Procedures by which a Person Handling Registration or Post- registration Procedures shall Submit Documents to the

Patent Office

Issued pursuant to Section 12, Paragraph two

of the Law on Industrial Property Institutions and Procedures

1. The Regulation prescribes the procedures by which a person handling registration or post-registration procedures for an object of industrial property shall submit documents to the Patent Office.

2. If the document has been submitted in electronic form without a secure electronic signature or via fax, the day when the derivative was received shall be deemed as the day when the document was submitted if the person submits the original of the document to the Patent Office within one month (except for the patent application the original of which has to be submitted to the Patent Office within 14 days). If the original of the document is submitted after the set deadline, the day when the original was received shall be deemed as the day when the document was submitted.

3. If the document has been submitted in electronic form without a secure electronic signature or via fax, the person may omit the submission of the original to the Patent Office when:

3.1. the document refers to correction of linguistic, transcription or obvious mistakes in the application, another submission or translation of the document;

3.2. the document is submitted upon a request of the Patent Office for amending, clarifying or correcting the application or submission if the information does not extend and create new rights and a fee is not provided for making such amendments or corrections;

3.3. changes in the communication address are notified;

3.4. the respective information may be verified in commonly available data bases or web pages.

4. When submitting print-outs from commonly available data bases or web pages, the submitter shall indicate time and place of their retrieval. For photos and other records made with technical means, the time and place of their making, and also other information which might be of relevance for the respective procedure shall be indicated.

5. This Regulation shall come into force on 1 January 2016.
