Her Majesty, in exercise of the powers conferred upon Her by section 108(2) of the Trade Marks Act 1994(1), is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:

Citation and commencement

1. This Order may be cited as the Trade Marks Act 1994 (Isle of Man) (Amendment) Order 2002 and shall come into force on 24th December 2002.

Amendment of the Trade Marks Act 1994 (Isle of Man) Order 1996

2. In the Schedule to the Trade Marks Act 1994 (Isle of Man) Order 1996(2), after paragraph 11 insert—

11A.—(1) In section 92A(1)(3), omit “(in Scotland, a sheriff or justice of the peace)” and “(in Scotland, by evidence on oath)”.

(2) in section 92A(2)— (a) omit “, in England and Wales”, and (b) for the words “section 9(2) of the Police and Criminal Evidence Act 1984 (c. 60)”

substitute “section 10(2) of the Police Powers and Procedures Act 1998 (an Act of Tynwald)”.”.

This Order modifies in its application to the Isle of Man, section 92A of the Trade Marks Act 1994 (which was inserted by section 6 of the Copyright etc. and Trade Marks (Offences and Enforcement) Act 2002).
