modalités de traitement des demandes non unitaires.
Décision relative à la demande
Règle 13. — 1) La décision rendue à la suite de la demande est prise sur la base d’un rapport d’examen et dûment motivée.
2) La décision est prise dans le délai prescrit aux articles 14 et 15 de la loi et conformément aux dispositions de ces articles; elle consiste
— soit à inscrire la topographie au registre national des topographies,
— soit à rejeter la demande d’enregistrement de la topographie.
3) La décision d’enregistrer la topographie est communiquée au déposant avec le certificat d’enregistrement.
4) Le rejet de la demande est communiqué au déposant dans les 15 jours qui suivent la prise de la décision.
5) Si, pendant l’examen de la demande, le déposant informe l’OSIM qu’il souhaite retirer ou abandonner la demande ou s’il présente toute autre requête constituant renonciation à l’enregistrement de la topographie, il est mis fin à l’examen de la demande et il est dressé un procès-verbal par lequel l’OSIM prend acte de la requête. Le procès- verbal est communiqué au déposant, ou à son mandataire professionnel, dans les 15 jours qui suivent son établissement.
Enregistrement de la topographie
Règle 14. — 1) La décision d’enregistrer une topographie est inscrite au registre national des topographies.
2) La date officielle d’enregistrement est la date du dépôt régulier de la demande d’enregistrement.
3) Au registre national des topographies sont consignés tous les renseignements concernant le statut juridique des topographies enregistrées ainsi que tout changement intervenant pendant la durée de la protection.
4) Le registre national des topographies comprend au minimum les colonnes suivantes :
— numéro d’enregistrement de la topographie;
— numéro et date du dépôt de la demande d’enregistrement;
— nom du circuit intégré qui peut être fabriqué à l’aide de la topographie;
— date officielle d’enregistrement;
— date de première exploitation commerciale de la topographie;
— date de création ou de premier codage de la topographie;
— renseignements sur l’identité du propriétaire;
— nom et prénom(s), adresse complète et pays de résidence du ou des créateurs de la topographie;
— renseignements sur l’identité du mandataire professionnel;
— cessions;
— licences;
— changements concernant le propriétaire;
— changements concernant le ou les créateurs;
— cessation de la protection.
Délivrance du certificat d’enregistrement
Règle 15. Le certificat d’enregistrement d’une topographie est établi sur la base de la décision prise concernant la topographie.
Le certificat d’enregistrement, signé par le directeur général de l’OSIM, est délivré au propriétaire dans les trois mois qui suivent la date officielle du dépôt régulier de la demande.
Publication de l’enregistrement de la topographie
Règle 16. — 1) L’OSIM publie l’enregistrement des topographies au bulletin officiel de la propriété industrielle (BOPI), à la rubrique «brevets d’invention», subdivision «topographies de circuits intégrés».
2) La publication est faite dans les deux mois qui suivent la date de délivrance du certificat d’enregistrement; elle comprend les éléments suivants :
— numéro d’enregistrement de la topographie;
— date officielle du dépôt régulier de la demande;
— nom du circuit intégré qui peut être fabriqué à l’aide de la topographie enregistrée;
— nom/dénomination du propriétaire;
— nom et prénom(s) du ou des créateurs de la topographie;
— date de première exploitation commerciale;
— date de création ou de premier codage de la topographie;
— durée de la protection.
3) L’OSIM publie au BOPI toutes les modifications concernant les topographies enregistrées, conformément aux dispositions du deuxième alinéa de l’article 17, du deuxième alinéa de l’article 36 et des articles 37, 38 et 42 de la loi.
Accès du public aux documents annexés à la demande
régulièrement déposée
Règle 17. — 1) Après avoir publié l’enregistrement d’une topographie, l’OSIM rend accessibles au public les documents figurant dans la demande régulièrement déposée. À cette fin, il est constitué un dossier comprenant un exemplaire de chacun de ces documents.
2) Dans le cas des topographies dont le déposant a déclaré qu’une partie de la documentation technique contient des secrets d’affaires, le dossier ouvert à la consultation publique ne comprend que les documents ne contenant pas de secrets d’affaires.
De même, si, selon la déclaration du déposant, les créateurs mentionnés comme tels dans la demande ne désirent pas que leur nom soit divulgué, le dossier ouvert à la consultation publique comprend l’exemplaire de la demande où ne figure pas le nom des créateurs.
3) Le dossier des demandes rejetées ou retirées (abandonnées) n’est pas ouvert à la consultation publique.
4) À la demande de toute partie, l’OSIM peut délivrer des copies certifiées conformes de documents non confidentiels figurant dans le dossier de dépôt régulier des
topographies enregistrées ou de pages du registre national des topographies. La demande doit être accompagnée du récépissé de paiement des taxes légales perçues pour la délivrance de copies.
